Statement of Principles concerning malignant neoplasm of the nasopharynx (Reasonable Hypothesis) (No. 9 of 2020)

The central legal concept is the “reasonable hypothesis” standard. Under section 120A of the VEA and section 338 of the MRCA, a claim for malignant neoplasm of the nasopharynx will succeed only if the material before the decision-maker raises a reasonable hypothesis connecting the disease to the person’s relevant service. Alcohol consumption is measured in kilograms using the Australian standard of 10 grams of alcohol per standard drink; 500 kilograms thus equals 50,000 standard drinks - a very high lifetime total. “Inhaling wood dust” is defined as exposure from work, not from hobby or domestic activities: it must arise from “work entailing the sanding, planing, machining, sawing, repairing or manufacturing of timber products or performing other tasks in an area where such work is being performed.” That excludes wood dust from firewood, pellet stoves, or DIY projects unless done in a work context. “Chinese-style salted fish” is defined by less salt and higher fermentation due to warm, moist conditions, typical of southern China and Southeast Asia. “Preserved vegetables” includes salting, fermenting, or pickling. The term “terminal event” is defined as pneumonia, respiratory failure, cardiac arrest, circulatory failure, or cessation of brain function - used to connect death to the disease. The concept of “inability to obtain appropriate clinical management” (factor 13) is not further defined; it applies only to material contribution to, or aggravation of, the disease where the person’s malignancy was suffered or contracted before or during (but did not arise out of) relevant service. That factor imposes a vague duty on the decision-maker to assess whether clinical management was unavailable or inadequate, which invites subjective judgment and may drive litigation over what constitutes “appropriate” management given the circumstances of service.

The primary affected persons are veterans and current members of the Australian Defence Force who have rendered relevant service and who develop malignant neoplasm of the nasopharynx (or die from it) and lodge a claim for compensation or treatment under the VEA or MRCA. That includes persons who served in operational deployments, peacekeeping missions, hazardous service (e.g., nuclear test participants), British nuclear test defence service, warlike service (e.g., active combat), and non-warlike service (e.g., peace enforcement). Secondary affected groups include: (a) legal practitioners and advocates who represent claimants and must advise on the likelihood of satisfying a factor; (b) medical practitioners who provide opinions on clinical onset, diagnosis, and exposure histories; (c) Department of Veterans’ Affairs decision-makers who must apply the SoP rigidly, including delegates in the Claims Processing area; (d) members of the Veterans’ Review Board and Administrative Appeals Tribunal who review rejected claims; and (e) the Repatriation Medical Authority itself, which must maintain and update SoPs based on new evidence. The SoP also affects the public indirectly through the cost of the compensation system. Each successful claim under the SoP results in a liability funded by the Commonwealth - that is, by taxpayers. The factors are designed to identify service-related cases, but the thresholds are necessarily arbitrary; some non-service-related cancers will be accepted if the factor thresholds are met (for example, a heavy smoker who happened to serve in peacetime but whose smoking was unrelated to service can still raise a hypothesis if the service is relevant). This SoP is made under subsection 196B(2) of the VEA. It applies to claims under section 120A of the VEA (claims based on operational service) and section 338 of the MRCA (claims under that Act). It does not apply to claims under the Safety, Rehabilitation and Compensation Act 1988 (the Comcare scheme) or to state workers’ compensation schemes. It replaces SoP No. 25 of 2011, which is repealed. The SoP must be read together with the VEA and MRCA, particularly the provisions on standard of proof, evidence, and review. The interaction can be procedural: if the sinusitis itself did not arise from service, but the nasopharyngeal cancer did, the sinusitis factor may fail unless the sinusitis is independently service-related. The SoP also interacts with the Legislation Act 2003: it is a legislative instrument that must be registered on the Federal Register of Legislation, tabled in Parliament, and subject to disallowance. However, it is not subject to sunsetting because it is an instrument under the VEA with indefinite effect (though the Authority may revoke or replace it). In terms of state law, the SoP has no direct effect, but a veteran who receives compensation for the disease may also have rights under state workers’ compensation if the condition arose from civilian employment - though dual compensation is generally prohibited by the VEA.

This instrument was made on 28 February 2020 and commenced on 23 March 2020. It repealed SoP No. 25 of 2011 (Federal Register of Legislation No. F2011L00740). The text of the current instrument does not show any subsequent amendments; it is the original version as registered. The Authority may amend or replace SoPs when new medical evidence emerges, but no changes have been recorded in the text provided. The earlier SoP (No. 25 of 2011) likely had different factor thresholds, possibly based on older evidence. For example, the previous SoP may have used different pack-year thresholds, different latency periods, or different definitions of relevant service. Claimants whose claims were rejected under the 2011 SoP may be able to reapply under the 2020 SoP if the factors are now more favourable. Several technical traps exist. First, the definition of “inhaling wood dust” in the dictionary is explicitly work-related: “being exposed to fine particulate material of wood origin from work entailing the sanding, planing, machining, sawing, repairing or manufacturing of timber products or performing other tasks in an area where such work is being performed.” A veteran who used wood-fired heating in a house (inhaling smoke) or did sawing as a hobby at home does not meet the definition unless that activity was part of paid employment or service duties. Many hobby woodworkers may mistakenly believe their exposure counts. Second, factor 3 (smoking) requires that smoking commenced at least 15 years before clinical onset and, if smoking ceased, the onset occurred within 15 years of cessation. A veteran who quit smoking 20 years ago and develops cancer now cannot use the smoking factor, even if they smoked heavily for 40 years. That temporal window restricts the factor severely. Third, the alcohol factor (4) requires at least 500 kilograms of alcohol consumed before clinical onset. That is a huge amount: 50,000 standard drinks. A veteran who drinks 20 standard drinks per week would take about 48 years to reach that threshold. It excludes moderate drinkers. Fourth, the preserved vegetables factor (10) requires an average of at least 75 grams per week for at least five consecutive years within the 20 years before onset. Many people eat pickles or sauerkraut occasionally but not consistently; the “average per week” and “consecutive years” language makes it hard to prove without detailed dietary records. Fifth, factor 11 (inability to consume at least 100 grams per day of fresh fruit and vegetables for five consecutive years within 20 years before onset) is difficult to prove negatively: a claimant must show they could not consume that amount, not just that they chose not to. Proving an inability requires medical or economic evidence (e.g., due to poverty, deployment to a place without fruit supply, or a medical condition preventing consumption). Sixth, factor 13 (inability to obtain appropriate clinical management) applies only if the cancer was present before or during service (but not arising out of service). If a veteran develops cancer years after discharge, and there was no clinical management issue during service, that factor is irrelevant. Seventh, the timing requirements for several factors require that the exposure occurred before clinical onset, and sometimes with a minimum latency (e.g., mustard gas must be at least five years before onset; formaldehyde must be at least 15 years before onset). The factor of wood smoke (factor 8) does not specify a latency period, but the definition of smoking does. Practitioners must map each factor’s timing precisely to the date of clinical onset. Eighth, the definition of “pack-years” uses tailor-made cigarettes; roll-your-own tobacco is converted by weight (1 gram per cigarette equivalent). A veteran who smoked rollies must convert accurately. Ninth, the factor for chronic sinusitis or chronic rhinitis (12) does not require the condition to be severe or documented by medical records during service, but clinical onset of the cancer must be after the sinusitis. If a veteran develops sinusitis after cancer diagnosis, the factor fails. Tenth, factor 1 (Epstein-Barr virus) does not require a minimum latency; it only requires the infection to be before clinical onset. Since EBV is ubiquitous (most adults are seropositive), that factor could potentially be satisfied by nearly any veteran. However, the decision-maker might require evidence of active infection (high viral load or recent seroconversion) rather than past exposure. The SoP does not define “having infection” - does it mean current active infection or any past infection? That ambiguity invites litigation.

For claimants, compliance involves proving at least one factor and relating it to relevant service. The process is document-intensive. For factor 1 (EBV), provide serology results showing elevated VCA-IgM or IgG, or a positive test for viral capsid antigen, but note that many people have IgG from past infection - active infection is harder to prove. For factor 2 (HIV), provide positive HIV test results. For factor 3 (smoking), provide a detailed smoking history in pack-years: type of tobacco, number per day, years of smoking, and cessation date. A statutory declaration supported by family or medical records is typical. For factor 4 (alcohol), calculate lifetime consumption in grams: number of standard drinks per week multiplied by 10 grams x years of drinking. If the total exceeds 500 kg, document with self-report and corroborative evidence (medical records of alcohol-related conditions, liver tests). For factor 5 (mustard gas), provide service records showing exposure to chemical weapons or testing, and evidence of the exposure occurring at least five years before onset. For factor 6 (wood dust), prove at least 7,500 hours of occupational wood dust exposure (or 4 hours per day on more days than not for 10 years) before onset. Provide employment records, workplace dust monitoring reports, or witness statements. For factor 7 (formaldehyde), prove cumulative 750 hours of exposure at 1 ppm or causing sensory irritation, at least 15 years before onset. This is difficult for most Australian veterans unless they worked in pathology, embalming, or manufacturing. For factor 8 (wood, charcoal, or coal smoke in an enclosed space), provide evidence of living in a home with a wood stove or cooking over charcoal for at least 10 years on more days than not or 7,500 hours cumulative before onset. For factor 9 (Chinese-style salted fish), document average weekly consumption of at least 10 grams for at least five consecutive years within the 20 years before onset. The fish must be the specific type defined. For factor 10 (preserved vegetables), show average weekly consumption of at least 75 grams for five consecutive years within 20 years before onset. For factor 11 (inability to consume fruit/veg), provide evidence of unavailability due to deployment, poverty, or medical condition, showing an average of less than 100 grams per day for five consecutive years within 20 years before onset. For factor 12 (chronic sinusitis or chronic rhinitis), provide medical records documenting the condition before cancer onset. For factor 13 (inability to obtain appropriate clinical management), this applies only if the cancer existed before or during service and was not service-related. Provide evidence that clinical management was unavailable or inadequate (e.g., lack of specialist referral, diagnostic delay), and that this materially contributed to progression or death. For decision-makers, compliance means checking each factor’s timing, definition, and relation to service. They must request evidence if insufficient, and if a factor is satisfied, they must accept the claim unless the hypothesis is not reasonable - which is rare. The compliance burden on the Department is to train staff to apply the SoP consistently and to maintain precedents for borderline cases. The cost of compliance for the system is the time spent evaluating evidence that may be thin. For taxpayers, the cost is the compensation paid when a factor is met, even if the cancer is not causally related to service - for example, a heavy smoker who also served in a non-operational role may still get compensation if the smoking is “related to service” (e.g., started during service because of cheap canteen cigarettes). That is a policy choice built into the VEA. The best way to minimise downstream cost is for the Authority to periodically review the evidence and adjust thresholds to better reflect causation, but the instrument is static until replaced.
