Statement of Principles concerning gender dysphoria (Reasonable Hypothesis) (No. 113 of 2021)

The phrase “any other adult in contact with that child” is broad and could include teachers, coaches, family friends, or strangers who interact with the child in some way, as long as they are adults. The abuse must be “severe” and occur before the clinical worsening of gender dysphoria, not necessarily before onset. This means the SoP can apply even if the condition was present before service, as long as service-related factors caused an aggravation.

This SoP directly affects all persons who have rendered relevant service as defined: operational service, peacekeeping service, hazardous service, or British nuclear test defence service under the VEA; or warlike or non-warlike service under the MRCA. Inability to obtain appropriate clinical management (factor 4) implies a right of the claimant to argue that service prevented them from accessing treatment, but there is no guarantee that clinical management will be provided; it is simply a factor that may connect the condition to service if the inability existed due to service circumstances.

It is not a criminal or regulatory statute; it is a legislative instrument that determines the standard for connecting a condition to service for compensation purposes. Enforcement is through the claims review process: if a decision-maker fails to apply the SoP correctly, the claimant may seek review by the Veterans’ Review Board and then the Administrative Appeals Tribunal, and ultimately judicial review in the Federal Court on questions of law.

False or misleading statements in support of a claim are penalised under the VEA and the Criminal Code, not under this SoP. The SoP itself does not create any offence.

The real “enforcement” mechanism is the evidentiary burden it places on claimants. A claim that does not satisfy the SoP will be rejected unless the condition arose out of service. That is a significant practical penalty: denial of compensation for a condition that may be genuinely disabling. For the government, the risk is that the SoP may be too narrow or too broad and lead to either unjust denials or inflated payouts. That ties into the definitions of terminal event (pneumonia, respiratory failure, cardiac arrest, circulatory failure, or cessation of brain function), which are standard for SoPs.

Several aspects of this SoP are likely to cause traps for the unwary.

First, timing: all factors must occur before the clinical worsening of gender dysphoria. That means a claimant cannot rely on a stressor that occurred after the condition had already stabilised or improved. Clinical worsening must be demonstrated by evidence of a distinct deterioration. The SoP does not define “clinical worsening”, leaving room for dispute. If a veteran has chronic gender dysphoria with fluctuating severity, it may be difficult to pinpoint when worsening occurred. Claimants should have longitudinal mental health records.

Second, the category 2 stressor definition requires that the negative life event be “chronic in nature” and cause “ongoing distress, concern or worry”. A single event is not enough; the consequence must be enduring. For example, being socially isolated due to posting to a remote location may qualify if it leads to chronic distress, but a short-term posting may not. Bullying must be “ongoing disharmony” and involve “perceived lack of control”. This is a high bar.

Third, inability to obtain appropriate clinical management (factor 4) is the only factor that does not require an external stressor. But it requires demonstrating that the inability was service-related. “Appropriate clinical management” is not defined; it likely means treatment consistent with current Australian standards. If a veteran was denied gender-affirming care due to military policies (e.g., historical bans on transitioning), that could qualify. But if the veteran simply chose not to seek treatment, it would not. The factor must exist “before the clinical worsening”, so a delay in access that caused worsening could be relevant.

Fourth, the “serious physical attack or assault” factor (2) uses a five-year window, but the attack must be “serious”. The instrument does not define seriousness, so minor assaults may not suffice. The inclusion of “rape and sexual molestation” suggests that any instance of rape qualifies, but again timing must be within five years before clinical worsening.

Fifth, section 9(2) limits the application of all four factors to cases where the gender dysphoria was suffered or contracted before or during (but did not arise out of) relevant service. That means if a person first develops gender dysphoria during service as a result of service (arising out of service), this SoP does not apply. In that scenario, the standard of proof may be different, or the RMA may need to issue a different SoP. This is counterintuitive: a condition that first appears during service might be excluded from the SoP if it arose out of service. Not all childhood adversity qualifies.

Seventh, the definition of gender dysphoria excludes disorders of sex development. If a person is diagnosed with gender dysphoria but also has a congenital intersex condition, the SoP does not apply. The claimant must then claim under a different SoP for the intersex condition, or possibly claim the gender dysphoria is a symptom of that condition. This creates a potential gap for a small group of claimants.

Eighth, the SoP is static in time regarding DSM edition. As clinical understanding evolves, the DSM-5 criteria may be criticised or revised. Claimants with diagnoses under DSM-5-TR may not meet the DSM-5 definition exactly, but the SoP demands DSM-5. This could lead to technical rejections.

Ninth, the “inability to obtain appropriate clinical management” factor does not specify that the inability must be due to service. It says only that the factor must exist and be related to service. If the clinical management was unavailable generally in the community (e.g., no specialists in a remote area), but the veteran was posted to that area because of service, the factor may be service-related. But if the veteran chose to live remotely after discharge, it may not.

Finally, note 1 under section 8(3) on category 2 stressors states that such stressors can arise during service, from separation from service, or in the transition to civilian life. This broadens the scope: a stressor that occurs after discharge but is related to the transition (e.g., financial hardship due to unemployment after service) may qualify if it occurs within one year before clinical worsening.

Compliance with this SoP is relevant for two groups: claimants (and their representatives) preparing a claim, and decision-makers adjudicating it.

For claimants, the first step is to obtain a diagnosis of gender dysphoria from a qualified mental health practitioner that confirms the DSM-5 criteria and excludes congenital disorders of sex development. The diagnosis should record the date of onset and any periods of clinical worsening. The claimant must then identify whether any of the four factors existed before a clinical worsening.

For factor (1) severe childhood abuse: gather evidence of abuse before age 16, including medical records, police reports, child protection documents, witness statements, or detailed clinical notes. The abuse must be severe and perpetrated by an adult in contact with the child. The abuse must be related to service; this is typically satisfied if the abuse occurred before service but the connection is that the abuse caused a predisposition that was later aggravated by service. However, the abuse itself must have occurred before the clinical worsening, not necessarily during service. If the abuse occurred during service (e.g., a child of a service member abused by a family member while the member was posted), the abuse must still be related to service, which would be straightforward.

For factor (2) serious physical attack or assault within 5 years before clinical worsening: document the incident, ideally with police or medical records. “Serious” may require hospitalisation or significant injury. The assault must be related to service; for example, an assault while on deployment or during service-related travel.

For factor (3) category 2 stressor within 1 year before clinical worsening: the claimant must identify one of the seven listed chronic negative events. Provide evidence of the event (e.g., separation papers, financial statements, medical records for family member’s illness) and evidence that it caused ongoing distress. The stressor must be related to service; for example, social isolation due to posting to a remote base, or financial hardship due to unemployment after discharge. The one-year window is strict.

For factor (4) inability to obtain appropriate clinical management: evidence that the claimant sought or needed treatment for gender dysphoria but was unable to get it due to service circumstances. This could include military medical records showing denial of referral, or evidence that treatment was not available at the posting location. The inability must be before clinical worsening.

All factors require that the condition be pre-existing or contracted during service (not arising out of service). If the first diagnosis was made during service and the condition first manifested during service, the claimant must argue that the condition did not arise out of service (e.g., it was coincidental) or that this SoP applies on an aggravation theory if the condition was subclinical before service.

For decision-makers, compliance means applying the SoP text strictly. They must check the DSM-5 criteria, confirm the absence of congenital disorders, identify which factor is claimed, assess the timing of clinical worsening, and determine whether the claimed factor is related to relevant service. They should not accept a factor if the evidence does not meet the definitions. For category 2 stressors, they must ensure the event is chronic and causes ongoing distress.
