Statement of Principles concerning hypogonadism (Balance of Probabilities) (No. 74 of 2021)

The SoP organises liability around a short set of interlocking concepts: the medical definition of hypogonadism, enumerated causative or aggravating factors, temporal thresholds for exposures and treatments, the requirement that any factor be related to relevant service, and cross‑references to other Statements of Principles where diseases overlap.

Definition of the condition. The instrument defines hypogonadism for VEA/MRCA purposes as deficient production of sex steroids or gametes that is associated with clinical symptoms or a requirement for treatment (s 6(2)(a)). It expressly includes primary and secondary forms and endocrine or gonadal infertility (s 6(2)(b)). It excludes a set of clinical entities so that not all low gonadal function presentations are captured: heritable and congenital forms, compensated hypogonadism, diminished ovarian reserve, naturally occurring menopause and abnormal semen analysis are excluded (s 6(2)(c)). The Schedule supplies further medical and operational definitions that the decision‑maker must apply , for example infertility, active epilepsy, chronic kidney disease and the definition of “terminal event” in death cases (Schedule 1).

Balance of probabilities as the operative standard. Section 7 states the RMA’s view, based on the sound medical‑scientific evidence available, that it is more probable than not that hypogonadism can be related to relevant service. That is the usual civil standard, and the SoP is framed to identify factual circumstances in which causation on that standard can be taken to exist.

Enumerated, often binary factors. Section 8 lists a set of factors one of which must be satisfied for the SoP to be met. Many factors are framed in definitive terms , for example, “surgical excision of both ovaries or testes” (s 8(5)), “infection with human immunodeficiency virus” (s 8(7)), “mumps orchitis as an adult affecting both testes” (s 8(10)) , and other factors include defined thresholds and windows, including cumulative exposure hours (s 8(26)-(27)) and specified durations of drug therapy (s 8(20), s 8(50)). Some factors apply to males only or females only (for example testicular varicocele is male only at s 8(12) and smoking pack‑year thresholds are female only at s 8(28)).

Clinical onset and clinical worsening. The SoP distinguishes between factors relevant to the clinical onset of hypogonadism and factors relevant to the clinical worsening of hypogonadism. Subsections 8(1)-8(30) address factors that must exist before clinical onset, while subsections 8(31)-8(61) address factors relevant to clinical worsening. Section 9(2) restricts the application of the worsening factors so they only apply where hypogonadism pre‑existed or was contracted before or during relevant service but did not arise out of it.

Temporal and exposure thresholds in the Schedule. The Schedule contains definitional material that turns many factors into practical evidentiary tests. Examples include: active epilepsy defined as at least one epileptic seizure per year; being underweight as BMI of 18.5 or less; chronic kidney disease as an abnormality present for at least three months; a pack‑year unit and the method for calculating pack‑years (Schedule 1). For inhalation or contact exposures the instrument imposes a cumulative 2,000‑hour threshold and a 2‑year window after cessation for the onset/worsening (s 8(26)-(27), s 8(56)-(57) and Schedule 1). For some iatrogenic factors the instrument sets minimum treatment durations and temporal windows for effect or rechallenge evidence (s 8(20), s 8(25), s 8(50), s 8(55)).

Death linked to the condition. The SoP covers death where hypogonadism contributed to a terminal event or condition; a terminal event is defined broadly in the Schedule to include pneumonia, respiratory failure, cardiac arrest and cessation of brain function (s 6(3) and Schedule 1).

Cross‑reference mechanism. Section 10 provides a mechanism by which factors that refer to another injury or disease are to be interpreted by applying any relevant separate Statement of Principles for that other injury or disease. That creates an explicit dependency on the content of other SoPs when factors in s 8 reference conditions covered elsewhere.

Taken together these concepts convert a broad clinical diagnosis into a set of legal triggers and evidentiary thresholds that the veterans’ compensation decision process can apply with relatively high granularity. The main conceptual trade‑off is between standardisation (clear, enumerated factors) and the risk that uncommon clinical pathways that are not captured in the list may not be recognised unless they are covered by other SoPs or otherwise meet the decision‑maker’s threshold for causation.

Primary affected parties. The SoP is intended to be applied to veterans and members of the Australian Defence Force who make claims that fall under section 120B of the Veterans’ Entitlements Act 1986 or section 339 of the MRCA (s 4). That means two groups of people are directly affected: (a) persons seeking a finding that hypogonadism or death from hypogonadism is connected with their relevant service for VEA entitlements, and (b) persons seeking the corresponding finding under the MRCA framework. The instrument’s reach is thus confined to the veterans/ADF compensation context, not to the general medical or workers’ compensation systems.

Beneficiaries when a factor is established. Establishing an enumerated factor that is related to relevant service satisfies the SoP on the balance of probabilities and therefore assists entitlement decision‑makers in finding a service connection. That confers potential benefit in the form of pensions, treatment, rehabilitation and other entitlements available under the relevant statutes. The beneficiaries are therefore claimants with one or more of the listed factors who can produce the evidence necessary to show the factor and the relationship to relevant service.

Medical practitioners and specialists. Endocrinologists, urologists, gynaecologists, oncologists, occupational physicians, psychiatrists and general practitioners who treat current or former ADF members will be affected operationally because their records and reports are the primary evidence used to satisfy the enumerated factors. The SoP sets specific clinical evidence requirements and definitions (for example definitions for infertility, active epilepsy and chronic kidney disease), which clinicians must address in their reports if they are to support a claim.

Departmental decision‑makers and the Repatriation Medical Authority. The Repatriation Medical Authority (RMA) is the statutory author of the SoP (s 3). Administrators within the Department of Veterans' Affairs and decision‑makers under the VEA and MRCA will use the SoP as a binding evidentiary guideline for causation in hypogonadism claims. The RMA’s view that the link can exist on a balance of probabilities (s 7) is the stated scientific basis for administrative decisions.

Families and dependants in death cases. Because the instrument includes death from hypogonadism where hypogonadism contributed to a terminal event (s 6(3)), family members and dependants who submit claims following a veteran’s death are affected. They must demonstrate that hypogonadism contributed to the terminal event, using the instrument’s definitions and factors.

Providers of occupational and exposure records. Employers, Defence Health Services and unit medical officers who maintain service exposure, vaccination, deployment and occupational hygiene records are affected because the SoP builds on documented exposures, surgical procedures, drug treatments and service histories. Certain factors depend on service‑related exposure evidence (for example radiation fields including gonads, cumulative inhalation exposures of 2,000 hours, or inability to obtain appropriate clinical management).

Those not captured. The instrument explicitly excludes some conditions from the definition of hypogonadism (see s 6(2)(c)): heritable and congenital forms, compensated hypogonadism, diminished ovarian reserve, natural menopause and abnormal semen analysis. People whose clinical picture fits only those excluded entities cannot rely on this SoP to establish a service link for hypogonadism under the VEA/MRCA frameworks. Also, factors for clinical worsening (s 8(31)-8(61)) are limited by s 9(2) and therefore do not apply in circumstances where hypogonadism arose out of service.

Geographical and temporal boundaries. The instrument applies to “relevant service” as that term is defined in the Schedule (which includes eligible war service, defence service and peacetime service under the MRCA). The instrument’s temporal thresholds for exposures (for example cumulative exposure and windows after cessation) create additional constraints on which claimants can satisfy factors. For example, many exposures require onset within specified windows after cessation (s 8(26)-(27), s 8(56)-(57)).

In short, the SoP affects claimants seeking service connection for hypogonadism or for a death where hypogonadism contributed, the medical and record‑keeping professions who provide evidence, the administrative decision‑makers who apply the SoP, and families of deceased veterans. The mechanics of many factors place the practical burden on claimants to assemble service and medical records that meet the instrument’s definitional and threshold tests.

This instrument is not a statute imposing criminal duties or civil liabilities. It is an administrative SoP that creates evidentiary presumptions and tests to be used within the VEA/MRCA compensation frameworks. The duties and rights that flow from the SoP are therefore administrative and functional rather than penal.

Duty to apply the SoP criteria. Decision‑makers applying the VEA or the MRCA must take this SoP into account when deciding whether hypogonadism or death from hypogonadism is connected with relevant service for the purposes of the statutory provisions referenced in section 4. The RMA’s role under s 196B(3) of the VEA is the statutory authority for making Statements of Principles, and this instrument therefore supplies the medical criteria that decision‑makers must apply.

Right to have causation assessed against the SoP. Claimants have the procedural right to have their hypogonadism claims assessed against the criteria in this SoP, subject to the general procedural rights provided by the VEA and MRCA claims processes. If an enumerated factor in section 8 is established and related to relevant service (s 9(1)), that will satisfy the SoP on the balance of probabilities, thereby supporting a finding of service connection.

Duty to relate factors to relevant service. Even where an enumerated factor exists, section 9(1) requires that factor to be related to the person’s relevant service. The claimant must therefore provide the connection between the factor and service. The SoP does not itself set out how that relationship is proved, but it requires that the factor be related to service as a precondition to the SoP being satisfied.

Duty to respect temporal limitations and specific definitions. Many factors contain temporal or quantitative limits that are part of the test (for example cumulative 2,000 exposure hours and time windows after cessation, drug durations, pack‑year thresholds and BMI duration). Decision‑makers must apply the Schedule definitions and the temporal rules in section 8 when judging whether the factor exists at the relevant time (see Schedule 1 and the relevant subparagraphs of s 8).

Cross‑reference duty to other SoPs. Section 10 creates a duty on decision‑makers to apply other Statements of Principles where a factor in this instrument refers to an injury or disease that is the subject of another SoP. That requires decision‑makers to consult and apply, contemporaneously, other SoPs “as in force from time to time” when factors overlap.

Right to rely on the RMA’s stated view. Section 7 records the RMA’s scientific position. In practice that supplies the medical rationale decision‑makers rely upon. The RMA’s statement that it is of the view, on sound medical‑scientific evidence, that it is more probable than not that hypogonadism can be related to relevant service provides the evidentiary standard that frames decision‑making. It is an administrative statement rather than a legal presumption of causation, but it is a key piece of the legal‑medical scaffolding that confers rights on claimants who meet the listed factors.

No penalty regime in this instrument. The SoP contains no penalty or sanctioning provisions. It does not create offences or fines. The instrument’s enforcement is through the application of the VEA/MRCA schemes and departmental decision processes rather than through criminal enforcement.

Duty to ensure records and evidence are adequate. Practically, the SoP creates a duty on clinicians, record keepers and claimants to assemble medical, surgical, occupational and service records that establish the factors and relate them to relevant service. Where factors depend on exposure thresholds (for example, 2,000 cumulative hours), documentation of time, duties and exposures becomes determinative.

In sum, the SoP assigns administrative duties to decision‑makers to apply its enumerated factors and definitions, confers procedural rights on claimants to have their cases assessed under those criteria, and imposes practical evidence‑gathering duties on clinicians and record holders whose documents will be decisive in showing whether any listed factor related to relevant service is present.

This Statement of Principles is an administrative instrument that sets medical and evidentiary tests for the purposes of entitlement decisions under the VEA and the MRCA. It contains no criminal penalties, monetary fines, or administrative sanctions within its text. The instrument does not impose enforcement mechanisms of the sort found in regulatory or criminal statutes. It performs an evidentiary function within the veterans’ entitlements decision framework.

What enforcement looks like in practice. Enforcement of the SoP is operational and indirect. The RMA issues the SoP under the statutory power in subsection 196B(3) of the VEA (s 3). Decision‑makers under the VEA and MRCA use the SoP as the medical guideline for determining whether hypogonadism or death from hypogonadism is connected with relevant service for entitlement purposes. If a claimant cannot establish a listed factor related to relevant service, the likely administrative outcome is refusal of service connection for hypogonadism or death from it. Conversely, satisfying a qualifying factor related to service assists a positive decision. Those administrative outcomes are the instrument’s practical enforcement mechanism.

No penalties for misstatement or fraud in the instrument itself. The SoP does not create offences for false claims or false statements. Any misconduct issues would be dealt with under the broader VEA/MRCA framework or general criminal law, but the SoP does not itself prescribe investigatory or penal powers.

Decision quality control. The instrument requires decision‑makers to apply specified clinical criteria and definitions (Schedule 1). Internal administrative review, merits review and judicial review mechanisms that operate under the VEA/MRCA frameworks (outside the text of this instrument) control how the SoP is applied. The instrument is publicly available and amended through RMA processes, and decision‑makers are required to apply the SoP “as in force from time to time” (s 10). The compilation includes amendment history and endnotes (Endnotes 3 and 4) showing how the SoP has been changed and when amendments commenced; that transparency is part of the administrative governance around its application.

Risk of divergent application. The instrument provides precise factors and definitions but leaves to decision‑makers the task of assessing whether those factors are present and related to service in each case. Errors of application, incomplete evidentiary assessment or disputes over the factual record are resolved in the normal administrative and judicial review channels available under the relevant Acts rather than by any penalty provision in this SoP.

Record keeping and evidence as the practical enforcement lever. Because the SoP ties entitlement outcomes to documented factors and service relationships, the practical enforcement mechanism is evidentiary: the presence, completeness and quality of medical and service records will determine whether the SoP is found to be satisfied and entitlements are granted. The instrument thereby channels enforcement through documentation quality and adjudicative processes rather than by imposing sanctions.

Statutory nexus. The SoP is made under subsection 196B(3) of the VEA (s 3) and expressly applies to claims to which section 120B of the VEA or section 339 of the MRCA applies (s 4). It is therefore a statutory medical instrument designed to be incorporated into the VEA/MRCA decision frameworks. The instrument does not stand alone as a source of entitlements; it functions as the RMA’s medical guidance that decision‑makers must use in applying the substantive provisions of the VEA and the MRCA.

Dependency on other Statements of Principles. Section 10 directs how overlapping disease definitions are handled. If a factor in this SoP refers to an injury or disease that is itself covered by another SoP, the factors in that other SoP apply as in force from time to time. That creates an explicit cross‑SoP interdependence: decision‑makers must consult relevant other SoPs and apply them to the extent that factors in section 8 reference conditions covered there. In practice this can affect causation analysis for infections, malignant neoplasms, infiltrative diseases and other conditions named in the Schedule’s specified lists.

Administrative law remedies and appeal routes (contextual, not specified). The SoP does not itself set out appeal or review mechanisms; those are provided by the VEA and MRCA frameworks and general administrative law. The instrument will be applied within the statutory decision processes of those Acts, and party rights of review or appeal are exercised under the provisions of those Acts and the general administrative law system. The SoP therefore interacts with tribunals and courts not by amending their jurisdiction but by shaping the evidentiary standard and the medical triggers used by those decision‑makers.

Interaction with clinical and occupational safety law. Several factors in this SoP depend on occupational exposures, inhalation of specified chemicals or metals, or inability to obtain clinical management. Those subject matters overlap with occupational health and safety law, workers’ compensation schemes and industrial‑relations recordkeeping. The SoP does not alter those bodies of law but may draw on their records when establishing exposures and service relationships. For example, proving cumulative inhalation exposure of 2,000 hours (s 8(26)-(27)) may require workplace exposure records, and the SoP’s reliance on those records links veterans’ compensation outcomes to occupational documentation that sits outside the VEA/MRCA.

Effect on medical prescribing and treatment decisions. The SoP lists certain drugs and drug classes as factors (Specified List 1 and Specified List 2 in Schedule 1). That creates an intersection between clinical practice and entitlement outcomes. The SoP is not clinical guidance for optimal treatment; it is an evidentiary framework. Clinicians should note that prescriptions (for example androgens, opioids, antipsychotics, steroids in Specified List 2) can be relevant to causation assessments under the SoP, but the instrument does not constrain prescribing choices directly.

Consistency with other Commonwealth instruments. The SoP refers to the VEA and the MRCA and is part of the RMA’s broader suite of Statements of Principles. Section 10’s requirement to apply other SoPs where they are relevant ensures internal coherence across RMA instruments. The instrument’s amendments and compilation history are recorded in the endnotes, which show registry and commencement dates (Endnote 3 and 4).

No repeal of other substantive law. The SoP does not repeal or modify the substantive entitlement provisions of the VEA or the MRCA. It must be read and applied within those Acts’ frameworks. It is an interpretative, medical evidentiary tool rather than a legislative amendment to entitlements or procedures.

In practice, therefore, the SoP is an instrument that sits inside and interacts with the VEA/MRCA statutory schemes, cross‑references other RMA instruments, draws on clinical and occupational records that exist under other laws and administrative regimes, and is applied through the administrative and judicial review channels available under the relevant statutes.

The compilation includes the original Statement of Principles concerning hypogonadism (Balance of Probabilities) (No. 74 of 2021) and an amendment (No. 52 of 2022) as reflected in the endnotes. The endnotes at the end of the compilation provide the official record of registration and commencement of the instrument and its amendment(s).

Key dates and instruments. The original SoP (No. 74 of 2021) was registered on 24 May 2021 (F2021L00620) and commenced on 21 June 2021 (Endnote 3). The Amendment Statement of Principles concerning hypogonadism (No. 52 of 2022) was registered on 2 May 2022 (F2022L00668) and commenced on 30 May 2022 (Endnote 3). The compilation date shown is 30 May 2022.

Specific amendments recorded. The amendment history table in Endnote 4 lists specific provisions affected. It records that Section 2 was repealed by the Legislation Act provision LA s 48D (provision affected: “Section 2………………. rep LA s 48D”). The same endnote records that the Schedule 1 definition for immune checkpoint inhibitor was revised by the Regulation Subordinate Instrument No. 52 of 2022 (rs No. 52 of 2022). The compilation notes that the day of commencement of the Amendment SoP (No. 52 of 2022) is 30 May 2022.

Compilation practices and uncommenced amendments. The compilation contains a note explaining that uncommenced amendments are not shown in the text and that underlined text in the endnotes marks amendments made up to but not commenced as of the compilation date. It also notes that if this compiled law has been modified by another law, the modification operates even where the modification does not amend the text of the compiled law; such modifications are not shown in the compilation and readers should consult the Legislation Register for full details.

Practical implications of amendment history. The inclusion and later amendment of Schedule 1 definitions (for example immune checkpoint inhibitor) demonstrate that the RMA updates the SoP to reflect advances or changes in medical science or treatment classes. Practitioners should therefore check the current in‑force SoP and any associated SoPs that cross‑reference certain diseases or treatments. The endnotes record the serial numbers and commencement dates which are necessary to determine which version applies to a particular claim.

Transparency and public record. The endnotes provide an explicit record of registry numbers, dates of registration and dates of commencement, which assists legal practitioners and claimants in identifying the correct instrument and the version operative for a given claim. The SoP also includes a “Compilation No. 1” and a compilation date (30 May 2022) at the head of the instrument, which helps identify which amendments are incorporated in the compiled text.

In short, the SoP has a recorded amendment history with a first instrument (No. 74 of 2021) and a subsequent amendment (No. 52 of 2022) that updated at least the immune checkpoint inhibitor definition. Practitioners must verify the current in‑force wording against the Legislation Register and the RMA’s published SoPs to ensure they rely on the operative text for a given claim.

The instrument itself contains no litigation or judicial decisions. The compilation and the endnotes do not record any court or tribunal cases that interpret or challenge this particular Statement of Principles. The text names no cases and the endnotes do not list precedent or litigation history for this SoP.

Where litigation or disputes would arise is outside the instrument’s text. The SoP is an administrative medical instrument applied within the VEA and MRCA frameworks. Disputes concerning the application of a Statement of Principles are resolved through the administrative review and appeal processes established under those Acts and through judicial review channels in federal tribunals and courts. The instrument does not set out appeal procedures or record any cases in which its provisions have been judicially tested.

Practical significance of the absence of recorded litigation. The fact that the SoP itself contains no litigation history in the endnotes means that current authoritative judicial construction of any of its specific phrasing, thresholds or cross‑references is not recorded here. Practitioners should therefore be attentive to administrative decisions and tribunal or court rulings that may post‑date this compilation and that could interpret the SoP’s factors, definitions or their application to particular factual matrices. Those decisions, if any, would not appear in this instrument but may be relevant when advising clients on the merits of a claim or when anticipating evidentiary requirements in contested cases.

Areas of likely dispute given the text. While the instrument contains no recorded litigation, its structure identifies areas where disputes commonly occur in practice and where litigation could plausibly arise. Those areas include the determination of clinical onset and clinical worsening dates, proving cumulative exposures (for example 2,000 hours of exposure to certain fumes or chemicals), application of the 2‑year windows after cessation of exposure, the meaning of “related to relevant service” in borderline cases, and the interaction with other SoPs where factors refer to conditions covered elsewhere (s 10). The Schedule provides precise definitions for terms such as active epilepsy, chronic kidney disease and pack‑years, but factual application of those definitions to an individual’s records may be contested.

Record reliance and evidentiary disputes. The SoP’s reliance on medical, surgical, prescription and occupational records to establish factors creates a practical locus for disputes: incomplete or inconsistent records, differing clinical opinions, or absence of contemporaneous documentation may lead to contested administrative decisions that are then appealed. The instrument does not itself report outcomes of such disputes.

In summary, this compilation contains no litigation history. Practitioners should check contemporary administrative decisions, tribunal determinations and court judgments arising after the compilation date to determine whether the SoP has been judicially interpreted in any material way.

This instrument sets out precise factors and definitions that simplify some causation assessments but also create traps for claimants and practitioners. The following are specific pitfalls and practical risks to watch for when advising on or preparing a hypogonadism claim under the VEA/MRCA framework.

Binary and strict thresholds. Many factors are expressed in definitive terms that leave little room for clinical nuance. For example, the surgical factor requires excision of both ovaries or testes or a single functional gonad where only one exists (s 8(5)). Exposures or injuries that are clinically relevant but do not meet the exact wording risk exclusion. Practitioners must map the facts precisely to the provision’s text.

Temporal windows and cumulative thresholds. Several factors contain temporal windows that a claimant must meet. For inhalation or contact with specified metals or chemical agents the instrument requires cumulative exposure of at least 2,000 hours and, if exposure ceased before clinical onset or worsening, then onset/worsening must occur within two years of cessation (s 8(26)-(27), s 8(56)-(57)). Establishing cumulative hours can be difficult long after service: rosters, duty statements and industrial hygiene records may be incomplete. Similarly, immune checkpoint inhibitor exposure must have occurred within one year before onset or worsening (s 8(23), s 8(53)). GnRH agonist/antagonist therapy thresholds (one year of therapy within two years before onset/worsening at s 8(20) and s 8(50)) require precise treatment timelines.

Drug‑related tests require dechallenge/rechallenge or fixed durations. Some factors require evidence of clinical improvement within two months of discontinuing or tapering a drug, or redevelopment on rechallenge, and the drug must have been taken for at least 30 days before onset/worsening (s 8(25), s 8(55)). That timing and response evidence is often unavailable, particularly where the drug remains clinically necessary and cannot be ceased or substituted. The instrument acknowledges drugs “which cannot be ceased or substituted” (s 8(24), s 8(54)) but these entries impose a higher evidentiary demand where cessation evidence would normally be used.

Sex‑specific factors. Several factors apply to one sex only. For instance, testicular varicocoele appears as a male‑only factor (s 8(12), s 8(42)), alcohol use disorder is male only (s 8(29), s 8(59)), and being underweight is female only (s 8(30), s 8(60)). Practitioners must avoid assuming symmetry in the factors and should check sex or biological status where a claimant’s sex or gender history may complicate application.

Exclusions and diagnostic labels. The SoP excludes heritable and congenital hypogonadism, compensated hypogonadism, diminished ovarian reserve, natural menopause and abnormal semen analysis (s 6(2)(c)). Claims framed as infertility based solely on abnormal semen analysis will not qualify under this SoP unless the infertility meets the Schedule definition of infertility (inability to conceive after 12 months of unprotected intercourse, use of ART, or azoospermia) and is associated with endocrine or gonadal pathology (s 6(2)(b) and Schedule 1).

Worsening factors are limited by s 9(2). Subsections 8(31)-8(61) addressing clinical worsening apply only to material contribution to, or aggravation of, hypogonadism where the person’s hypogonadism was suffered or contracted before or during (but did not arise out of) the person’s relevant service (s 9(2)). That is a technical limitation that can catch claimants who had hypogonadism that arose out of service or who developed hypogonadism during service that was directly caused by service. Practitioners must parse the pre‑existing or contracted‑before/during but not arisen‑out‑of language carefully; using an aggravation factor for a condition that arose out of service is not permitted by that provision.

Proving “related to relevant service”. Section 9(1) requires that the existence of any factor must be related to the person’s relevant service. That relational element is not defined in the instrument. In practice, establishing that relationship will often require linking the qualifying event or exposure to a specific period or location of service, and that linkage is factually dependent on service records, unit histories, occupational exposure data and medical notes. Absence or ambiguity in those records may result in unsuccessful claims.

Inability to obtain appropriate clinical management as a factor. Factor 61 permits “inability to obtain appropriate clinical management for hypogonadism” to be a qualifying factor. This creates evidentiary complexity: what constitutes “appropriate clinical management” and how to show it was unavailable as a result of relevant service circumstances. Practitioners should compile contemporaneous clinical correspondence, referrals, wait‑lists, and administrative records that demonstrate barriers to care.

Death linkage complexities. Deaths where hypogonadism “contributed to” a terminal event are included (s 6(3) and Schedule 1 terminal event definition). Demonstrating contribution to a terminal event such as pneumonia or cardiac arrest requires nuanced clinical evidence; death certificates alone may be insufficient. Collating comprehensive final‑hospital records and specialist opinions is likely necessary.

Cross‑SoP dependencies. Section 10 requires application of other SoPs where a factor refers to a disease covered by another SoP. Practitioners must identify and consult the relevant other SoP(s) and ensure those criteria are satisfied. Failure to do so may result in incomplete causation submissions.

Specified lists must be checked precisely. The Schedule defines Specified List 1 and Specified List 2 drugs, specified infiltrative diseases, specified metals and specified chemical agents. For example, Specified List 1 includes alkylating agents, anthracyclines, ibiraterone and platinum compounds. Specified List 2 includes androgens, antipsychotics, opioids and other categories. A claimant whose therapy involves a drug not named in the lists may not meet the listed drug factors. Practitioners should cross‑check the exact lists when preparing submissions.

Measurement of pack‑years and BMI histories. For female smoking exposure the instrument requires at least five pack‑years and onset/worsening within ten years of cessation (s 8(28), s 8(58) and Schedule 1). The Schedule explains how to calculate pack‑years, including equivalents for pipe tobacco and cigars. Similarly, “being underweight” is BMI ≤ 18.5, and the female underweight factor requires sustained underweight for at least five years prior to onset/worsening (s 8(30), s 8(60) and Schedule 1). Longitudinal weight records are therefore necessary to meet these tests.

In sum, the SoP’s specificity helps to make causation determinations predictable in some cases but creates numerous documentary requirements and strict temporal thresholds that can defeat otherwise plausible medical connections unless the supporting evidence is comprehensive and precisely aligned with the instrument’s wording.

Preparing a claim under this SoP requires deliberate evidence collection and careful mapping of clinical and service facts to the instrument’s enumerated factors and Schedule definitions. The following practical steps set out what practitioners and claimants should assemble and how to present it to maximise the chance of satisfying the SoP.

1. Identify the relevant SoP factors and definitions. Start by identifying which subsection(s) of section 8 (onset or worsening) the claimant seeks to rely on. Check sex‑specific factors, the timing requirements in each factor, and any cross‑references to other SoPs per section 10. Confirm which version of the SoP was in force at the time relevant to the claim (use the Legislation Register and the endnotes’ amendment history).

2. Establish clinical onset and/or clinical worsening dates. The SoP differentiates between factors relevant to clinical onset and those relevant to clinical worsening (s 8 and s 9). Document the earliest clinical signs, first diagnostic tests, specialist letters, hormone test results, and dates of treatment initiation. Where onset or worsening timing is contested, obtain detailed endocrinology and specialist reports that explicitly state opinion on timing relative to service or exposures.

3. Compile full medical records. Collect hospital records, surgical notes (especially for excisions of ovaries/testes), oncology records for radiotherapy and chemotherapy regimens (include field descriptions if possible), pathology reports, infectious disease records, endocrine testing (e.g., FSH, LH, testosterone/estradiol), semen analyses where relevant (bearing in mind abnormal semen analysis alone is excluded), and any bone marrow or stem cell transplant records (s 8(15), s 8(19), s 8(6), s 8(5)). Label and index these records against the specific subsection of s 8 they evidence.

4. Document drug histories with dates and doses. For drug‑related factors, supply prescription records, pharmacy dispensing histories and clinician letters that provide start and stop dates, cumulative duration, and records of any dose tapering. For factors that require dechallenge/rechallenge evidence (s 8(25), s 8(55)), include records of clinical improvement after discontinuation or documented recurrence on rechallenge. For Specified List 1 or 2 drugs (Schedule 1), identify the exact drug and treatment duration to confirm alignment with the lists.

5. Gather service and occupational exposure evidence. Where factors depend on exposure or service events, secure Defence service records showing deployment locations, duties, exposure incidents, industrial hygiene surveys, radiation dosimetry records (if available), and unit rosters indicating time spent in duties that produced inhalation/chemical exposure. For cumulative exposure tests (2,000 hours), calculate cumulative duty hours and support with rosters, training records and employment histories. For radiation factors (s 8(6), s 8(36)), obtain oncology radiotherapy records and treatment plans showing whether gonads were in the field.

6. Collect lifestyle and anthropometric records. For pack‑year smoking factors (female only) assemble smoking histories with quantified daily consumption and duration; the Schedule provides the calculation method for pack‑years. For being underweight (female) document serial weight and height records to establish BMI ≤ 18.5 and sustained duration of at least five years. For alcohol use disorder (male only) provide diagnostic records, treatment notes and relevant assessments.

7. Obtain specialist opinions that apply the SoP language. Commission treating endocrinologists or other relevant specialists to prepare medico‑legal statements that explicitly address whether the claimant meets the specific SoP factor(s), apply the Schedule definitions, and express an opinion on the relationship to relevant service. Where a factor requires service‑relatedness (s 9(1)), ask the specialist to comment on whether the identified factor was linked to the service exposure or event, and why.

8. For death claims, document contribution to terminal event. Assemble death certificates, terminal hospital records, specialist correspondence, autopsy reports where available, and expert opinions linking hypogonadism to the terminal event defined in Schedule 1. The expert opinion should explain the causal pathway by which hypogonadism contributed to the terminal event.

9. Address cross‑SoP references. If any factor refers to another disease covered by a separate SoP (s 10), obtain and apply that SoP’s factors and include evidence satisfying those factors. Cross‑reference all other RMA SoPs that touch on infections, infiltrative diseases or neoplasms named in Schedule 1.

10. Evidence inability to obtain appropriate clinical management. If relying on factor 61, compile administrative and clinical records showing attempts to obtain management, refusals, unavailability of services, delay documentation, or service‑specific obstacles. Provide contemporaneous correspondence, referral letters, appointment wait times, and Defence administrative records where relevant to demonstrate deprivation of treatment or access that was connected to service.

11. Present a mapped claim bundle. Prepare a claim bundle that maps each evidentiary item to the specific SoP subsection it is intended to satisfy. Include a concise table of contents that states the factor relied on, the documents substantiating it and the relevant Schedule definitions. Where temporal calculations are necessary (for example, pack‑years or cumulative hours), provide worked calculations and cite the underlying records.

12. Anticipate likely queries and prepare clarifying statements. Decision‑makers may request clarification on cumulative exposures, dose durations, or whether a drug “cannot be ceased or substituted.” Prepare clear client statements and clinician addenda that address these questions with documentary support.

13. Keep contemporaneous service records and preserve evidence. Where possible ensure service records, industrial hygiene surveys, rosters and medical records are preserved. If records are missing, obtain statutory declarations by colleagues or supervisors detailing duties, exposure frequency and duration. Be aware that the SoP requires linkage to relevant service (s 9(1)): where records are silent, credible contemporaneous evidence becomes critical.

14. Confirm the operative SoP version and check for amendments. Use the Legislation Register and RMA publications to confirm which version of the SoP is in force at the time of decision, noting the compilation and amendment history in the endnotes (Endnote 3 and 4). Pay special attention to changes in the Schedule definitions (for example immune checkpoint inhibitor was updated by No. 52 of 2022).

15. Prepare for review routes. If an initial decision is adverse, advise the client about internal review, merits review or judicial review paths available under the VEA/MRCA frameworks and keep documentation ready for review proceedings. While the SoP gives the decision‑maker the medical test, review bodies will focus on whether the facts meet that test.

Following these steps aligns the claim presentation with the SoP’s precise wording, the Schedule definitions and the temporal and quantitative thresholds that the instrument sets. The practical compliance burden falls on claimants to assemble often dispersed evidence that demonstrates both the presence of a qualifying factor and its relationship to relevant service.
