Statement of Principles concerning subcutaneous lipoma (Balance of Probabilities) (No. 83 of 2024)

This instrument is a Statement of Principles (No. 83 of 2024) made by the Repatriation Medical Authority under subsection 196B(3) of the Veterans' Entitlements Act 1986 (the VEA) to set out the medical and causation framework that the Authority considers is necessary to connect subcutaneous lipoma, and death from subcutaneous lipoma, with relevant service on the balance of probabilities (see s1 Name; s3 Authority; s8 Basis for determining the factors). It replaces an earlier Statement concerning lipoma made in 2015 (s4 Repeal). It commences operation on 19 November 2024 (s2 Commencement) and is dated 18 October 2024 on its face.

Mechanically, the instrument does four things. First, it defines the medical entity to which it applies: subcutaneous lipoma (see s7(2)), and it lists explicit exclusions from that term (breast lipoma, fat hyperplasia, liposarcoma, and prolapse of adipose tissue). Second, it specifies that the Authority considers, on the available medical science, that it is more probable than not that subcutaneous lipoma (and death from it) can be related to relevant service for the purposes of claims under the VEA and the Military Rehabilitation and Compensation Act 2004 (MRCA) (s8). Third, it sets the specific factual factors which must exist before a causal connection on the balance of probabilities can be accepted , the factors are limited to two categories (s9). Fourth, it establishes how those factors must be related to service (s10) and how this instrument interacts with other Statements of Principles (s11).

The instrument is not a provision that itself creates benefits, payments, offences, or procedural steps. It is an evidentiary/causation standard that the Repatriation Medical Authority has determined will be applied by decision makers assessing claims that are adjudicated under s120B of the VEA or s339 of the MRCA (s5 Application). The Statement therefore functions as a medical-legal input to claims adjudication: when an accepted factor exists, a tribunal or decision-maker may use this Statement as the scientific basis for deciding whether the disability is connected with service. The instrument references ICD‑10‑AM coding (D17) but makes clear that the operative definition for this Statement is the textual definition in s7(2), with the ICD code provided for reference in s7(3).

In sum, the instrument establishes a narrow, specified set of causation factors and definitions that decision-makers should apply when determining whether subcutaneous lipoma, or death from it, is service-related for veterans and members covered by the VEA and MRCA. It replaces the 2015 Statement on lipoma and becomes effective 19 November 2024.

The Statement revolves around several tightly defined concepts: the medical entity (subcutaneous lipoma), the evidentiary threshold (balance of probabilities), the causation factors that must be present, the temporal and relational requirement of connection to relevant service, and cross-application from other Statements where applicable. Each of these is expressed in the instrument and controls how claimants will be evaluated.

Definition of the medical entity. The instrument provides a controlling definition of subcutaneous lipoma in subsection 7(2). The term means a benign neoplasm of mature adipose cells occurring in subcutaneous tissues, usually surrounded by a capsule (s7(2)(a)). Four specific conditions are excluded: breast lipoma; fat hyperplasia; liposarcoma; and prolapse of adipose tissue (s7(2)(b)). Although it notes that subcutaneous lipoma attracts ICD‑10‑AM code D17, the instrument instructs that the meaning for this Statement is the statutory textual definition in s7(2) (s7(3)). The ICD reference is therefore a cross-reference and not an autonomous definitional base (s7(3)).

Death and terminal events. The Statement expressly extends to "death from subcutaneous lipoma" by reference to death caused or contributed to by the disease (s7(4)). The Schedule defines "terminal event" as the proximate or ultimate cause of death and lists examples such as pneumonia, respiratory failure, cardiac arrest, circulatory failure, and cessation of brain function (Schedule 1 - Dictionary, terminal event). This clarifies that deaths attributed to downstream events where subcutaneous lipoma contributed are within scope.

Evidential threshold. The Authority frames its view on causation using the balance of probabilities standard. Subsection 8 records the Authority's medical‑scientific view that, on the available evidence, it is "more probable than not" that subcutaneous lipoma and related death can be related to relevant service under the VEA and MRCA (s8). The instrument title also expressly contains "Balance of Probabilities", signalling the standard applied.

Causation factors. Section 9 narrows the acceptable pathways for causation into two explicit factors that must exist before the Authority will accept a service nexus on the balance of probabilities. These are: (1) having alcohol use disorder at the time of clinical onset of benign symmetrical lipomatosis (s9(1)); and (2) inability to obtain appropriate clinical management for subcutaneous lipoma before clinical worsening (s9(2)). A note clarifies that benign symmetrical lipomatosis is also known as multiple symmetrical lipomatosis or Madelung disease and usually manifests with multiple symmetrical fat deposits in the head, neck and shoulder area (s9 note). The instrument therefore selects a narrow set of medical and access-related factors as the pathways by which service may be considered causative.

The Statement affects a defined set of stakeholders by changing the medical-causation framework applied in claims under the VEA and MRCA. Explicitly affected parties include veterans and members of the Forces who lodge, or contemplate lodging, claims under s120B of the VEA or s339 of the MRCA that assert subcutaneous lipoma or death from subcutaneous lipoma (s5 Application). Those decision-makers and administrative offices that assess such claims will be affected because they are required to apply the Statement as the Repatriation Medical Authority's view of the medical‑scientific links relevant to causation (s3 Authority; s8 Basis).

Who makes determinations. The Repatriation Medical Authority made the Statement under its statutory power (s3). The instrument provides the medical basis decision-makers should rely upon; it does not itself determine individual claims. Administrative decision-makers under the VEA and MRCA, and any tribunals charged with reviewing such decisions, will be the practical users of the Statement when adjudicating claims that involve subcutaneous lipoma. The Statement also interacts with any Statements of Principles that cover other conditions referred to in s9 factors (s11).

Who carries evidentiary burden. The instrument defines the factual pathways (s9) that must exist to establish a link on the balance of probabilities. It does not prescribe who must prove those factors, nor the precise evidentiary standard beyond the balance of probabilities that the Authority uses in its determination (s8). However, by setting discrete factors, the instrument shifts focus in claims: claimants will need to show that at least one of the listed factors existed and was related to relevant service per s10(1). Decision-makers will have to assess whether the factor is present and related to service. Health practitioners providing medical evidence will be expected to address these specific factors when preparing reports, because the Statement defines the causation pathways used in adjudication.

Health providers and record-keepers. Hospitals, clinics, general practitioners, and military medical services that diagnosed, treated, or recorded subcutaneous lipoma, benign symmetrical lipomatosis, alcohol use disorder, or health-care access issues may find their contemporaneous records become pivotal. The Statement expressly includes inability to obtain appropriate clinical management as a causation factor (s9(2)), so records evidencing attempts to obtain care, refusals, or systemic barriers to treatment could be material to claims where this factor is invoked.

Other Statements and agencies. The instrument contemplates interaction with other Statements (s11). Where a s9 factor refers to another injury or disease covered by a separate Statement, the factors in that other Statement apply. Therefore, agencies and advisers who handle multiple related conditions will need to track cross-references and the current versions of other Statements in force.

This instrument is a Statement of Principles and so does not itself create statutory entitlements, express duties on private persons, or criminal penalties. Its core legal effect is to set out the Repatriation Medical Authority's medical‑scientific view that guides causation findings in claims under the VEA and MRCA (s3 Authority; s8 Basis). The practical rights and duties that flow from the instrument are therefore mediated by how decision-makers under the VEA and MRCA use the Statement when determining claims.

Rights affected. The Statement delineates the conditions under which subcutaneous lipoma and death from it can be accepted as connected to relevant service on balance of probabilities (s8, s9, s10). For a claimant, the right of legal significance is the ability to have their condition recognised as service-related for purposes of the VEA or MRCA. The Statement establishes the medical criteria that, if met and accepted by the decision-maker, will support such a finding. The instrument itself does not list the consequential benefits or entitlements; those are determined under the VEA or MRCA. The Statement therefore affects claimants’ practical right to succeed on causation grounds in claims presented under those Acts.

Duties on decision-makers. The instrument is produced under a statutory power and forms the Repatriation Medical Authority's determination under subsection 196B(3) VEA (s3). Decision-makers who adjudicate claims are expected to apply Statements of Principles as the Authority's considered medical view. The instrument imposes a framework that decision-makers must consider when assessing whether subcutaneous lipoma is connected to service. While the Statement does not itself prescribe procedural steps for decision-makers, its content constrains the causation inquiries they must make: they must determine whether at least one of the s9 factors existed and was related to relevant service per s10(1). However, because the Statement identifies specific causation factors, the practical duty for claimants who wish to advance such claims is to put forward evidence addressing those factors. Practitioners preparing medical reports or certificates, if they wish their evidence to be relevant to a VEA or MRCA claim involving lipoma, will need to address the factors listed in s9 and the service‑connection rules in s10.

Interaction with other Statements. Section 11 creates a duty for decision-makers to apply factors from other Statements where a s9 factor refers to an injury or disease that is the subject of another Statement. If a s9 factor overlaps another Statement, the factors in that other Statement apply "as in force from time to time" (s11). This establishes an ongoing obligation to check the current version of any referenced Statement when making assessments.

The Statement contains no express penalty, sanction, compliance enforcement mechanism, or criminal provision. It is a medical-technical determination made under subsection 196B(3) of the VEA and is designed to inform administrative decision-making rather than to create offences or impose fines (s3 Authority). There is therefore no enforcement machinery in the instrument itself.

How outcomes from the Statement may be enforced or produce consequences depends on their use in the primary legislation. The Statement is intended to guide determinations under s120B of the VEA and s339 of the MRCA (s5 Application). If administrative decision-makers accept that the factors and service relationship set out in the Statement are satisfied in an individual claim, the practical consequence will be that the condition is treated as connected to service within the VEA or MRCA decision‑making frameworks, and any statutory entitlements, benefits, or rehabilitative obligations under those Acts may follow. The Statement itself does not define those consequences or enforcement pathways.

Remedies and review. The instrument does not specify appeal or review routes. Any rights of review, merits appeal, or judicial review will be those provided by the VEA, the MRCA, and the administrative or judicial systems that oversee decisions made under those Acts. The Statement does not alter those statutory appeal routes; it supplies the medical causation view that will be weighed in such proceedings.

Administrative compliance. The Statement places no statutory obligations on medical practitioners, hospitals, or government agencies to provide particular records or to take specified actions. Nonetheless, because the Statement includes inability to obtain appropriate clinical management as a causation factor (s9(2)), records and documentary evidence evidencing access to treatment will be relevant material in claims. There is no mechanism in the Statement for compelling production of records; such powers, if available, stem from the adjudicative statutes and their administrative processes.

Interaction with other Statements. Section 11 requires decision-makers to apply factors from other Statements where relevant. That cross-application is a substantive legal direction rather than an enforcement mechanism. The instrument does not provide direct enforcement authority to require other agencies to adopt policies or provide services.

Summary. The Statement does not create penalties or enforcement tools. Its force is evidentiary and persuasive within the statutory framework of the VEA and MRCA: acceptance of its factors by decision-makers will determine whether conditions are treated as service-related and thus whether statutory entitlements follow, but any punitive, coercive or compliance enforcement mechanisms come from the primary legislation and administrative procedures rather than from this Statement.

The Statement is explicitly produced under the VEA and is designed to be applied within the decision-making frameworks of both the VEA and the MRCA. Several provisions in the instrument identify these interactions and the limits of the Statement's autonomous operation.

Source of power and primary statutes. The Statement is made under subsection 196B(3) of the VEA (s3 Authority). It applies to claims to which s120B of the VEA or s339 of the MRCA apply (s5 Application). This creates a direct normative link: the Statement is to be used in adjudicating claims under those statutory provisions. The Schedule defines "VEA" and "MRCA" and details what amounts to "relevant service" under both Acts (Schedule 1 - Dictionary, MRCA; relevant service; VEA). Therefore the Statement has no independent statutory effect; it functions inside the claims architecture established by those Acts.

Definitions and coding. The instrument references the ICD‑10‑AM code associated with subcutaneous lipoma (D17) but makes clear that the definitional meaning for this Statement is the textual one at s7(2), not the code alone (s7(3)). The ICD code cited is the Tenth Edition effective 1 July 2017 of the Australian Modification and is copyrighted by the Independent Hospital Pricing Authority; the instrument therefore recognises an external diagnostic coding system but anchors legal meaning in its own text.

Cross-application of other Statements. Section 11 sets out a mechanism for interaction with other Statements of Principles produced under the same VEA power. If a s9 factor refers to an injury or disease that is the subject of another Statement, then the factors in that other Statement apply "in accordance with the terms of that Statement as in force from time to time" (s11). This creates a legal hierarchy and mutability: decision-makers must consult other Statements and apply them as current. It also means that changes or repeals of other Statements may affect how the s9 factors are applied.

Effect on entitlements under primary Acts. The Statement itself does not define entitlements or mechanisms for payment, rehabilitation, or compensation. Those outcomes remain governed by the VEA and MRCA. The Statement’s role is to provide the medical-scientific foundation for causal links. Consequently, its interaction with the VEA and MRCA is procedural and evidentiary: acceptance under this Statement of a causal factor will be one element for deciding whether the statutory tests in the VEA or MRCA are met.

Repeal and transitional considerations. The instrument expressly repeals the earlier Statement concerning lipoma (No. 101 of 2015) (s4 Repeal). This creates an interaction with the prior regulatory environment. Decision-makers must therefore apply this 2024 Statement after its commencement date (s2) and not the 2015 Statement. The Statement does not specify transitional arrangements for claims in progress; any such transitional rules would be found in the primary statutes or administrative policy. The repeal means that any legal analyses or decisions previously grounded on the 2015 Statement must be revisited in light of the content of the new Statement.

This instrument contains limited internal amendment history but records a single explicit repeal of a predecessor Statement. The Statement is dated 18 October 2024 on its face and has a specified commencement date of 19 November 2024 (s2 Commencement; front matter). It was made under subsection 196B(3) of the Veterans' Entitlements Act 1986 (s3 Authority).

The sole formal amendment action recorded within the instrument is the repeal in section 4. Section 4 states that the Statement of Principles concerning lipoma (Balance of Probabilities) (No. 101 of 2015), which appeared in the Federal Register of Legislation as F2015L01316, is repealed (s4 Repeal). That repeal is unconditional in the text: once this instrument commences, the 2015 Statement is no longer in force. The instrument does not itself record any earlier amendments to the 2015 Statement nor does it supply a history of prior drafts or consultations.

The instrument also contains a saving implicit in section 11: where a factor in this Statement refers to an injury or disease covered by another Statement determined under subsection 196B(3) of the VEA, the factors in that other Statement apply "as in force from time to time" (s11). That phrase acknowledges and anticipates that other Statements may be amended, replaced, or repealed in the future, and requires decision-makers to apply those other Statements in their current form. It therefore embeds a linkage to the amendment lifecycle of other Statements without itself prescribing amendment mechanisms beyond repeal of the earlier 2015 Statement.

No transitional provisions or savings clauses are provided in this instrument concerning ongoing claims, past determinations made under the 2015 Statement, or the application of this Statement to claims lodged before commencement. The instrument is silent on temporal transitional arrangements. Any transitional or saving rules would have to be found in the VEA, MRCA, or in administrative policy and practice rather than in this Statement.

The Schedule defines certain terms that may be used in other amendments or in future Statements; for example, it defines "relevant service", "VEA", and "MRCA" (Schedule 1 - Dictionary). Those definitions frame how subsequent amendments to the VEA, MRCA, or other Statements would interact with this Statement.

In sum, the instrument replaces the 2015 Statement as of its commencement date, sets out its own definitions and operative content afresh, and requires that cross-referenced Statements be applied in their current versions, thereby acknowledging the potential for future amendment of related Statements without itself containing an amendment history beyond the single repeal it effects.

That restricts the possible routes for establishing service connection to either an alcohol use disorder coincident with the clinical onset of benign symmetrical lipomatosis (s9(1)), or an inability to obtain appropriate clinical management prior to clinical worsening (s9(2)). Definition anchoring and exclusions. The statutory definition of subcutaneous lipoma (s7(2)) is precise and expressly excludes breast lipoma, fat hyperplasia, liposarcoma, and prolapse of adipose tissue (s7(2)(b)). Claims framed around those excluded conditions cannot rely on this Statement. Although the instrument notes ICD‑10‑AM code D17 (s7(3)), it explicitly states the textual definition governs; reliance on the ICD code alone without fitting within the statutory definition risks misapplication.

Specific timing constraint on the treatment‑access factor. The inability to obtain appropriate clinical management factor (s9(2)) is limited by subsection 10(2). It applies only to material contribution to, or aggravation of, subcutaneous lipoma where the lipoma was suffered or contracted before or during relevant service, but did not arise out of service. That temporal and causal qualification means the factor is unavailable for lipomas that first arose out of service, and it is intended to address cases where pre-existing lipoma was made worse due to lack of access to care. Practitioners must therefore establish the chronology of onset relative to service to use s9(2).

Ambiguity in "appropriate clinical management". The instrument uses the term "appropriate clinical management" in s9(2) without further statutory elaboration of what constitutes "appropriate". The Statement does not set out objective standards for appropriateness, who decides it, or what evidence suffices to demonstrate inability to obtain it. Consequently, evidence and expert opinion about standards of care, availability of services, attempts to access treatment, and systemic barriers will be decisive in contested claims, but the Statement leaves the content of "appropriate" to external medical evidence and decision-maker assessment.

Compliance with the operative requirements of this Statement is primarily about evidentiary preparation for claims under the VEA or the MRCA. The Statement does not prescribe procedural steps, forms, or filing rules. It prescribes substantive factors that must be shown on the balance of probabilities for a decision-maker to accept a causal connection between subcutaneous lipoma (including death from it) and relevant service. The following steps describe how advisers and claimants should align evidence and argument with the Statement’s text.

1. Confirm that the claim falls within the Statement’s application. Ensure the claim is one to which s120B of the VEA or s339 of the MRCA applies (s5 Application). Check that the veteran’s or member’s service falls within the Schedule’s definition of "relevant service" (Schedule 1 - Dictionary, relevant service). If the person’s service does not meet those categories, this Statement will not apply.

2. Establish that the condition is correctly characterised as subcutaneous lipoma under the Statement’s definition. The Statement defines subcutaneous lipoma as a benign neoplasm of mature adipose cells in subcutaneous tissue, usually encapsulated, and excludes breast lipoma, fat hyperplasia, liposarcoma and prolapse of adipose tissue (s7(2)). Medical diagnosis and histopathology reports, where available, should be used to show that the condition matches the statutory definition. While the Statement references ICD‑10‑AM code D17, the textual definition is controlling (s7(3)).

3. Identify which s9 factor is being relied upon. The claimant must demonstrate that at least one of the two listed factors exists (s9). These are (a) alcohol use disorder at the time of clinical onset of benign symmetrical lipomatosis (s9(1)); or (b) inability to obtain appropriate clinical management for subcutaneous lipoma before clinical worsening (s9(2)). Legal and medical advisors should select which factor is most supportable given the clinical facts and records.

4. For s9(1) claims, document the timing and nature of alcohol use disorder relative to the clinical onset of benign symmetrical lipomatosis. The Statement requires alcohol use disorder to be present "at the time of the clinical onset" of benign symmetrical lipomatosis (s9(1)). Medical records, substance-use assessments, contemporaneous notes, and diagnoses should be marshalled to show both the presence of alcohol use disorder and the contemporaneity with clinical onset. Clinical descriptions linking the presentation to benign symmetrical lipomatosis (also called multiple symmetrical lipomatosis or Madelung disease) should be included, matching the note to s9.
