Statement of Principles concerning malignant neoplasm of the breast (Reasonable Hypothesis) (No. 84 of 2023)

The instrument anchors around a small set of statutory concepts and medical thresholds used to create a link between malignant neoplasm of the breast and relevant service. Central concepts include: the precise medical meaning of "malignant neoplasm of the breast" (s7(2)); the "reasonable hypothesis" evidentiary threshold for service connection, operationalised by requiring at least one enumerated factor (s9); the requirement that any such factor be "related to the relevant service" (s10(1)); and the cross‑reference mechanism to other Statements of Principles where factors overlap with other conditions (s11).

Meaning of the disease. Section 7(2) defines malignant neoplasm of the breast as a primary epithelial malignant neoplasm of male and female breasts, expressly including carcinoma in situ and Paget disease of the breast, and expressly excluding haematolymphoid tumours, malignant melanoma and mesenchymal tumours (s7(2)(a)-(c)). The instrument notes ICD‑10‑AM codes C50 and D05 attract to the condition, but instructs that the statutory description controls in application (s7(3)-(4)).

Factors as mechanistic proxies. Section 9 lists the discrete factors, and commences by stating that "At least one" must exist to raise a reasonable hypothesis connecting the disease to relevant service. The factors are concrete, measurable or documentary items such as a cumulative equivalent radiation dose of at least 0.1 sievert (s9(1)); specified durations of menopausal hormone therapy or combined oral contraceptive pill use with precise timing windows and cessation windows (s9(2)-(3)); exposure to ethylene oxide measured as an 8‑hour time‑weighted average with cumulative hours or ppm‑years thresholds (s9(19) and Schedule 1); night shift work criteria based on shift frequency, minimum hours per shift and continuous period (s9(20)); and quantifiable tobacco, second‑hand smoke and alcohol exposure thresholds (s9(11)-(13) and Schedule 1). The Statement also includes clinical management factors such as inability to obtain appropriate clinical management resulting in clinical worsening (s9(21)), and a factor specific to death claims that hinges on prevented access to mammographic screening for females aged 50-69 (s9(17)).

Temporal and demographic qualifiers. Many factors are qualified by age, sex or reproductive status, and by time windows between exposure and clinical onset. For example, some factors apply only to males and postmenopausal females (obesity and diabetes, s9(15)-(16)), some apply only to females older than 35 (nulliparity, s9(8)), and one factor explicitly addresses male to female transgender persons for estrogen cross‑sex hormone therapy (s9(6)). Each factor typically contains a minimum duration or cumulative exposure threshold plus a look‑back or cessation window that governs whether a past exposure remains relevant at the clinical onset date (s9; Schedule 1).

Reference definitions and measurement methods. The Schedule defines technical measurement concepts that determine whether a claimant meets a factor threshold. Cumulative equivalent dose uses the ARPANSA Guide methodology dated 2 August 2017 (Schedule 1). Pack‑years, BMI, BMI formula, waist circumference thresholds to define obesity, MET units for physical exertion limitations, ppm‑years and 8‑hour time‑weighted average for ethylene oxide are all defined and thereby anchor quantification and evidentiary expectations (Schedule 1).

Relationship to the statutory scheme. The Statement operates within the VEA/MRCA claims framework by providing an RMA‑issued list of factors that, if established and linked to relevant service, permit an adjudicator to find a reasonable hypothesis. The RMA frames this as its view on available medical‑scientific evidence (s8), but the instrument itself is an input to decision making, rather than a final claim determination.

Primary affected parties are people who have or die from malignant neoplasm of the breast and who seek entitlements under the VEA or the MRCA. The instrument expressly applies to claims to which section 120A of the VEA or section 338 of the MRCA apply (s5). Those sections determine the statutory ability to link injury or disease to relevant service via the "reasonable hypothesis" standard; this Statement supplies the medical factors that operationalise that standard.

Stakeholders by role:

• Claimants: veterans and former members of the Forces, members of Peacekeeping Forces, and persons who served under definitions of relevant service (Schedule 1). The Schedule’s definition of "relevant service" lists operational, peacekeeping, hazardous, British nuclear test defence service under the VEA, and warlike and non‑warlike service under the MRCA (Schedule 1).
• Particular populations within claimants: the Statement distinguishes between males, females, postmenopausal females, parous and nulliparous females, and male to female transgender persons for one factor (s9(6); s9(7)-(10); Schedule 1 definitions of parous and nulliparous).
• Medical witnesses and experts: clinicians and authorised medical assessors will be asked to provide evidence of clinical onset dates, hormone therapy durations, contraceptive use, radiation dose reconstructions, ethylene oxide exposure estimates, BMI and waist circumference at relevant times, diabetes diagnosis records, breastfeeding history, smoking pack‑year calculations and physical activity limitations (s9; Schedule 1).
• Administrative decision makers: Department of Veterans’ Affairs officers, claims adjudicators and Veterans’ Review Board members who apply the VEA and MRCA will use the factors to determine whether a reasonable hypothesis exists linking the disease to relevant service (s5; s8-9).
• Employers and record holders: hospitals, clinics, employers (for shift work rosters and exposure records), military units (for deployment records), pharmacy records and pathology/laboratory records may be required to provide documentary evidence.

Differential impacts by demographic and clinical condition. The Statement’s factors create different evidentiary paths depending on the claimant’s sex, reproductive history, age and clinical course. For instance, the mammographic screening factor (s9(17)) is confined to females aged 50-69 and applies to death claims only, while the obesity and diabetes factors apply to males and postmenopausal females only (s9(15)-(16)). The inclusion of male breast cancer in the statutory definition (s7(2)(a)) expands coverage to men, while the explicit transgender provision (s9(6)) creates a tailored route for MTF cross‑sex hormone therapy exposure.

Who bears burdens and who decides. The instrument situates the factual burden of proving the presence of a listed factor and its relationship to relevant service on the claimant’s evidence presented to the decision maker. The Repatriation Medical Authority provides the medical‑scientific view and the definitions; claim processors must translate those into questions of fact on each claim (s8; s9; s10). The instrument does not itself adjudicate individual claims or allocate monetary entitlements, rather it provides the medical criteria that feed into the statutory decision making in the VEA/MRCA framework.

This Statement of Principles does not itself create duties in the manner primary legislation does, but it generates binding application rules that carry operational duties for decision makers applying the VEA/MRCA scheme and practical obligations for claimants. Core duties and rights arising from the instrument include:

For decision makers:

• Duty to apply this Statement as an authoritative list of factors when considering whether a reasonable hypothesis is raised in claims falling under s120A VEA or s338 MRCA (s5; s9). The instrument requires that at least one factor in s9 be shown before the decision maker can say a reasonable hypothesis is raised linking malignant neoplasm of the breast to relevant service (s9 introductory wording).
• Duty to consider the defined meanings and measurement methodologies in the Schedule when assessing claims. For example, cumulative equivalent dose must be calculated "in accordance with" the ARPANSA Guide identified in Schedule 1, and pack‑years and obesity thresholds have specific definitions that decision makers must use (Schedule 1).
• Duty to apply s11 where a listed factor refers to an injury or disease covered by another Statement of Principles. In that case, the decision maker must give effect to the terms of that other Statement as "in force from time to time" (s11).

For claimants:

• Right to have a claim assessed against the factors in s9 and the definitions in the Schedule to determine whether a reasonable hypothesis exists (s5; s9). If a claimant establishes one or more factors and links them to relevant service, that factual foundation allows the statutory process for service connection to proceed.
• Practical duty to provide evidence supporting any factor relied on. Given the specification of durations, concentrations, cumulative doses, cessation windows and age thresholds in s9 and Schedule 1, claimants will need documentary and expert evidence to demonstrate compliance with the precise thresholds.

For medical practitioners and experts:

• Duty to provide evidence and, where applicable, dose reconstructions, exposure estimates and clinical records aligned to the measurement concepts in the Schedule. Cumulative equivalent dose evidence must conform to the ARPANSA Guide methodology (Schedule 1). For ethylene oxide exposure, evidence must speak to an 8‑hour time‑weighted average concentration and cumulative hours or ppm‑years as defined (s9(19); Schedule 1).

Constraints and limitations embedded in the Statement:

• The instrument requires that any factor established must be "related to the relevant service rendered by the person" (s10(1)). That sets a causation link requirement beyond mere presence of a risk factor in a person’s life. Decision makers must therefore evaluate whether the factor was connected to the person's military or peacekeeping service, which imports additional evidentiary needs such as service records, deployment histories, exposure records or medical management during service.
• A specific limitation exists for the clinical management factor (s9(21)): per s10(2), that factor applies only to material contribution to, or aggravation of, the disease where the disease was "suffered or contracted before or during (but did not arise out of) the person's relevant service." This restricts the clinical management factor to cases where disease pre‑existed service or was present during service but not caused by it.

Administrative rights of revision and reference. The instrument is made under statutory authority (s3) and may be amended or repealed by subsequent RMA determinations. Section 11 anticipates interplay with other Statements of Principles and requires application of those Statements "as in force from time to time", which means decision makers must track amendments to other SOPs that may affect the present Statement’s applicability.

This Statement of Principles is an administrative instrument and does not itself create criminal offences or civil penalties. It is a determinative medical‑scientific instrument used within the VEA and MRCA frameworks to assess entitlement to benefits. The instrument does not include a sanctions regime, fines, or enforcement mechanisms. Rather, enforcement occurs through its use by statutory decision makers in claims processing, reviews and appeals under the VEA and MRCA.

Mechanics of enforcement in practice. The Statement’s practical enforcement takes place at the point of adjudication of claims under the VEA or MRCA. Decision makers, including departmental officers and review bodies such as the Veterans’ Review Board or courts charged with reviewing administrative decisions under the relevant Acts, will use the Statement as part of the evidentiary framework when determining whether a "reasonable hypothesis" exists and thus whether further entitlement processes should follow. The instrument thereby affects the outcome of claims, granting or refusing entitlements, rather than imposing external penalties.

Evidence standards and procedural consequences. Although the Statement specifies substantive medical factors, the instrument operates within the VEA/MRCA procedural rules that set the standard of proof and appeal pathways. The Statement requires that "at least one" of the enumerated factors exist before a reasonable hypothesis can be raised (s9). If claimants fail to show any factor or fail to demonstrate the factor was related to relevant service (s10(1)), the practical consequence is likely to be rejection of service‑connection claims. That rejection can be challenged through internal review, the Veterans’ Review Board, and judicial review routes provided under the Acts, but this instrument itself does not detail those procedures.

No criminal or regulatory penalties in the instrument. The instrument contains no provisions for penalising false statements, nor does it authorise enforcement action against third parties who withhold records. The instrument does not create mandatory reporting obligations for clinicians or employers; instead it supplies criteria that decision makers and claimants use when assessing medical evidence and service linkage.

Evidence integrity expectations. The instrument’s detailed thresholds and measurement methods, for example the ARPANSA Guide for cumulative equivalent dose (Schedule 1), imply that adjudicators will expect technical evidence presented in forms consistent with those methods. While the Statement does not command particular evidentiary formats, failure to present evidence aligned to the defined methodologies may weaken a claimant’s position and produce an adverse benefit decision.

Primary statutory anchor. The Statement is made under subsection 196B(2) of the Veterans’ Entitlements Act 1986 (s3). It is designed to operate within the statutory adjudicative frameworks created by the VEA and the MRCA: it applies to claims where section 120A of the VEA or section 338 of the MRCA are engaged (s5). Those sections in the parent Acts set the legal standard (the "reasonable hypothesis" threshold) used for establishing service connection in claims; this instrument supplies the medically based factors that operationalise that threshold for malignant neoplasm of the breast.

Cross‑reference to other Statements of Principles. Section 11 expressly states that if a factor in s9 refers to an injury or disease covered by another Statement of Principles determined under subsection 196B(2) of the VEA, then the terms of that other Statement apply "as in force from time to time" (s11). This creates a hierarchical interaction: where a factor is more properly characterised by an alternative SOP, decision makers must apply that SOP’s terms. The instrument thereby mandates harmonisation across RMA determinations and requires continuous attention to changes in other SOPs.

Reference to external technical standards. The Schedule incorporates an external technical guide for dose calculation, namely the "Guide to calculation of 'cumulative equivalent dose' for the purpose of applying ionising radiation factors contained in Statements of Principles determined under Part XIA of the Veterans' Entitlements Act 1986 (Cth), Australian Radiation Protection and Nuclear Safety Agency, as in force on 2 August 2017" (Schedule 1). This binds cumulative equivalent dose calculations in these claims to the ARPANSA methodology as of that date. Decision makers, experts and parties must therefore use that guide for dose reconstruction unless a subsequent recognized version is adopted by the RMA process or the Schedule is amended.

ICD code and classification reference. The Statement notes that malignant neoplasm of the breast attracts ICD‑10‑AM codes C50 or D05, but clarifies that for application of the Statement the statutory definition in s7(2) controls (s7(3)-(4)). The ICD reference points decision makers and clinicians to common coding for record retrieval, but the instrument prevents mechanistic reliance on coding where the statutory text defines or excludes particular tumour types.

Interaction with clinical standards. The mammographic screening factor (s9(17)) uses the phrase "in accordance with contemporary medical standards at the time", which imports an extra‑statutory reference point: contemporary clinical screening standards. Adjudicators will need to determine what "contemporary medical standards" were at relevant times. That determination will involve reference to applicable clinical guidelines, screening program policies or expert evidence relevant to the 10‑year period prior to clinical onset (s9(17)).

Overlap with employment law and occupational exposure records. The instrument contemplates exposures that commonly arise in occupational settings (e.g., ethylene oxide sterilisation in hospitals, night shift work, aircrew cosmic radiation exposures) and indicates examples of workplace sources in Schedule 1 and in factors such as s9(19) and notes. Consequently, claims often will require coordination with employer records, occupational health and safety investigation materials, and military exposure records. Those materials fall within other legal regimes (employment, privacy, record‑keeping obligations) but the Statement itself simply requires that such evidence be used to establish the presence and timing of relevant factors.

Supersession of prior RMA instruments. Section 4 explicitly repeals the Statement of Principles concerning malignant neoplasm of the breast No. 96 of 2014. This demonstrates how RMA determinations operate in place of prior SOPs and how updates alter the medical criteria that feed into statutory decisions under the VEA and MRCA.

The instrument itself records a short, concrete amendment history. It is numbered as Statement of Principles No. 84 of 2023 and is dated 25 August 2023 (cover page and signature block). Section 2 sets its commencement as 26 September 2023. Section 4 expressly repeals the earlier Statement of Principles concerning malignant neoplasm of the breast No. 96 of 2014 (Federal Register of Legislation No. F2014L01383) that was made under subsections 196B(2) and (8) of the VEA.

What the instrument does not show. The instrument does not include a series of amendments or a history of incremental changes, nor does it list earlier versions beyond the immediate predecessor that was repealed. There is no schedule of serial amendments or transitional provisions included in the text provided. The instrument does indicate continuities: for instance, it continues to rely on established external materials such as the ARPANSA Guide as of 2 August 2017 for cumulative equivalent dose calculations (Schedule 1). Because the instrument refers to other Statements of Principles "as in force from time to time" (s11), there is an implied ongoing amendment regime across the corpus of SOPs issued under s196B(2), but details of any subsequent amendments are not part of this instrument.

Practical implications of the repeal and reissue. Repeal of the 2014 Statement and replacement by the 2023 Statement means that claim assessments, dose reconstructions and medical evidence presented from the commencement date forward must be evaluated using the 2023 criteria and definitions. Decision makers will need to ensure that their processes and staff apply the new thresholds, demographic qualifications, time windows and definition changes (for example, any revised phrasing for inclusion/exclusion of tumour types), and that expert evidence addresses the 2023 instrument’s specific definitions and references, especially the ARPANSA Guide methodology cited in Schedule 1.

Tracking change across SOPs. Section 11’s direction that other Statements apply "as in force from time to time" creates an operational task: practitioners and decision makers must monitor amendments to other SOPs that might affect the application of a factor in s9 if that factor is covered elsewhere. The instrument itself contains no automatic amendment clause nor a schedule of future anticipated revisions; any future amendment would appear as a subsequent RMA determination and would need to be checked against current practice.

The instrument contains no litigation history, case citations or references to judicial determinations. It states the Repatriation Medical Authority’s view that there is sound medical‑scientific evidence indicating a possible relationship between malignant neoplasm of the breast and relevant service (s8), but does not reference any court or tribunal decisions interpreting this Statement or earlier versions.

Consequences of the absence of litigation references. Because the instrument does not name cases, practitioners must look outside the instrument to the VEA, the MRCA and relevant administrative and judicial decisions to determine how courts and review tribunals have interpreted Statements of Principles and the "reasonable hypothesis" threshold in practice. The instrument itself cannot be read as supplying precedential guidance on issues such as how strictly numerical thresholds are applied, how to reconcile competing expert evidence, or how to weigh service linkage evidence in borderline cases.

Where to look for litigated interpretation. In practice, litigated interpretation of SOPs and the reasonable hypothesis standard will appear in decisions of the Veterans’ Review Board, Administrative Appeals Tribunal, Federal Court or other relevant appellate bodies. The Statement’s absence of litigation references means decision makers and practitioners should check the body of case law under the VEA and MRCA outside this instrument to understand procedural and evidential trends. The Statement’s cross‑reference provision (s11) and its citation of external technical standards (Schedule 1) will also be relevant in contested cases, but again the instrument itself provides no commentary on how disputes about technical interpretation should be resolved.

No retroactive immunity or settled litigation text. The instrument does not purport to validate or overturn prior determinations made under the 2014 Statement. It simply repeals that prior Statement and offers a new set of criteria from the commencement date (s2-4). Any pending litigation that seeks to rely on the old Statement or argues for retrospective application would need to be sourced in the procedural law and judicial decisions, none of which are contained in this instrument.

This instrument contains numerous technical thresholds and eligibility qualifications that can be easily misapplied or overlooked. The following practical pitfalls derive directly from the instrument’s text and definitions.

1. Disease definition vs ICD code. Although the Statement acknowledges ICD‑10‑AM codes C50 and D05 (s7(3)-(4)), it explicitly commands that the statutory definition in s7(2) controls. That means a tumour coded as C50 in records still needs to meet the statutory description, and conversely, exclusions such as haematolymphoid tumours, melanoma and mesenchymal tumours are obvious traps if a claimant assumes ICD coding is determinative (s7(2)(c)).

2. At least one factor rule. The Statement requires "at least one" enumerated factor to exist to raise a reasonable hypothesis (s9). Some claimants may have multiple risk exposures none of which individually meet the thresholds. The instrument does not allow aggregation across unrelated items unless a listed factor expressly contemplates cumulative exposures. Practitioners must therefore carefully map client histories to the precise factors and thresholds.

3. Relationship to relevant service. Establishing a factor is necessary but not sufficient; the factor "must be related to the relevant service" (s10(1)). Claimants need to show not only that an exposure occurred, but that the exposure was connected to military/peacekeeping service. For example, night shift work or ethylene oxide exposure must be shown to have occurred during relevant service or as a result of it. Service records, rosters and exposure logs are frequently required.

4. Time windows and cessation periods. Many factors include look‑back windows and cessation thresholds. For example, combined oral contraceptive use has different cessation windows depending on duration of use (s9(3)). Alcohol cessation is relevant for up to 40 years (s9(13)), smoking up to 30 years (s9(11)), and second‑hand smoke up to 30 years (s9(12)). Practitioners must calculate onset dates precisely and align cessation dates accordingly.

5. Technical measurement standards. For radiation, cumulative equivalent dose must be calculated according to the ARPANSA Guide as of 2 August 2017 (Schedule 1). Inadequate or inconsistent dose reconstructions can be fatal to a claim. Similarly, ethylene oxide requires 8‑hour time‑weighted average or ppm‑years calculations (s9(19); Schedule 1). Many medical experts or occupational hygienists may need to align their reports to these methodologies.

6. Gender, reproductive and transition‑related limitations. Some factors apply only to specific groups. Obesity and diabetes factors apply to males and postmenopausal females only (s9(15)-(16)). Nulliparity applies only to females aged over 35 (s9(8) and Schedule 1). The transgender factor applies only to male to female transgender persons for at least two years of estrogen cross‑sex hormone therapy (s9(6)). Practitioners must avoid miscategorising claimants and ensure the claimant falls into the demographic bracket for the chosen factor.

7. Breastfeeding and parity evidence. Proof of inability to breastfeed for a cumulative three months (s9(7)) or timing of the first live birth (s9(10)) will often depend on obstetric records and contemporaneous notes. Self‑report alone may be weaker evidence without medical corroboration.

8. Mammographic screening factor complexity. The death‑only mammographic screening factor (s9(17)) is multi‑element: it applies only to females aged 50-69, requires prevention from accessing mammographic screening "in accordance with contemporary medical standards at the time" within 10 years prior to clinical onset, and requires that if screening was later resumed there was no normal test result and that subsequent screening opportunities were not declined (s9(17)(a)-(b)). Establishing being "prevented" from screening and what constituted "contemporary medical standards" can be contested and may require documentary proof of attempted access, service‑related barriers to access, or contemporaneous policies.

9. Clinical management factor limited by service timing. The inability to obtain appropriate clinical management for malignant neoplasm of the breast before clinical worsening (s9(21)) only applies to material contribution or aggravation where the disease was "suffered or contracted before or during (but did not arise out of) the person's relevant service" (s10(2)). That caveat excludes cases where the disease arose out of service from being remedied under this particular factor, which may be counter‑intuitive.

10. Proof of second‑hand smoke and physical inactivity. Second‑hand smoke requires at least 10,000 hours in an enclosed space (s9(12)), which is a high evidentiary bar; similarly proving inability to undertake activities greater than 3 METs for five consecutive years within 30 years before onset (s9(14)) demands objective clinical assessment and possibly functional testing records.

11. Obesity measures are time‑sensitive. The Schedule defines obesity using BMI and waist circumference thresholds (Schedule 1). Advocates must establish BMI or waist circumference readings covering the relevant 5‑year period within 20 years before onset for obesity claims (s9(15)). Absent contemporaneous records, retrospective estimation is vulnerable to challenge.

12. Ethylene oxide exposure specificity. The uses listed in the instrument, sterilisation of surgical instruments and protective clothing in hospitals, are common in military medical settings (s9(19) Note 1). But proof requires concentration estimates and cumulative hours in the relevant continuous period. Employers’ workplace exposure records, maintenance logs and steriliser monitoring reports will typically be necessary.

13. Record fragmentation and civilian treatment during service. Many exposures may have occurred during service but recorded in civilian clinical files. The Statement’s requirement to relate factors to relevant service means claimants must gather cross‑sector records across military and civilian providers.

These "gotchas" are directly traceable to the instrument’s language and definitions, and they indicate areas where claim preparation, expert engagement and document retrieval need particular attention.

Compliance in this context means compiling and presenting evidence so that a decision maker can find that at least one factor in s9 exists and that the factor is related to the person's relevant service (s9; s10(1)). The following is a practical checklist, mapped to the instrument’s provisions, for claimants, practitioners and medical experts.

1. Identify the clinical onset date. The onset date anchors time windows in s9 and cessation periods. Obtain clinical notes, pathology reports and imaging studies that record the date of diagnosis or first clinical manifestations of malignant neoplasm of the breast. Confirm tumour type aligns with the statutory definition in s7(2).

2. Map claimant demographics to factor applicability. Determine sex, menopausal status, parity status, transgender status (male to female), and age at onset to identify which factors apply (s9(6)-(10), Schedule 1).

3. Align exposures to specific s9 factors and collect primary evidence:

   • Ionising radiation (s9(1)): collect military dosimetry, radiology procedure records, flight logs (aircrew), nuclear test attendance records, and any occupational exposure records. Arrange dose reconstruction using the ARPANSA Guide methodology cited in Schedule 1, ensuring cumulative equivalent dose can be calculated and shown to reach at least 0.1 sievert and the first exposure occurred at least 5 years prior to onset (s9(1); Schedule 1).
   • Menopausal hormone therapy (s9(2)): obtain prescription records and clinic notes showing at least one year of therapy and, if therapy ceased, that onset occurred within five years of cessation.
   • Combined oral contraceptives (s9(3)): obtain pharmacy and medical records showing continuous use duration, start date at least five years before onset, and calculate appropriate cessation windows (10 or 15 years depending on duration).
   • Diethylstilbestrol in pregnancy (s9(4)): obtain prenatal records documenting DES exposure.
   • Estrogen therapy for prostate cancer (s9(5)): treatment notes evidencing at least 15 months of estrogen therapy prior to onset.
   • Transgender cross‑sex hormone therapy (s9(6)): for male to female claimants, gather endocrinology records showing at least two years of estrogen‑containing therapy prior to onset.
   • Breastfeeding inability (s9(7)): obtain obstetric and lactation records to show inability to breastfeed for cumulative 3 months.
   • Nulliparity and first birth timing (s9(8), s9(10)): collect birth certificates, obstetric records confirming parity and ages at birth.
   • Pregnancy within 25 years (s9(9)): obtain pregnancy records and dates.
   • Tobacco smoking (s9(11)): obtain detailed smoking history to compute pack‑years per Schedule 1, check that smoking began at least five years before onset, and document cessation dates if relevant (onset within 30 years after cessation).
   • Second‑hand smoke (s9(12)): compile occupational and residential histories with evidence of time spent in enclosed spaces with smokers, and calculate total hours to reach 10,000 hours, with commencement at least five years before onset and cessation windows (s9(12); Schedule 1).
   • Alcohol consumption (s9(13)): document cumulative alcohol consumption quantified by Australian standard drinks (10 g ethanol), establishing at least 40 kg of alcohol consumption, commencement at least five years before onset, and cessation windows up to 40 years.
   • Physical inactivity (s9(14)): collect functional assessments and medical records documenting inability to undertake activities above 3 METs for five consecutive years within 30 years before onset; expert functional assessments may be necessary (Schedule 1).
   • Obesity (s9(15)): obtain contemporaneous weight and height data to calculate BMI equal to or above 30 or waist circumference measurements meeting the thresholds in Schedule 1, and demonstrate the five‑year obesity period within 20 years before onset.
   • Diabetes mellitus (s9(16)): provide diagnostic records for diabetes prior to clinical onset.
   • Mammographic screening prevention (death only, s9(17)): for females aged 50-69 in death claims, secure documentary evidence showing attempts to access mammography or reasons for prevention, link to service circumstances, and demonstrate either resumed screening with no normal result or that opportunities were not declined (s9(17)(a)-(b)).
   • Digoxin/digitalis/digitoxin exposure (s9(18)): obtain prescribing records showing continuous use for at least one year prior to onset and cessation timing if relevant.
   • Ethylene oxide (s9(19)): assemble occupational hygiene records, steriliser monitoring logs, maintenance and work schedules to estimate ambient concentrations and cumulative hours. Engage an occupational hygienist to calculate 8‑hour time‑weighted averages and ppm‑years as defined in Schedule 1, ensuring the first exposure was at least five years before onset.
   • Night shift work (s9(20)): obtain rosters and pay records showing at least three nights per week, minimum 10 hours per shift, for a continuous five‑year period, and calculate cessation windows where relevant.
   • Inability to obtain appropriate clinical management (s9(21)): supply medical records demonstrating lack of access to standard care and link clinical worsening to that lack of access; remember s10(2) restricts this factor to situations where the disease was present before or during but did not arise out of service.

4. Establish relationship to relevant service. For each factor relied upon, obtain service records showing the exposure or barrier to care occurred during or as a consequence of relevant service. For occupational exposures (ethylene oxide, radiation, night shift), use military or unit records, employer logs and contemporaneous reports. For healthcare access issues, document attempts to access care while in service and reasons for prevention.

5. Use defined measurement methods. For cumulative equivalent dose, follow the ARPANSA Guide (Schedule 1). For pack‑years, use the Schedule 1 calculation. For BMI, use the W/H2 formula in Schedule 1. For METs, use the Schedule 1 definition. For ethylene oxide, use 8‑hour time‑weighted average and ppm‑years measurements as defined.

6. Provide expert interpretation. Where technical calculations are required (dose reconstruction, occupational exposure estimation, MET assessments), obtain reports from qualified experts who explicitly reference the measurement definitions and methods in the Schedule to ensure admissibility and alignment with the Statement.

7. Anticipate cross‑references. If a factor refers to another condition that has its own Statement of Principles, identify and gather evidence relevant to that other SOP as required by s11.

8. Document chronological continuity. Because many factors include continuous periods (for example, continuous hormone therapy, continuous night shift work, continuous occupational exposure), evidence should demonstrate uninterrupted durations or adequately account for permissible breaks.

9. Prepare for record gaps. Where contemporaneous records are missing, assemble multiple corroborating sources: witness statements, unit diaries, pharmacy dispensing histories, employer attestations, aviation flight logs, and clinical letters. Explain any gaps and provide plausible reconstructions tied to the ARPANSA methodology where radiation dose reconstruction is needed.

10. Be specific when alleging prevention. For the mammographic screening factor and the clinical management factor, document attempts, denials and reasons, and connect prevention or inability to service circumstances rather than making general claims about access.

Following the instrument’s own definitions and thresholds precisely, and aligning expert reports to those standards, is the most reliable route to compliance with the Statement’s requirements. Decision makers are required to apply these textual criteria; therefore compliance means matching evidence to text, not to general clinical impressions.
