Statement of Principles concerning periodontal abscess (Reasonable Hypothesis) (No. 25 of 2022)

The instrument operates around a small set of core legal‑medical concepts set out in the operative provisions and the Schedule. Those concepts are the definitional scope of the condition, the causal‑link threshold, the discrete factual factors that can satisfy that threshold, the temporal constraints on some factors, and the relationship between those factors and relevant service.

1. Definition and exclusions: "Periodontal abscess" is expressly defined (s7(2)(a)) and several related but clinically distinct conditions are excluded by name (s7(2)(b)(i)-(v)). The exclusions are: combined periodontic‑endodontic lesions; gingival abscess; periapical abscess; periapical periodontitis; and pericoronal abscess. Those exclusions limit coverage to abscesses arising specifically within periodontal tissue supporting the teeth and associated with destruction of supporting bony and ligamentous tissues (s7(2)(a)-(b)).

2. Reasonable‑hypothesis threshold: The instrument operates at the threshold of whether a "reasonable hypothesis" connecting the condition to relevant service has been raised. It specifies, in s9, the factors that "must as a minimum exist" before it can be said that such a reasonable hypothesis has been raised. The RMA frames the instrument by reference to its view that there is "sound medical‑scientific evidence" indicating a connection between periodontal abscess and relevant service (s8); that statement is the Authority's explanatory claim for issuing the SOP.

3. Discrete factors and temporal windows: Section 9 catalogues nine alternative factors; any one is sufficient to meet the reasonable‑hypothesis threshold. Several factors are time‑delimited: periodontitis must have existed at the affected site within the six months preceding clinical onset (s9(1)) or within six months before clinical worsening (s9(5)). Trauma or surgery must have occurred within the four weeks before clinical onset or clinical worsening (s9(3), (4), (7), (8)). These windows allocate evidential burdens to claimants and record‑keeps.

4. Foreign bodies and examples: The instrument recognises "foreign body embedded in the affected region of the periodontium" as a factor (s9(2), (6)). Notes provide non‑exhaustive examples including fingernails, corn husks, dental floss, shrapnel and materials derived from dental procedures (s9 notes).

5. Treatment access and management availability: One factor is "inability to obtain appropriate clinical management for periodontal abscess" (s9(9)). The instrument does not define the phrase in the Schedule; accordingly, its meaning will be a matter of interpretation in application.

6. Onset versus worsening and material contribution: The instrument treats clinical onset and clinical worsening as separate events for the purposes of causation. Factors 1-4 relate to clinical onset; factors 5-8 relate to clinical worsening; factor 9 addresses inability to obtain management (s9). Section 10(2) constrains the application of factors 5-9 to cases where the abscess pre‑existed or was contracted before or during service (but did not arise out of service), and where the factor materially contributed to or aggravated the abscess.

7. Death: The instrument expressly includes death from periodontal abscess where the terminal event or condition was contributed to by the abscess (s7(3)). Schedule 1 defines "terminal event" and provides a short, enumerated list of examples (pneumonia, respiratory failure, cardiac arrest, circulatory failure, cessation of brain function).

8. Interaction with other SOPs: Section 11 provides a mechanism for cross‑application where a factor refers to an injury or disease covered by another SOP. In that case, the other SOP's factors apply "in accordance with the terms of that Statement of Principles as in force from time to time" (s11).

Together these concepts shape the evidentiary framework for a claims officer, medico‑legal assessor or advocate: they define what clinical facts and documentary evidence will meet the threshold for a reasonable hypothesis linking periodontal abscess (or death from it) to the categories of "relevant service" set out in Schedule 1 (see Schedule 1 definition of "relevant service").

The instrument identifies and limits its application to a defined class of claimants, and it also affects decision‑makers and medical assessors who apply Statements of Principles in the VEA/MRCA claims process.

1. Claimants (veterans and members of the Forces): By its terms the instrument "applies to a claim to which section 120A of the VEA or section 338 of the MRCA applies" (s5). Those statutory references pick out the administrative claim pathways available to veterans and serving or former members of the Australian Defence Force (the instrument itself does not reproduce the text of s120A or s338; it makes application contingent on them). The Schedule defines "relevant service" to include operational, peacekeeping, hazardous, British nuclear test defence service under the VEA and warlike and non‑warlike service under the MRCA (Schedule 1). Therefore the instrument primarily affects persons whose periodontal abscess or death from periodontal abscess is alleged to be connected with those categories of service.

2. Medical assessors and claims decision‑makers: The instrument is a tool for the Repatriation Medical Authority's own medical opinion and for claims handlers. The RMA states its view that sound medical‑scientific evidence exists linking periodontal abscess to relevant service (s8). The practical consequence is that medical officers, independent health assessors and decision‑makers who determine whether a reasonable hypothesis has been raised will use the criteria specified in s9 and the definitions in Schedule 1 to assess causation.

3. Service providers and record keepers: Because the instrument gives weight to temporal medical facts (for example, periodontitis within six months, trauma or surgery within four weeks), it affects dentists, dental clinics, hospitals and treating clinicians whose records may be required to show the presence or timing of the relevant factors. The instrument’s evidentiary structure implicitly increases the value of contemporaneous dental and medical records for claimants.

4. Families and estates in death claims: The instrument explicitly extends to "death from periodontal abscess" where death resulted from a terminal event or condition contributed to by the periodontal abscess (s7(3)). This means that dependants or estates bringing statutory claims governed by s120A VEA or s338 MRCA will rely on the Statement when establishing a causal link for benefit purposes.

5. Other SOP authors and agencies: Section 11 makes explicit that where a factor in this Statement refers to an injury or disease covered by another Statement of Principles, the factors in that other Statement apply. That creates a cross‑impact on the application of other SOPs , decision‑makers must consult the other SOP when overlap arises.

Who bears evidentiary burdens: The instrument does not itself allocate legal burdens of proof or specify benefits; it sets factual gates. Practically, it shifts the evidentiary task to claimants to show the presence of one or more of the listed factors and that the factor was related to their relevant service (s9; s10(1)). For factors 5-9, the additional requirement that the periodontal abscess was suffered or contracted before or during service (s10(2)) places an additional temporal evidentiary demand on such claimants.

Who decides: The instrument was made by the Repatriation Medical Authority (s3 and the sealing statement), but it does not itself decide claims. Instead it supplies the medical‑technical criteria used by decision‑makers under the VEA/MRCA claims framework. The text does not identify a particular claims decision‑maker by name or set out decision procedures; it confines itself to being a Statement of Principles determining factors relevant to a reasonable hypothesis.

The Statement of Principles is a standards instrument that places duties and confers rights indirectly through the statutory claims framework to which it applies. The instrument itself does not create primary statutory duties such as offences, nor does it specify benefit entitlements. Instead, it defines criteria that must be present to satisfy a statutory evidentiary threshold used by decision‑makers under the VEA/MRCA.

Rights and entitlements affected

• Entitlement process linkage: The instrument "applies to a claim to which section 120A of the VEA or section 338 of the MRCA applies" (s5). Those provisions set out the statutory mechanisms under which claims for compensation or entitlements are decided. The Statement therefore functions as an evidentiary input into the claimant's right to have a condition recognised as service‑connected for those statutory claim purposes.

• Right to have a death linked to a terminal event attributed in part to periodontal abscess: For death claims, the instrument explicitly includes death from periodontal abscess where death followed a terminal event or condition that the abscess contributed to (s7(3) and Schedule 1 definition of "terminal event"). This gives a recognised causal pathway for estates and dependants to argue service connection for a fatality.

Duties or evidentiary obligations

• Duty to establish factors: The SOP declares that at least one of the factors in s9 "must as a minimum exist" before a reasonable hypothesis can be said to have been raised (s9). This has the practical effect of requiring claimants (or their representatives) to adduce evidence that at least one listed factor existed and that it was related to relevant service (s10(1)).

• Temporal and causal specificity: Several factors impose time‑bounded evidentiary duties. For onset‑related factors, evidence must show periodontitis within six months, or trauma/surgery within four weeks before clinical onset (s9(1)-(4)). For worsening‑related factors, similar time windows apply (s9(5)-(8)) but are additionally constrained by s10(2) (they apply only to material contribution or aggravation where the periodontal abscess was suffered or contracted before or during service). Claimants relying on those factors must therefore produce records or other probative material demonstrating timing and causal nexus.

• Cross‑reference obligations: If a factor refers to an injury or disease covered by another SOP, the claimant must address the requirements of that other SOP because s11 instructs that the other SOP's factors apply in accordance with its terms as in force from time to time.

Who decides and discretion

• The Repatriation Medical Authority made the instrument and states its view about the medical‑scientific evidence (s3, s8). The instrument itself is not prescriptive about how decision‑makers exercise their evaluative judgement beyond stating the list of factors that are sufficient to raise the reasonable‑hypothesis threshold. Those applying the SOP will exercise professional and administrative discretion in interpreting terms that the instrument leaves undefined (for example "clinical onset", "clinical worsening", "inability to obtain appropriate clinical management").

Administrative consequences rather than statutory penalties

• The instrument modifies the medico‑legal assessment applicable to claims but it contains no penalty provisions. It neither creates offences nor prescribes sanctions; instead, it alters the criteria used to determine whether a claim proceeds on the basis of a reasonable hypothesis.

In sum, the Statement allocates an evidentiary duty to produce facts listed in s9 and to show their relation to relevant service (s10(1)). It confers, indirectly via the claims statutes referenced, the right to have such evidence considered when determining service connection for periodontal abscess and related death. The instrument leaves significant interpretative and evidential work to claims handlers, medical assessors and claimants.

The Statement of Principles is not an enactment that imposes criminal sanctions or administrative penalties in itself. It is a technical standards instrument that guides causation assessment for claims under statutory provisions referenced in s5. The instrument contains no sections creating offences, fines, or other penal measures. Its enforcement character is therefore procedural and evidentiary rather than penal.

What enforcement means in practice

• Application in claims determination: Enforcement of the instrument's standards occurs through its use by decision‑makers and medical assessors when evaluating whether a "reasonable hypothesis" connecting periodontal abscess (or death from it) to relevant service has been raised. Section 9 sets out the discrete factors that, if proven, will satisfy that threshold. Hence "enforcement" is the act of applying those criteria to accept or reject that threshold in an individual claim.

• Repeal and supersession: Section 4 repeals the prior Statement of Principles for periodontal abscess (No. 49 of 2013). The repeal means that decision‑makers must apply this instrument in place of the earlier one for claims falling under s120A VEA or s338 MRCA. There is no enforcement mechanism beyond the requirement in administrative practice to use the current SOP.

No penal or regulatory sanctions in the instrument

• Because the instrument lacks penalty provisions, there are no fines, imprisonment terms, or administrative sanctions set out in the text. The way the instrument affects outcomes is by influencing administrative determinations regarding entitlement to benefits or other statutory responses under the VEA and MRCA frameworks. Those statutory schemes themselves contain their own administrative processes and legal remedies, but those are outside the text of this instrument.

Potential compliance consequences for claimants and evidence providers

• Although there are no penalties, failure to provide evidence that meets the factors listed in s9 will have a practical effect on claim success. A claimant who cannot show any of the listed factors or is unable to demonstrate that a listed factor relates to their relevant service (s10(1)) risks not meeting the reasonable‑hypothesis threshold and thus not progressing to entitlement on that technical ground. Administrative appeal mechanisms within the broader VEA/MRCA framework would be the available remedial channels, but they are not specified here.

Delegation and decision discretion

• The instrument delegates substantive medical value judgements to the RMA's own professional view (s8) and to the application of its enumerated factors. It leaves to claims decision‑makers the interpretation of clinical terms and the exercise of discretion in borderline cases. This creates an enforcement environment in which consistency of application depends on professional assessment standards rather than statutorily mandated enforcement measures.

In short, the instrument enforces standards by guiding administrative determinations and by replacing the prior SOP. It does not itself create or enforce penalties; its consequences are administrative and evidentiary within the VEA/MRCA claims systems.

This Statement of Principles situates itself within the statutory architecture of veterans' entitlements and compensation in Australia. Its interactions with other laws and instruments are principally evidentiary, definitional and hierarchical.

Primary statutory linkages

• Authority and creation: The instrument is made under subsection 196B(2) of the Veterans' Entitlements Act 1986 (s3). That subsection is the statutory power under which the Repatriation Medical Authority makes Statements of Principles. The Statement therefore derives its force and role from the VEA even though it applies to claims under both the VEA and the MRCA (s5).

• Application to claims under VEA and MRCA: Section 5 explicitly ties the Statement’s operation to claims to which s120A of the VEA or s338 of the MRCA apply. The instrument therefore functions as a medical‑causal input into the decision‑making processes that those sections trigger. The instrument does not itself reproduce the content of those sections nor does it purport to expand or limit the substantive legal rights contained in either Act; it provides criteria that are used when those statutory claim provisions are engaged.

Interaction with other Statements of Principles

• Cross‑application where overlap exists: Section 11 creates an express mechanism for interaction with other Statements of Principles. If a factor listed in s9 refers to an injury or disease covered by another SOP made under subsection 196B(2) of the VEA, then "the factors in that Statement of Principles apply in accordance with the terms of that Statement of Principles as in force from time to time" (s11). Practically this requires claim handlers and medical assessors to consult multiple SOPs when the factual factor invokes another injury/disease domain.

Supersession of previous instrument

• Repeal of prior SOP: Section 4 repeals the 2013 Statement of Principles concerning periodontal abscess (No. 49 of 2013). The repeal is a direct interaction , the new instrument replaces the earlier instrument entirely. Decision‑makers must apply the No. 25 of 2022 SOP to eligible claims from its commencement date (s2).

Definitions and statutory categories

• Shared definitions across instruments: The Schedule defines "relevant service", "terminal event", "trauma to the affected region of the periodontium", and other terms. Some of those defined categories (for example, the enumerated types of relevant service) mirror statutory classifications used elsewhere in the VEA and MRCA, meaning the SOP's definitions dovetail with those Acts for consistent application in claims processing (Schedule 1).

Limits of interaction

• No alteration of substantive statutory entitlement tests: The Statement does not purport to alter the substantive legal standard of entitlement contained in the VEA or MRCA. It operates at the causal‑assessment stage by defining the factors that raise a reasonable hypothesis. Any ultimate legal entitlement, or the procedural rules for claims and appeals, remains governed by the VEA and MRCA themselves and related regulations and administrative law, not by the SOP text.

Operational impact on administrative law and evidence

• Evidentiary and procedural consequences: The SOP interacts with administrative decision‑making practice by prescribing the factors and time windows that will be treated as meeting the reasonable‑hypothesis test. That affects what evidence should be gathered, how expert medical opinion is framed, and how tribunal or court reviewers may evaluate whether a decision was reasonable, given the SOP is the authoritative statement of relevant factors for this condition.

In sum, the instrument is an administrative standards device that sits below and interacts with the governing Acts (VEA and MRCA) and alongside other Statements of Principles. It replaces an earlier SOP, cross‑references other SOPs where overlap arises, and uses definitions consistent with the statutory framework, but it does not itself change the statutory entitlement scheme or create independent legal rights outside that framework.

The instrument sets out a concise internal amendment and commencement record in its operative text. The points of amendment history evident from the document are as follows:

• Instrument identification and date of making: The Statement is identified as "Statement of Principles concerning PERIODONTAL ABSCESS (Reasonable Hypothesis) (No. 25 of 2022)" and is dated 4 March 2022 as the date on which it was determined by the Repatriation Medical Authority (seal and signature block). It commences on 4 April 2022 (s2).

• Repeal of prior SOP: Section 4 states that the Statement of Principles concerning periodontal abscess No. 49 of 2013 (Federal Register of Legislation No. F2013L01125) is repealed. That is an explicit supersession: No. 25 of 2022 replaces No. 49 of 2013 as the operative Statement of Principles for periodontal abscess.

• No other amendments recorded in the instrument: The body of the text does not record any prior amendments to this instrument itself. It provides the final, complete text of the current Statement. The instrument does not include consequential amendment provisions altering primary legislation or other instruments; its scope is confined to defining the Statement’s content and its repeal of the 2013 instrument.

• Ongoing referencing to other SOPs: Section 11 contemplates that other Statements of Principles may be "in force from time to time", which implicitly recognises that other SOPs may be amended or replaced. The current instrument delegates to the terms of those other SOPs as they stand at the time of application (s11). Therefore the operational amendment history of this instrument will be partly shaped by subsequent changes to other SOPs that it cross‑references.

• Signature and sealing: The instrument bears the Common Seal of the Repatriation Medical Authority and is signed at the direction of the Chairperson (Professor Terence Campbell AM). These formal entries record the instrument's execution but are not legislative amendments.

Practical consequence for claimants and practitioners

• Transition from previous SOP: The repeal of the 2013 SOP is the principal historical change recorded. Practitioners should note that claims historically assessed under the 2013 Statement must, from 4 April 2022, be assessed under No. 25 of 2022. This may alter the clinical factors relied upon, the temporal windows relevant to proof and the exclusions that apply.

• Future amendments: The instrument anticipates a living regulatory environment by referencing other SOPs "as in force from time to time" (s11). Consequently, practitioners must monitor for subsequent amendments to other SOPs that could interact with this Statement.

No internal record of previous amendments to No. 25 of 2022 appears in the text, and no other historical instruments or legislative amendment dates are mentioned beyond the replacement of the 2013 SOP.

The instrument itself does not record any judicial or tribunal challenges, and it contains no appendix referencing litigation. The Statement of Principles is a technical instrument produced by the Repatriation Medical Authority under subsection 196B(2) of the VEA (s3). The text is silent on previous or ongoing litigation concerning its terms, the prior SOP, or its application.

What the absence of recorded litigation in the instrument means

• No litigation recorded in the instrument: Because the document is an instrument, not a report of litigation, it does not provide a litigation history. The lack of any litigation record in the text does not necessarily imply there has been no relevant litigation; it simply means the instrument does not itself include such material.

• Litigation context sits outside the SOP text: Challenges to determinations that use Statements of Principles generally arise in administrative appeal channels under the VEA or MRCA or in judicial review proceedings. Any litigation would be recorded in tribunal or court decisions, not in the instrument. The SOP contains no sections referencing court or tribunal decisions, and it names no cases.

Implications for practitioners

• Need to review external jurisprudence: Practitioners seeking to understand how a decision‑maker has applied this SOP in contested cases will need to search tribunal and court databases for decisions referencing Statement of Principles No. 25 of 2022, or decisions applying the predecessor 2013 SOP. The instrument itself provides no direct guide to litigation trends or judicial interpretation.

• No preemptive judicial gloss contained in the SOP: Because there is no litigation history embedded in the document, claim handlers must rely on the plain terms of the SOP, the definitions in Schedule 1, and the statutory framework, supplemented by any administrative guidance or external case law found elsewhere.

In summary, the instrument contains no internal litigation history. Its practical application in contested claims will be shaped by how tribunals and courts (if engaged) interpret the terms used , for example "clinical onset", "clinical worsening", "inability to obtain appropriate clinical management", and the temporal windows in s9 , but such interpretations are not supplied in this document.

The text contains several drafting features and definitional choices that create potential pitfalls for claimants, advisers and decision‑makers. These issues arise directly from the instrument’s structure, choice of defined terms, exclusions and temporal constraints.

1. Narrow condition definition with explicit exclusions (s7(2)): The instrument confines coverage to periodontal abscess as defined and expressly excludes several related dental conditions (combined periodontic‑endodontic lesions; gingival abscess; periapical abscess; periapical periodontitis; pericoronal abscess). Claimants and clinicians must take care to map clinical diagnoses precisely to the statutory definition. A diagnosis that uses a differently labelled abscess or describes periapical pathology will not fall within the SOP even where clinically related symptoms exist.

2. Timing windows are short and different for onset versus worsening (s9(1)-(8)): The instrument requires periodontitis within six months prior to clinical onset or clinical worsening, and trauma or surgery within four weeks prior. Those windows create evidentiary risk where medical records are incomplete, missing or non‑specific. For older veterans or where dental care was episodic, establishing the precise timing may be difficult.

3. "Inability to obtain appropriate clinical management" is a factor but undefined (s9(9)): The instrument lists inability to obtain appropriate clinical management as a standalone factor but does not define what constitutes "appropriate" management nor what proof is required to demonstrate inability to obtain it. This will likely be a fact‑intensive, case‑by‑case determination and a source of dispute between claimants and decision‑makers.

4. Different legal effect of factors 5-9 (s10(2)): Factors 5-9 apply only to material contribution to or aggravation of periodontal abscess where the abscess was "suffered or contracted before or during (but did not arise out of) the person's relevant service" (s10(2)). If a claimant's periodontal abscess first arose out of service, those factors will not be available to show material contribution or aggravation. Advisers must therefore map the chronology of the condition precisely against the relevant service dates.

5. Undefined clinical milestones: The instrument uses terms such as "clinical onset" and "clinical worsening" without providing statutory definitions. Those concepts may be interpreted variably by clinicians and decision‑makers, producing uncertainty. For instance, "clinical worsening" may be read to require documented deterioration rather than patient report, and standards of proof for such deterioration are not specified.

6. "Foreign body" examples are illustrative not exhaustive (s9 notes): The note to s9 lists examples of foreign bodies (fingernails, corn husks, dental floss, shrapnel, calculus fragments, cement remnants and orthodontic separators). The list is not exhaustive, so other foreign bodies may qualify, but proving a foreign body was embedded at the time of clinical onset or worsening will require contemporaneous evidence or expert opinion.

7. Death linkage requires contribution to a terminal event (s7(3); Schedule 1): Death from periodontal abscess is included only where death followed a "terminal event or condition that was contributed to by the person's periodontal abscess" (s7(3)). Schedule 1 lists examples of terminal events (pneumonia, respiratory failure, cardiac arrest, circulatory failure, cessation of brain function). Establishing a causal contribution from a periodontal abscess to such terminal events is inherently complex and will require medico‑legal evidence linking oral infection to systemic or terminal pathophysiological processes.

8. Interaction with other SOPs may obligate additional evidentiary work (s11): If a listed factor refers to an injury or disease covered by another SOP, that other SOP’s factors apply. Practitioners must therefore identify overlapping SOPs and comply with their terms; failure to do so may result in missing applicable requirements.

9. Repeal of the 2013 SOP (s4): For claims bridging the two instruments, advisers must determine which SOP applies. The new instrument commenced on 4 April 2022 (s2). Claims decided earlier may have been assessed under the 2013 SOP; subsequent claims must be assessed under No. 25 of 2022. There may be transitional evidentiary issues for conditions with long natural histories.

10. Practical evidentiary burdens not spelled out in the instrument: The SOP sets the criteria but does not prescribe what documentary forms of evidence will or will not be accepted. Practitioners should not assume that informal attestations suffice; contemporaneous dental records, imaging, operative notes, and expert reports will be significantly more persuasive.

11. Absence of procedural guidance or definitions for "related to the relevant service" (s10(1)): Section 10(1) requires that any factor in s9 "must be related to the relevant service rendered by the person." The instrument does not define how that relationship is to be established or measured; consequently the determination may depend on broader statutory or administrative interpretation practices outside the instrument.

These "gotchas" emphasise that the instrument is highly technical, temporally prescriptive and reliant on precise clinical characterisation. Claimants and advisers must focus on contemporaneous documentation, carefully map chronology to service periods, obtain appropriate expert opinion where necessary and be alert to the definitional exclusions in s7(2).

Compliance in the context of this Statement of Principles means assembling and presenting the evidence necessary to establish that at least one of the factors in section 9 existed and that the factor was related to the person’s relevant service (s9; s10(1)). The steps below follow directly from the instrument’s text and specify the practical documentary and clinical evidence that will be needed to meet the SOP’s criteria.

1. Identify the operative SOP and claim pathway

• Confirm the claim is one "to which section 120A of the VEA or section 338 of the MRCA applies" (s5). Practically, ensure the claim is within the statutory categories that trigger application of Statements of Principles.

• Confirm which SOP applies to the claim date. This SOP commenced on 4 April 2022 and repealed the 2013 SOP (s2-s4). For claims lodged or assessed on or after commencement, use No. 25 of 2022.

2. Map the clinical diagnosis to the SOP definition

• Ensure the clinical diagnosis corresponds to the statutory definition: periodontal abscess is "a localised collection of pus within the periodontal tissue, adjacent to a periodontal pocket, that is associated with destruction of the bony and ligamentous tissues supporting the teeth" (s7(2)(a)). If the clinical diagnosis uses terms the SOP excludes (s7(2)(b)(i)-(v)), correct or supplement the diagnostic material.

• Obtain dental records, operative notes, imaging (dental radiographs), periodontal charting and specialist periodontal reports that explicitly confirm the location (periodontium adjacent to a periodontal pocket) and the presence of bony and ligamentous tissue destruction consistent with periodontal disease.

3. Establish at least one qualifying factor from section 9

• If relying on periodontitis (s9(1) or s9(5)), gather records demonstrating periodontitis at the affected site within the relevant six‑month window before clinical onset or clinical worsening. Useful documents include periodontal charting, periodontal probing depths, clinical notes, treatment plans and specialist assessments that date the periodontitis.

• If relying on a foreign body (s9(2) or s9(6)), obtain clinical or imaging evidence showing a foreign object was embedded in the periodontium at the time of clinical onset or worsening. Where the foreign body originated from non‑medical sources (for example fingernails or plant material), contemporaneous notes from treating clinicians, photographs and patient declarations supported by clinical signs will assist. If the foreign body is related to dental treatment (calculus fragments, cement remnants, orthodontic separators), dental procedural notes, itemised treatment records and images are critical.

• If relying on trauma (s9(3) or s9(7)), secure contemporaneous emergency department records, dental trauma reports, referral letters, radiographs indicating fracture, luxation or disruption of the periodontium. Schedule 1 defines "trauma to the affected region of the periodontium" to include fracture, luxation, loss or extraction of a tooth, or disruption or fracture of the periodontium (Schedule 1). Record the exact date of trauma to show it fell within the four‑week window.

• If relying on surgery (s9(4) or s9(8)), collect surgical operative notes, discharge summaries, post‑operative dental records and dates showing surgery occurred within four weeks before clinical onset or worsening.

• If relying on inability to obtain appropriate clinical management (s9(9)), prepare a narrative and documentary evidence demonstrating attempts to obtain treatment, barriers encountered (for example, lack of access to dental services in theatre, deployments, remoteness, or service‑related restrictions), contemporaneous correspondence refusing or delaying treatment, and clinical deterioration attributable to lack of timely treatment. The SOP does not define "appropriate clinical management", so detailed documentary context is necessary.

4. Demonstrate relation to relevant service and temporal constraints

• Link the identified factor to the person’s relevant service (s10(1)). Produce service records, deployment logs, medical evacuation records, dental treatment records generated during service and contemporaneous reports that show the factor occurred in the context of relevant service as defined in Schedule 1.

• Where relying on factors 5-9 (material contribution or aggravation), confirm that the periodontal abscess was "suffered or contracted before or during (but did not arise out of) the person's relevant service" (s10(2)). That requires pre‑service or in‑service evidence that the condition pre‑existed and was then aggravated or materially contributed to by a listed factor occurring in service.

5. For death claims, link to a terminal event

• For claims concerning death, obtain the death certificate, medical cause of death, hospital records, post‑mortem reports if any, and clinicians’ opinions that specify whether a terminal event listed in Schedule 1 (pneumonia, respiratory failure, cardiac arrest, circulatory failure, cessation of brain function) occurred and whether the periodontal abscess contributed to that terminal event (s7(3); Schedule 1).

• Seek expert medical opinion tying the oral pathology to systemic infection or to mechanisms by which periodontal infection materially contributed to the terminal event.

6. Address overlaps with other Statements of Principles

• If any factor refers to an injury or disease already covered by another SOP, identify and comply with that other SOP’s requirements because s11 makes that cross‑application explicit. Obtain documentation and expert opinions addressing the requirements of the other SOP, as they may impose additional conditions or evidence standards.

7. Prepare expert reports and clinical statements

• Where clinical issues are contested or complex (for example, whether a periodontal abscess contributed to pneumonia), obtain a written, dated expert report from an appropriately qualified clinician (periodontist, oral surgeon, infectious disease physician) that addresses the SOP’s factors and the standard of causation required by the claims process.

• Experts should address the timing (clinical onset, clinical worsening), the local pathology (periodontal tissue involvement, bony and ligamentous destruction), presence and nature of foreign bodies, and the plausibility of systemic contribution, linking each to the relevant service events.

8. Ensure contemporaneous and corroborative documentation

• Given the short time windows (four weeks for trauma/surgery, six months for periodontitis), contemporaneous documents are highly persuasive. When contemporaneous records are absent, assemble corroborative evidence: secondary medical records, witness statements, unit logs, photographs, or corroborating clinician notes.

9. Be precise about diagnosis labels

• Avoid relying on general or non‑specific dental diagnoses. If treating clinicians used terms excluded by the SOP (periapical abscess, periapical periodontitis, gingival abscess), request clarification or additional assessment to re‑classify and confirm whether the abscess met the SOP’s periodontal definition (s7(2)(b)).

10. Monitor SOP versioning and applicability

• Confirm the SOP in force at the relevant time and check for any later amendments or replacement SOPs that might affect claims, especially with respect to cross‑referenced SOPs (s11). The instrument replaced the 2013 SOP from 4 April 2022 (s2-s4), so post‑commencement claims should use No. 25 of 2022.

Practical checklist for advisers and claimants

• Service records establishing relevant service dates and categories (per Schedule 1).
• Full dental history and treatment records, including dates.
• Radiographs and periodontal charting showing bony/ligamentous involvement.
• Records of trauma, surgery or foreign body presence with specific dates.
• Evidence of attempts and barriers to obtain appropriate clinical management where relied upon.
• Expert medico‑legal reports tailored to the SOP’s factors and linking the factor to relevant service.
• For death claims, death certification and expert opinion linking periodontal abscess to a terminal event.

Following the steps above aligns evidential presentation with the instrument’s explicit requirements (s7-s11 and Schedule 1). Because the SOP prescribes precise temporal and clinical gates, thorough documentation and targeted expert opinion are the primary means of compliance.
