Statement of Principles concerning pleural plaque (Reasonable Hypothesis) (No. 105 of 2022)

The instrument is structured around a small set of legal and medical concepts. Primary concepts defined or used in the instrument are: pleural plaque; death from pleural plaque (including contributing terminal events); respirable asbestos fibres; refractory ceramic fibres; erionite; relevant service; and the reasonable‑hypothesis threshold to connect disease to service.

• Pleural plaque: The instrument defines pleural plaque as a circumscribed area of thickening of the pleura related to the inhalation of mineral fibres (s 7(2)). The instrument adds clinical notes describing the histological and anatomical features (elevated flat or nodular lesion, dense hyalinised collagen, possible calcification, usually parietal pleura, often bilateral), but the operative definition remains a fibre‑related pleural thickening (s 7(2) and accompanying notes).

• Death from pleural plaque: The instrument treats death as included where death is from a terminal event or condition contributed to by the person's pleural plaque. It defines terminal event by example (pneumonia, respiratory failure, cardiac arrest, circulatory failure, cessation of brain function) in Schedule 1 (s 7(3), Schedule 1).

• Reasonable hypothesis framework: Section 9 uses the phrase "At least one of the following factors must as a minimum exist before it can be said that a reasonable hypothesis has been raised connecting pleural plaque or death from pleural plaque with the circumstances of a person's relevant service." This sets a conjunctive structure: any single listed factor, when shown to be present and related to relevant service, suffices to raise the reasonable hypothesis for claims under the specified statutory provisions (s 9; s 5 links to those claim provisions).

• Exposure categories and thresholds: The instrument identifies four discrete exposure/management factors:

  1. Inhaling respirable asbestos fibres while material containing asbestos was being applied, removed, cut, drilled, dislodged or disturbed, with first inhalation at least five years before clinical onset (s 9(1)(a)-(b)).
  2. Inhaling respirable refractory ceramic fibres in an enclosed space during manufacture/processing, for a cumulative period of at least 2,000 hours and with first inhalation at least five years prior to clinical onset (s 9(2)(a)-(b); Schedule 1 defines refractory ceramic fibres).
  3. Inhaling erionite fibres on more days than not for at least five years before clinical onset, with first inhalation at least 10 years before clinical onset (s 9(3); Schedule 1 defines erionite).
  4. Inability to obtain appropriate clinical management for pleural plaque, subject to the limiting provision in s 10(2) (s 9(4), s 10(2)).

• Relevant service: The instrument requires that any factor relied on be related to the person's relevant service, which is explicitly defined in the Schedule to include operational, peacekeeping, hazardous, British nuclear test defence service under the VEA, and warlike or non‑warlike service under the MRCA (Schedule 1). Section 10(1) makes the relationship to relevant service an express requirement.

• Cross‑reference to other Statements: If a factor in s 9 refers to an injury or disease covered by another Statement of Principles under s 196B(2) of the VEA, then the factors in that other Statement apply in accordance with their terms as in force from time to time (s 11).

The instrument therefore converts a set of medical‑scientific positions into legally operative thresholds that claim‑decision processes must test against when assessing whether the reasonable‑hypothesis threshold is met for pleural plaque claims under the specified statutory provisions.

The instrument applies to persons making claims to which section 120A of the VEA or section 338 of the MRCA applies (s 5). It thus targets the decision‑making and evidentiary environment around veteran and defence force member claims covered by those statutory claim provisions. The instrument does not itself specify entitlement outcomes or payments; instead it provides the medical‑scientific criteria that must be met to raise a reasonable hypothesis that pleural plaque, or death from pleural plaque, is connected to the individual's relevant service (s 9, s 10).

The Schedule defines relevant service as a range of service types under the VEA and MRCA: operational service, peacekeeping service, hazardous service, British nuclear test defence service under the VEA, and warlike and non‑warlike service under the MRCA (Schedule 1). Therefore, the categories of people affected include veterans, former and current members of the Forces, and members of Peacekeeping Forces whose service falls into any of those defined categories, provided their claims fall under the statutory provisions specified in s 5.

Practically, affected parties include:

• Claimants (veterans/members) who assert pleural plaque or death from pleural plaque as related to their relevant service. They must adduce evidence that at least one of the factors in s 9 existed and was related to their relevant service (ss 5, 9, 10).

• Medical and evidentiary advisers, including medical officers and clinicians preparing opinions for claims, who must align their reports with the medical‑scientific criteria the Authority has set out (s 8, s 9).

• Decision‑makers under the VEA and MRCA, who will treat this Statement as the medical basis for testing the reasonable‑hypothesis threshold in respect of pleural plaque claims (s 3, s 5, s 8). The instrument itself does not name the decision maker but is made under s 196B(2) of the VEA and is addressed to claims under VEA and MRCA provisions (ss 3, 5).

• Administrators responsible for record‑keeping and claims processing who must ascertain whether the temporal, spatial and exposure thresholds are met , for example, investigating whether an inhalation occurred "at the time material containing asbestos was being applied, removed, cut, drilled, dislodged or disturbed" or whether exposures occurred "in an enclosed space" during manufacture or processing for the cumulative hours specified (s 9(1)-(2)). The instrument includes a note emphasising that disturbance of debris or dust contaminated with asbestos fibres in an enclosed space may result in exposure (s 9(1) note).

Because the Statement cross‑references other Statements of Principles (s 11), persons whose exposure factors overlap with another Statement (for example, where a factor in s 9 refers to an injury or disease covered elsewhere) will be affected by the interplay between Statements and may need to rely on the other Statement's factors as they stand from time to time.

The instrument also affects those preparing or contesting claims as to causation and latency: its specific latency requirements (first inhalation at least five years before clinical onset for certain factors; ten years for erionite first inhalation) and cumulative exposure requirements create concrete evidentiary thresholds that claimants must engage with when assembling service histories and medical timelines (s 9).

This instrument does not create statutory duties, penalties or direct entitlements itself; rather it specifies the medical‑scientific criteria that must be met to raise a reasonable hypothesis that pleural plaque, or death from pleural plaque, is connected to relevant service. The operative duties and rights therefore flow from how decision‑makers under the VEA and MRCA use the Statement when assessing claims.

Duties implied by the instrument:

• Duty to establish at least one qualifying factor: For a reasonable hypothesis to be raised, a claimant must establish the existence of at least one of the factors listed in section 9. These are minimum evidentiary thresholds that must exist in relation to the person's exposure history and clinical timeline (s 9).

• Duty to link the factor to relevant service: Section 10(1) requires that the existence of any factor referred to in section 9 "must be related to the relevant service rendered by the person." This places a relationship test between the demonstrated factor and the declared category of relevant service (s 10(1); Schedule 1 defines relevant service).

• Duty regarding clinical management factor: The factor in subsection 9(4), inability to obtain appropriate clinical management for pleural plaque, is limited by subsection 10(2). It applies only to material contribution to, or aggravation of, pleural plaque where the person's pleural plaque was suffered or contracted before or during (but did not arise out of) the person's relevant service. That creates a temporal and causal limitation on the use of the "inability to obtain appropriate clinical management" factor (s 9(4), s 10(2)).

• Duty to consult other Statements where applicable: Section 11 requires that where a factor in s 9 refers to an injury or disease covered by another Statement of Principles, the factors of that other Statement apply in accordance with their terms. Decision‑makers must therefore apply cross‑referenced Statements as in force from time to time (s 11).

Rights and procedural implications for claimants:

• Entitlement pathway: The Statement is designed to be used in the reasonable‑hypothesis test required by the VEA and MRCA claim provisions referenced in s 5. If a claimant meets a factor in s 9 and the factor is related to relevant service (s 10), a reasonable hypothesis is raised that may permit further entitlements processing under the applicable statute. The Statement operationalises the medical side of that test.

• Right to marshal evidence on exposure and latency: Claimants have the practical right (and burden) to provide evidence showing timing of first inhalation, duration, cumulative hours where required, and contemporaneous circumstances of exposure (s 9).

• Right to rely on cross‑Statements: Where an exposure factor invokes another Statement of Principles, claimants can rely on the factors contained in that other Statement, as they stand at the relevant time (s 11).

The instrument does not itself provide an appeals or review route, nor does it specify who decides entitlement; those procedural rights and duties remain governed by the VEA and MRCA provisions to which this Statement is linked (s 5). The Repatriation Medical Authority is the body that made the instrument under s 196B(2) of the VEA (s 3), and the Statement represents the Authority’s medical‑scientific position to be applied by administering agencies and decision‑makers in the statutory claims process.

The Statement itself contains no penal provisions, sanctions, or enforcement mechanisms. It is a medical‑scientific instrument made under subsection 196B(2) of the VEA (s 3) that prescribes criteria for raising a reasonable hypothesis in claims to which section 120A of the VEA or section 338 of the MRCA applies (s 5). Enforcement of the Statement’s operation is administrative and procedural: the instrument is used by claims decision‑makers as the medical basis for determining whether the reasonable‑hypothesis threshold is met for pleural plaque or death from pleural plaque.

Key enforcement and compliance observations grounded in the instrument:

• Administrative application: The Statement will be applied by the agencies and decision‑makers who process claims under the VEA and MRCA. The instrument does not itself state which decision‑maker implements it; that role is set by the statutes referenced in s 5. The Statement provides the criteria that must be tested, but it does not prescribe sanctions for non‑compliance or prescribe an enforcement regime within the text of the instrument.

• Evidentiary role: The Statement operates as an evidentiary standard. It identifies factors that must exist before a reasonable hypothesis can be said to be raised (s 9). Therefore, enforcement in practice will take the form of administrative acceptance or rejection of claims based on whether the claimant can meet those evidentiary factors and whether the factor can be related to relevant service (s 10).

• Cross‑Statement interaction: Section 11 provides that where a factor in this Statement refers to an injury or disease covered by another Statement, the factors in that other Statement apply. This creates an administrative obligation on decision‑makers to apply the relevant Statement in force from time to time when assessing claims involving overlapping exposures (s 11).

• No criminal or civil penalties: The instrument does not create offences, fines or civil remedies. It does not change criminal law or private tort law. Its effect is confined to the medical criteria used in the statutory claims process under VEA and MRCA.

• Repeal and commencement: The instrument repeals the prior Statement No. 45 of 2014 (s 4) and commenced on a stated date (s 2), which affects which Statement is administratively applicable to claims lodged from or after the commencement date. Administrative practice will therefore enforce the new Statement from its commencement date.

In short, enforcement of the Statement is administrative through claims processing; the Statement imposes evidentiary criteria to be applied by decision‑makers rather than penalties or direct sanctions within its text.

The instrument is made under subsection 196B(2) of the VEA (s 3) and expressly applies to claims to which section 120A of the VEA or section 338 of the MRCA applies (s 5). Therefore, the Statement interacts with the VEA and MRCA claim frameworks by providing the Repatriation Medical Authority’s medical‑scientific criteria for raising a reasonable hypothesis in pleural plaque cases. The Statement does not amend the substantive entitlements or procedures contained in the VEA or MRCA; rather it operates as the medical evidence base those statutes require be considered when assessing causation in claims covered by the cited provisions (s 5, s 8).

Specific interactions and cross‑references within the instrument:

• Made under s 196B(2) VEA: Section 3 records the statutory power under which the Authority made the Statement. That statutory mechanism is the instrument's legal hook; the Statement is intended to be used within the VEA statutory scheme.

• Application to VEA and MRCA claim provisions: Section 5 ties the Statement to claims under s 120A of the VEA and s 338 of the MRCA. The Statement therefore supplements the evidentiary and causation tests embedded in those statutes by supplying the medically informed factors that raise a reasonable hypothesis.

• Cross‑Statements: Section 11 requires decision‑makers to apply factors in another Statement of Principles where a factor in this Statement refers to an injury or disease already covered by that other Statement. This creates a networked relationship among Statements made under s 196B(2) of the VEA; the operative factors from related Statements apply "as in force from time to time" (s 11). Practically, this means the instrument does not operate in isolation where overlap exists.

• Definitions and statutory terms: The Schedule defines MRCA and VEA and lists the categories comprising "relevant service" (Schedule 1). Decision‑makers must therefore interpret the Statement in light of those statutory definitions. For example, "relevant service" brings in a defined set of service types under both the VEA and MRCA (Schedule 1), and the Statement requires that any factor relied upon be related to that defined relevant service (s 10(1)).

• No express interaction with non‑VA/MRCA statutes: The Statement contains no explicit references to other Federal, state or territory statutes outside the VEA and MRCA context. It does not purport to alter private law causation or workplace compensation regimes, and it contains no provision asserting primacy over other laws. Its scope is the VEA/MRCA claim environment as set out in s 5.

Because it cross‑references other Statements and operates as the Repatriation Medical Authority's medical guidance for the reasonable‑hypothesis test, the Statement is a technical instrument that decision‑makers must read alongside the relevant statutory provisions of the VEA and MRCA and any other Statements that cover overlapping diseases or exposures.

The instrument contains a limited amendment history within its own text. It expressly repeals the earlier Statement of Principles concerning pleural plaque No. 45 of 2014 (Federal Register of Legislation No. F2014L00474) made under subsection 196B(2) of the VEA (s 4). The instrument itself is dated 21 October 2022 and commences on 21 November 2022 (s 1 heading, s 2; the front matter records the date of the Authority's determination). No other amendments, transitional arrangements or savings provisions are contained within the text of the instrument.

From the instrument itself the amendment timeline is thus:

• Statement No. 45 of 2014 existed and was in force until it was repealed by this instrument (s 4). The instrument does not provide the content of the repeal beyond that express repeal; it does not set transitional arrangements for claims lodged before commencement.

• This instrument was determined on 21 October 2022 and commenced on 21 November 2022 (s 2 and the front matter). The instrument thereby establishes its own commencement date.

• The instrument contains no further amendments, nor does it record prior amendments to earlier Statements beyond the single repeal.

Users should therefore treat this instrument as the operative Statement on pleural plaque for the relevant claim provisions from its commencement date forward, and be aware that the prior Statement No. 45 of 2014 has been removed from the statutory instrument record by this repeal (s 4).

Note that section 11 contemplates that other Statements of Principles may be "in force from time to time" and that those Statements' factors apply where cross‑referenced. That language implicitly recognises that Statements are subject to change, but the instrument itself contains no schedule of future amendments or a mechanism for amendment other than the statutory process under which the Authority makes Statements (s 3).

The instrument contains no internal record of litigation. It does not name any cases or judicial determinations. The instrument is a determinative administrative instrument made by the Repatriation Medical Authority under subsection 196B(2) of the VEA (s 3) and is silent on any litigation that might have arisen in relation to this Statement or its predecessor. The instrument therefore provides no litigation history, judicial interpretations, or reported disputes within its text.

Practitioners should note that the Statement is an administrative medical determinative instrument; its legal effect in contested cases will be as part of the evidentiary and causation framework applied under the VEA and MRCA. The instrument itself, however, does not supply any record of judicial review, appeal, or precedent. Any litigation impact, challenge to the Authority's conclusions, or judicial interpretation would need to be sought from external case law or records not contained in the instrument.

Because section 11 requires cross‑application of other Statements when a factor refers to an injury or disease covered elsewhere, factual or legal disputes might in practice implicate multiple Statements. Those disputes and any resulting litigation would, however, be external to the instrument's text and are not documented within it.

The Statement contains several precise technical points and limitations that can be decisive in claims assessment; these are areas where practitioners commonly encounter interpretive and evidentiary difficulty. The following are source‑grounded "watchouts" derived from the text.

1. Latency and timing conditions are strict and differently framed across factors:

   • For asbestos fibres (s 9(1)(b)) and refractory ceramic fibres (s 9(2)(b)), the first inhalation must have commenced at least five years before the clinical onset of pleural plaque. For erionite fibres (s 9(3)), the first inhalation must have occurred at least ten years before clinical onset, and exposures must have been "on more days than not for at least 5 years" before clinical onset. Practitioners must identify the date of "first inhalation" and the date of "clinical onset" to test compliance. The instrument does not define "clinical onset" within its Schedule, so evidence and interpretation of the clinical onset date will be contested at the evidentiary stage (the term appears throughout s 9 but is not defined in Schedule 1).

2. Different exposure quantification standards apply between fibre types:

   • Refractory ceramic fibres require a cumulative minimum of 2,000 hours in an enclosed space during manufacture or processing (s 9(2)(a)). Asbestos exposure is described functionally , inhalation "at the time material containing asbestos was being applied, removed, cut, drilled, dislodged or disturbed" , rather than by cumulative time (s 9(1)(a)). Erionite requires a qualitative frequency threshold ("on more days than not for at least 5 years") rather than a stated cumulative hours metric (s 9(3)).

3. The asbestos disturbance wording creates a causal link to specific activities:

   • The asbestos factor requires inhalation "at the time material containing asbestos was being applied, removed, cut, drilled, dislodged or disturbed" (s 9(1)(a)). Practitioners must show that inhalation occurred contemporaneously with those enumerated activities, not merely that asbestos was present in the environment at some time.

4. Exposure in enclosed spaces receives special treatment:

   • Refractory ceramic fibres must have been inhaled "in an enclosed space" during manufacture/processing (s 9(2)). The asbestos note also highlights enclosed spaces: "Disturbance of debris or dust contaminated with asbestos fibres already present in an enclosed space may result in exposure to respirable asbestos fibres." The enclosed‑space qualifier will therefore be a contested factual matter in many cases.

5. The "inability to obtain appropriate clinical management" factor is narrowly limited:

   • Subsection 9(4) is available only in tightly defined circumstances by s 10(2): it applies to material contribution to, or aggravation of, pleural plaque where the plaintiff's pleural plaque was suffered or contracted before or during (but did not arise out of) the person's relevant service. This creates a specific temporal and causal limitation that restricts the factor’s usefulness to certain service timing scenarios (s 9(4), s 10(2)).

6. Relationship to relevant service is mandatory:

   • Section 10(1) requires that any factor in s 9 be "related to the relevant service rendered by the person." The Schedule defines relevant service categories narrowly (Schedule 1). A factor that occurred outside relevant service cannot by itself raise a reasonable hypothesis without that connection being established.

7. Pleural plaque is defined as fibre‑related:

   • The operative definition requires that pleural plaque be "related to the inhalation of mineral fibres" (s 7(2)). Where a claimant alleges pleural plaque from non‑fibre causes, the Statement’s definition would not support a reasonable hypothesis under this instrument.

8. Some key terms are not defined in the instrument:

   • The Schedule defines erionite, refractory ceramic fibres, terminal event and relevant service, but the instrument does not define "clinical onset", "respirable asbestos fibres", "respirable refractory ceramic fibres", or "appropriate clinical management". The absence of definitions for those terms means litigable questions about their interpretation may arise in claims assessments.

9. Cross‑Statement complexity:

   • Where a factor refers to an injury or disease covered by another Statement, section 11 requires that the other Statement’s factors apply as in force from time to time. Claims involving overlapping exposures may thus require consideration of more than one Statement, each with its own thresholds and terminology (s 11).

10. Repeal of prior Statement:

• The earlier Statement No. 45 of 2014 is repealed (s 4). Practitioners must ensure which Statement applied at the time of the claim or clinical onset, particularly for claims straddling the commencement date; the instrument itself contains no transitional provisions, so administrators must rely on the governing statutes or administrative practice outside this text to determine transitional application.

These "gotchas" reflect tightly expressed technical limits in the instrument. For decision‑makers and claimants, the interpretive questions will often focus on the precise dating (first inhalation, clinical onset), the factual circumstances (enclosed space, manufacture/processing, disturbance of asbestos), the appropriate metric for exposure (cumulative hours v qualitative frequency), and whether the exposure can be linked to the defined categories of relevant service.

Compliance for claimants, medical advisers and decision‑makers turns on meeting the instrument’s factual and temporal thresholds and establishing the connection between an identified factor and the person's relevant service (ss 9-10). The instrument sets minimum evidentiary gates; practical compliance means assembling documentation and medical evidence that map onto each element.

Practical steps for claimants and their advisers:

1. Establish diagnosable pleural plaque under the instrument’s definition:

   • Obtain clinical and radiological/histological evidence diagnosing pleural plaque as a circumscribed thickening of the pleura related to inhalation of mineral fibres (s 7(2); notes under s 7 describe typical features such as dense hyalinised collagen and possible calcification). If the claim is for death from pleural plaque, obtain medical records showing that the terminal event was contributed to by pleural plaque (s 7(3); Schedule 1 defines terminal events).

2. Document exposure dates and nature of exposure:

   • For asbestos (s 9(1)): show that respirable asbestos fibres were inhaled "at the time material containing asbestos was being applied, removed, cut, drilled, dislodged or disturbed." Contemporaneous service records, duty statements, witness statements and workplace logs that tie inhalation to those activities are central. Note the latency requirement: first inhalation must have commenced at least five years before clinical onset (s 9(1)(b)).

   • For refractory ceramic fibres (s 9(2)): document that exposure occurred "in an enclosed space" while refractory ceramic fibres were being manufactured or processed, and establish a cumulative exposure of at least 2,000 hours prior to clinical onset, with first inhalation at least five years before clinical onset (s 9(2)(a)-(b)). Time records, rosters, task sheets, or workplace exposure records will be necessary to meet the 2,000‑hour threshold and to show enclosed space settings.

   • For erionite (s 9(3)): evidence must show inhalation on "more days than not for at least 5 years" with the first inhalation at least ten years before clinical onset. Detailed service location histories and environmental exposure records that establish recurrent exposure over the timeframe will be required.

   • For inability to obtain appropriate clinical management (s 9(4), s 10(2)): collect contemporaneous medical records, correspondence, referrals and evidence of health system availability demonstrating that appropriate clinical management was unavailable, and ensure the timing matches the limitation in s 10(2) (ie, the pleural plaque was suffered or contracted before or during, but did not arise out of, the relevant service).

3. Link exposure to relevant service:

   • Demonstrate that the exposure occurred during a period and in circumstances that constitute relevant service as defined in Schedule 1 (operational, peacekeeping, hazardous, British nuclear test defence service under VEA; warlike or non‑warlike service under MRCA). Service records, postings, deployment orders and unit histories will be required to show that the exposure is related to relevant service (s 10(1), Schedule 1).

4. Consider cross‑referenced Statements:

   • If the exposure factor or an injury involved is the subject of another Statement of Principles, assemble evidence to satisfy the factors contained in that Statement, as s 11 requires application of that Statement’s factors "as in force from time to time." Identify overlapping Statements early and cross‑check their thresholds.

5. Address lacunae in defined terms:

   • Because the instrument does not define "clinical onset," "respirable asbestos fibres" or "appropriate clinical management," provide expert medical evidence that explains clinical onset dates and the clinical standards applied. For respirable fibre types, expert testimony on particle size and typical exposure scenarios will be useful where the record is not explicit.

6. Use the instrument’s notes:

   • The instrument expressly notes that disturbance of debris or dust contaminated with asbestos fibres already present in an enclosed space may result in exposure (s 9(1) note). Where exposure is inferred from disturbance rather than direct handling of asbestos‑containing material, document the circumstances and contemporaneous evidence of disturbance.

Practical steps for decision‑makers and administrators:

1. Apply the instrument as the medical basis for the reasonable‑hypothesis test:

   • Test each claim against the enumerated factors in s 9 and against the relationship requirement in s 10(1). Treat any single qualifying factor, properly related to relevant service, as sufficient to raise a reasonable hypothesis (s 9).

2. Require documentation that maps to each element:

   • For cumulative hours (refractory ceramic fibres) or frequency thresholds (erionite), require sufficiently detailed employment/service records to substantiate the numerical thresholds. For asbestos disturbance scenarios, request specific incident reports or contemporaneous evidence showing the listed activities occurred.

3. Manage cross‑Statements:

   • Where a factor refers to conditions covered by another Statement, apply that Statement's factors as in force and coordinate evidence requirements across Statements (s 11).

4. Address definitional gaps by soliciting expert evidence:

   • Where terms like "clinical onset" or "appropriate clinical management" are ambiguous in the record, procure medical expert opinions that explain how those terms should be dated and assessed in the medical context of pleural plaque.

5. Timeframe issues and transitional claims:

   • Be alert to the repeal of the prior 2014 Statement (s 4) and determine, as a matter of administrative practice and relevant statute, which Statement is to be applied to claims where events or onset span the repeal/commencement dates.

Evidence and proof standards:

• The instrument sets minimum factual criteria but does not specify evidentiary standards such as balance of probabilities; those procedural standards reside in the governing statutes referenced in s 5. Practitioners should therefore prepare evidence sufficient for the standard applicable under the VEA or MRCA procedural framework.

In summary, compliance requires mapping medical diagnosis, exposure history and temporal evidence to the discrete, enumerated factors in s 9 and demonstrating that the chosen factor is related to the person’s relevant service as defined in the Schedule (ss 9-10). Where the factor invokes another Statement, apply that Statement’s factors as required by s 11.
