Statement of Principles concerning toxic vestibulopathy (Balance of Probabilities) (No. 89 of 2020)

The key medical‑legal concepts the Statement articulates are: the condition definition, the causal standard, the discrete factors establishing causation, temporal windows, the lists of implicated agents, the relationship to “relevant service”, and the treatment of overlapping Statements of Principles.

Definition of the condition: toxic vestibulopathy is defined as damage to the vestibular organs of the inner ear or the vestibular nerve resulting from exposure to a chemical agent and producing symptoms or signs of vestibular loss (s6(2)(a)). The definition expressly excludes balance impairment arising from brain or brainstem damage (s6(2)(b)). The instrument supplies a clinical note of typical symptoms and signs (nausea, vomiting, vertigo, dizziness, disequilibrium, nystagmus and oscillopsia) but the operative definition is damage to vestibular organs/nerve due to chemical exposure (s6(2) and Note).

Death: “death from toxic vestibulopathy” includes a death from a terminal event or condition to which the person’s toxic vestibulopathy contributed (s6(3)). “Terminal event” is defined in Schedule 1 to include listed proximate or ultimate causes such as pneumonia, respiratory failure, cardiac arrest, circulatory failure and cessation of brain function (Schedule 1).

Standard and evidential basis: the RMA states it is “of the view that it is more probable than not” that toxic vestibulopathy and death from it can be related to relevant service, based on the sound medical‑scientific evidence available (s7). This is an evidentiary statement by the RMA as the expert medical body; the instrument itself then prescribes the specific factors for determinations.

Factors and temporal windows: section 8 lists seven discrete, largely temporal or treatment‑response based, factors. Several factors require exposure to a specified drug or chemical agent within 30 days before clinical onset or clinical worsening (s8(1), s8(3), s8(4), s8(6)). Some factors require the drug treatment to have been continued for at least three days before onset or worsening (s8(2), s8(5)). Two factors require evidence that cessation or tapering of the drug led to a decrease in symptoms and signs within three months (s8(2)(b) and s8(5)(b)). One factor is inability to obtain appropriate clinical management (s8(7)).

Specified lists: Schedule 1 supplies the operative lists:

• Specified list of drugs: includes amiodarone; aminoglycosides; chloroquine; hydroxychloroquine; immune checkpoint inhibitors; loop diuretics; mefloquine; non‑steroidal anti‑inflammatory drugs; platinum‑based chemotherapy (cisplatin, carboplatin, oxaliplatin); and sotalol (Schedule 1).
• Specified list of chemical agents: aminoglycoside‑containing ear drops, Burow’s solution (5% aluminium subacetate), and surgical antiseptics (Schedule 1).

Inner ear exposure qualification: inner ear exposure to specified chemical agents is only taken to occur in the presence of a defect in the tympanic membrane (s8(3) Note 1 and s8(6) Note 1). This imposes an anatomical precondition for the chemical exposure mechanism.

Relationship to service: section 9 requires that any factor listed in s8 must be related to the person’s relevant service. The Schedule defines “relevant service” as a limited set of service types: eligible war service (other than operational service), defence service (other than hazardous service and British nuclear test defence service) under the VEA, or peacetime service under the MRCA (Schedule 1).

Interaction with other Statements: section 10 provides that if a factor in s8 refers to an injury or disease that is itself the subject of a different Statement of Principles, then the factors in that other Statement apply in accordance with their terms. This creates a cross‑reference mechanism allowing other SOPs to govern the causal connection for co‑morbid or causal conditions.

Operational mechanics: The RMA has determined these specific factors to be the medical foundation for connection. Decision‑makers under the VEA and MRCA will apply these factors when assessing claims to determine whether, on the balance of probabilities, the condition or death is connected with relevant service (s4, s7, s8, s9).

Primary affected parties:

• Veterans and members of the Forces who lodge claims under the VEA or MRCA where toxic vestibulopathy or death from toxic vestibulopathy is alleged. The instrument applies to claims to which section 120B of the VEA or section 339 of the MRCA applies (s4). The “relevant service” definition in Schedule 1 constrains which service categories are covered for the purposes of this Statement (Schedule 1).

Secondary affected parties and decision‑makers:

• Decision‑makers operating under the VEA or MRCA (claims assessors, medical officers, Veterans’ Review Board or tribunals as relevant) who must apply this Statement as the RMA’s medical findings when determining causal connection (s3, s4, s7). The Statement provides the medical causation framework those decision‑makers must use.
• Treating clinicians and medical experts who prepare evidence for claims, because the Statement prescribes specific clinical and temporal evidence that will be decisive for causation findings (s8, Schedule 1).

Administrative burden bearers:

• Claimants and their representatives, who must assemble medical and pharmaceutical records to establish the presence of one or more of the factors in section 8 and the relationship of those factors to the person’s relevant service (s8, s9).
• Defence and veterans’ affairs administrative units, insofar as they must obtain, review and weigh clinical records against the RMA’s factors.

Who does not fall within its scope:

• Persons whose service falls outside the statutory “relevant service” definitions in Schedule 1 are not within the instrument’s defined scope for these purposes. The Schedule excludes operational service and hazardous service in certain categories (Schedule 1 definition of relevant service).
• Balance impairment caused by brain or brainstem damage is expressly excluded from “toxic vestibulopathy” (s6(2)(b)). Claims for balance impairment that are primarily central (brain/brainstem) in origin are not governed by this Statement.

Effects on private medical practice and prescribing:

• The Statement identifies specific drugs and chemical agents that can cause toxic vestibulopathy for the purposes of claims (Schedule 1). This will influence what prescribing histories and ENT examinations are collected in claims. It may change which historical records are considered decisive in claims assessments.

Effects on proof and evidentiary collection:

• Because the factors are factual and temporal (for example, exposure within 30 days; drug continued at least three days; improvement within three months of cessation), claimants are affected in how they must document onset dates, prescription and administration dates, tympanic membrane status, and any documented clinical improvement after stopping drugs (s8, Schedule 1).

Geographic and temporal scope:

• The instrument applies to claims lodged after its commencement for persons whose relevant service falls within the Schedule definition; it does not itself state retrospective limitations beyond the general operational application under the VEA/MRCA (s2, s4). The instrument commenced on 30 November 2020 (s2).

This Statement does not itself create new statutory duties or rights; instead it defines the medical criteria that decision‑makers under the VEA and MRCA must use when determining whether toxic vestibulopathy (or death from it) is connected with relevant service. The duties and rights that are implicated arise from how the Statement is applied within the VEA and MRCA claims processes.

Duties for decision‑makers:

• Apply the RMA’s Statement of Principles as the medical foundation for causation when assessing claims to which section 120B VEA or section 339 MRCA apply (s4). The RMA instrument states the factors that “must exist” before a connection can be said to be established on the balance of probabilities (s8).
• Ensure any factor relied upon is related to the person’s relevant service (s9(1)). Decision‑makers must make a link between factual factor(s) and the period/type of service the Schedule defines as relevant.

Duties for clinicians and experts providing evidence:

• Provide the specific factual and clinical information the Statement requires, because the factors hinge on dates of drug exposure, duration of therapy, documented clinical onset/worsening, documentation of improvement within a three‑month window after cessation, and evidence of tympanic membrane defects where inner ear exposure to chemical agents is asserted (s8, Schedule 1).
• Where a factor refers to an injury/disease that is the subject of another Statement, apply the factors and terms of that other Statement as in force (s10). Expert reports must therefore be aware of overlap with other SOPs.

Rights of claimants:

• Claimants retain the procedural rights and entitlements available under the VEA and MRCA frameworks; the Statement operates as the medical test for causal connection used by decision‑makers (s4, s7). The Statement gives claimants clarity on what medical facts are required to meet causation on the balance of probabilities.
• For death claims, claimants may rely on the Statement to link a terminal event (as defined in Schedule 1) to prior toxic vestibulopathy where the evidence shows toxic vestibulopathy contributed to the terminal event (s6(3)).

Operational constraints and limits:

• Factors 4 to 7 apply only to material contribution to, or aggravation of, toxic vestibulopathy where the person’s toxic vestibulopathy was suffered or contracted before or during (but did not arise out of) relevant service (s9(2)). This limits the circumstances in which worsening during/after service can be treated as related to service.
• Inner ear exposure to specified chemical agents requires a tympanic membrane defect (s8(3) Note 1 and s8(6) Note 1), which imposes an evidential precondition that must be proven for chemical exposure claims.

Standard of proof and the RMA’s role:

• The RMA declares that, on the sound medical‑scientific evidence available, it is more probable than not that toxic vestibulopathy can be related to relevant service (s7). This is the RMA’s expert statement; the actual entitlement determination remains with the decision‑maker under the VEA/MRCA applying the SOP’s factors and the legal standard of the relevant statutory scheme.

No new procedural remedies or compensation rates:

• The instrument specifies medical causation criteria; it does not specify or alter the statutory benefits, procedural remedies, appeals routes or compensation schedules under the VEA or MRCA. Those rights and duties remain in the underlying Acts and regulations.

The Statement of Principles instrument itself contains no penalty provisions, enforcement mechanisms or criminal sanctions. It is a technical medical instrument, not a punitive or regulatory statute. The role of the instrument is evidentiary and determinative for causation in statutory claims, rather than coercive.

How enforcement operates in practice:

• Enforcement in this context is achieved indirectly through application in claims decision‑making under the VEA and MRCA. Decision‑makers are required by the statutory scheme to consider RMA Statements of Principles as authoritative medical findings when assessing causation. The instrument therefore has force in administrative determinations rather than by imposing penalties (see s3 and s4 for authority and application).
• If a decision‑maker departs from the Statement in a claim determination, the procedural mechanisms for review or appeal under the VEA/MRCA and associated review bodies would be the pathway to challenge such departures. This instrument does not itself establish review procedures.

Implications for medical evidence and records:

• Because the Statement prescribes specific factual and temporal elements (for example: drug exposure within 30 days of onset, three‑day minimum drug exposure, improvement within three months of cessation, tympanic membrane defect for inner ear exposure), decision‑makers will evaluate medical records against those criteria. The practical effect is that claims lacking the prescribed documentation may be rejected on causation grounds. That is an administrative effect rather than a statutory penalty.

No monetary fines or criminal liability in the instrument:

• The Statement does not create any fines, offences, or disciplinary sanctions for individuals or clinicians. It does, however, create a de facto compliance standard for proof: absent the factors the RMA specifies, causation on the balance of probabilities may not be established for the purposes of entitlements.

Potential administrative consequences:

• An adverse claims decision based on the application of the Statement can generate administrative outcomes (denial of claims, refusal of benefit), which are enforceable by the relevant benefit payment machinery of the VEA/MRCA. Those consequences are managed through the usual claims and review apparatus in the statutes rather than by the Statement itself.

Decision‑maker discretion and compliance oversight:

• The Statement does not prescribe how decision‑makers should weigh evidence when a factor is present but contested on credibility or interpretation. That remains a matter of administrative judgement under the VEA/MRCA decision framework. Likewise, it does not provide compliance audit processes; oversight of decision‑makers’ application of the Statement occurs through the statutory accountability and review mechanisms in the VEA/MRCA systems, not the Statement instrument.

The Statement is expressly an instrument under s196B(3) of the VEA and is designed to be used within the VEA and MRCA decision‑making frameworks. Its interaction with other law is primarily as an evidentiary medical instrument incorporated into statutory claims processes.

Primary statutory interactions:

• Application to specific claims: the instrument applies to claims to which section 120B of the VEA or section 339 of the MRCA apply (s4). Those statutory sections govern the legal treatment of medical causation and entitlement within the respective Acts; the Statement supplies the medical findings that decision‑makers must apply under those legal frameworks.
• Authority source: the Statement is made under the RMA’s statutory powers in s196B(3) of the VEA (s3). The RMA’s determinations are intended to inform how decision‑makers apply the causation rules in the VEA/MRCA.

Interaction with other Statements of Principles:

• Section 10 establishes that where a factor in this Statement refers to an injury or disease that is the subject of another Statement determined under subsection 196B(3) of the VEA, then the factors in that other Statement apply in accordance with that other Statement as in force from time to time. This creates a networked application; cross‑condition causation may be governed by multiple RMA determinations and the most relevant Statement’s terms will apply to the linked condition.

Overlap with clinical and administrative law:

• The Statement prescribes factual and clinical tests (time windows, response to drug cessation, tympanic membrane defect). Those requirements interact with evidentiary law in administrative decision‑making; for example, the availability of medical records, standards for admissible expert evidence, and the administrative burden of proof in claims. The Statement itself does not set evidentiary rules but will be applied within the evidentiary and procedural rules of the VEA/MRCA claims system.

No direct modification of criminal, drug control, workplace safety or civil liability law:

• The instrument does not purport to alter criminal law, regulatory controls on medicines, occupational health and safety duties, or civil tort rules. It is narrowly focused on the causal link between toxic vestibulopathy and “relevant service” for veterans’ entitlements. If the condition also gives rise to other legal claims (for example, workers’ compensation, medical negligence, or civil damages), the Statement may be referenced as medical evidence but does not bind other legal processes.

Definitions that affect cross‑statute interpretation:

• The Schedule’s definition of “relevant service” (Schedule 1) narrows the categories of service for which this SOP provides a causal connection framework. Decision‑makers applying other statutes that use differing definitions of service must be attentive to any definitional misalignment between this Statement and the other statute.

Administrative decision review and appeals:

• Because the Statement functions within the VEA/MRCA claims apparatus, any disputes over how the Statement has been applied in an entitlement decision will proceed under the review and appeal mechanisms of those Acts. The Statement does not itself create a new right of appeal or judicial review procedure.

Temporal interaction and potential supersession:

• Section 10 contemplates that other Statements may apply “as in force from time to time”, so changes to other Statements of Principles can affect how this Statement operates in respect of related injuries or diseases. The RMA may update Statements; decision‑makers and practitioners must therefore track changes to other Statements that may affect linked factors.

The instrument itself contains limited temporal data. It records:

• The instrument was dated 30 October 2020 (cover page) and it commenced on 30 November 2020 (s2).
• It was made under subsection 196B(3) of the VEA (s3).

No amendments, revisions or prior versions are recorded within the text supplied. The instrument does not include historical notes or a schedule of prior versions or amendments. It also does not record any sunset clause, periodic review obligation, or automatic expiry date.

Consequences of the information provided:

• As drafted, the Statement’s operative text is the version that commenced on 30 November 2020. Any later amendments to the Statement would need to be located in later RMA instruments or official amendment instruments; none are included here.
• Section 10 explicitly contemplates that other Statements of Principles may be “in force from time to time”, implying that the RMA expects Statements to be updated periodically; however, this instrument does not itself set an update mechanism or timetable.

Practical implications for practitioners:

• Practitioners must use the version of the Statement in force at the time of the claim’s determination. Since the Statement does not include amendment history, practitioners should confirm whether later RMA determinations or amendments exist beyond this instrument when preparing or prosecuting claims.
• The instrument’s reliance on “sound medical‑scientific evidence available” (s7) suggests the RMA’s findings are evidence‑based at the time of issue; changes in medical knowledge could prompt future amendments, but the text here does not record any such changes.

No recorded transitional or grandfathering provisions:

• The instrument does not specify transitional arrangements for claims lodged before commencement, nor does it state whether it applies retrospectively. The general statutory framework of the VEA/MRCA and their implementing regulations would determine transitional application. The instrument itself simply states its commencement date (s2) and its application to claims to which the defined statutory sections apply (s4).

Repository and next steps:

• Because the instrument is an RMA determination, any future amendments or replacement Statements would be documented by the RMA in subsequent instruments. Practitioners should check the RMA’s instrument register and the consolidated Statements of Principles to identify amendments beyond the 30 November 2020 commencement version.

The supplied instrument contains no litigation history. It does not identify any cases, appeals or judicial determinations that have interpreted or tested this particular Statement of Principles. There are no judicial citations, no references to administrative review outcomes, and no annotations in the text reflecting prior disputes.

Potential areas likely to generate litigation or review (based on instrument content):

• Interpretation of temporal terms such as “clinical onset”, “clinical worsening”, and the precise computation of the 30‑day window in s8(1), s8(3), s8(4), s8(6). These terms are factual and may be contested where onset dates are ambiguous.
• The requirement that, for certain factors, drug therapy be continued “for at least the three days before the clinical onset” (s8(2), s8(5)), and proof of symptom decrease “within three months” of discontinuing or tapering (s8(2)(b), s8(5)(b)). Disputes may arise as to whether an observed clinical change meets those temporal windows.
• The tympanic membrane defect requirement for inner ear exposure to chemical agents (s8(3) Note 1 and s8(6) Note 1). Litigation or review could arise where the presence of a defect is not contemporaneously documented and must be inferred or where documentation is equivocal.
• The application and scope of s9(2), which restricts subsections 8(4) to 8(7) to cases where the person’s toxic vestibulopathy was suffered or contracted before or during (but did not arise out of) relevant service. Questions may arise about how to determine whether the condition “arose out of” relevant service or whether it was merely aggravated.
• The meaning and evidential weight of “inability to obtain appropriate clinical management” (s8(7)). Because the instrument does not define “inability” or “appropriate clinical management”, administrative decision‑makers may need to develop standards that could be challenged in review.

Procedural review avenues:

• Any challenge to a decision that applies the Statement would follow the VEA/MRCA appeal and review pathways. The Statement does not itself change those judicial or administrative review mechanisms; it serves as the medical basis that those reviewing bodies would analyse.

Absence of precedent in the instrument:

• Because no cases are cited or referenced, there is no internal judicial gloss on the Statement’s terms in the supplied text. Users of the Statement should not assume any particular judicial interpretation and should be prepared to argue interpretations based on the instrument’s text and the underlying clinical evidence.

Practical note for practitioners:

• In the absence of litigation history provided here, practitioners should anticipate that contested claims will turn on factual proofs (dates, clinical records, tympanic membrane evidence, drug cessation and response) and on administrative law principles applied by the relevant tribunal or review body. Collecting contemporaneous clinical documentation that maps precisely onto the factual requirements in s8 and Schedule 1 will reduce risk of adverse findings.

This Statement contains multiple specific, technical requirements that can be decisive in claims. Practitioners and claimants should be alert to the following traps and interpretive pitfalls.

1. Narrow time windows are determinative

• Several factors require exposure within 30 days before clinical onset or clinical worsening (s8(1), s8(3), s8(4), s8(6)). If the documented exposure falls outside the 30‑day window, the factor cannot be relied upon under that provision. Claimants must document exact dates of drug administration, chemical exposure, and clinical onset/worsening.

2. Some factors require at least three days of treatment immediately before onset/worsening

• Factors in s8(2) and s8(5) require that treatment with the drug continued for at least the three days before the clinical onset or worsening. Shorter or intermittent courses or gaps that mean the drug was not continued for those three days may defeat reliance on those factors.

3. Improvement within three months after stopping or tapering is required in two factors

• For s8(2) and s8(5), the Statement requires that the individual experienced a decrease in symptoms and signs within three months of discontinuing or tapering the drug. Failure of symptoms to show improvement within that timeframe can negate reliance on those factors even if a temporal association exists.

4. Inner ear exposure requires tympanic membrane defect

• The Statement explicitly notes that inner ear exposure to specified chemical agents “will only occur in the presence of a defect in the tympanic membrane” (s8(3) Note 1 and s8(6) Note 1). Absent clinical evidence of tympanic membrane perforation or comparable defect, chemical exposure factors for inner ear exposure cannot be established.

5. The lists of drugs and chemicals are finite

• Only the drugs and chemical agents listed in Schedule 1 qualify as “specified list of drugs” or “specified list of chemical agents”. Exposure to unlisted agents will not satisfy the s8 factors that require specified‑list exposure. The list includes, for example, aminoglycosides (drug and ear‑drop chemical entries), amiodarone, mefloquine, platinum‑based chemotherapy, immune checkpoint inhibitors and NSAIDs (Schedule 1). Claims relying on agents not on the list must instead establish causation under other medical evidence, but the RMA’s Statement will not assist for those unlisted agents.

6. Factors 4-7 are limited to aggravation/interaction scenarios

• Subsections 8(4) to 8(7) apply only where the person’s toxic vestibulopathy was suffered or contracted before or during, but did not arise out of, relevant service and the exposure materially contributed to or aggravated the condition (s9(2)). This excludes scenarios where the condition itself arose out of relevant service; the legal mechanism and available factors differ in those circumstances.

7. “Relevance” to service must be shown

• Section 9(1) requires that any factor used from s8 must be related to the person’s relevant service. A factor that exists but cannot be connected to the service period or type defined in Schedule 1 will not satisfy the causation requirement. The Schedule’s “relevant service” definition excludes certain service types (for example, operational or hazardous services noted in Schedule 1). Proof of the specific service period is therefore essential.

8. “Inability to obtain appropriate clinical management” is undefined

• s8(7) provides a factor that could be attractive in some cases, but the Statement does not define “inability” or “appropriate clinical management” nor does it specify required documentary proof. Decision‑makers will therefore exercise discretion in evaluating such claims, and claimants should provide contemporaneous evidence of attempts to obtain care, refusals, resource constraints, or other objective proof.

9. Death claims require linking toxic vestibulopathy to a terminal event

• For death claims, the Statement covers death from a terminal event that was contributed to by toxic vestibulopathy (s6(3)). Practitioners need to map the causal chain from toxic vestibulopathy to the listed terminal events in the Schedule (pneumonia, respiratory failure, cardiac arrest, circulatory failure, cessation of brain function). Simply showing toxic vestibulopathy on a death certificate is insufficient; the contribution to the terminal event must be evidenced.

10. Cross‑references to other Statements can change applicable factors

• If a factor in s8 refers to another injury or disease covered by its own Statement of Principles, the factors in that other Statement apply as in force (s10). This means that the legal and evidentiary requirements may change depending on cross‑references, and practitioners must check linked Statements for additional or alternative tests.

11. Clinical provenance and records are critical

• The Statement’s reliance on specific clinical indicators (onset/worsening dates, tympanic membrane status, treatment durations and response) makes contemporaneous, well‑dated records decisive. Retroactive or vague clinical statements are less likely to satisfy the stated factors.

12. RMA’s position is evidence‑based but not determinative of entitlement

• The Statement declares the RMA’s medical position (s7), but entitlement decisions remain statutory determinations under the VEA/MRCA. Practitioners should not conflate the RMA Statement with an automatic entitlement; it is a necessary medical foundation for causation but not sufficient on its own to guarantee a favourable administrative outcome.

For claimants, representatives, clinicians and decision‑makers, compliance with the Statement’s requirements is primarily evidential and procedural: collect, document and present the specific facts the Statement requires, and ensure a clear link to the defined “relevant service”.

1. Establish the service nexus

• Confirm the claimant’s service type and dates against the Schedule 1 definition of “relevant service” (Schedule 1). Document service records that show the claimant’s service fell within the eligible categories specified.

2. Document clinical onset and worsening precisely

• Record exact dates (or best estimates supported by contemporaneous notes) for clinical onset and any clinically documented worsening. The factor thresholds use precise time windows (30 days before onset/worsening) and are sensitive to date calculations (s8(1), s8(3), s8(4), s8(6)). Where onset is gradual, obtain clinical expert evidence to estimate onset reasonably on the balance of probabilities.

3. Collect complete medication administration histories

• For any asserted drug exposure from the specified list (Schedule 1), assemble pharmacy dispensing records, prescription instructions, inpatient medication administration charts, allied health notes, and any documentation that shows treatment duration, start date, stop date, and whether the drug was continued for at least three days before clinical onset/worsening where required (s8(2), s8(5)). For drugs given in a hospital setting, obtain inpatient drug charts.

4. Demonstrate response to drug cessation or tapering if relying on s8(2) or s8(5)

• If relying on the treatment‑response factors, provide contemporaneous clinical documentation that symptoms/signs decreased within three months of discontinuing or tapering the drug (s8(2)(b), s8(5)(b)). Objective measures or clinician statements comparing baseline and follow‑up vestibular testing (where available) will assist.

5. Prove tympanic membrane defect where chemical exposure is asserted

• For claims alleging inner ear exposure to specified chemical agents, obtain ENT examination records, otoscopic images, tympanometry, or operative reports demonstrating a tympanic membrane defect prior to or at the time of exposure (s8(3) Note 1 and s8(6) Note 1). Lack of documentation of a defect will likely preclude reliance on the chemical‑exposure factors.

6. Use the specified lists literally

• Refer to Schedule 1 when asserting a specified drug or chemical agent. Provide evidence that the substance used is one of the entries. Do not assert causation from substances outside the listed items unless alternative medical causation evidence is presented and the decision‑maker is persuaded outside the RMA factors.

7. Address “inability to obtain appropriate clinical management” carefully

• If relying on s8(7), provide documentary proof of attempts to obtain care (appointments scheduled and missed for lack of availability, referrals refused, remote area access issues, records showing no access to required specialists) and contemporaneous clinical notes describing inability to obtain management. Because the Act does not define “inability” or “appropriate clinical management”, build a clear factual record of barriers to care.

8. For death claims, map the causal chain to a terminal event

• When the claim involves death, ensure medical records and cause‑of‑death documentation link toxic vestibulopathy to the terminal event listed in Schedule 1 (pneumonia, respiratory failure, cardiac arrest, circulatory failure, cessation of brain function) and show that the vestibulopathy contributed to or precipitated the terminal event (s6(3), Schedule 1).

9. Provide expert opinion tied to the Statement’s factors

• Medical expert reports should directly address the s8 factors and demonstrate, on the balance of probabilities, how factual evidence satisfies a specific factor. Experts should avoid general causation opinions that do not map onto the discrete temporal and response criteria set out in the Statement.

10. Anticipate cross‑references to other Statements

• Check whether any s8 factor refers to an injury/disease that is the subject of another RMA Statement. If so, procure and apply the factors from that other Statement as in force (s10). Experts should identify whether alternative SOPs apply and provide opinions accordingly.

11. Maintain contemporaneous records and chain of custody

• Because the Statement relies heavily on dated clinical and pharmacy records, ensure timely collection, retention and, where appropriate, authenticated copies of records. Where records are absent, create a credible evidential foundation through affidavits, corroborating documentation, and expert opinion explaining gaps.

12. Prepare for possible adjudicative scrutiny

• Given the specificity of the factors and time windows, expect decision‑makers to scrutinise the timing, dosage, continuity of treatment, tympanic membrane findings, and clinical response. Frame evidence so it addresses these points directly and quantifiably.

13. Update practice to reflect the Statement

• Clinicians treating personnel in relevant service contexts should record onset dates, vestibular testing, tympanic membrane status and clear documentation of treatment changes and responses, anticipating the use of such records in claims relying on this SOP.

14. Check for later RMA amendments or related SOPs

• Since the Statement is part of an evolving suite of RMA determinations, verify whether later Statements or amendments alter the factors or lists included here, especially where s10 indicates cross‑application. The instrument as supplied commenced 30 November 2020 (s2); later versions may differ.

By following these steps and mapping documentary evidence directly to the statutory factors (s8 and Schedule 1), claimants and their advisers are better positioned to meet the RMA’s medical causation framework and to prepare evidence that decision‑makers under the VEA and MRCA can apply coherently.
