Statement of Principles concerning malignant neoplasm of the salivary gland (Balance of Probabilities) (No. 103 of 2023)

The SOP deploys a small set of interlocking legal and medical concepts to operationalise causation for claims purposes. The core concepts are: the defined disease, qualifying causal factors, the temporal latency requirements, the relationship to relevant service, and technical definitions governing dose calculations and terminal events.

Defined disease. Malignant neoplasm of the salivary gland is defined narrowly as primary epithelial malignancy of the major salivary glands (parotid, submandibular, sublingual), minor salivary glands, or salivary ducts, while excluding carcinoid tumours, haematolymphoid tumours and soft tissue sarcoma (s 7(2)(a) and (b)). Death from the condition is included where death is a proximate or ultimate outcome contributed to by the disease (s 7(3)).

Triggering factors. Section 9 lists five distinct factors, any one of which must exist before the RMA’s view that a link to relevant service may be established on the balance of probabilities. Three factors are exposure or treatment related: cumulative equivalent dose of ionising radiation to the salivary gland of at least 0.5 sievert (with latency thresholds, s 9(1) and s 9(2)), and ablative radioactive iodine therapy for thyroid cancer where first exposure occurred at least 10 years before clinical onset (s 9(3)). Two factors are clinical or access related: prior infection with human immunodeficiency virus (s 9(4)), and inability to obtain appropriate clinical management prior to clinical worsening of the disease (s 9(5)).

Latency and age‑dependent thresholds. The instrument imposes a latency rule for ionising radiation. For adults, the cumulative dose must have been received at least 10 years before clinical onset (s 9(1)); for individuals aged 20 years or less, the same cumulative dose threshold is effective with a shorter latency of at least 5 years before clinical onset (s 9(2)). For ablative radioactive iodine, the required latency is 10 years (s 9(3)).

Causation and service linkage. S 10 imposes that any factor must be related to the person’s relevant service. The Schedule defines relevant service to include several categories: eligible war service (other than operational service) under the VEA; defence service (other than hazardous service and British nuclear test defence service) under the VEA; or peacetime service under the MRCA (Schedule 1, definition of relevant service). The limitation in s 10(2) restricts the application of the clinical management factor to cases where the disease pre‑existed or was contracted before or during relevant service but did not arise out of it.

Technical definitions. The Schedule defines cumulative equivalent dose and fixes the methodology for calculating it by reference to the Australian Radiation Protection and Nuclear Safety Agency Guide "as in force on 2 August 2017" (Schedule 1, cumulative equivalent dose). The Schedule also defines terminal event by listing proximate causes of death such as pneumonia, respiratory failure and cardiac arrest, which are included when death is contributed to by the salivary gland malignancy (Schedule 1, terminal event).

Cross‑reference to other SOPs. Section 11 provides that if a factor in this SOP refers to an injury or disease covered by another SOP determined under subsection 196B(3) of the VEA, the factors in that other SOP apply in accordance with its terms. This creates an explicit mechanism for cross‑application where a factor overlaps a separate medical standard.

Collectively, these concepts create a ruleset that converts specified exposures, treatments, infections or access failures, when tied to service and latency requirements, into a presumption that the condition can be linked to service on the balance of probabilities.

This SOP affects three groups directly and others indirectly through the claims process. First, it affects veterans and members of the Forces who lodge claims to which section 120B of the VEA or section 339 of the MRCA applies (s 5). The instrument does not create entitlements itself; rather it provides the causal criteria that decision‑makers will apply when determining whether a person’s malignant neoplasm of the salivary gland, or death from it, is connected with relevant service for the statutory claim provisions specified.

Second, it affects decision‑makers who adjudicate those claims. The RMA made the SOP under its statutory power (s 3), and the SOP provides the factors decision‑makers must consider. Although the instrument does not name the administrative body that uses the SOP in determinations, its application to claims under statutory sections of the VEA and MRCA implies that decision‑makers operating under those Acts will apply the SOP in making entitlement decisions (s 5). Those officials will therefore be required to assess evidence against the explicit factors and definitions in this instrument.

Third, it affects supporting professionals: medical practitioners, occupational or radiation dose reconstruction experts, and legal advisers assisting claimants or respondents. The Schedule makes clear that cumulative equivalent dose must be calculated in accordance with a specific ARPANSA guide "as in force on 2 August 2017" (Schedule 1, cumulative equivalent dose). This imposes a technical evidence requirement for claims relying on ionising radiation factors. Similarly, satisfying the radioactive iodine factor requires records of ablative treatment and date of first exposure (s 9(3)). Evidence of prior HIV infection (s 9(4)) and evidence of inability to obtain appropriate clinical management before clinical worsening (s 9(5)) will require clinical and service records.

Indirectly, the SOP may affect service organisations and record keeping bodies. Because the SOP relies on exposure data and treatment records, organisations that hold or generate such records will become sources for claims evidence. The SOP also implicitly affects the allocation of evidentiary and investigative resources inside the claims administration system, because certain factors (for example cumulative dose calculations) can require specialised dose reconstruction work.

The instrument also affects the timing of claims. It imposes latency thresholds for radiation‑related factors (s 9(1)-(2), s 9(3)). Claims with onset dates and exposure histories that do not meet those minimal latencies will not be connected on the basis of those factors. Additionally, s 10(2) confines the clinical management factor to a subset of cases where the disease pre‑existed or was contracted before or during relevant service but did not arise out of it, narrowing the class of claimants for whom that factor can be decisive.

This instrument does not create new statutory duties or criminal offences. Instead, it prescribes the legal test and evidentiary contours to be applied when determining whether malignant neoplasm of the salivary gland, or death from it, is connected with relevant service under specified claim provisions. The primary operative duties and rights are therefore those arising under the VEA and MRCA, read with this SOP.

Duty to apply the SOP. Decision‑makers who determine claims under the relevant statutory sections must apply the SOP’s factors and definitions when assessing causation. Section 9 sets the threshold that at least one enumerated factor must exist before it can be said, on the balance of probabilities, that the disease or death is connected with the circumstances of relevant service. Section 10 requires that any such factor be related to the person’s relevant service. Section 11 requires cross‑application of factors where they refer to injuries or diseases covered by other SOPs determined under subsection 196B(3) of the VEA. The instrument therefore imposes a duty on decision‑makers to refer to, and apply, the SOP and its definitions in adjudication.

Obligation to prove or document factors. While the SOP sets out which factors will satisfy causation, it also establishes the types of evidence that will be relevant. For radiation factors, the Schedule prescribes the method to calculate cumulative equivalent dose, requiring application of the ARPANSA guide "as in force on 2 August 2017" (Schedule 1). For ablative radioactive iodine, proof of treatment and timing is required (s 9(3)). HIV infection before clinical onset must be shown (s 9(4)). Inability to obtain appropriate clinical management prior to clinical worsening must be demonstrated in the factual context described in s 10(2) and s 9(5). These provisions impose an evidentiary burden on claimants to produce or enable production of clinical, service, treatment and exposure records.

Right to have a claim assessed using the SOP. Claimants whose claims fall under the specified statutory provisions have the procedural right to have causation assessed against the SOP factors; the instrument applies to such claims by operation of s 5. This confers a rights‑bearing position in that a claimant need only satisfy one of the enumerated factors, related to relevant service, on the balance of probabilities to have the disease treated as connected to service for the purpose of the associated claim provisions.

Limitations and conditionality. The instrument contains several built‑in limits. The disease definition excludes specific tumour types (s 7(2)(b)). The radiation dose excludes normal background radiation exposure in Australia from the cumulative equivalent dose calculation (Schedule 1). The clinical management factor is limited to contributions or aggravations where the disease was suffered or contracted before or during, but did not arise out of, relevant service (s 10(2)). These limits constrain the circumstances in which the SOP will alter the outcome of entitlement decisions.

No penalties within the SOP. The instrument itself contains no enforcement powers or penalties. It is an administrative standard for causal assessment. Any consequences for entitlements, compensatory payments, or vocational rehabilitation arise only through the application of this SOP to claims under the VEA or MRCA, and through the decision‑making and review mechanisms embedded in those Acts. The SOP’s legal effect therefore operates through its mandatory application by decision‑makers rather than by creating independent sanctions.

The instrument contains no criminal sanctions, civil penalties, or enforcement mechanisms within its text. It is a Statement of Principles made under subsection 196B(3) of the VEA that defines causal factors to be used in determining connection between malignant neoplasm of the salivary gland (or death from it) and a person’s relevant service (s 3, s 9). Enforcement therefore operates indirectly through the administrative decision process under the VEA and MRCA, rather than through direct penal provisions in the SOP itself.

Administrative effect. The primary means by which this SOP affects outcomes is its binding role in claims adjudication. Section 5 makes the instrument applicable to claims to which section 120B of the VEA or section 339 of the MRCA applies. That connection means that decision‑makers must apply the SOP’s factors and definitions when establishing causation for those statutory claim pathways. Any “penalty” in practice is the possible loss or gain of statutory entitlements that hinge on a finding of connection to service. The SOP therefore functions as a determinative evidentiary standard that shapes admissible and decisive matters of proof.

Review and appeal routes are not specified in the SOP. The instrument does not set out procedural review, merits review or judicial review pathways. Those avenues and any consequences for erroneous application of the SOP are governed by the VEA, MRCA and relevant administrative law principles; they are not addressed in this instrument. Claimants or respondents seeking to challenge a decision that applied the SOP will need to rely on the statutory and common law review mechanisms outside the SOP.

No enforcement against non‑application. The instrument does not create direct enforcement instruments to compel a decision‑maker to use it. The RMA’s statutory function is to determine SOPs under s 196B, and the SOP’s legal force derives from that statutory authority. The practical enforcement of the SOP will be through internal administrative practice, the expectations placed on decision‑makers under the VEA and MRCA, and external review mechanisms governed by those Acts and administrative law.

Evidentiary obligations. While not framed as penalties, the Schedule and sections 9 and 10 impose practical obligations that operate as de facto compliance requirements. For example, cumulative equivalent dose must be calculated per the ARPANSA guide "as in force on 2 August 2017" (Schedule 1). Failure to produce or obtain required technical evidence (dose reconstructions, treatment records, HIV test records, clinical management documentation) will hinder claims reliant on the corresponding factors. The instrument therefore enforces evidentiary discipline rather than imposing statutory penalties.

The SOP is expressly a subordinate legal instrument made under the VEA and designed to be applied in tandem with entitlement provisions in the VEA and the MRCA. Section 3 records the statutory authority for the instrument as subsection 196B(3) of the VEA. Section 5 specifies that the SOP applies to claims to which section 120B of the VEA or section 339 of the MRCA applies, creating direct legal interaction between this SOP and those claim provisions.

Cross‑application with other Statements of Principles. Section 11 provides for explicit inter‑SOP interaction. If a factor in this SOP refers to an injury or disease for which another SOP exists under subsection 196B(3) of the VEA, then the factors of that other SOP apply according to its terms. This creates a hierarchical or networked relationship among SOPs: where overlap exists, practitioners must consult both instruments and apply the other SOP’s factors as they stand at the relevant time (s 11). The practical effect is that a factor in this instrument may trigger the need to consult different or additional causation criteria set out elsewhere.

Interaction with technical regulatory material. The Schedule fixes the method for calculating cumulative equivalent dose by reference to an external technical guide, specifically the Australian Radiation Protection and Nuclear Safety Agency Guide to calculation of 'cumulative equivalent dose' as in force on 2 August 2017 (Schedule 1). This binds the SOP to a particular iteration of an external regulatory instrument. Decision‑makers and experts must therefore apply that version’s methodology when assessing dose‑based factors, rather than newer or alternative methodologies, unless and until the SOP is amended.

Relationship to definitions in the VEA and MRCA. The Schedule defines MRCA and VEA as shorthand for the acts themselves, and it defines relevant service by reference to categories that exist within the VEA and MRCA framework (Schedule 1, relevant service). The SOP therefore relies on, and is read alongside, statutory definitions and coverage rules in those Acts. Its operation is contingent on, and limited by, those underlying statutory regimes.

Repeal and succession. Section 4 expressly repeals the previous SOP No. 58 of 2015. The repeal means that, from commencement, adjudicators must apply the No. 103 of 2023 SOP rather than the 2015 instrument. That succession mechanism interacts with administrative practice, record‑keeping and any ongoing litigation or review that referenced the earlier instrument; practitioners must ensure the correct SOP is applied to claims with relevant dates (s 2, s 4).

No interaction with criminal or civil liability within this text. The SOP itself does not create or modify criminal offences or civil liability regimes. Any civil consequences, such as entitlement to compensation, or legal disputes arising from the application of the SOP, will be resolved under the VEA, MRCA and general administrative and civil law, rather than by any provision in this instrument.

The instrument records a short but definitive amendment history within its own text. The current instrument is the Statement of Principles concerning malignant neoplasm of the salivary gland (Balance of Probabilities) (No. 103 of 2023), dated 25 October 2023 and commencing 28 November 2023 (s 1, s 2 and the opening signature block). Section 4 expressly repeals the prior Statement of Principles concerning malignant neoplasm of the salivary gland No. 58 of 2015 (Federal Register of Legislation No. F2015L00261), which was made under subsections 196B(3) and (8) of the VEA. The instrument does not record any other amendments, transitional provisions or savings clauses.

Temporal effect. The commencement provision (s 2) makes the new SOP operable from 28 November 2023. Repeal of the 2015 SOP is explicit and contemporaneous in the instrument (s 4). The instrument does not specify retroactivity, nor does it address whether claims lodged before commencement should be assessed under the older SOP or the new one. In the absence of transitional language in this instrument, practitioners must look to the VEA, MRCA, and administrative practice or guidance from decision‑makers to determine which SOP applies to claims spanning the repeal and commencement dates. This is a practical gap in the instrument itself.

Reference to external methodology date. The Schedule binds cumulative equivalent dose calculations to the ARPANSA guide "as in force on 2 August 2017" (Schedule 1). That reference fixes the technical methodology at a historical date. Any subsequent amendments to the ARPANSA guide after 2 August 2017 are not incorporated into this SOP unless the SOP itself is amended. The instrument therefore establishes a fixed technical benchmark as part of its amendment history; changing the dose‑calculation standard will require an amendment of the SOP.

No recorded historical reason or explanatory memorandum inside the instrument. The text contains the RMA’s high‑level statement that its view is based on sound medical‑scientific evidence (s 8), but the instrument does not include an explanatory memorandum, statement of reasons, or a schedule of changes from the 2015 SOP. Any comparison of substantive changes between the 2015 and 2023 SOPs must therefore be conducted by comparing the texts externally, because the instrument itself does not summarise what has changed.

Amendment mechanism not restated. The SOP is made under the RMA’s power in subsection 196B(3) of the VEA (s 3). The instrument does not restate the process for future amendment, but that process will be governed by the statutory powers in the VEA. Practitioners seeking to challenge, update, or otherwise influence future amendments must therefore engage with the statutory amendment procedure under the VEA rather than rely on the instrument for procedural directions.

The instrument contains no references to case law, judicial interpretation, or ongoing litigation. It neither cites judicial authorities nor records that it has been the subject of legal proceedings. The text is purely an administrative determination of factors under subsection 196B(3) of the VEA (s 3, s 8). Therefore, within the four corners of this instrument, there is no litigation history to report.

Practical implication of absence of litigation references. Because the SOP does not include or reference any decisions that interpret its terms, practitioners must rely on future administrative decisions and any subsequent tribunal or judicial rulings to develop a body of interpretive law on issues such as how strictly to apply the ARPANSA methodology reference, how to establish that a factor is “related to the relevant service” (s 10(1)), or how to prove inability to obtain appropriate clinical management (s 9(5), s 10(2)). Until those questions are litigated or subject to published administrative guidance, claimants and decision‑makers will have to apply the SOP text as written and rely on standard principles of statutory interpretation and administrative law.

Potential dispute drivers. Absent specific litigation in the instrument, one can identify through the text likely sources of dispute that could lead to future litigation. These include: how cumulative equivalent dose is reconstructed in practice using the fixed ARPANSA guide (Schedule 1); what evidence suffices to show the radiation dose threshold was met; whether first exposure to radioactive iodine occurred as required and when; the sufficiency of documentation to prove prior HIV infection and its temporal relationship to clinical onset; and the criteria for establishing inability to obtain appropriate clinical management prior to clinical worsening. The instrument creates clear thresholds and references that will be focal points for contested claims, but any litigation or tribunal decisions must be sourced from later materials beyond this SOP.

No transitional judicial rulings. Because the instrument repeals a 2015 SOP (s 4) and introduces a 2023 SOP without recording transitional guidance, there is potential for disputes over which SOP applies to claims that straddle the repeal and commencement dates. The instrument itself does not resolve that question; the litigation history will, if it arises, have to be built from subsequent cases addressing those issues.

Several provisions in the SOP have immediate operational consequences that can be overlooked, and which carry practical significance for claimants, advisers and decision‑makers.

Fixed technical methodology. The Schedule instructs that cumulative equivalent dose be calculated "in accordance with the methodology set out in Guide to calculation of 'cumulative equivalent dose' ... as in force on 2 August 2017" (Schedule 1). The gotcha is that the SOP locks in a historical version of a technical guide. Any updates to the ARPANSA methodology after that date are not automatically incorporated. Parties relying on the radiation factors must ensure calculations adhere to the 2 August 2017 version; relying on a later ARPANSA methodology will not satisfy the SOP unless the SOP is amended.

Exclusion of background radiation. The cumulative equivalent dose expressly excludes "normal background radiation exposure in Australia" (Schedule 1). Practitioners must ensure dose reconstructions subtract background levels. Failure to do so may overstate dose estimates and produce an unfavourable evidentiary result.

Age threshold and latency differences. For ionising radiation the SOP imposes different latency requirements depending on the age at exposure. If the relevant individual was aged 20 years or less at the time of exposure, the required latency between exposure and clinical onset is at least 5 years (s 9(2)); for older individuals the latency is at least 10 years (s 9(1)). The practical consequence is that identical exposure histories can yield different causation outcomes depending on the age at exposure. Advisers must check age and onset dates precisely.

Narrow disease definition. The SOP’s disease definition excludes several tumour types: carcinoid, haematolymphoid tumours (including both non‑Hodgkin and Hodgkin lymphoma), and soft tissue sarcoma (s 7(2)(b)). A diagnosis that might be colloquially described as salivary region malignancy but that falls into an excluded histological category will not be covered. Confirmatory pathology reports and precise diagnostic coding will therefore be critical.

Clinical management factor’s limited scope. The inability to obtain appropriate clinical management factor (s 9(5)) is constrained by s 10(2), which confines its application to material contribution or aggravation where the disease was suffered or contracted before or during, but did not arise out of, relevant service. This means that where the disease arose out of service, s 9(5) cannot be relied upon for material contribution or aggravation. Put differently, s 9(5) does not create a standalone route for causation where the disease first arose during relevant service’s circumstances and did so as a direct result; it only applies in specific pre‑existing or contracted cases.

Dependency on other SOPs. Section 11 requires cross‑application where a factor refers to an injury or disease covered by another SOP. The practical gotcha is that satisfying a factor here may require satisfying additional or different criteria contained in a separate SOP, which can extend evidentiary requirements or introduce incompatible thresholds. Practitioners must identify and consult any linked SOPs.

Record and proof burdens. The instrument relies on technical and clinical proof: dose reconstructions, treatment dates for radioactive iodine, dated HIV infection proof, and documentation of clinical management attempts. For exposures that occurred decades ago, or where records are incomplete, meeting these evidentiary standards can be difficult. The SOP itself does not provide relaxed evidentiary rules for missing records, so claimants with poor documentation face an uphill task.

No penalties or procedural instructions in the SOP. There is no guidance in the instrument on procedural matters, evidentiary weight, or review pathways. Parties must therefore rely on the VEA, MRCA and administrative procedures for those operational details. Lack of transitional rules between the 2015 and 2023 SOPs may create dispute about which instrument governs a particular claim.

Terminal event scope. The definition of death from the condition includes death from a terminal event that was contributed to by the salivary gland malignancy, and Schedule 1 lists several terminal events (pneumonia, respiratory failure, cardiac arrest, circulatory failure, cessation of brain function). Practitioners must be ready to demonstrate the malignancy’s contribution to these proximate causes of death; a proximate cause alone does not automatically satisfy that the malignancy materially contributed.

For claimants, advisers and decision‑makers, complying with the SOP means assembling evidence that maps directly to the enumerated factors and definitions, and ensuring the temporal and service‑link requirements in sections 9 and 10 are satisfied. The following practical steps focus on documentary and evidentiary tasks the SOP requires.

1. Verify diagnosis and histology. Obtain the pathology report and clinical records that establish the diagnosis as malignant neoplasm of the salivary gland as defined in s 7(2)(a). Confirm that the tumour type is not excluded under s 7(2)(b), namely carcinoid, haematolymphoid tumours, or soft tissue sarcoma. Precise histopathology is essential because the SOP excludes those categories.

2. Establish clinical onset date. Determine and document the clinical onset date of the salivary gland malignancy. Latency thresholds for radiation and radioactive iodine factors are measured from clinical onset (s 9(1)-(3)), so accurate onset dating will be consequential.

3. Map exposure and service records. For factors tied to ionising radiation, assemble service records, occupational logs, medical imaging or treatment records evidencing exposure(s). Demonstrate how those exposures occurred during the person’s relevant service, because s 10(1) requires the factor be related to relevant service. Relevant service is defined in the Schedule and includes specific categories under the VEA and MRCA.

4. Obtain dose reconstruction per ARPANSA guide. If relying on the ionising radiation factor, commission or prepare a cumulative equivalent dose calculation in accordance with the ARPANSA guide specified in the Schedule, "as in force on 2 August 2017" (Schedule 1). Ensure background radiation in Australia is excluded as required. Because the SOP references a specific version of the guide, use that version’s methodology exactly.

5. Age check for latency. Determine the person’s age at the time(s) of exposure. If the person was aged 20 years or less, apply the 5‑year latency rule in s 9(2); otherwise, apply the 10‑year latency rule in s 9(1). Document calculations and timelines clearly.

6. For radioactive iodine, produce treatment records. If the claim relies on s 9(3), obtain medical records confirming ablative radioactive iodine therapy for thyroid cancer and the date of first exposure. Confirm that the first exposure occurred at least 10 years before clinical onset.

7. For HIV factor, produce dated clinical evidence. If relying on s 9(4), obtain medical records or laboratory results that document HIV infection preceding the clinical onset of the salivary gland malignancy.

8. For inability to obtain appropriate clinical management, document attempts and timing. If relying on s 9(5), assemble evidence showing attempts to obtain appropriate clinical care, the reasons for inability to obtain it, and how that inability preceded the clinical worsening. Because of the limitation in s 10(2), ensure the matter fits the scope (the disease suffered or contracted before or during, but did not arise out of, relevant service). Records may include clinic correspondence, referral delays, geographic or resource constraints during service, and contemporaneous medical notes.

9. Cross‑check linked SOPs. If a factor references another injury or disease covered by a different SOP, obtain and apply the other SOP’s factors as required by s 11. Make sure linked SOPs are in force in their current versions.

10. Present evidence in claims process. When lodging or supplementing a claim under the VEA or MRCA provisions referenced in s 5, present a clear evidentiary linkage: diagnosis, onset date, exposure/treatment/infection evidence, service connection, and technical dose calculations where applicable. Decision‑makers are required to apply the SOP, so ensure the claim file aligns factor by factor to the instrument’s language.

11. Anticipate gaps and prepare expert input. For historical exposures with limited records, secure expert opinion to reconstruct likely dose histories, using the ARPANSA guide method. For clinical management issues, obtain expert testimony on standard of care and causative impact of delays or lack of treatment.

12. Be precise about what the SOP does not cover. Avoid relying on the SOP for tumour types excluded by s 7(2)(b) or for radiation calculations that include background Australian radiation. Confirm that the claimed factor is expressly within the SOP’s list in s 9 and related to the person’s relevant service per s 10(1).

13. Check commencement and repeal dates. The SOP commenced on 28 November 2023 (s 2) and repealed the 2015 SOP (s 4). For claims around that timeframe, determine which SOP applies by reference to administrative guidance or the underlying legislation, since this instrument contains no transitional clause.

Following these steps aligns claim construction and documentary preparation with the SOP’s explicit textual mandates. The instrument’s precision on dose calculation method and timing thresholds makes documentary fidelity and technical accuracy central to successful application.
