Statement of Principles concerning goitre (Reasonable Hypothesis) (No. 9 of 2022)

This instrument is a Statement of Principles concerning goitre made by the Repatriation Medical Authority under subsection 196B(2) of the Veterans' Entitlements Act 1986, dated 24 December 2021 and commencing 31 January 2022 (ss 2-3). It replaces the prior Statement No. 23 of 2013 (s 4). Its legal effect is to specify the medical and exposure factors which, if proved and related to a person’s relevant service, raise a reasonable hypothesis that goitre, or death from goitre, is connected with that service (s 8; s 9). The instrument applies to claims falling under section 120A of the VEA or section 338 of the Military Rehabilitation and Compensation Act 2004 (s 5).

Mechanically, the Statement establishes (1) a statutory definition of the kind of condition covered , an enlarged thyroid gland persisting at least four weeks, with specified inclusions and exclusions (s 7(2)); (2) a discrete list of factors which must exist, at least one of which must be present to found a reasonable hypothesis connecting goitre to service (s 9); and (3) temporal and causal conditions for those factors to be treated as service-related (s 10). The instrument also addresses death from goitre by treating death from a terminal event contributed to by goitre as falling within the scope (s 7(3)). Definitions and quantitative thresholds used in the factors are set out in Schedule 1, for example thresholds for iodine intake and urinary iodine concentration, the definition of one pack-year, and the ARPANSA methodology for calculating cumulative equivalent dose.

Functionally, the Statement is an evidentiary template for decision-makers assessing entitlement claims under the VEA and MRCA framework. It identifies which clinical findings, exposure histories, medication histories, radiological dose reconstructions, and lifestyle measures will satisfy the statutory reasonable hypothesis test, subject to the requirement that the factor be related to relevant service (s 10(1)). Where a listed factor refers to an injury or disease that has its own Statement of Principles, that other Statement applies according to its terms (s 11). The instrument contains no procedural rules, sanctions, or administrative penalties; it provides medical-technical criteria to be applied in claims assessment.

The Statement organises its substantive content around a small set of legal‑technical concepts which determine coverage and the burden of proof in claims.

• The condition: goitre is defined in s 7(2) as an enlarged thyroid gland that has persisted for at least four weeks. The definition includes both diffuse enlargement and nodular enlargement, and explicitly excludes several thyroid disorders (congenital goitre, dyshormogenetic goitre, Graves disease, Hashimoto thyroiditis, haemorrhage or infarction of the thyroid, and primary or secondary malignancy). The diagnosis does not depend on thyroid hormone levels (s 7(2) Notes).

• Death from goitre: s 7(3) treats death from a terminal event or condition that was contributed to by the person’s goitre as included for the purposes of the Statement. Schedule 1 defines “terminal event” by example, including pneumonia, respiratory or circulatory failure and cessation of brain function.

• Reasonable hypothesis and factors: s 8 records the Authority’s view that there is sound medical‑scientific evidence linking goitre to relevant service. Section 9 lists the discrete factors which must exist, at least one of which is necessary to raise the reasonable hypothesis that service is related to the condition. Those factors are time‑bound (for example, “within 6 months before the clinical onset”) and exposure‑specific (for example, specific drugs, iodine-containing contrast agents, cumulative radiation dose).

• Temporal distinction between onset and worsening: the Statement separates factors that may have contributed to clinical onset (ss 9(1)-9(13)) from factors that may have materially contributed to, or aggravated, existing goitre (ss 9(14)-9(26)). Section 10(2) makes clear that the latter group applies only where the person’s goitre was suffered or contracted before or during relevant service and did not arise out of service.

• Cross‑application: s 11 provides that where a listed factor refers to an injury or disease that is the subject of another Statement of Principles, the terms of that other Statement apply. This mechanism allows chain‑linking of SOPs rather than duplicating content.

• Quantitative thresholds and technical methods: Schedule 1 supplies precise numerical thresholds and methodologies used by assessors: iodine deficiency and excess thresholds in micrograms per day and urinary concentration; the pack-year unit and the 3 pack‑year threshold for smoking; amiodarone and drug exposure durations; and a cumulative equivalent dose metric calculated using ARPANSA guidance (Schedule 1 definitions). These quantifications are central to operationalising the factors in s 9.

This Statement principally affects three groups identified by the instrument and the statutory context.

• Claimants: veterans, former members of the Forces, members of Peacekeeping Forces, and persons covered by the MRCA who lodge claims under the VEA or MRCA (the instrument applies to claims to which s 120A VEA or s 338 MRCA applies, s 5). For these individuals, the Statement sets out what medical, exposure and service‑related evidence can raise a reasonable hypothesis that goitre, or death from goitre, is connected to their relevant service. Practically, claimants whose records or medical history align with one or more of the factors in s 9 have a pathway to a favourable inference of service connection, subject to the requirement that the factor be related to relevant service (s 10(1)).

• Clinicians and medical experts: treating physicians, specialists and independent medical examiners will be called upon to document clinical onset and persistence of an enlarged thyroid for at least four weeks (s 7(2)), to record and interpret thyroid function and pathology, and to provide opinions on temporal relationships between exposures and clinical onset or worsening. They may also need to measure or interpret urinary iodine concentrations, document medication histories (including specified drugs in Schedule 1 and cumulative iodine intake), quantify smoking history in pack‑years, and document chronic renal failure, pituitary adenomas, or specified infectious or systemic diseases. For nodular goitre, clinicians or medical physicists may need to provide radiation dose reconstructions consistent with the ARPANSA guide (Schedule 1).

• Decision‑makers and administrators: persons or entities charged with adjudicating claims under the VEA or MRCA will apply this Statement as the evidentiary standard for raising a reasonable hypothesis that a condition is related to service. The instrument itself does not name a specific decision maker, but it is made under s 196B(2) of the VEA and is expressly applicable to claims under VEA and MRCA provisions (s 5). Administrative assessors will therefore use the factors and definitions in this Statement when evaluating entitlement claims, including considering whether a listed factor is related to relevant service (s 10(1)) and whether any cross‑referenced Statement of Principles applies (s 11).

Other affected parties include employers and insurers insofar as claims recognition may affect entitlements and benefit flows under veterans’ compensation schemes. The Statement has a regulatory effect on how medical evidence will be weighed, thereby affecting the demand for particular diagnostic tests, specialist opinions, and dose reconstruction services. It also affects legal practitioners and advocates preparing claims, who must structure evidence submissions to demonstrate one or more of the factors in s 9 and to establish the connection of that factor to relevant service.

The instrument does not impose criminal duties or create new civil causes of action. Rather, it establishes evidentiary criteria that operate within the VEA and MRCA claims processes. The core operative rights and obligations are as follows:

• Rights to rely on enumerated factors: a claimant has the right to rely on any one or more of the factors set out in s 9 to raise a reasonable hypothesis that goitre (or death from goitre) is related to their relevant service. The Statement specifies that “at least one of the following factors must as a minimum exist” (s 9 opening). This is an evidentiary entitlement: showing that a listed factor existed within the time and magnitude thresholds specified provides the basis for the “reasonable hypothesis” standard the statute requires.

• Obligation to establish relation to relevant service: the existence of a listed factor is not, by itself, sufficient. Section 10(1) requires that the factor be related to the person’s relevant service. This creates an evidentiary duty on claimants to adduce records, service histories or medical evidence linking the relevant exposure or event to the period or circumstances of service. For example, an iodine‑containing radiographic contrast administered during service or exposure to ionising radiation during service must be shown to have occurred in connection with relevant service.

• Temporal constraints and scope limitation: s 10(2) limits the application of the factors in subsections 9(14)-9(27) to material contribution or aggravation of goitre where the goitre was suffered or contracted before or during, but did not arise out of, the person’s relevant service. This creates a right for claimants with pre‑existing goitre to seek recognition of aggravation due to service; it also places an evidentiary burden to show the timing and that the condition did not arise out of service.

• Cross‑application of other Statements: s 11 imposes a duty on decision-makers to apply the terms of another Statement of Principles where a listed factor in s 9 refers to an injury or disease covered by that other Statement. Practically, this means a claimant cannot rely on a bare citation to a disease in Schedule 1 where a separate SOP governs that disease; the cross‑applied SOP’s criteria must be satisfied.

• Diagnostic and measurement requirements: Schedule 1 supplies definitions that translate into specific measurement obligations. For example, proving iodine deficiency or excess requires evidence of average daily intake over specified periods or urinary iodine concentrations at specified thresholds (Schedule 1 definitions of iodine deficiency and iodine excess). Proving radiation exposure requires a cumulative equivalent dose calculated in accordance with the ARPANSA guide referenced in the Schedule.

The Statement does not create criminal offences, fines, or administrative penalties. It is a technical evidentiary instrument; it prescribes criteria used to determine whether a reasonable hypothesis exists linking goitre or death from goitre to relevant service (s 8-9). Enforcement occurs indirectly through the claims adjudication process under the VEA and MRCA rather than by penal sanction.

• No penalties within the instrument: there are no sections imposing penalties, monetary sanctions, licensing conditions, or enforcement powers. The instrument is silent on enforcement mechanisms beyond its application in claims; its function is to guide determinations made pursuant to the VEA and MRCA (s 5).

• Practical enforcement through benefit decisions: the effective enforcement mechanism is the administrative decision to accept or reject a claim for entitlements. If a claimant can demonstrate a factor in s 9 and relate it to relevant service (s 10), decision-makers will be able to find that a reasonable hypothesis is raised , a finding that typically moves a claim to acceptance or to further examination under the VEA/MRCA procedural framework. Conversely, failure to show a listed factor, or to relate it to relevant service, will likely lead to rejection of a service‑connection claim.

• Interaction with other administrative remedies: the Statement does not alter rights of review or appeal embedded in the VEA or MRCA. Any procedural remedies, merits review or judicial review available under those Acts remain the means by which decisions applying these Principles can be challenged. The Statement itself neither provides nor removes appeal rights.

• Risk of evidentiary disputes: although not an enforcement mechanism, the instrument’s technical thresholds and references to external methodologies (for example, ARPANSA guidance for cumulative equivalent dose) create potential for evidentiary disputes. Claims may hinge on the quality and interpretation of radiation dose reconstructions, urinary iodine measurements, medication records, smoking histories and clinical timing. Disagreement over these measurements and their relationship to service will be resolved within the statutory claims process and any subsequent reviews.

In summary, the Statement’s enforceability is procedural and evidentiary. It does not prescribe sanctions; rather, it shapes administrative determinations about entitlement under the VEA and MRCA by specifying the factors and definitions that raise a reasonable hypothesis of service connection.

This Statement is situated within the VEA and MRCA statutory frameworks and interacts with other instruments and technical documents referenced in its text.

• Connection to VEA and MRCA: the instrument is made under subsection 196B(2) of the VEA (s 3), and explicitly applies to claims to which section 120A of the VEA or section 338 of the MRCA applies (s 5). Therefore, it operates as part of the statutory machinery for determining service‑relatedness of conditions and is to be used by decision-makers and tribunals applying those Acts.

• Repeal of earlier Statement: s 4 repeals the Statement of Principles concerning goitre No. 23 of 2013. The repeal indicates that the criteria in this instrument supersede those in the earlier 2013 Statement for claims falling within its application. Decision‑makers should therefore apply the 2022 Statement in place of the older document.

• Cross‑application with other Statements of Principles: where a factor in s 9 refers to another injury or disease that is itself the subject of a separate Statement of Principles, s 11 requires that the other Statement apply in accordance with its terms. This creates a hierarchical interaction between SOPs rather than an inconsistency resolution mechanism. Practically, it means that a factor such as “Pneumocystis jirovecii infection” (specified list of diseases in Schedule 1) will be governed by its own SOP if one exists.

• Reference to ARPANSA methodology: the Schedule defines “cumulative equivalent dose” and directs that it be calculated in accordance with the Guide to calculation of 'cumulative equivalent dose' for the purpose of applying ionising radiation factors in Statements of Principles determined under Part XIA of the VEA, Australian Radiation Protection and Nuclear Safety Agency, as in force on 2 August 2017 (Schedule 1). This ties radiological assessments to an external technical methodology. Decision-makers and experts will need to follow that methodology when establishing the radiation dose criterion in s 9(12) and s 9(25).

• Relationship to clinical and regulatory frameworks: the Statement references clinical diagnoses, laboratory measurements and therapeutic practices (for example, use of amiodarone, radioiodine therapy exclusions in Notes to s 9). It does not override clinical standards but supplies legal definitions and quantitative thresholds which must be reconciled with prevailing clinical practice and diagnostic records. For example, the exclusion of radioiodine therapy for goitre or thyroid nodules from the definition of ionising radiation exposure (Notes to s 9(12) and s 9(25)) interacts with clinical records documenting such therapy.

The instrument itself contains a small recorded amendment history, limited to its enactment and the repeal of a predecessor Statement.

• Enactment and commencement: The Statement is dated 24 December 2021 and, per s 2, commenced 31 January 2022. Section 3 records the authority under which the instrument was made, namely subsection 196B(2) of the Veterans' Entitlements Act 1986.

• Repeal of earlier Statement: Section 4 expressly repeals the Statement of Principles concerning goitre No. 23 of 2013 (Federal Register of Legislation No. F2013L00721), which had been made under subsections 196B(2) and (8) of the VEA. The instrument therefore replaces the 2013 criteria for goitre with the 2022 criteria for all relevant claims once it commenced.

• References to external documents as fixed points: the Schedule ties the calculation of cumulative equivalent dose to the ARPANSA Guide “as in force on 2 August 2017” (Schedule 1). That phrasing fixes the applicable methodology to the version in force on that date. Any later changes to the ARPANSA guidance after 2 August 2017 are not incorporated by the Schedule unless the instrument is amended to reference a later version.

• No other amendments recorded: within the text supplied no later amendments, disallowance, or transitional provisions are recorded. The instrument does not include saving provisions for decisions made under the repealed 2013 Statement; however, the repeal is absolute in form. Any transitional application to claims lodged before commencement would be addressed in the broader VEA/MRCA administrative practice rather than in this Statement.

• Practical implications for continuity: the repeal and replacement mechanism means that evidence standards and thresholds that applied under the 2013 Statement are superseded by this instrument for claims to which s 120A VEA or s 338 MRCA apply from its commencement date. Practitioners should therefore ensure they use the 2022 definitions and thresholds (for example iodine intake levels, pack‑year calculations, radiation dose thresholds and timing requirements) when preparing or defending claims lodged or decided after 31 January 2022.

If future amendments are made to this Statement, they should be expected to follow the same formal mechanism under subsection 196B(2) of the VEA and be recorded and published on the Federal Register of Legislation with commencement dates. The instrument as presented contains only the single step of repeal and replacement.

The text of the Statement contains no recorded litigation history. It does not cite cases, nor does it record judicial consideration or challenge to the Statement itself.

• No cases named: the instrument does not name any judicial decisions, tribunal outcomes or precedents that interpret or apply this Statement. It stands as an administrative medical‑evidentiary instrument rather than as a litigated statute.

• Practical consequences: because the Statement is a statutory instrument under the VEA regime, its interpretation and application could be subject to judicial review or merits review by relevant tribunals under the VEA or MRCA processes. Any such litigation would arise from decisions applying these Principles in the context of individual claims. The instrument itself, as provided, contains no summary or annex describing litigation outcomes.

• Areas likely to generate disputes: while no litigation is recorded in the instrument, there are several factual and technical points that may give rise to contestation in the claims process: the measurement and reconstruction of cumulative equivalent dose (Schedule 1 reference to ARPANSA methodology); the interpretation and proof of iodine deficiency or excess using dietary intake versus urinary iodine concentration; the establishment of smoking history at the 3 pack‑year level; the temporal relationship between exposure and clinical onset or worsening; and the arguably open‑ended factor of “inability to obtain appropriate clinical management” (s 9(27)). These are matters that frequently form the basis of evidentiary and expert disputes in administrative claims.

• No judicial gloss in the instrument: users of the Statement should therefore plan for the possibility of contested factual findings and prepare contemporaneous, verifiable records to support claims. Any future litigation or tribunal decisions that interpret the wording of this Statement will be a matter recorded in external case law and administrative decisions; the instrument itself records none.

In sum, the instrument records no litigation history. Its application in the administrative claims process creates scope for future judicial or tribunal engagement on technical questions, but any such cases are outside the content of this Statement.

This Statement contains several technical thresholds, exclusions and temporal conditions that can produce traps for claimants and advisers if not carefully addressed.

• The four‑week persistence rule: goitre is defined as an enlarged thyroid gland that has persisted for at least four weeks (s 7(2)(a)). A single transient swelling or a lesion that resolves within that window will not meet the basic definitional requirement. Clinical documentation must therefore show persistence.

• Explicit exclusions: the instrument excludes several specific thyroid conditions from the definition of goitre (s 7(2)(c)). If the treating diagnosis is Graves disease, Hashimoto thyroiditis, congenital goitre, dyshormogenetic goitre, haemorrhage/infarction of the thyroid, or malignant neoplasm, the condition falls outside this Statement. Practitioners must therefore ensure that diagnostic labelling does not inadvertently disqualify a claim.

• Temporal windows are tight and differ by factor: many factors require exposure “within the 6 months before the clinical onset” (for example iodine deficiency/excess, specified drugs, iodine‑containing contrast agents, smoking threshold) (ss 9(1)-9(6)). Amiodarone has a separate window of “within the 1 year before the clinical onset” and requires a continuous period of at least two weeks (s 9(5)). For nodular goitre radiation exposure requires a cumulative dose of at least 0.5 sievert occurring at least 1 year before clinical onset (s 9(12)(a)). The difference between “within 6 months” and “at least 1 year before” is consequential for claims where timing of exposures is ambiguous.

• Quantitative thresholds that require measurement: iodine deficiency and excess are defined by average intake levels over set periods or urinary iodine concentrations (Schedule 1). Proving dietary intake thresholds retrospectively is difficult and often requires indirect evidence. Urinary iodine concentration testing is relatively specific but will only capture recent changes. Similarly, smoking requires a calculation of at least 3 pack‑years (Schedule 1), and the Statement requires that, if smoking ceased before clinical onset, the onset occurred within 5 years of cessation (s 9(7)(b)). Accurate pack‑year histories and cessation dates are therefore essential.

• Cumulative equivalent dose methodology: radiation exposure for nodular goitre uses the “cumulative equivalent dose” metric and requires calculation in accordance with the ARPANSA guide as in force on 2 August 2017 (Schedule 1). Dose reconstructions can be technically complex and may require expert input, dose records, or estimations where records are missing. The Schedule excludes radioiodine therapy from exposure to ionising radiation for this purpose (Notes to s 9(12) and s 9(25)).

For claimants, medical practitioners and advocates preparing or assessing claims under the VEA/MRCA framework, the Statement prescribes a checklist of evidence items and procedural steps to satisfy the reasonable hypothesis standard. Below are practical, source‑grounded steps to establish a factor under s 9 and to meet the service‑relation requirement in s 10.

1. Establish the diagnosis of goitre that meets the definition

• Obtain clinical records demonstrating an enlarged thyroid gland that has persisted for at least four weeks (s 7(2)(a)). This can include primary care notes, specialist endocrinology reports, neck examinations, and imaging reports (ultrasound) showing enlargement.
• Ensure the diagnosis is not one of the excluded conditions in s 7(2)(c), unless the claim is being channelled through another SOP under s 11. If the clinical record labels the condition as Graves disease or Hashimoto thyroiditis, the Statement does not apply to that diagnosis.

2. Identify which s 9 factor(s) might apply and gather direct evidence

• For iodine deficiency or excess (ss 9(1), 9(2), 9(14), 9(15)): obtain dietary histories, supplement and medication records, and urinary iodine concentration results. Schedule 1 defines iodine deficiency and excess in precise quantitative terms (average intake thresholds over set durations or urinary iodine concentrations). Where direct dietary records are unavailable, contemporaneous prescribing records for iodine-containing medications or supplements and specialist notes are useful.
• For specified drugs (ss 9(3), 9(16)): collect prescription and dispensing records showing the drug and timing. Schedule 1 lists the specified drugs by name (for example, carbamazepine, interferon alpha, lithium carbonate, phenytoin, valproic acid, sorafenib, sunitinib) and these names should be quoted in expert reports or records.
• For high‑iodine drugs (s 9(4), 9(17)): show daily dosage and continuity of at least 4 weeks within the required 6‑month window.
• For amiodarone (ss 9(5), 9(18)): show continuous use for at least two weeks within the 1‑year window before clinical onset or worsening.
• For iodine‑containing radiographic contrast (ss 9(6), 9(19)): obtain radiology reports and procedural notes documenting administration within six months before clinical onset or worsening.
• For smoking history (ss 9(7), 9(20)): compile smoking histories sufficient to calculate pack‑years as defined in Schedule 1. Document date of cessation if relevant to the 5‑year cessation rule.
