Statement of Principles concerning hyperthyroidism and thyrotoxicosis (Balance of Probabilities) (No. 6 of 2022)

The central legal and medical concepts in the instrument are defined and deployed to determine when hyperthyroidism or thyrotoxicosis (or death from them) can be connected to relevant service on the balance of probabilities. The instrument distinguishes between hyperthyroidism and thyrotoxicosis by definition (ss 7(2)-(3)), and it expressly excludes certain thyroid disorders from its scope, directing those cases to other Statements of Principles (ss 7(2)(b)(iii)-(v), 7(3)(b)(iii)-(v), and notes 3 and 4 to each).

Hyperthyroidism is defined as a functional endocrine disorder in which the thyroid gland synthesises and secretes excessive amounts of thyroid hormone sufficient to produce clinical signs or warrant treatment (s 7(2)(a)). Thyrotoxicosis is defined as the systemic effect of inappropriately high thyroid hormone levels, whether endogenous or exogenous, that produce clinical signs or warrant treatment (s 7(3)(a); Schedule 1 notes 1-2). Both conditions may be acute or chronic and can present as thyrotoxic crisis; thyrotoxic crisis is defined in the Schedule as a constellation of severe, life‑threatening symptoms with biochemical evidence of elevated thyroid hormones (Schedule 1).

The instrument proceeds from a causation‑by‑factors approach: it lists discrete factors that, if proven to have existed and to be related to the person’s relevant service, must exist before a decision‑maker can say that, on balance of probabilities, the condition or death is connected with service (s 9). These factors include exposures (for example iodine excess, iodine‑containing radiographic contrast agents, specific drugs including amiodarone, minocycline and a specified list of drugs), neoplastic causes (pituitary adenoma, chorionic gonadotrophin‑secreting neoplasm, primary or metastatic thyroid neoplasm), mechanical events (trauma to the thyroid, surgery), ingestion of excess thyroid hormone, and the inability to obtain appropriate clinical management (s 9(1)-(23)). For many factors the Statement prescribes precise temporal windows (for example iodine excess within 3 months before clinical onset, amiodarone for at least 2 weeks within the 1 year before onset, minocycline for at least 6 months within 3 months before onset) and numerical thresholds (see Schedule 1 definition of iodine excess).

An important procedural concept is the linkage between the factor and relevant service. Section 10 requires that any factor relied upon must be related to the person’s relevant service. The Schedule defines “relevant service” to mean eligible war service (other than operational service) under the VEA, defence service (other than hazardous service and British nuclear test defence service) under the VEA, or peacetime service under the MRCA. Section 10(2) creates a narrower application for the factors in subsections 9(12)-9(23) , the aggravation material contribution factors , limiting them to cases where the hyperthyroidism or thyrotoxicosis was suffered or contracted before or during, but did not arise out of, the person’s relevant service.

Finally, the instrument includes an inter‑Statement cross‑reference mechanism: where a factor in s 9 points to an injury or disease already covered by another Statement of Principles, the other Statement governs that aspect of causation (s 11). The Schedule supplies definitional precision for terms such as “iodine excess”, “acute precipitating event”, “chorionic gonadotrophin‑secreting neoplasm”, “struma ovarii”, and the numerical cut‑offs for urinary iodine concentration and average intake that constitute iodine excess.

The instrument targets claimants and decision‑makers involved in claims under the VEA and MRCA. By its terms it applies to claims to which section 120B of the Veterans’ Entitlements Act 1986 or section 339 of the Military Rehabilitation and Compensation Act 2004 applies (s 5). Those statutory references indicate that the Statement is used in the statutory framework that determines whether a disease or death is connected with relevant service for the purposes of veterans’ entitlements and military compensation. The Schedule defines “relevant service” to include eligible war service (other than operational service), defence service (other than hazardous service and British nuclear test defence service) under the VEA, or peacetime service under the MRCA.

Directly affected individuals are therefore veterans or members of the Forces who lodge claims invoking the connection between hyperthyroidism or thyrotoxicosis (or death from those conditions) and their relevant service. Health practitioners and medico‑legal advisers who prepare clinical evidence for such claims are affected because the Statement prescribes the factors and temporal/numerical thresholds that the decision‑maker will evaluate. Administrative decision‑makers in the Departmental processes implementing the VEA and MRCA will apply the Statement as the medical‑scientific yardstick when assessing causation on the balance of probabilities; the Statement was determined by the Repatriation Medical Authority under s 196B(3) (s 3) and contains the RMA’s view as to the probabilities based on the sound medical‑scientific evidence available (s 8).

The instrument also affects related entitlements in the event of death. Section 7(4) includes death from hyperthyroidism or thyrotoxicosis, defined to include death from a terminal event or condition that was contributed to by the person’s hyperthyroidism or thyrotoxicosis. The Schedule’s definition of “terminal event” lists proximate causes such as pneumonia, respiratory failure, cardiac arrest, circulatory failure and cessation of brain function. Where death is claimed as connected to service via the underlying thyroid condition, surviving dependants or estates pursuing benefits under the VEA/MRCA framework will need to show the same factor/service nexus required for living claimants.

Certain clinical subgroups are explicitly outside the Statement’s scope and therefore are affected differently. The instrument excludes Graves disease, toxic multinodular goitre and toxic thyroid adenoma from its definition of hyperthyroidism and thyrotoxicosis (s 7(2)(b)(iii)-(iv), 7(3)(b)(iii)-(iv)) and notes that those conditions are covered by separate Statements of Principles. People whose thyroid disease is due to those excluded conditions must rely on the applicable other Statements rather than this instrument. Similarly, where a factor in s 9 refers to an injury or disease that is covered by another Statement, s 11 directs that the other Statement’s factors apply.

Finally, the instrument affects claim preparation practice because it sets out narrow temporal windows and defined exposure thresholds. Claimants who cannot document exposures within the prescribed windows, or cannot show that the factor was related to their relevant service, will not meet the criterion established by this Statement.

The Statement of Principles is an evidentiary instrument rather than a statute that imposes civil or criminal duties. Nonetheless, it sets binding medical criteria that decision‑makers are to use when assessing causation in relevant claims under the VEA and MRCA framework. The Repatriation Medical Authority, having determined the Statement under s 196B(3) of the VEA (s 3), states its view that hyperthyroidism and thyrotoxicosis can be related to relevant service on the balance of probabilities, based on the sound medical‑scientific evidence available (s 8). The Statement thus performs the legal function of prescribing which factors, and under what temporal and quantitative conditions, must exist before a decision‑maker can find connection.

For decision‑makers assessing claims, the key duty is to apply the Statement’s factors when determining connection. Section 9 curates a list of factors that “must exist” before a finding of connection on the balance of probabilities. Section 10 requires that any factor relied upon must be related to the person’s relevant service. For aggravation or material contribution (subsections 9(12)-9(23)) there is an additional application constraint: those factors apply only where the person’s hyperthyroidism or thyrotoxicosis was suffered or contracted before or during, but did not arise out of, the person’s relevant service (s 10(2)). Where a factor cited in s 9 refers to an injury or disease that is the subject of another Statement of Principles, s 11 requires that the factors in that other Statement apply in accordance with its terms.

For claimants, the practical right is to have their claim assessed against the medical criteria set by the RMA: if they can prove a factor in s 9, show the factor was related to their relevant service (as defined in the Schedule), and satisfy any timing/threshold requirements, then under the Statement a decision‑maker is in a position to conclude that connection exists on the balance of probabilities. The Statement also provides the right to rely on death being included where hyperthyroidism or thyrotoxicosis “contributed to” a terminal event or condition (s 7(4) and Schedule definition of terminal event).

The instrument does not itself create or modify the substantive entitlement rules under the VEA or MRCA, nor does it set any administrative remedies, appeal rights, or payment mechanisms. Those rights and duties remain governed by the parent Acts. The Statement is a binding medical‑scientific input into the causation element of entitlement determinations; it constrains and focuses the evidence that must be adduced by claimants and assessed by decision‑makers.

The Statement of Principles contains no penalty, sanction or criminal enforcement measures within its text. It is a medico‑legal instrument that supplies prescribed factors for establishing service connection in claims under the VEA and MRCA. The instrument does not purport to impose regulatory offences, civil fines, or enforcement powers. Its enforceability is functional and indirect: it is enforced through the claims assessment process under the VEA and MRCA. Adverse or favourable findings using the Statement will flow into entitlement decisions governed by those Acts, and any consequences, administrative actions or penalty regimes are those established by the VEA, MRCA and their administrative frameworks rather than by this instrument itself.

The Repatriation Medical Authority’s role is to formulate the Statement under its statutory power (s 3). The instrument records the RMA’s view as to the probability of causation based on medical evidence (s 8); decision‑makers applying that Statement must accept the RMA’s prescribed factors as the relevant medical yardstick. The practical effect is that a decision‑maker who wants to find connection for hyperthyroidism or thyrotoxicosis on the balance of probabilities will, in most cases, need to identify one or more of the factors in s 9 and establish the required relationship to relevant service per s 10. Where there is a dispute about whether the Statement was applied correctly, remedies and appeals would be pursued under the VEA or MRCA statutory review and merits/administrative review mechanisms, not under this instrument’s text.

Because the Statement institutes specific temporal windows and numerical thresholds (for example the Schedule’s definition of iodine excess), failure to prove the required facts within those parameters will lead to a negative causation finding, which may have the practical effect of denying entitlements. That practical consequence is the closest analogue to enforcement contained in the instrument, but any contestation of that outcome must proceed through the legal and administrative pathways provided in the parent Acts, not through penalties contained in the Statement.

The Statement operates as a subsidiary medical‑evidentiary instrument within the VEA/MRCA legal architecture. It is made under subsection 196B(3) of the Veterans’ Entitlements Act 1986 (s 3) and expressly applies to claims to which section 120B of the VEA or section 339 of the MRCA apply (s 5). Those cross‑references place the Statement into the statutory claim assessment regime: it supplies the medical criteria for deciding whether hyperthyroidism or thyrotoxicosis is connected to relevant service for the purposes of the VEA and MRCA.

The Schedule defines “relevant service” in terms that mirror the VEA and MRCA service categories: eligible war service (other than operational service) and defence service (other than hazardous service and British nuclear test defence service) under the VEA, and peacetime service under the MRCA. This means that the Statement’s factors must be related to those defined categories of service to establish connection (s 10, Schedule 1). The instrument therefore interacts with the statutory concepts of service and with the entitlement rules and procedures contained in the VEA and MRCA.

Section 11 creates an explicit mechanism for interaction with other Statements of Principles determined under s 196B(3). If a factor in s 9 refers to an injury or disease that is already the subject of another Statement, then the factors in that other Statement apply “in accordance with the terms of that Statement of Principles as in force from time to time” (s 11). Practically, this means that where a Factor cross‑refers to, for example, toxic multinodular goitre, toxic thyroid adenoma or Graves disease, the decision‑maker must consult and apply the applicable Statement for that disease rather than this instrument’s factors. The instrument itself includes notes pointing claimants and decision‑makers to the other Statements for those exclusions (s 7 notes, Schedule references).

There is also implicit interaction with medical records law, privacy legislation and administrative law because the Statement’s operation in claims will require the collection, submission and assessment of clinical evidence and exposure histories. The Statement sets temporal and quantitative evidentiary thresholds (for example the iodine intake and urinary iodine concentrations in Schedule 1) that must be met. How those thresholds are evidenced (medical records, laboratory reports, prescribing records, imaging documentation of administered contrast) will be governed by the evidentiary and procedural rules of the VEA/MRCA claims process and any applicable privacy or records statutes. The instrument itself does not regulate those processes, but it shapes what evidence is necessary and hence interacts indirectly with procedural and records regimes.

Finally, the repeal of the prior Statement (No. 28 of 2013) by s 4 indicates an amendment interaction: claims made after the commencement will be assessed against this instrument rather than the repealed Statement. The instrument’s commencement date is 31 January 2022 (s 2), and it was determined on 24 December 2021. Decision‑makers and advisers must therefore note which Statement applies at the relevant decision date to ensure correct application.

This instrument formally repeals the earlier Statement of Principles concerning hyperthyroidism and thyrotoxicosis No. 28 of 2013 (Federal Register of Legislation No. F2013L00724) by section 4. The instrument itself is identified as No. 6 of 2022 and was dated 24 December 2021 (front matter and s 1). It commences on 31 January 2022 (s 2), at which point the 2013 Statement is replaced for the purposes of the VEA/MRCA claims to which it applies.

The instrument contains internal notes that identify cross‑references and delegations to other Statements where particular diseases are excluded (for example Graves disease and toxic multinodular goitre are stated to be covered by other Statements , see notes in ss 7(2)-(3)). Section 11 establishes that if a factor in s 9 refers to an injury or disease governed by another Statement, the factors of that other Statement apply “as in force from time to time”, thereby accommodating future amendments to other Statements without amending this instrument.

Beyond those explicit actions , determination by the Repatriation Medical Authority under s 196B(3) (s 3), repeal of the 2013 Statement (s 4), commencement date (s 2) , the instrument contains no schedule of past amendments, transitional provisions or staged implementation steps. The Schedule provides definitions and numerical thresholds that establish the substantive content; any future amendment to those definitions (for example changing the numerical cut‑offs for iodine excess) would require a further instrument under the same statutory power or an amendment to this instrument.

The instrument does not contain any savings provisions or retrospective application wording. Its application clause (s 5) states that it applies to claims to which s 120B of the VEA or s 339 of the MRCA applies, without specifying temporal limits or transitional arrangements relative to the 2013 Statement. Practitioners should therefore check administrative guidance and the decision date to determine which Statement governs a particular claim; the plain statutory mechanics in this instrument effect a repeal and replacement as of the commencement date.

The instrument itself does not record any case law or litigation history. It is a Statement of Principles determined by the Repatriation Medical Authority and contains no references to judicial decisions within its text. Because the Statement operates within the VEA/MRCA statutory framework, any litigation or judicial review relating to the application of this Statement would be conducted under the parent Acts and relevant administrative or merits review processes, but the instrument contains no internal record of such proceedings.

Practitioners and researchers seeking litigation history must therefore consult external sources: decisions of tribunals or courts that have engaged with Statements of Principles, or litigation that contests specific claim outcomes where this Statement was applied. The instrument’s section 11 contemplates ongoing interaction with other Statements “as in force from time to time”; any litigation that interprets those other Statements may indirectly affect how the factors in this Statement are applied, but no such decisions are cited here.

This Statement’s practical effect may generate administrative decisions that are subject to review in the normal statutory channels under the VEA and MRCA. However, the instrument itself provides no narrative or annex of cases, no cross‑citation to tribunal or court authority, and no record of challenges to the RMA’s determination. In short, there is no litigation history contained within the instrument and no case law referenced; the file on judicial engagement will be external to this document.

Several technical and practical traps for claimants and advisers flow directly from the Statement’s structure and text.

1. Exclusions by disease label. The Statement explicitly excludes Graves disease, toxic multinodular goitre and toxic thyroid adenoma from its definitions of hyperthyroidism and thyrotoxicosis (ss 7(2)(b)(iii)-(v), 7(3)(b)(iii)-(v)). These exclusions mean that a claimant with those diagnoses must rely on the separate Statements of Principles that cover them rather than this instrument. Advisers should not attempt to shoehorn such diagnoses under this Statement.

2. Narrow temporal windows and quantitative thresholds. Many factors have precise time windows. For example, iodine excess must exist within 3 months before clinical onset (s 9(1) and s 9(12)), an iodine‑containing radiographic contrast agent must have been administered within 3 months before clinical onset or clinical worsening (s 9(2), s 9(13)), amiodarone must have been taken for at least 2 weeks within the 1 year before onset or worsening (s 9(3), s 9(14)), minocycline for at least 6 months within the 3 months before onset or worsening (s 9(5), s 9(16)). The Schedule defines iodine excess numerically (average intake >1,100 micrograms/day for adults or >900 micrograms/day for under 18s for at least 3 months; or urinary iodine concentration >300 micrograms/litre (>500 micrograms/litre for pregnant women)). Failure to document exposures within these windows or meet the numeric cut‑offs will likely defeat the factor.

3. Differing tests for onset versus worsening and for first presentation as thyrotoxic crisis. Some factors are specific to thyrotoxic crisis or to thyrotoxicosis (s 9(10), s 9(11), s 9(21), s 9(22)). If the presentation is a thyrotoxic crisis, additional causal elements such as an acute precipitating event within 48 hours before clinical onset or worsening are required (s 9(10), s 9(21); Schedule definition of acute precipitating event and examples). Advisers must carefully characterise the clinical presentation.

4. Relationship to relevant service. Section 10(1) requires that any factor relied upon must be related to the person’s relevant service. The Schedule defines the categories of relevant service. Importantly, s 10(2) limits the application of subsections 9(12)-9(23) (the factors relevant to clinical worsening or aggravation) to cases where the condition was suffered or contracted before or during, but did not arise out of, relevant service. This is a technical causation constraint: if the disease “arose out of” service then the aggravation factors in 9(12)-(23) do not apply in the same way. Advisers should record the temporal sequence between disease onset and service.

5. Cross‑reference to other Statements. Where a factor refers to another injury or disease with a Statement of Principles, the other Statement’s factors apply (s 11). That can introduce complexity if multiple Statements interact. For instance, if a factor points to a form of thyroiditis covered by another Statement, the practitioner must consult that Statement instead of relying only on this instrument.

6. “Inability to obtain appropriate clinical management” (s 9(23)). This factor can be relevant to claims of material contribution or aggravation, but the Statement does not define “appropriate clinical management” within its text. Claimants relying on s 9(23) should document attempts to obtain care, availability of treatment, and reasons care was not obtained. The absence of a definition introduces evidentiary and implementation uncertainty.

7. No penalty provisions and administrative consequences. Because the Statement contains no enforcement clauses, the only way it affects outcomes is through its integration into VEA/MRCA decision processes. Practitioners must therefore ensure evidence is assembled in the form and time frame needed by those decision processes; failing to do so will lead to a negative finding without an internal appeal mechanism contained in the Statement itself.

8. Death causation complexity. The instrument includes death where hyperthyroidism or thyrotoxicosis contributed to a terminal event (s 7(4) and Schedule definition of terminal event). Establishing that contribution will require both clinical proof that the underlying thyroid disease existed and evidence of causal contribution to the terminal event listed. Medical records and cause‑of‑death documentation will therefore be central.

9. Drug lists and completeness. The “specified list of drugs” in the Schedule is limited to immune checkpoint inhibitors, interferon alpha, interleukin‑2, lenalidomide, lithium carbonate and tyrosine kinase inhibitors. If a claimant took a drug not on that list, the Statement’s s 9(4,15) factors will not apply; counsel and clinicians should consider whether other factors are available under s 9 or another Statement.

10. Burden of proof and practical evidentiary burden. The Statement sets the factual framework necessary to meet the balance of probabilities test, but proving those facts remains the claimant’s evidentiary task. Documentary evidence such as prescribing records, pathology, laboratory iodine assays, radiology records demonstrating contrast administration, operative reports for thyroid trauma, and cancer histopathology will typically be needed to meet the factor requirements. Where such documentation is absent, the claimant faces a practical evidentiary hurdle.

For claimants, clinicians and advisers preparing or litigating claims that depend on this Statement, compliance means organising and adducing specific, time‑stamped medical and exposure evidence mapped to the factors and definitions in the instrument.

1. Identify the applicable Statement and relevant service. Confirm the claim falls within section 120B of the VEA or section 339 of the MRCA (s 5). Identify the claimant’s relevant service category using the Schedule’s definition of “relevant service” so that any factor relied upon can be linked to that service per s 10.

2. Establish which condition is in scope. Confirm that the claimant’s diagnosis falls within the Statement’s definitions of hyperthyroidism or thyrotoxicosis (ss 7(2)-(3) and Schedule notes). If the diagnosis is excluded (for example Graves disease, toxic multinodular goitre, toxic thyroid adenoma) obtain the applicable Statement of Principles for those diseases instead.

3. Map clinical onset/worsening dates. Determine precise dates for clinical onset and any clinical worsening. Many factors are time‑sensitive: for example iodine excess or administration of iodine‑containing radiographic contrast agent must be within 3 months before onset or worsening (s 9(1)-(2), s 9(12)-(13)). Amiodarone exposure must be at least 2 weeks within 1 year before onset or worsening (s 9(3), s 9(14)). Minocycline must be for at least 6 months within 3 months before onset or worsening (s 9(5), s 9(16)). Ensure dates are documented in clinical notes, prescribing records, or hospital records.

4. Gather documentary evidence for each relied factor. Typical documents include:

   • Laboratory reports showing elevated T3/T4 and suppressed TSH, plus urinary iodine concentration if available (Schedule definition of iodine excess).
   • Dietary/supplement histories corroborated by purchase records or clinician notes to evidence average iodine intake where urinary iodine is not available (Schedule definition of iodine excess).
   • Radiology reports and hospital records evidencing administration of iodine‑containing contrast agents and dates (s 9(2), s 9(13)).
   • Prescribing and dispensing records for amiodarone, minocycline and the specified list of drugs with duration and dosage (ss 9(3)-(6), s 9(14)-(17); Schedule list).
   • Surgical and procedural notes for trauma involving the thyroid or surgery in the thyroid region (s 9(11)(d), s 9(22)(d); Schedule definition of trauma involving the thyroid).
   • Histopathology or imaging confirming primary or metastatic thyroid neoplasm or struma ovarii where relevant (ss 9(9), 9(11)(b), 9(22)(b), Schedule definitions).
   • Medical oncology documentation for chorionic gonadotrophin‑secreting neoplasms and tumour markers (ss 9(8), 9(19); Schedule definition).
   • Records documenting abrupt cessation of anti‑thyroid therapy or other acute precipitating events within 48 hours if the presentation is thyrotoxic crisis (s 9(10), s 9(21), Schedule definition of acute precipitating event).
   • Evidence of ingestion of excess thyroid hormone in medication, supplements or food within 3 months before onset or worsening for thyrotoxicosis cases (s 9(11)(e), s 9(22)(e)).
   • Records demonstrating inability to obtain appropriate clinical management where s 9(23) is relied upon, including correspondence, referral wait times, location of service, and contemporaneous clinical notes explaining lack of access.

5. Quantify iodine exposure where necessary. Use the Schedule’s numeric definitions for iodine excess: average intake >1,100 micrograms/day for adults (or >900 micrograms/day for those 18 and under) for a continuous period of at least 3 months; or urinary iodine concentration >300 micrograms/litre (>500 micrograms/litre for pregnant women). Where direct urinary assays are unavailable, document dietary and supplement intake and engage clinicians to assess whether the intake is likely to meet or exceed the defined thresholds.

6. Demonstrate relation to relevant service. For each factor, prepare evidence that links the exposure or event to the claimant’s relevant service. For example, show that an iodine‑containing contrast CT was administered during or as a consequence of military service, or that a drug was commenced while the person was on relevant service. Section 10 requires that the existence of the factor be related to relevant service; s 10(2) also constrains aggravation factors to cases where disease pre‑existed or was contracted before/during but did not arise out of service.

7. Address cross‑referencing Statements. If any factor points to a disease or injury that is the subject of another Statement of Principles, obtain and apply the applicable Statement (s 11). For example, if the underlying cause is a form of thyroiditis that is covered elsewhere, do not rely solely on this Statement.

8. Prepare medico‑legal statements that map facts to the Statement. Clinicians and medico‑legal advisers should produce focused opinions that: identify which s 9 factor(s) are present; state the dates and evidence that meet the temporal windows and thresholds; explain how the factor was related to relevant service; and, where necessary, explain causal contribution to death using the Schedule’s definition of terminal event.

9. Anticipate evidentiary weaknesses. Where direct laboratory evidence is absent, provide contemporaneous clinical notes and secondary records and explain gaps. For the “inability to obtain appropriate clinical management” factor, document efforts to obtain care, system constraints and clinician advice recorded at the relevant time.

10. Timing and transitional awareness. Confirm which Statement governs the claim by reference to the commencement date (31 January 2022) and the date of the alleged onset/worsening and decision. The 2013 Statement has been repealed by s 4 so claims after the commencement date should be assessed under this Statement, but practitioners should check administrative guidance and any transitional directives.

Applying the Statement strictly means mapping the claim to one or more of the s 9 factors and demonstrating the service link under s 10. Failure to map and document accordingly is the most common compliance failure. Ensure documentary proofs, date stamping, lab reports and clinical statements are assembled before lodging or during appeals.
