Statement of Principles concerning female sexual dysfunction (Balance of Probabilities) (No. 96 of 2016)

This instrument is a Repatriation Medical Authority determination, made under subsection 196B(3) of the Veterans' Entitlements Act 1986, that sets out a Statement of Principles (SOP) for female sexual dysfunction (FSD) on the balance of probabilities (s3, s7). It commenced on 28 November 2016 (s2) and was compiled with amendments up to 24 September 2018 (endnotes). The instrument applies to claims to which section 120B of the VEA or section 339 of the Military Rehabilitation and Compensation Act 2004 apply (s4). Mechanically, it supplies the medical-scientific framework decision-makers use when assessing whether FSD, or death from FSD, can be accepted as connected with a veteran’s or member’s relevant service.

The SOP performs three concrete legal functions. First, it defines what is meant by "female sexual dysfunction" for the purposes of claims under the relevant parts of the VEA and MRCA, including positive inclusions and explicit exclusions (s6(2)). Second, it specifies the causal or associative factors that, if present and related to relevant service, permit a finding on the balance of probabilities that FSD or death from FSD is connected with service (s8). Third, it supplies dictionary definitions and bright-line thresholds for many of those factors in Schedule 1, so that decision-makers have identifiable criteria (for example, BMI >= 30 for "being obese"; chronic renal failure defined by GFR or dialysis status).

Operationally, the SOP requires that at least one of the listed factors exist before it can be said that, on the balance of probabilities, FSD or death from FSD is connected with the circumstances of relevant service (s8). Section 9 adds a further gating condition: any factor relied upon must be related to the person’s relevant service. For factors listed at subsections 8(18) to 8(35), those factors operate only for material contribution to, or aggravation of, FSD where the FSD was suffered or contracted before or during (but did not arise out of) the person’s relevant service (s9(2)). The SOP also provides that where a factor refers to an injury or disease covered by another SOP, the factors in that other SOP apply in accordance with its terms (s10).

The instrument is administrative and medical in character; it does not create criminal offences or prescribe monetary penalties. Its legal effect is evidentiary and determinative within the statutory framework under which the Repatriation Medical Authority and decision-makers operate. The RMA records a view that, on the sound medical‑scientific evidence available, it is more probable than not that FSD and death from FSD can be related to relevant service (s7). That statement is the medico-legal predicate by which the lists of factors and definitions are given weight in claim assessments.

The SOP introduces several interlocking concepts that structure how a claim for FSD can be accepted as service-related.

Female sexual dysfunction and exclusions: The SOP defines female sexual dysfunction as a clinically significant problem in the female sexual response cycle preventing satisfaction from sexual activity, persisting for at least six months; it expressly includes female sexual interest/arousal disorder, genito-pelvic pain/penetration disorder and female orgasmic disorder, and it expressly excludes hyperactive sexual desire disorder and persistent genital arousal disorder (s6(2)). The Schedule sets out diagnostic features for the included disorders, for example the symptom thresholds that constitute female orgasmic disorder and the cluster of signs for female sexual interest/arousal disorder and genito‑pelvic pain/penetration disorder (Schedule 1).

Death from FSD: The SOP treats "death from female sexual dysfunction" as death from a terminal event or condition that was contributed to by the person’s FSD (s6(3)). The Schedule defines "terminal event" with examples such as pneumonia, respiratory failure, cardiac arrest and cessation of brain function. This produces a causal chain approach where FSD may be accepted as contributing to a proximate terminal event.

Factors as causal or aggravating elements: Section 8 enumerates 35 discrete factors that, if present and related to relevant service, permit a finding of nexus on the balance of probabilities. The factors fall into groups: genitourinary pathology; systemic medical illness (renal failure, haematological/solid organ cancer, endocrine disorders, specified neurological disorders, severe chronic medical conditions); treatments (therapeutic pelvic radiation, drugs from a specified list); physiological states (menopause, obesity); trauma (blunt or penetrating trauma to relevant anatomy, including surgical trauma and traumatic childbirth); persistent pain; reduced physical capacity (MET threshold); mental health conditions; extreme stressors and childhood abuse; inability to obtain appropriate clinical management; and timing windows for onset or worsening.

Temporal and threshold rules: Several factors include strict timing or quantitative thresholds in Schedule 1 and section 8. Examples: persistent pain requires at least three months duration; trauma must have occurred within three months prior to clinical onset or worsening; category 1A and 1B stressors are limited to events within five years prior to clinical onset or worsening; drugs must have been taken within 30 days before onset or worsening; obesity is BMI >= 30; chronic renal failure is defined by GFR <15 mL/min/1.73 m2 for at least three months, need for renal replacement therapy, or ongoing chronic dialysis. A MET threshold is used to express physical capacity inability (see Schedule 1).

Primary claimants: The SOP affects veterans and members of the Forces who lodge claims under provisions identified in section 4, specifically claims to which section 120B of the VEA or section 339 of the MRCA apply. Those persons are the intended beneficiaries of determinations about whether FSD, or death from FSD, is connected to relevant service.

Decision-makers and administrators: The Department and other decision-making bodies that apply the VEA and MRCA rely on RMA SOPs when deciding service connection. Although the instrument itself does not spell out the decision‑making process under those Acts, the SOP is a formal RMA determination under s196B(3) and is intended for use in claim adjudication (s3, s4). Medical panels, assessors, and claims officers will use the SOP to evaluate medical evidence and to decide whether at least one of the listed factors existed and was related to relevant service.

Clinicians and treating practitioners: Healthcare providers who prepare medical reports for claimants are affected. The SOP sets out the kinds of objective or categorical findings and timeframes that are persuasive for claim acceptance: for example, recording BMI to demonstrate "being obese" (Schedule 1), documenting GFR or dialysis for chronic renal failure, specifying duration of persistent pain, recording dates and fields for therapeutic radiation, and noting dates and frequency of psychiatric follow-up for "clinically significant disorder of mental health as specified". Practitioners supplying evidentiary reports must address the SOP’s thresholds and timing windows if they wish their reports to assist a claims decision.

Legal advisers and advocates: Lawyers, advocates and representatives who prepare claims or appeals will need to structure medico-legal arguments around the SOP’s factors and the requirement that factors be related to relevant service (s9). For example, establishing that a category 1B stressor occurred within five years of clinical onset will require both factual evidence and linkage to service dates.

Other instruments and SOPs: The instrument interacts with other SOPs. Where a listed factor refers to an injury or disease already covered by another SOP, the factors in that other SOP apply (s10). This means that amendments to other SOPs can indirectly change how this FSD SOP operates in practice. Endnotes show the instrument has been formally amended, and that certain dictionary entries were revised in 2018.

Wider administrative structures: The RMA is the author of the instrument and records its medical‑scientific view about causal plausibility (s7). The SOP therefore constrains, informs and simplifies the evidentiary tasks of administrators determining claims under the specified provisions of the VEA and MRCA.

What the instrument does not do: The SOP is not drafted as a statute imposing criminal sanctions, licensing obligations or monetary penalties. It is an RMA determination that defines how medical causation will be assessed in certain veteran claim contexts. The instrument does not itself create entitlement to benefits; it sets a medico-legal standard for establishing a causal link between FSD (or death from FSD) and relevant service.

Rights that arise indirectly: The main "rights" in practice are administrative. A claimant has the procedural right to have a claim assessed under the statutory provisions to which this SOP applies (s4) and to have the link between FSD and relevant service considered using the RMA-determined factors. Where at least one of the listed factors is present and related to service, decision-makers may find, on balance of probabilities, that FSD is connected with service. The SOP therefore provides a structured pathway to establish service connection; it functions as a legally significant piece of medical evidence for claimants.

Duties on decision-makers: The instrument does not, in its own text, say "decision-makers must apply" the SOP, but it is a determination made under subsection 196B(3) of the VEA (s3). Within the statutory framework, RMA determinations are the resource decision-makers draw on to assess causation. Practitioners should therefore treat the SOP as the operative RMA view that will be relied on during claim assessments; in practice, decision-makers will apply the SOP’s factors and definitions when determining whether a claimant’s FSD is connected to relevant service.

Evidentiary duties on claimants and clinicians: The SOP imposes de facto evidentiary duties on claimants and their clinicians. To rely on a particular factor, the claimant must adduce medical or documentary evidence that the factor existed at the time of clinical onset or worsening and that it was related to relevant service (s8, s9). Schedule 1 supplies precise definitions and numerical thresholds in multiple instances, creating documentary tasks (for example, showing BMI calculations for "being obese", GFR records for chronic renal failure, records of dialysis, dates and fields for radiation, prescription records for specified drugs within a 30-day window).

Interdependency with other SOPs: Section 10 creates an operational duty to check other SOPs where a factor refers to another injury or disease. If a listed factor is itself an injury covered by another SOP, the factors in that other SOP apply "in accordance with the terms of that Statement of Principles as in force from time to time". Practically, claims handlers and advisers must identify and apply the current version of any referenced SOP.

No criminal or regulatory penalties: The instrument contains no offences, fines or criminal penalties. It is a medico-administrative determination made by the Repatriation Medical Authority (s3), not a penal statute. The text does not establish enforcement mechanisms such as inspections, sanctions, or administrative penalties.

Enforcement is procedural and administrative: The SOP’s operational "enforcement" is its effect on claim outcomes. The instrument sets the medical criteria decision-makers will use when they determine whether FSD or death from FSD is connected to relevant service. In that sense, the SOP is "enforced" by its adoption in claim assessments under the VEA and MRCA framework; the consequence of failing to establish the necessary factor(s) and relationship to service is that a claim for service connection will not succeed, or will not be accepted on that basis.

Interaction with statutory review and appeal processes: The SOP itself does not set out administrative review or appeal rights. Those rights, remedies and procedural mechanisms are provided by the VEA and MRCA and related decision-making processes, not by this determination. The SOP is evidence used in proceedings under the relevant legislation. The instrument does not purport to remove or alter the statutory avenues for review that exist under the VEA or MRCA; practitioners should look to those Acts for review procedures.

Potential operational compliance consequences: Because the SOP defines precise criteria and thresholds, the practical consequence of non‑compliance with evidentiary expectations is an adverse claim outcome. For example, failing to supply medical evidence that shows a BMI of 30 or higher at the relevant time, or failing to document a category 1A or 1B stressor within the five-year period, will normally mean that the corresponding factor cannot be accepted under the SOP. That is an administrative consequence rather than a statutory penalty.

Amendment and currency obligations: Endnote material shows the SOP has been amended (e.g. No. 87 of 2018), meaning that the instrument’s content and the definitions upon which decisions are based can change. Practically, claimants and practitioners bear the compliance burden of ensuring they are operating against the current version of the SOP. The instrument itself does not set penalties for failing to use the current version; however, a decision made with reference to an out-of-date SOP could be vulnerable to challenge through the statutory review routes.

Statutory basis and application: The SOP is made under subsection 196B(3) of the Veterans' Entitlements Act 1986 (s3). Its stated application is to claims to which section 120B of the VEA or section 339 of the MRCA applies (s4). The document does not restate the substantive entitlement rules in those Acts; it provides the medical-scientific links decision-makers are to use when applying the statutory schemes. Practitioners must therefore read the SOP alongside the operative provisions of the VEA and MRCA when preparing or assessing claims.

Cross-reference to other Statements of Principles: Section 10 explicitly provides that where a factor in this SOP refers to an injury or disease that is covered by another SOP, then the factors in that other SOP apply in accordance with its terms as in force from time to time. That creates an inter-locking, hierarchical interaction between SOPs. A change to a different SOP may alter how a factor operates in this SOP; for example, if the SOP for a specified neurological disorder changes its operative factors, the application of that neurological disorder within the FSD SOP will follow the changed terms.

Relevant service definitions: The SOP’s application depends on the meaning of "relevant service", which the Schedule defines to include eligible war service, defence service under the VEA, and peacetime service under the MRCA. Thus, whether a particular episode qualifies will be tested against the definitions in those Acts and related service records. The SOP does not itself define the full scope of "eligible war service" or "defence service", which are concepts located in the primary legislation.

Medical causation and death law: The SOP includes "death from female sexual dysfunction" where death results from a terminal event or condition that was contributed to by FSD (s6(3)). The Schedule gives examples of terminal events. Where a death is attributed to a terminal event, the legal question becomes whether FSD contributed to that terminal event; the SOP supplies the medical framework for that contribution. This interacts with coronial findings and statutory death certification processes, though those processes are not governed by the SOP itself.

Evidentiary rules and administrative law: The SOP constitutes an authoritative medical view by the RMA that is used in administrative decision-making. Administrative law principles (procedural fairness, reasonableness) and evidentiary paths available in appeals and judicial review will interact with how the SOP is applied. The SOP itself does not state appeal or judicial review procedures; those are found in the VEA and MRCA and in general administrative law. Practitioners should be aware that the SOP is a determinative piece of evidence but subject to being tested on legal grounds in statutory review processes.

Core dates and documents: The Statement of Principles concerning female sexual dysfunction (No. 96 of 2016) was registered on 31 October 2016 and commenced on 28 November 2016 (Endnote 3). The compilation provided includes amendments up to the Veterans' Entitlements (Statements of Principles,Category 1B Stressor) Amendment Determination 2018 (No. 87 of 2018), which was registered 28 August 2018 and had a day of commencement of 24 September 2018 (compilation notes and endnotes).

What the amendment record shows: Endnote 3 lists the original instrument and the 2018 amendment. Endnote 4 provides the granular amendment history, indicating that Schedule 1 , Dictionary entries for "category 1B stressor" and "eyewitness" were "rs" (replicated or replaced) by No. 87 of 2018, and that "corpse" was added in that amendment (ad. No. 87 of 2018). The compilation date is 24 September 2018 and the compilation includes those amendments up to that date.

Operational consequence of amendments: Because the SOP cross-references other SOPs and incorporates definitions that may be amended, alteration of a dictionary term or definition can cascade into how the FSD SOP operates. For example, the 2018 amendment targeted dictionary entries for stressor categories and eyewitness definitions; those terms appear in s8 (factors 13, 14, 30, 31 and Schedule 1). Changes to those definitions change the eligibility of events as "category 1A" or "category 1B" stressors and the definition of "eyewitness", which in turn affects whether a factor is present under the SOP’s timing windows.

Uncommenced amendments and modifications: The compilation includes notes that uncommenced amendments are not reflected and that modifications may apply; the compilation's endnotes explain how uncommenced amendments and modifications are handled. Practitioners should consult the Legislation Register and series page for the compiled law for any amendments after the compilation date. The instrument itself warns users that the operation of a provision may be affected by application, saving or transitional provisions not included in the compilation.

No self-repealing provisions recorded: The compilation does not identify any self-repealing provisions within the instrument itself. The instrument remains in force as compiled on the stated compilation date, subject to any uncommenced amendments listed on the Legislation Register.

Practical advice from the amendment trail: The amendment history demonstrates that dictionary terms used in SOPs are not static. Because s10 requires that factors referring to other SOP-covered injuries be handled in accordance with those SOPs "as in force from time to time", amendment activity in other SOPs may alter application of this SOP without any amendment being made to the FSD SOP. Practitioners should therefore monitor RMA determinations and the Legislation Register for changes to dictionary entries and to other SOPs that are inter-referenced.

No cases recorded in the text: The compiled SOP itself contains no references to litigation or judicial decisions. The instrument is an RMA determination; the compilation reproduces the text of the SOP and the endnotes listing registration and amendment information, but it does not refer to case law or judicial interpretation.

Absence of litigation references in the SOP: The SOP does not include annotations or references to decisions that have applied or interpreted it. The lack of litigation references in the instrument is neutral: it may reflect that this is primarily a medical-determinative instrument rather than a judicial document, or simply that cases considering this SOP post-date the compilation. The SOP’s authority derives from the RMA’s statutory role under subsection 196B(3) of the VEA rather than precedent.

Where litigation would centre in practice: Although the instrument does not name cases, typical dispute points that could generate litigation at the administrative or judicial level include: the correct application of the Schedule’s numerical thresholds (for example BMI calculations, GFR thresholds, MET assessments), the temporal windows in s8 (for example whether trauma occurred within three months), the proper application of s9(2) when assessing aggravation or material contribution, and the interaction under s10 with other SOPs. Administrative law challenges may argue procedural unfairness or irrationality in the application of the SOP by decision-makers; merits review may examine whether the decision properly applied the RMA determination.

Evidence challenges: Judicial or tribunal review could also focus on evidentiary questions. For example, whether medical evidence adduced sufficiently establishes that a listed factor existed at the relevant time, whether the causative chain linking a factor to clinical onset or worsening is established on the balance of probabilities, and whether the "relation to relevant service" requirement in s9(1) is satisfied by the evidence. Because the SOP supplies a list of factors rather than a prescriptive formula, disputes about interpretation and weight of medical evidence will be natural focal points for appeal.

Recommendation for practitioners: Given the absence of litigation in the instrument text, practitioners should search administrative tribunal and judicial databases for decisions that interpret this SOP or analogous determinations. When preparing claims or appeals, anticipate that adjudicators and reviewers will closely interrogate documentary compliance with the Schedule’s thresholds and with the timing and relation-to-service requirements in s8 and s9.

Temporal windows and onset/worsening distinctions: The SOP contains multiple discrete timing rules that are easily overlooked. For onset, certain factors must exist "at the time of the clinical onset" of FSD (see s8(1)-(17)). For clinical worsening, an almost identical list repeats factors that must exist "at the time of the clinical worsening" (s8(18)-(34)). Practitioners must identify whether a claim concerns first clinical onset or a clinical worsening; the operative factor list and the service-relationship constraints under s9(2) differ depending on that classification. Misclassifying onset versus worsening can be dispositive.

Subsection 9(2) limitation: Factors in subsections 8(18) to 8(35) apply only to material contribution to, or aggravation of, FSD where the person’s FSD was suffered or contracted before or during (but did not arise out of) the person’s relevant service (s9(2)). This means that many of the "worsening" factors are not available as independent causal anchors where FSD arose after service but is alleged to be caused by service. Carefully document the chronology of FSD relative to service dates.

Definitions with numerical thresholds: Several definitions in Schedule 1 are numerically precise and demand documentary proof. Examples include "being obese" (BMI of 30 or greater), chronic renal failure (GFR < 15 mL/min/1.73 m2 for at least three months, or need for renal replacement therapy), and inability to undertake activity greater than three METs for at least one year. Where evidence does not explicitly record these metrics at the relevant time, claimants may fail to meet the SOP’s criteria. Practitioners should obtain retrospective clinical records or contemporaneous measurements where possible.

Short prescription window for drugs: The specified list of drugs includes classes commonly used in psychiatry and cardiology (e.g., SSRIs, SNRIs, tricyclics, beta blockers). The SOP requires that the drug be taken within 30 days before clinical onset or worsening (s8(17), s8(34)). Prescription records must therefore show timing that aligns with the onset/worsening date. Vague histories of past drug use will generally be insufficient.

Stressors and eyewitness constraints: Stressors are divided into category 1A and 1B and must have occurred within five years before onset or worsening (s8(13)-(14), s8(30)-(31)). The Schedule’s definitions of "category 1A stressor", "category 1B stressor", "corpse" and "eyewitness" are specific and were amended in 2018 (endnotes). A claimant’s description of a traumatic event must be aligned with the Schedule’s definitions; for example, viewing a closed body bag is excluded from "corpse". Changes to these definitions can alter claim prospects.

Evidence mapping and records checklist: To rely on the SOP, build an evidentiary package that maps each claimed factor to the SOP’s definitions and the relevant timing rules. Key documentary items include:

• Clinical onset/worsening date for FSD and contemporaneous clinical notes diagnosing FSD or recording relevant symptoms.
• Service records establishing relevant service dates and events; operational or deployment logs where relevant.
• For obesity, contemporaneous height and weight to calculate BMI (W/H2) demonstrating BMI >= 30 at the relevant time.
• For chronic renal failure, lab records showing GFR < 15 mL/min/1.73 m2 for at least three months, dialysis/transplantation records, or documentation of chronic dialysis.
• Cancer records: histopathology, oncology letters, and treatment dates for any haematological or solid organ cancer.
• Radiation records: treatment dates, radiation fields, and documentation confirming the lower abdomen, pelvis or perineal region was in the field of radiation.
• Endocrine and neurological diagnoses: specialist letters, diagnostic testing, and ongoing management notes supporting specified items in the Schedule.
• Persistent pain evidence: pain clinic records, analgesic prescriptions, disability notes showing at least three months’ duration and interference with activities.
• Trauma documentation: emergency department records, surgical notes, obstetric records documenting traumatic childbirth, or medico-legal reports specifying blunt or penetrating trauma within three months of onset/worsening.
• Menopause: records indicating cessation of menses for more than 12 months.
• Mental health management evidence: psychiatrist or GP notes demonstrating ongoing management, e.g. at least monthly follow-up, consistent with the Schedule’s "clinically significant disorder of mental health as specified".
• Stressor and eyewitness evidence: contemporaneous records, witness statements or service incident reports supporting a category 1A or 1B stressor within five years of onset/worsening; align the event description to the Schedule’s definitions.
• Drug prescription records: pharmacy or prescribing records showing class and timing of drugs taken within 30 days prior to onset/worsening.
• MET capacity evidence: exercise tests, functional capacity assessments or treating clinician reports that document inability to undertake activity greater than three METs for at least one year.
