Statement of Principles concerning Zika virus infection (Balance of Probabilities) (No. 16 of 2018)

The instrument revolves around a small set of concrete legal-medical concepts. Each is defined in the text and the Schedule; the instrument confines its causal scope and evidentiary thresholds by those definitions.

Zika virus infection (s 6(2)): the Statement defines the condition narrowly as a symptomatic, clinical illness caused by the Zika virus, which has been confirmed by laboratory testing. The instrument therefore excludes asymptomatic Zika viraemia from its scope. The text also provides a non-exhaustive clinical note listing typical symptoms (rash, tiredness, headache, arthralgias, myalgias, non-purulent conjunctivitis, lower back pain and mild fever).

Death from Zika virus infection (s 6(3) and Schedule 1): death is covered only where a terminal event or condition was contributed to by the person’s Zika virus infection. The Schedule defines “terminal event” by reference to proximate or ultimate causes of death and lists pneumonia, respiratory failure, cardiac arrest, circulatory failure and cessation of brain function as examples.

Factors that must exist for a causal nexus (s 8): the RMA prescribes two alternative factual pathways. The first is a temporal and exposure nexus: being exposed to the Zika virus between one and 21 days before clinical onset. The second is an access-to-care pathway: inability to obtain appropriate clinical management for Zika virus infection. The Schedule defines “being exposed to the Zika virus” in five discrete ways: mosquito bite from an infected mosquito; presence in a country/area designated by a recognised health authority as experiencing current Zika virus transmission; percutaneous or mucocutaneous exposure to infected blood; sexual contact with an infected person; or receipt of infected blood products/transplants. The instrument’s note gives examples of recognised health authorities (WHO, CDC, national health departments), but those are notes, not definitions that narrow or widen legal operation beyond the Schedule text.

Relevant service (Schedule 1): the instrument limits application to persons whose service falls within specified categories , eligible war service (other than operational service), defence service (other than hazardous service and British nuclear test defence service) under the VEA, or peacetime service under the MRCA. That ties the causation rules to particular classes of veterans or service members.

Relationship-to-service principle (s 9): the Statement requires that the factor relied upon in s 8 must be related to the person’s relevant service. The access-to-care factor in s 8(2) is expressly limited to material contribution to, or aggravation of, Zika infection where the infection was suffered or contracted before or during, but did not arise out of, relevant service (s 9(2)).

Interaction with other Statements of Principles (s 10): if a factor in s 8 relates to an injury or disease for which another Statement of Principles exists, the factors in that other Statement apply in accordance with its terms. This creates a modular cross-reference system within the RMA statements.

Overall, the main concepts channel claims through a tight evidentiary pipeline: lab-confirmed symptomatic infection; an exposure route within a defined window; or a discrete access-to-care exception limited by timing and by the requirement that the factor is related to relevant service.

Primary affected persons

• Veterans and members of the Forces who are eligible to make claims under the Veterans' Entitlements Act 1986 or the Military Rehabilitation and Compensation Act 2004 and whose claims fall under the sections cited in s 4 (claims to which s 120B of the VEA or s 339 of the MRCA apply). The instrument itself identifies these claim categories; it does not list specific payments or benefits (s 4).

• Persons (or estates in death cases) alleging Zika virus infection or death from Zika virus infection in dates and circumstances that potentially connect to relevant service as defined in the Schedule. That includes persons whose service record places them in locations or circumstances where the Schedule’s exposure routes could be met (for example, overseas postings to areas with Zika transmission, or medical events involving blood products).

Secondary affected actors

• Medical assessors and decision-makers within whatever agencies or tribunals administer claims under the cited statutory provisions will use this Statement as the RMA’s causation rule for Zika. The instrument does not name the administrative decision-makers, but it applies to claims under the VEA and MRCA sections identified (s 4). Those assessors will need to apply the definitions and the two-factor gateway in s 8 and the relationship rules in s 9.

• Health services and record-keepers who hold laboratory confirmation, travel records, transfusion/transplant documentation, sexual exposure evidence or clinical management records. These records become the evidentiary basis for establishing the definitions and factors the Statement requires (s 6(2), s 8 and Schedule 1).

Groups excluded or differently affected by the instrument’s wording

• Persons with asymptomatic Zika infection are outside the Statement’s definition of Zika virus infection because the condition is defined as symptomatic clinical illness confirmed by laboratory testing (s 6(2)). The instrument therefore does not treat asymptomatic seroconversion as a compensable condition within this Statement.

• Cases where the only factual connection is outside the specified exposure window (not being exposed within one to 21 days before clinical onset) and where inability-to-obtain-care cannot be established, will not meet the s 8 gateway.

• Situations where a factor in s 8 refers to an injury or disease covered by a different Statement of Principles will be subject to that other Statement’s terms under s 10. The practical effect is that claimants with multiple possible causation links may need to meet the other Statement’s criteria.

Who bears the evidential tasks

• The Statement prescribes the factual structures that must be proved “on the balance of probabilities” (the instrument’s title and s 7). It therefore places an evidentiary obligation on claimants to present evidence of lab confirmation, timing of exposure and relationship to service, or evidence about inability to obtain appropriate clinical management where that route is relied upon (ss 6, 8, 9, Schedule 1). The instrument itself does not identify shifting burdens; it prescribes the facts that decision-makers should treat as capable of establishing a nexus if proven.

Duties imposed by the instrument are primarily evidentiary and definitional; the Statement sets thresholds and definitions rather than creating new affirmative operational obligations on third parties. Rights arise in the sense that the instrument creates recognisable factual pathways by which claimants can have Zika virus infection or death accepted as connected with relevant service.

Duty to meet definitional criteria

• A claimant asserting Zika virus infection must show the condition meets the defined medical criterion: symptomatic clinical illness caused by Zika virus and confirmed by laboratory testing (s 6(2)). Decision-makers are entitled to require evidence showing laboratory confirmation and a record of clinical symptoms consistent with the Note in s 6(2).

Duty to establish the s 8 factor(s)

• A claimant must establish at least one of the factors in s 8. For exposure, this requires proof that the person was exposed to Zika virus between one and 21 days before symptom onset (s 8(1)). The Schedule prescribes what kinds of exposure count (mosquito bite from an infected mosquito; presence in an area designated as having current transmission; percutaneous/mucocutaneous exposure to infected blood; sexual contact with an infected person; receipt of infected blood products/transplant) and provides for recognised health authority designations to identify transmission areas (Schedule 1).

• For the inability-to-obtain-appropriate-clinical-management factor, a claimant must show they were unable to obtain appropriate clinical management and (per s 9(2)) that this inability materially contributed to or aggravated the Zika virus infection, but only where the infection was suffered or contracted before or during (but did not arise out of) the person’s relevant service.

Duty to relate the factor to relevant service

• Any factor relied upon must be related to the person’s relevant service (s 9(1)). The Schedule defines relevant service by reference to specified categories under the VEA and MRCA. That means claimants must tie the exposure or inability-to-treat to the circumstances of their relevant service rather than to unrelated private-life events.

Rights conferred by the Statement

• Where a claimant satisfies the Statement’s definitions and factors, the RMA has recorded that, on medical-scientific evidence, it is more probable than not that Zika virus infection and related death can be related to relevant service (s 7). Practically, that gives claimants a recognised pathway for causation when their claim meets the prescribed facts , decision-makers applying the VEA/MRCA sections cited must take the RMA’s Statement into account.

• The instrument also preserves cross-application of other Statements: if a s 8 factor refers to an injury or disease governed by a different Statement of Principles, then the factors in that other Statement apply as they are in force from time to time (s 10). This secures a claimant’s right to have overlapping causal issues considered under applicable Statements.

Discretion and duties not specified

• The Statement does not define what constitutes “appropriate clinical management”, nor does it prescribe evidentiary standards beyond “lab-confirmed” infection and the presence of specified factors. The absence of a formal definition for “appropriate clinical management” allocates interpretive space to decision-makers when assessing assertions under s 8(2) and s 9(2).

• The Statement does not impose duties on third parties such as health authorities to provide evidence; rather it identifies the kinds of evidence and events that will count if established.

This Statement of Principles does not itself create civil or criminal penalties, nor does it specify enforcement mechanisms in the form of fines, disciplinary proceedings, or sanctions. Its legal effect is normative within the statutory framework from which it was made (s 3), namely under subsection 196B(3) of the VEA. The instrument is a determinative causation rule intended to inform decisions under sections of the VEA and MRCA (s 4). There are, however, several enforcement implications to note that follow from its use as a causation instrument:

Use in administrative decisions

• Decision-makers resolving claims under the sections identified in s 4 will apply the Statement when considering whether a Zika virus infection or death is connected with relevant service. The instrument supplies the factual thresholds (lab confirmation, exposure window, exposure routes, access-to-care exception) that will be assessed in adjudication. The Statement itself does not outline how claims will be administratively enforced or prosecuted if false evidence is presented, but its criteria are enforceable in the sense that a claim lacking the required facts will not satisfy the Statement’s causation pathways.

Evidence expectations and potential consequences

• Because the instrument demands laboratory confirmation for symptomatic infection (s 6(2)), lack of lab evidence is a practical barrier that will be decisive in claim outcomes. The Statement does not say what happens where a claimant deliberately falsifies evidence; any such conduct would be dealt with under other legal instruments or administrative rules, not by this Statement alone.

No penalties specified

• There are no provisions imposing penalties on medical practitioners, health authorities, claimants or any other parties for failing to comply with the Statement. The document is limited in scope to prescribing what factors will satisfy causation on the balance of probabilities when the Statement is applied.

Interaction with other legal regimes

• Section 10 establishes that factors referring to injuries or diseases covered by another Statement of Principles will be governed by that other Statement as in force from time to time. This provides an internal enforcement coordination mechanism among RMA Statements but does not create external penalties.

In sum, enforcement of the Statement’s rules occurs through administrative adjudication of entitlements under the VEA and MRCA sections identified; the instrument does not create separate punitive or enforcement regimes, nor specify sanctions against parties who fail to meet its criteria.

The Statement is explicitly positioned within the statutory framework of veterans’ entitlements and rehabilitation by cross-reference to the VEA and the MRCA.

Primary statutory anchoring

• The instrument is made under subsection 196B(3) of the VEA (s 3). It applies to claims to which section 120B of the VEA or section 339 of the MRCA apply (s 4). The Statement therefore functions as an RMA-prescribed causation rule that decision-makers must use when applying those statutory provisions to claims involving Zika virus infection or death from Zika virus infection.

Integration with other Statements of Principles

• Section 10 provides a direct mechanism for interaction with other RMA Statements: where a factor in s 8 refers to an injury or disease for which another Statement exists, the factors in that other Statement apply in accordance with its terms as it is in force from time to time. This creates a modular approach where overlapping medical issues are resolved through the applicable Statements. Practically, it requires decision-makers to check for other, possibly more specific Statements that might govern aspects of causation and to apply those provisions rather than treating this Statement in isolation.

Definitions that cross statutory boundaries

• The Schedule defines “MRCA” and “VEA” and “relevant service”, thereby tying the operational scope of the Statement to the statutory categories used in those Acts (Schedule 1). The Statement’s legal operation depends on how the VEA and MRCA define entitlements, relevant service and procedural rules in their own texts. The instrument does not reproduce the operative sections of the VEA or MRCA; it simply specifies that it applies to claims that fall under particular sections of those Acts (s 4).

Use of recognised health authorities

• The Schedule’s note supplying examples of “recognised health authorities” (such as WHO and the CDC) creates an evidentiary bridge between health-sector designations and legal causation under the VEA/MRCA. Decision-makers applying the Statement will therefore need to consider health authority determinations when assessing whether presence in a country or part of a country counts as “being exposed to the Zika virus” through local transmission.

No express conflict resolution clause beyond s 10

• Apart from the internal cross-reference in s 10, the Statement contains no express provisions about conflicts with non-RMA statutory or regulatory instruments (for example, public health powers, immigration law, or other compensation schemes). Its effect is limited to the VEA/MRCA claims context; outside that, other legal regimes operate independently.

Practical effects on claims involving multiple legal regimes

• If a claimant’s facts intersect other legal regimes (for example, a claim based on transfusion-acquired Zika where civil litigation or other compensation schemes are also possible), this Statement does not extinguish or modify those other regimes. It only states the RMA’s causation view for the purposes of adjudicating entitlement under the VEA/MRCA sections identified.

In short, interaction with other laws is mediated by three mechanisms in the instrument: (1) the statutory tie to sections of the VEA and MRCA (s 3-4), (2) the definitional links to “relevant service” in the Schedule, and (3) the cross-referencing rule in s 10 which brings other RMA Statements into play where relevant.

The instrument itself records its provenance and commencement but contains no text indicating subsequent amendments or a history of changes within the document provided.

Recorded dates and instrument identifier

• The Statement is titled Statement of Principles concerning Zika virus infection (Balance of Probabilities) (No. 16 of 2018) (Name: s 1). It bears the Repatriation Medical Authority seal and the instrument is dated 22 December 2017 (cover sheet). The instrument states that it commences on 29 January 2018 (s 2).

Authority for future variation

• The Statement is made under subsection 196B(3) of the VEA (s 3). That statutory provision supplies the RMA’s power to make Statements of Principles and therefore inherently permits the RMA to vary or revoke Statements under the statutory scheme; however, no variation, revocation or amendment is recorded in the instrument text provided.

Absence of recorded amendments

• There are no amendment clauses, transitional provisions, revocations of earlier Statements, or replacement enactments shown in the provided text. The only internal cross-reference concerns how this Statement will interact with other Statements (s 10). The document as presented is a freestanding Statement with the single commencement date noted.

Implications for practitioners

• Because the Statement lacks any recorded amendment history in the supplied text, users should treat the instrument as originating on the dates given and should check the RMA’s public registers and the VEA/MRCA administrative materials for any subsequent variations or revocation after the stated commencement date. The Schedule repeatedly notes that other Statements apply “as in force from time to time” (s 10), which demonstrates that Statements are living instruments; but no later versions or changes are contained in this text.

Administrative metadata

• The cover sheet includes the RMA Chairperson’s name and seal (Professor Nicholas Saunders AO), which is the administrative sign-off for the instrument. The instrument is presented as No. 16 of 2018, which serves as its identifier within the suite of RMA Statements.

In summary, the document as supplied shows a single issuance and commencement; no amendments or later legislative changes are recorded within the text provided.

The provided instrument contains no references to litigation, court decisions, tribunal determinations, or judicial consideration. It is a Statement of Principles set by the Repatriation Medical Authority and dated 22 December 2017, commencing 29 January 2018 (ss 1-2), but the text does not identify any cases, legal challenges, or prior rulings that concern this Statement.

What the text does record about evidentiary posture

• The RMA records its position that “on the sound medical‑scientific evidence available, the Repatriation Medical Authority is of the view that it is more probable than not that Zika virus infection and death from Zika virus infection can be related to relevant service” (s 7). That is a statement of the RMA’s scientific-causal conclusion, not an account of litigation history.

Practical implications for researchers and practitioners

• Because no litigation is cited, any question about how courts or tribunals have interpreted or applied this particular Statement cannot be answered from the instrument alone. Practitioners needing to rely on case law or tribunal decisions must consult external judicial and administrative records to determine whether and how this Statement has been treated in claims or appeals under the VEA and MRCA.

• The instrument does include a built-in provision that links to other Statements as they are “in force from time to time” (s 10). If litigation exists about overlapping Statements, that would not be disclosed in the present text and must be sought from primary case repositories and RMA administrative records.

In short, the instrument provides no litigation history and does not cite any adjudications that interpret, enforce or challenge its content.

This Statement contains several tightly phrased definitions and limits that can easily be overlooked or misunderstood; these are the practical “gotchas” that affect the strength and admissibility of claims.

Lab-confirmation requirement excludes asymptomatic infections (s 6(2))

• Zika virus infection is defined as symptomatic clinical illness confirmed by laboratory testing. Asymptomatic serological evidence without clinical illness does not meet the Statement’s definition. Practitioners should not assume seropositivity alone will satisfy the RMA’s condition.

Narrow exposure window: one to 21 days before onset (s 8(1))

• The exposure pathway requires that “being exposed” occur between one and 21 days before clinical onset. Timing is therefore critical. Claims relying on exposures outside that window will not satisfy the exposure factor. The Schedule’s definition of “being exposed” does not alter that window.

Multiple routes of “being exposed” with differing evidentiary traces (Schedule 1)

• The Schedule lists five discrete exposure routes (infected mosquito bite; presence in an area of current transmission as designated by a recognised health authority; percutaneous/mucocutaneous exposure to infected blood; sexual contact with an infected person; receipt of infected blood products/transplant). Each route generates different evidence types and strengths (e.g., travel records or public health designation for local transmission; transfusion records for blood products; sexual history or partner testing for sexual transmission). The instrument’s scope forces claimants and assessors to consider route-specific evidence.

Reliance on “recognised health authority” designations is evidentiary not exhaustive (Schedule note)

• The Schedule’s note gives examples of recognised health authorities (WHO, CDC, national government health departments), but those are examples in a note. Decision-makers will need to decide whether a particular designation is from a “recognised health authority” in each case; the note does not limit the class to the examples.

“Inability to obtain appropriate clinical management” is undefined and time-limited (s 8(2); s 9(2))

• The access-to-care factor lacks a statutory definition of “appropriate clinical management”. That creates interpretive scope for assessors. Additionally, s 9(2) restricts this factor to circumstances where infection was suffered or contracted before or during, but did not arise out of, relevant service, and it must materially contribute to or aggravate the infection. Practitioners should expect contested interpretations of what constitutes appropriate care and what evidence proves inability to obtain it.

Requirement that factor be “related to” relevant service (s 9(1))

• Any relied-on factor must be related to the person’s relevant service as defined in the Schedule. The instrument does not specify tests for “related to”; proving the nexus requires linking exposure or care access problems to service circumstances. Service records, location of deployment, timing and contemporaneous medical notes will be material.

Death coverage is contributory rather than exclusive (s 6(3); Schedule)

• Death is covered only where a terminal event or condition was contributed to by Zika virus infection. The Schedule enumerates terminal events by way of examples. A death certifying a terminal event will not automatically establish a causal link without evidence showing contribution from Zika infection.

Cross-application with other Statements (s 10)

• A factor in s 8 that refers to another Statement of Principles triggers application of that other Statement “as in force from time to time”. The relevant consequence is that claimants must track other Statements and any changes to them; they cannot rely solely on the Zika Statement where there is an overlap.

Administrative expectation, not criminal enforcement (Penalties and enforcement)

• The Statement does not create criminal or civil penalties. It is an administrative causation rule and must be used accordingly by decision-makers when adjudicating claims. Parties should therefore look to other statutory or administrative provisions for remedies against false statements or fraud.

Record quality will decide many outcomes

• The instrument’s reliance on lab confirmation, precise timing and explicit exposure routes means outcomes will often turn on record-keeping: laboratory results, clinical notes about symptom onset, travel documentation, transfusion/transplant records, partner testing, and contemporaneous evidence of care access problems.

In short, the “gotchas” are primarily definitional and evidentiary: narrow windows, required lab confirmation, undefined clinical-management standards, and the need to tie any factor to the person’s relevant service as defined in the Schedule.

For claimants, medical practitioners and decision-makers, compliance with the Statement requires focused evidence-gathering and clear demonstration of the relationships the instrument sets out.

What claimants should collect

• Laboratory confirmation of Zika virus infection: retain and provide contemporaneous laboratory test results demonstrating Zika virus infection, and clinical records documenting symptomatic illness consistent with s 6(2). The Statement requires laboratory confirmation for the condition to be within its scope.

• Precise symptom-onset documentation: clinical notes that record the date of onset of symptoms will determine the critical exposure window (s 8(1)). Where possible, obtain dated medical assessments or GP records noting symptom onset.

• Evidence of exposure in the one to 21 day window: depending on the exposure route relied on (Schedule 1), gather travel records, orders or deployment records showing presence in a country or area during a period designated by a recognised health authority as having current transmission; statements or contemporaneous notes about mosquito bites; transfusion/transplant documentation; records of sexual contact assessment if relevant; and documentation of percutaneous or mucocutaneous exposure to infected blood.

• Proof of relationship to relevant service: service records, posting rosters, deployment orders, travel authorisations, or other records connecting the exposure or inability-to-treat circumstances to the person’s relevant service (s 9(1); Schedule 1 definition of “relevant service”).

• Evidence for inability to obtain appropriate clinical management (where that factor is relied upon): contemporaneous clinical notes demonstrating referrals denied, lack of available-treatment resources, or other medical records showing that appropriate management could not be obtained and how that inability materially contributed to or aggravated the condition (s 8(2); s 9(2)). Because “appropriate clinical management” is not defined in the Statement, detailed factual records will be essential.

For estates in death cases

• Death certificate and medical records showing the terminal event, and medical evidence addressing whether Zika infection contributed to that terminal event (s 6(3) and Schedule 1). Provide laboratory confirmation of prior Zika infection if available and medical expert opinion linking the infection to the terminal event.

For medical assessors and decision-makers

• Verify laboratory results and clinical symptomatology against s 6(2). Confirm that the exposure alleged falls within the one to 21 day window and that the method of exposure is one of those listed in the Schedule (s 8(1); Schedule 1).

• Where the claimant relies on presence in a transmission area, consult recognised health authority designations for the relevant dates and locations. The Schedule’s note lists WHO, CDC and national health departments as examples; decision-makers should explain why a particular designation is accepted or rejected.

• For s 8(2)/s 9(2) cases, demand detailed evidence of inability to obtain appropriate clinical management and evaluate causation (material contribution or aggravation) with reference to contemporary clinical standards and the claimant’s medical history.

• Where overlap with other Statements occurs, apply s 10: identify the other Statement and apply its factors “as in force from time to time”.

Administrative best practice

• Maintain a checklist mapping the Statement’s requirements to evidence types: lab confirmation, symptom onset date, exposure route documentation, service nexus, evidence of inability to obtain care (if claimed), and in death cases, terminal event linkage.

• When factual ambiguity exists (for example, uncertain onset date or disputed travel dates), obtain contemporaneous corroborative records such as travel logs, military orders, clinic intake forms, blood transfusion/transplant records, or partner testing records.

• Document reasons for accepting or rejecting evidence in relation to the precise statutory definitions. Because “appropriate clinical management” is undefined, set out the adjudicative rationale when finding for or against the claimant on that factor.

Reasonable evidentiary standards

• The Statement operates on the balance of probabilities (s 7 title and text). Decision-makers should ensure their written findings make clear whether each element was established on that civil standard and why.

Inter-agency coordination

• Where claims involve health authority designations or blood-product testing, coordinate with public health units and transfusion services to obtain authoritative records. The Schedule itself anticipates reliance on recognised health authority determinations.

In sum, compliance requires targeted evidence: lab confirmation, signed clinical onset dates, route-specific exposure proof, service nexus documentation, and robust records where inability-to-treat is relied upon. Decision-makers must map evidence carefully to the Statement’s precise language and record the basis for their findings with reference to the relevant sections (ss 6-10; Schedule 1).
