### 101 Approval of Minister required for removal of rail infrastructure
> > (1) Despite any other provision of this Act, including [section 84(1)](#GS84@Gs1@EN) , rail infrastructure may not be removed from a corridor, or from a part of a road that extends between parts of a corridor, except with the approval of the Minister.

> > (2) The Minister may only issue an approval under [subsection (1)](#GS101@Gs1@EN) in relation to the removal of rail infrastructure if, where a permit is required under the [Land Use Planning and Approvals Act 1993](/view/html/inforce/2026-04-12/act-1993-070) in relation to the removal of the rail infrastructure, such a permit has been granted under that Act in relation to the proposed removal.
