Statement of Principles concerning gingivitis (Balance of Probabilities) (No. 18 of 2022)

This SOP organises its legal and medical logic around several core concepts: the defined medical entity (gingivitis), enumerated causative or aggravating factors, temporal and quantitative thresholds, the legal relation to relevant service, and cross‑reference to other SOPs. Each is a discrete decision node that a claims assessor must resolve.

1. Medical entity (what counts as gingivitis)

• The instrument gives an operational clinical definition: “an acute or chronic inflammation of the gums, limited to the mucosal epithelial tissue overlying the alveolar ridge and surrounding the necks of erupted teeth” (s7(2)(a)). It then expressly lists subtypes that are included, such as acute necrotising ulcerative gingivitis, desquamative gingivitis, gingival abscess, linear gingival erythema, peri‑implant mucositis and plasma cell gingivitis (s7(2)(b)).
• It also lists excluded conditions: destructive gingival inflammation extending beyond the gums into underlying supporting structures of the teeth (which would be conditions of periodontal bone loss), gingival hyperplasia/overgrowth, gingival recession, and oral aphthae (s7(2)(c)). The SOP therefore narrows the clinical phenotype to mucosal epithelial‑level gum inflammation rather than deeper periodontal disease.

2. Factors and thresholds (how causal linkage is established)

• Section 9 sets out 35 individual factors. At least one must exist for the SOP’s nexus test to be satisfied on the balance of probabilities. The factors include direct local causes (foreign body embedded, trauma, exposure to irritant or allergen, infection at the affected region,s9(2)-(4), (16)), systemic predisposing states (HIV infection, chronic renal failure, leukaemia/lymphoma, diabetes mellitus, severe vitamin C deficiency,s9(6)-(9), (15), (17), (27)), iatrogenic or medicinal causes (drugs causing neutropenia/agranulocytosis,s9(9), immunosuppression from stem cell/bone marrow transplant,s9(11), (28)), hormonal states (pregnancy, specified combined oral contraceptive use,s9(12), (13), (30)), behavioural risks (tobacco use at defined pack‑year levels for acute necrotising ulcerative gingivitis,s9(17), (34)), inability to access clinical care (s9(35)), and a windowed failure of self‑care (prevented from cleaning teeth for 14 continuous days within 30 days before onset or worsening,s9(1), (18)).
• Where temporal windows are specified, they are precise: for example, direct exposure to an irritant or allergen within 3 days before clinical onset/worsening (s9(4), (21), (5), (22)); trauma within 2 weeks (s9(3), (20)); prevention from cleaning for a continuous 14 days within 30 days before onset or worsening (s9(1), (18)); contraceptive pill use for at least 4 continuous weeks before onset/worsening (s9(13), (30)).

3. Relationship to service (legal linkage)

• Section 10 requires the factors to be “related to the relevant service rendered by the person” (s10(1)). The SOP thus supplies medical causation criteria but leaves the assessment of whether those factors are in fact service‑related to the statutory decision process under the VEA/MRCA.
• Section 10(2) specifies that factors in subsections 9(18)-(35) apply only to material contribution to, or aggravation of, gingivitis where the person’s gingivitis was suffered or contracted before or during (but did not arise out of) the person’s relevant service. That establishes a legal boundary between “arising out of” service and “material contribution/aggravation” by service exposures.

4. Cross‑reference with other SOPs

• Section 11 requires that where a factor in s9 refers to an injury/disease already covered by another SOP, the other SOP’s factors apply to the extent set out in that SOP (s11). This creates a modular framework where certain systemic disease factors (for example, leukaemia) are governed by the SOP applicable to that disease for finer detail or thresholds.

5. Dictionary and clinical thresholds

• Schedule 1 supplies definitions that convert clinical descriptors into operational thresholds (for example, chronic renal failure defined by GFR < 15 mL/min/1.73 m2 for at least 3 months, dialysis or transplantation, or undergoing chronic dialysis; severe vitamin C deficiency as symptoms of scurvy or serum ascorbic acid < 2.5 mg/L; the contraceptive pill defined as containing at least 50 micrograms oestrogen with progestogen) (Schedule 1).

6. Standard of proof and administrative role

• The SOP is framed around the balance of probabilities standard and is an evidentiary aid; s8 states the RMA’s view that on the sound medical‑scientific evidence available it is more probable than not that gingivitis and death from gingivitis can be related to relevant service. The SOP itself is not an entitlement instrument; it is an input to decision‑making under the VEA/MRCA (s5 and s8).

Understanding these concepts is essential for applying the SOP: the assessor must map a claimant’s presentation to the precise clinical definition, identify whether any factor from s9 applies within the specified temporal/quantitative thresholds and then determine whether that factor is related to the person’s relevant service (s9, s10).

This SOP affects three primary groups directly, and several ancillary actors indirectly.

1. Primary affected persons

• Veterans and former or current members of the Australian Defence Force who lodge claims for benefits under the VEA where section 120B applies, and persons whose claims fall under section 339 of the MRCA (s5). The SOP is explicit that it “applies to a claim to which section 120B of the VEA or section 339 of the MRCA applies” (s5). Those are the statutory provisions that govern acceptance of service connection and entitlements, so the SOP affects claimants seeking acceptance of gingivitis or death from gingivitis as service related.

2. Decision‑makers and administrators

• Decision‑makers within the Department of Veterans’ Affairs and any statutory or administrative bodies tasked with applying the VEA/MRCA will use this SOP as the medical framework to determine whether gingivitis is connected with service. The SOP instructs those decision‑makers what factors suffice, and sets the evidentiary thresholds and definitions that they must apply (s9, s10, Schedule 1).
• Medical advisers and clinicians who provide expert reports for claims will be affected because their assessments must be framed against the precise definitions and timeframes in the SOP. For example, clinicians must state whether criteria such as GFR thresholds (Schedule 1) or pack‑year calculations have been met.

3. Indirectly affected parties

• Legal representatives and advocates (solicitors, advocacy organisations) who prepare and present claims will need to understand the SOP’s temporal windows and definitions to assemble evidence and plan litigation or administrative reviews.
• Treating dentists and other healthcare providers who hold records and provide contemporaneous clinical notes. The SOP’s reliance on specific clinical onset/worsening dates, blood levels, transplant history, medication use, and access to care will require contemporaneous documentation for claims (s9 and Schedule 1).
• Insurers or other compensatory schemes may be indirectly affected where coordination of entitlements, offsets, or liability depends on acceptances under the VEA/MRCA.

4. Who does not benefit under this SOP

• Persons with lesions or conditions expressly excluded by the SOP’s definition of gingivitis (for example, destructive gingival inflammation that extends into the underlying supporting structures of the teeth, gingival hyperplasia, gingival recession, or oral aphthae) are outside the scope of this SOP and so this SOP cannot be relied upon to establish service nexus for those conditions (s7(2)(c)). That does not prevent those conditions being addressed under other SOPs or claim pathways; it only excludes them from coverage under this instrument.

5. Temporal and causal nuance that affects eligibility

• The SOP differentiates onset factors from aggravation factors. The factors in subsections 9(18)-(35) apply only to material contribution to or aggravation of gingivitis where the condition pre‑existed or was contracted before or during service but did not arise out of service (s10(2)). This distinction affects where the claim sits legally: whether the claim is for a disease “arising out of” service or for a pre‑existing disease materially aggravated by service will determine which factors are applicable and how the claim is assessed.

In sum, the SOP reshapes how medical causation is operationalised in claims for gingivitis and death from gingivitis under the VEA/MRCA. It changes evidentiary expectations for claimants and alters the functional workflow of decision‑makers, clinicians and advisers who must apply the SOP’s precise definitions, timelines and thresholds.

This SOP imposes no direct criminal or civil duties in itself, but it creates binding guidance that shapes administrative duties of decision‑makers and operational responsibilities on claimants and their clinical advisers. Rights and duties flow from the VEA and MRCA but are operationalised through the SOP’s content.

1. Decision‑makers’ duties

• Apply the SOP as the medical admissibility framework when determining whether gingivitis or death from gingivitis is connected with service for claims “to which section 120B of the VEA or section 339 of the MRCA applies” (s5). The SOP establishes the factors that must be considered and which, if satisfied and related to relevant service, suffice for the relevant medical nexus on the balance of probabilities (s9 and s8).
• Evaluate whether at least one of the enumerated factors exists and whether that factor is related to the person’s relevant service (s9 and s10(1)). The duty is to determine causal relation between the listed factor(s) and the person’s service , the SOP supplies medical criteria; factual relationship to service remains a decision‑maker task under the Acts.
• When a factor in s9 refers to another injury or disease that has its own SOP, apply the factors in that other SOP “in accordance with the terms of that Statement of Principles as in force from time to time” (s11). This creates a duty to cross‑check and apply the precise terms of linked SOPs where relevant.

2. Claimant duties (practical)

• For claimants who want the SOP to assist their claim, provide evidence to substantiate one or more of the factors in s9 and show that the factor(s) is related to relevant service (s9 and s10). This will typically require contemporaneous clinical records, medication history, laboratory results (for example serum ascorbic acid levels for severe vitamin C deficiency, Schedule 1), smoking histories with pack‑year calculations, dialysis or transplant records, or evidence of inability to access appropriate clinical management (s9(35), Schedule 1).
• Where the factor refers to an injury or disease covered by another SOP, claimants will need to ensure evidence aligns with the thresholds in that SOP as called up by s11.

3. Clinical advisers’ duties

• Provide assessments that address the SOP’s specific criteria: dates for clinical onset or clinical worsening, objective test results that meet Schedule 1 thresholds (for example GFR, serum levels), confirmation of medication use sufficient to cause neutropenia/agranulocytosis (s9(9), (26)), and specific documentation of exposures (foreign bodies, trauma within 2 weeks, direct exposure to irritant/allergen within 3 days, or prevention from tooth cleaning for the specified period) (s9).
• Where relevant, quantify smoking exposure in pack‑years, applying the Schedule 1 calculation method if asked to address acute necrotising ulcerative gingivitis (s9(17), (34) and Schedule 1).

4. Rights of claimants

• Claimants retain the statutory right to have their claims considered under the VEA and MRCA frameworks; the SOP provides a medical framework that can be used to support acceptance of service connection if criteria are met. The SOP does not remove procedural rights under the Acts to seek review, appeals or merits review where applications are rejected.

5. Administrative obligations and interpretative duties

• Decision‑makers must interpret the temporal windows and quantitative thresholds as set out (for example the “continuous period of at least 14 days within the 30 days” before onset,s9(1); “within the 3 days” before onset for irritant/allergen exposure,s9(4)-(5)) and be able to explain how the claimant’s evidence maps to those windows.
• The SOP imposes an administrative obligation to consider cross‑referenced SOPs (s11). This creates a practical duty to maintain an up‑to‑date awareness of other SOPs that may be engaged by factors in s9.

6. Limits on rights and duties

• The SOP itself does not confer a direct entitlement to compensation; it is an evidentiary and medical determinant. The right to benefits still requires satisfaction of the relevant statutory tests under the VEA or MRCA. The SOP’s role is to provide a medical basis for linking the condition to service; administrative and legal processes under the Acts determine entitlements.

In short, the SOP delineates the medical elements that must be proved and thereby shapes what claimants must establish and what decision‑makers must consider when exercising their statutory duties under the VEA and MRCA.

The SOP itself does not create criminal offences, civil penalties, or a separate enforcement regime. It is an instrument that prescribes medical criteria for administrative decision‑making under the VEA and MRCA. Enforcement and consequences arise within the statutory claims and review processes rather than through direct statutory penalties in the SOP.

1. No direct penalties in the instrument

• The instrument contains no penal provisions, infringement notices, fines, or enforcement clauses. It functions as a legislative instrument that defines criteria and thresholds for medical connection (entire instrument).

2. De facto enforcement through administrative decision outcomes

• Enforcement in practice means the SOP will be used to accept or reject claims. A claimant whose evidence does not demonstrate one of the factors in s9, or cannot show a factor is related to relevant service (s10(1)), risks denial of service connection and consequential loss of access to VEA/MRCA benefits linked to that acceptance. Conversely, demonstrating the factor(s) and service relation can lead to acceptance and resulting benefits under the Acts. Therefore, the “enforcement” is by acceptance/rejection decisions and the downstream administrative effects.

3. Review, appeal and legal remedies (external to the SOP)

• The SOP sits within the VEA/MRCA regime, which contains administrative review and appeal mechanisms. While the SOP does not describe those mechanisms, a claimant who disagrees with a decision that has relied on this SOP will exercise statutory review or appeal rights available under the VEA or MRCA, and judicial review may be available on issues of legal error. The SOP does not limit those rights, but it will be a primary evidentiary instrument relied upon in disputed cases.

4. Obligations on decision‑makers to follow the SOP

• As a Statement of Principles under s196B(3) of the VEA, the SOP is the RMA’s determination of the medical factors. Decision‑makers applying the VEA/MRCA framework are expected to have regard to RMA SOPs when deciding medical causation. Administrative law principles will ordinarily require decision‑makers to apply the SOP correctly and to take into account relevant factors and definitions; failure to do so may be a ground of legal challenge. The instrument itself does not spell out sanctions for failure to follow it, but administrative and judicial remedies (reconsideration, merits review, judicial review) can arise.

5. Risk of adverse consequences for incorrect or misleading evidence

• While the SOP does not create penal sanctions for false evidence, the broader legal system may prosecute or take action if there is fraud, false representation, or false documentation in support of a claim under other relevant statute or general criminal law. Those existing legal remedies are external to the SOP.

6. Practical enforcement through medical evidence standards

• The SOP enforces its criteria through the evidentiary standards set by decision‑makers. Failure to produce clinical or laboratory evidence matching Schedule 1 thresholds, or documentary evidence of temporality/exposure, will be determinative, effectively excluding claims that cannot meet evidentiary requirements.

In summary, the instrument has no internal penalty regime. Its enforcement is operational: the medical criteria it sets are applied by decision‑makers under the VEA/MRCA and control whether claimants obtain administrative benefits or face claim denial, with review and appeal routes available under the principal Acts.

This SOP operates within and supplements the Veterans' Entitlements Act 1986 and the Military Rehabilitation and Compensation Act 2004. It also cross‑refers to other SOPs and to clinical classification systems. The instrument creates a medical evidentiary framework whose legal effect is realised through the principal Acts.

1. Statutory source and application

• Made under subsection 196B(3) of the VEA (s3), the SOP is an exercise of delegated power to determine medical factors that decision‑makers should apply when assessing service connection. It is explicitly applicable to claims under section 120B of the VEA or section 339 of the MRCA (s5).

2. Relationship to other SOPs

• Section 11 provides that if a factor in s9 refers to an injury/disease already covered by another SOP made under s196B(3), the factors in that other SOP apply “in accordance with the terms of that Statement of Principles as in force from time to time” (s11). Practically, this means:
  • Where s9 mentions, for example, leukaemia or lymphoma, the SOP for leukaemia/lymphoma (if there is one) governs the detailed requirements for establishing those conditions as factors.
  • Decision‑makers must therefore consult and apply cross‑referenced SOPs. This creates a networked regime of SOPs rather than isolated criteria lists.

3. Interaction with clinical coding and standards

• The SOP references ICD‑10‑AM codes A69.1, K05.0, K05.1 but makes clear that the operative meaning of gingivitis is the definition in s7(2), not the code alone (s7(3)-(4)). The SOP therefore uses clinical coding as a cross‑reference but imposes its own definitional boundary.

4. Interaction with the principal Acts’ legal tests

• The SOP supplies medical causation criteria that inform whether the statutory tests in the VEA/MRCA are met. The VEA and MRCA contain legal tests such as “arising out of or in the course of” service and “material contribution” or “aggravation” by service. Section 10 of the SOP specifically links to those legal categories by stating that the factors in subsections 9(18)-(35) apply only to material contribution to, or aggravation of, gingivitis where the condition was suffered or contracted before or during (but did not arise out of) the relevant service (s10(2)). Thus the SOP differentiates which factors are relevant for claims that allege a disease arose out of service versus a claim of aggravation or material contribution.

5. Potential overlap with workplace health and safety or other compensation regimes

• The SOP does not address non‑VEA/MRCA compensation regimes (workers compensation, private insurance). However, evidence and diagnoses used under those regimes could be relevant and transferable in practice. The SOP neither binds nor supersedes other statutory compensation frameworks, but it will be authoritative for VEA/MRCA determinations.

6. Administrative law obligations

• Decision‑makers are required to apply SOPs appropriately within their statutory remit. Misapplication of the SOP (for example, ignoring its definitions or misreading temporal windows) may give rise to administrative law challenges under the Acts. The SOP’s cross‑references and definitional precision are therefore material to correct legal application.

7. Interaction with clinical and public health standards

• The SOP’s Schedule 1 provides clinical thresholds (e.g. GFR < 15 mL/min/1.73 m2; serum ascorbic acid < 2.5 mg/L; contraceptive pill containing ≥ 50 micrograms oestrogen). These thresholds intersect clinical practice guidance and laboratory standards and will require alignment with accredited tests and diagnostic codes used by Australian laboratories and clinicians.

8. Amendments and legislative hierarchy

• The instrument itself is subject to amendment (Endnote 3 records an amending instrument No. 116 of 2022). Changes to the SOP will alter the medical evidence required for claims, but its legal effect remains subordinate to the principal Acts. Any conflict between the SOP and the VEA/MRCA’s legal text would be resolved in favour of the primary statutes.

Overall, the SOP functions as a technical, medically‑focused adjunct to the VEA/MRCA, narrowing and specifying how medical causation is to be demonstrated for gingivitis‑related claims. It requires decision‑makers and clinicians to apply specific clinical thresholds and temporal requirements within the legal frameworks provided by the principal Acts, and to consult other SOPs where factors cross‑refer.

The compilation includes the primary instrument (No. 18 of 2022) and records a subsequent amendment (No. 116 of 2022). The endnotes supplied with the instrument set out the legislative history and amendment history.

1. Original instrument

• Name: Statement of Principles concerning gingivitis (Balance of Probabilities) (No. 18 of 2022).
• Registration: 4 January 2022 F2022L00011.
• Commencement: 31 January 2022 (Endnote 3, Legislation history table).

2. Amending instrument

• Amendment title: Amendment Statement of Principles concerning gingivitis (Balance of Probabilities) (No. 116 of 2022).
• Registration: 24 October 2022 F2022L01395.
• Commencement: 21 November 2022 (Endnote 3).

3. What the amendment changed

• The amendment (No. 116 of 2022) amended Schedule 1 - Dictionary, specifically the definition of “combined oral contraceptive pill as specified” (Endnote 4 lists: “Schedule 1 - Dictionary - combined oral contraceptive pill as specified … rs No. 116 of 2022”). The current Schedule 1 definition now reads: “combined oral contraceptive pill as specified means an oral contraceptive pill containing estrogen at a minimum dose of 50 micrograms and a progestogen” (Schedule 1). That threshold may be narrower or broader than the pre‑amendment definition; the compilation shows the post‑amendment text.

4. Editorial changes and compilation notes

• The instrument is presented as a compilation showing the text as amended and in force on 21 November 2022. The compilation includes endnotes that list amending laws and the amendment history of provisions (compilation preamble).
• The endnotes state that if an amendment is misdescribed and cannot be given effect as intended it may be labelled “(md not incorp)” in the history (Endnote commentary on misdescribed amendments). No such notation appears in the amendment history here.

5. Uncommenced amendments and modifications

• The compilation notes that effects of uncommenced amendments are not shown in the compiled text and that any modifications from other laws are not shown in the text (About this compilation). The endnotes list the amending instruments that had been made and commenced up to the compilation date.

6. Practical significance of the amendment

• The Schedule’s definition of the “combined oral contraceptive pill as specified” is material: it sets the pharmacologic threshold for factors s9(13) and s9(30) regarding contraceptive pill use as a factor in onset or worsening. By setting a minimum oestrogen dose (50 micrograms), the amendment alters which contraceptive formulations meet the SOP’s factor criteria and therefore changes what evidence will support those particular factors in s9.

7. How to track further amendments

• The compilation directs readers to the Legislation Register for any uncommenced amendments and to the series page for the compiled law for more information on modifications and commencement (About this compilation).

In sum, the SOP was made effective 31 January 2022 and was amended as at 21 November 2022 to alter a Schedule definition relevant to contraceptive exposure. Future amendments may further refine thresholds or factors and will alter evidentiary expectations for claims.

The instrument as compiled does not record any litigation or judicial determination about its application. The SOP is an administrative medical instrument; the document itself does not list cases applying or interpreting it.

What the compilation does show:

• No cases, appeals, or judicial summaries are included in the instrument text or endnotes. The endnotes are limited to legislative history and amendment history (Endnotes 3 and 4).
• Because the SOP is used by decision‑makers under the VEA and MRCA, it is feasible claims relying on this SOP may enter administrative review, merits tribunals, or judicial review processes, but the compilation contains no record of such proceedings. The instrument therefore does not supply litigation precedent or curated case law.

Practical implications for practitioners:

• Absent cases named in the instrument, practitioners should assume there may be limited published jurisprudence applying this particular SOP at the time of compilation. Claims and appeals may generate case law over time, but the compilation gives no guidance on how courts or tribunals have construed the temporal windows, the meaning of “related to relevant service” in s10(1), or the application of cross‑referenced SOPs under s11.
• Where legal argument is necessary, counsel and advisers will need to draw from general administrative law principles, the wording of the VEA/MRCA, and relevant SOPs for comparable conditions, rather than relying on established gingivitis-specific precedents contained in this instrument.

Recommendations for tracking litigation

• Monitor decisions of administrative review bodies and courts in veterans’ law for interpretations of how s9 factors and s10 have been applied.
• Check whether tribunals have considered contentious items such as the meaning of “inability to obtain appropriate clinical management” (s9(35)), the timing windows for prevention from tooth cleaning (s9(1), (18)), and the pack‑year calculations for acute necrotising ulcerative gingivitis (s9(17), (34) and Schedule 1), since these are likely to be factually contested in appeals.

In short, the SOP contains no litigation history or reported cases; practitioners must therefore plan claims and appeals with the SOP’s textual content as the primary source and anticipate judicial or tribunal development over time.

This SOP contains several features that can catch practitioners and claimants if not addressed precisely. These are concrete operational traps arising from the instrument’s wording, temporal windows, definitional thresholds and cross‑reference rules.

1. Narrow clinical scope and explicit exclusions (s7(2))

• The SOP is limited to mucosal epithelial gum inflammation and explicitly excludes destructive gingival inflammation extending beyond the gums into supporting tooth structures, gingival hyperplasia, gingival recession, and oral aphthae (s7(2)(a)-(c)). A claim described colloquially as “gum disease” may encompass periodontitis or other states excluded by the SOP. If a claimant’s diagnosis is periodontitis rather than gingivitis as defined, this SOP will not assist the claim.

2. Reliance on precise temporal windows (s9)

• Several factors require precise timing: prevented from cleaning teeth for 14 continuous days within the 30 days before onset (s9(1)); trauma within 2 weeks before onset/worsening (s9(3), (20)); direct exposure to irritant/allergen within 3 days before onset/worsening (s9(4), (5), (21), (22)); smoking cessation within 1 month of onset/worsening for acute necrotising ulcerative gingivitis if smoking has ceased (s9(17)(b)(ii), s9(34)(b)(ii)). Absent precise records or contemporaneous evidence, it can be difficult to meet these windows. Clinicians should date clinical onset/worsening and document exposures to avoid failed claims on timing grounds.

3. Dual pathways: onset vs aggravation (s9(1)-(17) vs s9(18)-(35) and s10(2))

• The instrument separates factors relevant to initial onset from those relevant to clinical worsening or aggravation. Sections 9(18)-(35) are restricted by s10(2) to cases where gingivitis was suffered or contracted before or during (but did not arise out of) service. Mischaracterising a case as an aggravation when it is actually an onset (or vice versa) may lead to misapplication of factors. Practitioners must establish whether the claimant’s gingivitis pre‑dated service or arose out of service to identify which set of factors applies.

4. “Being prevented from cleaning the teeth” requires proof of prevention (s9(1), (18))

• The factor requires a continuous 14‑day inability to clean teeth within 30 days before onset/worsening. “Prevention” implies an external barrier, not mere neglect. Evidence will likely be required that a person was physically prevented (for example, deployed circumstances, wounds, or policies in a theatre that prevented cleaning). Absent clear proof, this factor may be rejected.

5. “Inability to obtain appropriate clinical management” is open to contest (s9(35))

• This factor is broad and potentially subjective. What counts as “appropriate clinical management” and how inability is demonstrated will be contentious. Decision‑makers may require evidence of attempts to seek care, documentation of systemic barriers while in service or post‑service, or contemporaneous communications. The absence of a precise definition creates uncertainty and dispute risk.

6. Cross‑reference traps (s11)

• If a factor refers to a disease covered by another SOP, that other SOP’s terms apply. Practitioners must check for relevant SOPs (for example, if leukaemia is in issue, the leukaemia SOP governs that disease’s criteria). Failure to consult cross‑referenced SOPs may produce incomplete claims or inconsistent medical evidence.

7. Definition thresholds that change outcomes

• Schedule 1 gives precise quantitative thresholds. Examples:
  • Chronic renal failure defined by GFR < 15 mL/min/1.73 m2 for at least 3 months or need for renal replacement therapy or undergoing chronic dialysis (Schedule 1). A claimant with GFR 20 mL/min will not meet the Schedule 1 criterion.
  • Severe vitamin C deficiency defined by scurvy symptoms or serum ascorbic acid < 2.5 mg/L (Schedule 1). Laboratory confirmation will generally be required.
  • Combined oral contraceptive pill as specified requires minimum 50 micrograms oestrogen; many modern low‑dose pills contain less and so do not meet the SOP’s criterion post‑amendment (Schedule 1 and amendment history). Practitioners must check the exact formulation and dosage when relying on s9(13)/(30).
  • Smoking pack‑years are calculated precisely in the Schedule; vague smoking histories will not be sufficient.

8. Medication list examples are not exhaustive (s9(9), (26))

• The SOP gives examples of drugs that cause neutropenia or agranulocytosis (clozapine, sulfasalazine, ticlopidine, thioamides). The list is illustrative; other drugs with those hematologic effects may also satisfy the factor if they cause neutropenia/agranulocytosis. Clinicians must link specific drugs used by a claimant to the haematologic effect.

9. Death from gingivitis requires linkage to a terminal event (s7(5) and Schedule 1)

• The SOP includes death from a terminal event “that was contributed to by the person’s gingivitis” (s7(5)). Schedule 1 defines terminal events (pneumonia, respiratory failure, cardiac arrest, circulatory failure, cessation of brain function). Establishing contribution of gingivitis to such terminal events requires medical evidence of causal pathways, which may be complex.

10. ICD‑10‑AM codes not determinative (s7(3)-(4))

• Although codes A69.1, K05.0, K05.1 are referenced, the SOP warns that the operative meaning is the definition in s7(2). Reliance on ICD coding alone without clinical detail may be insufficient.

11. Amendment risk

• The amendment altering the contraceptive pill definition (No. 116 of 2022) demonstrates that Schedule definitions can change and so change which exposures qualify under the SOP. Practitioners must check the current SOP text at the time of claim.

12. Ambiguity in “related to the relevant service” (s10(1))

• The SOP requires factors to be related to relevant service, but does not define how close the relationship must be or what sorts of service exposures qualify. This leaves a factual and legal assessment to decision‑makers under the VEA/MRCA and may lead to contested decisions.

These “gotchas” are not traps in the pejorative sense but practical points where precise evidence, contemporaneous documentation and correct classification will determine whether a claim succeeds under this SOP.

For claimants, clinicians, advocates and decision‑makers, compliance with the SOP means producing, documenting and assessing evidence that maps precisely to the instrument’s definitions, temporal windows and thresholds. Below is practical, source‑grounded guidance on what to assemble and how to present it.

1. Map the clinical diagnosis to the SOP definition (s7(2))

• Ensure the clinical record explicitly documents that the condition is gingivitis as defined in s7(2)(a) and, if relevant, which subtype is present (for example, acute necrotising ulcerative gingivitis, desquamative gingivitis, peri‑implant mucositis). If the condition involves deeper periodontal structures or is one of the excluded conditions in s7(2)(c), do not present the claim using this SOP; consider whether another SOP or compensation pathway is appropriate.
• Clinical notes should describe the location (mucosal epithelial tissue overlying alveolar ridge and surrounding necks of erupted teeth), signs (bleeding, erythema, ulceration for acute necrotising forms), and any distinguishing features relevant to subtypes.

2. Establish one or more of the factors in s9 with contemporaneous evidence

• For exposures with temporal windows, provide dated records that fall within the specified windows:
  • Prevention from cleaning: document the continuous 14‑day period and show it occurred within 30 days before clinical onset/worsening (s9(1), (18)). Examples of evidence: unit orders affecting hygiene, contemporaneous medical or incident reports, statutory declarations describing the prevention, or facility records.
  • Foreign body embedded: provide dental imaging, operation notes, or dental appliance records showing presence at time of onset/worsening (s9(2), (19)).
  • Trauma: provide clinical injury notes, dental records, or incident reports indicating trauma to gingival region within 2 weeks before onset/worsening (s9(3), (20)).
  • Irritant/allergen exposure: document the exposure and its timing within 3 days before onset/worsening (s9(4), (21), (5), (22)). Provide product names, quantities, and circumstances of exposure.
  • Infection at the affected region: microbiology, swabs, or clinical diagnosis tying the infection to the gingival region at onset/worsening (s9(16), (33)).
  • Systemic predisposing conditions: provide laboratory results and specialist reports for HIV, chronic renal failure (GFR data, dialysis records), leukaemia/lymphoma biopsy and haematology, stem cell or bone marrow transplant history, diabetes mellitus (HbA1c, diagnosis), severe vitamin C deficiency (serum ascorbic acid or clinical scurvy evidence) (s9(6)-(8), (11), (15), (17), (23)-(27), (28), (31), (32), (27) and Schedule 1).
  • Drugs causing neutropenia/agranulocytosis: document prescription history and, where available, blood counts showing neutropenia/agranulocytosis at relevant times (s9(9), (26)). If relying on an example drug, identify the specific agent and link to haematologic effect.
  • Smoking exposure: calculate pack‑years using Schedule 1 methodology and provide supporting smoking history (s9(17), (34) and Schedule 1).
  • Pregnancy or contraceptive pill use: provide obstetric records for pregnancy status at onset/worsening, and for contraceptive pill use confirm product and dose to match Schedule 1 definition (s9(12), (13), (30) and Schedule 1).
  • Inability to obtain appropriate clinical management: document attempts to obtain care, refusals, system failures, or deployment constraints; contemporaneous notes and evidence of communications are useful (s9(35)).

3. Use Schedule 1 thresholds exactly where applicable

• For chronic renal failure, supply GFR trends and documentation meeting the Schedule 1 definitions (GFR < 15 mL/min/1.73 m2 for at least 3 months, renal replacement therapy, or chronic dialysis) (Schedule 1).
• For severe vitamin C deficiency, provide serum ascorbic acid levels < 2.5 mg/L or clinical signs of scurvy (Schedule 1).
• For contraceptive pill exposure, identify the pill formulation and confirm oestrogen dose ≥ 50 micrograms (Schedule 1 and amendment history).
• For smoking, compute pack‑years as per Schedule 1 notes and show the calculation in the clinical or medico‑legal report.

4. Demonstrate service relation (s10(1))

• After establishing a qualifying factor, provide documentary evidence linking that factor to the person’s relevant service. Examples:
  • Service medical records showing exposure or treatment during deployment.
  • Unit operational logs or orders showing circumstances (for example, field conditions preventing hygiene).
  • Records demonstrating foreign body embedded during service (dental repair performed while on active duty).
  • For material contribution/aggravation factors (s9(18)-(35)), ensure the gingivitis pre‑existed or was contracted before/during service and did not “arise out of” service, because s10(2) limits those factors to that factual scenario.
• Be precise about the type of relevant service (relevant service is defined in Schedule 1) , eligible war service, defence service, or peacetime MRCA service , and ensure service records align with the claimed exposure (Schedule 1 definition of relevant service).

5. Cross‑check other SOPs when factors reference other diseases (s11)

• If a s9 factor refers to another disease covered by its own SOP (for example, leukaemia), consult that SOP and ensure evidence meets its criteria. State explicitly in the claim which SOPs are engaged.

6. Present findings in medico‑legal reports against SOP criteria

• Reports should explicitly map facts to subsection numbers. For example: “Factor s9(3) applies because the claimant sustained blunt trauma to gingival tissues on [date], which is within 14 days of clinical onset dated [date]. Evidence: incident report [ref], clinician note [ref].” This reduces ambiguity for decision‑makers.

7. Anticipate and address likely points of contention

• Be prepared to:
  • Document why the condition is not one of the exclusions in s7(2)(c).
  • Prove continuous periods (e.g., 14 continuous days prevented from cleaning).
  • Provide objective tests for systemic conditions (GFR, HbA1c, serum ascorbic acid).
  • Demonstrate the relationship of the causative factor to service as required by s10(1).

8. Keep SOP amendments and ICD references in view

• Confirm the current text of the SOP and Schedule 1 definitions at the time of claim submission; amendments (for instance No. 116 of 2022) can change which exposures qualify (Endnote 3 and 4). While the SOP references ICD‑10‑AM codes, rely on the SOP’s own clinical definition rather than the code alone (s7(3)-(4)).

9. Documentation checklist (practical)

• Accurate diagnosis and subtype.
• Clinical onset date and any clinical worsening dates.
• Dated records of exposures/explanatory events matching s9 windows.
• Laboratory values and specialist reports meeting Schedule 1 thresholds.
• Medication history tied to relevant haematologic effects.
• Smoking history quantified in pack‑years with calculations (Schedule 1).
• Service records evidencing exposure or barriers to care where service relation is claimed (s10).
• If death is claimed, cause of death documents and evidence connecting the gingivitis to the terminal event (s7(5) and Schedule 1).

10. For decision‑makers: document your reasoning against SOP sections

• Decisions should state which s9 factor(s) were found to exist, how evidence meets the Schedule 1 thresholds where applicable, and why the factor(s) were or were not considered “related to the relevant service” (s10(1)). If cross‑referenced SOPs inform the outcome, the decision record should cite them (s11).

By aligning medical evidence and service documentation precisely to the SOP’s subsections and Schedule definitions, claimants and their advisers maximise the chance that decision‑makers can apply the SOP straightforwardly and reach a reasoned outcome.
