Statistics Act 1907

The Act’s architecture rests on a small set of interlocking statutory concepts: appointment and delegation of statistical officers; compulsion and enforcement to secure returns; secrecy and non‑disclosure protections; State-Commonwealth integration via an arrangement; and regulation as a residual tool.

Appointment and delegation: The Governor appoints the Government Statistician and may appoint a Deputy and other officers (s 4-5). Delegation is built into the office: actions or signatures of the Deputy are valid when the Statistician is absent (s 5).

Statistical agents and collectors: The Act designates the Inspector or officer in charge of each police district as the “statistical agent” and requires them to collect and furnish returns to the Statistician; those agents may appoint members of the police force as collectors (s 6). That establishes a statutory role for police resources in data collection.

Compulsion to supply returns and answer questions: The Statistician must prepare forms and instructions and take steps to collect statistics (s 7). “Prescribed persons” must fill in and supply particulars on prescribed forms to the best of their knowledge when required (s 9). Every person must answer questions necessary to obtain authorised statistics (s 10). The Act therefore imposes an affirmative duty of disclosure on both identified classes (prescribed persons and “every person” when asked) subject to penalties (ss 9-10, 20).

Inspection powers: For factories specifically, the Statistician or authorised officers may, during working hours, enter and inspect any part of a factory and inspect plant and machinery and make prescribed enquiries (s 11). Obstruction of these powers is an offence (s 11(2)).

Remedies and enforcement levers: The Statistician can require fresh returns if originals are missing or defective (s 12). The Treasurer can withhold payment of subsidies to a local authority that fails to furnish required returns until the return is furnished (s 13). Prosecutions for offences may be brought by persons authorised in writing by the Statistician and fines are payable to the Consolidated Account (s 23).

Secrecy and non‑production: Officers are subject to secrecy obligations in relation to forms and information (s 17). No private business return may be published in a way that divulges contents without the prior written consent of the person making the return (s 18). Statistical returns and information obtained under the Act are not to be produced in court (s 19). These provisions set the confidentiality boundary for the Act’s operation.

Penalty framework and regulatory scope: The Act specifies monetary penalties at the foot of certain sections (ss 9-11, 15-17, 20) and explains that those figures are the maximums on summary conviction (s 22). The Governor has regulation‑making power to prescribe matters necessary or convenient for the Act (s 24); in practice, regulation will be the mechanism to define who counts as “prescribed persons”, the forms, and technical details of collection.

State-Commonwealth integration: Part II and the Schedule provide an explicit legal route for the State to delegate or integrate its statistical work with the Commonwealth. The Schedule delineates governance structures for an Integrated Statistical Service, staff arrangements, funding (Commonwealth bears full cost, Schedule cl 9), access to State records subject to State secrecy laws (Schedule cl 12), use of police services for collection with Commonwealth-funded postage (Schedule cl 13), and dispute resolution via a Joint Statistical Committee (Schedule cl 18). The Schedule also contemplates execution of powers under the Commonwealth Census and Statistics Act by officers seconded to Commonwealth employment (Schedule cl 6, cl 8).

Prescribed subjects: The Act lists the subjects on which the Statistician shall collect annual statistics (s 8). The list is broad and includes population, vital and social statistics, industry‑level details (including nationality of proprietors and employees in factories), finance, transport, land tenure, primary industries, mining, forestry, fisheries, local government, water supply and “any other prescribed matters” (s 8). The “prescribed” hook (defined in s 3) ties the scope of obligations to regulations and orders.

In sum, the Act combines operational rules for collecting statistics with confidentiality guarantees and an express route to an integrated Commonwealth-State model, funded and administered largely by the Commonwealth under the Schedule. The main levers available to the State’s statistical authority are forms, authorised questions, inspection powers, sanctions for non‑cooperation, and the capacity to negotiate an overarching arrangement with the Commonwealth that can supersede or modify Part I operations (s 1B; s 25).

The Act imposes responsibilities and creates authorities that affect a range of actors across public and private spheres. Key affected parties and how the Act touches them are:

• Prescribed persons and “every person” asked for information: Section 9 requires “prescribed persons” to fill up and supply particulars on prescribed forms “to the best of their knowledge” when required by the Statistician. Section 10 extends an answering duty to “every person” when questioned by the Statistician or authorised officer. The combination means both categories of persons can be compelled to provide data, with penalties for failure or untruth (ss 9-10, 20). The statute leaves the identification of “prescribed persons” to the Act or to regulations (s 3, definition of “prescribed”).

• Private businesses and factories: Factories are subject to inspection by the Statistician or authorised officers during working hours, including inspection of plant and machinery and prescribed enquiries (s 11). Section 8 specifically lists “factories and manufacturing industries” and requires statistics to detail nationality of proprietor and number and nationality of employees (s 8(e)). Private businesses supplying returns are protected from publication of identifiable returns without written consent (s 18).

• Police: The Inspector or officer in charge of every police district is statutorily the “statistical agent” for that district and must cause returns to be collected and furnished to the Statistician; statistical agents may appoint members of the police force as collectors (s 6). The Schedule repeats and expands this role for the integrated service, requiring the State to make police services available for collection and the Commonwealth to meet postal and similar expenses (Schedule cl 13).

• Local authorities: Local authorities are within scope for returns and information. Section 13 permits the Treasurer to withhold payment of any subsidy to a local authority that has failed to furnish required returns until the return is furnished. This creates a direct financial enforcement lever against local government bodies.

• Statutory officers and public servants: The Government Statistician and Deputy are public offices created by the Act (ss 4-5). The Schedule contemplates that State statistical staff may resign their State public service appointment and be appointed to Commonwealth employment (Schedule cl 3-6), or that the State may retain employees at its own expense to perform functions under the State law (Schedule cl 7). Officers appointed under the Act are subject to secrecy obligations (s 17) and criminal sanctions for falsification (s 16).

• The Treasurer and Minister: The Treasurer is given a specific enforcement role in respect of local authority subsidies (s 13). The Minister (defined in s 3) is the political head charged with administration of the Act, which situates accountability in the executive.

• Commonwealth authorities and the Commonwealth Statistician: Part II and the Schedule bring Commonwealth entities into the picture. An arrangement under s 25 can place WA’s statistical work within an Integrated Statistical Service administratively controlled by the Commonwealth Statistician and operated by a Deputy Commonwealth Statistician, with Commonwealth funding (s 25; Schedule cl 1-2, cl 9).

• The public and courts: The public benefits from publication obligations (s 14) but is also limited by secrecy and non‑production provisions. The Statistician must publish compiled statistics and abstracts (s 14). Conversely, returns obtained under the Act are not to be produced in court (s 19), restricting parties’ access to raw return material for litigation.

• Persons authorised to prosecute: The Statistician may authorise in writing any person to prosecute offences under the Act; penalties recovered are payable to the Consolidated Account (s 23). This affects how enforcement actions will be staffed and funded.

The distribution of burdens and benefits is therefore concentrated. Businesses and individuals face the direct burden of accurate returns and potential entry inspections. Police and public servants will bear operational responsibilities for collection and may be moved between State and Commonwealth employment under an arrangement. The Commonwealth is expressly positioned as the financial provider for an integrated service should an arrangement be entered (Schedule cl 9), while the State retains control tools (appointment of Government Statistician, capacity to require returns, and secrecy protections).

Regulations under s 24 determine many operational details, including who is a “prescribed person,” the exact form and content of returns, and the scope of the inspections permitted by s 11. The Act’s Schedule also means that entry into an arrangement can materially reallocate decision‑making and resource responsibilities from State public service mechanisms to Commonwealth administration.

The Act sets out a set of concrete duties on officers, collectors, prescribed persons, and persons generally, and confers rights in the form of secrecy protections and procedural mechanisms. Organised by actor, the key duties and rights are:

Government Statistician and authorised officers

• Duty to carry the Act into execution under the Minister (s 4).
• Duty to prepare and issue forms and instructions and to take necessary steps for collection of statistics (s 7).
• Right to require returns and to question persons; power to inspect factories during working hours (ss 9-11).
• Power to direct that fresh returns be made where existing returns are not made, collected, or are defective (s 12).
• Duty to compile, tabulate and publish the statistics or abstracts with observations (s 14).
• Duty to observe secrecy in respect of forms and information, and not to divulge contents except as allowed by the Act or regulations (s 17).

Deputy Statistician and other officers

• Can perform functions and sign instruments in the Statistician’s absence, and their acts are as valid as the Statistician’s (s 5).
• If integrated with Commonwealth under Schedule, officers appointed to the Commonwealth may be required to execute powers conferred by the Commonwealth Census and Statistics Act as directed (Schedule cl 6, cl 8).

Statistical agents and collectors (police)

• Inspectors or officers in charge of police districts are statistical agents and must cause returns to be collected and furnished to the Statistician (s 6).
• Statistical agents may appoint police members as collectors for their districts (s 6).
• Under the Schedule, the State must make police services available for collection in the same manner as before the arrangement (Schedule cl 13).

Prescribed persons and every person

• Prescribed persons must fill up and supply particulars on prescribed forms “to the best of their knowledge” when required by the Statistician (s 9). The identity of “prescribed persons” depends on the Act and regulations (s 3).
• Every person must answer questions put by the Statistician or authorised officer necessary to obtain information authorised by the Act (s 10).
• Liability for knowingly making untrue statements in forms or answers is expressly placed on persons (s 20).

Private persons and businesses

• Right: returns relative to private business shall not be published in a way that divulges content without prior written consent of the person making the return (s 18).
• Right: returns and information obtained under the Act are not to be produced in court; officers holding such returns are not required to produce them by subpoena (s 19). These are statutory confidentiality rights.

Local authorities

• Duty to supply returns and information when required; risk of Treasury withholding of subsidies until required information is furnished (s 13).

Prosecutorial authority and enforcement

• The Statistician may authorise persons in writing to prosecute offences under the Act; fines payable go to the Consolidated Account (s 23).

Regulatory rule‑making

• Governor has power to make regulations “prescribing all matters and things” required or permitted by the Act or necessary or convenient for its execution (s 24). That power is the principal means by which many operational definitions (including “prescribed persons”) will be set.

Publication duties

• The Statistician must publish statistics or abstracts and observations thereon (s 14). Publication is thus a statutory obligation, though constrained by secrecy rules (ss 17-18).

Entry and inspection rights

• The Statistician and authorised officers have the right to enter factories and inspect plant and machinery during working hours and to make prescribed inquiries (s 11).

Sanctioned penalties

• The Act provides penalties for failure to supply returns (s 9: $20), failing to answer questions (s 10: $20), obstructing an inspection (s 11: $20), neglect by agents or collectors (s 15: $20), officers signing untrue forms (s 16: $100), officers divulging secrets (s 17: $100), and persons making false returns or answers (s 20: $100). Section 22 clarifies that the penalties at the foot of sections are summary conviction maxima.

Arrangements with the Commonwealth

• The Governor may enter into an arrangement with the Governor‑General about collection and publication of statistics for both governments (s 25). The Schedule gives specific rights and duties if such an arrangement is adopted: Commonwealth funding of staff and equipment (Schedule cl 9), Commonwealth administration via the Deputy Commonwealth Statistician (Schedule cl 1-2), and access to State statistical records subject to State secrecy laws (Schedule cl 12).

Taken together, the Act imposes mandatory disclosure duties, empowers inspection, creates confidentiality protections for returns, and builds in administrative tools to ensure compliance and to integrate operations with Commonwealth systems. The balance of duties and rights is practical: compulsion to obtain data is paired with statutory confidentiality and non‑production protections for those returns.

The Act sets out a summary enforcement regime combining monetary penalties, administrative remedies and prosecutorial mechanisms. The penal and enforcement architecture consists of the following elements:

Specified monetary penalties

• Several sections state specific penalties at the foot of those sections. The figures given in the text are the maximum penalties on summary conviction for contravening the provision:
  • Section 9 (failure by prescribed persons to supply returns): penalty $20.
  • Section 10 (failure to answer questions): penalty $20.
  • Section 11 (hindering or obstructing authorised officers in entry and inspection): penalty $20.
  • Section 15 (statistical agent or collector refusing or neglecting to perform duties): penalty $20.
  • Section 16 (officer wilfully altering forms or signing untrue forms): penalty $100.
  • Section 17 (officer divulging contents of forms without authority): penalty $100.
  • Section 20 (person knowingly making an untrue statement in any form or answer): penalty $100.
• Section 22 explains that these footnote penalties indicate the maximum liability on summary conviction for contraventions of the relevant sections.

Prosecutorial authority

• The Statistician may authorise in writing any person to prosecute offences against the Act (s 23). This authorisation mechanism means prosecutions are not limited to Crown prosecutors; the Statistician controls who prosecutes breaches.
• Section 23 also provides that penalties recovered be credited to the Consolidated Account, aligning recovered fines with public revenues.

Administrative withholding power

• Separate from criminal penalties, the Act gives the Treasurer a withholding power: if the Statistician reports that a local authority has failed to furnish required returns or information, the Treasurer may withhold payment of any subsidy otherwise payable to that local authority until the return is furnished (s 13). This is an administrative, coercive remedy that targets public funding flows, creating a non‑criminal compliance lever against local government entities.

Directions and repeat returns

• The Statistician has power to require fresh returns if returns are not made, not collected, not received, or are so imperfect as to be valueless or misleading (s 12). The direction to remake or recollect returns is an operational enforcement tool without an immediate penalty but with potential follow‑on consequences (e.g. prosecution for false returns, s 20).

Secrecy and non‑production safeguards that act as limits on enforcement discovery

• The Act’s secrecy rules (s 17-18) and its ban on production of returns in court (s 19) constrain how statistical material can be used in enforcement processes outside the Act’s own offences. Section 19 explicitly prevents the Statistician or officer in custody of returns from being required by subpoena or otherwise to produce those returns in any court, which limits the use of returns as evidence in external proceedings.

Scope and enforcement practicalities

• The Act’s specified monetary penalties are modest by contemporary standards; s 22 refers to these maxima. The actual enforcement strategy in practice will likely depend on prosecutorial discretion exercised by persons authorised by the Statistician (s 23) and on the use of the administrative withholding power against public bodies (s 13). The power to require renewed returns (s 12) is also an important administrative tool to correct defective information before prosecuting.

Regulatory backstop

• Regulations under s 24 may prescribe processes, forms, and additional matters necessary for enforcement or compliance. That regulatory power is the statutory mechanism through which operational details (including possibly expanded penalties in line with updated legislative drafting, if enacted) would be implemented.

Commonwealth integration and enforcement

• The Schedule contemplates officers seconded or appointed to the Commonwealth who, as part of the integrated service, can be required to execute powers conferred under the Commonwealth Census and Statistics Act, subject to direction by Commonwealth statisticians (Schedule cl 6, cl 8). That introduces the prospect of Commonwealth statutory enforcement powers applying to activities performed under an arrangement.

In short, enforcement combines criminal sanctions with an administrative withholding power and directed operational remedies (fresh returns). Prosecutions may be mounted by persons authorised by the Statistician; recovered fines flow into the Consolidated Account. Statutory confidentiality and non‑production rules constrain external uses of returns, so enforcement tends to be internal to the Act’s own framework. The pecuniary penalties set in the Act are set amounts and are declared maximums on summary conviction; operational enforcement in practice will depend heavily on how the Statistician uses the authorising power in s 23 and on the supporting regulations the Governor may make (s 24).

The Act both references and is intended to operate alongside Commonwealth legislation, State public service laws, and associated secrecy obligations. The principal statutory interactions in the text are:

Commonwealth Statistics (Arrangements with States) Act 1956

• Part I of the Act is expressly made subject to “any arrangement, or supplementary arrangement” mentioned in s 5 of the Commonwealth’s Statistics (Arrangements with States) Act 1956 or successor Commonwealth Acts made under that authority (s 1B). That means an arrangement under the Commonwealth Act can alter the operation of Part I in practice.
• Section 25 allows the Governor, on behalf of the State, to enter into any arrangement mentioned in s 5 of the Commonwealth Act with the Governor‑General for collection and publication of statistics for both the Commonwealth and the State. The Schedule is provided as a model arrangement (s 25(2)) and any arrangement entered has effect according to its tenor (s 25(3)).
• The Schedule itself repeatedly refers to the Commonwealth Census and Statistics Act 1905-1949 (the Commonwealth Act in force at the time) as the Commonwealth law conferring powers that may be executed by officers seconded to the Commonwealth (Schedule cl 6, cl 8). Thus, when an arrangement is in place, officers may be required to execute powers under that Commonwealth statute.

Commonwealth Public Service Act and State Public Service laws

• The Schedule contemplates cross‑jurisdictional staff movement: the person occupying the office of State Government Statistician at the date of the arrangement will resign from the State Public Service and be appointed Deputy Commonwealth Statistician subject to the Commonwealth Census and Statistics Act and the Commonwealth Public Service Act (Schedule cl 3). Subsequent appointments will be made according to Commonwealth procedures subject to consultation and with simultaneous State appointment under State procedures (Schedule cl 4).
• The Schedule refers specifically to the Public Service Act 1922-1955 and requires consent of the Commonwealth Public Service Board and the State Public Service Commissioner for appointments and engagements under clause 6. That demonstrates the Act contemplates use of Commonwealth public service appointment machinery when an arrangement is implemented.

State secrecy and records law

• The Schedule requires that Commonwealth officers who access State records observe and comply with all statutes of the State relating to those records, including secrecy provisions (Schedule cl 12). Consequently, the Act’s own secrecy rules (ss 17-19) remain relevant even where Commonwealth officers are involved.

Treasury and financial administration statutes

• Section 13 gives the Treasurer a power to withhold subsidies to local authorities that fail to furnish returns. The practical deployment of that power will interact with State financial administration and local government funding regimes governed by other State statutes and financial instruments.

Criminal and procedural law

• The Act’s penalties are summary offences. Their prosecution and sentencing will be governed by the Criminal Procedure and Sentencing statutes and court rules applicable to Western Australian summary offences. Section 23 contemplates private persons authorised by the Statistician to prosecute; prosecution practice will therefore need to fit within state prosecutorial procedures.

Regulations and delegated law

• The Governor’s power to make regulations (s 24) is the mechanism to add procedural, administrative and technical detail. Regulations may interact with other State instruments, for example by prescribing who is a “prescribed person,” defining forms and specifying permitted inspections.

Absence of explicit interaction with privacy law in the text

• The Act contains its own secrecy protections (ss 17-19) and a non‑production rule (s 19). The Act does not, in the text reproduced, cross‑reference contemporary privacy legislation. Where modern State or Commonwealth privacy statutes apply, their interaction with the Act will be a matter for legal interpretation; the Act itself requires statutory observance of State secrecy statutes by Commonwealth officers under an arrangement (Schedule cl 12).

Commonwealth prosecution or data powers under the Census and Statistics Act

• Under an arrangement, officers appointed to the Commonwealth may be required to exercise powers conferred by the Commonwealth Census and Statistics Act (Schedule cl 6, cl 8). Those Commonwealth powers may differ in scope or sanction from the State Act, creating a layered statutory regime for officers operating within the Integrated Statistical Service.

In short, the Act is drafted to co‑operate with Commonwealth arrangements and public service rules, and its operation can be materially affected by an arrangement under s 25 and by the Commonwealth’s Statistics (Arrangements with States) Act. The Schedule creates a legal template for operational and employment interactions between State and Commonwealth statutes, while preserving State secrecy laws and local subsidy enforcement. How the Act interacts with modern privacy and information access laws will depend on legislative history and subsequent regulations; the text itself preserves State secrecy provisions as binding on Commonwealth officers acting under an arrangement.

The compilation table and marginal notes in the reproduced text show a clear amendment and reprint history spanning the original 1907 Act through the mid‑20th century and into the early 21st century. Key legislative and editorial changes noted in the source are:

• Original enactment: Statistics Act 1907 (3 of 1907), assented 2 September 1907 and commenced 1 January 1908 (Compilation table).
• Statistics Act Amendment Act 1956 (No. 62 of 1956) inserted Part II and the Schedule enabling State-Commonwealth arrangements; these provisions commenced 4 January 1957 and are responsible for the arrangement machinery now in the Act (Compilation table; Schedule inserted by No. 62 of 1956 s 3).
• Decimal Currency Act 1965 (No. 113 of 1965) made amendments on penalty amounts and other provisions commensurate with decimal currency conversion; sections 4-9 of that Act came into force on 14 February 1966 and the balance on 21 December 1965 (Compilation table).
• Reprints: The Act was reprinted and approved 17 March 1982, incorporating amendments up to that date, and again reprinted as at 6 June 2003, incorporating subsequent amendments (Compilation table).
• Financial Administration Legislation Amendment Act 1993 (No. 6 of 1993 s 11) amended s 23 (authorisation to prosecute) and came into operation 1 July 1993 (Compilation table).
• Financial Legislation Amendment Act 1996 (No. 49 of 1996 s 64) also affected s 23 and commenced 25 October 1996 (Compilation table).
• Statutes (Repeals and Minor Amendments) Act (No. 2) 1998 (No. 10 of 1998 s 76) deleted s 1A and is recorded in the marginal note (Compilation table).
• Financial Legislation Amendment and Repeal Act 2006 (No. 77 of 2006 s 4) and Standardisation of Formatting Act 2010 (No. 19 of 2010 ss 4, 43(2)) produced further textual or formatting amendments and reprint adjustments, with commencement dates recorded in the compilation table.

Marginal notes in the Act show specific insertions and deletions, for example:

• Part IA , Preliminary heading inserted by No. 19 of 2010 s 43(2) (marginal note).
• Section 1B was inserted by No. 62 of 1956 s 2 to make Part I subject to Commonwealth arrangements (marginal note).
• Section 1A has been deleted by No. 10 of 1998 s 76 (marginal note).

The compilation table provides precise assent and commencement dates for each amending instrument listed, enabling a chronological trace of changes to the Act. The Schedule itself was inserted by the 1956 amendment and remains the core mechanism for formalising an Integrated Statistical Service with the Commonwealth.

No amendments in the source indicate the penalty amounts have been updated since decimal currency conversion adjustments in 1965; the penalties shown ($20, $100, etc.) reflect the historical figures as compiled.

The Act’s textual history is therefore characterised by: early 20th century enactment; mid‑century realignment to permit Commonwealth-State integrated statistical arrangements (1956); currency‑related amendments (1965); periodic reprints for consolidation (1982, 2003); and later amendments relating to financial administration and formatting (1993, 1996, 2006, 2010). The Schedule and s 25 remain the central modern mechanism for cross‑jurisdictional operational change.

The statute text supplied does not include any reported cases, judicial interpretations, or litigation record. The Schedule and the Act reference Commonwealth statutes and public service procedures, but the reproduced material contains no judicial decisions that interpret the Act’s provisions, nor does it identify any specific litigation under the Act.

Consequently, the source provides no litigation history to summarise. Practitioners should therefore treat statutory provisions as the primary authoritative material and be aware that questions about interaction with Commonwealth arrangements, confidentiality limits, the scope of inspection powers (s 11), the operation of s 19 (non‑production in court), and the effect of Part I being subject to arrangements (s 1B) may give rise to legal disputes not reflected in the supplied text. In the absence of cases cited in the Act itself, points of legal uncertainty would typically be resolved by examining:

• subsequent case law in Western Australia and Commonwealth courts applying the Census and Statistics Act 1905 (or successor Commonwealth legislation) where Commonwealth arrangements have been effected;
• decisions interpreting statutory confidentiality and non‑production provisions where similar text appears; and
• any administrative law challenges to executive decisions under s 25 (entry into arrangements), s 12 (directions to remake returns), or s 13 (withholding subsidies).

Because the supplied compilation does not name cases, no case law can be described here. Practitioners seeking precedential authority will need to search Western Australian and federal law reports, databases and administrative tribunal decisions for any matters invoking the Act or its Commonwealth counterparts.

Several operational and legal traps can arise from the Act’s structure and specific draft choices. The following are concrete, source‑grounded issues to flag for practitioners and compliance officers:

Prescribed persons are defined by implication, not by text

• The obligation in s 9 applies to “prescribed persons,” but the Act leaves the term to be defined by the Act itself or regulations (s 3; definition of “prescribed”). Until regulations specify who is prescribed, it may be unclear to particular entities whether they fall within the mandatory returns regime. That regulatory gap can create short‑term uncertainty about compliance obligations.

Low nominal penalties, historical currency context

• The statutory maximum penalties are small dollar amounts as compiled (for example, s 9: $20; s 20: $100), reflecting historic figures and decimal conversion adjustments in 1965. In modern enforcement terms, these monetary caps may seem low and may affect deterrence and prosecution priorities. Section 22 clarifies these are maximum summary penalties, but there is no schedule in the text revising them to contemporary penalty scales.

Confidentiality obligations but non‑production in court can produce evidential limits

• Sections 17-19 provide strong confidentiality protections and prohibit production in court. While these protect informants and private business disclosure, they can also limit parties’ ability to use return material in litigation or administrative review. Users of the data should stop to consider whether reliance on the returns as evidence will be possible in future disputes.

Police as default collectors

• The Act places the primary on‑the‑ground collection role in the police force (s 6). That assignment may create organisational frictions: police priorities and resourcing are not naturally aligned with statistical collection. The Schedule continues this model but obliges the State to make police services available and the Commonwealth to pay postal and similar expenses (Schedule cl 13). Practitioners should note that police resourcing constraints could affect data quality and timeliness.

State-Commonwealth employment mechanics are unusual

• The Schedule contemplates that the incumbent Government Statistician will resign from the State Public Service and be appointed to the Commonwealth Public Service as Deputy Commonwealth Statistician while continuing to occupy the State office under this Act (Schedule cl 3). That hybrid status may raise questions about employment rights, immunities and obligations while acting in State capacity but paid or administered under Commonwealth procedures.

Non‑production in court vs. administrative review

• Section 19 prevents production of returns in court, but the text does not expressly address administrative tribunal review or Freedom of Information mechanisms. Practitioners should consider potential friction between s 19 and other avenues for information access, which may require legal analysis beyond the Act’s wording.

Part I subject to Commonwealth arrangements

• Section 1B makes Part I subject to arrangements under the Commonwealth’s Statistics (Arrangements with States) Act 1956. That means Part I’s operation can be displaced or modified by an arrangement. Entities must track whether an arrangement has been entered under s 25, because it can change who administers the statutory duties and who bears the costs.

No express modern privacy cross‑reference

• While the Act includes secrecy rules, it does not in the reproduced text cross‑reference modern State or Commonwealth privacy or data‑protection statutes. Practitioners should not assume the Act’s secrecy regime is coextensive with contemporary privacy obligations; interactions may require legal analysis where other statutes apply.

Regulatory dependence for operational detail

• Many operational details (who is “prescribed”, form contents, what inquiries may be “prescribed or allowed” during inspections) are left to regulations (s 7, s 11, s 24). The absence of up‑to‑date regulations in the text may generate compliance uncertainty until regulations are consulted.

Non‑production may hinder criminal investigation outside the Act

• The rule in s 19 that returns and information obtained under the Act are not to be produced “to any court” could complicate criminal or regulatory investigations outside the Act that might otherwise benefit from the same information. There is no express carve‑out in the text for law enforcement requests beyond the Act.

Treasurer’s withholding power applies to local authorities only

• The administrative coercion in s 13 is limited to withholding subsidies to local authorities. Private entities are not subject to an analogous non‑criminal funding withholding. This creates an asymmetric enforcement landscape where public authorities face a distinct administrative sanction.

Regulatory penalties and enforcement approaches may be outdated

• Because the penalty amounts and summary offence structure date to older amendments (with reprints noted), the practical enforcement posture and penalty regime may not align with contemporary compliance frameworks; any modernisation would require statutory amendment or regulation.

These “gotchas” are not dicta but flows from the text as compiled. Every practical implementation question , who is “prescribed”, what constitutes a permissible inspection, whether a particular return can be produced in a given legal process, and how an arrangement has altered administrative responsibility , requires looking beyond the Act’s bare text to the state of regulations and any existing s 25 arrangement.

For entities required to interact with or respond under the Act, the following practical compliance checklist is derived from the Act’s text (with section pointers). Implementing these steps will reduce enforcement risk and align operational practice with statutory obligations.

1. Determine whether you are a “prescribed person”

• Consult the regulations made under s 24 and any statutory instruments that identify “prescribed persons” (s 3, definition of “prescribed”; s 9). If regulations are silent, seek an administrative ruling from the Statistician’s office to clarify whether your organisation is within scope.

2. Establish processes for accurate and timely returns

• If required to fill out forms, ensure procedures are in place to answer “to the best of [your] knowledge” (s 9) including record retention, authorised signatories, and verification steps to avoid false statements (s 20).
• Maintain a record of how data is compiled and who is responsible for each field in the return; this evidentiary trail aids in demonstrating bona fide efforts to supply accurate information if questioned.

3. Prepare for statutory questioning

• Train staff to respond to authorised officers’ questions (s 10). Ensure that persons who may be questioned have access to necessary records and are instructed to answer only within the bounds of their knowledge and to avoid guesswork that could be characterised as knowingly false (s 20).

4. Facilitate inspections in factories

• If your operations include factories or manufacturing facilities, grant authorised officers access during working hours as required (s 11). Designate an internal contact, provide safe access to plant and machinery, and keep contemporaneous logs of any inspection interactions.

5. Protect confidentiality and privacy within your organisation

• Respect statutory confidentiality obligations: private returns cannot be published to divulge contents without prior written consent of the person making the return (s 18). Implement access controls and internal protocols so only authorised staff handle return material in accordance with s 17.

6. Maintain records and audit trails

• Because the Statistician may request fresh returns (s 12) or second checks, retain source documents and backup data for a reasonable retention period. These records support both internal quality control and statutory compliance.

7. Monitor potential State-Commonwealth arrangements

• Check whether an arrangement under s 25 is in force or under negotiation. An arrangement can change who administers the data collection, who pays costs, and which statutory powers (including Commonwealth Census and Statistics Act powers) apply to officers (Schedule cl 1-9). If an arrangement is in place, note the location of the Integrated Statistical Service and any new administrative contacts (Schedule cl 10).

8. For local authorities, avoid subsidy‑withholding risk

• Local authorities must prioritise furnishing returns to avoid triggering the Treasurer’s withholding power (s 13). Set internal reporting timetables and escalation procedures to ensure returns are submitted promptly.

9. Train police‑facing staff on collector interactions

• Where the police are acting as statistical agents or collectors (s 6), coordinate closely with assigned officers and ensure collector credentials are validated. If police members act as collectors, document the chain of custody for returns gathered.

10. Understand limitations on external use of returns

• Be aware that returns obtained under the Act are not to be produced in court (s 19). If your organisation is litigating and seeks use of statistical returns, obtain legal advice early to navigate the statute’s non‑production rule.

11. Implement internal compliance certification and point of contact

• Nominate an internal compliance officer who monitors statutory deadlines for returns, maintains contact with the Government Statistician’s office, and logs any communications or requests from authorised officers. This reduces risk of accidental non‑compliance.

12. Seek written authorisations and keep copies

• If you are directed to supply data or to have a person authorised to prosecute you or an entity under s 23 appears, retain copies of all written authorisations, directions and notices (s 21 describes how notices may be given by post and proof of posting). Documentation of receipt and the form of any direction will help in defending against compliance disputes.

13. Ensure officers observe secrecy obligations

• If you are a Statistician’s officer or collector, strictly observe s 17 and s 18. Implement training on the statutory confidentiality obligations and sanctions for undue disclosure.

14. Update contractual clauses and supplier arrangements

• If you rely on third parties for data or run shared facilities, ensure contractual arrangements permit the collection of returns, authorise sharing of required data with the Statistician, and include confidentiality obligations aligned with ss 17-18.

15. Monitor regulations and any Commonwealth arrangements

• Because many operational details depend on regulations (s 24) and because Part I is subject to Commonwealth arrangements (s 1B; s 25), regularly review relevant State and Commonwealth websites, and subscribe to legislative update services to track changes.

16. Seek pre‑emptive legal advice where uncertain

• Where the scope of a required return or the interaction with other laws (for example, data protection regimes not referenced in the Act) is unclear, obtain legal advice to assess risk and to plan for potential administrative directions or prosecution.

These compliance steps are grounded in the Act’s operative text: duties to fill forms and answer questions (ss 9-10), inspection powers (s 11), directions for fresh returns (s 12), secrecy obligations (ss 17-18), non‑production in court (s 19), and the regulation‑making head of power (s 24). Practical compliance is a mixture of procedural preparedness, documentation, staff training and active legal monitoring of regulations and any Commonwealth-State arrangement that may change administrative responsibilities or applicable powers.
