Statement of Principles concerning hypersensitivity pneumonitis (Balance of Probabilities) (No. 8 of 2020)

Hypersensitivity pneumonitis is defined in the instrument rather than by reliance solely on ICD code. The statutory meaning used here is a non‑infectious, immunological inflammation of the lung parenchyma secondary to inhalation, by a sensitised subject, of external antigens (s 7(2)(a)). The instrument expressly includes acute, subacute and chronic hypersensitivity pneumonitis (s 7(2)(b)) and excludes fibrosing interstitial lung disease, bronchiolitis obliterans organising pneumonia, and lung inflammation resulting from antigen exposure by non‑inhalation routes (s 7(2)(c)). The RMA notes that although hypersensitivity pneumonitis attracts ICD‑10‑AM code J67, the operative meaning for the Statement is the statutory definition in s 7(2) (s 7(3)-(4)).

Key definitional scaffolding is in Schedule 1. “Antigen” is defined as an exogenous substance capable of stimulating a type III or type IV hypersensitivity reaction via non‑IgE responses and reacting with resulting specific antibody or sensitised T‑lymphocytes (Schedule 1). “Specific antigen responsible” is the antigen which the available clinical or laboratory evidence implicates as the cause of hypersensitivity pneumonitis in the patient (Schedule 1). The Schedule gives examples of antigen sources (animal dust, bird droppings, metalworking fluid contaminated with micro‑organisms, mouldy timber dust, certain varnishes and resins, sewage sludge contaminated with micro‑organisms, spores from specific puffballs), but these are illustrative rather than exhaustive (Schedule 1, Note 1).

Causation is expressed as an evidentiary checklist: at least one of the three factors in s 9 must exist, and that factor must be related to the person’s relevant service (s 9; s 10(1)). The three factors are: inhalation of the specific antigen before clinical onset (s 9(1)); inhalation of the specific antigen within 30 days before clinical worsening (s 9(2)); and inability to obtain appropriate clinical management for hypersensitivity pneumonitis (s 9(3)). The instrument treats death from hypersensitivity pneumonitis as included where death was contributed to by the condition, and “terminal event” is defined to include pneumonia, respiratory failure, cardiac arrest, circulatory failure, and cessation of brain function (s 7(5); Schedule 1).

The instrument also clarifies relationship-to-service limitations: the factors in s 9 must be related to “relevant service”, as that term is defined in Schedule 1 to mean eligible war service (other than operational under the VEA), defence service (other than hazardous service and British nuclear test defence service under the VEA), or peacetime service under the MRCA (Schedule 1). Subsections 9(2) and 9(3) are limited to matters of material contribution or aggravation where the condition was suffered or contracted before or during (but did not arise out of) relevant service (s 10(2)). Finally, the instrument provides a practical cross-reference rule: if a s 9 factor refers to an injury or disease covered by another Statement of Principles, the factors in that other Statement apply according to its terms (s 11).

The instrument directly affects persons making claims that fall within the specified statutory claims frameworks referenced in s 5: claims to which section 120B of the Veterans’ Entitlements Act 1986 or section 339 of the Military Rehabilitation and Compensation Act 2004 applies (s 5). Those claimants will include veterans and certain members of the Forces who seek to establish a connection between hypersensitivity pneumonitis (or death from it) and their relevant service as defined in Schedule 1. Relevant service is expressly defined to include eligible war service (other than operational service) and defence service (other than hazardous service and British nuclear test defence service) under the VEA, and peacetime service under the MRCA (Schedule 1).

Decision-makers who assess entitlement under the VEA and MRCA claims processes will be affected in the sense that this Statement supplies the RMA’s medical criteria that the decision-maker must apply when considering whether hypersensitivity pneumonitis is related to relevant service (s 3; s 8; s 9; s 11). Clinicians, treating practitioners, occupational and environmental specialists preparing evidence for claims are affected because the instrument identifies what counts as a “specific antigen responsible” and what sorts of exposure timing and management failures are relevant (Schedule 1; s 9). The Schedule’s examples of antigen sources (for instance, bird droppings, contaminated metalworking fluid, mouldy timber dust, certain varnishes and resins) will guide the types of exposure history and laboratory/clinical evidence likely to be presented.

Families and dependants of claimants who seek death benefits or entitlements where death was contributed to by hypersensitivity pneumonitis are included, because the instrument explicitly includes death from the condition where death was contributed to by the person’s hypersensitivity pneumonitis (s 7(5); Schedule 1 definition of terminal event).

The instrument also tangibly affects the scope of previous and future Statements of Principles. It repeals the prior Statement on extrinsic allergic alveolitis (No. 88 of 2011) (s 4), so stakeholders must use the new criteria for claims arising on or after commencement. Where exposure or disease overlaps with conditions covered by other Statements, s 11 requires application of those other Statements’ factors in accordance with their terms.

Indirectly, workplaces and employers might be affected in that evidence of workplace exposure can be material to a claim, but the instrument itself does not create workplace duties or regulatory obligations; it defines evidentiary criteria for claims under the VEA and MRCA frameworks (s 5; Schedule 1 examples).

The instrument itself does not create criminal offences or impose administrative fines. Its operative legal role is to set the medical causation criteria the Repatriation Medical Authority has determined under s 196B(3) of the VEA for hypersensitivity pneumonitis and death from it (s 3; s 8). The legal effect is procedural: these criteria are applied in deciding whether, on the balance of probabilities, hypersensitivity pneumonitis can be related to relevant service for the purposes of claims specified in s 5.

Key duties and rights established or implicated by the instrument, as expressed in its terms, include:

• The duty on decision-makers to apply these criteria when considering claims within the statutory claims frameworks cited in s 5. The instrument is made under the RMA’s statutory authority (s 3) and states the RMA’s view that connection is possible on the balance of probabilities (s 8); this renders the factors in s 9 the touchstone for causation analysis for such claims.
• A right for a claimant to have their claim assessed against these defined factors. A claimant who can establish at least one of the factors in s 9, and show that that factor is related to their relevant service (s 10(1)), meets the RMA’s threshold for saying the condition is connected to service on the balance of probabilities.
• Evidential obligations on claimants and their advisers to prove the factual elements of a factor. The Schedule defines “specific antigen responsible” as the antigen which the available clinical or laboratory evidence implicates (Schedule 1), which means that available clinical or laboratory evidence will be central to satisfying s 9(1) or s 9(2). That places a practical obligation on claimants to produce or facilitate the production of clinical and laboratory evidence, and detailed exposure histories.
• A limitation on how factors may be used to establish causation. Subsections 9(2) and 9(3) are limited to establishing material contribution or aggravation where the condition was suffered or contracted before or during but did not arise out of the relevant service (s 10(2)). That restricts the circumstances in which a claim based solely on recent inhalation within 30 days of worsening or inability to obtain appropriate care will be successful; the claimant must also fit the temporal and causal constraints in s 10(2).
• A cross-Statement rule: where a factor in s 9 refers to an injury or disease covered by another Statement of Principles, the factors in that other Statement apply as in force from time to time (s 11). That gives practitioners and decision-makers a duty to check other Statements for overlapping conditions.

The instrument’s definitions impose specific evidentiary boundaries. For instance, “antigen” is limited to non‑IgE mechanisms (Schedule 1), which narrows the immunological mechanisms that will be treated as relevant under this Statement. The exclusion of non‑inhalation antigen exposure (s 7(2)(c)) excludes conditions resulting from ingestion or acute anaphylaxis from being treated as hypersensitivity pneumonitis under this Statement.

The Statement does not create new criminal offences or administrative penalties. It is a technical medical criteria instrument made under the RMA’s statutory power (s 3) and is intended to be applied within the claims assessment processes that the VEA and MRCA provide for (s 5). The instrument does not itself specify enforcement mechanisms, compliance sanctions, remedy pathways, or administrative review processes; those procedural and remedial steps reside in the VEA and MRCA claims frameworks referenced but are not set out in this instrument.

Enforcement in practice will be administrative and evidentiary. The instrument prescribes the medical factors that must exist for a finding of service connection on the balance of probabilities (s 9). The practical enforcement mechanism is the decision-maker’s application of those factors when determining claims: if the required factor(s) and the service relationship (s 10(1)) are not established on the evidence, the claim will be unsuccessful within that administrative process. If they are established, the RMA’s view in s 8 supports a finding of connection on the balance of probabilities.

The only express statutory “effect” in the instrument is repeal of the prior Statement (s 4); that alters which medical criteria are applied to claims from the commencement date (s 2). The instrument does not authorise penal measures, impose obligations on third parties outside the claims process, or set licensing, inspection, or workplace compliance duties. Any compliance or enforcement actions that involve penalties would derive from other statutes or regulations not contained in this instrument.

Because the instrument is a statement of medical criteria rather than a prescriptive regulatory instrument, the primary implementation risk and enforcement issue is evidential: whether claimants can marshal clinical and laboratory evidence to establish “specific antigen responsible” or demonstrate inability to obtain appropriate clinical management where that is alleged (s 9; Schedule 1). The instrument does not prescribe evidentiary standards beyond the requirement that available clinical or laboratory evidence implicates the specific antigen (Schedule 1).

The instrument is explicitly tethered to, and operates within, the statutory claims frameworks of two Acts: the Veterans' Entitlements Act 1986 and the Military Rehabilitation and Compensation Act 2004. It is made under subsection 196B(3) of the VEA (s 3) and applies to claims that fall under section 120B of the VEA or section 339 of the MRCA (s 5). The instrument does not reproduce or expand the claims processes, payment entitlements, review rights, or remedies which exist in those Acts; it supplies medical causation criteria that must be applied within those existing statutory schemes.

Section 11 creates a direct internal interaction within the body of Statements of Principles: if a factor listed in s 9 is also a factor that refers to an injury or disease covered by another Statement of Principles, then the factors in that other Statement apply according to its terms as in force from time to time (s 11). This creates a legal mechanism for cross-referencing and deference to other RMA Statements where overlap exists between diseases or causal pathways. Practically, it means decision-makers and practitioners must consult other Statements when the factual issue implicates conditions covered elsewhere.

The instrument repeals the 2011 Statement of Principles concerning extrinsic allergic alveolitis (s 4). That repeal alters which RMA Statement is current for the specified condition from the commencement date (s 2). The instrument also references the ICD‑10‑AM code J67 (s 7(3)-(4)) but takes care to state that the operative meaning is the statutory definition in s 7(2). This creates an interaction with coding systems used in clinical records and administrative databases: while the ICD code remains relevant for clinical classification, the legal assessment of causation uses the instrument’s definitions.

Beyond the internal interactions with the VEA and MRCA and other RMA Statements, the instrument does not itself purport to alter workplace health and safety law, environmental law, or public health law. Evidence of exposure to antigens that arises in workplace or environmental contexts may be material to a claim, but obligations and enforcement in those sectors are governed by separate regulatory schemes not contained in this instrument. The instrument’s Schedule lists illustrative sources of antigens (Schedule 1, Note 1), which may overlap with regulatory considerations in other statute regimes; however, remediation, employer liability, or WHS regulatory action remains outside the instrument’s scope.

Because the instrument defines the medical criteria used in the administrative process, it will interact operationally with administrative law doctrines when decisions based on it are reviewed , for example, principles of evidence, reasonableness, and procedural fairness under the general law , but the instrument itself does not set out those review avenues or standards.

The instrument contains a short, explicit amendment history within its own text. It replaces and repeals the Statement of Principles concerning extrinsic allergic alveolitis No. 88 of 2011 (Federal Register of Legislation No. F2011L01447) (s 4). The new Statement is dated 28 February 2020 and commences on 23 March 2020 (s 2 and the opening material). No other amendments or prior versions are recorded in the instrument itself.

Because the instrument is made under subsection 196B(3) of the VEA (s 3), future amendments will depend on the RMA’s exercise of that statutory power and any consequential administrative action. The instrument’s s 11 contemplates that other Statements of Principles may be in force from time to time and that their factors will be applied where relevant; this creates a practical expectation that RMA Statements will evolve, but the instrument itself records only the immediate repeal of the 2011 Statement and the commencement of the 2020 instrument.

There is no schedule of staged amendments or grandfathering clauses in the instrument beyond the repeal. The commencement provision (s 2) fixes a single operative date and does not provide transitional detail; practitioners should therefore assume the instrument’s criteria operate for claims to which the relevant VEA and MRCA sections apply from the date of commencement forward. The instrument does not supply retrospective application rules or transitional entitlements; those matters, if relevant, will be determined by the VEA and MRCA frameworks and by the date of the claim and the relevant statutory rules, none of which are reproduced in this instrument.

The instrument itself does not record any litigation history. It contains no references to judicial decisions, no recitals of litigation outcomes, and no administrative appeals or review outcomes. It is a unilateral RMA medical statement, dated and sealed, and made under statutory authority (s 3). Because the instrument is a technical statement of medical causation criteria to be applied in administrative claims, it is possible that decisions applying the Statement could become the subject of judicial review, merits review, or appeals under the review regimes established by the VEA or the MRCA, but the instrument contains no record or example of such litigation.

The absence of litigation history in the instrument means that any interpretation disputes, issues of evidentiary sufficiency, or questions about the application of s 9 factors and s 10 linking to relevant service will have to be resolved in the administrative decision-making context and, if contested, in avenues for external review provided by the enabling statutes. The instrument’s s 11 cross-reference rule could generate factual or legal disputes where multiple Statements of Principles overlap; those disputes would be resolved by the decision-maker and, if appealed, by the relevant review bodies or courts according to the VEA and MRCA frameworks.

Practitioners should be aware that the instrument’s definitions (for example the immunological limitation of “antigen” to non‑IgE mechanisms in Schedule 1) and the exclusion list in s 7(2)(c) create interpretive questions that may be contested in particular cases. The instrument, however, provides no litigation guidance or examples of prior adjudications. Any litigation history that may emerge will be external to this document and will arise from application of these criteria in claims administration and review.

This instrument contains a number of precise drafting features and limitations that are easy to miss but matter for claims and evidence. Highlighted here are the points that commonly cause confusion or error if not read closely, with the controlling provisions cited.

• “At least one” factor suffices (s 9). A claimant does not need to prove all three factors; proving one factor in s 9, and that it is related to the person’s relevant service (s 10(1)), is the threshold. Practitioners should not assume cumulative proof is required where the text requires only one factor.
• The “specific antigen responsible” requires available clinical or laboratory evidence (Schedule 1). The Schedule defines “specific antigen responsible” as the antigen which the available clinical or laboratory evidence implicates. That shifts emphasis to documented clinical or laboratory linkage rather than speculative or non‑specific exposure histories.
• Immunological mechanism is limited (Schedule 1). The definition of “antigen” is restricted to triggers of type III or type IV hypersensitivity via non‑IgE responses. Immunological presentations relying primarily on IgE‑mediated mechanisms are outside the Schedule’s definition and therefore may not be treated as relevant under this Statement.
• Exclusions matter (s 7(2)(c)). The instrument explicitly excludes fibrosing interstitial lung disease, bronchiolitis obliterans organising pneumonia, and lung inflammation resulting from non‑inhalation antigen exposure such as ingested drugs or acute anaphylaxis. A diagnosis labelled generically as an interstitial lung disease will not automatically fall within this Statement’s scope unless it meets the statutory hypersensitivity pneumonitis definition.
• ICD‑10‑AM coding is not determinative (s 7(3)-(4)). Although hypersensitivity pneumonitis attracts ICD‑10‑AM code J67, the instrument says the statutory meaning in s 7(2) controls. Clinical records coded J67 should be checked against the statutory definition rather than treated as a definitive legal classification.
• Time-limited worsening factor is narrow (s 9(2); s 10(2)). Subsection 9(2) requires inhalation of the specific antigen within the 30 days before clinical worsening. That 30‑day window is strict in terms of what the Statement defines as a valid “worsening” linkage; proof of exposures outside that window will need to rely on other factors or other Statements.
• Service relationship is required for every factor (s 10(1)). Even where s 9(1) is established, the exposure must be related to the person’s relevant service. The instrument does not accept an unrelated exposure as sufficient for service connection.
• Subsections 9(2) and 9(3) have an additional restriction (s 10(2)). They apply only to material contribution to, or aggravation of, hypersensitivity pneumonitis where the person’s hypersensitivity pneumonitis was suffered or contracted before or during, but did not arise out of, the person’s relevant service. That means these two factors are not free-standing routes to connection in all circumstances; they are constrained to particular temporal and causal contexts.
• Cross-references to other Statements may change applicable tests (s 11). If a s 9 factor refers to an injury or disease already covered by another Statement of Principles, the other Statement’s factors apply. Practitioners must check for overlapping RMA Statements when preparing or adjudicating claims.
• Death is included but only where contributed to by the condition (s 7(5)). The Statement includes death from a terminal event or condition that was contributed to by hypersensitivity pneumonitis. Establishing contribution to the terminal event is therefore necessary for death benefits under this Statement; death from an unrelated terminal event is not covered.
• Repeal of the 2011 Statement may affect prior claims (s 4). The 2011 Statement’s factors have been repealed; practitioners must use the 2020 criteria for claims to which the VEA/MRCA sections apply from the commencement date. Be careful when relying on earlier opinions or precedent that predate the repeal.

These “gotchas” turn on precise statutory language. The Schedule’s examples of antigen sources are illustrative, not exhaustive (Schedule 1, Note 1), which means novel or uncommon antigens can be considered if clinical or laboratory evidence implicates them. Finally, because the instrument is a technical medical criterion, the main evidentiary traps are failing to document the exposure, the timing of onset/worsening, or the link to relevant service in the required terms.

For claimants, clinicians and advisers preparing evidence for claims under the VEA/MRCA provisions referenced in s 5, compliance means aligning factual proof with the instrument’s definitional and causation requirements.

Practical steps, grounded in the instrument’s language:

• Identify the diagnosis against the statutory definition. Confirm that the clinical diagnosis meets the Statement’s definition in s 7(2): a non‑infectious, immunological inflammation of the lung parenchyma secondary to inhalation by a sensitised subject, and not excluded by s 7(2)(c). Do not rely solely on ICD coding; the instrument instructs that the statutory meaning in s 7(2) governs (s 7(3)-(4)).
• Establish the “specific antigen responsible” using available clinical or laboratory evidence. The Schedule makes clear that the specific antigen is the one implicated by the available clinical or laboratory evidence (Schedule 1). Gather and present the available clinical laboratory results, serology/precipitins or other immunological test results where available, histopathology, imaging, and clinician reports that link a specific antigen to the patient’s illness. Where laboratory evidence is not available, detailed contemporaneous clinical records documenting exposure and clinical correlation will be important.
• Map exposure timing to the s 9 factors. The instrument requires that at least one of the factors in s 9 be present. For s 9(1), document inhalation of the specific antigen prior to clinical onset, including dates or reasonably precise timings and exposure circumstances. For s 9(2), evidence must show inhalation of the specific antigen within 30 days before clinical worsening, so document both the exposure timing and the clinical markers of worsening. For s 9(3), document attempts to obtain appropriate clinical management and the reasons why appropriate management was not obtained (for example, lack of access to specialists, absence of timely diagnosis, or systemic barriers). Ensure any assertion of inability to obtain appropriate clinical management is factually supported by dates, correspondence, referrals, and clinical notes.
• Tie the relevant factor to “relevant service” as defined. Every factor in s 9 must be related to the person’s relevant service (s 10(1)). The Schedule defines relevant service categories; therefore, create a clear service chronology linking the exposure to times, places, or duties that fall within the claimant’s relevant service. For subsections 9(2) and 9(3), ensure the temporal and causal constraints in s 10(2) are satisfied: they apply only to material contribution or aggravation where the condition was suffered or contracted before or during but did not arise out of the relevant service.
• Check for overlapping Statements (s 11). If any exposure or disease element overlaps with another Statement of Principles, apply that other Statement’s factors. Practically, identify whether a co-morbid or contributing disease is covered by another Statement and obtain supporting evidence in the form required by that Statement.
• Use the Schedule’s examples to inform but not limit evidence collection. The Schedule lists illustrative antigen sources (e.g. bird droppings, contaminated metalworking fluid, mouldy timber dust, certain varnishes and resins). Where exposures relate to these examples, gather specific workplace or environmental records, safety data sheets, maintenance logs, or witness statements that corroborate exposure. For less common antigens, focus on clinical/laboratory linkage as the Schedule requires.
• Document death causation with terminal event evidence when relevant. Where death is alleged to have been contributed to by hypersensitivity pneumonitis, compile clinical records showing that the terminal event (as defined in Schedule 1) was contributed to by the hypersensitivity pneumonitis, with coroner reports, hospital records, and treating clinician opinions as available.
• Be mindful of the balance-of-probabilities standard that the RMA states it has applied to reach its view (s 8). The Statement is premised on the RMA’s conclusion that, on the balance of probabilities, hypersensitivity pneumonitis can be related to relevant service. Accordingly, claim preparation should aim to meet that civil standard with contemporaneous documentation, clinical correlation, and laboratory support.

Operationally, clinicians and advisers should ensure records include: detailed exposure histories with dates and locations; clinical onset and worsening dates; results of relevant tests and imaging; records of referrals, attempts to obtain treatment and any barriers encountered; and service records that link exposure circumstances to relevant service as defined in the Schedule. For decision-makers, compliance means applying these criteria precisely, checking for exclusions in s 7(2)(c), and applying s 11 where other Statements are implicated.

The instrument does not prescribe specific laboratory tests or thresholds, so practitioners should present the available clinical and laboratory evidence that best supports the linkage. Finally, because the instrument repeals the prior 2011 Statement (s 4), parties should ensure that evidence and opinions rely on the 2020 criteria from the commencement date (s 2).
