Statement of Principles concerning sick sinus syndrome (Balance of Probabilities) (No. 67 of 2022)

The SoP introduces several key concepts. First, sick sinus syndrome is defined in subsection 7(2) as “a group of cardiac arrhythmias caused by dysfunction of the sinus node, in which persistent or intermittent abnormalities of cardiac impulse formation and propagation cause an atrial rate inappropriate for physiological requirements, resulting in clinical symptoms.” The definition explicitly excludes congenital sick sinus syndrome. This means that only acquired dysfunction of the sinus node is covered. The RMA’s notes clarify that the condition can manifest as persistent or intermittent sinus bradycardia, sinus pause or arrest, bradycardia‑tachycardia syndrome, and other arrhythmias, with typical symptoms including fatigue, lightheadedness, palpitations, presyncope, syncope, dyspnoea on exertion, and chest discomfort. The ICD‑10‑AM code assigned is I49.5, but the legal meaning is the definition in subsection 7(2), not the code itself (subsection 7(3)). This is important because medical classification changes may not automatically alter the legal scope. Second, clinical onset and clinical worsening are distinct triggering points. Factors 1-18 relate to onset; factors 19-37 relate to worsening. Section 10(2) explains that the worsening factors apply only to material contribution or aggravation “where the person’s sick sinus syndrome was suffered or contracted before or during (but did not arise out of) the person’s relevant service.” This distinction prevents double‑counting and limits worsening claims to pre‑existing conditions that were not caused by service. Third, the balance of probabilities standard is inherent: the SoP is made under subsection 196B(3) of the VEA, which requires the RMA to be satisfied that “it is more probable than not” that the condition can be related to relevant service. This is a lower threshold than reasonable hypothesis, but still requires sound medical‑scientific evidence. Fourth, relevant service is defined in the dictionary as: (a) eligible war service (other than operational service) under the VEA; (b) defence service (other than hazardous service and British nuclear test defence service) under the VEA; or (c) peacetime service under the MRCA. This means the SoP does not apply to operational service, hazardous service, or warlike service - a significant limitation. Fifth, the specified list of drugs (defined in the dictionary) includes 12 categories of medications, such as beta blockers, antidepressants (e.g. amitriptyline), antihypertensives (e.g. clonidine), class 1A/1C/III anti‑arrhythmics, cardiac glycosides, lithium, and non‑dihydropyridine calcium channel blockers. For the factor to be satisfied, the drug must have been taken within the 30 days before the clinical onset or worsening. This imposes a tight temporal link and may require detailed prescription or dispensing records. Sixth, terminate event is defined to include pneumonia, respiratory failure, cardiac arrest, circulatory failure, or cessation of brain function. Death from sick sinus syndrome includes death contributed to by any such terminal event (subsection 7(5)). Seventh, the concept of relationship to service (section 10) requires that the factor itself be related to the person’s relevant service - not just the sick sinus syndrome. If, for instance, hypertension is the factor, the hypertension must itself be service‑related, either through another SoP or direct evidence. This cascading concept can multiply the evidentiary burden. Finally, the SoP incorporates other Statements of Principles for referenced diseases (section 11). For example, if a factor is “having ischaemic heart disease,” then the SoP for ischaemic heart disease applies to determine whether that disease is related to service. This prevents conflicting standards within the same claim.

The SoP directly affects veterans and members of the Australian Defence Force (ADF) who have rendered relevant service as defined and who claim that they suffer from sick sinus syndrome as a result of that service. Specifically, it applies to: (a) veterans with eligible war service that is not operational service (e.g. home defence or certain peacekeeping missions); (b) veterans with defence service that is not hazardous service and not British nuclear test defence service (e.g. peacetime training); and (c) members with peacetime service under the MRCA (generally ADF members who served after 1 July 2004 in non‑warlike circumstances). Their dependents and legal personal representatives are affected when the claim involves death from sick sinus syndrome. The instrument does not apply to veterans with operational service (e.g. service in a combat zone) unless a separate SoP under subsection 196B(2) is made - which this is not. That operational‑service cohort would be assessed under the reasonable hypothesis standard, and the RMA would issue a different SoP for that purpose.

Beyond claimants, the SoP imposes obligations on the Department of Veterans’ Affairs and the Military Rehabilitation and Compensation Commission as the decision‑making bodies. Their internal medical advisors, delegates, and review officers must apply the SoP strictly when assessing claims. The SoP reduces their discretion - if a factor is present and service‑related, the connection is presumed unless the decision‑maker can disprove it on the balance of probabilities. This shifts administrative costs from claimants to the department: the department may need to commission expert evidence to rebut the presumption. Legal practitioners and advocates who represent veterans must become familiar with the 37 factors and the temporal requirements. They must gather evidence of the specific factor (e.g. a drug chart or biopsy showing myocarditis) and tie it to service. Medical specialists diagnosing sick sinus syndrome will need to attest not only to the presence of the condition but also to the potential causal factors listed, which may increase the time and cost of producing reports. The pharmaceutical industry is indirectly affected because the specified list of drugs links prescription patterns to compensation eligibility. Any drug that appears on the list, if taken within 30 days of onset, can form the basis of a claim. This may create a perverse incentive for claimants to attribute their arrhythmia to a medication rather than an underlying condition, but the factor still requires the drug to be taken and a temporal link. The RMA itself, as the rule‑maker, is affected because it must monitor medical‑scientific evidence and update the SoP when necessary. The repeal of the 2014 SoP means that any decision made under that instrument after 25 July 2022 may need to be reviewed if the new factors are more favourable to the claimant. The instrument thus affects the administration of hundreds or thousands of claims annually, with direct fiscal consequences for the Commonwealth budget.

The SoP creates both rights and duties. For a person claiming compensation under the VEA or MRCA in respect of sick sinus syndrome, the key right is to have the claim assessed using the factors in section 9. If the person can prove that at least one factor exists and that factor is related to their relevant service, the decision‑maker must accept that the sick sinus syndrome is connected to service on the balance of probabilities - unless the decision‑maker can prove otherwise. This effectively shifts the burden of disproof to the department. The claimant also has the right to rely on the incorporation of other SoPs (section 11) for any factor that is itself a disease covered by a separate SoP. For example, if the factor is “having hypertension at the time of clinical onset,” the claimant does not need to prove the causal link between hypertension and service from scratch; they can rely on the Hypertension SoP to establish that connection, provided the hypertension itself satisfies that SoP. This cascading reliance can reduce the evidentiary burden.

Claimants also have the right to argue that a particular factor applies even if the disease onset or worsening occurred many years after service, as long as the factor existed at the relevant time and is service‑related. For the worsening factors (19-37), the claimant has the right to claim that a material contribution or aggravation occurred after the disease was already present, but only if the disease did not arise out of service. This is a limitation: if the disease was already caused by service, the worsening factors are not available. The right is conditional on being a person with relevant service - as defined in the dictionary - which excludes operational service, hazardous service, and British nuclear test defence service. Thus the right is narrower than many veterans might assume.

The corresponding duty on the claimant is to produce evidence that the factor exists and that it relates to service. This may involve obtaining medical records documenting atrial fibrillation, hypertension, myocarditis, or the ingestion of a specified drug. For drug‑related factors, prescription and dispensing records are critical. For surgical factors, operative notes must be provided. The claimant also has a duty not to make a false or misleading statement - fraud provisions in the VEA and MRCA carry penalties including loss of entitlements and potential prosecution. For the decision‑maker, the duty is to apply the SoP as a binding direction. The SoP does not allow a decision‑maker to disregard a factor even if they think the medical connection is implausible, as long as the factor is made out. However, the decision‑maker retains the duty to assess whether the factor itself is related to service. For example, a claimant may have hypertension, but the decision‑maker must determine whether that hypertension is a result of service (e.g. due to noise exposure or stress) based on the applicable SoP or direct evidence. The decision‑maker also has a duty to treat the SoP as the exclusive pathway for proof of connection - no other factors can be considered (AAT case law confirms that factors outside the SoP cannot be used to establish connection). This is a significant limitation on the decision‑maker’s discretion. The RMA has a duty to maintain the SoP based on “sound medical‑scientific evidence” and to review it periodically, though the SoP itself does not specify a review period.

The SoP itself does not impose penalties. It is a determinative instrument, not a penal one. However, it operates within the broader enforcement framework of the VEA and MRCA. If a person makes a false or misleading statement in support of a claim under this SoP - for example, falsely claiming to have taken a specified drug within 30 days of onset - they may be subject to penalties under section 56 of the VEA (offences relating to false statements) or similar provisions in the MRCA. Those penalties can include imprisonment or fines. The DVA and MRCC have enforcement powers to investigate claims, request medical records, and recover overpayments if a claim is later found to have been based on incorrect information. There is no direct penalty provision within the SoP, but the compliance burden is shifted onto claimants to produce accurate evidence. For a decision‑maker who fails to apply the SoP correctly, the remedy is internal review or appeal to the Administrative Appeals Tribunal (AAT) or the Federal Court, not a penalty against the decision‑maker. The SoP could be challenged by a veteran if a decision‑maker refuses to apply a factor that is properly made out, leading to a reviewable error. The AAT may set aside the decision and substitute its own. The RMA’s determination of the SoP itself can be judicially reviewed, though the threshold for such review is high (e.g. jurisdictional error, failure to take into account relevant material). No specific penalty for non‑compliance with the SoP is provided because it is not a set of rules to be “obeyed” in a regulatory sense; it is a standard of proof to be applied. The enforcement of the SoP is therefore primarily through the claims appeal system. The practical cost of enforcement falls on the taxpayer, as the DVA and MRCC must fund investigations and legal representation in contested cases. There may also be penalties for medical practitioners who knowingly provide false reports, under the Health Insurance Act 1973 or professional conduct standards, but those are external to this instrument. Overall, the SoP lacks any enforcement teeth of its own; its effectiveness depends on the integrity of the evidence provided and the vigilance of decision‑makers in verifying that evidence.

The SoP sits within a framework of veterans’ entitlements legislation and medical‑legal instruments. Its primary enabling law is subsection 196B(3) of the VEA, which gives the RMA power to determine factors for claims assessed on the balance of probabilities. The SoP also applies to claims under section 339 of the MRCA, which is the equivalent provision for peacetime service. The interaction with the standard of proof is crucial: this SoP does not apply to claims assessed under the reasonable hypothesis standard (subsection 196B(2) of the VEA). A separate SoP for those claims would need to be made. Thus the SoP divides the veteran population by service type. It also interacts with the Interpretation Act 1901 (Cth) regarding commencement, repeal, and definitions. The repeal of the 2014 SoP means that any claim made after 25 July 2022 that was previously subject to the old SoP must now be decided under this new instrument. The transitional provisions (section 5) state that the SoP applies to claims to which section 120B of the VEA or section 339 of the MRCA applies - that is, to claims made or pending on or after commencement? The text says “applies to a claim to which section 120B … applies”, which could include existing claims if the SoP is favourable to the veteran. However, section 120B itself has temporal rules; generally the SoP in force at the time of the decision is applied. This SoP interacts with the social security law only indirectly - a veteran who receives compensation for sick sinus syndrome may have their Centrelink benefits affected. The SoP itself does not provide for indexation or payment rates; those are in the VEA and MRCA.

The SoP also interacts with the general law of evidence. The fact that the SoP provides a list of accepted factors means that evidence outside those factors cannot establish connection. This can be challenged as an unconstitutional restriction on judicial power, but that argument has been rejected by the High Court in previous challenges to the RMA scheme (e.g. Repatriation Commission v Vietnam Veterans’ Association of Australia (2000) 177 ALR 467, though not cited in the instrument). The SoP interacts with the Health Insurance Act and the Medicare system when medical reports are obtained. If a factor references a disease that has its own SoP, that SoP is incorporated (section 11). This creates a cascading effect: to prove the factor “having hypertension,” you must apply the Hypertension SoP. That SoP may in turn reference other factors, leading to a chain of linking. This can increase the length and cost of claims. The SoP also interacts with the ICD‑10‑AM classification; subsection 7(4) specifies the 10th edition (effective 1 July 2017). If the ICD coding changes, the meaning of sick sinus syndrome for this SoP does not automatically update - the definition in subsection 7(2) controls. This can cause confusion if medical reports use a newer code. The SoP also interacts with state and territory workers’ compensation schemes if the veteran also has a workplace claim; but generally, the VEA and MRCA operate as exclusive schemes for service‑related conditions. The interaction with the common law is limited: common law tort claims against the Commonwealth are barred or restricted by the VEA and MRCA. The SoP also interacts with the Australian Consumer Law if a medical practitioner fails to diagnose sick sinus syndrome, but that is a separate cause of action.

This SoP repeals the Statement of Principles concerning sick sinus syndrome No. 16 of 2014 (Federal Register of Legislation No. F2014L00024), which was also made under subsection 196B(3) of the VEA. The current instrument commenced on 25 July 2022, the day after it was registered on the Federal Register of Legislation (presumably 24 June 2022 was the date of making). There is no amendment history within the instrument itself - it is a standalone replacement. The 2014 SoP had been in force for about eight years. The reasons for the replacement are not stated in the instrument, but the RMA’s note in section 8 says “on the sound medical‑scientific evidence available” the RMA is of the view that the connection is more probable than not. This suggests that new evidence or a review of existing evidence led to the change. The specific changes compared to the 2014 SoP are not detailed in this document, but we can infer from the factors. For instance, the 2014 SoP may have had a different list of drugs, timeframes, or included or excluded certain conditions. The fact that the 2022 SoP includes COVID‑19 (SARS‑CoV‑2) as an example of viral myocarditis in the notes to factors 9 and 27 is a notable update reflecting the pandemic. The inclusion of immune checkpoint inhibitor therapy as a cause of non‑infectious myocarditis also reflects recent medical understanding. The repeal itself is clear: section 4 states “The Statement of Principles concerning sick sinus syndrome No. 16 of 2014 … is repealed.” There is no saving or transitional provision, meaning the new SoP applies to all claims decided after commencement, even if the claim relates to a period before 2022. This could disadvantage a claimant who had a claim under the old SoP that would have succeeded but fails under the new one. Conversely, a claimant who failed under the old SoP may now succeed if a new factor (e.g. COVID‑19) is present. There is no requirement for the RMA to provide a statement of reasons for the changes, though under the Legislative Instruments Act 2003 (now the Legislation Act 2003) the instrument would have been accompanied by an explanatory statement. That statement is not provided here. Future amendments to this SoP would be by another instrument made by the RMA. Given that SoPs are reviewed periodically, a further update may occur in several years. The amendment history is therefore simple: one predecessor (2014) and the current (2022), with no intermediate amendments.

The instrument itself does not discuss any litigation history. Statements of Principles are frequently challenged in the Administrative Appeals Tribunal (AAT) and the Federal Court, particularly regarding whether the RMA has properly exercised its power, whether the factors are supported by sound medical‑scientific evidence, and whether the SoP is consistent with the VEA. There have been many cases involving other SoPs (e.g. for ischaemic heart disease, post‑traumatic stress disorder), but specific litigation on the sick sinus syndrome SoP is not referenced here. It is reasonable to assume that the 2014 SoP may have been litigated, but we cannot state that without a source. What can be said is that the RMA is subject to judicial review under the Administrative Decisions (Judicial Review) Act 1977 and the Constitution. A court could set aside the SoP if it is found to be ultra vires the VEA - for example, if a factor is not relevant to the disease or if the RMA failed to consider relevant material. The current SoP’s reliance on “sound medical‑scientific evidence” (section 8) is a jurisdictional fact that could be challenged if a party proves that the RMA acted on no evidence or an irrational basis. However, the courts give the RMA a wide margin of appreciation. The AAT may also review decisions made under the SoP, but the SoP itself is a legislative instrument and the AAT cannot overturn it; the AAT can only decide whether the decision‑maker correctly applied the SoP to the facts. If the AAT finds that the SoP is ambiguous, it may interpret it, but it cannot declare it invalid. Only the Federal Court (or High Court) can do that. There is no publicly available indication that this SoP has been the subject of litigation since its commencement in 2022, though individual claim decisions under it will inevitably be appealed. The absence of cited cases in the instrument means we cannot provide any specific litigation outcomes. The 2014 SoP may have been considered in cases such as Repatriation Commission v Snow (2021) 285 FCR 136 (if the disease was related), but that is speculation. The safe course is to note that the litigation history is not contained in the source provided and therefore cannot be discussed in detail. The only certain litigation is the theoretical possibility of judicial review.

Several provisions in this SoP can easily trip up claimants and even experienced advocates. First, the exclusion of congenital sick sinus syndrome (subsection 7(2)(b)) means that if a person’s arrhythmia is due to a congenital sinus node abnormality, no factor under this SoP can help them. The factor list only addresses acquired causes, and a congenital classification may be argued by the DVA to defeat a claim. Second, the temporal limitations are strict: for drug ingestion, it must be within 30 days before clinical onset or worsening; for thoracic surgical procedures, within 1 year; for penetrating trauma, within 3 months; for general anaesthesia, within 30 days. A claimant who took a beta blocker 31 days before the first documented symptom may not satisfy factor 18 or 36, even if the medication could have been a trigger. The phrase “at the time of the clinical onset” (used for many factors like hypertension, atrial fibrillation) does not specify a precise timeframe, which creates ambiguity. A claimant with hypertension diagnosed after the onset of sick sinus syndrome may argue it existed beforehand, but the decision‑maker may require evidence that it was present before or concurrently. Third, the relationship to service requirement (section 10) is often overlooked. Even if a claimant has a factor (e.g. viral myocarditis from SARS‑CoV‑2), they must also show that the infection itself was related to their relevant service. A veteran who contracted COVID‑19 while on leave, not during service, may not satisfy this link. For drug factors, the medication must have been taken as a result of service - e.g. prescribed for a service‑related condition. If the drug was for a condition unrelated to service, the factor fails. Fourth, factor 37 “inability to obtain appropriate clinical management for sick sinus syndrome” is a catch‑all for worsening, but it requires proof that such inability occurred and caused the worsening. This is difficult to establish and may be interpreted narrowly (e.g. lack of access to a pacemaker). Fifth, the specified list of drugs is a trap for the unwary. Many common medications are on it, but the list is exhaustive. For example, amiodarone is a class III anti‑arrhythmic and is on the list, but a newer anti‑arrhythmic not listed cannot be used. The note says “specified list of drugs” is defined in the dictionary, and it includes “beta blockers” without specifying that only cardioselective beta blockers are included. This could lead to disputes over whether a particular drug (e.g. sotalol, which has both beta‑blocking and class III properties) falls under beta blockers or class III, but it is included under one of them. Sixth, the worsening factors (19-37) apply only if the sick sinus syndrome did not arise out of service. If the disease was already caused by service, any subsequent worsening cannot be claimed under this SoP. That means claimants with a service‑connected onset cannot use factors 19-36 to claim additional payments for aggravation; they would need to show a separate worsening due to inability to obtain clinical management (factor 37). This is counter‑intuitive. Seventh, the ICD code reference in subsection 7(3)-(4) creates a potential mismatch. If a doctor diagnoses “sick sinus syndrome” but assigns a different ICD‑10‑AM code (e.g. I49.8), the definition in subsection 7(2) still applies, but the discrepancy may cause confusion. Eighth, the incorporation by reference to other SoPs (section 11) means that an applicant must satisfy the factors in both this SoP and the referenced SoP for the underlying condition. If the Hypertension SoP requires hypertension to be diagnosed on two separate occasions, for example, the claimant must meet that standard. This multiplies the evidentiary burden. Finally, the Death from sick sinus syndrome definition includes terminal events that were contributed to by the disease. A claimant’s death may be primarily due to pneumonia, but if sick sinus syndrome was a contributing factor, it may still be compensable. However, the contribution must be more than negligible - the standard is uncertain.

Compliance with this SoP is not about obeying a regulatory code but about successfully navigating a claim for compensation. For a claimant, the first step is to obtain a definitive medical diagnosis of sick sinus syndrome under the definition in subsection 7(2) - excluding congenital cases. A cardiologist’s report should explicitly state the diagnosis based on sinus node dysfunction and clinical symptoms, and should document whether it is congenital or acquired. Second, the claimant must identify all potential factors from the list (section 9) that apply to their medical history. This requires a comprehensive review of past and present medical records, including: any diagnosis of atrial fibrillation, atrial flutter, hypertension, ischaemic heart disease, heart failure, rheumatic fever, pericarditis, cardiomyopathy, myocarditis, neoplasms, hypothyroidism; details of any thoracic surgery, invasive cardiac procedures, heart transplant, general anaesthesia, penetrating trauma to the heart; and a list of all medications taken, cross‑referenced against the specified list of drugs, with dates of ingestion. Particular care is needed with the drug list: the claimant should obtain pharmacy records showing dispensing dates within 30 days before the first symptoms or before documented worsening. For surgical factors, operative notes and admission dates are needed to prove the 1‑year or 30‑day timeframe. For infections like viral myocarditis, the claimant must provide evidence of the specific infection (e.g. a positive PCR for SARS‑CoV‑2, or serology for coxsackievirus). Third, the claimant must establish that the chosen factor itself is related to relevant service. This is often the hardest step. For example, if the factor is hypertension, the claimant needs to prove that the hypertension is service‑related - usually by relying on the Hypertension SoP (if applicable) or by direct evidence that it was caused by service. If the factor is taking a specified drug, the claimant must show that the drug was prescribed for a service‑related condition (e.g. beta blockers for combat‑related hypertension). If the drug was for a non‑service condition (e.g. migraine unrelated to service), the factor cannot be used. Fourth, the claimant must determine whether the claim is for clinical onset or clinical worsening. If the sick sinus syndrome first manifested after service, use onset factors. If it existed before or during service but worsened after, use worsening factors - but only if the disease did not arise out of service. The claim should clearly state which time point is being relied on. Fifth, the claimant must ensure that the temporal requirements for each factor are met. This may require obtaining medical records that specifically note the date of the first symptom (e.g. syncope, palpitations). If the first symptom is unclear, the decision‑maker may use the date of first diagnosis, which could be later than actual onset. The claimant should provide a timeline. Sixth, if the factor is a disease that has its own SoP (e.g. ischaemic heart disease), the claimant must also satisfy the factors in that SoP. The claim should incorporate that evidence. Seventh, the claimant must document the relationship between the factor and service. This may involve service records, postings, combat exposure, vaccination records, or anything showing that the factor was caused or contributed by service. For example, viral myocarditis from COVID‑19 contracted during a deployment would need proof of deployment and infection. Eighth, the claimant must avoid relying on a single factor if alternatives exist. If multiple factors apply, list them all to increase the chance of at least one being accepted. Ninth, the claimant should preserve all evidence of medical history, especially if the condition is longstanding. The SoP does not require the factor to be the sole cause, just to exist at the relevant time. Tenth, for death claims, the claimant must show that sick sinus syndrome contributed to a terminal event (pneumonia, respiratory failure, cardiac arrest, circulatory failure, or cessation of brain function). A death certificate should mention sick sinus syndrome as a contributing cause. If it does not, a medical opinion linking the condition to the terminal event is necessary. Finally, the claimant should seek legal advice from a specialist veterans’ lawyer or advocate, because the interplay between this SoP and others is complex. The decision‑maker (DVA or MRCC) must also comply by applying the SoP strictly, but they have the duty to verify the evidence. The compliance burden for the system is heavy, as each factor requires corroboration, and the cascading references to other SoPs can lengthen processing times. For medical practitioners, compliance means providing detailed reports that address not just the diagnosis but also the presence of each potential factor and its timeline. Failure to do so can lead to claim rejection or costly appeals.
