Statement of Principles concerning trigger finger (Balance of Probabilities) (No. 40 of 2019)

Principal clinical concept

• Trigger finger is defined clinically as stenosing flexor tenosynovitis, a tendon entrapment of one or more digits where enlargement of the tendon or narrowing of its flexor pulley sheath prevents smooth tendon gliding (s 6(2)). The instrument notes typical presentation with catching and locking during flexion or extension, and clarifies that, although ICD‑10‑AM code M65.3 is associated with the condition, the statutory meaning is the clinical definition in s 6(2) (s 6(2)-(4)).

Balance of probabilities

• The SoP is expressly determined on the balance of probabilities. The RMA states, on the sound medical‑scientific evidence available, that it is more probable than not that trigger finger and death from trigger finger can be related to relevant service (s 7). The instrument therefore frames causal thresholds in probabilistic, not deterministic, terms.

Kinds of causal linkage

• The SoP articulates two broad causal linkages relevant to claim assessment:
  • Causation of trigger finger (new onset) by exposures or events occurring prior to clinical onset (s 8(1)-(5)).
  • Material contribution to, or aggravation of, pre‑existing trigger finger by exposures or events occurring prior to clinical worsening (s 8(6)-(10) and s 9(2)).
• Additionally, inability to obtain appropriate clinical management is included as a factor that may support connection (s 8(11)).

Quantitative and temporal thresholds

• For occupational exposure, two quantitative thresholds are defined:
  • A cumulative period of at least 500 hours within the six months before clinical onset (s 8(1)).
  • The same 500 hours within the six months before clinical worsening for material contribution/aggravation (s 8(6)).
• For acute trauma, the relevant temporal window is within one year before clinical onset or clinical worsening respectively (s 8(2), (7)).
• For pharmacological exposure to aromatase inhibitors, the relevant window is within one year before clinical onset or worsening (s 8(5), (10)).

Definitions that operationalise exposure

• The Schedule defines forceful activities and repetitive activities numerically (forceful activities: equivalent to lifting/carrying loads >3 kg or carrying an object >1 kg in the hand more than ten times per hour; repetitive activities: bending/twisting or same/similar movements in the hand at least 50 times per hour) (Schedule, Definitions). Those definitions interact with the 500‑hour cumulative rule and the six‑month window (s 8(1), (6)).

Relationship to service

• Any factor in s 8 must be related to the person’s relevant service (s 9(1)). Relevant service is defined in the Schedule and encompasses eligible war service, defence service (other than hazardous service and British nuclear test defence service) under the VEA, and peacetime service under the MRCA (Schedule, Definitions).

Interaction with other Statements of Principles

• If an s 8 factor refers to an injury or disease covered by another SoP determined under s 196B(3) of the VEA, then the factors in that other SoP apply according to its terms as in force from time to time (s 10). This creates an explicit cross‑reference mechanism between SoPs.

Death and terminal events

• Death from trigger finger includes death from a terminal event or condition to which the trigger finger contributed. The Schedule lists examples of terminal events that count, including pneumonia, respiratory failure, cardiac arrest, circulatory failure, and cessation of brain function (s 6(5), Schedule definition of terminal event).

Primary affected persons

• The immediate subjects are persons making a claim to which section 120B of the VEA or section 339 of the MRCA applies (s 4). That is, veterans or members of the Forces whose claims for entitlements under those statutory provisions involve an asserted connection between trigger finger or death from trigger finger and relevant service.

Decision‑makers and medical assessors

• Decision‑makers assessing such claims will use this SoP as the medical causal framework when determining whether on the balance of probabilities trigger finger or death from trigger finger is connected with relevant service. The instrument itself is made by the Repatriation Medical Authority (s 3) and records its medical‑scientific view (s 7). The instrument does not itself name administrative decision‑makers, but it applies to claims under the specified provisions (s 4), which places the SoP into the administrative adjudicative process for those claims.

Claim preparation professionals

• Practising lawyers, medical experts, allied health professionals, and those preparing claims or expert reports are affected because the SoP sets out the factors that, if established and related to service, will found a connection on the balance of probabilities (s 8, s 9). The numerical and temporal thresholds in the Schedule and s 8 will shape what evidence is material.

Dependants and estates

• Because the SoP includes death from trigger finger (s 6(1), (5)), dependants, beneficiaries and estates asserting death benefits that depend on causal link with service are affected. The inclusion of terminal events in the Schedule means a claimant must show contribution of trigger finger to death via a recognised terminal event.

Medical practitioners and recordkeepers

• The SoP’s reliance on clinical onset/worsening dates, medication histories, diagnoses such as diabetes mellitus, and evidence of trauma or space occupying lesions means that treating clinicians’ records, diagnostic imaging, operative notes and prescription histories will be central. The statutory definitions of forceful and repetitive activities introduce a need for factual evidence about task frequency and force generation in the claimant’s service and post‑service activities.

Pharmaceutical context

• Persons treated with aromatase inhibitors within one year before clinical onset or worsening are specifically named (s 8(5), (10)). This affects claimants who have such treatment histories and requires medication records to be examined.

Cross‑SoP implications

• Where an s 8 factor refers to another SoP, parties affected by that other SoP will be affected by the cross‑application, because the other SoP’s factors apply in accordance with its terms (s 10). This mechanic can expand the evidence that decision‑makers must consider.

Administrative bodies

• The instrument imposes no fines or direct statutory penalties, but it affects administrative decision‑making under VEA and MRCA frameworks because it dictates which medical and exposure factors are sufficient to meet the balance of probabilities test for the stated condition (s 4, s 7). Administrative bodies adjudicating such claims are therefore indirectly affected.

Duties arising from the SoP

• There are no express statutory "duties" imposed on members of the public in the instrument that carry penalties. Rather, the principal practical duty is evidentiary: a person asserting that trigger finger or death from trigger finger is connected with relevant service must establish, on balance of probabilities, the existence of at least one of the factors in s 8 and that the factor is related to the person’s relevant service (s 8, s 9(1)). This creates a duty on claimants to adduce medical and factual evidence sufficient to meet those thresholds.

Rights created or clarified

• The instrument creates a procedural and evidentiary right in the sense that claimants who establish an applicable factor related to service will have a recognised evidential head for connection. The SoP sets out what is sufficient to meet the causal connection on the balance of probabilities for the purposes of claims under the VEA/MRCA (s 7, s 8). It also clarifies that the ICD‑10‑AM code is not the exclusive definitional determinant, clinical meaning controls (s 6(3)).

Obligations on medical evidence

• The SoP places a practical obligation on medical experts and treating clinicians to record and opine about specific points the SoP lists: dates of clinical onset and worsening, presence of diabetes mellitus before onset/worsening, presence of space occupying lesion at onset/worsening, records of acute trauma within the one‑year windows, pharmacological histories including aromatase inhibitors within one year, and whether the claimant was unable to obtain appropriate clinical management (s 8(2)-(5), (7)-(11)). It also makes occupational exposure quantifiable through definitions of repetitive and forceful activities and the 500‑hour cumulative rule (s 8(1), (6) and Schedule definitions).

Interaction with relevant service requirement

• The SoP requires that any factor relied upon be related to the relevant service rendered by the person (s 9(1)). For the factors that pertain to aggravation or material contribution (s 8(6)-(11)), those provisions apply only where the person’s trigger finger was suffered or contracted before or during relevant service but did not arise out of it (s 9(2)). That creates a two‑part factual enquiry for such cases: (a) whether the person had pre‑existing trigger finger before/during service, and (b) whether the post‑service exposures materially contributed to or aggravated the condition before clinical worsening.

Cross‑SoP application duty

• Section 10 requires application of other SoPs where an s 8 factor refers to an injury or disease covered by another SoP. Practitioners therefore must identify whether an s 8 factor implicates another SoP and ensure the other SoP’s factors are applied as in force (s 10). This is a duty on advisers and experts preparing the claim, and an obligation on decision‑makers to import those factors.

Absence of penalties or private rights of enforcement

• The instrument does not create private causes of action, statutory penalties, or enforcement mechanisms within its text. Its function is to inform administrative entitlement decisions under the VEA and MRCA (s 4). Any rights or duties that give rise to remedies will therefore be those available under the VEA, MRCA and their administrative review processes, not under the text of this SoP itself.

No penal provisions in the instrument

• The SoP contains no provisions creating offences, penalties, fines, or enforcement mechanisms. The instrument is an administrative medical instrument under subsection 196B(3) of the VEA and records the Repatriation Medical Authority’s medical‑scientific view that certain factors are sufficient on the balance of probabilities to establish a connection between trigger finger (or death from trigger finger) and relevant service (s 3, s 7). The absence of penal text means there are no direct statutory sanctions in the SoP.

How it is enforced in practice

• Enforcement, in practical terms, takes place through the administrative decision‑making processes under the VEA and MRCA because the SoP applies to claims under those provisions (s 4). Decision‑makers assessing claims will apply the SoP as the authoritative medical causal guidance. If a claimant cannot establish the required factor(s) linked to relevant service, an entitlement claim may be rejected or reduced pursuant to the VEA/MRCA decision framework. However, the SoP itself does not set the procedural steps, review rights or remedial mechanisms; those are provided in the VEA, MRCA and associated administrative law.

Evidentiary role, not adjudicative power

• The instrument functions as a source of authoritative medical opinion for adjudication; it does not have adjudicative power. It specifies which factors are sufficient to establish a connection on a balance of probabilities (s 8, s 9). The SoP therefore guides evidence thresholds and the framing of medical opinions but is not an adjudicative decision on an individual claim.

Administrative discretion and review pathways

• While the SoP narrows or clarifies what evidence is sufficient for causal connection, the actual assessment of whether the claimant has met the balance of probabilities remains an exercise by the authorised decision‑maker under the VEA or MRCA. The SoP does not change existing administrative review or merits review pathways that apply to decisions under those Acts. The instrument does not itself alter rights of review or appeal available under the VEA or MRCA; any such procedural rights are contained in those Acts and their regulations.

No specified compliance regime or sanctions for false statements in SoP text

• The instrument does not include a compliance regime for false evidence or statements. Existing general provisions in the VEA, MRCA, and other statutes concerning false statements, fraudulent claims or misleading conduct (if any) are not modified by this SoP and are not set out in the instrument itself.

Applicability to VEA and MRCA claims

• The SoP is expressly made to apply to claims to which section 120B of the Veterans' Entitlements Act 1986 or section 339 of the Military Rehabilitation and Compensation Act 2004 applies (s 4). It is therefore integrated into the statutory frameworks governing entitlement decisions under those Acts.

Definition cross‑references

• The Schedule defines MRCA and VEA by acronym and defines relevant service to include several categories under those statutes (Schedule, Definitions). Those definitions connect the SoP to the substantive provisions and categories of service in the VEA and MRCA. The SoP does not purport to amend or displace the definitions in those Acts; it operates within their application by specifying medical causal factors for the condition.

Interaction with other Statements of Principles

• Section 10 provides an explicit interaction rule: where an s 8 factor refers to an injury or disease that is the subject of another SoP made under subsection 196B(3) of the VEA, the factors in that other SoP apply in accordance with its terms as in force from time to time (s 10). This creates a mechanism for cross‑application, meaning the SoP is not necessarily self‑contained where other conditions are referenced.

ICD coding vs statutory meaning

• The SoP notes that trigger finger attracts ICD‑10‑AM code M65.3 but insists that the meaning for the SoP is the clinical definition in s 6(2) (s 6(3)). The instrument also defines the relevant ICD‑10‑AM edition and effective date for reference (s 6(4)). This limits reliance on classification codes as substitute for clinical definitions when courts or tribunals interpret the SoP.

Medical evidence and other legislation

• The SoP requires proof of factual and medical elements such as diabetes mellitus, presence of a space occupying lesion, history of trauma, use of aromatase inhibitors, and inability to obtain appropriate clinical management (s 8). While the SoP does not alter privacy or health records law, it implicitly requires medical records, diagnostic imaging and pharmacological histories that are also regulated by health privacy and records legislation. The SoP does not provide access rights; it prescribes what evidence will be relevant in VEA/MRCA adjudication.

No effect on civil law causation doctrines beyond SoP context

• The SoP sets administrative evidentiary standards for entitlement claims under the VEA and MRCA. It does not purport to alter civil law causation doctrines in state or federal courts. The SoP’s probabilistic approach and specified factors are binding on claim assessment in the VEA/MRCA context but do not directly change tort or workers compensation law outside that statutory sphere.

Procedural law left unchanged in instrument

• The SoP does not specify procedural rules for making claims, time limits, or appeal processes. Those procedural matters remain governed by the VEA, MRCA and general administrative law. The SoP interacts with those laws by supplying the causal matrix for assessing claims, not the process for adjudication or review.

Instrument metadata and dates

• The instrument is titled Statement of Principles concerning trigger finger (Balance of Probabilities) (No. 40 of 2019) (s 1). It is dated 1 March 2019 and commenced 25 March 2019 (instrument header and s 2). The instrument records that the Common Seal of the Repatriation Medical Authority was affixed to it at the direction of the Chairperson (instrument header).

Scope of amendment history in the text

• The instrument itself contains no internal history of prior versions, repeals or amendments. It is presented as a standalone Statement of Principles determined under subsection 196B(3) of the VEA (s 3). There is no schedule within the instrument recording earlier SoPs or prior versions; nor does the text record any amendments by number or date. The only temporal markers are the date of determination (1 March 2019) and the commencement date (25 March 2019) (instrument header, s 2).

Cross‑application clause that anticipates change

• Section 10 anticipates that other Statements of Principles may be amended from time to time by providing that, where an s 8 factor refers to an injury or disease covered by another SoP, the factors in that other SoP apply in accordance with its terms as in force from time to time (s 10). This clause means that, although this instrument does not itself record subsequent amendments to other SoPs, it authorises application of those other SoPs as they change.

No express sunset, review or automatic amendment mechanism

• The instrument contains no express sunset clause, periodic review requirement, or automatic updating mechanism other than importing other SoPs as in force (s 10). Any amendment to this SoP would require the Repatriation Medical Authority to determine a further Statement of Principles under the statutory power in subsection 196B(3) of the VEA (s 3).

Practical consequence for practitioners

• Because the instrument makes cross‑reference to other SoPs as they stand from time to time (s 10) practitioners must monitor not only this SoP but also any other SoPs that are referenced by its factors for subsequent amendments. The instrument does not itself list the other SoPs by name; it applies the general cross‑application rule.

No litigation recorded in the instrument

• The text of this SoP does not record any case law, judicial decisions, or prior litigation arising from it. It contains no references to court challenges, declaratory proceedings, or precedent. The instrument is limited to the RMA’s Statement of Principles and does not include a litigation history section.

Implication for researchers and advisers

• Because there is no litigation history in the instrument, practitioners cannot rely on judicial interpretations of this specific SoP from the instrument text. Any legal arguments about the meaning or application of provisions such as the 500‑hour rule, the definitions of forceful and repetitive activities, or the scope of s 8(11) (inability to obtain appropriate clinical management) would need to be informed by decisions under the VEA/MRCA context, if any exist, or addressed in administrative review. That said, the SoP itself is an authoritative administrative medical position for decision‑making under the VEA/MRCA (s 3, s 7).

Where litigation may arise

• The instrument could generate disputes in administrative decision‑making contexts where claimants and decision‑makers disagree on whether the factual elements of an s 8 factor are made out and whether they are related to relevant service as required by s 9(1). Although no cases are recorded in the text, that is the procedural pathway where litigation or judicial review might later arise.

Terminology over ICD code

• The instrument emphasises that, although trigger finger attracts ICD‑10‑AM code M65.3, the meaning for the SoP is the clinical description in s 6(2) (s 6(3)). Relying solely on coding in medical records without clinical evidence showing the tendon entrapment and sheath pathology could be insufficient. Practitioners should ensure that medical opinions address the clinical criteria in s 6(2), not merely the diagnostic code.

Two distinct causal enquiries: onset versus aggravation

• The SoP treats onset and clinical worsening differently. Sections 8(1)-(5) address factors for clinical onset; sections 8(6)-(11), together with s 9(2), address material contribution to, or aggravation of, pre‑existing trigger finger. Subsection 9(2) expressly limits subsections 8(6)-(11) to cases where trigger finger was suffered or contracted before or during relevant service but did not arise out of it. That means the claimant must first establish timing of initial onset relative to service before relying on the aggravation provisions.

Quantitative thresholds that are potentially difficult to evidence

• The SoP requires a cumulative period of at least 500 hours within six months of clinical onset or worsening for the occupational exposure factors (s 8(1), (6)). The definition of forceful and repetitive activities in the Schedule sets rates (e.g. 50 actions per hour, or lifting >1 kg more than ten times per hour). The interaction of a cumulative-hours test with per‑hour frequency thresholds can be evidence‑intensive. Records of duties, rosters, task diaries and contemporaneous statements will usually be required to meet the numeric thresholds.

Burden to establish relation to relevant service

• Even when an s 8 factor is objectively present, s 9(1) requires that the factor be related to the person’s relevant service. The instrument does not prescribe how relation to service is proved. Practitioners must therefore gather service records, task descriptions, deployment histories and medical records to connect the factor to the specific period of relevant service defined in the Schedule.

Definition points that change thresholds

• The Schedule defines forceful activities as equivalent to lifting or carrying loads of more than three kilograms, or carrying an object in the hand greater than one kilogram in excess of ten times per hour. Repetitive activities are defined by 50 movements per hour (Schedule, Definitions). Small differences in task descriptions or job roles can therefore push a claimant either above or below the numerical thresholds. Expert opinion will often be required to translate duties into the defined units.

Ambiguity around "clinical onset" and "clinical worsening"

• The instrument uses the terms clinical onset and clinical worsening but does not define them. The absence of statutory definitions means clinicians and decision‑makers will need to rely on medical records and expert interpretation to fix the dates that trigger the temporal windows (s 8(1), (6), (2), (7), etc.). This creates an evidentiary issue where onset/worsening dates are imprecise or gradual.

"Inability to obtain appropriate clinical management" is open‑ended

• Section 8(11) lists inability to obtain appropriate clinical management as a factor. The SoP does not define what constitutes appropriate clinical management, nor does it set temporal or causal parameters for this factor. Demonstrating this factor will therefore require evidence of attempts to obtain care, barriers encountered, and a causal link between lack of management and onset or worsening, all linked to relevant service per s 9(1).

Space occupying lesion and examples

• The SoP treats presence of a space occupying lesion at the time of clinical onset or worsening as a factor (s 8(4), (9)) and provides examples such as amyloid deposit, gouty tophus, granuloma and post‑surgery adhesion (notes to s 8(4), (9)). The presence of such lesions typically requires imaging or histopathological evidence. Absence of such evidence will preclude reliance on these factors.

Pharmacology window requires recent treatment records

• The SoP specifies being treated with an aromatase inhibitor within one year before clinical onset or worsening as a factor (s 8(5), (10)) and lists examples of agents. Practitioners must obtain prescription and dispensing records, oncology notes and treatment timelines to establish this factor.

Cross‑SoP import may expand obligations

• Section 10’s importation of other SoPs as they exist from time to time means that the factors relevant to a claim may depend on multiple SoPs. Identifying and applying the up‑to‑date version of any referenced SoP is therefore necessary, and failure to do so may omit crucial factors or evidence that the other SoP requires.

No penalties spelled out in the instrument

• Because the SoP contains no penalty or enforcement provisions, parties may mistakenly look to it for guidance on sanctions or obligations beyond evidentiary sufficiency. The SoP’s scope is limited to medical causation guidance for entitlements under the VEA/MRCA (s 4). Procedural or disciplinary consequences arise from those Acts and general law, not from the SoP text.

Assemble a targeted evidence bundle

• For any claim invoking this SoP, compile a focused evidentiary bundle addressing each possible s 8 factor the claimant wishes to rely upon. This should include:
  • Clear documentation of dates of clinical onset and any clinical worsening, from treating clinicians, to fix the temporal windows required by s 8(1)-(11).
  • Service records, task descriptions, rosters, and contemporaneous duty statements to demonstrate performance of repetitive or forceful activities and to quantify cumulative hours over the six months before onset or worsening (s 8(1), (6) and Schedule definitions of forceful and repetitive activities).
  • Medical records showing diagnosis of diabetes mellitus and the date of diagnosis prior to onset or worsening (s 8(3), (8)).
  • Imaging, pathology, or surgical reports evidencing space occupying lesions at the time of onset or worsening (s 8(4), (9)).
  • Trauma records, incident reports, emergency department notes, or operative records showing acute trauma to the affected tendon or sheath within one year of onset or worsening (s 8(2), (7)).
  • Medication records, oncology treatment notes and dispensing histories confirming treatment with aromatase inhibitors within one year before onset or worsening where relevant (s 8(5), (10)).
  • Documentation evidencing inability to obtain appropriate clinical management where that factor is relied upon: referral letters, wait‑list correspondence, appointment refusals, access barriers and contemporaneous notes showing deterioration attributable to lack of management (s 8(11)). Given the SoP requires that any factor be related to relevant service (s 9(1)), the inability to obtain management must be connected to service circumstances.

Use expert reports that map evidence to the SoP

• Obtain medico‑legal or specialist reports that state explicit opinions framed against the SoP: identify which of s 8’s factors are present, the relevant dates, and whether the factor is related to relevant service as required by s 9(1). For aggravation claims, the report should address whether trigger finger pre‑existed before or during service and whether the subsequent exposure materially contributed to or aggravated the condition (s 9(2)). Experts should expressly address clinical onset and clinical worsening dates because those terms are not defined in the instrument.

Quantify exposure against the numerical tests

• Where relying on repetitive or forceful activities, experts and fact witnesses should convert duties into the SoP’s numerical units: at least 50 movements per hour or equivalent, and cumulative at least 500 hours in the six months before onset or worsening (s 8(1), (6) and Schedule definitions). Where lifting thresholds are invoked, establish the weight and frequency numbers that meet either the >3 kg single‑lift equivalence or the >1 kg carried more than ten times per hour test as specified in the Schedule.

Address relation to relevant service

• Because every employed factor must be related to relevant service (s 9(1)), compile service records, deployment histories and contemporaneous occupational descriptions that connect the identified factor to the period and nature of the person’s relevant service as defined in the Schedule. For claims under the MRCA or categories of service under the VEA, ensure evidence corresponds to the relevant category identified in the Schedule.

Consider cross‑SoP implications early

• If an s 8 factor refers to an injury or disease that is the subject of another SoP, identify that other SoP and ensure the claim addresses its factors, because s 10 requires application of those other SoP factors as in force (s 10). Practitioners should check for subsequent amendments to any referenced SoP.

Prepare for challenges on onset dates and chronicity

• Given clinical onset and worsening can be gradual or poorly documented, anticipate that decision‑makers will scrutinise contemporaneous records. Obtain GP notes, specialist clinic entries, allied health records and symptom diaries where available to triangulate onset/worsening dates.

Address pharmacological and comorbidity factors

• For diabetes mellitus and aromatase inhibitor treatment, obtain endocrinology and oncology records and medication charts to show diagnosis and treatment windows trumping the relevant time limits in s 8(3), (5), (8), (10).

Document attempts to obtain care

• If relying on s 8(11), document all attempts to obtain management and the nature of the barriers. Include referrals, waiting lists, communications with service health units, evidence of denied access, and contemporaneous clinical advice stating management was unavailable. Link the lack of care to clinical deterioration and to relevant service where applicable.

Use clear indexing and statements of reliance in submissions

• In the claim submission, index each piece of evidence to the relevant SoP subparagraph it supports (for example, s 8(1) or s 8(4)). Include a concise statement that maps facts and medical opinions to the statutory language of the SoP and to the requirement in s 9(1) that the factor be related to relevant service. For aggravation claims, explicitly address s 9(2) pre‑existence requirement.

Monitor other SoPs and the RMA

• Because s 10 imports other SoPs as in force, practitioners should check the Repatriation Medical Authority’s current SoP publications at the time of lodgement and before hearings to ensure the latest versions of any referenced SoPs are relied upon.

Anticipate the administrative balancing exercise

• The SoP reflects the RMA’s probabilistic view (s 7). Even where factors are present, decision‑makers still apply the balance of probabilities test to the totality of evidence. Prepare submissions that recognise competing causes and address why the SoP factors, combined with the claimant’s evidence, satisfy the required causal standard.

Recordkeeping and contemporaneous evidence practice

• Given the numerical and temporal thresholds, claimants with ongoing exposure should be advised to keep contemporaneous records of tasks, weights lifted, frequencies and any acute injuries. Medical practitioners should be encouraged to record onset and progression dates and to comment on any barriers to accessing appropriate management at the time of presentation.
