What it does
This Act, styled the Statute Law (Miscellaneous Provisions) Act 2024, is a short miscellaneous instrument that (1) fixes commencement, (2) excludes explanatory notes from the operative text, (3) records that Schedules 1 and 2 are repealed, and (4) provides a Schedule (Schedule 3) of general savings, transitional and other provisions that govern the legal consequences of the amendments effected by the Act. The Act commences on the date of assent (s 2). The Act expressly states that the material under the heading “Explanatory note” in the schedules does not form part of the Act (s 3). Schedules 1 and 2 are recorded as repealed (the text shows “Schedules 1, 2 (Repealed)” and a marginal note indicating they were repealed by 1987 No 15, s 30C), so they contain no operative amendments in this instrument.
Schedule 3 contains five clauses that govern how amendments effected by this Act interact with existing amending provisions, earlier acts or decisions made under provisions that are being amended or repealed, instruments made under amended Acts, the revocation of repeals, and the making of regulations consequential on this Act. Key mechanical effects in Schedule 3 are:
-
s 1: Where this Act (via Schedule 1 or 2) amends an amending provision in an Act or instrument, and that amending provision had already commenced before the Schedule 1/2 amendment, the Schedule amendment is taken to have effect from the commencement of the amending provision, whether or not the amending provision has since been repealed. Section 1(2) defines “amending provision” for the purposes of the section by reference to three modes of direct amendment (repeal/omission without insertion; omission and insertion; insertion into the amended Act/instrument).
-
s 2: Unless expressly provided otherwise, an act done or decision made under a provision that is amended or repealed by this Act continues to have effect after the amendment/repeal as if it had been done or made under the provision as amended or repealed.
