Statement of Principles concerning tooth decay (dental caries) (Reasonable Hypothesis) (No. 74 of 2024)

The central concept is "tooth decay (dental caries)". The instrument defines it as the localised destruction of dental hard tissues (enamel, cementum or dentine) by dental plaque, leading to demineralisation or cavity formation. It explicitly excludes dental pulp and periapical disease, tooth loss, and tooth wear. This means a claimant cannot use this SoP to claim for a tooth that has been lost or worn down, even if decay was a contributing factor. The instrument cross-references ICD-10-AM codes K02.0, K02.1, K02.2, K02.3, K02.5, K02.8 and K02.9 but states that the meaning of tooth decay for the SoP is the one given in the instrument, not the code assignment. This creates a potential source of confusion if medical records use ICD codes differently.

The concept of "reasonable hypothesis" is not defined in this instrument but is referenced from the VEA and MRCA. The SoP is made on the basis that the Repatriation Medical Authority is satisfied there is sound medical-scientific evidence that tooth decay can be related to relevant service (section 8). The factors in section 9 are the minimum necessary to raise such a hypothesis. The instrument also distinguishes between "clinical onset" and "clinical worsening". Several factors apply to both, but factor 12 (inability to obtain appropriate clinical management) applies only to clinical worsening, not onset. That reflects a policy choice: poor management after onset may aggravate decay, but earlier service factors are needed for initial causation.

"Relevant service" is defined in the dictionary to mean operational service, peacekeeping service, hazardous service, or British nuclear test defence service under the VEA, or warlike or non-warlike service under the MRCA. This excludes peacetime service that does not fall into those categories, such as some forms of reserve service. The instrument also defines "one pack-year" as 20 cigarettes per day for one year or 7,300 grams of smoking tobacco by weight, with a calculation formula. This is important for factor 7 (smoking at least 3 pack-years before clinical onset or worsening, with cessation within 10 years). The instrument also defines "terminal event" as six listed causes, including cardiac arrest and cessation of brain function.

A notable concept is "inability" in several factors - inability to obtain therapeutic fluoride, inability to perform effective personal cleaning, inability to access preventive professional dental care, and inability to obtain appropriate clinical management. The instrument gives examples for factor 9 (inability to perform personal cleaning) such as active combat, physical or severe mental disability, or fixed orthodontic appliances. But the instrument does not specify what standard of "inability" applies - whether it is a medical impossibility or a practical inability due to service circumstances. This creates uncertainty and likely leads to contestation over evidence of what the claimant could or could not do.

The instrument directly affects veterans, members of the Peacekeeping Forces, and members of the Forces under the VEA who have rendered relevant service, as well as members under the MRCA with warlike or non-warlike service. It also affects their dependants in death claims. Claimants seeking compensation or treatment for tooth decay must satisfy one of the enumerated factors, or they will not be able to establish a reasonable hypothesis connecting the condition to service. For veterans who served in non-operational, non-hazardous, non-warlike roles, the definition of relevant service may exclude them entirely unless their service falls under one of the specific categories listed. That is a significant limitation: a veteran who served only in peacetime training exercises, without operational deployment, will not have relevant service for this SoP and cannot use it to link tooth decay to service under the VEA.

The instrument also affects decision-makers. These include delegates of the Repatriation Commission under the VEA and the Military Rehabilitation and Compensation Commission under the MRCA. They must apply the factors mechanically. If a factor is not satisfied on the evidence, they must find that no reasonable hypothesis exists, regardless of other circumstantial evidence. This reduces discretion but also reduces the risk of inconsistent outcomes. The Administrative Appeals Tribunal and the Federal Court are also affected, as they must review decisions against the SoP.

Dental practitioners who provide evidence may be required to specify timeframes - for example, whether tooth wear existed for at least four weeks before clinical onset (factor 1), or whether dry mouth lasted three months (factor 4), or whether fluoride exposure was insufficient for at least one year continuously (factor 5). These are evidentiary burdens that may be difficult to prove retrospectively, especially for veterans whose service was decades ago. The instrument's factor about "inability to access preventive professional dental care at least every 15 months" (factor 10) could affect many veterans who served in remote locations or during active combat, but proving a negative - that they could not access care - is inherently challenging. Legal representatives for claimants must be familiar with the precise wording of each factor, including the time windows (e.g. within 2 years before clinical onset for many factors, within 5 years for fluoride and dental care access factors).

The instrument imposes no duties on claimants in the sense of obligations to act. Rather, it confers an evidentiary right: a claimant who can prove an applicable factor related to their service is entitled to have the decision-maker find that a reasonable hypothesis exists. That finding is a precondition for the claim to be considered under the reverse onus provisions in the VEA and MRCA. However, the right is heavily circumscribed by the specific terms of each factor. For example, factor 5 (inability to obtain therapeutic fluoride) requires that the inability existed "on more days than not for a continuous period of at least 1 year". A claimant who lacked fluoride for 11 months, or who had intermittent access every two weeks, would not satisfy the factor. The instrument also requires that the inability be to obtain fluoride in one of three listed forms: fluoridated drinking water with at least 0.5 mg/L, toothpaste with at least 1,000 ppm, or liquid/tablet/lozenge formulations. This narrows the definition significantly. For instance, topical fluoride varnish applied by a dentist once every six months is not listed, and a claimant cannot rely on it to satisfy the factor even if they otherwise lacked all other fluoride sources.

The right to rely on the factor is further limited by section 10, which requires that the factor be related to the person's relevant service. This is a separate causation step. Even if a factor exists (e.g. smoking 3 pack-years), the claimant must show that the smoking was related to their service - presumably that they smoked as a result of service stress, or that the start of smoking occurred during service, etc. The instrument does not provide examples of what "related to relevant service" means, leaving that to general law. This introduces uncertainty and invites litigation.

For decision-makers, the duty is to apply the instrument as a binding legislative instrument. They cannot create new factors or vary the timeframes based on clinical judgment alone. However, they must still weigh whether a factor is satisfied on the evidence. This is a duty to correctly interpret the instrument and apply it to the facts. The instrument gives no guidance on the standard of proof for proving a factor (beyond the reasonable hypothesis standard that applies overall), but the claimant bears the evidentiary burden of raising the factor.

This instrument does not impose penalties in the traditional sense. It is not a criminal or civil penalty provision. Its enforcement mechanism is the claims and review process under the VEA and MRCA. If a decision-maker incorrectly applies the SoP - either by failing to accept a factor that is satisfied, or by accepting a factor that is not - that decision can be appealed to the Veterans' Review Board, the Administrative Appeals Tribunal, and ultimately the Federal Court. The primary "penalty" for an erroneous decision is financial: a veteran who is wrongly denied compensation loses access to a lump sum or periodic payments, while a veteran who is wrongly granted compensation receives public money that may later be recovered if the error is corrected. There is no personal liability for decision-makers who err in good faith.

The instrument itself does contain one important enforcement-related provision: section 11 states that if a factor refers to an injury or disease covered by another Statement of Principles determined under subsection 196B(2) of the VEA, then the factors in that other SoP apply. This means that a claimant who relies on factor 3 (therapeutic radiation to head or neck) must also satisfy the requirements of any SoP that covers radiation-related conditions if those conditions are referred to. In practice, this incorporates other SoPs by reference and means that the enforcement of this SoP may depend on proving factors in other instruments. That increases the overall compliance burden for claimants with complex conditions.

The Repatriation Medical Authority is responsible for maintaining and updating SoPs, but there is no penalty for failing to update a SoP within a certain timeframe. The instrument itself is subject to disallowance by Parliament under the Legislation Act 2003, but that is a rare occurrence. The practical enforcement of the SoP is through the claims adjudication process, and the ultimate sanction for a poorly drafted SoP is that it may be judicially reviewed and declared invalid if it exceeds the Authority's power or is not based on sound medical-scientific evidence. That is a high bar.

This instrument is made under subsection 196B(2) of the Veterans' Entitlements Act 1986, and its operation is subordinate to that Act and to the Military Rehabilitation and Compensation Act 2004. It does not replace or override the substantive provisions of those Acts, but it fills in the evidentiary requirements for the "reasonable hypothesis" standard in sections 120A (VEA) and 338 (MRCA). Without this SoP, decision-makers would have to determine on general medical evidence whether a hypothesis is reasonable. The SoP converts that open-ended inquiry into a checklist of factors. It is therefore a key piece of delegated legislation that shapes the rights and obligations under the primary Acts.

The instrument explicitly interacts with other Statements of Principles through section 11. If a factor in this SoP refers to an injury or disease for which another SoP exists, the factors in that other SoP apply as in force from time to time. For example, factor 4 (dry mouth resulting from severely reduced saliva flow) notes that xerostomia can result from surgery, Sjögren syndrome, or a wide variety of drugs. If the underlying cause of xerostomia is a condition that has its own SoP - such as Sjögren syndrome - then the claimant might need to satisfy both SoPs. This creates a cascading effect where proving entitlement to compensation for tooth decay may require proving entitlement for another condition first.

The instrument also interacts with the ICD-10-AM classification system, but only for noting purposes. The definition of tooth decay in the instrument is authoritative; the ICD codes are merely references. This means that a medical report that diagnoses "K02.9 - Dental caries, unspecified" will not automatically satisfy the definition if the clinical notes show only tooth loss or wear, because those are excluded. Decision-makers must look behind the code to the clinical description.

The instrument does not interact with state or territory health laws, nor with dental boards or professional standards. It is confined entirely to the Commonwealth veterans' and military compensation systems. It also does not affect private dental insurance or Medicare claims for dental treatment. Its scope is limited to determining liability for compensation under the VEA and MRCA.

This instrument repeals and replaces the Statement of Principles concerning dental caries (Reasonable Hypothesis) (No. 122 of 2015), which was in force from 2015 until 18 November 2024. The 2015 instrument was made under the same legislative power. The new instrument commences on 19 November 2024. The instrument states that it is based on the Repatriation Medical Authority's view that there is sound medical-scientific evidence of a relationship between tooth decay and relevant service (section 8). There is no explanatory statement or amendment history provided in the instrument itself; we only know the preceding instrument's registration number.

The differences between the 2024 and 2015 versions are not listed here, but a comparison would be necessary for any practitioner advising on historical claims. The 2015 SoP would have applied to claims lodged before 19 November 2024. The new instrument applies to claims to which sections 120A or 338 apply, without transitional provisions. This could create a situation where a claim lodged before commencement is decided after commencement, and the decision-maker must apply the new SoP if it has effect from the date of determination. But the instrument's application clause (section 5) says it applies to a claim to which those sections apply; it does not limit itself to claims lodged after commencement. It would likely be interpreted as applying to all claims decided after its commencement, subject to any general principles of retrospectivity.

The instrument itself is not subject to ongoing amendment; it is a standalone determination. The Repatriation Medical Authority may issue further SoPs in the future if medical evidence changes or new factors emerge. The repeal of the 2015 SoP is immediate and unconditional.

As this instrument is new, there is no litigation history specific to it. However, previous Statements of Principles concerning dental caries and other conditions have been the subject of litigation in the Federal Court and the Administrative Appeals Tribunal. Disputes typically involve whether the Repatriation Medical Authority acted within power, whether the factors are based on sound medical-scientific evidence, and whether the standard of "reasonable hypothesis" has been correctly applied. The Authority's decisions have been upheld in most cases, but courts have occasionally found that a factor is too vague or that the Authority did not properly consider conflicting evidence.

A recurring issue in SoP litigation is the meaning of "related to relevant service". The instrument does not define this phrase, and it has been interpreted by the Full Federal Court in other contexts. Claimants may argue that a factor such as smoking or poor diet was caused or influenced by service conditions. The instrument's silence on this point leaves room for argument. Another issue is the "inability" factors: whether the inability must be due to service or merely co-exists. For example, a veteran may have had a fixed orthodontic appliance placed before service, and the instrument says the inability to clean due to that appliance must be related to relevant service. But if the orthodontic appliance was placed before service and not caused by service, the factor may not be satisfied.

Practitioners should expect disputes over the fluoride factor (factor 5). Proving the fluoride concentration of drinking water over a continuous one-year period, especially for historical service locations, is difficult. Similarly, proving "inability to access preventive professional dental care at least every 15 months" requires evidence of what dental services were available at the service location and whether the claimant could have physically or logistically accessed them. The Administrative Appeals Tribunal has, in other SoP cases, accepted circumstantial evidence for such factors, but the burden remains on the claimant.

Several aspects of this instrument create traps for unwary claimants and practitioners.

First, the definition of tooth decay excludes dental pulp and periapical disease. A claimant with a toothache caused by pulpitis or an abscess at the tooth root cannot rely on this SoP even if the pulpitis was caused by untreated decay. They would need a separate SoP for pulp disease or periapical disease, if one exists. Similarly, tooth loss alone is not covered, nor is tooth wear.

Second, the factor for tooth wear (factor 1) requires wear involving the affected tooth for at least four weeks before clinical onset. This is a short timeframe but may still be difficult to prove for conditions that develop slowly. The factor does not specify the degree of wear, only that it existed.

Third, factor 5 (inability to obtain therapeutic fluoride) requires a continuous period of at least one year where fluoride was absent "on more days than not". A claimant who had access to fluoridated water for six months and then lost access for six months may not satisfy the factor if they had fluoride more days than not over the year. The factor also only accepts three forms of fluoride; fluoride from dental varnish, mouthrinses, or food sources is not counted.

Fourth, the dietary factor (factor 6) has two alternative limbs: consuming sugar or processed starch continuously over at least 6 hours per day, or on at least 10 separate occasions per day with more than 30 minutes between exposures. These are very specific thresholds. Occasional snacking, even if frequent, may not meet the "continuous" limb. The factor requires a continuous period of at least three months within two years before onset.

Fifth, factor 9 (inability to perform effective personal cleaning) gives examples including active combat, physical disability, severe mental disability affecting self-care, and fixed orthodontic appliances. The "fixed orthodontic appliance" example does not require that the appliance was related to service; it only requires that the inability to clean was present. But section 10 still requires that the inability be related to relevant service. If a veteran had braces before service and could not clean them properly due to deployment, they would need to show the deployment caused or worsened the inability.

Sixth, factor 10 (inability to access preventive professional dental care at least every 15 months) applies within five years before clinical onset or worsening. This is a broad factor that could cover many veterans who were on extended deployments. But it requires proving a negative - that the veteran could not access care. If the veteran was offered dental care but refused it, the factor likely is not satisfied.

Seventh, factor 12 (inability to obtain appropriate clinical management) applies only to clinical worsening, not to clinical onset. This means a veteran who developed tooth decay after service and then could not get treatment cannot use this factor to argue service caused the initial decay. It only potentially aggravates existing decay.

Eighth, the instrument applies only to claims under sections 120A of the VEA and 338 of the MRCA. These provisions cover the reasonable hypothesis standard. Claims under the Safety, Rehabilitation and Compensation Act 1988 (DRCA) for peacetime service of a different kind are not covered, even if the veteran served in the ADF. This is a limitation that can catch practitioners used to the broader compensation system.

Ninth, the definition of "relevant service" does not include peacetime service that is not classified as operational, hazardous, or British nuclear test defence service under the VEA, or warlike/non-warlike under the MRCA. A veteran who served only in Australia during peacetime, with no operational deployment, may have no relevant service for this SoP at all.

Tenth, the note under factor 4 about xerostomia lists drugs including anticholinergics, tricyclic antidepressants and amphetamines. But the factor itself simply requires dry mouth from severely reduced saliva flow for a continuous period of at least three months. A veteran whose dry mouth was caused by other medications not listed can still satisfy the factor if the dry mouth exists, regardless of cause. The note is not exhaustive.

For claimants and their representatives, compliance with this instrument means gathering evidence that matches the precise wording of at least one factor in section 9. The evidence must be contemporaneous where possible, but retrospective reports from dental practitioners or historical service records may suffice. The following practical steps are relevant:

• Document the clinical onset date of tooth decay, based on dental records or clinical diagnosis.
• Identify which factor(s) may apply. For example, if the veteran smoked heavily during and after service, check whether they smoked at least 3 pack-years and whether the decay began within 10 years of quitting. Obtain a smoking history with pack-years calculated.
• For the fluoride factor, obtain evidence of the fluoride concentration of the water supply at the veteran's location during service, or more conveniently if the veteran used fluoridated toothpaste regularly, show that they could not obtain it (e.g. deployed to an area where it was unavailable). But the factor requires "inability to obtain" - so if the veteran had access but chose not to use it, the factor is not satisfied.
• For the dietary factor, collect dietary histories that quantify sugar and processed starch intake. Logging six continuous hours of consumption or ten separate occasions per day is a rigorous task; claimants may need to reconstruct diets from memory or service canteen records.
• For inability factors, obtain medical or service records showing combat deployment, disability affecting self-care, or the presence of fixed orthodontic appliances. Also obtain evidence that the inability was related to service - e.g. a medical report tying the disability to a service injury.
• For factor 10 (inability to access preventive dental care), locate evidence of the dental services available at the service location and the veteran's inability to attend (e.g. due to operational tempo, logistical barriers, or being a prisoner of war).
• Factor 11 (prisoner of war) is straightforward if the veteran was a POW; obtain official records.

Claimants should also be aware of the interaction with other SoPs (section 11). If a factor (such as therapeutic radiation) refers to another condition, the claimant must comply with that other SoP's factors as well. This may require additional evidence.

For decision-makers, compliance means applying the instrument strictly. They should not accept a factor if the evidence does not meet the timeframes or durations. They should also ensure that any factor used is "related to the relevant service" as per section 10. For example, if a veteran developed tooth decay from a high-sugar diet while on operational deployment, that diet factor would be related to service. But if the veteran consumed a high-sugar diet at home and then served later, without the diet being service-related, the factor would not be satisfied even if the decay occurred within the timeframe. Decision-makers should ask whether the factor itself was caused or influenced by the service, or whether it simply happened to exist at the same time.

For legal practitioners, compliance means staying up to date with any subsequent changes to other SoPs that are incorporated by reference, and understanding the standard of proof for raising a reasonable hypothesis. The instrument itself does not provide guidance on what constitutes sufficient evidence of a factor; that is left to general administrative law principles. Given the specificity of the factors, it is likely that the Administrative Appeals Tribunal will require direct evidence, not mere speculation. Practitioners should also check whether the claim is under the VEA or MRCA, and whether the veteran has relevant service as defined, as this will dictate which factors are applicable and which sections are engaged.
