Strata Titles Regulations 2018

The Regulations operate as subordinate, technical rules to the Strata Titles Act 1988. They embody several recurring concepts that practitioners must treat as statutory inputs to strata decision‑making and compliance.

• Prescribed documents and forms, Schedule 1: The Regulations supply mandatory templates and certification forms, including a licensed surveyor’s certificate (Form 1, regulation 6(1)), a notice for missing consent holders (Form 2, regulation 8), a certificate of amendment of articles (Form 3, regulation 9(1)) and a penalty notice (Form 4, regulation 9(2)). Those forms are prescribed “for the purposes of” specific Act provisions and therefore are the default documents that will satisfy the statutory prerequisites for deposit, amendment, notification and penalty processes (see regs 6, 8, 9).
• Unit entitlement arithmetic: Regulation 5 prescribes that the aggregate unit entitlements of all units on a strata plan must total 10 000, for the purposes of s 6(3) of the Act. That numeric standard is binding under the delegated power.
• Delegations and body corporate managers: Regulation 12 prescribes minimum disclosure and insurance: a body corporate manager must provide the strata corporation with a schedule to its professional indemnity policy that identifies the manager, insurer, nature of the policy and indemnity amounts (reg 12(1)), the PI minimum is $1.5 million per claim per 12 months (reg 12(2)), and contracts must contain specified undertakings and inspection rights (reg 12(3)). The manager must also ensure the availability of a pamphlet describing roles and member rights (reg 12(4)). These provisions operationalise the Act’s delegation regime.
• Trust accounts and agents: Division 6 (regs 17-28) is a tightly specified regime for handling trust money held by agents when performing services for strata corporations. It prescribes authorised accounts (reg 18), the content and timing of cash book and ledger entries (regs 21-22), monthly reconciliations (reg 23), prohibitions on cash payments (reg 24(1)), strict receipt forms and timing (reg 25), and annual audits with specified auditor duties and mandatory reporting to the Minister for certain discoveries (reg 26). These rules draw on mechanics used in land agency regulation (see reg 18 reference to Land Agents Act 1994 and Conveyancers Act 1994).
• Insurance minima and exceptions: Regulation 14 sets specified minima, public liability in tort at $10 000 000 (reg 14(1)) and fidelity guarantee insurance at the greater of the maximum total balance of the corporation’s bank accounts in the preceding three years or $50 000, with an exception where a corporation has no administrative or sinking funds (reg 14(2)).
• Meeting and governance content: Regulation 10 details officer functions for secretary and treasurer (reg 10(1)-(2)). Regulation 15 prescribes AGM agenda items, voting rules where managers hold specific proxies or powers of attorney, transparency and inspection steps for proxies held by managers, and conditions for remote attendance and voting by unit holders (reg 15(1)-(4)).
• Time and record retention: Regulation 30 prescribes specific retention periods, for example minute books and certain documentary materials for 30 years, and accounting records, correspondence and notices for seven years. Regulation 20 sets electronic record standards and backup frequency.
• Fees, access and GST interaction: Regulation 31 prescribes fees for supply of strata information and documentary material, varying by whether the applicant is an owner, and contains an express GST adjustment mechanism (reg 31(2)-(3)).

These concepts convert the Act’s broadly framed powers into precise operational requirements that drive day‑to‑day behaviour: how strata corporations prepare AGMs, how managers and agents structure contracts and insurance, how trust money is handled, what records must be produced and for how long, and how disputes over missing consents are to be notified (Form 2 procedure). The Regulations also allocate decision roles to the Registrar‑General, the ERD Court and Minister, and set thresholds and time limits that increase the predictability of enforcement outcomes.

The Regulations allocate obligations and entitlements across a defined set of actors. The primary affected parties, and the nature of the effect, are as follows:

• Unit holders and strata corporations: They are directly affected by multiple provisions. Unit entitlements must aggregate to 10 000 when plans are lodged (reg 5). Corporations must purchase insurance to specified minima (reg 14), prepare agenda items for AGMs that include insurance policies and Part 3A application disclosures (reg 15(1)), retain records for prescribed periods (reg 30), and may be charged fees for copies or inspections under reg 31. Unit holders also have express rights to inspect manager‑held records under reg 12(3)(b), and may request remote attendance and voting under reg 15(4). The Regulations thus impose compliance costs on strata corporations, and confer procedural and information rights on unit holders.
• Body corporate managers: They face disclosure and insurance obligations under reg 12. They must provide a schedule to their professional indemnity policy, maintain PI insurance with a minimum indemnity of $1.5 million per claim over 12 months (reg 12(1)-(2)), include prescribed contract clauses (reg 12(3)), and make a pamphlet describing managers’ roles and members’ rights available (reg 12(4)). They must also comply with the trust account rules when acting as agents under Division 6 where relevant.
• Agents who hold trust money: Agents are subject to the detailed trust accounting and audit regime in Division 6 (regs 17-28). They must keep cash books and trust ledger accounts with specified entries and timing (regs 21-22), perform monthly reconciliations (reg 23), arrange audits each financial year with auditors performing prescribed checks and reporting to the Minister in specified circumstances (reg 26), and return records and trust money promptly upon revocation of delegations (reg 13). Agents also cannot pay trust money in cash and must comply with detailed cheque marking and receipt requirements (reg 24(1)-(2), reg 25). Noncompliance carries monetary penalties specified in the Regulations (for example maximum penalty $500 in several places).
• Auditors: Auditors of agent trust accounts must carry out specified audit procedures, provide an audit statement covering detailed matters, attach the agent’s notice, verify by statutory declaration and forward the signed copy to the agent, and in some circumstances report discoveries to the Minister (reg 26). The Regulations also bar certain persons from auditing agents, for conflict reasons (reg 28).
• Registrar‑General and ERD Court: The Registrar‑General sets plan and map guidelines and may determine the prescribed distance in encroachment cases (reg 4, reg 6(2)(b)). The ERD Court, for applications to amend or cancel strata plans, is to have regard to enumerated matters including number of objecting unit holders and adverse consequences, as specified in reg 7. The Minister receives certain auditor reports under reg 26.
• Commissioner for Consumer Affairs: The Commissioner approves authorised trust accounts described in reg 18, the accounts that are prescribed for the purposes of s 36E of the Act.
• Prospective purchasers, professionals and creditors: The prescription of unit entitlement totals (reg 5) and the requirements for certified plans and surveyor certificates (reg 6(1)) affect the title and development process. The form and timeliness requirements for disclosure and information supply (reg 31) affect those seeking strata information.

Costs and benefits are concentrated differently. Strata corporations and unit holders bear ongoing insurance, recordkeeping and disclosure costs. Body corporate managers and agents face compliance costs in securing PI insurance, implementing trust accounting systems and meeting audit requirements. The decision makers named in the Regulations,Registrar‑General, ERD Court, Commissioner for Consumer Affairs and the Minister, acquire discrete responsibilities that require administrative capacity to manage approvals, guidelines, court considerations and audit reports respectively (regs 4, 7, 18, 26). Where multiple parties act together, for example a strata corporation engaging a body corporate manager who handles trust money, obligations cascade: the manager’s contract must permit inspection (reg 12(3)(b)), the agent must keep and produce records per regs 20-25, and an auditor must carry out checks per reg 26.

The Regulations translate broad statutory delegations into specific duties, timelines and rights. Below are the principal duties, the actors who must perform them, and the statutory source in the Regulations.

Duties of strata corporations and their officers

• Secretary functions, reg 10(1): prepare and distribute minutes, give statutory notices on behalf of members and management committee, answer communications, convene management committee meetings, and perform administrative tasks associated with corporate functions. These are mandatory functions assigned to the secretary role.
• Treasurer functions, reg 10(2): notify unit holders of contributions, receive, acknowledge, bank and account for money paid to the corporation, and keep accounting records and prepare financial statements.
• AGM agenda duties, reg 15(1): include specified items in the AGM agenda such as appointment of presiding officer, treasurer and secretary, insurance policies required by the Act, number and nature of Part 3A applications, contract proposals with body corporate managers (including text of resolution and availability of the contract and manager pamphlet), and proposed controls on delegates’ expenditure.
• Insurance duty, reg 14: maintain liability in tort insurance of at least $10 000 000, and fidelity guarantee insurance at the prescribed higher of a 3‑year maximum balance or $50 000, unless the corporation has no administrative or sinking funds (reg 14(1)-(2)).

Duties and rights of body corporate managers

• Disclosure duties, reg 12(1): provide the strata corporation with the schedule to the policy of professional indemnity insurance identifying the manager, insurer, nature of policy and indemnity amount.
• Insurance minimum, reg 12(2): maintain professional indemnity insurance of at least $1.5 million per claim during any 12‑month period.
• Contractual obligations, reg 12(3): contracts must verify the manager’s insurance, undertake to maintain that insurance, allow any unit holder to inspect records in the manager’s possession during ordinary business hours, and specify how inspection can be arranged.
• Pamphlet availability, reg 12(4): ensure availability of a pamphlet setting out the manager’s role and member rights, including inspection rights and rights to revoke delegations, appoint or revoke proxy appointments, be informed of payments from other traders for placing business, terminate contracts and apply to the Magistrates Court for dispute resolution.

Duties of agents handling trust money

• Withdrawal authorisation, reg 17(1): fees, costs or disbursements agreed in writing by the corporation are authorised withdrawals from trust accounts.
• Time limit for transferring earned fees, reg 17(2): transfer to a non‑trust receipts account “as soon as practicable” and in any event within 3 months; maximum penalty for breach $500.
• Use of authorised accounts, reg 18: only Commissioner‑approved accounts for Land Agents Act and Conveyancers Act purposes are prescribed for holding trust money.
• Recordkeeping and electronic record rules, reg 20: electronic records permitted, but alterations recorded within 24 hours, weekly offsite backups, prohibition on deletion without hard copy, ability to produce hard copy on request and offsite access to the programme used to maintain records.
• Cash book and ledger detail and timing, regs 21-22: specify the fields to be recorded for each receipt or payment, require records to appear together in chronological order and be entered within 2 business days of receipt or EFT confirmation.
• Reconciliation, reg 23: monthly reconciliation statements reconciling cash books and ledgers to the trust account.
• Prohibition of cash payments, reg 24(1): payments of trust money in cash are forbidden, maximum penalty $500; cheques must be marked “Trust Account” and crossed and endorsed, or a specified receipt obtained (reg 24(2)).
• Receipt form and timing, reg 25: each receipt must contain precise information, be produced in duplicate hard copy pre‑numbered and marked “Trust Account”, and be produced immediately on receipt or on EFT confirmation.

Audit and reporting duties

• Audit frequency and scope, reg 26(1)-(3): agents must have accounts audited for each financial year, auditors must perform specified checks and deliver an auditor’s statement covering enumerated matters.
• Auditor reporting to Minister, reg 26(6): if an auditor discovers improper recordkeeping, suspected dishonesty, loss or deficiency of trust money, or failure to comply with the Act or Regulations, the auditor must report to the Minister and the agent as soon as possible; limited exceptions where the auditor is satisfied internal action will adequately address the matter (reg 26(7)).
• Agent statements, reg 27: agents must certify specified particulars by statutory declaration before completion of an audit and deliver the notice to the auditor, with maximum penalties in some instances.

Rights of unit holders and members

• Inspection rights and access to records held by managers, reg 12(3)(b) and reg 15(3)(c): unit holders have a statutory entitlement to inspect manager‑held records and managers must make proxies available for inspection at meetings.
• Remote attendance and voting, reg 15(4): unit holders may attend and vote by remote communication if the corporation’s articles permit or if a written request to the secretary is made and the secretary makes arrangements to receive and record attendance and votes.
• Information access fees, reg 31: owners may apply for information with reduced or nil fees in certain categories, for example no fee for an owner applying for information in s 41(1)(a), no fee for inspection requests under s 41(1)(c) by owners, and reduced copy fees for owners (reg 31(2)).

Procedural duties for deposit and amendment of plans

• Surveyor’s certificate, reg 6(1) prescribes Schedule 1 Form 1 as the certificate required under s 12(3)(c)(ii) of the Act.
• Prescribed notice where a person’s whereabouts are unknown, reg 8 prescribes Form 2 under s 17A(2)(a) of the Act, and sets the 28‑day period for objections as stated in the form.

Many of these duties are time‑sensitive, numeric and documentary in nature, thereby shaping contracting, staffing and recordkeeping decisions by strata corporations, managers and agents. The Regulations also embed audit and reporting obligations that transfer certain information to the Minister and specified courts, thereby creating administrative oversight channels.

Enforcement under the Regulations operates primarily through specified maximum penalties for certain contraventions, criminal or regulatory reporting duties placed on auditors, and procedural mechanisms that make compliance verifiable.

Monetary penalties and specific offences

• Several Regulations specify a maximum penalty of $500 for particular contraventions. Notable examples include:
  • Reg 17(2) requires an agent who becomes entitled to money held in a trust account to transfer the money to a non‑trust receipts account within three months, with a maximum penalty of $500.
  • Reg 24(1) forbids payment of trust money in cash, with a maximum penalty of $500.
  • Reg 26(6) provides that auditors must report certain findings to the Minister and the agent, and the provision is followed by “Maximum penalty: $500”, which signals a penalty for failing to report where required.
  • Reg 27 and reg 28 contain maximum penalties of $500 for non‑compliance with agent notice and auditor eligibility rules.
• These monetary maxima are relatively modest. The Regulations rely on the Act for broader enforcement tools, including the strata corporation’s ability to recover unpaid penalties as debts under s 27 of the Act, as referenced in Schedule 1 Form 4.

Auditor reporting and ministerial oversight

• Reg 26 imposes a positive duty on auditors to report discoveries that indicate non‑compliance, dishonesty or loss/deficiency of trust money. The auditor must give a report to the Minister and the agent as soon as possible, unless the auditor is satisfied internal action will adequately address the matter and there is no dishonesty or breach of law (reg 26(6)-(7)).
• The auditor must also attach the agent’s notice to the auditor’s statement and verify the statement by statutory declaration, then provide a signed copy to the agent (reg 26(4)-(5)). Those procedural steps increase traceability and create documentary evidence for subsequent enforcement.

Revocation and return requirements

• Reg 13 prescribes consequences where delegations are revoked, including mandatory return or availability for collection of records within 10 business days (reg 13(1)), and return of trust money by EFT, cheque by registered post, or availability for collection within 7 business days (reg 13(2)). Failure to comply is an offence under the Act and is supported by these prescriptive timelines in the Regulations.
• Reg 13(3) caps a fee that can be charged in relation to withheld records at $1.40 per page, for the purposes of s 27D(7)(b) of the Act.

Court and administrative decision‑making

• The ERD Court is given a structured list of matters it must have regard to when determining applications to amend or cancel a strata plan (reg 7). Those enumerated factors direct the Court to weigh the number of objecting unit holders and adverse consequences to unit holders among other considerations, thereby shaping the Court’s exercise of discretion.
• The Commissioner for Consumer Affairs approves authorised trust accounts (reg 18), creating a non‑judicial gatekeeper for where trust money may be held.

Contractual and civil enforcement

• Several Regulations create documentary proof that supports civil enforcement: the prescribed forms for certified resolutions and penalty notices (Schedule 1 Forms 3 and 4) provide mechanisms for strata corporations to impose penalties and certify changes to articles, with recourse to the Magistrates Court under the Act as noted in Schedule 1 Form 4.

Enforcement architecture and practical effect

• The Regulations combine administrative oversight, audit reporting duties and low maximum pecuniary penalties for specified technical breaches. The practical enforcement levers are therefore a mix of: (1) audit reporting to the Minister, which may trigger further administrative or criminal investigation; (2) strata corporations exercising recovery measures under the Act for unpaid penalties; and (3) the ERD Court and Magistrates Court as forums for disputes about plan amendments or penalty revocations (reg 7, Schedule 1 Form 4).
• The low monetary maxima in the Regulations for technical breaches suggests they mainly aim to standardise recordkeeping and procedural compliance and to provide early warning signals to regulators rather than to impose large fines directly under these specific regulatory provisions.

The Regulations explicitly cross‑reference multiple statutes and administrative roles, integrating strata practice with wider administrative, corporate, tax and land title frameworks. The main interactions in the Regulations are as follows, with direct provision citations.

Strata Titles Act 1988

• The Regulations function under and for specific purposes of the Act. Nearly every rule is framed “for the purposes of” a particular Act subsection, for example reg 5 for s 6(3), reg 6 for s 12(3)(c)(ii), reg 12 for s 27B, regs 17-27 for ss 36D-36H, and reg 31 for s 41. That interdependency means compliance with the Regulations is a necessary piece of compliance with the Act itself.

Survey Act 1992

• Regulation 6(1) requires the certificate of a licensed surveyor, and Schedule 1 Form 1 expressly states the surveyor is “a licensed surveyor under the Survey Act 1992”, tying strata plan certification to the Survey Act’s licensing regime.

Land Agents Act 1994 and Conveyancers Act 1994

• Regulation 18 prescribes that accounts approved by the Commissioner for Consumer Affairs in relation to the holding of trust money under the Land Agents Act 1994 and the Conveyancers Act 1994 are authorised trust accounts for strata purposes. This imports bank account approvals from two separate pieces of legislation into the strata trust account regime, creating a cross‑sectoral standard for where trust money may be held.

GST and Commonwealth A New Tax System (Goods and Services Tax) Act 1999

• Regulation 31(5)-(6) define GST and GST law, and reg 31(3) provides a mechanism to increase prescribed fees to account for GST payable on supplies made in response to information requests. This links strata corporations’ fee structures for information supply to Commonwealth GST rules, and requires fee setters to consider tax treatment.

Administrative bodies and courts

• Registrar‑General: reg 4 authorises the Registrar‑General to issue guidelines for plans and maps lodged under the Act and reg 6(2)(b) permits the Registrar‑General to determine an encroachment distance in a particular case.
• Commissioner for Consumer Affairs: reg 18 requires Commissioner approval for authorised trust accounts.
• ERD Court: reg 7 sets factors that the ERD Court must consider in applications to amend or cancel strata plans.
• Minister: reg 26 requires auditors to report certain discoveries to the Minister, introducing a direct reporting channel for audit concerns.

Relationship with professional regulation

• The Regulations require professional indemnity insurance minima for body corporate managers (reg 12(2)), thus intersecting with insurance contract law and insurance market capacity. They also impose audit eligibility restrictions (reg 28), intersecting with auditor independence and professional practice obligations.

Civil procedure and debt recovery

• Schedule 1 Form 4 references s 27 of the Act for recovery of penalties as contributions, and informs recipients of their right to apply to the Magistrates Court for revocation of penalty notices. That form therefore embeds civil recovery mechanisms into the penalties process.

Records and evidence

• The Regulations’ electronic records rules (reg 20) and receipt and cheque marking requirements (regs 24-25) feed into evidentiary standards for disputes and audits, and may shape admissibility or probative value of records in court and administrative proceedings.

Taken together, the Regulations create a multi‑legislation compliance environment. Practitioners must therefore coordinate compliance across the Act, the Survey Act, Land Agents and Conveyancers Acts, GST law and the insurer and auditor regulatory regimes. The Registrar‑General, Commissioner and Minister become focal administrative actors whose decisions and approvals condition strata administrative practice (regs 4, 18, 26).

The Regulations are the 2018 principal instrument that revokes the prior Strata Titles Regulations 2003. The legislative history included in the instrument is minimal but definitive on key dates.

• Principal instrument and commencement: The Strata Titles Regulations 2018 (No 193) were published in Gazette 2.8.2018 p 2994 and the regulations commence on 1 September 2018, as per regulation 2 and the legislative history notes.
• Revocation of prior regulations: Schedule 2 expressly revokes the Strata Titles Regulations 2003. The 2018 Regulations are therefore the successor regime and replace the 2003 rules in their entirety.
• No further amending instruments or later schedules are contained in the text provided. The Regulations refer to guidelines that the Registrar‑General may issue “from time to time” for plans and maps (reg 4), which implies ongoing administrative updates by the Registrar‑General rather than formal regulation amendments.

There is no express amendment timetable or sunset clause in the Regulations. The substantive numeric, timing and documentary provisions set by the 2018 Regulations, such as the 10 000 aggregate unit entitlement (reg 5), PI minimum for managers of $1.5 million (reg 12(2)), insurance minima (reg 14), and record retention periods (reg 30),are now the prescriptive standards unless amended by later subordinate instruments or by primary legislation. For a full picture of subsequent amendments, one must consult the consolidated statutes database or later Gazettes; the instrument itself contains only the initial legislative history indicating the principal regulation’s date and commencement.

For practitioners, two immediate consequences flow from the amendment history: (1) transitional practices or forms that had been in place under the 2003 Regulations should be reviewed against the 2018 text, and (2) any policies, insurance certificates, manager contracts and recordkeeping systems should be checked for compliance with the new minima and timing rules effective 1 September 2018 (e.g. reg 12(2) and regs 20-27).

The text of the Regulations contains no case law or judicial interpretations. The instrument names the ERD Court (Environmental, Resources and Development Court) as the decision‑maker for plan amendment and cancellation applications and prescribes the factors that Court must have regard to (reg 7). It also references the Magistrates Court in relation to applications to revoke penalty notices served under s 19(3b)(e) of the Act, as reproduced in Schedule 1 Form 4.

Absent from the Regulations are reported judgments, statutory construction disputes, or administrative law challenges arising from this instrument. The Regulations do not themselves list any litigation, nor do they cite cases, precedent or interpretive guidance. Consequently:

• There is no litigation history embedded in the Regulations to guide interpretation of the new requirements. Practitioners must therefore rely on (1) the text of the Regulations, (2) the underlying provisions of the Strata Titles Act 1988, and (3) any subsequent case law, not included here, to interpret ambiguous or contested points.
• Two potential dispute forums are referenced in the Regulations: the ERD Court for plan amendment/cancellation matters, with mandatory consideration points in reg 7, and the Magistrates Court for revocation of penalty notices under the Act as described in Schedule 1 Form 4. That identifies the likely litigation pathways for disputes that will arise under the Regulations, but the Regulations themselves do not provide statutory case examples or precedents.
• Where auditors are required to report to the Minister (reg 26(6)), subsequent administrative actions or prosecutions might follow an auditor report, but no examples are in the text.

In practice, because the Regulations set out prescriptive, technical obligations, such as record bookkeeping, trust account procedures, statutory forms, and insurance minima, litigation is most likely to develop around disputed compliance, auditors’ duty to report, and ERD Court treatment of plan amendment cases where reg 7’s enumerated factors will be applied. For authoritative litigation guidance, practitioners should search subsequent court databases for ERD Court and Magistrates Court decisions referencing these Regulations after 1 September 2018.

The Regulations contain specific, technical traps for practitioners and strata participants. Below are practical “gotchas” grounded in the text, with references to the controlling regulations.

Unit entitlement arithmetic and plan certification

• Aggregate unit entitlements must total 10 000 (reg 5). Failure to meet this precise aggregate will render deposited plans non‑conforming for s 6(3) purposes. Practitioners who adjust unit entitlements for new developments must ensure re‑scaling to the 10 000 base, or seek Registrar‑General guidance where atypical allocations are needed.
• The prescribed surveyor’s certificate (Schedule 1 Form 1, reg 6(1)) must be used for the certificate required by s 12(3)(c)(ii). Using a non‑prescribed certificate risks non‑compliance at lodgment.

Encroachment and encroachment distance

• For plan amendment purposes, the Regulations declare that part of a structure that sits on footings protruding beyond the boundaries is an “associated structure of a prescribed nature” and set a prescribed distance of 0.20 metres, unless the Registrar‑General determines otherwise in a particular case (reg 6(2)). Practitioners must note that a 0.20 metre default may be small enough to fall within tolerances, but cannot be assumed to be unlimited; the Registrar‑General can flex it in a particular case, which creates administrative unpredictability.

Timeframes for record transfer on delegation revocation

• When delegations are revoked, electronic records must be returned within 10 business days by emailing to an address provided by the corporation or by sending a USB or other electronic form by registered post, or made available for collection (reg 13(1)(a)(i)-(ii)-(b)). Trust money must be returned by EFT, cheque by registered post, or made available for collection within seven business days (reg 13(2)). Agents and corporations must coordinate these timelines precisely to avoid contraventions and ensure continuity of records and funds.

Manager PI insurance and contractual disclosure

• Body corporate managers must maintain PI insurance cover of at least $1.5 million per claim during any 12‑month period (reg 12(2)), and must provide a schedule to the policy (reg 12(1)). Contracts must contain a specific statement verifying insurance and an undertaking to allow unit holder inspection of manager‑held records (reg 12(3)). Failure to include these specifics in manager contracts or to produce the schedule can invalidate the delegation compliance requirements.

Audit reporting obligations and auditor independence

• Auditors must report to the Minister if they discover non‑compliance, suspected dishonesty, loss of trust money or a failure to pay or account for trust money (reg 26(6)). While the Regulations allow the auditor discretion not to report where the matter can be dealt with internally and does not involve a breach of the law (reg 26(7)), that discretion is subjective and requires careful professional judgment. Auditors who do not report, and are later found to have been wrong to exercise the exception, could be exposed to professional sanctions or dispute.
• Auditors are barred from auditing an agent if they have been an employee or partner of the agent within two years, are employees of another agent actually carrying on business as an agent, or are themselves agents (reg 28). This may limit auditor choice in local markets and create scheduling or cost issues for small agents.

Strict timing and format rules for trust accounting

• Entries for receipts and payments must be made within two business days following the receipt, or in an EFT case, the EFT confirmation (regs 21(2)(b), 22(4)(b)). Practically, agents must reconcile their banking and ERP systems to ensure EFT confirmations are captured and recorded promptly. Failures can quickly cascade into reconciliation mismatches required to be checked on two audit dates per reg 26(2)(d).
• Electronic records rules require that each alteration be recorded within 24 hours and weekly offsite backups be made (reg 20(2)(a)-(b)), with the program used to keep the records accessible offsite (reg 20(2)(e)). Deleting electronic records is prohibited unless a hard copy is taken first (reg 20(2)(c)). These rules place operational constraints on IT systems and backups that agents must implement.

Receipts and cheque protocols

• Receipts must be produced in duplicate hard copy and marked “Trust Account”, and must be pre‑numbered in chronological order (reg 25(b)-(d)). EFT receipts must be generated immediately on EFT confirmation rather than on the date of making the receipt (reg 25(a)(i), reg 25(e)(i)). Agents accustomed to digital or consolidated receipts must adapt to these hard‑copy and sequencing requirements.
• Cheques must be marked with the agent’s name and “Trust Account” and be crossed and endorsed “Not negotiable” or accompanied by a detailed receipt (reg 24(2)). Structuring transactions without complying may void protections against misapplication of trust money and complicate audits.

Fee caps and recovery mechanics

• Reg 13(3) caps fees at $1.40 per page for certain record requests after revocation of delegations. Corporations and agents must apply this cap when charging for record copies. Failure to do so can give rise to disputes and recovery actions noted in Schedule 1 Form 4.
• Reg 31 prescribes different fee rates for owners and non‑owners seeking information, and requires the corporation to account for GST when applicable (reg 31(2)-(3)). Misapplying owner vs non‑owner status or neglecting GST adjustments risks overcharging or undercharging requesters.

Insurance and fidelity guarantee calculations

• Fidelity guarantee insurance must be at least the greater of the maximum total balance of the corporation’s bank accounts at any time in the preceding three years or $50 000 (reg 14(2)(a)(i)-(ii)). Corporations must calculate historical maximum balances over three years, which may be administratively burdensome, and must ensure policies cover that calculated amount. Corporations with no administrative or sinking funds are exempt (reg 14(2)(b)), but if funds are later established, insurance may become required.

Presiding officer voting and manager proxies

• If a manager or employee holds specific proxies or powers of attorney to vote on whether the manager should preside, reg 15(2) entitles the manager to vote as proxy, but reg 15(3) requires the manager to inform the meeting at the outset of proxies held and that the manager may only preside if a majority present and entitled to vote agree to it. These procedural notice requirements can be a source of dispute where managers seek to preside based on proxy holdings without following the required meeting procedure.

These “gotchas” emphasise that compliance is technical and procedural. Small lapses, late ledger entries by a day, imperfectly marked cheques, or a manager contract missing the prescribed wording, can create audit findings, reporting obligations to the Minister, or operational friction when delegations are revoked.

Compliance under the Regulations requires operational steps, governance checkpoints and document controls. Below is a practical checklist divided by actor, with timing and documentary references to the Regulations.

For strata corporations and committees

• AGM agenda and disclosures: Ensure AGMs include the items prescribed by reg 15(1). Prepare and distribute agendas that list appointment of presiding officer, treasurer and secretary, insurance policies required by the Act, number and nature of Part 3A applications, any proposed contract with a body corporate manager including the text of the resolution and how to inspect the contract and pamphlet, and proposed controls on delegates’ expenditure.
• Insurance procurement: Maintain liability in tort insurance of at least $10 000 000 (reg 14(1)). Calculate the maximum total balance of the corporation’s bank accounts over the preceding 3 years and procure fidelity guarantee insurance for that amount or at least $50 000, unless the corporation has no funds (reg 14(2)). Document insurer names and policy particulars for AGM disclosure and recordkeeping.
• Record retention and register maintenance: Maintain minute books and specified documentary material for 30 years, and accounting records, statements of account, notices, correspondence and meeting notices for seven years (reg 30). Ensure a register of unit holders and information used to compile it is kept for at least seven years (reg 29).
• Manager appointment and contract controls: If appointing a body corporate manager, require the manager’s contract to include the prescribed insurance verification and undertaking, provision for unit holder inspection of manager‑held records and details of how inspection is arranged (reg 12(3)(a)-(b)). Before entering or renewing manager contracts, make the contract and the pamphlet available for inspection per reg 15(1)(e).

For body corporate managers

• PI insurance and schedule: Procure and maintain professional indemnity insurance of at least $1.5 million per claim over each 12‑month period (reg 12(2)). Prepare and deliver a schedule to the PI policy that identifies the manager, the insurer, the nature of the policy and the indemnity amount and provide that schedule to the strata corporation (reg 12(1)).
• Pamphlet and disclosure: Ensure a pamphlet describing the manager’s role and members’ rights is available (reg 12(4)), and include required undertakings in contracts to allow inspection by unit holders (reg 12(3)(b)). Maintain processes to respond to requests for records access during ordinary business hours, per the contract undertaking.
• Delegation and revocation readiness: On revocation of delegations, have procedures to return electronic records as required within 10 business days by emailing to a corporation‑provided email address or by sending the records on a USB by registered post, or otherwise make them available for collection (reg 13(1)). For trust money, be ready to effect return by EFT or cheque by registered post within seven business days (reg 13(2)).

For agents handling trust money

• Account authorisation and segregation: Use only authorised trust accounts approved by the Commissioner for Consumer Affairs as prescribed by reg 18.
• Cash book and ledger procedures: Implement cash books and separate trust ledger accounts for each client and each transaction as required by reg 21 and reg 22. Ensure each receipt or payment entry records date, evidence (EFT confirmation or cheque reference), amount, parties, strata corporation reference and purpose, and make entries within 2 business days or on EFT confirmation (regs 21(1)-(2), 22(2)(b), 22(4)).
• Electronic record controls: If records are electronic, record every alteration electronically within 24 hours, create weekly offsite backups, do not delete records unless hard copies are made, and ensure an up‑to‑date copy of the program used is accessible from different premises (reg 20(2)).
• Reconciliation and monthly statements: Prepare monthly reconciliation statements reconciling cash book balances and ledger balances to the trust account, and retain the reconciliation records (reg 23).
• Payments and receipts: Do not make trust money payments in cash (reg 24(1)). If paying by cheque, mark cheques with the agent’s name and “Trust Account” and cross and endorse them “Not negotiable”, or obtain the detailed receipt specified in reg 24(2)(b)(ii). Produce receipts in duplicate hard copy, pre‑numbered and marked “Trust Account”, immediately on receipt or on EFT confirmation (reg 25).
• Transfer of earned fees: Where an agent becomes entitled to money in an agent’s trust account for fees, transfer the money to a non‑trust receipts account as soon as practicable and in any event within 3 months (reg 17(2)).
• Audit readiness: Arrange an annual audit for each financial year, ensure the auditor can perform the checks specified by reg 26(2)-(3), and provide the agent’s statutory notice to the auditor as required by reg 27. Prepare to address auditor queries and to have audit statements and declarations delivered within two months after the end of each audit period (reg 26(8)).

For auditors

• Independence and scope: Confirm independence and eligibility per reg 28,do not accept audits of agents where disqualifying relationships exist, such as having been an employee or partner within two years. Perform the prescribed checks including selecting two dates for balance comparisons and making a general test examination of accounts and passbooks (reg 26(2)(c)-(d)).
• Reporting obligations: If during the audit you discover improper recordkeeping, suspected dishonesty or deficiencies in trust money, report promptly to the Minister and the agent (reg 26(6)). Attach the agent’s notice to the audited statement, verify by statutory declaration and provide a signed copy to the agent (reg 26(4)-(5)).

For all parties implementing IT systems

• EFT confirmation capture: Configure bank and accounting interfaces to capture EFT confirmations as evidence for entries and timing under regs 21-22 and for receipts under reg 25(e)(i).
• Backup and access practises: Implement weekly offsite backups, retention of hard copies where deletion is necessary, and offsite access to the programs used to maintain electronic records as required by reg 20(2).

For those supplying and charging for information

• Fees and GST: Apply the fee schedule in reg 31(2) depending on whether the applicant is a unit owner or not, and increase fees where GST is payable so that, after deduction of GST, the net fee equals the prescribed amount (reg 31(3)). Consider waiving or reducing fees under reg 31(4) where appropriate.

Operationalising these steps requires documented procedures, staff training, contract review and, where necessary, upgrades to accounting and file management systems. The Regulations’ precise timing and documentation requirements mean that compliance is largely an operational exercise, and the key implementation risks are ill‑matched IT systems, lack of backup processes, outdated manager contracts or insufficient insurance cover. Implementing a compliance calendar tied to monthly reconciliations and annual audits will materially reduce the risk of contravention.
