Statement of Principles concerning tooth decay (dental caries) (Balance of Probabilities) (No.75 of 2024)

This instrument is a Statement of Principles (SoP) determined under subsection 196B(3) of the Veterans' Entitlements Act 1986 (VEA). It specifies the medical and service-related factors that must exist before tooth decay (dental caries) or death from tooth decay can be accepted as connected with a person's relevant service on the balance of probabilities. The SoP replaces the previous SoP on dental caries (No. 123 of 2015) effective from 19 November 2024. It applies to claims under section 120B of the VEA and section 339 of the Military Rehabilitation and Compensation Act 2004 (MRCA).

Mechanically, the instrument performs several functions. First, it provides a precise definition of the disease it covers: "the localised destruction of dental hard tissues (enamel, cementum or dentine) by dental plaque, leading to demineralisation or cavity formation," and explicitly excludes dental pulp and periapical disease, tooth loss, and tooth wear (s 7(2)). Second, it lists eleven specific factors in section 9, at least one of which must be present and related to service before a causal connection can be found. Third, it defines the standard of proof as "balance of probabilities" (the instrument's title confirms this), meaning the decision-maker must be satisfied that it is more probable than not that the disease is service-related.

The instrument does not create a presumption that tooth decay is service-related; rather, it sets evidentiary hurdles that a claimant must clear. It also does not deal with all forms of military service: "relevant service" is defined in the dictionary as eligible war service (other than operational service), defence service (other than hazardous service and British nuclear test defence service) under the VEA, or peacetime service under the MRCA. Operational service, hazardous service, and British nuclear test defence service are deliberately excluded from this SoP because those categories typically fall under a different evidentiary standard (reasonable hypothesis) determined under subsection 196B(2) of the VEA. The effect is that claimants with operational service will need to rely on a separate SoP, if one exists, or argue their claim under the reasonable hypothesis test.

The instrument also deals with clinical worsening (s 9 factors and s 10(2)), but only where the person's tooth decay was suffered or contracted before or during (but did not arise out of) their relevant service. This limits the scope of aggravation claims: a veteran who developed tooth decay entirely unrelated to service but then experienced worsening due to a service-related factor may establish a claim under this SoP, provided the worsening factor is related to service.

From an economic and regulatory perspective, this SoP imposes compliance costs on claimants and the Department of Veterans' Affairs (DVA). Veterans must gather evidence to prove one or more factors and the relationship to service, which may require dental records, service records, and expert reports. DVA must train decision-makers and allocate resources to assess claims. The instrument does not itself mandate any preventive or treatment measures; it is purely a compensation eligibility tool.

Tooth decay (dental caries) is defined restrictively in section 7(2). It is the localised destruction of enamel, cementum, or dentine by dental plaque leading to demineralisation or cavity formation. Conditions such as pulp disease, periapical disease, tooth loss, and tooth wear are specifically excluded, even though they may be related to caries progression. This means a claim for dental pulpitis alone would not fall under this SoP; it may need to be assessed under another SoP or on its own merits. The instrument references ICD-10-AM codes K02.0, K02.1, K02.2, K02.3, K02.5, K02.8 and K02.9 but clarifies that the definition in the instrument prevails over any coding classification.

Relevant service is a term of art defined in the dictionary. It covers only three categories of service: eligible war service (non-operational) under the VEA, defence service (non-hazardous, non-British nuclear test) under the VEA, and peacetime service under the MRCA. This excludes the most intense forms of service - operational service (war-like service) and hazardous service (including certain peacekeeping and warlike operations). As a result, a veteran who served in a combat zone but is claiming under a non-operational service category would not have their claim assessed under this SoP. The rationale is that the VEA provides a different evidentiary standard for operational service (reasonable hypothesis) which is deemed to be more generous to the claimant, while this SoP applies the balance of probabilities standard for non-operational, peacetime, and defence service.

Balance of probabilities is the standard of proof specified in the instrument's title. Section 120B of the VEA and section 339 of the MRCA require that SoPs be determined for claims where the standard is balance of probabilities. This SoP is the instrument that establishes the minimum requirements for a positive finding. If a claimant cannot establish at least one factor in section 9 related to service, the claim must be refused (unless an exception such as a separate SoP for a linked disease applies). The decision-maker cannot rely on general history or unsupported medical opinion; the factor must be one that the Repatriation Medical Authority (RMA) has determined, based on sound medical-scientific evidence, is necessary for a connection.

The factors in section 9 are the core of the instrument. They include: tooth wear on the affected tooth for at least 3 months before clinical onset (factor 1); gingival recession exposing root surface for at least 3 months before onset of root surface caries (factor 2); therapeutic radiation to the head or neck within 2 years before onset or worsening (factor 3); xerostomia (dry mouth due to severely reduced saliva flow) for at least 3 months within 2 years (factor 4); inability to obtain therapeutic fluoride exposure (via fluoridated water, toothpaste, or supplements) on more days than not for at least 1 year within 5 years (factor 5); consumption of sugar or processed starch for at least 6 hours per day or on at least 10 separate occasions per day for at least 3 months within 2 years (factor 6); smoking at least 6 pack-years (with cessation within 5 years) before onset or worsening (factor 7); chewing tobacco use for at least 10 years on more days than not (with cessation within 5 years) before onset or worsening (factor 8); inability to perform effective personal cleaning of the affected tooth for at least 3 months within 2 years (factor 9); inability to access preventive professional dental care at least every 15 months within 5 years (factor 10); and inability to obtain appropriate clinical management for tooth decay before clinical worsening (factor 11).

The primary affected group is veterans and members of the Australian Defence Force who render "relevant service" as defined: eligible war service (non-operational), defence service (non-hazardous, non-BNTS), or MRCA peacetime service. For a veteran with operational service (e.g., service in a declared war or warlike operation) or hazardous service (e.g., peacekeeping in dangerous areas), this SoP does not directly apply; they would need to rely on the reasonable hypothesis SoP or the general provisions of the VEA and MRCA, which may set a lower evidentiary bar. That distinction is crucial: the instrument does not cover the most common combat-related claims.

Decision makers within DVA, the Veterans' Review Board, and the Administrative Appeals Tribunal (AAT) are directly affected because they must apply this SoP as binding guidance. Section 120B(3) of the VEA requires that the Commission or the tribunal be satisfied, on the balance of probabilities, that the disease is connected with service; this SoP defines the minimum requirements for such satisfaction. The RMA is also affected as the maker of the instrument, tasked with keeping it up to date with sound medical-scientific evidence.

Providers of dental care and professionals who provide expert evidence are indirectly affected. They may be asked to provide reports addressing whether a particular factor existed and was related to service. For example, a dentist may need to confirm the presence of gingival recession, the history of fluoride exposure, or the inability to clean the affected tooth due to a physical disability or fixed orthodontic appliance.

Taxpayers and the government are affected because the SoP influences the quantum of compensation payable. Each accepted claim results in liability for medical treatment costs, incapacity payments, and potentially permanent impairment compensation. The instrument does not estimate the fiscal impact, but by tightening or broadening factors relative to the 2015 SoP, it can affect expenditure. The 2024 version may have altered thresholds or added factors; the only explicit change is the repeal of the old instrument and the inclusion of a new one with different wording (e.g., factor 5 now explicitly lists drinking water with at least 0.5 mg/L fluoride as one form of therapeutic fluoride, whereas the 2015 SoP may have used different language).

Private enterprise is not directly regulated, but dental product suppliers and insurers may see shifting demand if the SoP influences veterans' dental care utilisation. However, the instrument is about compensation eligibility, not behaviour regulation.

The SoP imposes no duties on private persons; it is a decision-making tool for public administrators. Claimants have the right to have their claim assessed under this SoP if they fall within the scope. The right is not absolute: if the claimant has operational service, the decision-maker may be required to apply a different standard or a different SoP. Claimants also have the right to argue that a factor applies and is related to their service, and to provide evidence to that effect.

The RMA has a duty under section 196B of the VEA to determine SoPs based on "sound medical-scientific evidence." The RMA discharged that duty for this instrument, as stated in section 8: "the Repatriation Medical Authority is of the view that it is more probable than not that tooth decay (dental caries) and death from tooth decay (dental caries) can be related to relevant service." This view is the basis for the factors.

Decision makers (the Commission, tribunal, or delegates) have a duty to consider the factors in section 9 and to be satisfied that at least one factor exists and is related to relevant service. They must also apply the definitions and exclusions strictly. For example, they cannot accept a claim based solely on tooth loss; that is excluded. They must ensure that the factor meets the temporal and frequency requirements: e.g., factor 6 requires consumption of sugar/starch for a continuous period of at least 3 months within 2 years before clinical onset or worsening, and the pattern must be either 6 hours per day continuously or 10 occasions per day with >30 minute intervals.

Section 10(1) requires that the factor be related to the relevant service rendered by the person. This means mere existence of the factor is insufficient; there must be a causal or temporal connection to the person's military service. For example, a veteran who developed xerostomia from a medication prescribed for a post-service condition would not satisfy the relationship requirement unless the medication was for a service-related condition. Similarly, smoking must have occurred during or because of service to be considered related, though the factor itself does not specify that the smoking must be service-related; the requirement comes from s 10(1).

Clinical worsening factors (several are listed in s 9) apply only where the person's tooth decay was suffered or contracted before or during (but did not arise out of) their relevant service. This means a veteran who entered service with existing caries and then experienced worsening due to a service-related factor (e.g., inability to clean teeth due to combat) may claim for the worsening, but only if the worsening factor is related to service and the original disease did not arise out of service. If the disease arose out of service, the claim is for the original condition, not worsening.

The SoP itself does not create criminal or civil penalties. It is not a regulatory instrument that imposes obligations on the public; it is a legislative instrument that guides administrative decision-making. However, enforcement of its application occurs through the claims process. A claim that does not meet the SoP's requirements will be refused. That refusal is reviewable by the Veterans' Review Board and the AAT, and ultimately the Federal Court on questions of law. The "penalty" for a claimant is the denial of compensation.

There are no penalties for decision makers who misapply the SoP, though they may be subject to internal review or judicial review. The instrument is binding: s 120B(3) VEA requires the Commission to be satisfied in accordance with the SoP. Failure to apply the SoP may result in a decision being set aside on review.

The instrument does not contain any offences. The VEA and MRCA do contain penalties for fraudulently obtaining benefits (e.g., s 214 VEA imposes imprisonment for obtaining payment by false statements), but those are independent of this SoP. Claimants who fabricate evidence that they had xerostomia for 3 months or that they consumed sugar 10 times daily could be prosecuted under general law, but the SoP does not address that.

In economic terms, the enforcement mechanism is the administrative cost of refusal and review. Claimants may incur legal or assistance costs to challenge a refusal. The government bears the cost of running the review bodies. The clarity of the SoP can reduce disputes, but the detailed timeframes and thresholds may also create technical barriers that lead to litigation.

This SoP is made under subsection 196B(3) of the VEA. It sits alongside a counterpart SoP under subsection 196B(2) for the reasonable hypothesis standard, which would apply to claims involving operational service. The two SoPs may have different factors or thresholds because the evidentiary standard differs. The instrument notes at the end that the VEA and MRCA are defined in the dictionary, reinforcing that it operates within those Acts.

The SoP repeals the previous Statement of Principles concerning dental caries (No. 123 of 2015). Claims lodged before 19 November 2024 may be determined under the old SoP if they were made before commencement (see s 4 and s 5 for application). The instrument applies to claims to which s 120B VEA or s 339 MRCA applies. Those sections require the Commission to determine claims in accordance with any relevant SoP.

Section 11 of the instrument provides for interaction with other SoPs. If a factor in s 9 refers to an injury or disease for which a separate SoP exists under s 196B(3) VEA, then the factors in that other SoP apply as in force from time to time. For example, factor 3 refers to a course of therapeutic radiation; if the radiation caused an injury like osteoradionecrosis, that condition might have its own SoP. The claimant would need to satisfy the factors of that SoP to establish the radiation factor. This cross-referencing avoids duplication but creates complexity: a claimant may need to satisfy multiple SoPs to establish one factor.

The SoP also interacts with the general law of evidence and administrative law. Decision makers must consider the whole of the evidence, not just the factors, but the factors set a minimum. If no factor is present, the claim must fail, regardless of other evidence, unless the disease is covered by a different SoP or the claim proceeds under a different standard.

The instrument does not change any other legislation. It does not affect the Dental Benefits Act 2008 or state dental practice laws. It is purely a federal compensation guide.

This instrument is the 2024 version. It repeals the Statement of Principles concerning dental caries (Balance of Probabilities) (No. 123 of 2015). The only amendment history discernible from the source is the replacement of the 2015 instrument with this one. The RMA periodically reviews SoPs and updates them based on evolving medical evidence. The 2015 SoP had been in force for nearly nine years. The new version was made on 18 October 2024 and commences 19 November 2024.

The source does not provide a list of changes from the 2015 version. Practitioners would need to compare the two instruments to identify differences. Common changes might include updated definitions, new factors, revised thresholds, or clarifications. For example, factor 5 in the 2024 instrument specifically mentions "fluoridated drinking water with a fluoride concentration of at least 0.5 milligrams per litre" and "fluoridated toothpaste with at least 1,000 parts per million fluoride," which may be more precise than the 2015 version. Factor 6 now mentions "processed starch" as an addition to sugar, and clarifies "more than 30 minutes between exposures." These details may broaden or narrow the availability of claims.

The source instrument does not contain any reference to litigation history. It is a legislative instrument that would be challenged in administrative tribunals (AAT) and courts, but the instrument itself records no cases. It is common for SoPs to be reviewed on questions of law, such as whether the RMA properly considered sound medical-scientific evidence, or whether a factor is relevant. However, without citing specific cases (which the source does not provide), we cannot list any.

Practitioners should be aware that the Federal Court and High Court have considered the validity of SoPs in the past (e.g., in relation to other diseases), but those cases are not attached to this instrument. The absence of recorded litigation history in the source may simply reflect the fact that the instrument is new; the 2015 SoP may have been litigated, but that is not mentioned.

Several aspects of this SoP can trip up claimants and decision makers.

1. Exclusion of operational and hazardous service. The most significant limitation is the definition of "relevant service". A veteran who served in a war zone (operational service) cannot rely on this SoP; they must use the reasonable hypothesis standard or a separate SoP. If no SoP exists for reasonable hypothesis, the claim may be determined without a specific SoP. But if a decision maker erroneously applies this Balance of Probabilities SoP to an operational service claim, that could be an error of law.

2. Strict exclusions in the definition. Tooth decay excludes pulp and periapical disease, tooth loss, and tooth wear. A claim for a root canal infection or for tooth loss due to caries would not be covered unless the underlying caries is the accepted condition. The decision maker must be careful to distinguish between the caries itself and its sequelae.

3. Time windows are tight. Each factor has a specific period before clinical onset or worsening. For example, inability to obtain fluoride requires at least 1 year within the 5 years before onset. A claimant who moved to a fluoridated area 4 years before onset but had no fluoride exposure for 3 years before that may fail if the continuous period of inability was not at least 1 year. Similarly, sugar/starch consumption must be for a continuous period of at least 3 months within 2 years before onset. A break of a few days may break the continuity, though the instrument does not define "continuous" - likely a matter of fact.

4. Frequency thresholds for sugar/starch. Factor 6 requires consumption for at least 6 hours per day continuously or at least 10 separate occasions per day with more than 30 minutes between exposures. This is a high bar. Sipping a sugary drink every hour would be 8 occasions, but if the intervals are less than 30 minutes, the second sub-factor is not met. The first sub-factor (6 hours continuous) would require essentially constant exposure over a 6-hour period, which is unusual. Many claimants may find it difficult to satisfy either test.

5. Pack-year calculation for smoking. Factor 7 requires at least 6 pack-years. A pack-year is 20 cigarettes per day for one year. Calculating pack-years for irregular smokers or for those who smoked different amounts over time requires careful arithmetic. The definition includes equivalent tobacco weight for pipes and cigars: 7,300 grams per pack-year. Claimants who smoked lighter cigarettes or roll-your-own may need conversion. Also note that the factor applies only if smoking has ceased and onset occurred within 5 years of cessation. A current smoker may still meet the 6 pack-years threshold, but the condition must have its clinical onset or worsening after the smoking began. The factor does not require cessation for current smokers; it says "and where smoking has ceased, clinical onset or clinical worsening occurred within 5 years of cessation". For current smokers, the cessation condition is not triggered, so the factor can still be met as long as the other conditions (smoked at least 6 pack-years before onset) are satisfied.

For a veteran or claimant seeking to use this SoP, the process involves proving at least one factor from section 9 and that the factor is related to relevant service. Practical steps:

1. Obtain a dental diagnosis. Ensure a dentist confirms that the condition meets the definition in s 7(2): localised destruction of enamel, cementum, or dentine by plaque. Exclude pulp disease, periapical disease, tooth loss, and tooth wear if those are the primary diagnoses. The diagnosis should state the affected teeth and whether it is coronal, root, or recurrent caries.

2. Identify potential factors from service history. Review service records for periods of combat, field postings, medical treatments, medications, smoking logs, dental access records, and other relevant events. Common factors may include inability to clean teeth during active combat (factor 9), inability to access dental care when posted to remote locations (factor 10), dry mouth from medications (factor 4), smoking (factor 7), or radiation treatment for other conditions (factor 3).

3. Gather evidence of time windows. Each factor requires proof of the factor within a specific period before clinical onset or worsening. Collect dental records that document when the caries was first diagnosed or when it worsened. For clinical onset, the first diagnosis date is key. For worsening, show a clear change in severity.

4. Document the factor with specificity.

   • For fluoride inability (factor 5): show that the water supply had <0.5 mg/L fluoride, or that the person could not obtain fluoride toothpaste with >1000 ppm, or could not take supplements. Evidence could include water quality reports, receipts for toothpaste purchases, or statements from the person.
   • For sugar/starch consumption (factor 6): diary evidence or witness statements showing consumption of sugary foods/drinks for at least 6 hours per day continuously or on at least 10 occasions per day. This is difficult to prove; a dental history questionnaire may suffice if consistent with diet.
   • For smoking (factor 7): calculate pack-years from service records or GP records. A smoking history from a doctor's notes or the person's own statement can be used, but it must be credible.
   • For inability to clean (factor 9): evidence of a physical or mental disability (e.g., injury report, medical certificate) or fixed orthodontic appliance (dental records), and a statement that cleaning was not possible for at least 3 continuous months.
