Statistics Regulations

The Regulations organise a small set of recurring legal and administrative concepts that operationalise the Statistician’s data collection functions. The core concepts are prescribed matters for collection, prescribed persons, prescribed forms, Statistical Agents, periodic returns, Ministerial approval of certain activities, and the scope of available publications. Each concept appears repeatedly and interacts with the others.

Prescribed matters for collection. Reg 1(1) lists topics the Statistician shall collect annually, in addition to matters already in section 8 of the Act. The list is framed as mandatory on the Statistician “subject to these regulations”, which situates responsibility at the Statistician’s office while recognising delegated procedural detail in other provisions. The list is specific but not exhaustive beyond what is stated: omnibus services, non‑rail goods transport, wholesale/retail prices and rents, commercial air services, co‑operatives, electricity generating stations (explicitly including mine/quarry generation whether sold publicly or used internally), and building operations (Reg 1(1)(a)-(g)).

Prescribed person. The term “prescribed person” is central because section 9 of the Act (cross‑referred in multiple Regulations) makes it the trigger for statutory obligations. Reg 1(3) and Reg 2(2) expand the class of prescribed persons by fiat: owners and their servants/agents who make returns become prescribed persons for section 9 purposes. Reg 3 gives the Statistician ongoing power to determine and publish who is a prescribed person for particular particulars, requiring Gazette notification (Reg 3(1)-(3)). This mechanism is a flexible administrative designation process that converts statutorily defined classes into specifically notified obligations.

Prescribed forms and instructions. Reg 6 states that forms prepared and issued by the Statistician under section 7 of the Act are prescribed forms and that instructions that accompany a form are deemed part of that form until changed. The effect is to bind respondents not only to data fields but to procedural and definitional instructions the Statistician supplies, and to make those instructions legally significant by regulation.

Statistical Agents; J‑forms for intrastate interstate traffic. Reg 5 designates named port and transport officers (Harbour Trust secretary, Albany and Bunbury Harbour Board secretaries, Goods Agents and Stationmasters of Commonwealth and State railways and Midland Railway Co., Boundary Stock Inspector, Wharfingers) as Statistical Agents for collection of import and export returns. Reg 5(2)-(3) then prescribes who must fill in which of Forms J.1-J.4 when exporting or importing goods between Western Australia and other Australian States or mainland territories. The Regulations define “goods” to include livestock, and “port” to include airport, railway station, post office, warehouse, depot or place at or from which goods are received or despatched (Reg 5(1)(b)). The Schedule contains the J‑forms (images in the source), which are legally significant because of Reg 6.

Periodicity and timing. Reg 2 imposes a strict quarterly timeline for banks: returns are to be furnished within 14 days after quarter ends (or as soon as practicable thereafter). Reg 5(4) allows the Statistician to authorise periodic batching of returns for persons handling many goods, with an appointed day for each period; the authorised person must furnish a return even if “Nil” (Reg 5(4)(a)-(c)). The Statistician can revoke a periodic authority at any time (Reg 5(4)(d)).

Publication and Ministerial approval. Reg 7 authorises compilation and publication of lists of names and addresses for specified categories, but only “subject to section 18 of the Act” and with the Minister’s approval. Reg 8 makes clear that certain inquiries require the Minister’s written approval to be “prescribed or allowed” under section 11 of the Act. That introduces a ministerial gatekeeping step for two kinds of activities: (i) authorised public dissemination of name/address lists and (ii) intrusive or special inquiries.

Interplay with existing statutes and administrative structures. The Regulations explicitly incorporate classes defined in other statutes (Traffic Act 1919-1935; State Transport Co‑ordination Act 1933) when identifying who must report. They also rely on Gazette notifications for operationalising designations (Reg 3(2)-(3), Reg 5(4)(d) on revocation and Reg 7(2) treated compiled lists prior to the regulation coming into force as valid).

In short, the Regulations translate statutory powers into operational levers: who must provide, when, what form, where to deliver, who may collect, and when Ministerial approval is required for publication or special inquiries. For compliance and risk assessment, those levers determine who pays the compliance cost, who can compile and publish potentially commercially useful lists, and where administrative discretion resides (primarily with the Statistician plus ministerial approvals).

The Regulations identify multiple, specific classes of regulated entities, and they widen the pool of responsible persons by explicitly including servants and agents whom an owner instructs or authorises to make returns. The text creates duties for particular commercial actors and administrative delegates; those affected include:

• Owners and operators connected to road passenger and goods transport. Reg 1(2) makes the owner of every omnibus (as defined under the Traffic Act 1919-1935) and the owner of every goods transport vehicle licensed or required to be licensed under the State Transport Co‑ordination Act 1933 subject to the Statistician’s requirement to fill forms when so required. The owner’s servants and agents who make returns are also treated as prescribed persons (Reg 1(3)).

• Wholesale and retail businesses, auction markets, lodging landlords. Owners of wholesale or retail establishments, controllers or responsible representatives of auction markets, and owners of rented dwellings are required to provide particulars specified in forms the Statistician issues, on notice (Reg 1(2)). Those owners’ agents who submit returns are designated prescribed persons (Reg 1(3)).

• Commercial air services and co‑operatives. Owners of any commercial air service and the managing body or manager of every co‑operative company or society are required to provide particulars as prescribed when the Statistician requires them (Reg 1(2)(d)-(e)).

• Electricity generating stations and associated owners/managers/agents. Reg 1(1)(f) and Reg 1(2) explicitly extend the collection regime to electricity generating stations, plants, or works of any kind or nature, including those used in or in connection with quarries or mines where minerals are mined, and whether generation is sold to the public or used solely internally. The owner, manager, or agent of such installations must provide particulars in the prescribed forms.

• Persons engaged in building operations. Individuals who engage, or appear on reasonable grounds to engage in building operations other than as employees are required to supply particulars (Reg 1(2)). That catches contractors and potentially subcontractors who operate outside employment relationships.

• Banks and banking managers. Reg 2(1) imposes a specific quarterly reporting duty on the manager or person in charge of any bank or banking business in Western Australia; they must provide particulars within 14 days after each quarter end. Servants or agents authorised to make returns are prescribed persons (Reg 2(2)).

• Transport and port officers as Statistical Agents. Reg 5(1)(a) lists named positions as Statistical Agents for the collection of import and export returns: the Secretary to the Fremantle Harbour Trust; Secretaries to Albany and Bunbury Harbour Boards; Goods Agents and Stationmasters of Commonwealth Railways in Western Australia, the Western Australian Government Railways and Midland Railway Co. of W.A. Ltd; the Boundary Stock Inspector of the State Department of Agriculture; Wharfingers of Ports under State Harbour and Light Department control; and any subsequent appointees by the Governor in Council. Those officers receive returns under Reg 5(2)-(3).

• Consignors, consignees, carriers and delivery takers in interstate goods movements. Reg 5(2)-(3) and the Schedule (Forms J.1-J.4) specify who must complete export/import returns at ports when goods move between Western Australia and other States or mainland territories of Australia. The regulations make detailed distinctions between a person who despatches goods, a person who accepts goods for despatch, the consignor listed on a return, and the person accepting delivery at arrival. Each of these roles may, at specific points in the supply chain, be required to submit a different J‑form.

• Servants and agents instructed to make returns. Reg 1(3) and Reg 2(2) expressly bring within the category of “prescribed persons” any servant or agent whom the owner or manager instructs to make the required returns. That creates an employer/owner control dynamic: the person nominated to fill the form is also subject to the Act’s machinery.

• Anyone acquiring compiled lists. Reg 7(1) permits the Statistician, with Ministerial approval and subject to s 18 of the Act, to compile and publish or make available lists of names and addresses such as motor vehicle owners by make and type, owners of particular livestock or poultry classes, growers of specified crops, and makers of wine. This affects commercial users and other persons who may purchase or receive such lists.

Beyond the named categories, the Regulations also define “goods”, “person”, and “port” for the J‑form framework to broaden scope: “goods” includes livestock; “person” includes body corporate; “port” includes airport, railway station, post office, warehouse, depot or place (Reg 5(1)(b)). That means corporations, non‑maritime transport nodes, and livestock handlers are explicitly within scope for the export/import return regime.

In practice this creates compliance obligations across primary producers, transport operators, utility owners (including mine‑site generation), financial institutions, landlords and retail businesses, together with a subset of public officers acting as Statistical Agents. The Regulations therefore distribute the burden of information collection across sectors that interact with transport, housing, retail, finance and electricity generation.

The Regulations establish specific duties for data suppliers and powers for the Statistician and the Minister. They also create rights in the sense of authorised administrative actions and revocation powers. The key duties and rights are as follows, with text citations.

Duties to complete prescribed forms and follow instructions. A person required to fill up and furnish any form or return under the Act or these Regulations must comply with the instructions contained in or accompanying the form and must deliver it to the Statistician or the officer specified in the instructions (Reg 4). Reg 6 reinforces this by declaring that forms prepared and issued by the Statistician under section 7 of the Act are prescribed forms, and that instructions that accompany the form are part of the form. The statutory effect is to make adherence to the instructions a legal duty.

Duties of specific actors and time limits. Owners and managers in the classes specified in Reg 1(2) must, when required by the Statistician and to the best of their knowledge and ability, fill up and supply particulars in the forms prepared by the Statistician at times and for periods the Statistician prescribes by Gazette notice (Reg 1(2)). Bank managers must furnish particulars within fourteen days after each quarter end or as soon thereafter as practicable (Reg 2(1)). Persons handling imports and exports must complete the appropriate J‑form at time of despatch or on possession or arrival as set out in Reg 5(2)-(3).

Duty on nominated servants and agents. The Regulations treat any servant or agent whom an owner or manager instructs or authorises to make returns as a prescribed person within the meaning of section 9 of the Act (Reg 1(3) and Reg 2(2)). That imports into the person making the return the same legal status as the primary owner or manager for the statutory obligations under section 9.

Duty to provide returns even where nil. For persons whom the Statistician authorises to furnish returns periodically, the Statistician appoints the day returns must be furnished and the person must still furnish a return with the word “Nil” written across it if no goods were handled during the period (Reg 5(4)(a)-(c)). This eliminates a common avoidance route by requiring an explicit nil return.

Powers of the Statistician. The Statistician may determine who shall be the prescribed person within the meaning of section 9 for particular particulars, and must publish Gazette notification of that determination and cause the same notification to be made on relevant forms (Reg 3(1)-(2)). The Statistician can authorise periodic returns and revoke that authority (Reg 5(4)(a), (d)). Under Reg 7 the Statistician may, with Ministerial approval, compile and publish lists from return contents or other information obtained under the Act, subject to section 18 of the Act.

Ministerial approvals and prescribed inquiries. Reg 7 requires Ministerial approval for the publication of lists and Reg 8 requires the Minister to approve in writing inquiries the Statistician proposes that are to be “prescribed or allowed” for the purposes of section 11 of the Act. Those provisions create ministerial checks on data dissemination and on special inquiries.

Designation and appointment rights. Reg 5(1)(a) names certain public officers as Statistical Agents and allows subsequent appointments by the Governor in Council. The Governor in Council therefore retains an appointment route for expanding the collection network. The designation of Statistical Agents confers on those officers the right and duty to receive specified returns at ports and related facilities (Reg 5(2)-(3)).

Rights conferred on data users. Reg 7(1) states that the Statistician may compile and publish or otherwise make available to any person or persons lists containing names and addresses of specified classes. While the text makes the Statistician the decision point, once authorised lists can be made available “to any person or persons”, which is a broad grant enabling private sector use of compiled data if the Statistician and Minister approve.

Revocation and modification rights. The Statistician can revoke an authorisation for periodic returns at any time (Reg 5(4)(d)). The Statistician also controls the content and lifecycle of prescribed forms and their instructions (Reg 6).

Procedural duties for port‑side reporting. Reg 5 creates a detailed duty framework for exporters, consignors, consignees and carriers. It prescribes which J‑form is required in which circumstances and includes obligations to supply information to the Statistical Agent at the port or, if none, to the Statistician (Reg 5(2)(a)-(d), Reg 5(3)(a)-(e)).

Absence of explicit penalties in the Regulations. The Regulations themselves do not set out penalties or sanctions. They rely on the Act for the statutory offence framework (the Regulations repeatedly cross‑refer to sections of the Act such as 7, 8, 9, 11, 18 and 24). Practically, regulatory duties are enforceable only through the Act’s enforcement provisions; compliance advice must therefore review the Act for offences and penalties.

Taken together, these duties allocate data provision responsibilities across private sector actors and public officers, and place procedural controls in the hands of the Statistician and the Minister, with Gazetted notices serving as the formal vehicle for assigning and publicising obligations. The Regulations turn high‑level statutory collection powers into day‑to‑day administrative requirements and authorisations.

The Regulations themselves do not set out a schedule of fines or criminal penalties. They operate by creating duties, establishing procedural requirements, and authorising administrative designations and actions; enforcement and penal consequences must therefore be sought in the Statistics Act 1907, which the Regulations repeatedly cross‑refer to (see Regs 1, 3, 6, 7, 8). The text supplied shows a procedural enforcement framework rather than direct punitive measures; the key enforcement mechanisms and practical levers visible in the Regulations are administrative and procedural rather than penal.

Administrative levers and enforcement points visible in the Regulations:

• Designation and Gazette notification. The Statistician may determine who is a prescribed person and publish that determination in the Government Gazette, and similar notification will be included on the relevant form (Reg 3(1)-(3)). Gazette notification operationalises legal duty and establishes public notice; failure to comply after Gazette designation is the likely trigger point for any enforcement action under the Act.

• Requirement to follow form instructions. Reg 4 makes compliance with instructions contained in or accompanying a prescribed form a duty and requires delivery to the Statistician or to the officer specified. This converts procedural non‑compliance into a formal breach of the Regulations for enforcement under the Act.

• Periodic returns and revocation power. The Statistician can authorise periodic returns and may revoke the authorisation at any time (Reg 5(4)(a), (d)). Revocation is an administrative sanction with operational impact: revocation could force more frequent returns and impose additional compliance costs; the Regulation itself provides the capacity to change reporting cadence.

• Port and agent infrastructure. By naming Statistical Agents with authority to receive returns (Reg 5(1)(a)) and prescribing the J‑forms that consignors, consignees and carriers must complete (Reg 5(2)-(3)), the Regulations create structured local checkpoints. These agents are the first line of compliance monitoring at ports and transport nodes.

• Ministerial approvals as gatekeeper. Reg 7 requires Ministerial approval for publication of certain lists, and Reg 8 requires Ministerial written approval for prescribed inquiries under section 11 of the Act. These provisions place limits on actions the Statistician might otherwise take, and create an enforcement posture where Ministerial denial prevents certain investigations or publications.

What is not in the Regulations and consequences for enforcement planning:

• No express fines or criminal offences are set out in the Regulations themselves. Any penalty for non‑submission of returns, furnishing false information, or failure to deliver must therefore come from the Statistics Act 1907. The Regulations point to section 9 for the status of prescribed persons and to other sections (7, 8, 11, 18 and 24) for duties and powers, but do not reproduce offence provisions or fines.

• No administrative penalty or infringement notice scheme is created in the Regulations. The instrument uses designation and form‑based obligations rather than an express civil penalty regime.

Practical enforcement implications for affected entities and compliance teams:

• The Gazette notice regime (Reg 3) makes compliance obligations publicly discoverable; regulated parties should monitor the Government Gazette and the particular forms they receive for designation or amendment.

• Because instructions are deemed part of the prescribed form (Reg 6), failure to follow instructions provided with a form may be treated as non‑compliance with the Regulations and actionable under the Act. That increases the legal importance of the administrative details on the face of the forms.

• Port agents (Reg 5(1)(a)) act as de facto compliance monitors. Businesses that handle interstate goods flows must ensure their frontline staff complete J‑forms correctly and on time at the port or delivery point to avoid triggering downstream enforcement.

• Banks face a tight reporting window (Reg 2(1)) and managers must ensure internal reporting processes can meet the 14‑day deadline after each quarter.

• For persons authorised to furnish periodic returns under Reg 5(4), the obligation to deliver an explicit “Nil” return may be used by administrators to confirm compliance, creating a useful audit trail.

Recommended next steps for advisers and compliance officers preparing for enforcement risks:

• Consult the Statistics Act 1907 to identify the specific offences, penalties and enforcement powers linked to prescribed persons and to the submission of returns, including penalties for false or misleading information.

• Maintain Gazette monitoring to detect designations and revocations under Reg 3 and Reg 5(4)(d).

• Ensure internal controls and recordkeeping match the instructions deemed part of the prescribed forms (Reg 6), because those instructions are legally binding.

In short, enforcement under these Regulations is driven by administrative designations, mandated forms, Gazette publication, and the exercise of powers under the Statistics Act 1907. The instrument itself creates procedural levers rather than specifying fines; any punitive consequences will be found in the parent Act.

The Regulations operate as a subordinate instrument under the Statistics Act 1907 and explicitly cross‑refer to several provisions of that Act. They also incorporate or reference other identified statutes and administrative arrangements to define who must report and under what circumstances. The interactions are mechanistic: the Regulations give practical effect to the Act and reference external statutes to define regulated classes.

Interaction with the Statistics Act 1907. The Regulations repeatedly invoke the Act. Key cross‑references are:

• Section 7 of the Act is the statutory basis for the Statistician to prepare and issue forms; Reg 6 makes those forms “prescribed forms” and deems accompanying instructions part of them. The interaction is direct: the Act delegates form creation and the Regulations recognise and elevate those forms into the regulatory regime.

• Section 8 of the Act deals with matters for which statistics may be collected; Reg 1(1) supplements by listing additional matters the Statistician shall collect annually, “subject to these regulations”, thereby clarifying operational scope.

• Section 9 of the Act contemplates “prescribed persons”; Reg 1(3), Reg 2(2) and Reg 3 operationalise that concept by specifying who counts and how the Statistician will notify the designation.

• Section 11 is invoked in Reg 8; the Regulation requires Ministerial approval in writing for an inquiry to be “prescribed or allowed” by regulations under s 11. That places an interlocking procedural requirement between the Act’s inquiry powers and Ministerial oversight.

• Section 18 is specifically cited in Reg 7 as a constraint on compilation and publication of name/address lists; the Regulations authorise publication subject to s 18 of the Act. That means the breadth and limits of publication are ultimately determined by that section of the Act.

• Section 24 is the statutory power used to make and amend regulations, which is recorded in the preamble as the basis for these Regulations coming into force (preamble).

Interaction with transport and licensing statutes. The Regulations import definitions or statutory statuses from other Acts to define who is required to return information:

• The Traffic Act 1919-1935 is referenced to define “omnibus” owners who must supply particulars when required by the Statistician (Reg 1(2)). That means a person’s obligations under the Regulations depend on their legal status under the Traffic Act.

• The State Transport Co‑ordination Act 1933 is referenced to capture owners of goods transport vehicles who are licensed or required to be licensed under that Act (Reg 1(2)). Again the Regulations rely on statutory licensing categories in other Acts to identify regulated subjects.

Interaction with port, rail and agricultural administration. Reg 5(1)(a) designates bodies and officers that are embedded in other administrative regimes:

• Fremantle Harbour Trust, Albany and Bunbury Harbour Boards, Commonwealth Railways, Western Australian Government Railways, Midland Railway Co. of W.A. Ltd, the State Department of Agriculture (Boundary Stock Inspector), and the State Harbour and Light Department are all brought into the statistical collection network. Those organisations retain their other statutory duties while acquiring the role of Statistical Agent for returns under these Regulations.

Interaction with privacy and data disclosure regimes. The Regulations permit compilation and publication of lists of names and addresses for specified classes (Reg 7(1)), but do so “subject to section 18 of the Act”. The Regulations themselves do not address privacy statutes or broader public sector information access laws. Consequently, any intersection with contemporary privacy or freedom of information regimes is determined by:

• The substantive permissive language in Reg 7 that a compiled list may be “published or otherwise made available to any person or persons”, constrained only by s 18 of the Act and Ministerial approval. For compliance and risk assessment, regulated entities and users of compiled lists must therefore reconcile this availability with any state or Commonwealth privacy obligations that apply to personal information. The Regulations do not comment on that reconciliation.

Interaction with corporate and agency law. The Regulations explicitly define “person” in the import/export regime to include body corporate (Reg 5(1)(b)). That makes corporate entities subject to the returns regime. The appointment of officers as Statistical Agents may intersect with agency and employment law for agents and servants required to make returns, because a servant or agent authorised to make returns becomes a prescribed person (Reg 1(3), Reg 2(2)).

Administrative law and ministerial discretion. The Regulations give the Statistician and the Minister procedural discretion:

• The Statistician determines prescribed persons and may authorise periodic returns or revoke authorisations (Reg 3, Reg 5(4)). The Minister must approve in writing certain inquiries and publication of lists (Reg 7, Reg 8). These are administrative acts potentially reviewable under general administrative law principles. The Regulations do not set out merits or procedural review rights; those will be governed by the Act and general administrative law.

In summary, the Regulations sit within a network of statutory instruments. They operationalise the Statistics Act 1907, rely on transport and licensing statutes to identify regulated parties, embed port and rail officers in the collection system, and permit publication of lists subject to statutory constraints. They do not address modern privacy regimes; where disclosure of names and addresses is possible under the Regulations and the Act, compliance officers should check contemporary privacy and information access statutes to ensure there is no conflict.

The Regulations contain an explicit compilation table and amendment notes in the source. The instrument as published in 1939 repealed prior regulations under the Statistics Act 1907 and substituted a consolidated set of Regulations, and subsequent amendments have modified particular regulations and added new provisions. The timeline and textual amendments recorded in the source are as follows:

• Initial promulgation and replacement of prior regulations. The preamble states the Government Statistician issued these Regulations under section 24 of the Statistics Act 1907 on 31 August 1939, repealing and revoking all prior regulations made under the Act and substituting the Schedule set out in the instrument. The Gazette citation is Government Statistician’s Office, Perth, 31st August, 1939 (C.L.D. 1161/37; Ex. Co. No. 1820), and the compiled entry records “Untitled” with gazettal 8 Sep 1939, p.1558-60 (Compilation table).

• Early amendments. Reg 1 was amended by notices published 2 February 1940 (Gazette p.151) and 22 March 1946 (Gazette p.304), as noted in the margin to Reg 1 and the compilation table. These amendments appear to have adjusted the list of matters or the categories in Reg 1, though the compiled text incorporates the later language (Reg 1 includes a marginal note: amended Gazettes 2 Feb 1940; 22 Mar 1946).

• 1950 and later changes. The compilation table records gazettals 4 Aug 1950 p.1718, 15 Jun 1956 p.1479-85, and 7 Jan 1958 p.17. The source notes that Regulation 4 was inserted by Gazette 15 June 1956 p.1479. Regulation 5 was inserted on the same date (Gazette 15 June 1956 pp.1479-81) and subsequently amended 7 January 1958 p.17. The Schedule (Forms J.1-J.4) was also inserted 15 June 1956 p.1482-85.

• Specific insertions and amendments recorded in the Regulations. The source identifies:

  • Regulation 1 amended: Gazettes 2 February 1940 p.151; 22 March 1946 p.304.

  • Regulation 4 inserted: Gazette 15 June 1956 p.1479.

  • Regulation 5 inserted: Gazette 15 June 1956 pp.1479-81; amended Gazette 7 January 1958 p.17.

  • Schedule inserted: Gazette 15 June 1956 p.1482-85.

• Compilation note. The Notes section explains that the document is a compilation of the Statistics Regulations and includes the amendments referred to in the Table. The Compilation table summarises relevant gazettal dates and commencement notations (Compilation table).

Operational takeaway from the amendment history:

• The Regulations have been the subject of incremental updates since their initial substitution in 1939; notable structural additions occurred in the mid‑1950s with the insertion of Reg 4, the introduction of a systematic Statistical Agents framework in Reg 5, and the formalisation of J‑forms for interstate goods reporting in the Schedule.

• The Regulations’ adjustments suggest an evolving administrative architecture over time: earlier iterations likely contained different lists and mechanisms, and the 1956 insertions substantially fleshed out port reporting and periodic return mechanisms.

• The compiled text in the source is the authoritative current text insofar as the compilation includes the listed amendments; any practitioner must consult the consolidated regulations and the Government Gazette history for precise amendment wording and dates if relying on historical versions.

For current legal advice or compliance design, practitioners should confirm no further amendments occurred after the dates listed in the compilation table. The compilation table in the source terminates with the 1958 gazette entry; a modern legal check should be done against the official consolidated regulations database or the State Law Publisher to identify any later amendments or revocations.

The text supplied contains no reported cases or litigation history related to these Regulations. The Regulations themselves do not name any judicial decisions, and the compilation notes do not cite legal actions. Therefore, based on the provided source alone:

• There is no litigation history recorded in this instrument or its compilation notes.

• Because the Regulations cross‑refer to provisions of the Statistics Act 1907 (including provisions that authorise designated persons, inquiries and publication), any litigation that may have arisen in practice would likely be reported against the Act rather than the Regulations themselves. The source does not record such cases.

• Practitioners seeking precedent on enforcement, interpretation of “prescribed person”, the lawfulness of the Statistician’s publications, the scope of Gazette notifications, or the delineation of port‑based reporting obligations will need to search court records and law reports for cases invoking the Statistics Act 1907 and these Regulations.

Recommended practical steps for researching litigation:

• Search Western Australian case law databases and law reports for decisions mentioning the Statistics Act 1907, sections 7, 8, 9, 11, 18 or 24, or mentioning the Statistics Regulations.

• Search administrative law decisions for challenges to Gazette designations, Ministerial approvals of inquiries, or the compilation/publication of lists under Reg 7 to identify any judicial review challenges.

• Inspect tribunal or judicial decisions about data disclosure and privacy where the Statistician’s publication powers or the compilation of names and addresses under Reg 7 might have been contested.

Because the Regulations do not provide any litigation references, any legal arguments about the Regulations’ scope, the binding nature of form instructions, or the validity of Statistical Agent actions would need to be anchored in Act provisions and in general administrative law principles, plus any reported cases that apply them. The absence of litigation references in the compilation requires researchers to verify precedent independently.

The Regulations contain several practical traps and design features that can cause unexpected compliance exposure or operational friction if not recognised. These “gotchas” are drawn from explicit texts in the Regulations and their operational consequences.

1. Instructions are part of the prescribed form. Reg 6 deems instructions contained in or accompanying any form prepared under section 7 to be part of the prescribed form. Effect: failure to adhere to instructive material that accompanies a form is not mere sloppiness but a breach of the form as prescribed. Compliance processes must therefore capture not only data fields but ancillary procedural notes, definitions, rounding rules and signatory requirements.

2. Servants and agents who fill in returns become prescribed persons. Reg 1(3) and Reg 2(2) say that a servant or agent whom an owner instructs or authorises to make the required returns shall be a prescribed person for the purposes of section 9. Effect: the act of delegating completion to an employee or courier does not insulate the owner; it also imports legal status on the person who completes the return. Employers must ensure delegated staff are instructed correctly and that delegation is documented.

3. Banks’ tight 14‑day quarter deadline. Reg 2(1) requires bank managers to furnish quarter‑end particulars to the Statistician within fourteen days after each quarter end, or “as soon thereafter as practicable”. Effect: banking back‑office and legal teams need concrete processes to hit a short, recurring timeframe. “As soon thereafter as practicable” retains some flexibility but is not a blank cheque.

4. Periodic returns are binding and require explicit nil returns. Reg 5(4)(a)-(c) allows the Statistician to authorise periodic batching for persons handling many goods, but requires returns on appointed days and requires a “Nil” return when no goods are handled. Effect: automated systems must generate and lodge explicit nil returns to preserve compliance evidence. The Statistician can revoke authority (Reg 5(4)(d)), and revocation may change reporting cadence suddenly.

5. Port‑based complexity and multiple overlapping obligations. Reg 5(2)-(3) delineate multiple situations for exports and imports with different J‑forms (J.1-J.4) depending on who despatches, accepts or forwards goods. Effect: logistics managers must determine which party at each stage is responsible for each J‑form. Mistaken identification of responsibility may lead to missing returns.

6. Publication of personal names/addresses with Ministerial approval and subject to s 18. Reg 7(1) permits compiling and publishing lists of names and addresses (vehicle owners, livestock owners by class, growers, wine makers) but it is subject to section 18 of the Act and requires the Minister’s approval. Effect: commercial entities may find their customer lists compiled and made available if the Statistician and Minister approve; regulated actors should be aware that confidentiality expectations may be limited by statutory publication powers.

7. The J‑forms are integral but are reproduced as images in the Schedule. The Schedule contains Forms J.1 to J.4 as images in the source. Reg 6 makes these prescribed forms. Effect: compliance requires access to the exact forms and their embedded instructions; textual copies may omit critical formatting or instruction content, so practitioners should source the official forms as published or gazetted.

8. Definitions broaden scope for import/export regime. Reg 5(1)(b) defines “goods” to include livestock, “person” to include body corporate, and “port” broadly to include airports, railway stations, post offices, warehouses, depots or places where goods are received or despatched. Effect: the import/export returns regime applies beyond maritime ports to a wide set of nodes and to corporate entities, expanding who may need to make returns.

9. The Regulations do not state penalties. The absence of penalty provisions in the Regulations means that the enforcement regime and specific sanctions are contained in the Statistics Act 1907. Effect: parties cannot rely on the Regulations alone to assess risk; they must consult the Act to identify offences, maximum penalties, and any time limits or defences.

10. Gazette notifications are the operative designation mechanism. Reg 3 requires the Statistician to publish notifications in the Government Gazette to identify prescribed persons and to replicate notice on forms. Effect: regulated parties must watch Government Gazette notices; statutory obligations can arise by administrative Gazette notification even if a person did not receive direct individual notice.

11. Ministerial approval required for prescribed inquiries. Reg 8 requires the Statistician to satisfy the Minister about the nature and necessity of any proposed inquiry to be “prescribed or allowed” under section 11 of the Act, with the Minister’s written approval. Effect: the Statistician’s investigatory reach is subject to ministerial discretion, and regulated parties may face or avoid inquiries depending on political or policy considerations.

12. Historical amendments indicate changeability. The Regulations have been amended multiple times (notably 1940, 1946, 1956, 1958). Effect: the regulatory architecture has changed historically and could change again; compliance programs must be adaptable and include legal monitoring.

These specific textually grounded features create risks that are administrative rather than doctrinal. For example, an exporter who assumes the carrier will complete the J‑form because the carrier physically sends the goods may nevertheless be the person required to submit the J.1 or J.2 in a particular circumstance. Practitioners should map operational workflows to the scenario grid in Reg 5(2)-(3) and confirm which party is the person required to supply a J‑form at each handover point.

Compliance with these Regulations requires a combination of legal awareness, procedural controls, record‑keeping and active monitoring of Gazette notices and forms issued by the Statistician. Below is a practical compliance checklist and recommended operating practices, grounded in the text of the Regulations.

1. Identify whether your organisation falls within a regulated class. Consult Reg 1(2) and Reg 2(1) to determine if your organisation is an owner of an omnibus, a licensed goods transport vehicle, a wholesale or retail establishment, an auction market controller, a landlord, a commercial air service owner, a co‑operative manager, an electricity generating station owner/manager/agent (including mine/quarry generation), a builder or contractor, or a bank manager. Reg 5(1)(b) expands persons and ports in the import/export context; check whether your business handles goods leaving or arriving in Western Australia to/from other States or mainland territories.

2. Monitor Government Gazette notifications. The Statistician uses Gazette notices to determine and publicise prescribed persons and to notify changes (Reg 3(1)-(3)). Compliance teams must subscribe to Government Gazette updates and have a process to evaluate whether any new designations capture the organisation or its personnel.

3. Centralise form management and instructions. Because the Statistician’s forms and their instructions are “prescribed” (Reg 6) and instructions are deemed part of the form, maintain a central repository of the current prescribed forms and their accompanying instructions. Ensure staff completing returns use the latest official forms rather than ad hoc or outdated templates. For banks that must report quarterly (Reg 2(1)), build an internal schedule running to the fourteen‑day deadline.

4. Map responsibilities for J‑forms in the supply chain. For interstate goods movements, Reg 5(2)-(3) attaches obligations to specific roles: despatcher, acceptor for forwarding, consignor, consignee, and conveyor. Create a decision matrix that identifies who (in your operations) is responsible for J.1 through J.4 in different scenarios and embed that matrix into shipping instructions and contracts. Include a default rule that where there is no Statistical Agent at the port, the return must be furnished to the Statistician (Reg 5(2)(a), Reg 5(3)(a)).

5. Formalise delegation and training for servants and agents who will complete returns. Under Reg 1(3) and Reg 2(2), servants or agents authorised to make returns are themselves prescribed persons. Provide training, written delegations, and quality control for those individuals to avoid incorrect or late returns. Maintain evidence of authorisation to show who was responsible for the return.

6. Prepare for “Nil” reporting where authorised. If the Statistician authorises periodic returns for your operations (Reg 5(4)(a)), ensure systems produce periodic reports and file an explicit “Nil” return when no goods were handled during the period (Reg 5(4)(b)). Maintain audit logs proving the “Nil” return was submitted on the appointed day.

7. Track periodic authorisation and possible revocation. If the Statistician grants a periodic reporting arrangement, be aware the Statistician may revoke it at any time (Reg 5(4)(d)). Ensure you can revert to more frequent or per‑transaction reporting on short notice.

8. Ensure timely delivery to specified officers. Reg 4 obliges a person to deliver a completed form to the Statistician or to the officer specified in the instructions. Confirm, for each form, who is the recipient and the postal or electronic address and keep proof of delivery.

9. Implement record‑keeping and internal audit. Keep copies of submitted forms and evidence of submissions (timestamps, courier receipts, email confirmations). Because the Regulations do not specify retention periods, follow the organisation’s records policy, and be ready to produce entries in the event of an inquiry or audit under the Act.

10. Review contracts with logistics and freight providers. Since obligations can lie with consignors, consignees or carriers, ensure contracts allocate responsibility for submission of J‑forms and for indemnities relating to failures to submit accurate returns.

11. Consider privacy and publication exposure. Reg 7 allows, subject to section 18 of the Act and Ministerial approval, compilation and publication of lists of names and addresses (Reg 7(1)). Where your business maintains customer or supplier lists that fall within the listed categories (vehicle owners by make/type, owners of livestock classes, growers, wine makers), evaluate whether your data could be compiled and published and embed appropriate confidentiality clauses and risk management measures. Also check contemporary privacy statutes for additional obligations not addressed in these Regulations.

12. Engage with the Statistician proactively. If your operations are complex, request clarification from the Statistician on who is the prescribed person for particular particulars (Reg 3(1)), whether periodic return authorisation is appropriate (Reg 5(4)(a)), and the exact content and instructions associated with prescribed forms (Reg 6). Seek written confirmation where possible.

13. Legal check for penalties and defences. Because the Regulations do not specify penalties, consult the Statistics Act 1907 to determine the sanctions for non‑compliance, false statements or other offences, and examine defences and notice requirements. Include those legal obligations in compliance matrices and training.

14. Prepare incident response for inquiries. Reg 8 requires Ministerial approval for certain inquiries under section 11 of the Act. If you are notified of an inquiry, identify whether it purports to be a “prescribed or allowed inquiry” under Reg 8 and check whether Ministerial approval was obtained in writing. Preserve relevant records and seek legal advice promptly.

15. Keep internal reporting calendars aligned with statutory dates. For bank managers, schedule internal close, reconciliation and sign‑off processes to deliver returns within the 14‑day quarter reporting window (Reg 2(1)). For other regulated parties, schedule compliance checks around any Gazette notices that prescribe dates and periods for returns (Reg 1(2)).

Summary compliance posture. These Regulations place heavy emphasis on procedural correctness: correct forms, correct instructions, correct recipient, correct timing, and explicit documentation of delegations and nil returns. A practical compliance programme should therefore be process‑driven: maintain a legal register for Gazette notices and prescribed forms; map operations to required forms and responsible persons; ensure rigorous sign‑off and proof of delivery; train those authorised to complete returns; and confirm that contracts allocate responsibility where supply chain handovers change reporting duties. Legal teams must also consult the Statistics Act 1907 to understand offence provisions and potential penalties.
