Statement of Principles concerning osteoarthritis (Balance of Probabilities) (No. 62 of 2017)

For death, s 7(5) treats osteoarthritis as including death from a terminal event or condition contributed to by osteoarthritis; terminal event is defined in the dictionary.

Fourth, the instrument defines crucial epidemiological and occupational thresholds in Schedule 1. Examples include being overweight defined as BMI of 25 or greater (Schedule 1 definition of being overweight and BMI), repetitive activities as at least 50 repetitions per hour, and trauma to the affected joint as a discrete event with symptom onset within 24 hours and persistence for at least seven days unless certain medical interventions occurred (Schedule 1 definition of trauma). Many of the occupational factors are expressed as cumulative exposures with precise numeric thresholds and look‑back windows: for upper limb repetitive tasks, an average of at least 100 hours per month for a cumulative period of at least ten years within a continuous 15‑year window, within the 25 years before clinical onset (s 9(12)); for lower limb lifting, a cumulative total of at least 150 000 kilograms within any ten year period (s 9(14)(b)).

Fifth, temporal conditioning and distinction between onset and worsening are built in. The factors are framed both in relation to clinical onset and clinical worsening (s 9 generally sets both sets), and subsections 9(24) to 9(47) apply only to material contribution to or aggravation of pre‑existing osteoarthritis where the osteoarthritis was suffered or contracted before or during relevant service (s 10(2)). Section 10(1) requires that any factor relied upon must be related to the person’s relevant service.

Finally, the instrument contains an interaction clause for overlapping SoPs: if a factor in s 9 refers to an injury or disease already covered by another SoP, then the other SoP applies according to its terms (s 11). Decision makers within DVA and tribunals are affected operationally because the SoP is the RMA’s medico‑scientific view used to determine causation on the balance of probabilities. The SoP does not itself award entitlements; it supplies a medico‑scientific template that DVA and review bodies apply under the VEA and MRCA statutory processes. Section 3 identifies the RMA as the authority under whose subsection 196B(3) the instrument is made.

Third parties such as insurers and workers‑compensation authorities are not mentioned in the instrument. The SoP does not purport to displace other compensation schemes; it confines application to VEA/MRCA claims. However, evidence gathered for VEA/MRCA claims (imaging, medical reports, employment records) will be the same evidence relevant to other schemes. The Schedule 1 definitions fix the technical thresholds on which clinicians and case managers will need to base opinions.

This SoP is not a statute imposing duties or conferring rights in the public law sense of criminal sanctions or private rights of action. Instead, its key operational duties and rights are administrative and evidentiary within the VEA/MRCA claims regime.

Duty of decision makers to apply the SoP. The instrument is made under the RMA’s statutory authority (s 3) and sets the RMA’s medico‑scientific view (s 8) and factors (s 9). While the SoP itself does not state the procedural duty of DVA or tribunals, its purpose is to be used by decision makers when assessing causation under the VEA and MRCA. Practically, decision makers have the obligation, arising from the statutory context, to consider the SoP when assessing whether osteoarthritis is connected with relevant service in the manner described at s 5. A claimant has the right, in the sense of entitlement to have the factors considered, to present evidence that at least one of the factors in s 9 existed and was related to their relevant service (s 10(1)). If a factor in s 9 refers to an injury or disease covered by another SoP, claimants can rely on the other SoP’s factors as they apply under s 11. Duty to relate factors to relevant service. Section 10(1) requires that any factor relied upon must be related to the person’s relevant service. Relevant service is defined in the Schedule 1 Dictionary and includes eligible war service, defence service as defined under the VEA (excluding hazardous and British nuclear test defence service, per the Schedule’s text), and peacetime service under the MRCA. Conditionality for aggravation or material contribution. Section 10(2) restricts application of subsections 9(24)-9(47) to claims for material contribution to, or aggravation of, osteoarthritis where the osteoarthritis was suffered or contracted before or during the person’s relevant service. This imposes the duty on claimants seeking compensation for aggravation to establish both the pre‑existence of osteoarthritis before or during service and a causal link between service and aggravation under the specified factors.

Right to have overlapping SoPs applied. Section 11 gives an administrative right to have another SoP applied where a factor refers to an injury or disease already covered by that other SoP. The Statement of Principles instrument contains no penal provisions and does not itself create enforcement powers or civil penalties. It is an administrative instrument that sets medico‑scientific criteria for establishing connection between osteoarthritis (including death from osteoarthritis) and relevant service for the purposes of VEA and MRCA claims (see s 5 and s 3). Section 3 records the statutory authority under subsection 196B(3) of the VEA. • The Schedule 1 definition of "joint of the upper limb" was also revised by the 2022 amendment (rs No. 77 of 2022), which has knock‑on effects for which joints certain exposure provisions apply to.

Because the instrument states the RMA’s medico‑scientific view and supplies specific technical thresholds (for example, cumulative lifting and cumulative hours criteria), expect that contested cases to the extent disputes arise will involve questions of fact: whether a specified factor existed, whether its timing meets the SoP’s temporal windows, whether the factor is related to relevant service as required by s 10(1), and whether pre‑existence or aggravation conditions under s 10(2) are satisfied. The SoP contains a number of technical traps and evidentiary pitfalls that materially affect claim outcomes. These gotchas are concrete and textually grounded.

1. Numeric and temporal thresholds are strict. Many occupational and exposure factors are expressed as precise cumulative totals and time windows. Examples include: upper limb repetitive tasks require an average of at least 100 hours per month for a cumulative period of at least ten years within a continuous 15‑year period, within 25 years before clinical onset (s 9(12)); lower limb lifting requires a cumulative total of at least 150 000 kilograms within any ten year period before clinical onset and within 25 years following that period (s 9(14)(b)); carrying loads requires at least 3 800 hours within any ten year period (s 9(14)(c)); kneeling or squatting requires at least one hour per day on more days than not for a continuous two year period before clinical onset for hip or knee osteoarthritis, and onset must occur within 25 years following that period (s 9(16)). These numeric tests are not expressed as flexible guidelines but as factors that must exist to establish causation on the balance of probabilities.

2. "On more days than not" phrase. Several provisions require exposure "on more days than not" for a continuous period (e.g. s 9(14)(d), s 9(16), s 9(37)(d)). That phrase imposes a quasi‑majoritarian frequency test across the relevant period and may be difficult to prove retrospectively without consistent records.

3. Traumatic event evidentiary specificity. The Schedule 1 definition of "trauma to the affected joint" requires (a) a discrete event with significant force; (b) development of symptoms and signs within 24 hours; and (c) persistence of symptoms and signs for at least seven days unless specific medical interventions occurred (Schedule 1). Where analgesia masked symptoms or unconsciousness occurred, symptoms must appear on return to consciousness or withdrawal of analgesic medication. This demands contemporaneous symptom records or immediate post‑event treatment records; retrospective assertions without documentation are vulnerable.

4. Distinction between onset and worsening. The instrument treats clinical onset and clinical worsening separately and provides parallel sets of factors for each (compare s 9(1)-(23) and s 9(24)-(47)). In addition, s 10(2) restricts application of s 9(24)-(47) to material contribution or aggravation where osteoarthritis pre‑existed before or during service. Practitioners must ensure they identify whether a claim is for initial onset or for aggravation; mixing the two will risk misapplication.

5. Definitions narrow which joints are covered. "Hand joint" excludes the radiocarpal joint (wrist joint) according to Schedule 1. "Joint of the upper limb" and "joint of the lower limb" are specifically enumerated. These definitional boundaries determine whether a particular exposure factor applies to a claimed joint. Post‑2022 amendments to the "joint of the upper limb" definition (Endnote 4) may have shifted applicability for some exposures.

6. BMI and waist circumference time windows. Being overweight is defined as BMI of 25 or greater (Schedule 1), and the instrument requires being overweight for at least ten years before clinical onset or worsening for certain joints (s 9(15) and 9(38)). Similarly, waist circumference thresholds (males >102 cm, females >88 cm) require ten years’ duration. Obtaining reliable retrospective anthropometric records spanning a decade is challenging; absence of records will make meeting these factors difficult.

7. Evidence difficulty for cumulative exposures. Cumulative lifting totals (150 000 kg over ten years), carrying hours (3 800 hours), ladder/stair counts (150 per day for five years) and tool usage "on more days than not" over ten years are all retrospective quantification problems. Employers and workplaces often do not keep the necessary logs. Expert occupational assessments will be required, but they are susceptible to contest on assumptions and methodology.

8. "Inability to obtain appropriate clinical management" as a factor. Subsection 9(47) includes inability to obtain appropriate clinical management for osteoarthritis as a factor for clinical worsening. This is an atypical non‑pathology factor that will require evidence of attempts to access care, referrals, availability issues, or system failures. The instrument does not specify the quantum of proof for this, leaving room for administrative interpretation.

9. Interaction with other SoPs. Where a s 9 factor refers to an injury or disease covered by another SoP, the other SoP applies in its terms (s 11). Practitioners must cross‑check other SoPs to avoid relying on an incorrect standard.

10. Version sensitivity. Amendments in 2019, 2020 and 2022 changed definitions and thresholds (Endnotes 3 and 4). Using an incorrect version of the SoP for a claim date or onset/worsening date can produce evidential mismatches. Always confirm the operative version.

11. "Related to relevant service" requirement. Section 10(1) requires that the existence of any factor in s 9 must be related to the person’s relevant service. Establishing temporal proximity, causal linkage and service nexus is a distinct evidentiary task separate from showing that a factor existed. Records showing the factor during non‑service civilian employment may not assist unless a service connection can be established.

12. Clinical diagnosis prerequisites. The definition of osteoarthritis in s 7(2) requires both clinical manifestations and osteophytes or loss of articular cartilage. Imaging or arthroscopy may be needed to meet the definitional test (s 7(2) note 2). Claims relying on symptoms alone without imaging documentation may be insufficient.

Each of these "gotchas" is rooted in and directly traceable to the statutory text of the SoP. Practitioners must therefore assemble documentary, clinical and expert evidence that aligns precisely with the enumerated thresholds, temporal windows and definitions if they are to meet the balance of probabilities test the RMA has articulated.

Compliance in this context means preparing and presenting an administrative claim under the VEA or MRCA for osteoarthritis (or death resulting from it) that satisfies the SoP’s medico‑scientific factors and the relation to relevant service required by s 10(1). 1. Identify which SoP factors are relevant to the claimed joint and whether the claim is for onset or for worsening/aggravation. Use s 9 to map the relevant subsection. If the claim alleges aggravation of pre‑existing osteoarthritis, confirm that the osteoarthritis was suffered or contracted before or during service as s 10(2) requires. If a s 9 factor refers to another SoP, obtain and use that other SoP as required by s 11.

2. Establish the clinical diagnosis in accordance with s 7(2). Ensure medical records document the clinical manifestations (pain, impaired function, stiffness) and imaging or arthroscopic findings showing osteophytes or loss of articular cartilage, as s 7(2) specifies. Where imaging is absent, arrange up‑to‑date radiology or specialist orthopaedic reports that directly address the subsection 7(2) elements.

3. For trauma or acute events, gather contemporaneous evidence. The Schedule 1 definition of "trauma to the affected joint" requires symptom onset within 24 hours and persistence for at least seven days unless certain interventions occurred. Collect ambulance, emergency department, general practitioner, hospital, surgical and physiotherapy records that document the event, symptoms, interventions and follow up.

4. For occupational/exposure factors, build a contemporaneous evidence base. The SoP requires precise cumulative figures and durations for many exposures (s 9(12), 9(13), 9(14)(b)-(c), 9(16), 9(37)(b)-(c), etc.). Obtain employment records, rostering data, duty statements, workplace logs, supervisor affidavits, pay‑time sheets, and any tools/equipment logs to document hours, frequency and loads. Where direct records do not exist, obtain detailed occupational histories from the claimant and corroboration from co‑workers or supervisors, and commission an occupational hygienist or ergonomist to produce a reasoned estimation that aligns with the SoP’s numeric thresholds.

5. Document anthropometric measures and duration. For claims relying on being overweight or waist circumference thresholds (s 9(15), 9(38)), seek clinic, GP, hospital or military medical records showing BMI or waist measurements over the requisite ten‑year period. If longitudinal records are absent, obtain a medical expert opinion addressing how historical BMI may be inferred from available medical notes, photographs or routine clinical entries, but recognise that retrospective inference will be contested.

6. Obtain specialist medical opinion that addresses both the SoP factors and the service nexus. The RMA’s SoP is medico‑scientific in nature, and decision makers will expect clear expert opinions that connect the listed factor to the joint in question, specify timing relative to clinical onset or worsening, and explain the causal relationship to the claimant’s relevant service. Experts should cite the SoP provisions they rely on (for example, s 9(14)(b) for lifting exposure) and demonstrate how the claimant’s documented exposures meet the specified thresholds.

7. For infection, inflammatory disease, depositional joint disease or necrosis, secure diagnostic records. Where a factor is a diagnosed systemic or joint disease (s 9(1), 9(2), 9(5), 9(11), etc.), provide pathology, microbiology, imaging, specialist notes and, if applicable, biopsy or arthroscopy reports that identify the condition and its timing relative to clinical onset.

8. Address "inability to obtain appropriate clinical management" with system evidence. If relying on s 9(47), provide evidence of attempts to access care, referral letters, appointment wait lists, correspondence with health services, or statements that describe service area limitations. The SoP does not quantify proof required, so contemporaneous records will strengthen the claim.

9. Pay attention to look‑back windows and latency. Many factors require exposures within 25 years before clinical onset or within specified periods after exposure (s 9). Prepare timelines that map service periods, exposure periods, clinical onset dates and any subsequent worsening. Where onset timing is disputed, collate diagnostic dates, first complaint dates and imaging dates to anchor the clinical onset assessment.

10. Prepare for cross‑SoP issues and version control. Ascertain which version of the SoP applied at the time of clinical onset or at lodgement of the claim. The endnotes list amendments; use the operative version for that claim’s dates (Endnotes 3 and 4). If a factor refers to another SoP, incorporate that instrument and conform to its standards per s 11.

11. Anticipate evidential gaps and use corroborative methods. Where exact records are missing, use multiple corroborating sources: witness statements from colleagues, supervisors and family; archived military unit logs; trade union records; and historic job descriptions. Explain methodology and margins of uncertainty in occupational expert reports so decision makers can assess whether the balance of probabilities test is satisfied.

12. Monitor administrative procedural steps. Lodge claims under the VEA or MRCA provisions referenced in s 5 and ensure all requested medicals, forms and authorisations are completed. Keep a record of document exchanges and DVA requests so that administrative compliance is demonstrable.

13. Consider staged expert strategy. Because the SoP sets specific factual thresholds, it can be efficient to commission a preliminary occupational or medical report to test whether the documented evidence is likely to meet the SoP thresholds before investing in more costly litigation‑grade expert reports.

14. Document service‑related nexus clearly. Section 10(1) requires the factor to be related to relevant service. Secure military service records, postings, incident reports, training logs and any contemporaneous health records that connect the factor to the claimant’s service history.

Following these steps aligns claim preparation with the SoP’s textual thresholds and definitions. The core compliance challenge is documentary proof tailored to the SoP’s precise numeric and temporal criteria; practitioners should plan evidence gathering and expert instruction to meet those requirements from the outset.
