#### 55A Decennial insurance criteria 55A Decennial insurance criteria > > (1) For the Act, section 211AA(2)(a), decennial insurance for a building must— > > > > > (a) not permit cancellation, whether by the developer or another party to the policy, > > > > > (b) be issued before an application is made for an occupation certificate under the [Environmental Planning and Assessment Act 1979](/view/html/inforce/current/act-1979-203) for any part of the building. > > > (2) To avoid doubt, insurance complies with subclause (1)(b) if the insurance is issued before the application for the occupation certificate subject to a condition that the insurance does not take effect until the occupation certificate is issued. > > **s 55A:** Ins 2023 No 44, Sch 3.2\[2\].
