Statement of Principles concerning periodontitis (Reasonable Hypothesis) (No. 27 of 2022)

The principal legal and medical concepts the instrument establishes are: the scope and definition of periodontitis for veterans' claims, the set of qualifying factors that raise a reasonable hypothesis linking periodontitis (or death from it) to relevant service, the temporal and clinical thresholds that attach to those factors, and the relationship rules that determine when factors are to be treated as material contribution or aggravation.

Definition of periodontitis. The instrument defines periodontitis in clinical terms, as inflammation of the tissues supporting the teeth with periodontal pocketing and destruction of periodontal ligament or alveolar bone, leading to progressive attachment loss and tooth loss at diseased sites (s 7(2)(a)). It explicitly includes aggressive, chronic, necrotising ulcerative periodontitis, peri‑implantitis and periodontitis as a manifestation of acquired systemic disease (s 7(2)(b)). It also lists exclusions, such as abscess of the periodontium, acute necrotising ulcerative gingivitis, chronic apical periodontitis and various other dental lesions (s 7(2)(c)). The instrument notes that although periodontitis attracts ICD‑10‑AM code K05.3, the meaning supplied in s 7(2) is determinative for applying this SoP (s 7(3)-(4)).

Factors and thresholds. Section 9 contains a closed list of factors. They are divided into two broad types: factors that establish a reasonable hypothesis that periodontitis was caused by circumstances connected to service (s 9(1)-(16)) and factors that establish a reasonable hypothesis that service materially contributed to, or aggravated, pre‑existing periodontitis (s 9(17)-(34)). Many factors are defined with precise temporal or numerical thresholds. Examples include:

• History of gingivitis involving the affected region continuously for at least 6 months before clinical onset or clinical worsening (s 9(1), (17)).
• Presence of a foreign body (implant, prosthesis, orthodontic appliance) in contact with the affected region on more days than not for at least 6 continuous months prior to clinical onset or worsening (s 9(2), (18)); if removed before onset/worsening the onset/worsening must have occurred within 4 weeks of removal (s 9(2), (18)).
• Oral piercing adjacent to the affected region for at least 6 months (s 9(3), (19)).
• Trauma or surgery to the affected region within 6 months prior to clinical onset or worsening (s 9(4)-(5), (20)-(21)).
• Systemic or haematological conditions present at time of onset/worsening, including neutropenia, agranulocytosis, leukaemia, HIV infection, diabetes mellitus, chronic renal failure, certain autoimmune diseases (s 9(6)-(12), (22)-(28), with definitions in Sch 1).
• Lifestyle or metabolic risk thresholds such as obesity for a continuous period of at least 3 years before onset/worsening (Sch 1; s 9(10), (26)), smoking of at least 2.5 pack‑years before onset/worsening with specified cessation windows (s 9(13), (29) and Sch 1), severe malnutrition, severe vitamin C or vitamin D deficiency using Schedule numerical cut‑offs (s 9(14)-(15), (30)-(31); Sch 1), and alcohol consumption averaging at least 200 grams per week for at least 2 continuous years before onset/worsening (s 9(16), (32)).
• For worsening only, osteoporosis and inability to obtain appropriate clinical management are also listed (s 9(33)-(34)).

Relationship to service and aggravation rules. Section 10 requires that any factor satisfying s 9 must be related to the person's relevant service as defined in Schedule 1, which lists the varieties of relevant service under the VEA and MRCA (Sch 1). Section 10(2) restricts the application of the factors in s 9(17)-(34) to situations where the person's periodontitis pre‑existed service or was suffered or contracted before or during, but did not arise out of, the person's relevant service. That is, the listed factors for "worsening" are applicable to material contribution or aggravation only where a pre‑existing condition is identified.

Cross‑reference mechanism. Section 11 creates a procedural cross‑reference: where a factor in s 9 refers to an injury or disease that is itself the subject of another SoP made under s 196B(2) of the VEA, the terms of that other SoP apply to that factor. The Schedule supplies definitions and numerical thresholds used throughout.

Authority and evidentiary posture. The instrument is an administrative evidentiary tool. Section 8 records the RMA's view that "sound medical‑scientific evidence" supports the link between periodontitis and relevant service. The statutory role of the SoP is to prescribe the test for raising a reasonable hypothesis so that the administrative decision maker can proceed to entitlement assessment under the relevant Acts.

Primary affected persons. The instrument applies directly to persons making claims under s 120A of the VEA or s 338 of the MRCA (s 5). Those are veterans, members of Peacekeeping Forces, and members of the Forces covered by the VEA and members under the MRCA, as summarised in Schedule 1's definition of "relevant service" (Sch 1). The instrument therefore affects claimants seeking compensation or rehabilitation entitlements for periodontitis or for death where periodontitis contributed to a terminal event (s 7(5)).

Decision makers and respondents. Administratively, the SoP is directed at the decision makers within the Department responsible for adjudicating VEA and MRCA claims because it sets out the factors that establish a "reasonable hypothesis" connecting injury or disease to service. The Repatriation Medical Authority (RMA) made the instrument (s 3). While the instrument records the RMA's scientific view (s 8), the practical users are adjudicators, medical officers, and case managers who will request and assess medical and dental evidence against the definitions and thresholds in s 7, s 9 and Sch 1.

Medical and dental practitioners. Practitioners who provide clinical evidence to support or rebut claims are materially affected. The SoP sets out clear clinical definitions and laboratory thresholds that practitioners will be asked to address, such as presence of gingivitis for continuous periods, documented foreign bodies, trauma or surgery in specified windows, laboratory cut‑offs for vitamin C and vitamin D, BMI calculations, and glomerular filtration rate criteria for chronic renal failure (Sch 1). Practitioners will need to link these factors to the timing of clinical onset or worsening, and to comment on whether any factor was related to relevant service.

Record holders and employers. Military health services, unit medical records, and any private or public dental services that hold records for service members are affected because claimants will need dental charts, surgical notes, pathology results and service medical records to meet the SoP thresholds. A failure to retain or access such records can materially affect a claimant's ability to establish a qualifying factor.

Indirectly affected parties. The instrument may affect insurers, rehabilitation providers, and legal advisers who handle veterans' claims, because the SoP changes the evidentiary checklist and hence the volume and type of evidence to be collected and processed.

Who bears evidentiary burdens. The SoP itself sets the evidentiary framework for the "reasonable hypothesis" test; it does not prescribe which party must produce which document. In practice, the claimant must produce medical and dental evidence to show that at least one of the factors in s 9 applied and that the factor was related to relevant service (s 9; s 10(1)). The Schedule supplies objective measures (BMI formula, pack‑year calculation, laboratory cut‑offs, GFR thresholds) which assign an empirical frame to those burdens (Sch 1).

Who makes the decision. The RMA issues the SoP, but decision makers under the VEA and MRCA use it as part of the statutory decision process. The SoP does not itself make entitlements; it is an evidentiary device. Section 11 also makes it clear that where a factor references an injury or disease covered by another SoP, the other SoP governs that issue.

Statutory function of the SoP. The SoP is made under s 196B(2) of the VEA (s 3). Its legal function is to prescribe the medical and temporal criteria which, if met and related to relevant service, raise a reasonable hypothesis that periodontitis or death from periodontitis is connected to service. Decision makers must apply the instrument in adjudicating claims that fall under s 120A of the VEA and s 338 of the MRCA (s 5).

Duty to establish relationship to service. Section 10(1) imposes a relationship requirement: any factor in s 9 that is relied on must be related to the person's relevant service. This allocates the substantive legal test: not only must a factor exist per the specified thresholds in s 9, but that factor must also be causally related to relevant service. The SoP does not define the evidentiary method for proving that relationship beyond that requirement; decision makers will be required to assess the link using the available service and clinical records.

Limitation on aggravation/material contribution factors. Section 10(2) constrains the use of a large subset of s 9 (factors 17-34). Those factors apply only to claims of material contribution to, or aggravation of, periodontitis when the periodontitis was suffered or contracted before or during, but did not arise out of, the person's relevant service. The administrative duty for decision makers is therefore to determine the timing of the claimant's periodontitis relative to service before applying those worsening‑factors.

Cross‑SoP application. Section 11 creates a duty to apply other SoPs where a factor in s 9 refers to another injury or disease that has its own SoP. The practical effect is a nested application: if, for instance, s 9 refers to diabetes mellitus and there is a separate diabetes SoP, decision makers are bound to apply that SoP's factors and terms when considering diabetes as a factor (s 11).

Requirements for evidence quality. The instrument supplies precise clinical and laboratory thresholds in Schedule 1 which convert general assertions (for example, "obesity" or "vitamin D deficiency") into quantifiable criteria (BMI of 30 or greater, serum 25‑hydroxyvitamin D < 50 nmol/L). This creates a duty on claimants to produce evidence that meets those quantitative thresholds for the named factors. Practitioners are correspondingly asked to produce clinical records that address timing and thresholds.

Rights created or affected. The SoP itself does not create a standalone entitlement; rather it defines the circumstances that satisfy the statutory "reasonable hypothesis" threshold used in VEA and MRCA entitlement assessments. Claimants therefore have the right to have their claim assessed using the SoP's criteria, and decision makers have the right and duty to apply those criteria. Where a factor refers to a disease covered by another SoP, claimants have the right to rely on that other SoP as it applies (s 11).

No penalties or criminal enforcement. The instrument contains no offence provisions, fines, or criminal penalties. Its operation is limited to evidentiary and administrative determinations within the veterans' entitlements system (no penalty sections appear in the instrument).

Transparency and administrative record. The SoP is published and dated, with the RMA Chairperson named and the common seal affixed (front matter). The Schedule sets out the technical definitions used when applying the SoP, which provides an administrative transparency function about thresholds and terminology.

No criminal or civil penalties in the instrument. The Statement of Principles does not create criminal offences, civil penalties, or regulatory sanctions. The text contains no penalty clauses and does not purport to create enforceable private rights or obligations outside the veterans' entitlements scheme. Its operation is confined to the statutory decision framework in the VEA and MRCA, to which it applies (s 5).

Administrative enforcement mechanism. The SoP is an administrative evidentiary standard intended for use by decision makers. The "enforcement" mechanism, to the extent one exists, is the binding use of the SoP by administrators when determining whether a reasonable hypothesis has been raised that periodontitis or death from periodontitis is connected to relevant service. That means claim outcomes, entitlements and rehabilitation decisions can turn on whether a factor in s 9 is shown and related to service under s 10. The instrument itself does not set the decision process, but it modifies the evidentiary threshold that must be satisfied within the statutory processes of the VEA and MRCA.

Discretion exercised by decision makers. The RMA formulates the SoP and records its view that there is "sound medical‑scientific evidence" for a link between periodontitis and relevant service (s 8). However, the SoP leaves administrative decision makers with evaluative discretion in assessing whether a factor is established on the available evidence and whether it is related to service. The instrument supplies precise criteria for many factors which narrows factual discretion, but judgment remains about interpretation of the clinical evidence, timing and causal relation to service.

Appeals and reviews. The instrument does not itself specify review or appeal routes. Claimants dissatisfied with an administrative decision that applied the SoP will need to rely on the review and appeal mechanisms established in the VEA and MRCA. Those mechanisms lie outside the instrument, and the SoP does not alter statutory appeal rights; it merely provides the evidentiary framework decision makers must apply.

Recordkeeping and evidentiary consequences. Because the SoP sets out concrete quantitative and temporal thresholds (for instance BMI, pack‑years, laboratory cut‑offs), claimants who cannot produce records meeting those thresholds will be less likely to satisfy the reasonable hypothesis test. The practical enforcement effect is therefore evidentiary pressure: the outcome of claims will be enforced by the administrative decision contingent on production of appropriate clinical, laboratory, dental and service records.

No retrospective penalty for past record‑keeping. The SoP does not impose retrospective compliance penalties on the medical services or personnel who provided past treatment. It does, however, make access to existing records more consequential for claim outcomes.

Direct statutory references. The SoP is made under s 196B(2) of the VEA (s 3). It expressly applies to claims to which s 120A of the VEA or s 338 of the MRCA apply (s 5). The instrument therefore functions as an interpretive and evidentiary tool for the application of those statutory provisions in the adjudication of claims.

Cross‑SoP application. Section 11 stipulates that where a factor in s 9 refers to an injury or disease that itself has an SoP under s 196B(2) of the VEA, the factors in that other SoP apply in accordance with its terms. That creates an inter‑SoP dependency. Practically, where s 9 invokes, for instance, diabetes mellitus, the diabetes SoP (if present) governs the assessment of diabetes as a factor. This interaction can create nested evidence chains and may require claim files to contain evidence addressing both SoPs' criteria.

ICD‑10‑AM reference. Section 7(3)-(4) acknowledges that periodontitis is coded under ICD‑10‑AM code K05.3 but states that, for the purposes of this SoP, the definition in s 7(2) governs. It also identifies the specific version and edition of the ICD‑10‑AM (Tenth Edition, effective date 1 July 2017) as the source of any ICD references. That ties the SoP to a specific clinical classification system for terminological consistency but displaces the code as the determinant of coverage in favour of the instrument's textual definition.

VEA and MRCA scheme. The SoP is a component of the larger VEA and MRCA statutory frameworks that establish entitlements, rehabilitation and compensation for veterans and members of the Forces. The SoP does not itself alter entitlement criteria in those Acts; it prescribes the medical evidentiary standards decision makers use when applying the statutory causation tests within those Acts. The instrument therefore modifies how existing statutory tests are operationalised without amending the substantive entitlement provisions of the VEA or MRCA.

Medical standards and external health law. The Schedule sets objective clinical and laboratory thresholds (for example, BMI formula, GFR cut‑off, vitamin levels). These interact with general medical practice standards and diagnostic criteria. The SoP therefore interfaces with external medical evidence regulation and record‑keeping obligations, because clinical and laboratory documentation that meets the Schedule's thresholds will be relied upon by administrative decision makers.

No express conflict resolution clause. The instrument does not provide a mechanism for resolving conflicts between the SoP and other legislative instruments beyond the cross‑SoP rule in s 11. Where other laws confer rights or duties relevant to medical records, privacy, or clinicians' obligations, those laws remain in force; the SoP is an evidentiary tool rather than a substitute for privacy or record‑release obligations.

Temporal scope and repeal of prior instrument. The instrument repeals the prior SoP No. 47 of 2013 (s 4). Decision makers must therefore apply the 2022 instrument to claims falling within its application dates, subject to the operative transition rules in the VEA and MRCA statutory schemes where relevant. The instrument does not itself state transitional provisions; practitioners should consult the VEA/MRCA decision practice for any transitional application of repealed instruments.

Instrument dates and action. The instrument is dated 4 March 2022 and commences on 4 April 2022 (front matter; s 2). It was made under s 196B(2) of the VEA (s 3). The text records that the common seal was affixed by direction of the Chairperson of the Repatriation Medical Authority (front matter), and the instrument replaces the earlier Statement of Principles concerning periodontitis No. 47 of 2013 (s 4).

Single repeal recorded. Section 4 expressly repeals the 2013 Statement of Principles concerning periodontitis (Federal Register of Legislation No. F2013L01128). No other amendments or amendments-of-amendments are recorded in the instrument. The instrument does not contain a schedule of prior amendments, nor does it incorporate footnotes about prior versions beyond that single repeal.

Commencement mechanics. The instrument sets a clear commencement date, one month after the instrument date (s 2). The instrument does not include express transitional provisions or savings clauses describing how ongoing claims initiated before commencement are to be treated. Practitioners should therefore expect that the SoP will be applied to relevant claims from the commencement date in accordance with the statutory adjudication procedures of the VEA and MRCA.

No amendment record within the instrument. The present instrument contains no internal amendment history beyond the repeal of the 2013 SoP. It does not purport to amend the VEA or MRCA. Any further amendments to the SoP after its commencement would be reflected in subsequent instruments published by the RMA and would need to be checked in the consolidated Federal Register of Legislation.

Implications for practitioners. Because the 2022 instrument expressly repeals the 2013 instrument (s 4), practitioners should not rely on the earlier SoP for claims falling after commencement. Where a claimant's evidence was gathered under the earlier SoP, decision makers must nonetheless apply the 2022 SoP for claims falling within its application; this can lead to evidentiary gaps where the 2022 SoP uses different thresholds or includes/excludes different factors. The instrument does not document transitional provisions; users should therefore check departmental guidance on application to existing claims.

The instrument itself contains no citations to judicial decisions, and it does not record any litigation history. It is a statement made by the Repatriation Medical Authority and published in the Federal Register; no case law or disputes are recited in the text. The SoP does not purport to summarise judicial treatment of similar instruments.

Practical consequence of no litigation record. The absence of litigation references in the instrument means that the text stands as the RMA's administrative view and specification of factors; it does not assert or summarise how courts have interpreted comparable instruments. Administrative decision makers and advisers will therefore need to rely on the VEA/MRCA statutory processes, departmental practice, and any external case law that addresses the reasonable hypothesis test or the treatment of SoPs more generally. Those cases are not named in this instrument.

How disputes are likely to arise. Although no litigation history is recorded in the instrument, disputes could arise in practice over interpretation of the SoP's thresholds, the sufficiency of evidence to establish a factor, the timing of clinical onset versus clinical worsening, the relationship of a factor to relevant service, and the interaction with other SoPs under s 11. Any such disputes would be resolved through the statutory review processes provided by the VEA and MRCA and potentially through judicial review and merits appeal pathways existing under those Acts. The instrument does not set or alter those remedies.

Evidence base and possible judicial scrutiny. Section 8 records the RMA's view that "sound medical‑scientific evidence" indicates a relationship between periodontitis and relevant service (s 8). If decisions applying this SoP are litigated, courts or tribunals may be asked to consider whether the SoP's factors provide a reasonable evidentiary basis for raising the required hypothesis in individual cases, and whether decision makers applied the SoP correctly. This instrument itself does not document any such judicial scrutiny.

No declarative or declaratory history recorded. The instrument does not contain an explanatory memorandum or extended legislative history within the text provided. The front matter identifies the chairperson and affixing of the common seal, but no further administrative procedural history, consultation record or review timeline is included.

Definition vs coding. The instrument expressly notes that periodontitis attracts ICD‑10‑AM code K05.3 but says the applicable meaning for this SoP is the definition in s 7(2), not the code (s 7(3)). Practitioners should not assume that an ICD code entry alone will satisfy the SoP; the textual clinical elements in s 7(2) control. Similarly, several conditions are explicitly excluded from the definition (s 7(2)(c)), so an ICD code for K05.3 will not automatically cover lesions specifically excluded in the text.

Onset versus worsening, different factor sets. The SoP separates factors that apply to the clinical onset of periodontitis (s 9(1)-(16)) from those that apply to clinical worsening or material contribution/aggravation (s 9(17)-(34)). These are distinct inquiries, and the later group applies only where the periodontitis pre‑existed service or was suffered or contracted before or during but did not arise out of service, per s 10(2). A common pitfall is treating onset and worsening interchangeably; practitioners must establish the timing of onset relative to service to determine which factors may be applied.

Temporal and numerical thresholds are precise and non‑elastic. The SoP contains precise temporal windows and numerical thresholds. Examples include continuous exposure for at least 6 months for gingivitis, foreign body contact or oral piercing before onset/worsening (s 9(1)-(3), (17)-(19)); obesity for a continuous period of at least 3 years (s 9(10), (26) and Sch 1); smoking of at least 2.5 pack‑years with a 10‑year cessation window (s 9(13), (29) and Sch 1); and alcohol consumption averaging at least 200 grams per week for continuous 2 years (s 9(16), (32)). Because the SoP specifies these thresholds, evidence falling short of them is less likely to satisfy the reasonable hypothesis test. Practitioners need to gather records that evidence continuous durations and quantify exposure.

Pack‑year calculation specifics. The Schedule defines "one pack‑year" and gives examples and a method to calculate pack‑years (Sch 1). For pipe tobacco, cigars or combinations, the instrument assumes 1 gram of tobacco equals one cigarette; note the unusual conversion rule that may require careful application to non‑cigarette tobacco users and may produce unexpectedly high or low pack‑year totals if not calculated per the Schedule.

Laboratory and clinical cut‑offs must be evidenced. Several factors depend on laboratory values or objective clinical metrics that are defined in Sch 1: severe vitamin C deficiency (serum ascorbic acid < 2.5 mg/L), vitamin D deficiency (< 50 nmol/L), and chronic renal failure defined by GFR < 15 mL/min/1.73 m2 for at least 3 months or need for renal replacement therapy or chronic dialysis (Sch 1). Claimants should ensure pathology reports and nephrology records are included; absence of such documentation will undermine the factor being established.

Foreign body removal timing. If a foreign body in contact with the affected region was removed before clinical onset or clinical worsening, the SoP requires the onset or worsening to have occurred within 4 weeks of removal to qualify (s 9(2), (18)). That is a narrow window. Practitioners should document implant/prosthesis removal dates precisely.

"Unable to obtain appropriate clinical management" is vague. Factor 34 is "inability to obtain appropriate clinical management for periodontitis" as a basis for clinical worsening (s 9(34)). The SoP does not define what constitutes "appropriate clinical management" or the evidence required to establish inability. This creates potential evidentiary ambiguity. Practitioners should document attempts to access care, denial records, service dental availability, or referrals to support such a claim.

Terminal event linkage for death claims. For death claims, periodontitis includes death from a terminal event or condition that was contributed to by periodontitis (s 7(5) and Sch 1 definition of terminal event). The Schedule lists terminal events such as pneumonia, respiratory failure, cardiac arrest and circulatory failure. Establishing that periodontitis contributed to a listed terminal event will require medical evidence linking periodontitis as a contributing condition to those terminal events; this may be clinically challenging and will require clear causal opinions.

Interplay with other SoPs. Section 11 requires application of other SoPs where a factor in s 9 refers to a disease covered by a different SoP. This can create overlap and potential inconsistency if the other SoP has different thresholds or temporal rules. Practitioners must identify all relevant SoPs and apply them in combination where a factor references another disease.

Exclusions can be misunderstood. The instrument expressly excludes certain dental conditions from the meaning of periodontitis (s 7(2)(c)). A claimant whose dental records identify one of the excluded conditions will need to show that the pathology nevertheless meets the textual definition in s 7(2)(a) and (b) rather than relying on an aggregate dental diagnosis that may have been coded differently.

Burden of proof and relationship to service. The SoP requires that a factor be related to relevant service (s 10(1)). The instrument does not prescribe how that relationship is to be proved; claimants should assemble service medical and dental records, operational exposure records, and clinician opinion evidence linking the factor to service. Failing to do so will likely result in rejection even if one of the listed factors is objectively present.

Evidence checklist and documentation. To satisfy the SoP practitioners and claimants should assemble a claim file that addresses the definition, factors and relationship to service with documentary evidence. Key documents include:

• Dental records and periodontal charts establishing clinical onset dates, pocket depths, attachment loss, tooth loss and diagnoses identifying periodontitis consistent with s 7(2) (detailed dental notes, radiographs).
• Records of gingivitis documenting continuous involvement of the affected region for at least 6 months when that factor is relied upon (s 9(1), (17)).
• Evidence of foreign bodies in contact with the affected region, with dates of insertion and removal (implants, fixed prostheses, removable prostheses, orthodontic appliances), and documentation of removal where applicable to show the 4‑week onset/worsening window (s 9(2), (18)).
• Documentation of oral piercings, with dates showing continuous presence for at least 6 months before onset/worsening (s 9(3), (19); Sch 1 definition of oral piercing).
• Records of trauma or surgery to the affected region, with dates within the 6‑month window prior to onset/worsening (s 9(4)-(5), (20)-(21); Sch 1 definition of trauma).
• Haematological and immunological records confirming neutropenia, agranulocytosis, leukaemia, HIV infection at the time of onset/worsening (s 9(6)-(9), (22)-(24)). Where listed drugs are implicated in neutropenia, prescription and monitoring records should be supplied (s 9 note).
• Diabetes records and glycaemic control evidence at time of onset/worsening (s 9(9), (25)).
• Renal function evidence including GFR values, dialysis or transplant history to meet the chronic renal failure definition in Sch 1 (s 9(11), (27); Sch 1).
• Evidence of autoimmune disease from the specified list and timing relative to clinical onset/worsening (s 9(12), (28); Sch 1).
• Smoking history quantified to calculate pack‑years per Schedule guidance, with cessation dates if any to apply the 10‑year window (s 9(13), (29); Sch 1 notes).
• Weight and height records to calculate BMI, with a continuous record covering 3 years where obesity is relied upon (s 9(10), (26); Sch 1).
• Nutritional assessments, pathology reports showing severe vitamin C levels (< 2.5 mg/L) or vitamin D levels (< 50 nmol/L) where relied upon (s 9(15), (31); Sch 1).
• Alcohol consumption history with quantification to meet the 200 grams/week for 2 years threshold, including supporting notes from treating clinicians if available (s 9(16), (32)).
• Osteoporosis diagnosis and records where worsening is relied upon (s 9(33)).
• Evidence documenting inability to obtain appropriate clinical management, including requests for treatment, referrals, denials, period of unavailability of service dental care, or other corroborating material relevant to s 9(34).
• Service medical and dental records demonstrating exposures, injuries, or limited access to care during relevant service, to establish that any factor is related to relevant service per s 10(1).
• For death claims, medical cause of death documentation showing terminal event(s) and clinician opinions linking periodontitis as a contributing factor (s 7(5); Sch 1 terminal event list).

Clinical opinions and causation statements. Decision makers will expect clinicians to provide opinion evidence that ties the documented factor to the timing of clinical onset or worsening and that expresses an opinion, to an appropriate standard, about whether the factor was related to relevant service. For aggravation claims, clinicians should address whether pre‑existing periodontitis was present before or during service and whether the identified factor materially contributed to or aggravated that condition, consistent with s 10(2) and the s 9(17)-(34) factors.

Calculations per Schedule. Use the Schedule's formulas and conversions exactly. For BMI use BMI = W/H2 with W in kilograms and H in metres (Sch 1). For pack‑years, use the Schedule's definition and conversion notes, including the 1 gram tobacco to one cigarette equivalence for non‑cigarette tobacco forms (Sch 1 notes). For renal insufficiency, use the GFR threshold and chronicity criteria in Sch 1.

Identify and apply other SoPs. If a s 9 factor references another injury or disease that has its own SoP, identify and apply the relevant SoP in accordance with s 11. This may require additional evidence tailored to that other SoP's criteria.

Address exclusions and definitional points. Where there is any ambiguity, clinicians should explicitly address whether the claimant's condition satisfies the textual definition in s 7(2)(a)-(b) and whether it falls within any of the listed exclusions in s 7(2)(c). For example, if records mention "chronic apical periodontitis" or "pericoronitis", explain why those diagnoses do or do not represent the periodontitis targeted by this SoP.

Time sequencing for onset/worsening. Establish an accurate chronology that ties clinical onset or clinical worsening to the dates of service, exposures or events. Because many factors are defined by pre‑onset windows or short post‑removal windows (for foreign bodies), exact dates matter. Where dates are uncertain, procure contemporaneous notes, dental charts, radiographs and service medical entries to corroborate timing.

Practical steps to reduce evidentiary friction. Obtain consent and authorisations to access military health records early. Where records are incomplete, contemporaneous affidavits from treating clinicians or statements from unit medical officers describing availability of dental care or events during service can help substantiate claims, recognising that administrative decision makers will evaluate such evidence against the objective thresholds in the SoP.

Prepare for cross‑SoP evidence. If a s 9 factor refers to a disease covered by another SoP, obtain clinical evidence that satisfies both this instrument's requirements and the other SoP's requirements. For instance, diabetes used as a factor will require both diabetic control evidence and any specific evidence required by a diabetes SoP if one exists (s 11).

Record presentation for decision makers. Present a concise index mapping each evidentiary item to a specific s 9 factor or Sch 1 definition, with clinicians' opinions linked to the statutory requirements. This reduces administrative frictions and aids decision makers in applying the SoP to the claim.

Review and appeal considerations. Where a claim is refused on the basis that no s 9 factor is established or related to service, prepare a review strategy that focuses on adding the missing objective evidence identified above and on obtaining clear causation opinions addressing the SoP thresholds. The SoP provides objective targets for what evidence will be persuasive on review.
