Statement of Principles concerning pinguecula (Reasonable Hypothesis) (No. 60 of 2024)

The instrument rests on a few tightly specified legal and medical concepts. The primary concept is the Statement of Principles itself: a non‑statutory‑looking but statutory instrument under s196B(2) of the VEA by which the Repatriation Medical Authority sets out the medical criteria that, if met, permit a decision‑maker to conclude a reasonable hypothesis of service connection (see s3, s8, s9). The wording is that "At least one of the following factors must as a minimum exist before it can be said that a reasonable hypothesis has been raised" (s9). That phrase anchors the burden or threshold for causation under the VEA/MRCA claim pathways identified in s5.

Pinguecula is defined in clinical terms in s7(2). The instrument specifies the morphological description: a small, raised benign elastoic conjunctival degeneration presenting as a fatty nodule near the temporal or nasal limbus (corneal‑scleral junction) and excludes pterygium (s7(2)(a)-(b)). The instrument notes that pinguecula attracts ICD‑10‑AM code H11.1, but instructs that in applying the Statement the statutory meaning is that given in s7(2), not the code alone (s7(3)-(4)). Death from pinguecula is included where a terminal event or condition was contributed to by the pinguecula (s7(5)); terminal event is defined in the Schedule and includes specific causes such as pneumonia, respiratory failure and cardiac arrest.

Relevant service is a defined legal category in the Schedule and is the necessary nexus to which the factors must relate (s10(1) and Schedule 1). The Schedule lists six discrete categories drawn from the VEA and MRCA framework: operational service, peacekeeping service, hazardous service, British nuclear test defence service under the VEA, and warlike and non‑warlike service under the MRCA.

The Statement’s causation mechanics are factor‑based. The five alternative factors in s9 are discrete routes to raising a reasonable hypothesis. The sun‑exposure factor contains a numeric threshold and a method for latitude adjustment that prescribes multipliers for tropical, subtropical, warm temperate and cool temperate latitudes; the method requires calculating latitude equivalent hours and summing them (s9(1) and the explanatory note). The dust and welding factors are quantified as averages of at least 20 hours per week for two years (s9(2)-(3)). The instrument also includes a clinical comorbidity route,Meibomian gland dysfunction present at clinical onset, and an access to care route, inability to obtain appropriate clinical management prior to clinical worsening (s9(4)-(5)). The access to care factor is explicitly limited in effect where the pinguecula was suffered or contracted before or during, but did not arise out of, relevant service; in that circumstance the factor applies only to material contribution or aggravation (s10(2)).

Finally, the instrument preserves interaction with other Statements of Principles. If a factor in s9 refers to an injury or disease already covered by another Statement made under s196B(2) of the VEA, then the factors in that other Statement apply according to their terms as in force from time to time (s11). This creates a layered application where the content of other Statements can import or modify the medical factors relevant to a particular claimant.

The instrument applies narrowly to claims that fall within section 120A of the VEA or section 338 of the MRCA (s5). The Schedule defines "relevant service" and thus identifies the service types whose members are within the statutory ambit: operational service, peacekeeping service, hazardous service, British nuclear test defence service under the VEA, and warlike or non‑warlike service under the MRCA (Schedule 1). In practical effect, the class of persons affected are those who render or rendered one of these kinds of service and who lodge claims that engage s120A of the VEA or s338 of the MRCA. The Statement does not itself adjudicate benefits; rather, it supplies the medical criteria that must be met for a reasonable hypothesis to exist in relation to pinguecula and death from pinguecula (s8-s9).

The instrument affects several stakeholders in the claims process. Claimants and their advisers are affected because the Statement prescribes specific quantitative and qualitative criteria that must be established to raise the reasonable hypothesis; for example the sun exposure threshold and the dust and welding exposure averages (s9(1)-(3)). Medical practitioners preparing reports will be expected to engage directly with the defined medical description of pinguecula (s7(2)) and the listed factors, including documenting Meibomian gland dysfunction at clinical onset if relied upon (s9(4)). Decision‑makers assessing claims under the VEA and MRCA frameworks will use the Statement’s factors as the medical basis for concluding whether a reasonable hypothesis is raised; the instrument makes that the Authority’s view of the medical‑scientific evidence (s8).

Other affected parties include authors of other Statements of Principles. Where a factor in s9 refers to a different injury or disease that is the subject of another Statement, the terms of that other Statement apply as in force from time to time (s11). This means that updates or changes in other Statements can alter how a s9 factor is treated in practice.

The instrument also removes the prior Statement No. 118 of 2015 (s4). Anyone who relied on that earlier Statement for ongoing claims should note that the 2024 Statement replaces it from its commencement date (s2 and s4).

The instrument does not itself set out administrative processes for lodging claims, for payment, or for review. It also does not specify penalties or enforcement measures; therefore persons involved in claims must consult the VEA and MRCA provisions referenced at s5 and Schedule 1 to understand procedural and remedial mechanisms outside this Statement.

This instrument does not create new statutory duties in the sense of criminal or administrative offences. Instead it prescribes the medical factors that must exist for a reasonable hypothesis to be raised connecting pinguecula or death from pinguecula to a person’s relevant service (s9). Thus the operative duties and rights are those that arise when the Statement is applied in the statutory claims framework under the VEA and MRCA. The text itself identifies several legal obligations on parties presenting evidence in claims and corresponding rights afforded by the Statement.

Obligations on claimants and their advisers. To meet the Statement’s threshold claimants must show that at least one of the enumerated factors in s9 existed before clinical onset and that the factor is related to the claimant’s relevant service (s9 and s10(1)). The sun‑exposure route requires quantification of hours and latitude equivalent calculation using the multipliers supplied (s9(1) and note). The dust and welding routes require establishing averages (20 hours per week for two years) (s9(2)-(3)). Meibomian gland dysfunction must be present at clinical onset if relied upon (s9(4)). The inability to obtain appropriate clinical management is a narrower route and, per s10(2), applies only to material contribution or aggravation where the condition was suffered or contracted before or during, but did not arise out of, relevant service.

Rights of claimants. The Statement provides a clear catalogue of routes that, if evidenced and linked to relevant service, satisfy the Authority’s view of what raises a reasonable hypothesis (s8-s9). A claimant who establishes one of these factors and the requisite connection to relevant service has the statutory entitlement to have the claim advanced on the basis that a reasonable hypothesis exists; the Statement is the Authority’s view that provides medical‑scientific support for that conclusion (s8-s9). Where a factor refers to another Statement of Principles, claimants have the right to have those provisions applied as in force from time to time (s11).

Duties on medical witnesses. The Statement sets the medical parameters within which medical evidence will be assessed. A medical practitioner offering an opinion must address whether the claimant’s condition fits the definition of pinguecula in s7(2), whether any of the s9 factors are present, and whether those factors are related to relevant service as defined in the Schedule and s10(1).

Decision‑maker obligations. Decision‑makers operating under the VEA and MRCA must apply this Statement to claims to which s120A of the VEA or s338 of the MRCA applies (s5). The Statement prescribes minimum factors that raise a reasonable hypothesis; decision‑makers must therefore assess whether evidence establishes at least one such factor and its relationship to relevant service. The instrument does not itself outline evidence rules or procedural steps for decision‑makers beyond this substantive medical threshold.

Limitations and conditional rights. The inability to obtain appropriate clinical management factor is explicitly limited; it applies only to material contribution to or aggravation of pinguecula where the condition was suffered or contracted before or during but did not arise out of the relevant service (s10(2)). This creates a conditional right: a claimant relying on s9(5) must also fit within the pre‑service or during‑service-but-not‑arising‑out‑of-the‑service facts described in s10(2).

Cross‑reference rights. If a s9 factor refers to an injury or disease covered by another Statement, the rights and duties in that other Statement apply, as it may be amended (s11). This means the substantive medical thresholds for related conditions can change over time and alter claim outcomes.

This Statement of Principles contains no express penalty, fine, sanction, or enforcement mechanism within its text. It is a medical‑evidentiary instrument produced under subsection 196B(2) of the VEA (s3) and its operation is to define the medical factors that constitute the Repatriation Medical Authority’s view of the medical‑scientific evidence relevant to causation for pinguecula and death from pinguecula (s8-s9). The document therefore functions as an evidentiary standard to be applied in claims processes under the VEA and the MRCA, rather than as a freestanding regulatory instrument that prescribes penalties.

Enforcement in the sense of decision‑making will occur through the VEA and MRCA claims administrative process to which this Statement applies (s5). The instrument identifies those claim pathways by cross‑reference to s120A of the VEA and s338 of the MRCA (s5). Any administrative consequences, such as acceptance or rejection of a claim, the grant of entitlements, or review rights, are governed by those Acts and regulations and are not specified in the Statement. Because the Statement does not set out statutory sanctioning powers, there are no enforcement steps, compliance notices, or penalties contained in this text.

The instrument does, however, impose practical evidentiary requirements that operate as gating criteria. For example, unless at least one of the factors in s9 exists and is related to relevant service (s10(1)), it cannot be said that a reasonable hypothesis has been raised. That evidentiary gate will determine whether a claimant proceeds to entitlement assessments under the VEA/MRCA frameworks. The practical effect is that the Statement can operate as a determinative element in claims adjudication, but the mechanisms by which findings are enforced, and by which adverse decisions are reviewed or appealed, must be sought in the VEA and MRCA statutory schemes rather than in this Statement.

Because the Statement repeals the earlier 2015 Statement (s4), there is also an implementation date to note. From commencement (24 September 2024) the 2015 Statement is no longer in force; application of the new medical factors will be the basis for raising a reasonable hypothesis in claims covered by s120A VEA or s338 MRCA from that date (s2-s4). Any transitional or consequential enforcement effects fall to the administering statutes and agencies rather than to this Statement itself.

The Statement explicitly situates itself within the VEA and MRCA frameworks and cross‑references other Statements of Principles. Section 3 states that it is made under subsection 196B(2) of the VEA. Section 5 limits its application to claims to which section 120A of the VEA or section 338 of the MRCA applies. The Schedule 1 definitions cross‑refer to the VEA and MRCA vocabulary by defining "relevant service" in terms of the service categories used in those Acts (Schedule 1). Thus the instrument is designed to be read and applied within the statutory context of veterans’ entitlements and military rehabilitation legislation.

There are three concrete interaction mechanisms set out in the text. First, the Statement relies on the service categories in the VEA and the MRCA when imposing the nexus requirement in s10(1). A factor in s9 must be "related to the relevant service rendered by the person", and relevant service is defined by reference to the service types listed in the Schedule (s10(1); Schedule 1). Therefore any claim assessment must integrate service records and the legal categorisation of service under the VEA/MRCA to determine whether the required relationship exists. The Statement itself does not define how to prove that relationship; that process is governed by the VEA and MRCA provisions referenced at s5 and in Schedule 1.

Second, the Statement points to other Statements of Principles. Section 11 provides that if a factor in s9 refers to an injury or disease for which another Statement under subsection 196B(2) of the VEA has been determined, the factors in that other Statement apply in accordance with its terms as in force from time to time. This creates a legal layering: the content and current version of other Statements can modify how particular factors are treated during claims assessments. Practically, this means assessors must check the contemporary text of other Statements when a s9 factor implicates another disease.

Third, the Statement references ICD‑10‑AM coding (s7(3)-(4)). It notes that while pinguecula attracts ICD‑10‑AM code H11.1, the applicable meaning for the Statement is the statutory description in s7(2). The instrument cites the edition and effective date of the ICD‑10‑AM referred to, namely the Tenth Edition effective 1 July 2017, and identifies the publisher and ISBN (s7(4)). This is an informational cross‑reference that clarifies that coding does not supplant the statutory definition.

What the instrument does not do is alter or enumerate the procedural or remedial rules of the VEA or the MRCA. It does not set out the decision‑making process, appeal rights, or entitlement calculations; those remain in the referenced Acts. The Statement contains no provisions modifying those Acts, and it contains no penalties or enforcement powers of its own (see "Penalties and enforcement").

Finally, the instrument repeals the earlier Statement on pinguecula (No. 118 of 2015) (s4). That repeal is an express interaction with prior subordinate instruments and means that the 2015 Statement’s text is displaced from the date of commencement (s2). Where previous claims were considered under the 2015 Statement, subsequent assessments after commencement must apply the 2024 Statement, subject to any transitional arrangements found elsewhere in the VEA/MRCA schemes rather than in this Statement.

This Statement records only a limited amendment history within its text. The document is dated 20 August 2024 and commences on 24 September 2024 (s2). It expressly repeals the earlier Statement of Principles concerning pinguecula (No. 118 of 2015) previously made under subsection 196B(2) of the VEA (s4). No other prior versions, amendments, or transitional provisions are contained in this instrument.

The repeal in s4 is unconditional in the text: the 2015 Statement (Federal Register of Legislation No. F2015L01670) is replaced by this instrument on commencement. The instrument does not provide a schedule of savings, grandfathering, or transitional arrangements for claims made before commencement. The absence of transitional provisions in the instrument itself indicates that any transitional questions should be resolved by reference to the VEA and MRCA statutory frameworks or administrative practice rather than by this Statement.

The instrument also contains a mechanism that makes it responsive to changes elsewhere: section 11 directs that, where a factor in this Statement refers to an injury or disease covered by another Statement of Principles under subsection 196B(2), then the factors in that other Statement apply in accordance with its terms as in force from time to time. This establishes an ongoing interaction where amendments to other Statements will affect how certain s9 factors operate. In that sense, the Statement is not frozen in isolation; it imports the current content of other Statements when cross‑references occur.

No amendment procedure for this specific Statement is included in the text. Any future revisions would have to be made under the statutory authority cited at s3, that is subsection 196B(2) of the VEA. The instrument does not record dates or versions other than the 2024 text and the prior 2015 instrument it repeals.

Because the Statement cites a specific edition of ICD‑10‑AM (Tenth Edition, effective 1 July 2017) at s7(4), changes to that coding would not automatically alter the statutory definition of pinguecula in s7(2), but practitioners should note that the Statement’s explicit reference fixes the coding reference point. The Statement’s substantive definition control clause in s7(3) indicates the ICD code is informational rather than determinative.

The text of the Statement contains no reference to any litigation, judicial decisions, or administrative tribunal rulings that bear on its content. It names no cases, cites no authorities beyond the VEA and the MRCA statutory provisions under which it is made, and does not record any legal challenges to its predecessor instrument. Section 8 records the Repatriation Medical Authority’s view that "there is sound medical‑scientific evidence" connecting pinguecula and death from pinguecula to relevant service (s8), but the instrument does not provide citations to clinical studies, expert reports, or any judicial determinations.

Because the instrument is a Statement under subsection 196B(2) of the VEA, litigation concerning its application would occur, if at all, in the context of disputes under the VEA or the MRCA concerning entitlement determinations and the proper application of Statements of Principles. The instrument itself does not list any cases nor provide an administrative record of dispute. Consequently, there is no litigation history recorded in this document that would indicate how courts or tribunals have interpreted the factors or the reasonable hypothesis threshold in relation to pinguecula.

Practitioners seeking case law on the application of Statements of Principles generally or on the "reasonable hypothesis" standard will need to consult judicial and tribunal decisions outside this instrument. The instrument makes clear the factual and medical thresholds that decision‑makers are to treat as raising a reasonable hypothesis for pinguecula (s9), but it leaves open how those thresholds will be resolved in any particular factual dispute. The absence of cited litigation in the instrument means that any interpretive gloss or precedent must be identified from external case law rather than from the Statement itself.

This instrument contains several technical features and conditional rules that can materially affect claim outcomes; practitioners should note the precise formulation and limits contained in the text.

Statutory meaning overrides coding. Although the Statement notes that pinguecula attracts ICD‑10‑AM code H11.1 (s7(3)), it clarifies that the operative meaning for the Statement is the clinical description in s7(2). This means that reliance on the ICD code alone without reference to the statutory clinical description could be misplaced.

Precise definition of pinguecula. The instrument defines pinguecula narrowly: a small, raised benign elastoic conjunctival degeneration presenting as a fatty nodule near the temporal or nasal limbus, and explicitly excludes pterygium (s7(2)). A pathology or ophthalmology report that does not match this description may not meet the Statement’s condition. The presence of pterygium is specifically excluded, so claims that rely on a diagnosis described as pterygium will not fall within this Statement.

Quantification and latitude equivalence for sun exposure. The sun‑exposure factor in s9(1) requires at least 2,250 hours of unprotected exposure in a tropical area, or equivalent exposure in other latitudes calculated using the multipliers set out in the s9 note. The note prescribes multipliers: tropical 1.0, subtropical 0.75, warm temperate 0.5, cool temperate 0.25 (note to s9). Latitude equivalent hours must be added across regions. The practical implication is that claimants must provide or reconstruct detailed exposure histories that permit a latitude‑adjusted hours calculation. Generic statements about "lots of sun" will not satisfy the numeric threshold.

Averaging requirement for dust and welding exposures. Both the dust factor (s9(2)) and the arc welding factor (s9(3)) require an average exposure of at least 20 hours per week for two years before clinical onset. The average and the two‑year duration are both required. Shorter durations at high intensity, or intermittent exposures below the 20 hours per week average, will not, on the face of the instrument, meet these routes.

Unprotected eye requirement. The sun, dust and welding factors all specify exposure of the "unprotected affected eye" or welding "without eye protection" (s9(1), s9(2), s9(3)). This places evidential weight on whether the eye was protected during the relevant exposures. Documentation or credible evidence that eye protection was not used will therefore be central.

Meibomian gland dysfunction timing. The Meibomian gland dysfunction factor requires the disorder to be present "at the time of clinical onset" (s9(4)). The timing of that diagnosis relative to the onset date will be a critical fact. Retrospective diagnoses or later development of gland dysfunction may not assist unless they can be linked to the time of onset.

Access to care factor limitation. The inability to obtain appropriate clinical management factor (s9(5)) is not a general route to causation; section 10(2) limits its application. It applies only to material contribution to, or aggravation of, pinguecula where the person’s pinguecula was suffered or contracted before or during, but did not arise out of, relevant service. In other words, s9(5) cannot be used to assert that lack of management converted an otherwise unrelated condition into one arising out of service; it only addresses material contribution or aggravation for pre‑existing or contemporaneous but non‑service‑arising pinguecula.

Death from pinguecula includes contribution to terminal events. Section 7(5) extends pinguecula, for the purposes of the Statement, to include death from a terminal event or condition that was contributed to by the person’s pinguecula. Schedule 1 defines "terminal event" by example. A claimant alleging death caused or contributed to by pinguecula must adduce evidence that the pinguecula contributed to a listed kind of terminal event or other proximal/ultimate cause identified in the Schedule.

Cross‑reference complexity. Section 11 provides that if a s9 factor refers to an injury or disease covered by another Statement, that other Statement’s factors apply as in force from time to time. Practically, this requires assessors and claimants to check the current text of other Statements. The effect is that changes to other Statements can alter how a s9 factor operates at the time of decision.

Replacement of prior Statement. The 2024 Statement repeals the 2015 Statement (s4). If a claim was previously assessed under the 2015 Statement, the new text applies from the commencement date. No transitional provisions are included in the instrument.

No penalties or procedural rules in text. The Statement lacks procedural detail, penalty provisions or provisions about evidence admissibility. It is therefore crucial to read the VEA and MRCA provisions identified at s5 and Schedule 1 for procedural consequences, time limits, and review rights. The Statement establishes only the medical factors and the Authority’s view of the evidence supporting them.

Compliance in this context means presenting medical and factual material that establishes at least one of the s9 factors and the requisite relationship to relevant service under s10(1). The Statement’s text itself prescribes the substantive content of what must be shown; practitioners should therefore structure evidence and opinions to address the statutory elements and the specific thresholds.

1. Establish the diagnosis against the statutory definition (s7(2)-(3)). Medical reports should describe the lesion in terms consistent with the instrument: a small, raised benign elastoic conjunctival degeneration presenting as a fatty nodule near the temporal or nasal limbus. Because the instrument excludes pterygium (s7(2)(b)), ensure the diagnosis excludes pterygium explicitly where relevant.

2. Show the relationship to relevant service (s10(1) and Schedule 1). The Statement requires that any s9 factor relied upon be related to the person’s relevant service. Relevant service is defined in the Schedule as the VEA and MRCA service categories. Evidence should therefore identify the type of service rendered and connect the exposure or event giving rise to the s9 factor to that service period.

3. For sun exposure claims, apply the numeric threshold and latitude conversion (s9(1) and note). The sun route requires at least 2,250 hours of unprotected eye exposure in tropical latitudes or equivalent across latitudes. The note prescribes multipliers: tropical multiplied by 1.0, subtropical by 0.75, warm temperate by 0.5 and cool temperate by 0.25, and then adding the latitude equivalent hours across regions. Evidence must therefore enable an hours calculation by latitude. Practitioners should document locations, deployment dates, duties and typical daily exposure patterns to permit the latitude equivalent arithmetic required by the note to s9(1).

4. For dust exposure claims, document intensity and duration to show 20 hours per week average for two years (s9(2)). The instrument specifies "heavy exposure of the unprotected affected eye to dust, where the upper body is mostly covered in dust" at the quantifiable average. Evidence that merely describes occasional exposure is unlikely to meet this threshold. The two‑year continuous or averaged period must be established.

5. For arc welding claims, show unprotected exposure averages of 20 hours per week for at least two years before clinical onset (s9(3)). The provision requires welding without eye protection and exposure to arc welding radiation and fumes. Records should identify welding tasks, hours, absence of eye protection and the relevant two‑year averaging period.

6. For Meibomian gland dysfunction, link timing to clinical onset (s9(4)). The factor requires the gland dysfunction to be present "at the time of clinical onset." Medical evidence must place the diagnosis contemporaneously with the onset date and explain how the dysfunction plausibly contributed to pinguecula.

7. For inability to obtain appropriate clinical management, observe the conditional limit (s9(5) and s10(2)). This factor applies only to material contribution to or aggravation of pinguecula where the condition was suffered or contracted before or during, but did not arise out of, the person’s relevant service. Evidence should show pre‑existing or contemporaneous condition timing, the nature of the failure to obtain appropriate care, and causal linkage to material contribution or aggravation.

8. Where a factor invokes another Statement, consult that Statement (s11). If a s9 factor refers to another injury or disease covered by a different Statement of Principles, the claimant must meet the factors in that other Statement as it is in force. Practitioners should identify and cite the current text of any cross‑referenced Statement when preparing opinion evidence.

9. Address the death‑from‑pinguecula pathway when relevant (s7(5) and Schedule 1). If a claim involves death, the medical material must explain how the pinguecula contributed to a terminal event or condition. Schedule 1 provides examples of terminal events that the instrument contemplates. For a mortality claim, contemporaneous clinical documentation and cause‑of‑death material must connect the pinguecula to the terminal event.

10. Present evidence on eye protection usage. The sun, dust and welding factors specify exposure of the "unprotected affected eye" or welding "without eye protection" (s9(1)-(3)). If a claimant used eye protection at times, explain frequency and effectiveness; if no protection was used, document that fact.

11. Ensure temporal sequencing. All s9 factors must be present before clinical onset. The instrument repeatedly emphasises that the exposures or conditions must have occurred before clinical onset (see s9 heading and individual subparagraphs). Medical and service records must support the sequence of events.

12. Prepare clinicians to address the Statement directly. Medical experts should be asked to state whether, in their opinion, the claimant’s clinical findings fit the statutory definition of pinguecula, whether any s9 factors are met to the requisite thresholds, whether those factors were related to relevant service, and whether a reasonable hypothesis is raised. Where s9 factors implicate other Statements, experts should reference those texts and explain compliance.

13. Be alert to the repeal of the 2015 Statement (s4). For claims straddling the repeal and commencement date, legal advisers should identify which Statement applied at the time of any prior decision and whether reassessment is necessary under the 2024 Statement from 24 September 2024 (s2-s4).

This instrument does not prescribe filing procedures, evidence admissibility rules, or appeal rights. Those procedural steps are governed by the VEA and the MRCA provisions identified at s5 and in Schedule 1. Practitioners preparing claims should therefore pair the substantive evidentiary strategy described above with the procedural requirements of the governing Acts.
