Statement of Principles concerning sudden unexplained death (Reasonable Hypothesis) (No. 45 of 2022)

The SoP centres on a handful of definitional and operational concepts that determine how claims will be assessed under the VEA and MRCA framework. These are: the statutory meaning of sudden unexplained death (s7(2)), the set of qualifying factors (s9), the requirement that a qualifying factor be related to relevant service (s10), the cross‑application to other Statements of Principles (s11), and the dictionary definitions in Schedule 1.

Sudden unexplained death is narrowly defined. It requires absence of evidence of disease or injury that could account for death, and an onset-to-death time of 24 hours or less, except where life support prolongs death beyond 24 hours (s7(2)). The instrument notes that sudden unexplained death commonly has ICD‑10‑AM code R96, but the legal meaning is the text of s7(2) (s7(3)-(4)). The Note to s7(2) contemplates that a final death certificate may record that a cause cannot be determined.

The threshold for linking that kind of death to service is the statutory notion of a "reasonable hypothesis", which this instrument operationalises by stating that at least one of the enumerated factors in s9 must exist before it can be said that a reasonable hypothesis has been raised (s9). The list is discrete and time‑bounded. It includes recent acute exposures and events (for example a major stressful event within 24 hours (s9(1)), a bout of intense physical activity of at least 5 METs within 24 hours (s9(2)), receiving a blow to the chest immediately before death (s9(3)), blood alcohol content of at least 0.15 percent at the time of death (s9(8)), taking a drug that prolongs the corrected QT interval within 7 days (s9(9)), or taking a specified illicit drug within 24 hours (s9(10)). It also includes ongoing medical conditions at the time of death (BMI 35 or greater (s9(4)), diabetes mellitus (s9(5)), epilepsy (s9(6)), hypertension (s9(7))). Many of these terms are defined in the Schedule (Schedule 1).

The instrument emphasises temporal proximity and causal plausibility. Most factors are limited to events or conditions at the time of death or within 24 hours before death; the QT‑prolonging drug category uses a 7‑day window (s9). The Schedule defines how to calculate BMI (Schedule 1) and what a MET is, specifying the measurement unit for "intense physical activity" (Schedule 1). "Blow to the chest" is also defined as a blunt, forceful non-penetrating blow to the anterior chest and examples are supplied (Schedule 1).

The concept of relevant service is the statutory trigger linking a veteran or member to the compensation system; the Schedule lists the kinds of service that qualify as relevant service under either the VEA or MRCA (Schedule 1). Section 10 requires that any factor from s9 must be related to the relevant service rendered by the person. Section 11 establishes that, when a factor in s9 refers to an injury or disease that is the subject of another SoP under subsection 196B(2) of the VEA, the factors in that other SoP apply according to that instrument’s terms.

Finally, s8 states the Repatriation Medical Authority’s evaluative premise: it is of the view that there is sound medical‑scientific evidence indicating sudden unexplained death can be related to relevant service. That view is the basis for the Authority making this SoP (s8). The instrument therefore operates as a medical‑factual template that decision-makers must apply when assessing claims invoking sudden unexplained death, establishing which facts raise the relevant statutory threshold of a reasonable hypothesis.

This SoP primarily affects four categories of actors directly involved in veterans’ entitlements claims: claimants (veterans and certain serving members or their dependants), medical practitioners and forensic experts, decision-makers in the veterans’ compensation system, and providers of evidentiary materials such as coroners and pathologists. It also has indirect effects on representatives, advisers and legal practitioners working on such claims.

Claimants: The instrument applies to a claim to which section 120A of the VEA or section 338 of the MRCA applies (s5). The Schedule defines "relevant service" and includes operational service, peacekeeping, hazardous service, British nuclear test defence service under the VEA, and warlike and non-warlike service under the MRCA (Schedule 1). Therefore, the persons it affects are veterans, former members and possibly dependants who seek entitlements where a sudden unexplained death is invoked. For a claim that relies on this SoP, the claimant must establish facts that align with at least one of the factors in s9 and that the factor was related to the person’s relevant service (s9, s10). This will influence what evidence claimants must gather and present.

Medical practitioners and forensic experts: The SoP sets medical thresholds and time frames (for example BMI 35, blood alcohol content 0.15 percent, MET 5; Schedule 1 and s9). Medical and toxicological testing, BMI calculation, documentation of epilepsy, diabetes, hypertension, or recent drug exposure will supply the factual basis for whether a factor existed. Forensic pathologists and coroners who produce death certificates, toxicology reports and autopsy findings will therefore routinely supply materials used to test the factors, including whether a cause of death could be determined (s7(2) Note).

Decision-makers and administrative bodies: The Repatriation Medical Authority made the SoP (s3), and this instrument is designed to be applied by decision-makers determining claims under the VEA and MRCA. While the instrument itself does not spell out the procedural steps of claim adjudication, it provides the substantive trigger for a "reasonable hypothesis" analysis when sudden unexplained death is relied upon. Decision-makers will be required to identify whether at least one of the s9 factors exists and whether it is related to relevant service (s9, s10), and to apply any linked SoPs if the factor references another injury or disease (s11).

Coroners and other evidence suppliers: Because the SoP depends on time-limited and medically specific facts, coronial findings, autopsy reports and toxicology results will often be central. The instrument explicitly contemplates that a final death certificate may record that a cause cannot be determined (s7(2) Note). Where a factor is a recorded condition such as epilepsy, diabetes or hypertension, medical records and histories will be critical.

Legal advisers and representatives: Practitioners advising claimants will need to focus on collecting and framing evidence that a s9 factor both existed and was related to relevant service. The Schedule’s definitions will determine evidentiary forms that are necessary and probative, for example BMI calculation (Schedule 1) or measurement of METs.

Indirectly, there may be effects on other actors who generate or rely on similar evidence, including employers, witnesses to stressful or physical events, and agencies that hold service records demonstrating exposure to stressful, hazardous or physically demanding conditions. The instrument’s requirement that the factor be related to relevant service (s10) places the onus on assembling a chain of facts linking the medical or circumstantial factor to the person’s service history as defined in the Schedule.

This instrument does not create new obligations in the criminal law nor specify civil rights per se. Its operative function is normative: it prescribes the factual and medical criteria that must be met to raise a "reasonable hypothesis" connecting sudden unexplained death to relevant service, and in doing so it allocates responsibilities in the administrative task of claim assessment.

Duty to establish qualifying factors: For a claim based on sudden unexplained death to reach the statutory threshold of a reasonable hypothesis, at least one of the factors in section 9 must exist (s9). Those evaluating or supporting claims therefore carry the practical duty of establishing the existence of at least one of these factors with supporting evidence. The factors are discrete and time sensitive. Examples include demonstrating the occurrence of a major stressful event within 24 hours before death (s9(1)), proving intense physical exertion of at least 5 METs within 24 hours (s9(2)), evidence of a blow to the anterior chest immediately before death (s9(3)), or laboratory confirmation of blood alcohol of at least 0.15 percent at death (s9(8)).

Duty to connect factors to relevant service: Section 10 requires that any factor found to exist "must be related to the relevant service rendered by the person." That places the duty on claimants and decision-makers to link the factual or medical factor to the person’s service history as defined in the Schedule. Evidence of service exposures, service incidents, or duties forming part of operational, peacekeeping or hazardous service may be required to discharge that connection.

Duty to apply cross‑referenced SoPs: Section 11 provides that if a s9 factor refers to an injury or disease that itself is the subject of another SoP, then that other SoP applies in accordance with its own terms. Decision-makers must therefore identify and apply other SoPs where the listed factor implicates a separately governed disease or injury.

Right to rely on the Authority’s medical view: The Authority states it is of the view that sound medical‑scientific evidence links sudden unexplained death to relevant service (s8). In administrative practice, this SoP functions as a presumption‑setting instrument: where a claimant establishes at least one qualifying factor related to relevant service, decision-makers may (depending on the statutory standard and application processes outside this instrument) consider that a reasonable hypothesis has been raised. The instrument does not itself specify the legal effect beyond the reasonable hypothesis formulation; it provides the substantive foundation that adjudicators must work with.

Rights and constraints around medical definitions: The Schedule’s definitions constrain how terms used in s9 are to be interpreted for claim purposes. For example, BMI is calculable by the formula in Schedule 1; MET is defined by specific physiological units; blow to the chest is defined as blunt and non‑penetrating to the anterior chest. These definitions limit interpretive discretion to the textual meaning provided.

No adjudicative procedures or appeal mechanisms are set out in the instrument. It does not set time limits for claims or procedural duties such as evidence disclosure. It functions as a component in the broader statutory schema under the VEA and MRCA for assembling the medical-scientific basis upon which entitlement decisions are made.

This Statement of Principles does not create criminal penalties, civil sanctions, or a separate enforcement regime within its text. The document is a medical‑technical instrument made under subsection 196B(2) of the VEA (s3) and is designed to articulate the factual and medical circumstances that raise a reasonable hypothesis linking sudden unexplained death to relevant service. It does not, on its face, establish enforcement powers, fines, imprisonment, administrative penalties, or compliance offences.

Enforcement, in practice, occurs through application in administrative decision-making within the veterans’ entitlements framework. The instrument applies to claims under s120A of the VEA and s338 of the MRCA (s5). Those provisions are outside this instrument; this SoP supplies the substantive medical criteria that decision-makers will use when determining whether a claim involving sudden unexplained death meets the statutory threshold. The instrument thereby influences the outcome of entitlement decisions, but it does not itself provide procedural enforcement steps or remedies.

Because the instrument sets criteria that "must as a minimum exist" before a reasonable hypothesis can be said to have been raised (s9), its effect is to guide the evidential standard applied by administrators and decision-makers in adjudicating entitlements. That function creates practical enforcement consequences: if the required factor(s) cannot be established or cannot be linked to relevant service (s10), a claim premised on sudden unexplained death cannot meet the threshold set by this SoP. Administrative denial of a claim would follow from an inability to satisfy the SoP criteria, but the instrument itself does not describe the mechanics of refusal, review, or appeal.

The instrument also contains cross‑reference behavior that bears on enforcement: where a listed factor refers to an injury or disease subject to another SoP, that other SoP "applies in accordance with the terms of that Statement of Principles as in force from time to time" (s11). This creates an enforcement pathway wherein claim assessment may require application of other authored SoPs and their terms.

Because the Authority specifies the medical evidence basis for the SoP (s8), its role in enforcement is evidentiary and technical: the Authority defines what constitutes a reasonable hypothesis in sudden unexplained death cases, and administrative decision-makers are expected to apply that definition. Any procedural penalties, review procedures, or sanctions that attend claim decisions are instead provided in the VEA, MRCA or associated regulations; they are not contained within this instrument.

The instrument sits within the statutory architecture of the Veterans' Entitlements Act 1986 and the Military Rehabilitation and Compensation Act 2004 by providing an authoritative medical test used in determining entitlement claims under those statutes. It is made under subsection 196B(2) of the VEA (s3) and expressly applies to claims to which section 120A of the VEA or section 338 of the MRCA applies (s5). The Schedule defines "relevant service" in terms that reference both the VEA and the MRCA (Schedule 1), thereby aligning the reach of the SoP with the service categories that trigger entitlements under those Acts.

Interplay with other Statements of Principles: Section 11 provides an explicit interaction rule. If a factor listed in s9 refers to an injury or disease that is the subject of another SoP determined under subsection 196B(2) of the VEA, then "the factors in that Statement of Principles apply in accordance with the terms of that Statement of Principles as in force from time to time." That mechanism requires decision-makers to identify when a listed factor invokes another SoP and to apply that instrument’s terms, thereby creating a networked application model across SoPs.

Interpretation and ICD coding: Section 7(3) and (4) clarify the relation between the instrument’s textual definition and medical coding. While sudden unexplained death often attracts ICD‑10‑AM code R96, the instrument instructs that the meaning of sudden unexplained death for the purposes of this SoP is the statutory text in s7(2) rather than the ICD label alone. The instrument therefore constrains reliance on broad diagnostic coding and insists on the statutory definitional content. It references the precise edition of the ICD‑10‑AM used for code identification (s7(4)), but that reference is descriptive rather than normative: the legal meaning is the definition in s7(2).

Relationship to decision-making provisions of the VEA and MRCA: This SoP is one component in the decision matrix employed under relevant provisions of those Acts. Although the instrument does not itself lay down procedural steps, time periods or standards of proof for entitlement decisions, claimants and decision-makers must align their evidentiary and adjudicative processes with the SoP when a sudden unexplained death claim is made. The schedule’s definition of relevant service ties the SoP to the service categories that the VEA and MRCA use to determine eligibility.

Repeal and replacement: Section 4 expressly repeals the prior Statement of Principles concerning sudden unexplained death No. 57 of 2013. That repeal changes the statutory instruments applicable to claims going forward, which affects how decision-makers reference medical criteria and which other SoPs may now be mobilised in interplay (s4). Where factors overlap with conditions governed by other SoPs, the s11 cross-application rule will determine which SoP governs.

Limits on legal effect: The instrument does not alter non‑statutory areas of law directly, for example coronial procedures, criminal law, or private insurance rights. It relies on evidence typically produced in those domains, but it does not change their substantive or procedural law. Its legal effect is focused on the administrative determinations governed by the VEA and MRCA.

This instrument records minimal internal amendment history within its text, but it contains key lifecycle milestones that matter for claim assessment and retrospective application.

Commencement: The instrument declares its commencement date as 30 May 2022 (s2). That is the point from which the current statutory criteria apply.

Repeal of prior instrument: Section 4 expressly repeals the Statement of Principles concerning sudden unexplained death No. 57 of 2013, which had Federal Register of Legislation number F2013L01645. The 2013 instrument is therefore displaced by this 2022 instrument from its commencement date. The repeal creates a legal discontinuity: claims made after 30 May 2022 will be assessed against the 2022 SoP; claims adjudicated prior to that date would have been assessed under the 2013 instrument.

Authority of making: The instrument is made under subsection 196B(2) of the VEA (s3). Although subsection details and broader legislative amendment history of s196B(2) are not described in this instrument, the instrument’s legal authority is linked to that statutory provision. The Schedule reiterates the statutory constructs used by the VEA and MRCA such as the definitions of relevant service (Schedule 1).

Versioning and cross-applicability: Section 11 contains a temporal element by requiring that any other SoP that is applied must be applied "as in force from time to time". This language means that if, after the commencement of this instrument, other SoPs are amended, the current versions of those SoPs are to be applied when a s9 factor refers to an injury or disease covered by those SoPs. The instrument therefore anticipates future amendments to other SoPs and instructs decision-makers to apply those other instruments as they stand at the relevant time.

No further amendments, transitional provisions, or savings clauses are recorded in the instrument itself. The instrument’s lifecycle beyond its stated repeal of the 2013 SoP will therefore be governed by subsequent instruments or legislative changes made under the same power in subsection 196B(2) of the VEA.

The text provided contains no references to litigation, judicial consideration, or case law. It lists no decisions that interpret, apply or challenge the 2022 Statement of Principles. The instrument does not name any cases, and it does not contain citations to judicial materials or summaries of litigation. The Notes within the instrument supply illustrative examples for interpretation and do not purport to summarise any judicial findings.

Because this instrument functions as an administrative medical‑scientific instrument intended for use in claim determinations, any litigation that might concern it would typically arise in the context of appeals from decisions under the VEA or MRCA where the reasoning turned on whether a reasonable hypothesis had been raised by a claimant relying on this SoP. Such litigation, if it exists, would be external to the text supplied. The instrument itself does not record, or purport to record, any litigation history.

For practitioners preparing entitlement cases or reviews, the absence of reported litigation within the instrument means that the instrument must be applied based on its terms and the decision-making framework under the VEA and MRCA. If there are interpretive ambiguities in how the factors apply to particular factual matrices, those would be resolved by the decision maker or ultimately a tribunal or court, but that adjudicative history is not contained in this document.

This instrument contains several features that can produce practical pitfalls for claimants, advisers and decision-makers. These are features where the textual wording, defined terms, or cross-references create non-obvious evidentiary or interpretive consequences.

Narrow legal definition of sudden unexplained death: The statutory meaning requires death without evidence of disease or injury that could account for the death, and onset to death of 24 hours or less, except when life support extends death (s7(2)). A death that occurs after longer symptomatic periods, or where a plausible disease or injury is identified, will not meet the SoP’s definition even if clinically labelled otherwise. The instrument explicitly separates the ICD code from the statutory definition (s7(3)-(4)), so reliance on ICD R96 alone will not satisfy the SoP.

Minimum one-factor rule and temporal windows: Section 9 requires "at least one" of the enumerated factors to exist as a minimum. Each factor has specific temporal boundaries: many must be within 24 hours of death (s9(1)-(4), (8), (10)), one uses an immediate timing requirement (blow to the chest immediately before death at s9(3)), and drug-induced QT prolongation uses a seven day window (s9(9)). Failure to produce evidence within these windows will be fatal to raising the statutory reasonable hypothesis.

Requirement that the factor be related to relevant service: Section 10 shifts the evidentiary task from merely establishing a factor to proving that the factor was "related to the relevant service rendered by the person." That introduces a separate causal linkage element. For chronic and common conditions such as BMI ≥35, diabetes, hypertension or epilepsy (s9(4)-(7)), claimants must demonstrate how that condition connects to their relevant service. The instrument gives no examples of how to prove the "related to" link; practitioners must therefore gather service records, incident reports or contemporaneous medical evidence to show the connection.

Overlap with other Statements of Principles: Section 11 provides that if a factor in s9 refers to an injury or disease covered by another SoP, the other SoP applies in accordance with its terms. That can create procedural complexity: rather than applying s9 in isolation, decision-makers must locate and apply other SoPs, which may set different factors, timeframes, or interaction rules. Failure to identify and deploy the correct SoP may misapply the relevant criteria.

Broad medical categories with narrow definitions: Some listed items may appear straightforward but have precise definitions in the Schedule. For example, "blow to the chest" is defined narrowly as blunt, forceful, non-penetrating to the anterior chest (Schedule 1). Gunshot penetration or penetrating trauma may not fit the definition. Similarly, "MET" is precisely defined as particular oxygen consumption rates (Schedule 1), which may require expert testimony to convert a described activity into a MET estimate.

Specified list of drugs vs QT-prolonging drugs: The instrument distinguishes between two drug-related factors: one is taking "a drug that prolongs the corrected QT interval" within 7 days (s9(9)), a broad pharmacological category with many classes listed in the Note; the other is taking a "specified list of drugs" (cocaine, methamphetamine, MDMA) within 24 hours (s9(10); Schedule 1). These are different thresholds with different temporal limits and evidential implications. Toxicology results will need to specify the agent and timing.

High objective thresholds: Some numeric thresholds are relatively high and may be dispositive. Blood alcohol content must be at least 0.15 percent (s9(8)). BMI threshold is 35 (s9(4)). These are specific values; records below those thresholds do not assist under those discrete factors, though they may be relevant under other SoPs if cross-reference applies (s11).

Medical uncertainty and death certificate language: The instrument recognises that sudden unexplained death often results in a death certificate indicating cause cannot be determined (s7(2) Note). However, a cause‑undetermined certificate alone does not automatically satisfy the SoP. The claimant must still identify a qualifying factor and link it to relevant service.

No procedural guidance on evidence or burden: The instrument sets the substantive criteria but provides no procedural directions about what evidence suffices, who bears what burden, or the standard of proof required in administrative determinations. Practitioners cannot rely on this instrument alone to know the evidentiary thresholds, creating potential procedural gaps that must be filled by the VEA/MRCA decision framework.

Cross-jurisdictional evidence sources: Because the Schedule references examples such as assaults, sporting injuries, or gunshot impact while wearing body armour, evidence may come from civilian, military and coronial sources. Coordinating those records can be complex. The instrument does not streamline access to service health records, coronial findings or toxicology reports.

No express retroactivity or transitional clause: The repeal of the 2013 instrument (s4) has immediate effect from commencement (s2), but the instrument does not state transitional rules for matters in progress. Practitioners must check administrative practice on transitional application.

Compliance, as relevant to claimants and their advisers, requires assembling evidence that satisfies two linked requirements: (1) establish at least one of the enumerated factors in section 9 as existing within its specified timeframe or parameter; and (2) establish that the identified factor is related to the person’s relevant service as defined in the Schedule (s9, s10). Because the instrument supplies definitions and time windows, practical compliance is a matter of targeted evidence collection, medical assessment and service-history documentation.

1. Identify whether the death meets the statutory definition of sudden unexplained death. Confirm that death was without evidence of disease or injury that could account for death and that the onset-to-death period fits within 24 hours unless life support prolonged death beyond 24 hours (s7(2)). Obtain and review the final death certificate, coronial findings and autopsy reports; these will often record whether a cause was determined (s7(2) Note).

2. Map potential qualifying factors. Work through the ten discrete factors listed in s9 and determine which, if any, are plausibly present. These include:

   • Major stressful event within 24 hours prior to death (s9(1));
   • Intense physical activity of at least 5 METs within 24 hours (s9(2));
   • Blow to the anterior chest immediately before death (s9(3));
   • BMI 35 or greater at time of death (s9(4));
   • Diabetes mellitus at time of death (s9(5));
   • Epilepsy at time of death (s9(6));
   • Hypertension at time of death (s9(7));
   • Blood alcohol content at least 0.15% at death (s9(8));
   • Use of a drug that prolongs corrected QT interval within 7 days (s9(9));
   • Use of one of the specified drugs (cocaine, methamphetamine, MDMA) within 24 hours (s9(10)).

3. Obtain precise medical and forensic evidence tailored to the factor. For example:

   • For s9(8) and s9(10), obtain toxicology and blood alcohol tests with timings;
   • For BMI (s9(4)), gather recent height and weight measurements to calculate BMI using the formula in Schedule 1;
   • For diabetes, epilepsy and hypertension (s9(5)-(7)), secure medical records, diagnoses, treatment histories and medication lists;
   • For MET assessment (s9(2)), obtain a medical or exercise physiology expert report converting described activity into MET units, using the MET definition in Schedule 1;
   • For blow to the chest (s9(3)), gather witness statements, emergency department or paramedic reports, imaging, and any coronial evidence consistent with a blunt anterior chest impact; ensure the evidence matches the Schedule’s definition of a blunt, forceful, non‑penetrating blow to the anterior chest;
   • For QT-prolonging drug exposure (s9(9)), provide medical records, prescriptions, pharmacy records or autopsy toxicology that identify the drug and its temporal proximity within 7 days; the Note lists example drug classes but does not exhaustively define them, so evidence must identify the class and timing.

4. Demonstrate the relationship to relevant service. Section 10 requires that the factor "must be related to the relevant service rendered by the person." Relevant service is defined in the Schedule and includes operational service, peacekeeping, hazardous service, British nuclear test defence service under the VEA, and warlike or non‑warlike service under the MRCA. Gather service records, deployment information, incident reports, statements from commanding officers, medical records from service periods, and any contemporaneous records of exposure, assault, high‑stress incidents, or hazardous duty that link the factor to service. For chronic conditions, compile medical and service records that support a causal nexus between service conditions and the disease or condition.

5. Check for cross-application with other SoPs. If the s9 factor refers to an injury or disease with its own SoP, section 11 requires that the other SoP be applied as in force. Identify whether any factor invokes another SoP and, if so, apply that instrument’s criteria and evidence guidance as well.

6. Prepare expert opinion where required. Many elements require expert assessment to link physiological measures or events to the SoP thresholds. This includes converting activity to METs, interpreting toxicology windows, opining on the causal link between a service event and a chronic condition, or assessing whether a QT‑prolonging medication likely contributed to death.

7. Anticipate evidentiary limitations and plan alternatives. Forensic evidence may be incomplete. If direct toxicology is missing, seek contemporaneous clinical notes, witness accounts, service incident reports, or prior medical records that can supply indirect evidence of a factor’s presence. Where the factor is a common condition (for example obesity, hypertension), emphasise the service link by documenting onset dates, exacerbations during service, or exposure to causal factors while serving.

8. Present findings in claim submissions with precise references to the SoP text. Clearly identify which s9 factor(s) are said to exist, the temporal window relied upon, the specific Schedule definition invoked, and the service records showing the relationship to relevant service per s10. If another SoP is relevant under s11, include its application.

9. Monitor administrative practice and other SoPs. The instrument requires decision-makers to apply other SoPs "as in force from time to time" (s11). Keep track of amendments to related SoPs and the dates on which those amendments take effect.

10. Where death occurred prior to commencement or where matters were already in progress at commencement, check administrative guidance about transitional application. The instrument makes no transitional provision in text; administrative practice will need to be consulted.

Following these steps aligns the claim evidence with the precise textual requirements of the SoP. Because the instrument supplies strict definitions, temporal limits and cross‑application rules, compliance is primarily a process of disciplined evidence assembly and medical expert alignment with the Schedule’s definitions and the s9 factor thresholds.
