Statement of Principles concerning morbid obesity (Balance of Probabilities) (No. 44 of 2022)

The instrument organises its law around a small set of medico‑legal concepts, each defined in the text or schedule and carrying a precise temporal requirement. The central legal concept is causation on the balance of probabilities: the RMA states that, on the sound medical‑scientific evidence available, it is "more probable than not" that morbid obesity and death from morbid obesity can be related to relevant service (s 8). The practical operation of that statement is implemented by enumerating factors which, if present and linked to service, are sufficient to establish the required causal connection (s 9).

Key definitional concepts:

• Morbid obesity: operationalised by BMI (Schedule 1: BMI = W/H2). For adults, morbid obesity is a BMI of at least 40; for persons aged 18 years or younger, the threshold is BMI at least 120 percent of the 97th percentile in the 2007 WHO BMI Charts for age and gender (s 7(2); Schedule 1). The SoP therefore ties the disease label to numerical anthropometric thresholds rather than symptom clusters.

• Clinical onset and clinical worsening: The factors in s 9 distinguish between those that precede "clinical onset" and those that precede "clinical worsening". The instrument does not provide separate definitions of "clinical onset" or "clinical worsening" in the Schedule; those terms therefore carry their ordinary medico‑legal meaning and create a potential interpretive question for assessors about the moment at which obesity becomes clinically manifest or worsens.

• Temporal thresholds for causative factors: Each factor in s 9 is given a minimum exposure or duration (for example, caloric excess for at least five years prior to clinical onset or worsening (s 9(1), 9(14)); specified drugs for at least six months prior to onset or worsening (s 9(2), 9(15)); antipsychotics for at least three months prior to onset or worsening excluding aripiprazole and ziprasidone (s 9(3), 9(16)); prednisone ≥5 mg/day or equivalent for at least three months (s 9(4), 9(17)); binge eating disorder or night eating syndrome for at least one year (s 9(5), 9(18)); clinically significant mental health disorder for at least three years (s 9(6), 9(19); Schedule 1 lists eligible diagnoses).

• Specified list of drugs and equivalents: The Schedule provides an enumerated list of drugs (which includes carbamazepine, gabapentin, insulin, lithium, several antidepressants, sulfonylureas, thiazolidinediones, tricyclics, valproic acid, and others). For glucocorticoids, the schedule specifies minimum average doses for several agents and allows therapeutically equivalent doses to be treated as meeting the prednisone ≥5 mg/day threshold (Schedule 1: equivalent glucocorticoid therapy).

• Sleep, shiftwork and smoking definitions: The Schedule specifies operational definitions for inability to sleep (average of more than five hours per night for at least five years; s 9(10), 9(23)), night shift work (work for at least three hours between midnight and 5am, with a threshold of at least 500 occasions within a continuous five‑year period; s 9(11), 9(24); Schedule 1), and regular smoking history (at least 5 pack‑years within a continuous five‑year period; s 9(12), 9(25); Schedule 1 defines pack‑year).

• Mental health and eating disorders: The Schedule imports diagnostic criteria from DSM‑5‑TR (2022) for binge eating disorder and night eating syndrome, and lists specific mental disorders considered "clinically significant" for the purposes of this SoP (Schedule 1).

• Relationship to service and interaction with other SoPs: The instrument requires that the existence of any factor in s 9 be related to the person's relevant service (s 10(1)). Where a factor references an injury or disease that is covered by another SoP, the other SoP applies in accordance with its terms (s 11).

• Death: "Death from morbid obesity" is treated as morbid obesity that includes death from a terminal event or condition that the obesity contributed to (s 7(3)); the Schedule lists examples of terminal events (for example, pneumonia, respiratory failure, cardiac arrest) which can be proximate or ultimate causes.

These concepts convert clinical features and exposures into discrete evidentiary triggers that feed into VEA/MRCA claim determination processes. The SoP’s structure focuses adjudicative clarity through quantified durations and enumerated lists, but it leaves to claim handlers, medical assessors and decision‑makers the task of linking those factors to "relevant service" and of interpreting clinical onset/worsening in ambiguous cases.

Primary affected populations

• Veterans and members of the Australian Defence Force lodging claims under the Veterans' Entitlements Act 1986 or the Military Rehabilitation and Compensation Act 2004. The instrument applies specifically to claims to which VEA s 120B or MRCA s 339 apply (s 5). In practice this covers persons asserting that their morbid obesity or death from morbid obesity is related to "relevant service" as defined (Schedule 1: relevant service).

• Surviving dependants or estate representatives making death claims where death is said to have been contributed to by morbid obesity, given that s 7(3) includes death from a terminal event contributed to by morbid obesity.

Secondary affected groups and decision actors

• Medical assessors and treating clinicians who provide evidence for claims. The SoP sets precise diagnostic criteria, drug exposure thresholds and durations, and diagnostic sources (for example, DSM‑5‑TR) which clinicians must follow if submitting medical evidence to support a claim (see s 9; Schedule 1).

• RMA and claims decision‑makers within the Department of Veterans' Affairs or other agencies that administer entitlements under the VEA/MRCA. The RMA’s SoP is a medico‑scientific instrument that assists decision‑makers to determine causal connection; it does not itself grant benefits but it shapes eligibility findings under the relevant Acts (see s 3, s 5, s 8).

• Employers and record‑holders: Units, personnel managers and employers who control rosters, leave and drug records will be indirectly affected because their records (rosters, medication dispensing, service diaries) will be necessary evidence to establish temporal exposure thresholds like night shift work of 500 occasions over at least five years (s 9(11), Schedule 1), or drug exposure over six months (s 9(2), s 9(15)).

• Administrators of medical services and rehabilitation access, because s 9(26) includes "inability to obtain appropriate clinical management for morbid obesity" as a factor for clinical worsening; proof requires documentation of attempts to obtain care and of systemic or access barriers.

Who pays and who decides

• The SoP itself does not set payments or new benefits; it provides the RMA’s view on medico‑scientific causation. Payments and compensation (if any) continue to be determined under the VEA and MRCA frameworks and the relevant claims processes. The RMA decides the SoP; claims decision‑makers apply the SoP to individual claims. The instrument mandates that factors must be related to "relevant service" (s 10(1)); establishing that nexus is for the claimant and medical evidence to show, and for the decision‑maker to adjudicate under the VEA/MRCA process.

Distributional effects and substitutions

• The instrument concentrates evidentiary benefit on claimants who can show one or more of the enumerated factors and the service nexus. Individuals who cannot document the threshold durations or who cannot prove connection to service will face greater evidentiary obstacles. People whose obesity arises out of service (as distinct from being suffered or contracted before or during service) are treated differently: subsections 9(14)-9(26) apply only where morbid obesity was suffered or contracted before or during but did not arise out of service (s 10(2)), so the legal pathway depends on the temporal and causal characterisation of the obesity relative to service.

Geographic and cohort impacts

• The instrument uses WHO paediatric charts and international drug lists; it applies uniformly to eligible claimants regardless of where they live, subject to the definitions and evidentiary standards in the Schedule. Claimants in remote areas may face practical difficulties meeting documentary thresholds for "inability to obtain appropriate clinical management" (s 9(26)), night shift exposure rosters (s 9(11), s 9(24)), or documented mental‑health management (Schedule 1 notes that management may involve regular visits such as at least monthly).

Duties imposed by the instrument

• Duty to establish a factor and link to service: A claimant seeking to establish that morbid obesity (or death from morbid obesity) is connected with relevant service must show the existence of at least one of the factors in s 9 and that the factor was related to the person’s relevant service (s 9, s 10(1)). The SoP sets concrete minimum durations and thresholds for exposures and conditions (for example, specified drugs for at least six months before clinical onset (s 9(2)); binge eating disorder for at least one year before onset (s 9(5))).

• Duty on medical experts to apply the SoP definitions: Clinicians and medical experts providing opinion evidence are required to use the definitions and thresholds in the Schedule when giving causation opinions, for instance applying DSM‑5‑TR criteria for binge eating disorder and night eating syndrome (Schedule 1) and using the specified glucocorticoid equivalent doses (Schedule 1: equivalent glucocorticoid therapy).

• Duty to consider other Statements of Principles: If a factor refers to an injury or disease covered by another SoP that has been determined under s 196B(3) VEA, that other SoP applies in accordance with its terms as in force from time to time (s 11). Decision‑makers must therefore cross‑check factors that reference other conditions against existing SoPs.

Rights under the instrument

• Right to rely on the SoP for causation: Claimants have the right to rely on this SoP as medico‑scientific evidence to support a finding of service connection for morbid obesity or death from morbid obesity, where the relevant statutory tests under the VEA or MRCA are met (s 5, s 8). The SoP provides determinative guidance on the RMA’s view of sound medical‑scientific evidence.

• Right to have factors assessed relative to service: The instrument requires that factors be "related to the relevant service rendered by the person" (s 10(1)). This establishes the claimant's procedural right to have a decision‑maker evaluate not just whether a factor existed, but whether that factor was linked to relevant service.

Operational consequences for decision‑makers and clinicians

• The SoP places a burden on decision‑makers to interpret clinical timing (onset vs worsening) and to evaluate documentary evidence for durations. For example, establishing 500 night shifts in a continuous five‑year period (s 9(11), Schedule 1: night shift work) requires examination of rosters, pay records or service diaries. Similarly, asserting inability to obtain appropriate clinical management (s 9(26)) requires corroborative evidence such as records of referrals, appointments, wait times, or service access denials.

• The Schedule clarifies measurement rules and thresholds (e.g., BMI = W/H2), which standardise what counts as "morbid obesity" for claims purposes. Where a factor overlaps with another numbered SoP, the decision‑maker must follow s 11 and apply the relevant SoP’s terms.

Limits and scope

• The instrument does not itself confer a presumption of entitlement; it supplies medico‑scientific criteria for establishing a connection to service. Rights and duties that govern entitlements, appeals and procedural remedies remain the subject of the VEA and MRCA and their adjudicative regimes. The SoP does not specify penalties, compensation quantum, or administrative appeal routes in this instrument.

The instrument is a medico‑scientific Statement of Principles and does not itself establish criminal offences, monetary penalties, or direct enforcement mechanisms. It is an evidentiary instrument to be applied within the VEA and MRCA decision frameworks. The following enforcement‑related features are set out or implied by the text.

Enforcement architecture

• RMA's legal authority: The RMA made the SoP under subsection 196B(3) of the VEA (s 3). That subsection is the statutory head of power for the RMA to determine Statements of Principles. Enforcement of entitlements, and any penalties for false claims, are matters governed by the VEA, MRCA and associated administrative processes; they are not introduced or modified by this instrument.

• Application in claims: The SoP applies to claims to which VEA s 120B or MRCA s 339 apply (s 5). Those provisions (not reproduced here) set out the adjudicative machinery for claims and therefore contain the mechanisms by which determinations using this SoP may be enforced or reversed.

Absence of punitive measures in the SoP

• No direct sanctions: There are no sanctions, fines or criminal penalties in this instrument for failing to meet the SoP’s factors, or for providing false evidence. The instrument does not change statutory penalties applicable elsewhere under the VEA or MRCA, nor does it create administrative penalties.

Practical enforcement implications for decision‑makers

• Evidentiary consequences: The SoP influences the evidentiary burden in claims. If a claimant can show one or more of the listed factors and link them to relevant service, decision‑makers are to treat that as satisfying the causal connection on the balance of probabilities (s 8, s 9). Conversely, absence of an enumerated factor (or a failure to prove the service nexus) leaves claimants to rely on other evidence or arguments under the VEA/MRCA.

• Administrative review and challenge: While this instrument does not itself provide appeal routes, any decision by a claims administrator that applies the SoP could be subject to the statutory review and appeal mechanisms under the VEA or MRCA. The SoP’s clarity on durations and definitions will therefore shape litigation or review strategies, but the SoP does not alter the procedural remedies available under the Acts.

Compliance burden as an enforcement cost

• Record and proof requirements: The practical "enforcement" cost is procedural: claimants, clinicians and record‑keepers need to assemble evidence that meets the SoP’s thresholds (for example, medication records showing dose and duration for glucocorticoids per the Schedule; rosters or pay records showing 500 night shifts; BMI values at specified times). Failing to provide such documentation is likely to produce an adverse evidentiary outcome in claims handling.

Implementation risk and discretionary assessment

• Interpretation discretion: Decision‑makers will exercise discretion when interpreting thresholds like "clinical onset" or "inability to obtain appropriate clinical management", and those discretionary decisions will affect outcomes. The SoP does not eliminate the need for judgement and does not specify an alternative dispute resolution path within its text.

In summary, the instrument itself imposes no criminal or civil penalties. Its enforcement effect is procedural and evidentiary: it shapes what evidence will support service connection for morbid obesity or death from morbid obesity when decision‑makers apply the VEA or MRCA.

Primary statutory linkage

• VEA and MRCA application: The instrument is explicitly tied to two statutes. It is made under s 196B(3) of the Veterans' Entitlements Act 1986 (s 3) and applies to claims to which VEA s 120B or MRCA s 339 apply (s 5). That means the SoP is an input into the statutory claims processes of those Acts rather than a freestanding source of entitlements.

Interplay with other Statements of Principles

• Cross‑reference rule: Section 11 provides a mandatory interaction rule. If a factor in this SoP refers to an injury or disease that is the subject of another SoP determined under s 196B(3) of the VEA, then the factors in that other SoP "apply in accordance with the terms of that Statement of Principles as in force from time to time" (s 11). Practically, where a listed factor overlaps with a condition covered by another SoP, decision‑makers must consult and apply that SoP’s content. The instrument therefore expects a patchwork of SoPs to be applied coherently and imposes a duty on assessors to identify and apply the correct SoP(s).

Interaction with veterans' entitlements law

• Evidence and causation under the Acts: The SoP provides medico‑scientific evidence to be relied on when determining service connection under the VEA/MRCA. It does not itself create new statutory rights or amend entitlements in the Acts. Decisions about compensation, rehabilitation, or other benefits remain within the statutory frameworks of the VEA and MRCA; the SoP is a specialised tool to inform causation assessments under those statutes (s 5).

Definitions relying on external clinical standards

• DSM‑5‑TR and WHO charts: The Schedule incorporates external clinical standards for diagnostic criteria (DSM‑5‑TR, 2022) and paediatric BMI charts (2007 WHO charts). Those references import internationally recognised clinical definitions into the legal instrument and require assessors to use those versions for diagnostic interpretation. Where other laws or instruments reference different editions or charts, this SoP’s explicit reference will govern the medico‑legal meaning of terms within this SoP.

No collision with criminal law or other regulatory regimes

• Containment to administrative claims: The SoP does not purport to alter criminal law, regulatory licencing regimes, workplace health and safety obligations, or workers' compensation law. Interaction with such regimes would occur only insofar as evidence or diagnoses relevant to a claim overlap (for example, medication histories, BMI records, or diagnoses used in multiple administrative processes), but the SoP itself does not change those other laws.

Relevance of prior SoP repeal

• Repeal of earlier instrument: This SoP repeals Statement of Principles concerning morbid obesity No. 6 of 2014 (s 4). The repeal replaces the earlier medico‑scientific view with the current instrument; decision‑makers must apply the 2022 SoP for claims governed by the cited application provisions. If other statutes or determinations were relying on the older SoP, the RMA’s repeal changes the medico‑scientific baseline for causation going forward.

Practical interaction issues

• Overlapping conditions and double‑counting: Because the Schedule’s specified factors include conditions that are themselves the subjects of other SoPs, there is a risk of overlapping causal pathways. Section 11 requires the application of the other SoP in such cases, which imposes a cross‑checking duty on adjudicators to avoid inappropriate double‑counting or contradictory causal attributions.

• Procedural and evidential coordination: Claimants, medical experts, and decision‑makers must coordinate evidence across regimes. For example, documentation assembled for workers’ compensation or third‑party claims may be used in VEA/MRCA claims, but decision‑makers will apply the thresholds and diagnostic standards set out in this SoP when making causation findings for veteran entitlements.

In sum, this instrument is an evidentiary and definitional layer that sits within the VEA/MRCA administrative framework, interacts mandatorily with other RMA Statements of Principles, and imports specific clinical standards that must be applied for the purposes of causation determinations under the applicable statutes.

The text of the instrument itself records a succinct amendment history and enactment information. Relevant items from the instrument are as follows.

• Instrument identification and date: The document is titled the Statement of Principles concerning morbid obesity (Balance of Probabilities) (No. 44 of 2022), dated 29 April 2022 (front matter and seal). It commenced on 30 May 2022 (s 2).

• Repeal of prior SoP: Section 4 expressly repeals the Statement of Principles concerning morbid obesity No. 6 of 2014 (Federal Register of Legislation No. F2014L00022), which had been made under subsections 196B(3) and (8) of the VEA. The 2014 instrument is thus superseded by this 2022 instrument for the contexts specified in s 5.

• Authority for changes: The RMA made this instrument using its statutory power under subsection 196B(3) of the VEA (s 3). That subsection is the source of the RMA’s power to determine Statements of Principles, and the instrument identifies itself as an exercise of that power.

• No subsequent amendments recorded in this text: The supplied text contains no further amendment notes, schedules of amendment, transitional provisions or saved provisions beyond the repeal in s 4. There is no indication within this instrument of staged commencement or sunset clauses beyond the single commencement date (s 2).

• Relationship to other in‑force SoPs: Section 11 requires that where a factor in this SoP refers to an injury or disease that is the subject of a different SoP, that other SoP "apply in accordance with the terms of that Statement of Principles as in force from time to time" (s 11). The "as in force from time to time" language means that future amendments to other SoPs will automatically be engaged when the cross‑referenced factors are relied upon; however, nothing in this instrument itself amends those other SoPs.

Implications for reconciliation of versions

• Supersession effect: By repealing the 2014 SoP, the 2022 instrument replaces the medico‑scientific criteria previously used to assess causation for morbid obesity claims under the RMA’s remit. Decision‑makers must apply the 2022 SoP for claims falling under the VEA/MRCA sections listed in s 5, subject to any transitional rules in the VEA/MRCA claims administration which are outside the text of this instrument.

• Version control and administrative practice: Practitioners and claim administrators need to track which SoP was in force at the time a claim or clinical onset/worsening occurred if there is any temporal dispute. Although the instrument gives a single commencement date, claims with events predating that commencement might still be viewed through the lens of the RMA’s current SoP depending on statutory application and administrative policy; that question, however, is governed by the VEA/MRCA and is not settled within this instrument.

No further legislative history (such as prior drafts, consultation statements or amendment logs) is included in the supplied text. The instrument therefore presents itself as the operative and current RMA SoP for morbid obesity as at the commencement date, replacing the 2014 version.

The supplied instrument contains no reported litigation, case citations or references to judicial decisions. It is an administrative determination by the Repatriation Medical Authority (s 3) and does not itself summarise any litigation history or precedent.

Potential litigation vectors suggested by the instrument

Although no cases are named in the text, the instrument’s structure identifies several areas that are likely to attract dispute and therefore potential litigation or merits review within the VEA/MRCA frameworks:

• Interpretation of "clinical onset" and "clinical worsening": The SoP uses these terms as temporal anchors for many factors (s 9). Because the instrument does not define "clinical onset" or "clinical worsening" in the Schedule, contested claims may hinge on expert evidence about when a service‑related clinical event became manifest or when a pre‑existing condition objectively worsened. Such disputes typically lead to contested medical opinion and could give rise to reviewable decisions.

• Application of temporal thresholds and evidentiary proof: Factors require demonstrable durations (for example, specified drugs for at least six months (s 9(2), s 9(15)); clinically significant mental disorder for at least three years (s 9(6), s 9(19))). Litigation is possible where documentary records are incomplete, where parties dispute recall evidence, or where decision‑makers require thresholds to be strictly satisfied.

• Night shift work threshold and proof: The night shift requirement,500 occasions within a continuous period of at least five years, each occasion defined as working at least three hours between 12 AM and 5 AM (s 9(11), s 9(24); Schedule 1: night shift work),is a discrete numerical test that will require roster and employment records. Disputes over what constitutes an "occasion", the continuity of the period, or roster reliability can produce litigation.

• "Inability to obtain appropriate clinical management": Section 9(26) introduces a potentially subjective factor. The evidentiary showing needed to prove "inability" (for example, systemic denial of care, geographical access barriers, or negligent service provision) may be litigated if decision‑makers require precise documentation of attempts to obtain care.

• Cross‑application with other SoPs under s 11: Where a factor in this SoP overlaps with conditions governed by another SoP, there may be legal argument about which SoP controls and how to reconcile potentially inconsistent thresholds.

• Use of external diagnostic standards: The instrument relies on DSM‑5‑TR for specific disorder criteria and on the 2007 WHO paediatric BMI charts (Schedule 1). Litigation can arise where parties dispute diagnostic application, edition choice, or the applicability of those standards to specific clinical presentations.

What the absence of litigation in the text means

• No cases listed: The instrument does not summarise or list case law. Practitioners should therefore treat the SoP as a current administrative instrument and expect that interpretation disputes will be addressed through the VEA/MRCA adjudicative processes and, if necessary, judicial review or merits review procedures available under those statutes. The instrument itself neither records past litigation nor limits future challenges to its content.

In short, although the instrument contains no litigation history, its content identifies predictable areas of contestation that practitioners should anticipate when preparing or defending claims.

The instrument contains many precise thresholds and cross‑references; these create practical pitfalls for claimants, clinicians and decision‑makers. The following are concrete, source‑grounded "gotchas" that professionals should watch for.

1. Clinical onset and clinical worsening are not defined

• The SoP repeatedly uses "clinical onset" and "clinical worsening" as temporal anchors for exposures and conditions (s 9). The Schedule does not define these phrases, so disputes may arise about the point at which obesity is "clinically" present or when a deterioration constitutes "worsening". Practitioners must anticipate evidentiary scrutiny of any opinion that pins a duration to "onset" or "worsening".

2. Different tests for pre‑existing vs arising‑out‑of‑service obesity

• Subsection 10(2) states that factors in s 9(14)-9(26) apply only to material contribution or aggravation where the morbid obesity was "suffered or contracted before or during (but did not arise out of) the person's relevant service". That is a nuanced distinction: if the obesity arose out of service, these aggravation factors do not apply. Claimants and advisers must explicitly determine whether the condition "arose out of" service or was present before/during service to know which parts of s 9 are engaged.

3. Antipsychotic exclusion list

• The SoP excludes aripiprazole and ziprasidone from the antipsychotic factor (s 9(3), s 9(16)). If an assessor or clinician treats all antipsychotics alike, they risk misapplying the SoP. Medication histories must identify specific antipsychotics and durations.

4. Specified drugs list and glucocorticoid equivalents

• The Schedule lists drugs that meet the "specified list" and provides precise minimum average doses for several glucocorticoids (Schedule 1: equivalent glucocorticoid therapy). Dosage calculations and equivalence judgments are a technical task; incorrect dose conversion or failure to document average daily dose over time can lead to rejection of a factor that would otherwise assist the claim.

5. Roster‑based numerical tests for night shift work

• Night shift work requires at least 500 occasions within a continuous period of at least five years, where an occasion is working at least three hours between midnight and 5 AM (s 9(11), s 9(23); Schedule 1). Partial or spotty roster records, informal shift swaps, or ambiguous timestamps can make it difficult to prove the element numerically. Decision‑makers may expect robust employment records.

6. Smoking cessation timing and pack‑year calculation

• The smoking cessation factor applies only to persons with a "prior history of a regular smoking habit as specified", defined as at least 5 pack‑years within a continuous 5‑year period (Schedule 1). The cessation must be "permanent" and within the two years before clinical onset or worsening (s 9(12), s 9(25)). Correct pack‑year calculations (Schedule 1) and corroborating evidence of cessation dates are required.

7. "Inability to obtain appropriate clinical management" is evidentially porous

• Section 9(26) lists inability to obtain appropriate clinical management for morbid obesity as a factor for clinical worsening, but the instrument provides no detailed test for what counts as "appropriate" or what documentation proves "inability". That absence creates risk: subjective or anecdotal evidence may be insufficient; decision‑makers may expect documented attempts to obtain care and records of denial/waiting times.

8. Children use a different BMI threshold

• For persons aged 18 years or younger, the BMI threshold is tied to 120 percent of the 97th percentile from the 2007 WHO BMI Charts (s 7(2)(b); Schedule 1). Using an incorrect chart year, percentile, or conversion will misstate whether a paediatric claimant meets the morbid obesity threshold.

9. Cross‑SoP dependencies

• If a factor refers to another injury or disease that is the subject of a different SoP, that other SoP applies (s 11). Practitioners must check for overlapping SoPs and apply the most relevant medico‑scientific regime to avoid inconsistent causation arguments.

10. DSM‑5‑TR reliance for psychiatric diagnoses

• The Schedule specifies DSM‑5‑TR (2022) for binge eating disorder and night eating syndrome diagnostic criteria. Using an older DSM edition or a different diagnostic framework without reconciling the differences may reduce the persuasiveness of an opinion.

11. Evidence of "ongoing management" for mental health disorders

• The Schedule notes that a clinically significant disorder of mental health must be of sufficient severity to warrant ongoing management, which may involve regular visits (for example, at least monthly) to a psychiatrist, counsellor or GP. Importantly, Note 2 states that warranting ongoing management does not require that actual management was received or given. This produces a factual subtlety: claimants who can show the disorder met the severity threshold but who did not receive treatment are not automatically excluded, but they still need credible evidence of severity.

12. Death causation requires showing contribution to terminal event

• "Death from morbid obesity" includes death from a terminal event or condition that the obesity contributed to (s 7(3); Schedule 1: terminal event). Proving contribution to a terminal event will require medical opinion linking morbid obesity to the proximate or ultimate cause of death.

In practice, these gotchas translate to heightened evidentiary preparation: exact drug names and doses over time, BMI calculations and historic measurements, rostering and service records, documented attempts to obtain care, and robust psychiatric assessments aligned with DSM‑5‑TR.

For practitioners advising claimants, clinical witnesses, or decision‑makers, compliance means aligning evidence and opinion with the specific thresholds, durations and definitions in the SoP. Below are concrete, source‑grounded steps and document types to gather and tasks to perform.

1. Establish the morbid obesity threshold

• Record measured BMI values with dates. Use the BMI formula prescribed (Schedule 1: BMI = W/H2). For adults, confirm BMI ≥ 40 (s 7(2)(a)). For claimants aged 18 years or younger, calculate BMI relative to the 2007 WHO BMI Charts for age and gender and show BMI is at least 120 percent of the 97th percentile (s 7(2)(b); Schedule 1). Ensure height and weight measurements are contemporaneous and recorded by health professionals where possible.

2. Document clinical onset and worsening timings

• Obtain medical records, GP notes, specialist letters, hospital discharges, and contemporaneous clinical entries that indicate when obesity became clinically manifest and when any documented worsening occurred. Although "clinical onset" and "clinical worsening" are not defined in the Schedule, decision‑makers will look for objective clinical notes (s 9).

3. Prove exposure durations for listed factors

• Caloric intake (s 9(1), s 9(14)): Collect dietary histories, dietitian notes, food diaries and weight trajectories demonstrating caloric excess over at least five years before clinical onset or worsening.

• Specified drugs (s 9(2), s 9(15)): Produce prescription records, dispensing histories, hospital medication charts showing one of the listed drugs was taken for the required minimum period (six months). Cross‑check drug names against the Schedule 1 list.

• Antipsychotics (s 9(3), s 9(16)): Provide medication records that specify the antipsychotic agent and duration. Note the explicit exclusion of aripiprazole and ziprasidone; identify exact agents.

• Glucocorticoid therapy (s 9(4), s 9(17)): Record dosage and duration; use the Schedule table for minimum average rates and therapeutic equivalence. Provide calculations of average daily dose across the relevant period.

• Eating disorders and mental‑health disorders (s 9(5), s 9(6), s 9(18), s 9(19); Schedule 1): Obtain psychiatric assessments evidencing DSM‑5‑TR diagnostic criteria for binge eating disorder and night eating syndrome and documentation showing the requisite durations (one year for eating disorders, three years for clinically significant mental disorders). Where treatment was not received, secure records or affidavits establishing symptom severity sufficient to "warrant ongoing management" (Schedule 1 notes).

• Cushing syndrome, hypothyroidism, hypothalamic disorder (s 9(7), s 9(8), s 9(9) etc): Provide endocrinology notes, lab results (e.g., TSH, cortisol tests), imaging, surgical histories or radiation records that document the condition and the timing relative to clinical onset/worsening.

4. Address sleep, shiftwork and smoking factors

• Sleep (s 9(10), s 9(23)): Collate sleep histories, polysomnography or specialist sleep clinic reports showing average sleep less than or equal to five hours per night over the required five‑year period prior to onset/worsening. Where polysomnography is absent, contemporaneous clinical notes and sleep diaries may be used.

• Night shift work (s 9(11), s 9(24); Schedule 1): Assemble rosters, payroll records, service diaries, employer statements, or statutory declarations demonstrating at least 500 occasions of working at least three hours between midnight and 5 AM within a continuous period of at least five years.

• Smoking history and cessation (s 9(12), s 9(25); Schedule 1): Calculate pack‑years per the Schedule 1 method and document the smoking pattern to show at least 5 pack‑years within a continuous five‑year period. Validate permanent cessation with medical records, GP notes or cessation program records, and confirm the cessation occurred within two years before onset/worsening.

5. Evidence inability to obtain appropriate clinical management

• For s 9(26), document attempts to access care: referrals, appointment letters, waitlist correspondence, correspondence with health services, evidence of service unavailability in location or financial barriers. Provide chronology showing how failure to obtain care aligns with the timing of clinical worsening.

6. Link factors to "relevant service"

• Provide service records, deployment histories, tasking documents, medical records from service time, employer statements and any contemporaneous notes that link an enumerated factor to relevant service. Section 10(1) requires that the existence of any factor must be related to the person's relevant service; the link must be evidenced.

7. Where factors reference other SoPs, identify and apply them

• If a factor refers to a condition already covered by another RMA SoP, obtain and apply that SoP as required by s 11. For example, if Cushing syndrome or a psychiatric disorder is the subject of another SoP, include the relevant SoP and align diagnostic evidence with its terms.

8. Use correct clinical standards and editions

• For psychiatric diagnoses and criteria for binge eating and night eating syndromes, ensure assessments explicitly reference DSM‑5‑TR diagnostic criteria as the instrument specifies the 2022 text revision (Schedule 1). For paediatric BMI, use the 2007 WHO Charts as required (s 7(2)(b)).

9. Prepare expert medico‑legal opinions that map facts to SoP tests

• Experts should be instructed to address the SoP explicitly: identify which s 9 factor(s) are relied upon, explain how the diagnostic criteria (DSM‑5‑TR where applicable) are met, calculate and state relevant durations, and opine on the causal link between the factor and morbid obesity with reference to "balance of probabilities" reasoning per s 8.

10. Assemble a coherent evidence bundle

• Produce a chronological indexed bundle including: service records, roster/pay records, medical records (weight/height measures, lab tests), prescription and dispensing histories, psychiatric/specialist reports tied to DSM‑5‑TR where applicable, evidence of efforts to obtain care, and expert reports that apply the SoP conclusively.

11. Anticipate cross‑checks and documentary precision

• Because the SoP sets precise numeric thresholds, be prepared for strict assessment. Small discrepancies (for example, medication duration of five months when six months is required, or a BMI calculation slightly under 40) are likely to be decisive. Where uncertain, aim to obtain corroborative documentary sources or expert evidence that addresses borderline cases.

12. Record keeping and witness statements

• If documents are scarce, collect statutory declarations from supervisors, colleagues, family members or clinicians to corroborate exposure histories (shift counts, smoking patterns, caloric intake patterns). However, be aware that documentary evidence will generally carry more weight.

Following these steps aligns evidence and medical opinion with the explicit requirements of the SoP (s 7, s 9, Schedule 1) and provides the best practical method of demonstrating service connection for morbid obesity or death from morbid obesity in claims under the VEA and MRCA.
