Statement of Principles concerning sleep apnoea (Reasonable Hypothesis) (No. 68 of 2022)

The instrument revolves around several core constructs. First, the reasonable hypothesis standard: under the VEA, a claim will succeed if there is a reasonable hypothesis connecting the condition to service, unless the decision‑maker is satisfied beyond reasonable doubt that there is no such connection. The SoP codifies what constitutes a reasonable hypothesis for sleep apnoea. The factors in section 9 are not exclusive - other evidence could also support a hypothesis - but the instrument says that at least one of the listed factors must exist as a minimum. In practice, if no factor is present, the claim will almost certainly fail.

Sleep apnoea is defined in section 7(2) as chronic sleep‑related disordered breathing with periods of cessation or reduction of airflow in the upper airway, leading to arousals and disrupted sleep architecture, diagnosed by a specialist physician. It includes central, mixed, and obstructive sleep apnoea. The ICD‑10‑AM codes (G47.30-G47.39) are referenced but the definition is substantive, not code‑dependent. This definition excludes acute or transient apnoea and mild cases not diagnosed by a specialist. Death from sleep apnoea includes death contributed to by a terminal event from a defined list (pneumonia, respiratory failure, cardiac arrest, circulatory failure, cessation of brain function).

The instrument distinguishes between clinical onset and clinical worsening. Factors for onset (sections 9(1)-(9)) must exist at the time of first appearance of the condition. Factors for worsening (sections 9(10)-(20)) require that the condition existed before or during service but did not arise out of service (section 10(2)). Some factors appear only for worsening (e.g., alcohol consumption of at least 30 g per day for six months before worsening). Others appear for both but with different temporal requirements.

Types of sleep apnoea are critical. Several factors apply only to obstructive sleep apnoea (OSA): hypothyroidism with resultant hypothyroidism, chronic upper airway obstruction or narrowing, obesity (BMI ≥ 30), supine sleeping position for at least six months before onset or worsening, and taking protease inhibitors as antiretroviral drugs for HIV. The central sleep apnoea (CSA) factor is narrow: taking a long‑acting opioid at an average daily morphine equivalent dose of at least 75 mg for at least two months before onset or worsening. Long‑acting opioid is defined as an opioid with a duration of at least three hours, used to treat chronic pain or narcotic addiction. This is a very specific pharmacological threshold.

The dictionary (Schedule 1) defines terms precisely. Obesity is binary: BMI ≥ 30. Chronic renal failure is severe (GFR < 15 mL/min/1.73 m² for three months, or dialysis requirement). Autonomic neuropathy is defined broadly. The specified list of central nervous system lesions or disorders includes Alzheimer disease, cerebrovascular accident, epilepsy, moderate to severe traumatic brain injury, multiple sclerosis, spinal cord injury, and tumour or lesion of the cervical spine. Neuromuscular disease affecting respiratory muscles is noted by examples - myasthenia gravis, post‑polio syndrome, motor neurone disease - but is not limited to those.

The factor of inability to obtain appropriate clinical management (section 9(20)) is a catch‑all for worsening cases where no other factor applies, but it is vague and likely to be interpreted narrowly.

Importantly, each factor must be related to the person's relevant service (section 10(1)). For example, if obesity is the factor, the claimant must show that the obesity itself was caused or contributed to by service - not merely that the person was obese at the time of onset. This creates a two‑step causal chain. For worsening factors, the condition must have pre‑existed service but worsened during service (or after) in a way that is service‑related.

Section 11 provides that where a factor refers to another injury or disease that is itself covered by a Statement of Principles (e.g., heart failure, hypothyroidism, acromegaly), the factors of that other SoP must also be satisfied. This can compound the evidentiary burden significantly.

The instrument directly affects veterans, members of Peacekeeping Forces, and members of the Forces under the VEA, as well as members of the Australian Defence Force under the MRCA, who claim compensation for sleep apnoea or death from sleep apnoea. It also affects their dependants in death claims. The decision‑makers bound by the instrument include delegates of the Repatriation Commission, the Veterans' Review Board, the Administrative Appeals Tribunal, and ultimately the Federal Court. Medical practitioners are affected indirectly: claimants must obtain a diagnosis from a specialist physician (respiratory or sleep specialist), which increases the cost and time to pursue a claim. Legal advocates and ex‑service organisations (like the RSL or DVA‑appointed advocates) must understand the precise definitions and temporal requirements to properly advise clients.

The instrument does not affect private sector employees, general medical practice, or the general public. It operates only within the narrow universe of military and defence veterans' compensation. However, because many veterans work or seek treatment in the private sector, the evidentiary standards indirectly influence what private specialists are asked to certify and how sleep studies are interpreted. The requirement for a specialist diagnosis may reduce the number of successful claims by veterans who cannot afford private specialist fees or face long public wait times. That creates a de facto barrier to access, especially for rural and remote veterans. The instrument also affects the DVA's internal compliance and decision‑making costs; every claim requires checking the SoP factors, consulting medical records, and often obtaining further medical reports. The state’s administrative burden is passed partly onto the claimant.

The free‑market lens suggests that the instrument concentrates state discretion in the RMA to determine what scientific evidence is acceptable, rather than allowing individual claimants to argue causation on a case‑by‑case basis. The SoP mechanism reduces discretion of decision‑makers but also imposes rigid categories that may not reflect the full medical reality, potentially leading to outcomes that are scientifically unsound but legally correct.

The instrument imposes no duties directly on private individuals. Its duties fall on decision‑makers and claimants indirectly through the operation of the VEA and MRCA. The primary duty on the Repatriation Commission and its delegates is to apply the SoP when assessing a claim, meaning they must determine whether at least one factor in section 9 exists and whether that factor is related to the person's relevant service. If so, the reasonable hypothesis is raised, and the claim must be accepted unless contrary proof beyond reasonable doubt exists. That is a duty to apply the law correctly.

For claimants, there is a practical burden (not a legal duty) to produce evidence that satisfies a factor. The instrument gives claimants a right to have their claim assessed under the reasonable hypothesis standard with the benefit of the SoP's presumptions. They also have a right to rely on any other evidence that could raise a reasonable hypothesis outside the factors, but the instrument suggests that the listed factors are a minimum. In practice, if no factor is present, the claim is unlikely to succeed.

The instrument does not create any enforceable private right against a medical practitioner or the Department of Veterans' Affairs beyond the claim process. Section 10(2) is a crucial limitation: worsening factors apply only where sleep apnoea was suffered or contracted before or during (but did not arise out of) relevant service. This means if a veteran developed sleep apnoea for the first time during service and it arose out of service, the worsening factors are irrelevant. The claim would then need to rely on onset factors. This is a trap for claimants who might try to argue worsening instead of onset.

The factor of inability to obtain appropriate clinical management (section 9(20)) is unusual. It implies a duty on the part of the Commonwealth or the medical system to provide appropriate management, but the instrument does not create any substantive right to receive such management. It simply says that if the claimant could not obtain it and that inability contributed to worsening, it can be a factor. The scope of "appropriate clinical management" is undefined, creating uncertainty.

This instrument contains no penalty provisions. It is not a penal statute. Enforcement is achieved through the claim and review process. If a decision‑maker fails to apply the SoP correctly, the applicant can seek merits review at the Veterans' Review Board and then the Administrative Appeals Tribunal, and ultimately judicial review in the Federal Court. There are no fines or imprisonment for non‑compliance by decision‑makers; the remedy is setting aside the decision and substituting a correct one.

For claimants who provide false or misleading information to satisfy a factor, the VEA itself (section 140) imposes criminal penalties for fraud, but the SoP does not add extra penalties. The practical risk for a claimant is that if a factor is found not to exist, the claim fails - there is no penalty beyond that. However, if a claimant knowingly fabricates evidence (e.g., a false diagnosis), they may face prosecution under general criminal law or the Criminal Code.

The instrument's enforcement cost falls on the state: DVA must train staff on each new SoP, maintain medical advisory resources, and defend its decisions at review. Claimants bear the cost of obtaining specialist evidence, which can run into hundreds of dollars. For a claimant on a limited pension, this may be prohibitive. The state's control over the SoP process means that the RMA determines what factors are accepted; there is no direct appeal against the content of the SoP itself (only on grounds of unreasonableness or procedural error).

The instrument also interacts with the concept of "standard of proof" - the SoP defines a reasonable hypothesis, but the decision‑maker retains the discretion to reject the claim if satisfied beyond reasonable doubt that the condition was not service‑related. That is an extremely high bar for the state to meet, so in practice if a factor exists, claims usually succeed. The enforcement lever for the state is weak; the SoP effectively binds the state to accept causation once the factor is shown.

The instrument is made under section 196B(2) of the VEA and sits within the broader veterans' compensation framework. It applies to claims under section 120A of the VEA (which sets out the standard of proof for operational service) and section 338 of the MRCA (which applies similar standards). The SoP itself does not amend the VEA or MRCA; it fills in the content of what constitutes a reasonable hypothesis.

Section 11 is a critical interaction point. Where a factor in section 9 refers to another injury or disease (e.g., heart failure, hypothyroidism, acromegaly, chronic renal failure), the SoP requires that the factors in the Statement of Principles for that other condition must also be satisfied, as in force from time to time. This creates a cascading system of causation. For example, if a veteran relies on heart failure as a factor for sleep apnoea onset, they must also show that the heart failure itself is related to service under the heart failure SoP. This can multiply the evidentiary burden significantly and may create chains that break if any SoP factor is missing. The practical effect is that a claimant cannot simply assert a medical condition; they must trace it back through multiple SoPs to service.

The instrument repeals the previous Statement of Principles No. 41 of 2013. That means any claims determined after 25 July 2022 must be assessed under the new version. Claims that were finalised before commencement are unaffected, but on‑going reviews or appeals after commencement will use the new instrument if the matter is not finally determined (section 5 says it applies to claims to which section 120A or 338 applies - no grandfathering).

The instrument references ICD‑10‑AM coding but clarifies that the definition of sleep apnoea in section 7(2) is substantive. This means that even if a medical record uses a different code or no code, the condition must still meet the SoP's definition. The code is only a guide.

The dictionary definition of "relevant service" incorporates both VEA categories (operational, peacekeeping, hazardous, British nuclear test defence) and MRCA categories (warlike and non‑warlike). It does not include peacetime service under the VEA that is not operational. This limits who can rely on the SoP; peacetime only service under the VEA (e.g., Australian Regular Army service in Australia during non‑operational periods) is not covered unless it qualifies under another category. That is a significant exclusion.

The SoP does not interact with state workers' compensation, NDIS, or private health insurance. It is confined to Commonwealth military compensation.

The instrument itself provides its only amendment history: it repeals the Statement of Principles concerning sleep apnoea No. 41 of 2013 made under subsection 196B(2) of the VEA. That earlier instrument was registered on the Federal Register of Legislation as F2013L01129. No other amendments are recorded. The instrument commenced on 25 July 2022 and has not been amended subsequently as of its making. The RMA periodically reviews SoPs based on new medical‑scientific evidence; this version likely reflects updated evidence on causative factors such as opioid use, supine sleeping, and obesity thresholds. The 2013 version may have had different definitions (possibly a lower BMI threshold, different opioid requirements, or a broader definition of sleep apnoea). Without access to the 2013 text, we can only infer that the changes are intended to reflect current medical‑scientific evidence, as the RMA is required to ensure there is sound medical‑scientific evidence for each factor (section 8). The instrument does not provide transitional provisions for claims lodged before 25 July 2022 but not yet determined; section 5 simply says it applies to claims to which section 120A or 338 applies, which likely means claims made on or after commencement, or possibly any claim not finally determined. Practitioners should check the DVA's position.

The repeal is a full replacement; there is no saving of previous factors. The 2022 SoP is the sole authoritative version for claims determined after its commencement.

The source instrument itself does not mention any litigation. However, Statements of Principles under the VEA are frequently the subject of challenges in the Administrative Appeals Tribunal and the Federal Court. Common grounds include: that a factor is not based on sound medical‑scientific evidence (s. 196B(2) and (3) of the VEA), that the definitions are unreasonably narrow, or that the RMA failed to consider relevant material. The instrument would be subject to judicial review under the Administrative Decisions (Judicial Review) Act 1977 or the VEA's own review provisions.

Given that this instrument replaced a 2013 version, there may have been previous litigation on that earlier SoP, but the source does not reference any. Notably, the factor of supine sleeping for six months before onset is novel and may be challenged as lacking robust medical evidence. The requirement for a specialist physician diagnosis for sleep apnoea could also be contested if a claimant provides a diagnosis from a GP with extensive sleep training but is not a specialist. The term "specialist physician" is not defined in the dictionary; it would be interpreted by the ordinary meaning - a physician who has completed specialist training in respiratory or sleep medicine. That could lead to disputes.

The factor of inability to obtain appropriate clinical management is vague and could give rise to litigation about what constitutes "appropriate" management and whether the claimant genuinely could not obtain it. The RMA's determination in section 8 that there is sound medical‑scientific evidence is a jurisdictional fact that can be challenged.

While we cannot cite specific cases because none are in the source, it is safe to say that any SoP is a live document subject to legal contest. The free‑market perspective notes that litigation imposes costs on both the claimant and the state, and the rigidity of the SoP may increase disputes compared to a more flexible case‑by‑case assessment.

Several aspects of the instrument are liable to trap unwary claimants and even experienced advocates. First, sleep apnoea must be diagnosed by a specialist physician. A GP's diagnosis, even if supported by a sleep study report, will not satisfy the definition unless a specialist has made the formal diagnosis. This adds a step; the specialist must provide a written opinion.

Second, obesity is defined as BMI ≥ 30. A person with BMI 29.9 does not meet the factor, regardless of clinical significance. Moreover, the obesity must be related to service; if a veteran gained weight after service due to civilian lifestyle, the factor may not be satisfied unless the weight gain stems from a service‑related condition (e.g., depression from service). Third, for central sleep apnoea, the only factor (other than general factors like heart failure or CNS lesion) is taking a long‑acting opioid at a specific dose (≥75 mg morphine equivalent daily for two months). Short‑acting opioids, or lower doses, do not count. This is a very high threshold - 75 mg morphine equivalent is a substantial dose (e.g., 75 mg of morphine, or 50 mg of oxycodone). Many veterans on lower doses will not qualify.

Fourth, alcohol consumption is only a factor for worsening of sleep apnoea, not onset. A veteran who consumed alcohol before first developing sleep apnoea cannot use that factor for the initial claim. The requirement is an average of at least 30 g per day (three standard drinks) for at least six months before worsening. Occasional heavy drinking does not meet the average standard.

Fifth, supine position when sleeping for at least six months before onset or worsening of obstructive sleep apnoea. This requires evidence of habitual sleeping position; self‑report may be challenged, and many people change positions during sleep. Sixth, antipsychotic drug use must be for at least two months before onset or worsening. The instrument does not define "antipsychotic drug", leaving room for argument about whether atypical antipsychotics (e.g., quetiapine at low doses used for sleep) qualify likely yes, but that is not explicit.

Seventh, the inability to obtain appropriate clinical management factor (section 9(20)) appears simple but is difficult to prove. It requires demonstrating that the inability itself contributed to worsening. It will not cover cases where the veteran simply did not seek treatment.

Eighth, chronic renal failure is defined at a very advanced stage (GFR < 15 or dialysis). Early stage chronic kidney disease does not qualify. Ninth, the specified list of CNS lesions includes only certain conditions; e.g., it does not include brain tumours outside the cervical spine (only "tumour or lesion of the cervical spine"), nor does it include Parkinson's disease.

Tenth, section 11 cross‑referencing: if a factor relies on another condition, that condition's SoP must be satisfied. If the other SoP has even more restrictive factors, the claim may fail. For example, if a veteran has hypothyroidism but cannot link it to service under the hypothyroidism SoP, the sleep apnoea factor is unavailable.

Eleventh, timing : factors must exist "at the time of the clinical onset" (or before, for some). This means the temporal connection must be precise. A veteran who becomes obese after developing sleep apnoea cannot use obesity as a factor for onset.

Twelfth, the instrument applies only to relevant service as defined. If a veteran's service is not operational, peacekeeping, hazardous, British nuclear test, warlike, or non‑warlike, the SoP does not apply; they would need to prove causation on normal balance of probabilities.

Finally, the instrument does not create a presumption that service caused sleep apnoea; it only raises a reasonable hypothesis. The decision‑maker can still reject the claim if they are satisfied beyond reasonable doubt that the condition was not service‑related. That standard is rarely met, but possible if, say, the veteran had severe obesity and family history before service.

Compliance with this instrument is relevant for two groups: claimants (veterans and their representatives) and decision‑makers within DVA and review tribunals. For claimants, the steps are practical. First, secure a diagnosis of sleep apnoea from a specialist physician - typically a respiratory or sleep physician. The diagnosis must be based on a sleep study and meet the definition in section 7(2). Obtain a written report that states the type (obstructive, central, mixed) and clinical onset date. Second, identify which factor or factors from section 9 might apply. Common factors for OSA are obesity (BMI ≥ 30), supine sleeping, or hypothyroidism. For each factor, gather contemporaneous medical records showing the factor existed at the relevant time. For obesity, evidence of weight and height at the time of onset (or before). For supine sleeping, a history from bed partner or sleep study that shows supine position. For opioid‑induced CSA, obtain prescription records and calculate the morphine equivalent daily dose over the two months before onset. Use the Australian Standard of 10 g per standard drink for alcohol intake.

Third, and critically, establish that the factor is related to the person's relevant service. This is often the hardest part. For obesity, the veteran may need to show that service caused or contributed to weight gain (e.g., physical inactivity due to injury, medication‑induced weight gain, or psychological conditions). For heart failure, it must be service‑related via another SoP. For inability to obtain clinical management, show that the veteran was denied treatment by DVA or lacked access. Legal representatives should prepare a detailed statement linking the factor to service events.

Fourth, ensure the timing matches: onset factors require existence at the time of clinical onset; worsening factors require existence before worsening and that the condition pre‑existed service but did not arise out of it (section 10(2)). If sleep apnoea first arose during service and was caused by service, only onset factors apply.

For decision‑makers, compliance means scrupulously checking each factor against the definitions in the dictionary. Do not accept a diagnosis of sleep apnoea unless the report is from a specialist physician. For central sleep apnoea, confirm the type on the sleep study. For opioid use, request the prescribing records and calculate the dose. Do not accept a factor without verifying that the underlying condition (if referenced by another SoP) meets that SoP. If the factor is obesity, check that the person's BMI was 30 or greater at the time of onset (or worsening). Do not rely on later BMI as evidence of earlier BMI unless medical records consistent.

Note that the instrument uses the word "must" in section 9: at least one factor must exist. That means if no factor exists, the claim must fail (unless the hypothesis can be raised by evidence outside the SoP, but the instrument says the factors are a minimum; it does not say they are exhaustive, but in practice they are treated as necessary).

For worsening claims, ensure the veteran's sleep apnoea was present before or during service but did not arise out of service. A statement from the veteran about when they first noticed symptoms is essential. If the condition first appeared during service and is clearly linked to service, the worsening factors do not apply; treat it as an onset claim.

Finally, section 11 requires decision‑makers to apply other SoPs when a factor refers to another disease. Keep a copy of current SoPs for heart failure, hypothyroidism, chronic renal failure, etc., and apply them strictly. This can be complex and time‑consuming, but ignoring it would be an error of law.

From a free‑market perspective, compliance imposes significant transaction costs on both sides. Claimants may need to pay for medical reports, calculations, and legal assistance. The state must maintain a team of medical advisers and legal officers. The rigidity of the prescribed factors may lead to arbitrary outcomes where medical reality does not fit neatly into the SoP. However, it also provides certainty and uniformity, reducing the discretion of individual decision‑makers and the scope for inconsistent results.
