Statement of Principles concerning malignant neoplasm of the urethra (Balance of Probabilities) (No. 20 of 2025)

This SoP organises the medical‑causation question into definitional scope, a closed set of qualifying factors, and rules about how those factors relate to relevant service. The instrument’s main concepts are:

• Disease definition and scope: “malignant neoplasm of the urethra” is defined by histogenetic origin (primary epithelial cell neoplasm in the urethra) and by an enumerated list of included and excluded tumour types (s 7(2)). The instrument displaces reliance on ICD codes alone by stating that, although the condition attracts ICD‑10‑AM codes C68.0 and C68.1, the meaning for application is the textual definition (s 7(3)-(4)). This separates coding practice from eligibility: coding can inform but does not supplant the statutory meaning.

• Causation standard: the decision standard is the balance of probabilities. The Authority states that “on the sound medical‑scientific evidence available” it is “more probable than not” that the condition can be related to relevant service (s 8). This phrase frames the SoP as identifying factors that, if established, satisfy the civil standard of proof for connection.

• Closed set of qualifying factors: section 9 lists four disjunctive factors, at least one of which must exist to establish a connection on the balance of probabilities. The factors are (1) HPV types 16 or 18 infection before clinical onset, but limited to squamous or mixed squamous/urothelial carcinomas; (2) a cumulative equivalent ionising radiation dose of at least 0.5 sieverts to the affected site, with a latency of at least 10 years; (3) presence of a urethral diverticulum at the time of clinical onset; and (4) inability to obtain appropriate clinical management for the urethral malignancy before clinical worsening (s 9(1)-(4)). The SoP therefore moves away from open‑ended “could contribute” language and towards a defined set of medical antecedents.

• Exposure quantification: the Schedule defines cumulative equivalent dose (Schedule 1). It specifies that the calculation allows for combination of different ionising radiation types by accounting for differing biological effect, uses sievert as the unit, excludes normal background radiation, and includes therapeutic, diagnostic, cosmic at high altitude, occupation‑related sources and radiation from nuclear explosions or accidents. That definition creates a technical evidentiary requirement when radiation is asserted (Schedule 1).

• Temporal linkage and limitation: the radiation factor requires that the exposure be at least 10 years before clinical onset (s 9(2)). Section 10(2) limits the operation of factor 9(4) (inability to obtain appropriate clinical management) to circumstances where the malignant neoplasm was suffered or contracted before or during, but did not arise out of, the relevant service; in those cases the factor can only apply to material contribution or aggravation. Section 10(1) generally requires any factor relied upon to be related to the person’s relevant service.

• Death linkage: death from malignant neoplasm of the urethra is included if the terminal event or condition was contributed to by the person’s urethral malignancy; terminal event is defined to include specified proximate causes of death such as pneumonia, respiratory failure, cardiac arrest, circulatory failure or cessation of brain function (s 7(5); Schedule 1).

• Cross‑SoP dependence: where a factor refers to an injury or disease covered by another Statement of Principles, that other SoP’s factors apply in accordance with its own terms “as in force from time to time” (s 11). This creates an integrated system of SoPs for overlapping medical conditions.

Collectively, these concepts convert a clinical causation problem into a checklist of medically specified antecedents and measurements that decision‑makers must assess and relate to relevant service. The Schedule’s measurement and exposure definitions are technical and will require dosimetric and infectious disease evidence where those factors are contested.

The instrument identifies and affects several categories of parties through its application and through the practical implications of its factor‑based test.

Primary claimants: Veterans, members of the Forces and members covered by the MRCA who submit claims under section 120B of the VEA or section 339 of the MRCA are the persons to whom this SoP directly applies (s 5). For any such claimant alleging malignant neoplasm of the urethra or death from it, the decision‑maker must apply the SoP to determine whether the condition is connected with relevant service.

Decision‑makers and adjudicators: Those administering and deciding claims under the VEA and MRCA must use the SoP’s definitions and factors to determine causation. The instrument is expressly made under subsection 196B(3) of the VEA by the Repatriation Medical Authority (s 3 and front material), which indicates the Authority’s role in formulating the medical criteria; the SoP then functions as the medical standard that statutory decision‑makers apply.

Medical practitioners and experts: The SoP’s factors require medical evidence of infection with specific HPV types (16 or 18) in particular histological subsets of tumour (s 9(1)); dosimetric calculation of cumulative equivalent radiation dose to a particular organ or tissue with certain inclusions and exclusions (Schedule 1); demonstration of urethral diverticulum at clinical onset (s 9(3)); and evidence regarding inability to obtain appropriate clinical management (s 9(4)). Treating clinicians and medico‑legal experts will therefore be tasked with producing and interpreting pathology, virology, radiological, surgical and health‑services access evidence to meet the SoP’s requirements.

Claims advocates and legal advisers: Lawyers, advocates and representative bodies advising claimants must frame evidentiary strategies around the discrete factors. For example, establishing HPV 16/18 infection or assembling dosimetry evidence will be central if those factors are relied upon. The instrument’s explicit exclusions also shape case selection: tumours otherwise coded to ICD‑10 that fall within the SoP’s exclusions will not qualify as “malignant neoplasm of the urethra” for these purposes (s 7(2)(c)).

Record‑holders and institutions: Entities that hold radiotherapy records, diagnostic imaging, pathology and surgical notes (including hospitals, treating clinics, defence medical services, and occupational health records if radiation exposure at work is alleged) will be sources of evidence. The Schedule’s inclusion of occupational sources and cosmic radiation at high altitude as components of cumulative equivalent dose (Schedule 1) potentially brings aviation service records and occupational exposure records into relevance.

Other Statement of Principles: Where a factor in this SoP “refers to an injury or disease covered by another Statement of Principles,” the factors in that other SoP apply as in force from time to time (s 11). Therefore, claimants whose cases involve overlapping conditions (for example, another radiation‑related disease) will be affected by the interplay between SoPs.

The instrument therefore concentrates effects on claimants and those who assemble or decide evidence for claims under the VEA and MRCA, and imposes identifiable evidentiary demands on clinicians and record‑holders. It does not alter substantive entitlements in the statutes; rather, it prescribes the medical criteria used to determine whether the statutory causal connection exists for the specified condition.

This Statement of Principles creates a framework of evidentiary duties for establishing a service connection for malignant neoplasm of the urethra. It does not itself create benefits or penalties; rather, it prescribes the medical criteria that must be met for a decision under the VEA or MRCA to find the condition connected with relevant service.

Duty to establish at least one qualifying factor: Before it can be said that, on the balance of probabilities, malignant neoplasm of the urethra or death from it is connected with the circumstances of relevant service, at least one of the factors listed in section 9 must exist (s 9). That imposes an evidentiary duty on claimants to prove one or more of those factors in support of causation.

Duty to show relation of factor to relevant service: Section 10(1) requires that any factor relied upon “must be related to the relevant service rendered by the person.” The Schedule defines “relevant service” to include eligible war service (other than operational service), defence service (other than hazardous service and British nuclear test defence service) under the VEA, or peacetime service under the MRCA (Schedule 1). Claimants therefore must not only prove a qualifying factor but must also demonstrate how that factor arose in the course of the defined relevant service. The instrument does not specify the precise kinds of evidence sufficient to prove that relation; the statutory decision‑maker will need to determine whether the available evidence links the factor to relevant service.

Limitation on application of the management‑access factor: Section 10(2) restricts the operation of factor 9(4) (inability to obtain appropriate clinical management) to cases where the malignant neoplasm was “suffered or contracted before or during (but did not arise out of) the person's relevant service.” In such circumstances, the inability to obtain appropriate clinical management can only be considered as contributing to material contribution or aggravation of the condition. This limits the scope and effect of the management‑access factor and creates a temporal constraint on when that factor can be relied upon to establish connection.

Right to have death considered where contributed to by the condition: Where death resulted from a terminal event or condition that was contributed to by the person's malignant neoplasm of the urethra, death is included for purposes of the SoP (s 7(5)). The Schedule defines “terminal event” with a list of proximate causes (Schedule 1). Thus, beneficiaries asserting death related to the urethral malignancy have the right to have that causal contribution assessed under the same factors.

Duty to apply cross‑SoP factors where applicable: Section 11 requires that, if a factor in section 9 refers to an injury or disease already covered by another SoP, the factors in that other SoP apply according to its terms “as in force from time to time.” This creates a duty for decision‑makers to consult and apply the relevant criteria in other SoPs where factors overlap.

Obligation to use the instrument’s definitions: The Schedule provides specific technical definitions (for example, cumulative equivalent dose) which must be used when determining whether a radiation exposure meets the threshold (Schedule 1). Decision‑makers and experts must therefore apply those definitions rather than alternative metrics or informal measures.

Notice and temporal obligations: While the SoP itself does not prescribe procedural steps for claim filing or timelines, it will be applied in decisions under statutory provisions that do. The SoP therefore operates as a substantive test that intersects with procedural duties in the VEA and MRCA decision frameworks.

The instrument thus shifts the party‑facing duties to proving defined medical factors and their service linkages, and it creates rights for claimants to have death and overlapping conditions assessed under the SoP and other relevant SoPs. The SoP does not itself set procedural rights or remedies beyond these substantive evidentiary requirements.

The Statement of Principles is not a penal instrument and contains no criminal sanctions, fines or enforcement provisions within its text. It is a medical‑criteria instrument made under subsection 196B(3) of the Veterans' Entitlements Act 1986 and designed to be applied in the administrative decision‑making process for claims under the VEA and the MRCA (s 3, s 5). Accordingly, enforcement operates through administrative application rather than through penalties embedded in the SoP.

How enforcement functions in practice: The SoP’s enforcement mechanism is implicit and operational. Decision‑makers who determine claims under section 120B of the VEA or section 339 of the MRCA are required to use the SoP when assessing whether the condition in question is connected with relevant service. If the claimant cannot establish one or more of the specified factors, then, on the basis of this SoP, a decision‑maker may decide that the requisite causal connection is not established. Conversely, where the SoP’s factor(s) are established and related to relevant service, the decision‑maker can accept service connection. The instrument therefore enables administrative acceptance or rejection of claims based on its medical criteria.

No administrative penalty or compliance enforcement mechanisms: The instrument does not create independent civil penalty powers, enforcement notices or compliance orders. It does not state any powers to compel production of records or to sanction non‑compliance by third parties. Any such powers would come from the statutes under which claims are processed (VEA or MRCA) or from administrative processes external to this SoP; the SoP itself is silent on those procedural enforcement mechanisms.

Role of the Repatriation Medical Authority: The Authority made the SoP (s 3) and sets the medical standard. The SoP functions as technical guidance with binding effect on causation questions where the statutory decision‑maker is required to apply the VEA or MRCA provisions that refer to SoPs. Enforcement in the sense of ensuring consistent medical standards therefore rests with the application of the SoP by decision‑makers, and with any statutory review avenues available under the VEA and MRCA for adverse claim decisions. The text of the SoP does not alter those statutory review mechanisms, nor does it describe them.

Administrative discretion and legal challenge: While the SoP constrains medical causation decisions by prescribing factors, the instrument leaves factual questions open to the decision‑maker’s assessment of evidence. If a decision is made contrary to the SoP’s factors, or is inconsistent with the statutory test, judicial or administrative review procedures available under the VEA or MRCA and related administrative law principles would be the route for challenge. The SoP itself contains no enforcement or penalty apparatus; its practical effect is exercised through claim decision outcomes.

The Statement of Principles is expressly made under the VEA (s 3) and applies to claims to which section 120B of the VEA or section 339 of the MRCA applies (s 5). The instrument therefore operates within the statutory framework of those Acts and is intended to be used by decision‑makers applying those provisions. Several specific interaction points appear in the text.

Primary statutory interaction: The SoP draws its authority from subsection 196B(3) of the VEA (s 3). It does not itself amend the VEA or MRCA; rather it supplies the medical criteria that decision‑makers must apply under sections of those Acts that refer to Statements of Principles. The SoP therefore functions as a subordinate instrument implementing the statutory requirement that certain medical causation matters be determined by the Repatriation Medical Authority and applied in claims assessment.

Cross‑reference to other Statements of Principles: Section 11 provides that if a factor in this SoP “refers to an injury or disease in respect of which a Statement of Principles has been determined under subsection 196B(3) of the VEA,” then the factors in that other SoP apply “in accordance with the terms of that Statement of Principles as in force from time to time.” Practically, this means the SoP does not operate in isolation where its factors overlap with other medically related conditions; the relevant SoP regime will apply as it stands. This creates a networked system in which multiple SoPs can interact and the most recent relevant SoP provisions govern their subject matter.

ICD coding versus statutory meaning: Section 7(3)-(4) clarifies that although malignant neoplasm of the urethra attracts ICD‑10‑AM codes C68.0 and C68.1, the meaning of the condition for this instrument is that given in subsection 7(2). The instrument therefore displaces reliance on code alone, instructing decision‑makers to use the textual definition. The ICD reference is specifically to the Australian modification (ICD‑10‑AM, Tenth Edition, effective 1 July 2017) and is described as copyrighted material (s 7(3)-(4)). This interaction affects how medical coding is used in claims: coding informs but does not determine whether the SoP’s definition is met.

Definitions that affect other statutory concepts: The Schedule’s definition of “relevant service” (Schedule 1) ties the operation of the SoP to particular categories of service under the VEA and MRCA. Because the SoP requires factors to be related to relevant service (s 10(1)), it integrates with the statutory definitions and eligibility criteria of those Acts. The Schedule’s radiation definition (cumulative equivalent dose) sets technical measurement parameters that must be applied when radiation exposure is asserted. These definitions will interact with statutory and regulatory arrangements governing occupational exposure records, defence service records and health records.

No conflict or displacement of statutory rights: The SoP does not purport to limit or expand rights under the VEA or MRCA beyond providing the medical test for causation. It also does not purport to change procedural rights, review rights or other statutory mechanisms. Where an overlap arises with other SoPs, section 11 requires application of those other SoPs “as in force from time to time,” which preserves the precedence and currency of other instruments within the statutory SoP system.

Copyrighted material use: The instrument references and relies on an external copyrighted resource (ICD‑10‑AM) for coding identifications (s 7(3)). The SoP makes clear that reference is to the code assigned in that edition, but stresses the statutory definition is as provided in the text. This limits reliance on the ICD publication as a determinative tool and avoids importing that publication’s legal status into the SoP’s substantive definition.

In short, the SoP is an internally consistent subordinate instrument that must be applied in claims under the VEA and MRCA, interacts with other SoPs via cross‑reference rules, and requires decision‑makers to use its own definitions rather than external coding as the determinative meaning of the disease.

This instrument records a direct amendment to the statutory SoP framework by repeal and replacement. It expressly repeals the earlier Statement of Principles concerning malignant neoplasm of the urethra (Balance of Probabilities) (No. 50 of 2016), Federal Register of Legislation No. F2016L00581 (s 4). The new instrument is dated 18 February 2025 and commences on 25 March 2025 (front material and s 2). The body of the SoP does not itself list prior amendments beyond the repeal line; it functions as a replacement instrument.

Consequences of the repeal: Because the instrument repeals the 2016 SoP, the 2016 criteria cease to apply from the date this instrument commences (s 4; s 2 commencement). Decision‑makers assessing claims that span the repeal date will need to determine which instrument applies , the text of the VEA and MRCA and their procedural rules will govern retrospective or transitional questions. The instrument itself does not set out transitional provisions: it simply states repeal. Therefore, the practical effect is that, on and after commencement, the 2025 SoP is the operative Statement of Principles for the named condition, and the 2016 SoP no longer has force.

Updates by the Repatriation Medical Authority: The SoP is made under subsection 196B(3) of the VEA (s 3), which is the statutory mechanism by which the Authority determines medical causation criteria. The text in s 11 contemplates that other SoPs may be “in force from time to time,” implying that the Authority may revise SoPs and that such revisions will affect cross‑referenced applications. The instrument itself, as a determined SoP document, establishes the current 2025 standard; any future amendments would appear as subsequent SoPs or amendments under the Authority’s statutory power.

No amendment schedule or sunset: The instrument contains no express expiry date or periodic review schedule. It becomes the operative SoP on commencement and remains in force until repealed or superseded by a later instrument. The absence of express internal amendment or review provisions means future changes will be effected by replacement or repeal under the same statutory mechanism.

Record and identification: The repealed instrument is identified by Federal Register number F2016L00581. The 2025 instrument is identified in the heading as No. 20 of 2025. For audit or legal tracing, these identifiers and dates (18 February 2025 sign‑date and 25 March 2025 commencement) are the markers to determine which SoP applied at any point in time.

In sum, the amendment history is a single explicit repeal and replacement: the 2016 SoP is repealed and replaced by the 2025 SoP, which becomes operative from its commencement date, with no transitional text included in the instrument.

The instrument contains no references to judicial or administrative decisions, and it does not recite any litigation history relevant to its content or application. It is a standalone Statement of Principles made by the Repatriation Medical Authority under subsection 196B(3) of the VEA and does not cite cases, decisions or reviews as part of its preamble or explanatory material.

Implications of absence of litigation references: Because the SoP does not reference any litigation or precedent, its content should be treated as the Authority’s medical determination based on the “sound medical‑scientific evidence available” at the time of determination (s 8). That phrase indicates the Authority’s evidential basis for the causation conclusions, but the instrument does not disclose the evidence relied on, nor does it record any legal contest or judicial treatment of its earlier or current terms.

Potential for judicial engagement: Although the SoP itself contains no litigation history, decisions applying the SoP in individual claims remain reviewable under the administrative and judicial review mechanisms that govern decisions under the VEA and MRCA. Any litigation that arises will be from claim decisions that apply or misapply the SoP, rather than from the SoP instrument itself. The instrument does not restrict access to review avenues; it sets substantive medical criteria which may subsequently be the subject of legal challenge if applied in ways alleged to be unlawful, irrational or unsupported by evidence in a particular case. The text gives no guidance on precedential weight or prior judicial comments.

No named cases: The SoP does not name or cite any cases. If practitioners require a litigation history or precedent regarding similar SoPs or the RMA’s determinations, that information is not contained in this instrument and would need to be obtained from case law databases or administrative law records outside the SoP.

Because the instrument contains no litigation history, users should not infer the absence of legal controversy about its topics; rather the instrument itself merely does not document any such litigation. Any litigated issues concerning the interpretation or application of the SoP would arise after implementation and be recorded in judicial or administrative decisions external to the text.

The instrument contains a number of technical and practical features that can catch applicants and advisers if not noticed. The following points are grounded in the SoP text and the Schedule definitions.

Disease definition trumps ICD coding: The SoP explicitly states that, while the condition attracts ICD‑10‑AM codes C68.0 and C68.1, the meaning of “malignant neoplasm of the urethra” for the instrument is the textual definition in subsection 7(2) (s 7(3)-(4)). Thus, a claimant whose medical coding uses C68.0/C68.1 cannot assume that the statutory definition is met; excluded tumour types listed in s 7(2)(c) are not covered, even if coded as urethral. Practitioners must read the histopathology and site information against the SoP’s included/excluded list.

HPV factor limited by tumour histology: The HPV factor in s 9(1) applies only for “squamous cell or mixed squamous and urothelial cell carcinomas.” Claimants with other histological types, even if HPV infection is present, cannot rely on s 9(1). This is a narrow application tied to established HPV oncogenic roles in squamous histology.

Radiation metric technicalities: The radiation factor requires a cumulative equivalent dose of at least 0.5 sieverts to the affected site, and exposure must be at least 10 years before clinical onset (s 9(2)). The Schedule’s definition of cumulative equivalent dose is technical: it combines different radiation types by accounting for differing biological effect, uses sievert units, excludes normal background radiation, and includes therapeutic, diagnostic, cosmic at high altitude, occupation‑related sources and nuclear explosions/accidents (Schedule 1). This produces several practical pitfalls:

• Evidence must quantify dose specifically to the affected organ/tissue rather than whole‑body proxies.
• Background radiation is excluded; care is needed to separate occupational and diagnostic contributions from ambient exposure.
• The list of included sources is broad (therapeutic, diagnostic, cosmic at altitude and occupational, etc.), so assembling evidence may require non‑medical records (e.g., service aviation logs for cosmic exposure at altitude, or occupational exposure records).
• The combination formula is unspecified in the SoP text; technical experts will need to apply accepted dosimetric methods consistent with the Schedule’s description.

Temporal requirement for radiation: The 10‑year latency requirement means recent radiation exposure cannot support a connection under s 9(2). Clinical onset timing therefore becomes critical; onset must be dated to determine whether the radiation falls on the right side of the latency threshold.

Urethral diverticulum timing and causation: The SoP requires the presence of a urethral diverticulum at the time of clinical onset (s 9(3)). Practically, documentation demonstrating a diverticulum at or before onset is needed (imaging, surgical notes). The instrument’s explanatory note describes possible causes of diverticulum (infection of periurethral glands, trauma during vaginal delivery, dilatation or catheterisation, history of vaginal/urethral surgery), but the SoP itself requires presence at onset, not proof of causal mechanism. Advisers should ensure records show the diverticulum’s existence contemporaneously with onset.

Inability to obtain appropriate clinical management limited in scope: The inability to obtain appropriate clinical management (s 9(4)) is a factor, but section 10(2) confines its operation: it may only apply to material contribution or aggravation where the malignant neoplasm was suffered or contracted before or during, but did not arise out of, the person’s relevant service. That nuanced temporal restriction may limit the factor’s utility for many claimants and requires careful pleading and evidence about when the condition was first suffered/contracted relative to service.

Burden of proof and evidence types unspecified: The SoP requires that “at least one” factor exists, but it does not prescribe the kinds of evidence that suffice. For example, it does not say whether serology, tissue PCR or archived pathology will satisfy the HPV factor, or what proof suffices for inability to obtain appropriate clinical management. Decision‑makers must therefore evaluate the sufficiency of evidence on a case‑by‑case basis, creating uncertainty for claimants who may need to procure specialist testing or historical records.

Cross‑SoP dependencies: If a factor refers to another injury/disease covered by a different SoP, the other SoP’s factors apply as in force from time to time (s 11). This can complicate claims that straddle multiple medical issues, because a change in a separate SoP could alter the availability of that factor.

Death and terminal event linkage: Death is included only where the terminal event or condition was contributed to by the malignant neoplasm (s 7(5)). The Schedule’s definition of “terminal event” is specific and enumerative (pneumonia, respiratory failure, cardiac arrest, circulatory failure, cessation of brain function). Where death certificates record other proximate causes, careful causal analysis tying back to the urethral malignancy will be necessary.

No procedural or evidentiary guidance: The SoP supplies substantive medical thresholds but does not provide procedural details on how to assemble or present evidence, timelines for re‑examination, or transitional arrangements following repeal of the 2016 SoP (s 4). Practitioners must therefore work within existing claim procedures under the VEA and MRCA and may need to anticipate evidentiary hurdles not addressed in the SoP.

In short, the “gotchas” are technical: narrow histology limits, precise radiation metrics and latency, temporal constraints for the management‑access factor, and the need to match clinical documentation to the SoP’s textual definitions rather than to ICD codes alone.

Compliance, in this context, means assembling and presenting evidence that establishes on the balance of probabilities that at least one of the SoP’s factors existed and that the factor is related to the person’s relevant service (s 9; s 10(1)). The SoP itself supplies the elements; practitioners and claimants must translate those into evidentiary steps. The following are practical, source‑grounded steps.

1. Establish the correct disease definition

• Confirm the tumour is a primary malignant neoplasm arising from urethral epithelial cells and that it falls within the included list in s 7(2)(a)-(h).
• Exclude the listed exclusions in s 7(2)(c)(i)-(v). Obtain and collate histopathology, surgical notes and pathology reports that explicitly record tumour histology and site.

2. Consider ICD coding, but rely on pathology and site evidence

• Use ICD‑10‑AM coding (C68.0/C68.1) as supporting information, but prepare to demonstrate that the textual definition in s 7(2) is met because the instrument makes that the determinative meaning (s 7(3)-(4)).

3. Select which factor(s) to plead and gather targeted evidence

• HPV factor (s 9(1)):
  • This factor only applies to squamous cell or mixed squamous and urothelial cell carcinomas. Confirm histology.
  • Obtain pathology blocks, tissue PCR results, immunohistochemistry, or laboratory reports showing infection with HPV types 16 or 18 before clinical onset. Where direct pre‑onset evidence is lacking, seek archived tissue or pathology specimens that might demonstrate HPV presence at onset.
• Radiation factor (s 9(2) and Schedule 1):
  • Compile all sources of ionising radiation exposure relevant to the claimant, including therapeutic radiotherapy records, diagnostic imaging exposures, occupational exposure records, service records for high‑altitude flight that could contribute cosmic radiation, and records of any exposure from nuclear incidents.
  • Engage a dosimetry or radiation oncology expert to calculate the cumulative equivalent dose to the affected organ/tissue using accepted methods that combine different radiation types by accounting for differing biological effect, and confirm that the result meets or exceeds 0.5 sieverts.
  • Establish timing: document that the cumulative exposure occurred at least 10 years before clinical onset (establish onset date from clinical records).
  • Ensure that the calculation excludes normal background radiation, per the Schedule definition.
• Urethral diverticulum factor (s 9(3)):
  • Obtain imaging (e.g., MRI, ultrasound), surgical reports, or specialist notes demonstrating the existence of a urethral diverticulum at or before the date of clinical onset.
  • Where possible, supplement with accounts of prior procedures (catheterisation, urethral dilation, childbirth trauma, prior urethral/vaginal surgery) if they are relevant to establishing the diverticulum’s origin and timing, although the SoP requires presence at onset rather than specific causal proof.
• Inability to obtain appropriate clinical management (s 9(4) and s 10(2)):
  • Document contemporaneous attempts to obtain care (referrals, appointment records, correspondence, records of services declined or unavailable, geographic or service access issues) and demonstrate how lack of management contributed to clinical worsening.
  • Note the temporal restriction in s 10(2): this factor applies only where the malignancy was suffered or contracted before or during (but did not arise out of) relevant service and then operates only as material contribution or aggravation. Prepare evidence tying timing of disease contraction to service.

4. Demonstrate relation to relevant service (s 10(1); Schedule 1)

• Identify which category of “relevant service” applies (eligible war service other than operational service, defence service other than hazardous service and British nuclear test defence service under the VEA, or peacetime service under the MRCA) using the Schedule definition.
• Obtain service records, deployment histories, occupational exposure logs, and any defence health records that link the asserted factor (HPV infection, radiation exposure, diverticulum, inability to access care) to the relevant service period.

5. Death claims and terminal events (s 7(5); Schedule 1)

• For death claims, assemble records demonstrating that the person’s malignant neoplasm of the urethra contributed to the terminal event or condition.
• Collect death certificate, clinical notes describing terminal events (pneumonia, respiratory failure, cardiac arrest, circulatory failure, cessation of brain function as per Schedule), and treating clinicians’ opinions linking the tumour to the terminal event.

6. Use experts where required

• Radiation exposure will typically require dosimetric expertise.
• HPV linkage in historical cases may require pathology review or molecular testing of archived specimens.
• Medical expert reports should explicitly apply the SoP language: identify which s 9 factor(s) are asserted and explain how the evidence meets the definitions and thresholds in the SoP and Schedule.

7. Anticipate evidentiary gaps and remedial steps

• If direct evidence is missing (for example, no archived tissue for HPV testing), document exhaustive searches for records and explain why testing was not possible.
• For radiation, if records are incomplete, obtain contemporaneous service or occupational logs and expert opinion using conservative or accepted estimation techniques, making clear assumptions and their impact on dose estimation.

8. Address cross‑SoP issues (s 11)

• If a relied factor refers to an injury/disease covered by another SoP, obtain and apply the other SoP’s factors as in force. Cross‑check whether any recent amendments to that other SoP affect the case.

9. Prepare submissions that map evidence to the SoP checklist

• Frame the claim paperwork so that each element of s 9 and the Schedule definitions is addressed point‑by‑point: disease inclusion/exclusion, which factor is relied upon, the evidence for the factor, the relation of the factor to relevant service and the timing requirements.

10. Keep track of commencement and repeal dates

• For claims spanning the repeal of the 2016 SoP, verify which SoP applies by reference to dates and procedural rules outside the instrument. The 2025 SoP repeals the 2016 instrument (s 4) and commences 25 March 2025 (s 2); document which SoP was in force at the time the claim arose or at lodgement as required by decision‑maker practice.

Following these steps aligns claim preparation with the textual tests set by the instrument. Because the SoP does not prescribe evidentiary thresholds beyond its medical definitions, practitioners should ensure that expert opinions explicitly engage with the SoP language and that documentary evidence is organised to answer the discrete questions the SoP raises.
