Statement of Principles concerning malignant neoplasm of the cervix (Balance of Probabilities) (No. 81 of 2020)

Clinicians, pathologists and forensic medical advisors will be required to produce the kinds of evidence the SoP makes determinative: documented HPV typing over time (to show persistent infection by the same type for two consecutive years), records of HIV infection, detailed smoking histories that can be converted to pack‑years (using the one pack‑year definition in the Schedule), contraceptive prescription and use records, immunosuppressive drug prescriptions and transplant records, and records of screening, treatment attempts and any preventive events linked to service. Where a factor refers to “contemporary medical standards of the time” (s 9(6)-(7)), medical opinion will be required to identify what those standards were at the relevant period.

4. Service providers and records custodians. Defence force personnel records, health service records and pathology labs that hold HPV typing results are implicated. • Adjudicative effect. The SoP’s primary enforcement role is internal to the administrative claims process: if a decision‑maker accepts that a claimant’s malignant neoplasm of the cervix satisfies the RMA’s factors and is related to relevant service, that adjudicatory finding enables entitlement determinations under the VEA or MRCA framework.
