9 What must a referral authority do? (1) The referral authority must inform the Council within the prescribed time that it— (a) consents to the plan; or (b) requires specified alterations; or (c) refuses consent. (2) If the authority requires specified alterations or refuses consent, it must give written reasons to the Council and the applicant. (3) If the authority does not reply within the prescribed time or fails to give written reasons, it consents. S. 9(4) amended by No. 47/1989 s. 7(1)(c)(i)(ii). (4) If a referral authority requires a specified alteration to a plan, the time permitted for consideration of the plan by the authority and the Council is suspended until the altered plan is submitted to the Council. (5) If a plan contains all the specified alterations required by a referral authority, the authority cannot require any further alterations or refuse to consent to the plan.
