Compliance with the SOP means assembling and presenting evidence that establishes at least one factor in s 9 and that the factor is related to the claimant’s relevant service (s 10(1)). Below is a practical, step‑by‑step compliance checklist for claimants and advisers, aligned to the SOP’s text and definitions.

1. Confirm diagnosis and subtype against the SOP’s statutory definition (s 7(2))

   • Obtain and collate definitive pathology reports, surgical and oncology records that identify tumour type and primary tissue origin.
   • Verify the tumour falls within s 7(2) inclusions (for example, synovial sarcoma, malignant mast cell tumour, etc.) and is not an exclusion listed in s 7(2)(c) (Kaposi sarcoma, mesothelioma, leukaemia, non‑Hodgkin lymphoma, Hodgkin lymphoma, myeloma, primary myelofibrosis, myeloid sarcoma).
   • Where coding is used, ensure the ICD‑10‑AM code referenced corresponds to the 2017 Tenth Edition as cited if used as adjunct evidence (s 7(3)-(4)); but rely on textual pathology descriptors principally.

2. Establish clinical onset date

   • Identify the date of clinical onset (as required by multiple s 9 thresholds) from medical notes, first symptom reports, hospital admission dates, or pathology report dates. Where the onset date is unclear, obtain an expert opinion linking the presented history to an estimated onset date.

3. Map the factual scenario to one or more s 9 factors

   • Go through each s 9 factor and determine which, if any, could be met by available facts. Examples:
     • Vietnam service factor: confirm service records showing being on land in Vietnam, at sea in Vietnamese waters, or consuming potable water from evaporative distillation of estuarine Vietnamese waters, cumulatively at least 30 days and at least 5 years before clinical onset (s 9(1) and Schedule 1).
     • TCDD contamination: document tasks such as decanting, spraying, cleaning sawmill equipment, handling treated timber, being in dusty environments from treated timber, or using contaminated cutting oils, and quantify cumulative exposure hours to reach 250 hours at least 2 years before clinical onset (s 9(2) and Schedule 1).
     • Ionising radiation: obtain medical radiotherapy records or operational radiation exposure records and have dose‑reconstruction experts compute cumulative equivalent dose for the affected tissue/organ per ARPANSA guide (Schedule 1 and s 9(3)-(6)).
     • Vinyl chloride: assemble occupational records indicating exposure levels and durations; have occupational hygienists estimate cumulative ppm‑years to meet the 200 ppm‑years threshold (s 9(7) and Schedule 1).
     • Arsenic: get water sampling records showing average arsenic concentrations, or clinical evidence of chronic arsenic toxicity, to meet the Schedule 1 definition (Schedule 1 definition of "being exposed to arsenic" and s 9(8)).

4. Tie exposure to relevant service (s 10(1))

   • For each factor, collect service records (personnel files, deployment records, ship logs, unit diaries) to demonstrate that the exposure occurred during the claimant’s relevant service period. Where the factor is not manifestly service‑connected, prepare evidence and narrative linking the exposure to service tasks or locations.
   • For s 9(1) Vietnam service presence, use Schedule 2 items referenced in Schedule 1 (Items 3A, 3B, 4 and 8) to demonstrate the claimant’s presence in the areas and times specified.

   • For conditions requiring long durations (e.g., chronic osteomyelitis of at least 15 years (s 9(20)), obesity for at least 5 years within the 20 years before onset (s 9(16))), gather historical clinical notes, GP records, weight/height records, and longitudinal medical evidence to prove sustained presence of the condition over the requisite time.
   • For BMI calculation, use the formula W/H2 as defined in Schedule 1; you will need contemporaneous weight and height records or credible clinical entries.

7. Address special subtype requirements

   • If the claim involves angiosarcoma, hepatic angiosarcoma, or uterine sarcoma, ensure the evidence specifically addresses the relevant s 9 subclauses (e.g., arteriovenous fistula, vascular graft, Thorotrast internal deposition, tamoxifen exposure) and their timing thresholds (s 9(5)-(9), (13), (17)-(18)).

8. Document attempts to obtain clinical management when relying on s 9(21)

    • Secure medico‑legal experts who can: (a) confirm the diagnosis and subtype in terms consistent with s 7(2); (b) link exposure timing and dose/quantities to the disease with reference to latency periods specified in s 9; and (c) attach calculations and methodology statements (especially for cumulative equivalent dose and ppm‑years).
    • Ensure experts state whether, in their opinion, the SOP’s thresholds are met and explain reasoning against the SOP’s specific numerical and temporal criteria.

11. Preserve and collate service and environmental evidence

    • Obtain military service records, ship logs, water supply descriptions (particularly regarding evaporative distillation of estuarine Vietnamese waters,s 9(1)), employer records, industrial hygiene data, and any radiation monitoring files associated with deployment or medical treatment.
    • Where records are unavailable, obtain contemporaneous witness statements, unit diaries, or other secondary evidence to reconstruct exposure and service location.

12. Anticipate and pre‑empt technical challenges

    • Address issues that commonly lead to rejection: ambiguous onset dates, incomplete exposure records, use of wrong methodological editions for dose calculation, and mismatches between clinical coding and statutory text. Make experts explicitly explain any assumptions and reconcile differences with the SOP’s specified references.

13. Keep track of amendments and versions

    • Confirm that the SOP being relied on is the current in‑force version for the date of decision. The 2024 amendment modified the Schedule 1 Vietnam definition; ensure any reliance on service location uses the amended text where applicable (endnotes 3-4).

14. Administrative follow‑up

    • Where a reasonable hypothesis is established per the SOP, ensure submissions clearly set out which s 9 factor is met, how the Schedule definitions are satisfied, and how the factor relates to relevant service per s 10(1). Frame the chronology so the decision‑maker can see the threshold elements at a glance.
