Statement of Principles concerning goitre (Balance of Probabilities) (No. 10 of 2022)

The instrument rests on a small set of interlocking conceptual elements: the clinical definition of the condition, a catalogue of causal or contributing factors, temporal windows tied to clinical onset or worsening, the requirement that any listed factor be related to relevant service, and cross‑references to other Statements of Principles where overlap occurs.

Clinical definition and diagnostic threshold. Goitre is defined as an enlarged thyroid gland that has persisted for at least four weeks (s 7(2)(a)). The instrument clarifies that goitre can be diffuse or nodular and can be nontoxic, toxic or hypothyroid in terms of thyroid function (s 7(2)(b); Notes 1-3). The instrument also sets out an exclusion list: congenital goitre, dyshormogenetic goitre, Graves disease, Hashimoto thyroiditis, haemorrhage or infarction of the thyroid gland and primary or secondary malignancy of the thyroid gland are excluded from this Statement (s 7(2)(c)).

Causation framework and evidential standard. The RMA states that, on the available medical‑scientific evidence, it is "more probable than not" that goitre and death from goitre can be related to relevant service (s 8). That phrase signals the balance of probabilities legal standard. The instrument operationalises causation by listing specific factors which must be established before a connection to service can be accepted (s 9). These factors operate as medico‑legal presumptions or markers that, when present and related to service per s 10, allow an administrative finding of service connection.

Temporal distinction between onset and worsening. The factors fall into two broad temporal categories: those relevant to clinical onset (s 9(1)-(12)) and those relevant to clinical worsening or aggravation of pre‑existing goitre (s 9(13)-(24)). Section 10(2) clarifies that the latter group applies only to material contribution to or aggravation of goitre where the person’s goitre was suffered or contracted before or during (but did not arise out of) the person’s relevant service. This creates a legal distinction between causation of a new disease and contribution to an existing disease.

Specified exposures and thresholds. The list includes nutritional iodine deficiency and iodine excess with numerical thresholds set in the Schedule (Schedule 1 definitions for iodine deficiency and iodine excess), drug exposures (a specified list plus any drug containing at least 10 mg iodine daily over 4 continuous weeks), treatment exposures (iodine‑containing contrast agents within 3 months, amiodarone for 2 weeks within 1 year), meaningful smoking exposure (at least 5 pack‑years with cessation rules), forms of thyroiditis and other thyroid diseases (specified lists in the Schedule), acute precipitating events related to thyrotoxic crisis, ionising radiation exposure thresholds for nodular goitre (cumulative equivalent dose of at least 1 sievert by age 25 and at least 1 year before onset) and the inability to obtain appropriate clinical management (s 9).

Definitions and technical references. The Schedule provides operational definitions and references. For example, "cumulative equivalent dose" is to be calculated in accordance with the ARPANSA Guide dated as in force on 2 August 2017 (Schedule 1). "One pack‑year" is quantified and examples for conversion are given (Schedule 1). Acute precipitating events and thyrotoxic crisis are defined with examples. The RMA therefore ties several factors to quantifiable clinical or exposure measures, and anchors radiation dose reconstruction to an external technical guide.

Cross‑instrument interaction. Section 11 creates a rule for overlap with other Statements of Principles: if a factor listed in s 9 refers to an injury or disease already the subject of another RMA Statement, the other Statement’s factors apply in accordance with its terms. That ensures that where, for instance, an infectious thyroiditis is a factor but is covered by another SOP, the governing SOP is the source of the operative rules.

Overall, the instrument integrates clinical, exposure and temporal criteria to create a discrete set of medico‑legal pathways by which decision makers can find a causal connection between service and goitre or death from goitre, subject always to the condition that the factor(s) be related to the person’s relevant service (s 10).

The instrument directly affects claimants and decision makers in the veterans' entitlements and military compensation systems. By its terms it applies to claims to which VEA s 120B or MRCA s 339 apply (s 5). That means it governs the evidentiary framework used when assessing claims for service connection for goitre (or death from goitre) by veterans and by members covered under the Military Rehabilitation and Compensation Act 2004 (MRCA) where the MRCA provision applies. The Schedule’s definition of "relevant service" (Schedule 1) shows who is in scope: eligible war service (other than operational service), defence service (other than hazardous service and British nuclear test defence service) under the VEA, or peacetime service under the MRCA.

Who pays and who decides. The instrument does not itself allocate payments or benefits; instead it provides the medico‑legal framework that administrative decision makers use to determine entitlement under the VEA and MRCA regimes. The practical result is that the Commonwealth (through its veterans' benefits apparatus) is the payer of benefits awarded on the basis of a service connection that is made in accordance with this Statement. Decision‑making bodies that apply the RMA’s Statements are obliged to treat the listed factors as establishing a connection if the requirements (including relationship to relevant service) are met; the instrument therefore changes the evidentiary landscape for those administrative decision makers.

Claimants and their advisors. Claimants (veterans, former members, dependants in death claims) must assemble medical and service evidence that demonstrates the clinical diagnosis, the existence of one or more qualifying factors in s 9, and the relationship of those factors to relevant service (see s 10). Where a factor refers to an injury or disease covered by another Statement of Principles, claimants must be prepared to have that other Statement applied in accordance with s 11.

Medical practitioners and experts. Treating clinicians and medico‑legal experts will be asked to address whether the person satisfies the clinical definition in s 7(2), whether exclusions apply (s 7(2)(c)), whether one or more of the listed factors in s 9 are present and temporally linked to the clinical onset or worsening, and whether the factor(s) can be related to the person’s relevant service (s 10). They may also be required to provide evidence that an inability to obtain appropriate clinical management occurred (s 9(25)).

Administrators and technical specialists. For certain factors, administrative decision makers will require technical inputs that go beyond routine medical records. Radiation exposure factors require dose reconstruction using the ARPANSA Guide methodology for cumulative equivalent dose (Schedule 1). Iodine intake/excretion factors require nutritional history or urinary iodine concentration records with the numerical thresholds provided in the Schedule. Smoking quantification requires calculation of pack‑years using the Schedule method.

Third‑party actors. Entities that control records , hospitals (contrast agent administration), pharmacies and prescribing systems (amiodarone, lithium, interferon alpha, interleukin‑2), pathology laboratories (urinary iodine), defence archives (service records and any recorded radiation exposure), will be relevant to evidence collection. The instrument therefore affects how those records are sought and used in claims processes.

Indirect effects. Because the instrument lists an "inability to obtain appropriate clinical management" (s 9(25)) as a potential factor, health system access issues and administrative failures to provide or permit treatment may become relevant evidence in claims. That has potential implications for how systemic access problems are evidenced and considered by decision makers.

In sum, the Statement affects veterans and current members seeking recognition of goitre as connected to service; treating clinicians and experts tasked with providing appropriate evidence; administrative decision makers who adjudicate entitlement under VEA/MRCA provisions; and third parties who hold the necessary clinical, diagnostic, pharmaceutical and service records.

This instrument itself does not create new statutory duties or criminal offences. Instead it prescribes medico‑legal criteria that decision makers must apply when assessing claims for service connection for goitre and death from goitre under the VEA and MRCA frameworks. The key operative duties and rights arise from how the RMA’s Statement is used by administrative agencies under those Acts.

Duty of the decision maker to apply the Statement. Where a claim falls under VEA s 120B or MRCA s 339 (s 5), administrative decision makers must have regard to and apply the applicable Statement of Principles in determining whether the disease is connected with service. The instrument specifies the factors which "must exist" before a connection can be said to be established on the balance of probabilities (s 9). A decision maker assessing causation will therefore need to test whether one or more of the factors in s 9 are present, that they meet the numeric or temporal thresholds in the Schedule, and that the factor(s) are related to the person’s relevant service (s 10).

Duty to relate factors to relevant service. Section 10(1) requires that existence of any factor in s 9 "must be related to the relevant service rendered by the person." That is an explicit duty on adjudicators to consider the causal link between a listed factor and service. For the factors in subsections 9(13)-(25), s 10(2) limits their application to material contribution or aggravation where the goitre pre‑existed service or was suffered or contracted before or during (but did not arise out of) service.

Right to have other Statements applied. Section 11 gives a procedural rule for overlapping conditions: if a factor in s 9 refers to an injury or disease that itself is the subject of another Statement of Principles, then the factors in that other Statement apply "in accordance with the terms of that Statement of Principles as in force from time to time." This is a right in the sense that claimants are not confined to the present Statement where another SOP governs the referenced disease; rather the other SOP’s factors will stand.

Evidence thresholds and claimant obligations. The instrument does not alter the legal standard of proof in private materials, but it operationalises what medical or exposure evidence is necessary to meet the balance‑of‑probabilities test for service connection in the context of goitre. Claimants therefore carry the practical obligation of compiling medical, pharmaceutical, laboratory (for urinary iodine), radiological and service records that satisfy the numerical and temporal thresholds in the instrument and its Schedule.

Duty to use defined technical methods. For ionising radiation exposure claims, the instrument ties computation of "cumulative equivalent dose" to the ARPANSA Guide methodology (Schedule 1). Decision makers and their technical advisers are therefore obliged to use that listed methodology for dose reconstruction.

Interaction with other statutory processes. The instrument does not itself set out appeals, reviews or payment processes. Those procedural rights and duties (such as rights of review, merits review or judicial review) arise under the VEA and MRCA. However, because the Statement is determinative of the medical causation element, it can materially influence rights to benefits under those Acts by directing the medical finding of service connection one way or the other once the required factors and service relationship are shown.

No criminal penalties or private civil causes are created. The Statement establishes administrative evidentiary rules; it does not impose fines, custodial penalties or civil causes of action. It operates within the administrative compensation framework governed by the VEA and MRCA.

In summary, the principal "duties" created by the instrument are obligations on decision makers to apply its factors and definitions when assessing causation for claims under the VEA and MRCA; the principal "rights" are the claimant’s right to have their claim assessed against these specified factors and, where relevant, to have linked conditions assessed under the alternative SOPs cited by s 11.

The Statement of Principles instrument does not itself create criminal offences, civil liabilities, or administrative penalties. It is an administrative instrument setting out medical‑scientific criteria for establishing a causal connection between service and goitre (see s 3 for authority and s 8 for the RMA’s evidentiary stance). Enforcement is therefore indirect: the instrument is enforced through its application in administrative determinations under the VEA and MRCA frameworks specified in s 5, and through any consequential entitlement decisions that flow from those determinations.

How the Statement is used to effect outcomes. Decision makers assessing claims under VEA s 120B or MRCA s 339 will apply this Statement in deciding whether a veteran’s or member’s goitre is connected with relevant service. If the decision maker concludes that one or more of the factors in s 9 is established and that it is related to relevant service (s 10), that conclusion will typically be pivotal to an award of service‑connected benefits under the relevant legislation. Conversely, absence of any qualifying factor or inability to link a factor to relevant service will weigh against a finding of service connection. The "penalty" for failing to meet the Statement’s criteria is therefore the denial of service‑connected benefits , an administrative, not criminal, consequence.

Administrative review and judicial oversight. The instrument does not describe review mechanisms or appeal rights; those procedural routes are set out in the VEA and MRCA and their associated administrative frameworks. Because the Statement functions as the medical evidence standard for causation, administrative decisions using it may be subject to merits review or judicial review under the statutory appeal mechanisms in the VEA and MRCA, or under general administrative law, but the instrument itself contains no procedural enforcement provisions.

Enforcement risks and evidential gatekeeping. The Statement centralises substantive medical causation rules into a single, RMA-determined list of factors. That gives administrators a relatively clear gatekeeping tool. Practically, the stated numeric and temporal thresholds (for iodine intake, urinary iodine levels, amiodarone exposure, pack‑years, radiation dose, etc.) set evidential bars which claimants must meet. Failure to produce records that satisfy those measurements provides administrators with a defensible basis to refuse service connection. This is an enforcement effect achieved through evidentiary standardisation rather than through penalties.

No sanctioning of providers. The Statement does not impose sanctions on clinicians, hospitals or record holders for failing to provide treatment or for administrative errors. However, the inclusion of "inability to obtain appropriate clinical management for goitre" as a potential factor (s 9(25)) may make system or provider failures relevant to causation findings in individual claims; the Statement does not, however, itself compel corrective action by health providers.

Cross‑instrument compliance. The Schedule requires use of the ARPANSA Guide for radiation dose calculations (Schedule 1). Where administrators seek to deny causation based on claimed radiation exposure, they will need to rely on dose reconstructions completed in accordance with that referenced methodology. Failure to follow that methodology could be a ground for procedural challenge in review or litigation, but again this is an evidentiary procedural matter, not a penalty established by the instrument.

In short, the instrument’s "enforcement" mechanism is administrative adjudication: it sets the criteria that structure entitlement decisions under the VEA and MRCA. There are no direct penalties in the Statement, but its definitional and threshold rules create practical hurdles that affect entitlement outcomes.

This Statement operates within the statutory framework of the VEA and MRCA and cross‑references other RMA Statements of Principles. It therefore sits as a specialised, technical instrument used by administrators to determine a causal link for compensation and entitlement decisions under those Acts.

Primary statutory context. The instrument is made under s 196B(3) of the VEA (s 3). Its application is explicitly limited to claims where VEA s 120B or MRCA s 339 apply (s 5). Consequently, it is not a freestanding rule of law outside those claims processes; it informs determinations made under those statutory provisions. Any rights, duties or remedies arising from determinations that use this Statement will be governed by the VEA and MRCA, including the procedural, merits and judicial review routes those Acts provide.

Cross‑reference to other Statements of Principles. Section 11 sets out a specific interaction rule: if a factor listed in s 9 refers to an injury or disease that is already the subject of another RMA Statement determined under VEA s 196B(3), then the factors in that other Statement apply "in accordance with the terms of that Statement of Principles as in force from time to time." This creates a hierarchy or network effect among RMA SOPs: where conditions overlap, the separate SOPs are applied according to their terms rather than being conflated. Practitioners must therefore check for overlap and ensure that the correct SOP is used when a listed factor invokes another condition.

Technical interaction with other regulatory guidance. The Schedule requires that "cumulative equivalent dose" for ionising radiation be calculated in accordance with the ARPANSA Guide named and dated as in force on 2 August 2017 (Schedule 1). This anchors radiation dose reconstruction to an external technical standard produced by the Australian Radiation Protection and Nuclear Safety Agency. That reference imposes an interaction with ARPANSA's technical guidance and means that radiation exposure claims will require methodologies consistent with that Guide.

Interaction with clinical practice and medical records law. The instrument’s requirements , e.g. urinary iodine concentration thresholds, drug exposure windows, pack‑year calculations, documentation of iodine‑containing contrast agent administration and evidence of inability to obtain appropriate clinical management , draw upon clinical records, pathology results and pharmacy records. This creates operational interactions with privacy, health records and evidence retrieval legal regimes when claimants and administrators seek to obtain and use such records. The Statement does not alter privacy law, but its evidentiary demands will influence how records are collated and disclosed under existing privacy and records legislation.

Exclusions and overlap with other disease classification regimes. The Statement excludes certain conditions from its scope , congenital goitre, dyshormogenetic goitre, Graves disease, Hashimoto thyroiditis, haemorrhage or infarction of the thyroid gland, and primary or secondary thyroid malignancy (s 7(2)(c)). Claims that are properly diagnosable as or attributable to those excluded conditions will fall outside this Statement and will require examination under other applicable legal or medical instruments.

No direct amendment to the VEA or MRCA. The Statement does not amend the VEA or MRCA; it is an instrument made under those Acts to guide medical causation findings. Any statutory amendments to the VEA or MRCA would require separate legislative processes. The Statement does repeal an earlier RMA instrument concerning goitre (s 4), so it interacts with the corpus of RMA determinations temporally by replacing the prior SOP No. 24 of 2013.

Interaction with procedural review and judicial processes. The Statement will be applied within the adjudicative machinery of the VEA and MRCA, and decisions adopting or rejecting the RMA’s factors may be subject to merits review or judicial review under the relevant statutes or administrative law. The Statement does not itself provide appeal rights, but its content will be a central feature of any dispute about whether a medical causal link exists.

In summary, this Statement functions as a technical, instrument‑level rule that is applied within existing statutory processes under the VEA and MRCA, references external technical guidance (ARPANSA), and coordinates with other RMA Statements when conditions overlap. It does not alter broader statutory law but materially shapes how medical causation is evidenced and assessed in the applicable claims systems.

The instrument carries a limited internal amendment history presented in the text. It is titled No. 10 of 2022 and dated 24 December 2021 (s 1 and front matter). It commenced on 31 January 2022 (s 2). The only explicit historical action recorded within the instrument is the repeal of the previous Statement of Principles concerning goitre No. 24 of 2013 (Federal Register of Legislation No. F2013L00725), which was made under subsections 196B(3) and (8) of the VEA (s 4). No other amendments, transitional provisions, or saving clauses are included in the text.

How replacement works practically. By repealing the 2013 Statement, the RMA has replaced the previous medico‑legal criteria for linking goitre to service with the new list of factors, definitions and thresholds. Practitioners must therefore use the new instrument for claims within its commencement period (s 2) and under the statutory provisions listed in s 5. The instrument does not provide retroactive or transitional provisions concerning claims decided under the 2013 instrument; the text is silent on whether ongoing claims commenced under the predecessor Statement are to be determined under the new one or the old one. That silence suggests that the normal administrative practice and any procedural rules in the VEA/MRCA about which version of a Statement applies will govern; however, the instrument does not itself specify transitional arrangements.

External technical guidance reference. The Schedule attaches a dated technical reference for calculating cumulative equivalent dose for ionising radiation, specifying the ARPANSA Guide "as in force on 2 August 2017" (Schedule 1). This has the effect of locking the radiation dose reconstruction standard to that Guide version unless and until either the instrument is amended to update the reference or the Guide itself is changed and that change is reflected in a later SOP or RMA action. The instrument does not itself record any prior amendments to that external methodology.

No recorded subsequent amendments within the instrument. The instrument text supplied contains no later amendments, amendment dates, or notation of subordinate instruments altering its content. The only recorded predecessor in the instrument is the 2013 SOP that was repealed. If later RMA changes were made after the instrument’s commencement, they are not recorded in the provided text.

Practical implication for users. Practitioners should note that the RMA has updated its goitre Statement, that the updated definitions and thresholds in Schedule 1 are the operative standards as of 31 January 2022, and that any comparison with pre‑2022 decisions should be made with care given the repeal of the 2013 SOP. Where a listed factor refers to an injury or disease covered by another Statement, s 11 mandates use of the contemporaneous terms of that other Statement, and those other Statements may themselves have amendment histories affecting how vignettes are adjudicated.

In short, the instrument replaces the 2013 RMA Statement on goitre, commences on a specific date, and references an external technical guide dated 2 August 2017 for radiation dose calculation. The instrument contains no further internal amendment history in the supplied text.

The instrument as provided contains no references to any case law, litigation history, judicial consideration, or review decisions relating to this Statement of Principles. It cites only statutory authority (subsection 196B(3) of the VEA) and the RMA’s internal determinations. The text does not name any judicial decisions, tribunal outcomes or precedential matters that have interpreted or challenged the Statement.

What the absence of litigation references means in practical terms. Because the Statement is an administrative instrument setting out medical‑scientific criteria, disputes about its application are likely to arise in the administrative claim and review processes under the VEA and MRCA. Those disputes could generate litigation or review proceedings (merits or judicial review), but none are recorded within the instrument itself. Consequently, practitioners must look beyond the Statement to the VEA/MRCA case law and administrative decisions for precedents about how RMA Statements are treated in adjudication and review. The instrument itself provides no litigation history or binding legal interpretations.

Where to search for litigation or interpretative guidance. To find any judicial or tribunal decisions that consider this Statement, practitioners should search decisions under the VEA and MRCA frameworks made after the instrument’s commencement date (31 January 2022) in the Veterans’ Review Board, Administrative Appeals Tribunal, or courts that have jurisdiction over decisions under the VEA/MRCA. Those decisions are not contained in the instrument and would need to be sourced from legal databases and administrative tribunal decision registries.

No named cases in the instrument. The only external material explicitly referenced is the ARPANSA Guide for dose calculation (Schedule 1) and the repealed 2013 RMA Statement. There are no citations to precedents, so any claim about litigation history would have to be supported by independent research into relevant tribunal and court decisions after the instrument commenced.

Practical advice for litigators and advisors. Given the absence of litigation history in the instrument, counsel and advisers should be prepared to articulate how the instrument’s thresholds and definitions apply to factual circumstances in administrative proceedings, and to develop medical expert evidence that engages directly with the Schedule’s technical standards (e.g. urinary iodine thresholds, pack‑year calculations, ARPANSA methodology). Challenges may arise around interpretation of phrases that are not numerically specified (for example, what evidence satisfies "inability to obtain appropriate clinical management" in s 9(25)), and these are the kinds of issues that could give rise to litigation or appellate clarification post‑commencement.

In short, the Statement contains no recorded litigation history within its text. Any judicial or tribunal engagement with the Statement will need to be located outside the instrument in the decisions of relevant review bodies and courts following its commencement.

This instrument contains a number of specific technical thresholds, temporal windows and definitional exclusions that create practical pitfalls for claimants, clinicians and decision makers. Below are the concrete "gotchas" drawn from the instrument text and Schedule.

Diagnostic persistence requirement. By definition, goitre for the purposes of this Statement is an enlarged thyroid gland that has persisted for at least four weeks (s 7(2)(a)). A single transient enlargement or swelling lasting less than four weeks will not, on the face of this Statement, qualify as goitre. Practitioners must obtain documentation showing persistence across the four‑week threshold.

Exclusion list. The Statement expressly excludes a set of conditions (s 7(2)(c)): congenital goitre, dyshormogenetic goitre, Graves disease, Hashimoto thyroiditis, haemorrhage or infarction of the thyroid gland, and primary or secondary malignancy of the thyroid. If the clinical picture points to any of these, the present SOP does not apply. Misclassification of such conditions as "goitre" for the purposes of claims can lead to misplaced reliance on this Statement.

Thyroid function not required for diagnosis. The Statement notes that thyroid hormone levels are not determinative of the diagnosis because goitre may be nontoxic, toxic or hypothyroid (s 7 Note 2). Absence of abnormal thyroid function tests will not defeat a diagnosis, but clinicians should still document imaging or palpation findings demonstrating enlargement for four weeks.

Temporal windows are tight. Many factors require exposure within narrow time frames relative to clinical onset or worsening. Examples: iodine deficiency or iodine excess must exist within the three months before clinical onset (s 9(1)-(2)) or clinical worsening (s 9(13)-(14)). Drugs on the specified list must be taken within three months before clinical onset or worsening (s 9(3), 9(15)), and amiodarone must be taken continuously for at least two weeks within the one year prior to onset or worsening (s 9(5), s 9(17)). Practitioners should carefully document timing: evidence of remote exposure outside these windows may not assist.

Quantitative thresholds. The Schedule contains specific numerical thresholds that must be met for iodine deficiency/excess and for radiation exposure. For example, iodine deficiency is less than 150 µg/day (or less than 250 µg/day for pregnant/lactating women) for at least 30 days, or urinary iodine concentration under 100 µg/L (150 µg/L for pregnant women) (Schedule 1). Iodine excess thresholds are >1,100 µg/day for adults over a continuous period of at least 3 months, or urinary iodine >300 µg/L (500 µg/L for pregnant women) (Schedule 1). Failure to document such measurements, or reliance on imprecise dietary histories, can be fatal to a claim. Likewise, radiation exposure requires a cumulative equivalent dose of at least 1 sievert to the thyroid by age 25 and at least one year before clinical onset (s 9(11) and s 9(23)), and dose calculation must follow the ARPANSA Guide methodology in force on 2 August 2017 (Schedule 1).

Smoking pack‑year threshold and cessation rule. Smoking must be at least 5 pack‑years before clinical onset or worsening (s 9(7), s 9(19)). If smoking has ceased, the onset or worsening must occur within five years of cessation. The Schedule defines pack‑years and gives an exemplar calculation: e.g. smoking 10 cigarettes per day for 10 years equals 5 pack‑years (Schedule 1). Incomplete smoking histories or vague estimates of tobacco use can be problematic; precise calculation is required.

Specified drugs and iodine content. The listed "specified list of drugs" includes interferon alpha, interleukin‑2 and lithium carbonate (Schedule 1). Separate factors relate to taking any drug containing at least 10 mg of iodine daily for a continuous period of at least 4 weeks (s 9(4), s 9(16)). Practitioners must identify the drug, quantify its iodine content, and document continuity and timing. Pharmacy dispensing records and prescription histories will often be decisive.

Contrast agents and hospital records. Administration of an iodine‑containing radiographic contrast agent within three months before onset or worsening is a listed factor (s 9(6), s 9(18)). Hospital radiology records and procedural notes are therefore critical. Absent or incomplete hospital records present evidentiary risk.

Radiation exposure caveat. Exposure to ionising radiation does not include radioiodine therapy for goitre or thyroid nodules (s 9 Note 1). That exclusion matters because patients treated with radioiodine for thyroid disease should not expect radiation exposure thresholds in s 9(11) or s 9(23) to be satisfied by that therapy. Instead, the instrument anticipates environmental, medical diagnostic, or occupational radiation as sources for cumulative equivalent dose.

Ambiguity over "inability to obtain appropriate clinical management." Section 9(25) permits a finding based on inability to obtain appropriate clinical management for goitre, but the term is not defined in the Schedule. Claimants relying on this factor must evidence both that appropriate management existed as a clinical standard and that the claimant was unable to obtain it , e.g. documentation of denied referrals, lack of available services, or systemic barriers. The absence of a defined evidentiary standard creates uncertainty and may lead to contested assessments.

Overlap with other Statements. Section 11 requires that where a factor refers to an injury or disease covered by another Statement, that other Statement applies. Practitioners must therefore check whether, for example, a specified disease listed in the Schedule (e.g. sarcoidosis or tuberculosis) has its own SOP. Failure to do so may result in misapplication of s 9 factors.

Age cap for radiation‑related nodular goitre. The radiation factor for nodular goitre requires the cumulative dose to be received by age 25 and at least one year before the clinical onset or worsening (s 9(11), s 9(23)). Radiation received after age 25 will not satisfy this factor. This is an important chronological constraint.

Thyrotoxic crisis specifics. For toxic goitre presenting as thyrotoxic crisis, an "acute precipitating event" within 48 hours before onset is required (s 9(12)). The Schedule defines examples of such events (Schedule 1: abrupt cessation of anti‑thyroid therapy, infection, surgery, parturition, etc.). Proof of such an event and precise timing are needed.

Evidence of urinary iodine concentration. The Schedule permits urinary iodine concentration as an alternative objective measure for deficiency or excess. Pathology records that report urinary iodine concentrations are therefore highly probative; absent such laboratory results, claimants will need to rely on detailed nutrition/supplement histories, which are inherently more contestable.

Cumulative evidence requirement. Section 9 requires "at least one" of the listed factors to exist before a connection can be made. However, absence of a listed factor does not necessarily establish that a claim must fail if other medical evidence connects the condition to service under other legal or procedural pathways. Practitioners should be careful about overreliance on the list as the only route; s 11 and the broader statutory context may create additional avenues in some circumstances.

In sum, the gotchas are technical: four‑week persistence, tight temporal windows, numerical thresholds for iodine and radiation, pack‑year calculations, exclusions for certain thyroid diseases and for radioiodine therapy, and an undefined but potentially important "inability to obtain appropriate clinical management" factor. Evidence quality and precise timing are therefore critical.

For claimants, clinicians, experts and administrators navigating claims under this Statement, compliance means assembling evidence and expert opinion that directly map to the instrument’s definitional, quantitative and temporal requirements. Below is a practical compliance checklist based on the instrument.

1. Establish the diagnosis with persistence evidence (s 7(2)(a)). Documentation should show thyroid enlargement persisting for at least four weeks. Useful evidence: serial clinical notes, palpation findings, photographic evidence where visible swelling occurred, and imaging (ultrasound) reports showing enlargement or nodularity. Note that thyroid function tests are not required for the diagnosis but remain clinically relevant and should be included.

2. Exclude the listed exclusions (s 7(2)(c)). Obtain diagnostic or histopathology evidence to rule out congenital goitre, dyshormogenetic goitre, Graves disease, Hashimoto thyroiditis, haemorrhage/infarction of the gland and thyroid malignancy. If any excluded diagnosis applies, this SOP will not govern the claim.

3. Match the claim to the correct application pathway (s 5). Confirm that the claim is one to which VEA s 120B or MRCA s 339 applies. Establish the nature of the person’s "relevant service" using defence and service records (Schedule 1 definition).

4. Identify and document at least one factor in s 9 with temporal alignment. The list specifies timing; ensure records show the factor occurred within the required window relative to clinical onset or worsening:

   • Iodine deficiency/excess: obtain dietary histories, supplement records, and preferably urinary iodine concentration test results to meet the numeric thresholds in Schedule 1 (iodine deficiency: <150 µg/day or urinary iodine <100 µg/L; iodine excess: >1,100 µg/day or urinary iodine >300 µg/L, with pregnancy adjustments) and continuous period requirements (30 days for deficiency, 3 months for excess).

   • Specified drugs: demonstrate use of interferon alpha, interleukin‑2 or lithium carbonate within three months before onset/worsening (s 9(3), s 9(15)). Provide prescription/pharmacy dispensing records.

   • Drugs containing ≥10 mg iodine daily: identify the drug, quantify iodine content and show continuous use for at least 4 weeks within three months of onset/worsening (s 9(4), s 9(16)). Pharmacy records and pharmaceutical data sheets will be required.

   • Amiodarone: show continuous use for at least 2 weeks within the year prior to onset/worsening (s 9(5), s 9(17)). Use prescription records and cardiology notes.

   • Iodine‑containing radiographic contrast: obtain hospital radiology records documenting administration within three months prior to onset/worsening (s 9(6), s 9(18)).

   • Smoking: calculate pack‑years per Schedule 1. Show at least 5 pack‑years prior to onset/worsening and, if cessation occurred before onset/worsening, that it was within five years of cessation (s 9(7), s 9(19)). Use smoking histories, GP notes, occupational health records.

   • Specified forms of thyroiditis and other diseases: provide pathology, histology, infectious disease or specialist endocrinology records to demonstrate presence of conditions listed in Schedule 1 at the time of onset/worsening (s 9(8)-(9), s 9(20)-(21)).

   • Thyroid‑stimulating pituitary adenoma: obtain endocrine/neurosurgical records demonstrating presence at relevant time (s 9(10), s 9(22)).

   • Ionising radiation for nodular goitre: commission dose reconstruction using ARPANSA Guide methodology (Schedule 1) to show cumulative equivalent dose of at least 1 sievert received to the thyroid by age 25 and at least one year before clinical onset/worsening (s 9(11), s 9(23)). Exclude radioiodine therapy from this calculation (s 9 Note 1).

   • Acute precipitating events for thyrotoxic crisis: document the acute event within 48 hours of onset (s 9(12), s 9(24)), using hospital records, emergency notes, surgical or obstetric records, or infectious disease records as relevant. Use Schedule 1 examples (infection, surgery, parturition, etc.).

   • Inability to obtain appropriate clinical management: compile contemporaneous records showing attempts to access care, referrals refused or delayed, systemic barriers, and clinical advice indicating that appropriate management was not obtained (s 9(25)). Because the term is not defined in the Schedule, detailed documentary evidence and expert commentary interpreting "appropriate clinical management" in the patient’s circumstances will be crucial.

5. Demonstrate relation to relevant service (s 10). For each established factor, the claimant must show how that factor is linked to relevant service rendered. This could be a direct link (exposure during service, medical treatment in service, occupational exposure) or an indirect link (service circumstances causing iodine deficiency or inability to obtain care). For the factors in s 9(13)-(25), the Statement applies only where the person’s goitre was suffered or contracted before or during service and did not arise out of service (s 10(2)). Prepare expert opinion to set out causal nexus between service events and the factor in question.

6. Address overlaps with other SOPs (s 11). If any factor invokes a disease that is already the subject of another RMA Statement (for example, tuberculosis or sarcoidosis among the "specified list of diseases"), identify and procure the relevant SOP and ensure factors in that SOP are met. Section 11 requires application of the other Statement’s factors where applicable.

7. Use appropriate expert evidence. Medical experts should directly address the Schedule’s technical definitions, numerics and time windows. For radiation, use a qualified dosimetrist or radiation epidemiologist who can apply the ARPANSA Guide. For iodine measures, involve endocrinologists or clinical chemists able to interpret urinary iodine results and dietary data. Experts should explicitly opine on the balance of probabilities standard the RMA invoked (s 8), and state whether, in their view, the instrument’s factor(s) and service relationship are satisfied.

8. Ensure documentary provenance and chain of custody. Obtain originals or certified copies of pathology results, radiology records, pharmacy dispensing logs, service records, and hospital notes. The Statement’s factors are primarily documentary and technical; claims will fail if documentary evidence is missing or unverifiable.

9. Anticipate conflicts and prepare rebuttals. If the opposing party or decision maker argues that an exclusion applies (s 7(2)(c)), or that exposure is outside temporal windows, prepare countervailing evidence: contemporaneous notes, repeat imaging, and expert reconstructions of exposure timing.

10. Keep the ARPANSA Guide accessible. For radiation claims, ensure your dose reconstruction expert complies with the ARPANSA Guide as referenced in Schedule 1. Have the Guide and the reconstruction report ready for submission.

11. Document attempts to obtain clinical management where relying on s 9(25). Keep records of missed appointments, waiting list evidence, referrals, or notices of service unavailability. Expert evidence explaining why available management was not "appropriate" for the claimant may be required.

12. Procedural housekeeping. Confirm that the claim is lodged under the correct statutory provision (VEA s 120B or MRCA s 339), and adhere to time limits and evidence lodgement rules in those Acts and their administrative processes.

Following these steps aligns evidence and expert opinion with the Statement’s precise criteria and reduces the risk of administrative denial on technical grounds. The critical principle for compliance is mapping evidence precisely to the numerical, temporal and definitional thresholds set out in the Statement and its Schedule.
