Statement of Principles concerning pleural plaque (Balance of Probabilities) (No. 106 of 2022)

The instrument operates as a medical‑legal checklist translating epidemiological and clinical evidence into discrete factors that must be satisfied for causal connection on the balance of probabilities. The principal concepts are:

• Pleural plaque defined as pleural thickening related to inhalation of mineral fibres (s7(2)). The Notes to s7(2) specify that pleural plaque contains dense hyalinised collagen fibres and may be elevated, flat or nodular and may contain calcification; it is often bilateral and typically affects the parietal pleura (Notes to s7(2)). These descriptive elements set the clinical entity the RMA addresses.

• Death from pleural plaque defined to include death from a terminal event or condition that was contributed to by the pleural plaque (s7(3)). The Schedule defines "terminal event" to include pneumonia, respiratory failure, cardiac arrest, circulatory failure and cessation of brain function (Schedule 1).

• The evidentiary standard is the balance of probabilities. The RMA records that, on the sound medical‑scientific evidence available, it is of the view that it is more probable than not that pleural plaque and death from pleural plaque can be related to relevant service (s8). The title similarly states "(Balance of Probabilities)."

• Causal factors required. Section 9 lists the specific exposure or management factors which, if they exist and are related to relevant service, are sufficient for connection on the balance of probabilities. Those factors are:

  • Inhalation of respirable asbestos fibres during activities that disturb material containing asbestos, with the first inhalation commencing at least 10 years before clinical onset (s9(1)(a)-(b)). The accompanying Note explains that disturbance of debris or dust contaminated with asbestos in an enclosed space may produce respirable fibres.
  • Inhalation of respirable refractory ceramic fibres in an enclosed space during manufacture/processing, with a cumulative exposure of at least 2,000 hours and first inhalation at least 10 years before clinical onset (s9(2)(a)-(b)). The Schedule defines refractory ceramic fibres (Schedule 1).
  • Inhalation of erionite fibres on more days than not for at least 10 years before clinical onset, and where first inhalation occurred at least 15 years before clinical onset (s9(3)). The Schedule defines erionite (Schedule 1).
  • Inability to obtain appropriate clinical management for pleural plaque (s9(4)).

• Relationship to relevant service. Section 10 requires that any factor in s9 must be related to the person's relevant service (s10(1)). The Schedule defines "relevant service" as eligible war service (other than operational service) under the VEA, defence service (other than hazardous service and British nuclear test defence service) under the VEA, or peacetime service under the MRCA (Schedule 1). Section 10(2) further restricts the operation of s9(4): inability to obtain appropriate clinical management applies only to material contribution or aggravation of pleural plaque where the plaque was suffered or contracted before or during (but did not arise out of) the person's relevant service.

• Interaction with other Statements. Section 11 makes clear that where a factor in s9 refers to an injury or disease already covered by another Statement of Principles, the factors in that other Statement apply according to its operative terms as in force (s11).

Important drafting and definitional observations drawn from the instrument itself include the following: the instrument repeatedly uses timing phrases such as "clinical onset" (appearing in s9) but does not define that phrase in the Schedule; the term "respirable" is used but not defined; "in an enclosed space" appears as a situational qualifier in s9(2) and the Note to s9(1) but is not defined. The Schedule provides specific definitions for erionite and refractory ceramic fibres and delimits relevant service categories and terminal events (Schedule 1). These definitional gaps and precise timing and cumulative thresholds are central to how the instrument will be applied.

The instrument reaches three principal groups through its mechanics: claimants (persons asserting a claim under the VEA or MRCA for pleural plaque or death from pleural plaque), decision‑makers who determine entitlement under the specified statutory provisions, and the RMA as the issuing authority.

• Claimants. The instrument expressly applies to "a claim to which section 120B of the VEA or section 339 of the MRCA applies" (s5). That means persons seeking connection between pleural plaque (or death from pleural plaque) and their relevant service , that is, veterans or members who rendered the types of service defined in Schedule 1 as "relevant service" (eligible war service other than operational service; defence service other than hazardous service and British nuclear test defence service; or peacetime service under the MRCA) , are the primary affected group (s5; Schedule 1 definition of relevant service).

• Decision‑makers. Although the instrument does not itself decide claims, it is determinative of the RMA's view of the medical factors that "must exist" for a finding that pleural plaque is connected to service (s9). Those factors will be applied by the statutory decision‑makers responsible for claims under s120B VEA or s339 MRCA. The instrument’s purpose is to guide or constrain those decision‑makers when assessing causation on the balance of probabilities (s8; s9; s11).

• Medical and medico‑legal experts. The instrument requires, implicitly, medical assessment of pleural plaque and timing of clinical onset, and factual assessment of exposure histories. The clinical description of pleural plaque in s7(2) and the requirements in s9 impose specific evidentiary tasks for expert practitioners preparing medico‑legal opinions , for example, linking histological or radiological findings to the inhalation of specified mineral fibres and opining on timing relative to the stated thresholds.

• Administrative actors and records holders. Because the factors include temporal and quantitative thresholds (for example, at least 10 years between first inhalation and clinical onset, cumulative 2,000 hours for refractory ceramic fibres), employers, defence records, occupational health records, and other organisations that hold exposure, trade or service records will be consequential sources of evidence for claimants and decision‑makers (s9(1)-(3); s10(1); Schedule 1).

• Parties with pre‑existing allocation of liability or coverage under other Statements. Section 11 makes the instrument interact with other RMA Statements of Principles where a factor refers to an injury or disease already covered by another Statement. Therefore, individuals whose exposure profile overlaps with other recognised diseases may be affected by the operative terms of those other Statements as well as this one (s11).

Who does not fall within the instrument is also signalled by the Schedule: the definition of relevant service excludes operational service and certain categories of hazardous service under the VEA, and excludes British nuclear test defence service (Schedule 1). The instrument therefore does not apply to claims that are outside the statutory scope identified in s5 and Schedule 1.

This instrument does not create new statutory duties in the sense of legislative offences or compliance obligations; rather, it establishes the medical factors that must be present and related to relevant service before a causal connection can be found on the balance of probabilities. The key operative legal effects, drawn from the instrument itself, are:

• Duty of proof under balance of probabilities: The RMA frames the causation question on the "balance of probabilities" standard (title; s8). Practically, claimants bear the task of establishing that one or more of the factors in s9 exists and that the factor(s) is/are related to the person's relevant service (s9; s10(1)).

• Requirement to demonstrate specified exposures and temporal thresholds: Section 9 sets out what must exist. For asbestos, the claimant must show inhalation of respirable asbestos fibres at the time asbestos-containing material was being worked on, with first inhalation commencing at least 10 years before clinical onset (s9(1)(a)-(b)). For refractory ceramic fibres, the claimant must show inhalation in an enclosed space during manufacture/processing, for a cumulative period of at least 2,000 hours, and first inhalation at least 10 years before clinical onset (s9(2)(a)-(b)). For erionite, inhalation on more days than not for at least 10 years before clinical onset, with first inhalation at least 15 years before clinical onset (s9(3)). Alternatively, inability to obtain appropriate clinical management is a separate factor (s9(4)), but its application is constrained by s10(2).

• Relationship to relevant service is a necessary condition: Section 10(1) requires that any factor in s9 must be related to the person's relevant service. That places a legal nexus requirement between the factual exposure and the statutory category of service identified in Schedule 1.

• Conditional operation of the clinical management factor: Section 10(2) restricts the use of s9(4) (inability to obtain appropriate clinical management) to cases where the person's pleural plaque was suffered or contracted before or during (but did not arise out of) relevant service. In those circumstances s9(4) can apply only to material contribution to, or aggravation of, pleural plaque. The drafting therefore distinguishes between primary causation arising out of service and aggravation or material contribution where the condition predates or coincides with service (s10(2)).

• Interaction with other Statements: If a factor in s9 refers to an injury or disease covered by a different RMA Statement of Principles, the other Statement's factors apply in accordance with its terms (s11). That shapes rights and duties where exposures or diseases overlap across multiple Statements.

• Definitions constraining scope: The Schedule’s definitions limit the instrument’s scope by defining key terms (erionite; refractory ceramic fibres; relevant service; terminal event) and by cross‑referencing the governing Acts (MRCA and VEA) (Schedule 1). These definitions are operative in assessing whether a claimant’s exposure fits within the instrument’s factors.

The instrument does not itself provide procedural rights such as appeal mechanisms, nor does it specify the entitlement outcome if a factor is established. Those procedural and entitlement consequences fall to the underlying statutes referenced in s5 (s120B VEA and s339 MRCA) and to the decision processes those Acts and relevant administrative law provisions provide. The RMA’s determinations operate as medical‑scientific guidance that decision‑makers under those Acts will use in applying the statutory tests for service connection.

The Statement of Principles instrument contains no criminal penalties, administrative fines, or direct enforcement mechanisms. Its legal effect is evidentiary and normative: it expresses the RMA’s view of the medical‑scientific factors that, if present and related to relevant service, allow a causal connection to be established on the balance of probabilities (s3; s8; s9). There are therefore no penalty provisions within the instrument itself to enforce compliance, nor does the instrument create offences.

Enforcement in practical terms occurs through administrative decision‑making under the VEA and MRCA. The instrument applies to claims under s120B of the VEA and s339 of the MRCA (s5). Those statutory provisions and the administrative processes they invoke will determine entitlements, remedies, benefits, or compensation, and any penalties, offsets or conditions flow from those underlying Acts and associated regulations rather than from this instrument. The Statement will inform, and in many cases constrain, the factual and medical findings made by decision‑makers when they decide whether a service connection exists, but it does not itself impose sanctioning powers.

Remedial or review pathways available to persons dissatisfied with administrative decisions that rely on this Statement will be those available under the VEA, MRCA and administrative law generally; the instrument is silent about appeals, review rights or procedural steps. The instrument likewise does not set compliance monitoring regimes or obligations for employers, defence organisations, or medical practitioners; it functions as a criteria statement to be applied by decision‑makers and expert witnesses.

Because the instrument operates by prescribing the factors that "must exist" for a causal connection, its practical enforcement effect is that claimants who cannot establish the required factor(s) related to relevant service are unlikely to have a finding of service connection under the referenced statutory claims provisions. That consequence is an administrative effect rather than a penal sanction created by the Statement itself.

The Statement interacts with the VEA and the MRCA through direct reference and by acting as a medical‑scientific input to claims processes under those statutes. The interaction pathways in the text are explicit:

• Statutory authority and application. The instrument is made under s196B(3) of the VEA (s3). It applies to claims to which section 120B of the VEA or section 339 of the MRCA applies (s5). Therefore the Statement is an instrument that feeds into the statutory causation tests and claims procedures established by those Acts. The scope of "relevant service" used in the Statement is defined by reference to categories specified under the VEA and MRCA (Schedule 1).

• Repeal of prior RMA Statement. The instrument expressly repeals the earlier Statement of Principles concerning pleural plaque No. 46 of 2014 (s4). Decision‑makers and claimants must therefore apply this 2022 Statement rather than the 2014 Statement for relevant claims after its commencement (s2; s4). Where the earlier Statement contained different factors or thresholds, those have been superseded by this instrument as it now stands.

• Cross‑application with other RMA Statements. Section 11 provides a mechanism for cross‑reference: where a factor in this Statement refers to an injury or disease covered by another RMA Statement determined under s196B(3) of the VEA, the factors in that other Statement apply in accordance with its own terms as in force. This means overlapping exposure profiles or proximate conditions may require claimants and decision‑makers to consult multiple Statements to determine causation (s11).

• Definitions and statutory exclusions. The Schedule defines "relevant service" in a manner that excludes certain forms of service (for example, operational service is not included under the VEA categories listed; hazardous service and British nuclear test defence service are excluded from defence service) (Schedule 1). The instrument therefore interacts with the statutory definitions and exclusions in the VEA and MRCA; a claim that falls outside the "relevant service" categories in the Schedule will not be within the instrument’s application as stated in s5 and Schedule 1.

• Medical concept versus legal causation. The instrument furnishes medical‑scientific factors and timing thresholds that are to be used for legal causation assessment under the underlying Acts. The RMA’s statement that, on the sound medical‑scientific evidence available, it is of the view that pleural plaque can be related to relevant service (s8) is evidence‑oriented; the legal determination of entitlement under the VEA or MRCA remains the responsibility of decision‑makers applying the respective statutory tests. The instrument does not displace the statutory causation test but defines the medical criteria relevant to that test.

• Interaction with external occupational or health statutes. The instrument does not refer to, or modify, other Commonwealth, state or territory occupational health and safety laws, workers’ compensation schemes, or industrial instruments. Its operation is confined to the evidence required to establish service connection within the veterans’ entitlements and defence compensation frameworks (s5).

• Timing and retrospective effect. The instrument’s commencement date is specified (s2), and it repeals an earlier Statement (s4). It does not specify transitional or saving provisions concerning claims made prior to its commencement. Practitioners will therefore need to consider the commencement and repeal provisions in relation to the timing of claims and which Statement applies, acknowledging that the instrument itself contains no explicit transitional provisions.

In sum, the Statement’s legal effect is as an RMA determination that supplies medical‑scientific factors for use under particular statutory claims provisions; the substantive entitlements and procedural mechanisms remain those in the VEA and MRCA and any other applicable statutory or administrative law.

The instrument contains its own limited amendment and replacement history within the text:

• Issuance and commencement. The Statement is dated 21 October 2022 and commences on 21 November 2022 (front matter; s2). It is designated as Statement of Principles concerning pleural plaque (Balance of Probabilities) (No. 106 of 2022) (front matter; s1).

• Repeal of prior Statement. Section 4 expressly repeals the Statement of Principles concerning pleural plaque No. 46 of 2014 (Federal Register of Legislation No. F2014L00477), which had been made under subsection 196B(3) of the VEA. This instrument therefore replaces the 2014 Statement upon commencement (s4).

• Authority for change. The instrument is made under subsection 196B(3) of the VEA (s3), which is the statutory basis for the RMA to determine Statements of Principles. The text records the RMA Chairperson and the affixation of the Common Seal as the formal attestation of the instrument (front matter).

• No further amendments recorded. The instrument itself contains no other amendment entries, schedules of amendment, or saving provisions. It does not, within its text, record prior amendments to the 2014 Statement other than its repeal. It also does not record any future amendment mechanism beyond the normal RMA power to determine Statements under s196B(3) of the VEA (s3).

• Definitions and terminological changes. The Schedule sets out definitions that are current in the instrument (Schedule 1). Where a term used in the earlier Statement differed in definition, that change would be reflected by the repeal and replacement mechanism; however, the present instrument does not include a comparison table or notation of textual changes from the 2014 Statement.

Practitioners and decision‑makers should treat this 2022 instrument as the operative Statement of Principles for pleural plaque for claims to which s120B VEA or s339 MRCA apply, effective from its commencement date (s2, s4, s5). Any subsequent amendments would need to be sourced from later RMA determinations or from official amendment records; none are contained within the instrument text provided.

The instrument contains no record of litigation, judicial consideration, or case references. It is an administrative determination by the Repatriation Medical Authority pursuant to subsection 196B(3) of the VEA (s3), and the text does not cite any cases, past tribunal decisions, or court judgments that influenced its terms.

Because the Statement does not itself create a statutory remedy or private right of action, litigation concerning its application would typically arise in the context of judicial review or merits review of administrative decisions under the VEA or MRCA where a decision‑maker relied on this Statement in determining service connection. The instrument does not record any such litigation or judicial findings about its proper interpretation or application.

Practitioners seeking case law on the application of RMA Statements of Principles should note that none is provided in this instrument. Any court or tribunal authority addressing how this particular Statement should be applied, how to interpret terms such as "clinical onset" or "respirable" within the Statement, or whether s9(4) operates in a particular factual setting would need to be located in external case law and tribunals records, which are not contained in the Statement text.

In the absence of litigation referenced in the text, the instrument must be read as the RMA’s contemporaneous medical‑scientific view; how that view will be applied by administrative decision‑makers and how courts will treat it if disputed are matters outside the instrument’s content.

The instrument contains several drafting features and evidentiary thresholds that create specific risks and practical obstacles for claimants, decision‑makers and advisers. These are factual mechanisms arising from the text rather than policy judgments:

• Timing thresholds and latent disease. The factors commonly require a specified minimum interval between the first inhalation and "clinical onset" , typically at least 10 years for asbestos and refractory ceramic fibres (s9(1)(b); s9(2)(b)), and at least 15 years for initial erionite inhalation (s9(3)). The instrument therefore requires retrospective proof of exposure occurring a decade or more before disease onset. This creates an evidentiary dependency on historical records, service records, employment histories, or reliable witness accounts. The Statement does not define "clinical onset" in the Schedule, so medical evidence will be required to place the onset in time, and the absence of a definition introduces scope for disagreement on when clinical onset occurred.

• Undefined technical terms. Key exposure descriptors such as "respirable", "inhaling", and "in an enclosed space" are used but not defined in the Schedule. For instance, s9(1) requires inhaling "respirable asbestos fibres" when asbestos-containing material was being disturbed, and s9(2) requires inhaling "respirable refractory ceramic fibres in an enclosed space" during manufacture or processing. Without definitions in the instrument, parties will need to rely on expert evidence to translate workplace tasks, environment and fibre metrics into the Statement’s language. This can create disagreement on whether a particular exposure met the instrument’s terms.

• Cumulative exposure numerical threshold. Refractory ceramic fibres require a cumulative exposure of at least 2,000 hours before clinical onset (s9(2)(a)). That numerical threshold transforms exposure assessment into a quantification exercise. Records that routinely quantify hours of exposure are uncommon, especially for historical defence or civilian contexts, which may complicate proof and incentivise detailed evidentiary collection.

• Different thresholds for different fibres. The instrument treats asbestos, refractory ceramic fibres and erionite as distinct causal agents with differing exposure rules (s9(1)-(3)). A claimant with mixed or uncertain exposures may need to satisfy at least one set of conditions. Overlap with other disease Statements is possible and is expressly dealt with at s11, which requires recourse to other Statements where referenced.

• Scope of "pleural plaque". The instrument defines pleural plaque as pleural thickening related to inhalation of mineral fibres (s7(2)). That definition ties the clinical entity to inhalational mineral fibre exposure; pleural plaque from other causes or non‑inhalational mechanisms is excluded by the definition itself. The Notes to s7(2) describe typical features (hyalinised collagen fibres, bilateral, parietal pleura predominance), but the instrument does not attempt to delineate differential diagnosis issues that can arise clinically.

• Death from pleural plaque and terminal events. The instrument treats death from pleural plaque as including deaths from terminal events or conditions that were contributed to by the plaque (s7(3)). The Schedule lists specific terminal events (for example, pneumonia, respiratory failure, cardiac arrest) (Schedule 1). A practical difficulty arises in causation assessment where a claimant dies of a terminal event but pleural plaque’s contribution to that terminal event is contested; medical opinions about contribution will be required.

• Conditional operation of the clinical management factor. The fourth factor (inability to obtain appropriate clinical management) is broader in modality but narrower in application: s10(2) limits its operation to material contribution to, or aggravation of, pleural plaque where the plaque was suffered or contracted before or during (but did not arise out of) the person’s relevant service. That drafting nuance means s9(4) cannot be used to establish primary causation arising out of relevant service, only contribution or aggravation in a defined temporal relationship.

• Relationship to "relevant service" categories. The Schedule defines "relevant service" with exclusions: eligible war service other than operational service; defence service other than hazardous service and British nuclear test defence service; peacetime service under the MRCA (Schedule 1). These exclusions mean that some categories of service that often attract different benefit frameworks are not within the Statement’s scope as "relevant service". Practitioners must map exposures and service records carefully to the Schedule definitions before relying on the Statement.

• Repeal and commencement interplay. The instrument repeals the 2014 Statement (s4) and commences on a specified date (s2). Claims straddling the repeal/commencement date may raise questions about which Statement applies; the present instrument contains no transitional rules, so the timing of when a claim is considered and the date of clinical onset and exposures will be practically relevant.

• Interaction with other RMA Statements. Section 11 requires application of other Statements where cross‑referenced; that can complicate causation analysis where multiple pathologies or exposures are in issue. The instrument does not itself resolve overlaps or priority between Statements beyond requiring that the other Statements’ terms apply.

These drafting features create practical evidentiary and interpretative tasks. The instrument sets clear empirical thresholds in some respects but leaves other technical terms and the task of relating exposure evidence to "relevant service" to expert evidence and administrative application.

For practitioners advising claimants, and for decision‑makers applying this Statement in the VEA or MRCA claims context, compliance is a matter of assembling and presenting the specific types of evidence the instrument requires and ensuring factual links to "relevant service" as defined in the Schedule. The instrument furnishes the checklist; the implementation steps are derived from the instrument’s terms:

1. Identify the claim and statutory pathway. Confirm that the claim is one to which s120B of the VEA or s339 of the MRCA applies (s5). Establish whether the claimant’s service falls within the Schedule’s definition of "relevant service" (Schedule 1) , that identification is a threshold question because s10(1) requires the factors to be related to relevant service.

2. Establish the clinical diagnosis and "clinical onset". Obtain contemporaneous clinical records, radiology, histology and expert medical reports that identify pleural plaque consistent with the definition in s7(2). Because "clinical onset" is used repeatedly in s9 but is not defined in the Schedule, a medico‑legal opinion should address and date clinical onset for the purposes of applying the timing thresholds in s9. Medical reports should also address whether pleural plaque could have contributed to death where death is the subject of the claim (s7(3); Schedule 1 definition of terminal event).

3. Map exposures to the exact factors in s9. For each potential causal route, collect evidence that matches the exact factor language:

   • For asbestos (s9(1)): evidence that the claimant inhaled respirable asbestos fibres while material containing asbestos was being applied, removed, cut, drilled, dislodged or disturbed; and evidence that first inhalation commenced at least 10 years before clinical onset. Service records, trade records, maintenance logs, witness statements from colleagues, and workplace safety records can assist in establishing these factual elements.
   • For refractory ceramic fibres (s9(2)): evidence that inhalation occurred in an enclosed space at the time such fibres were being manufactured or processed; quantified evidence to support a cumulative exposure of at least 2,000 hours and evidence that first inhalation commenced at least 10 years before clinical onset. This typically requires specific work history documentation and expert interpretation of what constitutes an enclosed space and whether activities constituted manufacture or processing.
   • For erionite (s9(3)): evidence of inhalation on more days than not for at least 10 years prior to clinical onset and that first inhalation occurred at least 15 years before clinical onset. This will require proof of repeated, sustained exposures over a long period.
   • For inability to obtain appropriate clinical management (s9(4)): evidence that appropriate clinical management was unavailable and, per s10(2), that the pleural plaque was suffered or contracted before or during (but did not arise out of) relevant service, and that the lack of management materially contributed to or aggravated the condition.

4. Demonstrate relation to relevant service. Section 10(1) requires that any satisfied factor must be related to the person’s relevant service. Evidence should therefore show that the exposures occurred in the course of the service identified in the Schedule (service records, assignments, unit histories, and contemporaneous logs). Where exposures occurred outside service, consider whether other Statements or legal paths are relevant.

5. Address overlaps with other Statements. If a factor in s9 refers to injuries or diseases covered by another Statement of Principles, consult and apply the other Statement as required by s11. Where multiple Statements apply, align documentary and medical evidence to the operative terms of each, and note that the RMA requires application of the other Statement’s terms as they stand.

6. Use expert evidence to translate undefined terms. Because the instrument uses terms that are not defined (for example, "respirable", "enclosed space", "clinical onset"), expert occupational hygienists and medical specialists should be engaged to interpret workplace descriptions against the Statement’s requirements and to opine on timing and dose/duration where numerical thresholds are specified (for example, the 2,000 hours cumulative exposure requirement in s9(2)).

7. Prepare for record limitations. The timing thresholds (10, 15 years) and cumulative exposure requirement mean that many claims will depend on historical records or witness evidence. Where documentation is sparse, counsel and medical experts should construct coherent narratives that map available evidence to the Statement’s factors and identify reasonable inferences based on the medical‑scientific evidence the RMA used to formulate the Statement (s8).

8. Consider the scope of the "clinical management" factor cautiously. Because s9(4) is confined by s10(2), ensure that any reliance on inability to obtain appropriate clinical management is correctly framed as material contribution or aggravation where the plaque was suffered or contracted before or during relevant service but did not arise out of it.

9. Note the instrument’s commencement and repeal. For claims near the 21 November 2022 commencement date, confirm which Statement applies in the relevant factual timeframe (s2; s4). The 2014 Statement was repealed and must no longer be relied upon for claims to which this instrument applies post‑commencement (s4).

10. Document pleadings and submissions to the statutory decision maker. When presenting a claim under s120B VEA or s339 MRCA, tie factual proof explicitly to the numbered paragraphs of s9 and demonstrate the connection to relevant service per s10. Where another RMA Statement is invoked under s11, identify where and how its factors overlap or supplement the present Statement.

Advisers should be precise in matching evidence to the Statement’s language. Because many operative terms are technical or undefined, medical and occupational hygiene expertise should be front‑loaded into claim preparation. The instrument’s requirements create clear evidentiary categories; success in claims will turn on the ability to fit documentary and expert proof into those categories and to establish the nexus to the Schedule’s defined relevant service.
