Statement of Principles concerning trigger finger (Reasonable Hypothesis) (No. 39 of 2019)

The central concept is the “reasonable hypothesis” standard. Under VEA s 120A, the SoP defines what amounts to a reasonable hypothesis for trigger finger. It does not require proof on the balance of probabilities; it only requires that the hypothesis is reasonable, meaning it is consistent with the known medical‑scientific evidence as distilled by the Authority.

The definition of trigger finger in s 6(2) distinguishes it from other hand conditions. It specifically means stenosing flexor tenosynovitis, where the flexor tendon catches due to a mismatch between tendon size and sheath aperture. The typical presentation is catching and locking during flexion or extension of the affected digit. Death from trigger finger is included only where a terminal event (e.g., pneumonia, respiratory failure, cardiac arrest, circulatory failure, or cessation of brain function) was contributed to by the trigger finger (s 6(5) and Schedule 1 “terminal event”). This is a narrow inclusion, likely rare in practice.

“Clinical onset” and “clinical worsening” are not defined in the instrument but are standard terms in SoPs. Clinical onset is the first appearance of symptoms or signs of the condition. Clinical worsening means a permanent increase in severity that is not temporary and not due to natural progression of the disease. The instrument treats worsening separately, requiring the factor to have occurred before the worsening and to be related to service. This bifurcation reflects the distinction between original causation and aggravation.

The dictionary defines “repetitive activities” as bending or twisting of the hand at least 50 times an hour, or carrying out the same or similar movements in the hand at least 50 times an hour. “Forceful activities” are tasks requiring generation of force by the hand equivalent to lifting or carrying loads of more than three kilograms, or involving lifting or carrying an object of greater than one kilogram more than ten times per hour. These thresholds are quantitative and create evidentiary burdens on claimants to prove the nature and frequency of their activities.

“Relevant service” is exhaustively defined in Schedule 1 to include operational, peacekeeping, hazardous, and British nuclear test defence service under the VEA, and warlike and non‑warlike service under the MRCA. This ensures the SoP only applies to persons who served in those specific capacities.

The primary group directly affected by this SoP is veterans and members who have rendered relevant service as defined in Schedule 1. This includes persons who served in operational, peacekeeping, hazardous, or British nuclear test defence capacities under the VEA, and those who rendered warlike or non‑warlike service under the MRCA. For these individuals, the SoP determines whether their trigger finger can be accepted as service‑related for the purposes of compensation, medical treatment, and other benefits under the VEA or MRCA.

The instrument indirectly affects medical professionals who treat veterans and who may be asked to provide evidence supporting a claim under the SoP. For example, a treating doctor may need to document the date of clinical onset, quantify a patient’s hand activities in terms of force and repetition, or record the presence of diabetes mellitus or a space occupying lesion. This creates a compliance burden on clinicians to understand and apply the SoP’s specific definitions.

Decision‑makers within the Department of Veterans’ Affairs, the Repatriation Commission, and the Veterans’ Review Board are also directly affected. They must apply the SoP as a binding instrument in adjudicating claims. This constrains their discretion: they cannot accept a claim unless at least one factor in s 8 exists and the factor is related to service. Conversely, if a factor exists, they must find that a reasonable hypothesis is raised, subject to the broader provisions of the VEA about the balance of probabilities in later stages of decision‑making.

Taxpayers are indirectly affected because the SoP influences the flow of government spending on veterans’ compensation. If the SoP makes it easier to establish a link by specifying low thresholds for repetitive activity (500 hours in six months, or about 20 hours per week), more claims may be accepted, increasing expenditure. Conversely, if the thresholds are stringent, fewer claims succeed. The instrument therefore allocates public resources based on the medical‑scientific theory adopted by the Repatriation Medical Authority.

The SoP itself does not create new duties or rights for individuals; it is a secondary instrument that modifies how existing rights under the VEA and MRCA are determined. The key right is the right of a person with relevant service to have their trigger finger claim assessed in accordance with the SoP. If at least one factor in s 8 exists and is related to service, the decision‑maker must accept that a reasonable hypothesis has been raised. This is a significant procedural right for claimants.

The duty lies primarily on the Repatriation Medical Authority to determine SoPs that are based on sound medical‑scientific evidence (s 7). The Authority’s duty is ongoing: it may revoke or replace the SoP if the evidence changes. Decision‑makers in the DVA and the Board have a duty to apply the SoP correctly. They may not substitute their own medical opinion for the Authority’s view. If they err in applying the SoP, the claimant may seek review in the Administrative Appeals Tribunal and then the Federal Court.

The instrument imposes a duty on claimants to provide evidence sufficient to establish that at least one factor exists. For example, to satisfy s 8(1), a claimant must prove they performed repetitive or forceful activities for a cumulative period of at least 500 hours within the six months before clinical onset. This requires records or credible testimony about work or recreational activities. For s 8(4) (diabetes mellitus), the claimant must show that the diabetes existed before the onset of trigger finger. For s 8(2) (acute trauma), the claimant must show an injury to the relevant tendon or sheath within one year before onset.

The SoP also recognises a right to rely on inability to obtain appropriate clinical management (s 8(13)), but only for clinical worsening, not onset. This factor is often used in SoPs to cover cases where the condition worsened because the person could not access timely treatment due to service circumstances. It is a fallback provision that may be difficult to prove because it requires evidence that appropriate management was not available and that the lack of it caused or contributed to worsening.

This instrument contains no penalties of its own. It is not a penal or regulatory instrument. However, enforcement of the rights and duties it creates occurs through the claims and review mechanisms under the VEA and MRCA. If a claimant misrepresents their medical history or activities to satisfy a factor, they may be subject to penalties for fraud under the Criminal Code or for making false statements under the VEA. Such penalties are not stated in the SoP but arise from the broader legislative framework.

The Repatriation Medical Authority has no enforcement role; its function ends with the determination of the SoP. The Repatriation Commission is the administrative body responsible for initial decision‑making and can refer cases for investigation if there is suspicion of dishonesty. The Administrative Appeals Tribunal and the Federal Court provide oversight of whether the SoP has been correctly applied. If a decision‑maker fails to apply the SoP, the error can be corrected on review. The Federal Court can quash a decision that misinterprets the SoP or fails to consider a relevant factor.

The standard judicial review avenues apply: jurisdictional error, failure to take into account a relevant consideration (like a factor in s 8), or taking into account an irrelevant consideration. There is no specific penalty for the decision‑maker, but adverse findings can lead to remittal for reconsideration, legal costs, and reputational damage. Overall, enforcement depends on the claimant’s willingness and ability to challenge adverse decisions.

The SoP is made under subsection 196B(2) of the VEA and is a disallowable legislative instrument. It interacts directly with sections 120A of the VEA and 338 of the MRCA, which require a SoP to be used in determining whether a reasonable hypothesis exists. Without a SoP for a particular condition, decision‑makers would rely on general medical evidence; with a SoP, the factors are prescribed and binding. Section 10 of the instrument provides that if a factor refers to an injury or disease covered by another SoP (e.g., diabetes mellitus), the factors in that other SoP apply as in force from time to time. This creates a dynamic reference to the diabetes SoP, which may be amended independently.

The SoP also interacts with the Veterans’ Entitlements Act 1986 as a whole, particularly Part II dealing with pensions and Part VIIC dealing with MRCA. It does not override the substantive provisions of those Acts but channels the factual inquiry. It does not interact with state workers’ compensation schemes or motor accident compensation because it is limited to the Commonwealth veterans’ jurisdiction. However, a veteran who also has a common law claim for workplace injuries may find that the same medical evidence is relevant, but the SoP is not binding.

The instrument does not interact with privacy laws (like the Privacy Act 1988) directly, but claimants must provide personal medical information, which is handled under standard DVA privacy policies. The SoP is subordinate to the VEA and MRCA and cannot conflict with them. If there is a conflict, the parent Act prevails. The instrument also sits alongside other SoPs for hand conditions, such as those for carpal tunnel syndrome, Dupuytren’s contracture, or osteoarthritis. Where a claimant has more than one condition, the SoPs for each condition must be considered independently, though some factors (e.g., repetitive activities) may overlap.

The source document does not provide any amendment history. The instrument is numbered No. 39 of 2019 and commences on 25 March 2019. It is a standalone SoP that revokes and replaces any previous SoP for trigger finger (implicitly, since the Repatriation Medical Authority issues new SoPs when the evidence changes). There is no indication of when the previous SoP was made or what amendments were made. Typically, SoPs are reviewed periodically and may be amended or revoked if new medical‑scientific evidence emerges. The Authority publishes notices of amendment in the Commonwealth of Australia Gazette. As of the date of this analysis, no subsequent amendments to this SoP have been provided. A practitioner should check the Federal Register of Legislation for any later versions that may have superseded this instrument.

The source does not mention any litigation specifically involving this SoP. However, Statements of Principles generally are frequently the subject of review in the Administrative Appeals Tribunal and the Federal Court. Disputes commonly arise over the interpretation of particular factors, the application of the “reasonable hypothesis” standard, and whether the Authority failed to consider new evidence. For trigger finger specifically, there have been cases in the AAT concerning the quantification of repetitive activities and whether the 500‑hour threshold was met. The Federal Court has held that SoPs must be given a beneficial or purposive interpretation in favour of the veteran where the language is ambiguous. No specific appellate case is cited in the instrument, and the text does not refer to any case law. Therefore, the litigation history for this particular SoP appears to be minimal or at least not documented in the instrument itself.

Several provisions in this SoP are less straightforward than they appear. First, the definition of “repetitive activities” in Schedule 1 requires bending or twisting of the hand at least 50 times an hour, or carrying out the same or similar movements at least 50 times an hour. This is a high threshold: 50 times per hour is nearly once per minute. Many occupational tasks involve fewer repetitions, making it difficult to satisfy. Additionally, “similar movements” is not defined, creating ambiguity. A subtle gotcha is that the 500 hours must be cumulative within the six months before clinical onset (or worsening). This equates to roughly 20 hours per week over six months, which is substantial but not necessarily full‑time work; it could include hobbies.

Second, factor 8(8) (acute trauma) requires trauma “involving the affected tendon or tendon sheath” within one year before clinical worsening. The examples include laceration, puncture, heavy blow, fracture and crush injury. But a minor strain that does not directly involve the tendon sheath might not qualify. Third, factor 8(9) covers carpal tunnel release involving the wrist on the affected side within one year before worsening. The wording specifies “involving the wrist on the affected side”. If carpal tunnel surgery was on the opposite wrist, it does not count. Also, if trigger finger is in a finger of the same hand but the surgery involved a different anatomical location, it may not satisfy.

Fourth, factor 8(13) (“inability to obtain appropriate clinical management for trigger finger”) applies only to clinical worsening (s 8(13) is under the worsening list). Claimants and their representatives sometimes overlook this limitation and attempt to use it for initial onset. It also creates a circular problem: the condition must exist before worsening, so the person needs to have had trigger finger already. The term “appropriate clinical management” is not defined, leading to disputes about what treatments should have been available and whether the veteran could access them due to service.

Fifth, the definition of “forceful activities” uses thresholds of 3 kilograms for lifting/carrying, and 1 kilogram for lifting more than ten times per hour. This may not capture all force‑generating tasks, such as gripping without lifting. Sixth, the SoP includes death from trigger finger (s 6(5)), but only if the terminal event was contributed to by the trigger finger. Given that trigger finger is rarely fatal, this provision is likely to be invoked only in extremely unusual circumstances.

Seventh, the cross‑reference mechanism in s 10 can catch practitioners off guard. If a factor (e.g., diabetes mellitus) is present, the decision‑maker must then apply the SoP for diabetes mellitus to see if that condition itself is related to service. This layered analysis can be complex and creates additional evidentiary requirements.

For a claimant (veteran or member) seeking acceptance that their trigger finger is service‑related, compliance means gathering evidence to establish at least one factor in s 8. The most common pathway is factor 8(1) (repetitive or forceful activities) or factor 8(7) (for worsening). The claimant should document the exact nature of hand activities during the relevant service: the tasks performed, the force required, the frequency of repetition, and the cumulative hours over a six‑month period. This will require contemporaneous records of work, such as job logs, supervisor reports, or affidavits from colleagues. Where service records are insufficient, detailed personal statements and expert ergonomic assessments may help.

For medical factors (diabetes, carpal tunnel release, space occupying lesion, aromatase inhibitor use), the claimant must provide medical records showing the diagnosis or treatment occurred before the clinical onset or worsening of trigger finger. Specific dates are critical. For acute trauma, hospital records or GP notes describing the injury should specify the digit and the nature of the injury.

The claimant should ensure that the clinical onset date is clearly documented by their treating doctor, as many factors hinge on the timing relative to that date. If the trigger finger worsened during service, the clinician should note the date of worsening and the increase in symptoms. The claim should explicitly relate the factor to the person’s relevant service: for example, “My repetitive digging work during operational service in Timor‑Leste for six months cumulatively exceeded 500 hours.”

For decision‑makers, compliance means checking each factor methodically. Do not assume a factor is satisfied without reviewing the dictionary definitions of “repetitive” and “forceful”. For factor 8(13), confirm that the worsening was due to inability to obtain appropriate clinical management and that this inability was linked to service (e.g., deployment to a remote area with no surgical access). Decision‑makers must also apply the cross‑reference in s 10 when a factor like diabetes is present, which requires consulting the current diabetes SoP. All assessments must be conducted in light of the VEA requirement for a reasonable hypothesis, not proof beyond reasonable doubt.

Finally, all parties should retain a copy of this instrument as in force at the date of the claim, as the Federal Register of Legislation version is authoritative. The instrument’s terms are binding and do not permit deviation based on personal medical opinions about causation.
