Statement of Principles concerning coronavirus disease 2019 (COVID-19) (Reasonable Hypothesis) (No. 46 of 2020)

This instrument is framed around a small number of tightly defined legal‑medical concepts that determine whether a "reasonable hypothesis" exists to link COVID‑19, or death from COVID‑19, with relevant service. The core concepts are:

• coronavirus disease 2019 (COVID‑19): defined as illness caused by infection with SARS‑CoV‑2 (s6(2)). The instrument also notes typical clinical features as context, but those clinical features are provided as a non‑binding note rather than normative text. Death from COVID‑19 includes death from a terminal event or condition that the person’s COVID‑19 contributed to (s6(3) and Schedule 1 definition of "terminal event" which lists pneumonia, respiratory failure, cardiac arrest, circulatory failure, and cessation of brain function).

• Relevant service: the instrument uses the statutory categories of relevant service drawn from the VEA and MRCA. The Schedule defines "relevant service" by reference to operational, peacekeeping, hazardous, British nuclear test defence service under the VEA, and warlike and non‑warlike service under the MRCA (Schedule 1). Those statutory categories anchor the connection to service; the instrument itself does not redefine them.

• Factors that must exist: section 8 prescribes the threshold factual circumstances that, if established, raise a reasonable hypothesis. At least one of the following must exist: (1) exposure to SARS‑CoV‑2 as specified within the 14 days before clinical onset of COVID‑19; or (2) inability to obtain appropriate clinical management for COVID‑19. The schedule operationalises "being exposed" by enumerating five exposure pathways (Schedule 1).

• Temporal linkage and relation to service: section 9 requires that any factor in section 8 be related to the person’s relevant service (s9(1)). Section 9(2) restricts the operation of the inability‑to‑obtain‑care factor so that it applies only to material contribution to, or aggravation of, COVID‑19 where the person’s COVID‑19 was suffered or contracted before or during (but did not arise out of) the person’s relevant service.

• Interaction with other Statements of Principles: section 10 provides that where a factor in section 8 refers to an injury or disease that is the subject of another Statement of Principles made under s196B(2) of the VEA, then the factors in that other Statement apply in accordance with its terms as in force. This creates a layered framework where specialised SOPs interlock.

Two procedural‑legal contextual points in the text are important as conceptual guardrails. First, the instrument is made under s196B(2) of the VEA; the instrument therefore functions as a Repatriation Medical Authority determination under that provision (s3). Second, the instrument expressly applies to claims within the scope of section 120A of the VEA or section 338 of the MRCA (s4). The instrument does not itself create rights to compensation or benefits; rather, it supplies the medical causation factors that decision‑makers use when assessing claims under the specified provisions of the VEA and MRCA.

Finally, the instrument leaves certain terms undefined within the body of the text: "clinical onset" and "appropriate clinical management" are used as operative concepts but are not defined in the Schedule. The schedule does define "being exposed to SARS‑CoV‑2 as specified", "terminal event", "relevant service", MRCA and VEA. The presence of undefined but operative terms creates points where adjudicators will need to interpret the instrument when applying it to particular claims.

The instrument affects three groups directly and a broader administrative apparatus indirectly.

Primary affected persons

• Veterans and former or current members of the Australian Defence Force or of Peacekeeping Forces who lodge claims under the Veterans' Entitlements Act 1986 (VEA) where section 120A applies, or under the Military Rehabilitation and Compensation Act 2004 (MRCA) where section 338 applies (s4). The instrument is expressly directed to claims to which those sections apply; it therefore governs the medical causation inquiry used in assessing such claims.

• Persons who have suffered COVID‑19 or died from COVID‑19 where their illness or death is alleged to be connected to their relevant service as defined in the Schedule: operational, peacekeeping, hazardous, British nuclear test defence service under the VEA, warlike or non‑warlike service under the MRCA (Schedule 1 definition of "relevant service").

Secondary affected parties

• Decision‑makers and medical assessors operating under the VEA and MRCA. The Repatriation Medical Authority has produced this Statement of Principles as the medical benchmark for deciding whether a reasonable hypothesis is raised; decision‑makers will apply the instrument when considering causation in relevant claims (s3, s7).

• Medical practitioners and service medical units who provide records or expert opinions for claims. The instrument sets out the categories of exposure and the narrow medical bases that claimants will rely on to establish a causal link; medical evidence will be assessed against those factors (s8, Schedule 1).

• The administrative bodies that process and adjudicate claims under the VEA and MRCA. While the instrument does not itself create administrative duties, it alters the evidential landscape and therefore will influence workloads, evidentiary requests, and adjudication patterns.

Indirect effects and distributional bearings

• Because the Schedule defines "being exposed to SARS‑CoV‑2 as specified" in broad terms , including presence in a country or area experiencing transmission, shared household or immediate work/travel environment, direct contact with contaminated objects, proximity within two metres, or inhalation of contaminated droplet nuclei or aerosols (Schedule 1) , a wide range of factual scenarios may meet the instrument’s exposure factor. That breadth affects the population of claimants who can potentially raise a reasonable hypothesis on medical grounds, and therefore may increase the number and variety of claims that decision‑makers must handle.

• The "inability to obtain appropriate clinical management" factor affects a narrower subset of claimants because s9(2) limits its application to material contribution or aggravation where COVID‑19 was suffered or contracted before or during (but did not arise out of) relevant service. That restriction channels which persons may rely on this factor.

What the instrument does not directly affect

• Private‑law liability, employer duties outside the VEA and MRCA claims processes, or criminal law enforcement. There are no offences, penalties or enforcement provisions in this instrument; its scope is limited to the medical causation standards for specified statutory claims (see the absence of penalty provisions in the text).

• Broader public health entitlements and non‑service compensation schemes. The instrument does not purport to alter non‑VEA or non‑MRCA entitlements, though its definitions and medical findings may be persuasive in other contexts.

In short, the instrument chiefly affects veterans and service members who make claims under the specified statutory provisions, and the medical and administrative actors who assess those claims. The definitions and the two distinct causation factors determine who can plausibly raise a reasonable hypothesis and therefore who will proceed to the next stages of statutory entitlements adjudication.

This instrument does not create duties or criminal penalties. Rather, it establishes medical causation criteria that operate as part of the decision‑making framework for claims under the VEA and MRCA. The key operative obligations and rights are therefore indirect and procedural, arising in the context of a claim.

Rights and entitlements implicated

• Right to have a claim considered against a specified medical benchmark: a person lodging a claim to which section 120A of the VEA or section 338 of the MRCA applies is entitled to have the question of whether a reasonable hypothesis connects their COVID‑19, or death from COVID‑19, to their relevant service determined using the factors set out in this Statement of Principles (s4, s7). The Statement supplies the medical criteria decision‑makers must use when assessing causation under the referenced claim provisions.

Operational duties implied for decision‑makers and clinicians

• Duty to apply the factors in section 8 as the minimum factual basis for raising a reasonable hypothesis: decision‑makers must identify whether at least one of the section 8 factors exists before concluding that a reasonable hypothesis has been raised. Section 8(1) requires exposure to SARS‑CoV‑2 within 14 days before clinical onset; section 8(2) permits consideration of inability to obtain appropriate clinical management. The Schedule provides the defined meanings for "being exposed to SARS‑CoV‑2 as specified" (Schedule 1).

• Duty to establish nexus between the factor and relevant service: section 9(1) requires that any factor relied upon be related to the person’s relevant service. Decision‑makers must therefore assess whether the factual exposure or inability to obtain management is related to the person’s service as defined in the Schedule.

• Duty to observe the limitation on the clinical management factor: section 9(2) constrains use of the clinical management factor so that it applies only to material contribution to, or aggravation of, COVID‑19 where the COVID‑19 was suffered or contracted before or during, but did not arise out of, the person’s relevant service. Decision‑makers must therefore be able to temporally locate the illness relative to service and to ascertain causation or aggravation dynamics.

• Duty to apply other Statements where relevant: section 10 requires that if a factor in section 8 refers to an injury or disease covered by another Statement of Principles, then the factors in that other Statement apply in accordance with its terms. Decision‑makers must therefore cross‑reference and apply the relevant Statements as in force.

Evidence and proof burdens

• The instrument sets the medical grounds needed to raise a reasonable hypothesis; it does not itself allocate evidential burdens or specify standards of proof beyond the language "reasonable hypothesis." The VEA and MRCA provisions that this instrument supports, and the decision‑making frameworks that apply under those Acts, govern evidentiary procedures. What this instrument does is specify what factual categories, if established, are sufficient on medical grounds to raise the required hypothesis (s8).

No statutory penalties or enforcement duties

• The instrument contains no enforcement mechanisms, sanctions or administrative penalties. It neither imposes new administrative reporting obligations nor prescribes specific procedural steps to be taken by agencies in order to enforce compliance.

Practical implication of those duties and rights

• For claimants, the practical "right" is to have the instrument’s factors considered. For medical experts and decision‑makers, the duty is to apply the instrument’s definitions and constraints when determining whether a reasonable hypothesis is raised. For administrative decision‑makers, the instrument shapes which factual inquiries they must pursue and which evidentiary sources they may require to ascertain exposure within the defined 14‑day window and to judge whether inability to obtain clinical management is established and related to relevant service (s8, s9, Schedule 1).

The Statement of Principles contains no penalty clauses, no offence provisions and no direct enforcement or remedial mechanisms. It is a medical determination made under subsection 196B(2) of the VEA (s3) and functions as a technical input for the causation inquiry conducted in claims under section 120A of the VEA or section 338 of the MRCA (s4). The instrument’s legal force therefore derives from its role within the statutory claims framework rather than from standalone enforcement provisions.

What enforcement mechanisms are absent

• The instrument does not create fines, criminal offences, administrative sanctions or compliance orders. It does not prescribe timelines for decision‑making, inspection powers, civil enforcement processes, or dispute resolution mechanisms. It does not specify any investigatory powers for the Repatriation Medical Authority or any other agency.

How the instrument is enforced in practice

• Enforcement in the sense of operational effect occurs through the application of the instrument by decision‑makers under the VEA and MRCA. The Repatriation Medical Authority itself issues the Statement of Principles as the medical standard to be applied; adjudicators and medical assessors will apply the instrument when determining whether a reasonable hypothesis exists. Where a claimant meets the instrument’s medical factors, the claim proceeds to the statutory determination processes and any entitlements that the VEA or MRCA provides may become payable according to those Acts. The Statement therefore acts as an evidentiary and medical gate for progression within the established statutory scheme; the instrument does not itself award or enforce benefits.

Dispute or review pathways

• The instrument does not specify review, merits reconsideration, or appeal pathways. Any dispute about application of the Statement of Principles to a particular claim will be resolved via the statutory decision‑making and review processes applicable under the VEA and MRCA, including any internal review, merits review or judicial review rights provided by those Acts and general administrative law. The instrument itself does not add new review rights or adjudicative processes.

Practical enforcement risks and administrative consequences

• Because the instrument defines broad exposure pathways (Schedule 1) and provides an extra factor based on inability to obtain appropriate clinical management (s8(2)), decision‑makers may see an increased volume of claims or requests for medical assessment. The instrument does not supply resources or procedural rules to manage increased caseloads. Any administrative enforcement of the instrument therefore depends on the existing mechanisms and capacities of the agencies that handle VEA and MRCA claims.

In sum, the Statement of Principles is an administrative medical determination with operative effect through the statutory claims processes; it contains no independent penalties or enforcement provisions and relies on existing statutory mechanisms under the VEA and MRCA to give it practical effect.

This instrument is explicitly integrated into the VEA/MRCA statutory framework and interacts with other Statements of Principles under subsection 196B(2) of the VEA. The instrument’s text identifies the following legal intersections.

Direct statutory links

• Authority and operation: the instrument is made under subsection 196B(2) of the VEA (s3). Its stated application is to claims to which section 120A of the VEA or section 338 of the MRCA applies (s4). Therefore the instrument is a medical determination intended to be applied within the statutory decision‑making frameworks established by those two Acts. Any substantive entitlements, procedural rights and review mechanisms are supplied by the VEA and MRCA rather than by this instrument.

Interaction with other Statements of Principles

• Section 10 provides an express mechanism for inter‑Statement interaction. If a factor in section 8 applies in relation to a person and that factor refers to an injury or disease in respect of which another Statement of Principles has been determined under subsection 196B(2) of the VEA, then the factors in that other Statement apply in accordance with its terms as in force from time to time. This clause creates a hierarchical or networked application where multiple Statements may govern different components of an injury or disease relationship. Decision‑makers must therefore map cross‑references and apply the relevant Statements together.

Definitions linked to statute

• The Schedule defines MRCA and VEA as abbreviations for the Military Rehabilitation and Compensation Act 2004 and the Veterans' Entitlements Act 1986 respectively (Schedule 1). It also defines "relevant service" by reference to the service categories in those Acts (e.g., operational service, peacekeeping service, warlike service). Therefore the instrument relies on statutory categories in other laws to determine whether a person’s service falls within scope.

Non‑overriding nature

• The instrument does not purport to override or amend the substantive terms of the VEA or MRCA. It is a medical determination for use in the application of those Acts. Any legal effects on entitlements, procedural duties, or review rights flow from those parent Acts. The instrument therefore must be read as supplementary medical guidance rather than as an independent source of statutory power.

Potential areas of cross‑application

• Section 10 contemplates that some factors might refer to injuries or diseases covered by other Statements. For example, the list of terminal events in the Schedule (pneumonia, respiratory failure, cardiac arrest, circulatory failure, cessation of brain function) may be the subject of other Statements of Principles. Where overlap exists, section 10 requires application of the other Statement’s factors "as in force from time to time", meaning that updates to other Statements will also affect how this instrument operates where a factor invokes those other conditions.

Matters not addressed

• The instrument does not address how it should be applied where other federal or state statutes use different medical definitions, nor does it specify interaction with industrial or workers' compensation schemes. It also does not set out whether or how its definitions may be used or admitted in non‑VEA/MRCA litigation. Those issues are left to the decision‑making and judicial processes outside the instrument.

In short, this Statement of Principles functions within the legal architecture of the VEA and MRCA and is expressly designed to interoperate with other Repatriation Medical Authority Statements where factors overlap. It does not itself create new statutory duties outside that architecture.

The instrument identifies itself as "Statement of Principles concerning coronavirus disease 2019 (COVID‑19) (Reasonable Hypothesis) (No. 46 of 2020)" (s1). The operative metadata recorded in the instrument is limited; the text contains the following concrete historical data points:

• Date of determination: the face of the instrument is dated 12 June 2020 (the instrument carries the Repatriation Medical Authority common seal and the Chairperson's signature as attestation).

• Commencement date: the instrument commences on 22 June 2020 (s2).

• Instrument number: identified as No. 46 of 2020 in the title.

The instrument does not contain any textual record of prior versions, amendments, or revocations. It does not include a schedule of amendments or a history of changes. There are no transitional provisions or sunset clauses in the text as provided.

Implications of the absence of amendments in the text

• Because the text does not record any amendments, the instrument as supplied should be read as the initial, standalone Statement of Principles No. 46 of 2020, commencing 22 June 2020. Any later amendments, replacements or revocations, if they exist, are not recorded in this instrument and therefore cannot be relied on from this source. Section 10 anticipates that other Statements may be updated "from time to time", but this instrument’s text does not itself record subsequent changes to this Statement.

Administrative provenance

• The instrument explicitly states it is "made under subsection 196B(2) of the Veterans' Entitlements Act 1986" (s3). The Repatriation Medical Authority affixed its common seal and the Chairperson's signature to the instrument, which is the standard administrative procedure for Statements of Principles under that statutory provision. The instrument therefore follows the typical administrative process for issuing Statements of Principles.

Where to look for later amendments

• Any amendments, revocations or replacement Statements would be recorded in the Federal Register of Legislation and in subsequent Repatriation Medical Authority determinations. This instrument itself contains no further amendment history or recorded changes.

The text of this Statement of Principles contains no litigation history, judicial citations or references to case law. It does not refer to any decisions in which this particular Statement has been judicially considered, nor does it note any legal challenges, appeals or precedent‑setting determinations. The instrument is a medical‑scientific determination rather than a judicial instrument; any litigation history would arise after application in specific claims under the VEA or MRCA and is not recorded in this text.

What this absence means for practitioners and researchers

• There are no case citations or judicial interpretations contained in the instrument that clarify how courts or tribunals have applied these factors. Where disputes arise about the meaning or application of this Statement, those disputes will be resolved through the statutory review and appeal mechanisms in the VEA and MRCA and, if litigated, through administrative or judicial review in the courts. Any judicial or tribunal treatment of this Statement, and any persuasive or binding interpretations, will need to be sourced from case reports or tribunal decisions external to this instrument.

Topics likely to generate litigation (based on the instrument’s content)

• Ambiguities in operational terms: the instrument uses operational but undefined terms such as "clinical onset" and "appropriate clinical management". Disputes over the meaning and evidentiary thresholds for those terms could give rise to litigation about whether a reasonable hypothesis has been raised.

• Application of the inability‑to‑obtain‑care factor: section 9(2) places temporal and causal constraints on this factor. Litigation may arise over whether those constraints are satisfied in particular factual scenarios, for example where service periods overlap with periods of illness or where the causation pathway between inability to obtain care and aggravation of disease is contested.

• Interaction with other Statements: section 10 requires cross‑application of other Statements of Principles where factors overlap. Litigation could test which Statement governs and how to reconcile competing factors.

Because none of these disputes are documented in the instrument itself, practitioners and researchers must look to subsequent administrative decisions, tribunal outcomes and court judgments to map the litigation history.

This instrument is concise but contains several specific features and potential pitfalls that decision‑makers, practitioners and claimants should note. These "gotchas" arise from definitional breadth, omitted definitions, temporal constraints, cross‑reference mechanics and scope limitations in the text.

1. Broad definition of "being exposed to SARS‑CoV‑2 as specified"

• The Schedule enumerates five distinct exposure pathways: presence in a country or an area with current SARS‑CoV‑2 transmission; being in the same household, or immediate work or travel environment, as a person with SARS‑CoV‑2 infection; direct contact with an object or substance contaminated with SARS‑CoV‑2; direct contact with, or being within two metres of, a person with SARS‑CoV‑2 infection; or inhaling droplet nuclei or aerosols contaminated with SARS‑CoV‑2 (Schedule 1). Because the list includes being in a "country or an area" with transmission, many overseas deployments or travel histories may meet this criterion even without known close contact. Practitioners should be aware that the exposure factor is not limited to documented close contact.

2. Time window for exposure

• The exposure factor in section 8(1) requires exposure "within the 14 days before the clinical onset of coronavirus disease 2019 (COVID‑19)". This introduces a specific temporal boundary. The instrument does not define "clinical onset", so assessing whether an exposure falls within the 14‑day window may require medico‑legal interpretation of symptom onset dates, test dates, or clinician records. Claimants whose exposure occurred outside the 14‑day window will not be able to rely on s8(1) absent other factors.

3. Undefined but operative terms

• "Clinical onset" and "appropriate clinical management" are operationally critical but are not defined in the Schedule. This creates scope for interpretive disagreement. For example, what constitutes appropriate clinical management may vary with time, location and prevailing clinical guidance. Section 9(2) restricts the clinical management factor to specific temporal and causal circumstances, but the undefined nature of "appropriate clinical management" could generate evidentiary disputes.

4. Narrow operation of the clinical management factor

• The inability‑to‑obtain‑appropriate‑clinical‑management factor in s8(2) is available only for material contribution to, or aggravation of, COVID‑19 where the person’s COVID‑19 was "suffered or contracted before or during (but did not arise out of) the person's relevant service" (s9(2)). This means that if COVID‑19 arose out of the relevant service, the inability‑to‑obtain‑care factor cannot be used as a basis for material contribution or aggravation under this instrument. Practitioners must carefully establish the temporal relationship between illness and service.

5. Death definition and terminal events

• Death from COVID‑19 includes death from a terminal event or condition that was contributed to by COVID‑19 (s6(3)). The Schedule defines "terminal event" to include pneumonia, respiratory failure, cardiac arrest, circulatory failure, and cessation of brain function. Where death is ascribed to one of these terminal events, decision‑makers must assess whether COVID‑19 contributed to that terminal event. That assessment will require causal medical evidence linking COVID‑19 to the terminal pathology.

6. Cross‑references to other Statements

• Section 10 requires application of other Statements of Principles when a factor refers to an injury or disease already covered by another Statement. Practitioners should be alert to fact patterns that invoke multiple Statements and should apply the other Statements "as in force from time to time". Changes to other Statements after this instrument’s commencement will therefore affect how certain factors are to be assessed.

7. No operational procedures or evidentiary checklist supplied

• The instrument sets out the medical factors but does not prescribe the types of evidence (e.g., testing records, contact tracing, travel records, medical notes) that will satisfy those factors. Decision‑makers and claimants must therefore infer the evidentiary sources that reasonably establish the specified factors, which could lead to divergent adjudicative practices.

8. Instrument limited to VEA/MRCA claim context

• The Statement only applies to claims to which s120A of the VEA or s338 of the MRCA applies (s4). This means it will not automatically govern other compensation schemes or private litigation, even though its medical definitions may be persuasive elsewhere.

9. Administrative workload implications

• The combination of a broad exposure definition and an additional clinical management factor, albeit temporally restricted, may lead to an increased number of claims that can validly raise a reasonable hypothesis. The instrument itself contains no provision for administrative resourcing, and adjudicators will need to manage potential caseload and evidentiary complexity.

10. No penalties for false claims specified

• The instrument does not contain deterrents for false or exaggerated claims. Any sanctions for false statements or fraudulent claims would derive from other statutory or common law provisions in the VEA, MRCA or general law, not from this instrument.

Practitioners should therefore pay particular attention to timing, the evidentiary basis for exposure and clinical onset, the precise scope of the clinical management factor under s9(2), and any overlapping Statements of Principles referenced under s10.

Compliance in relation to this Statement of Principles means, for claimants and advisors, assembling and presenting the medical and factual material necessary to satisfy the instrument’s factors so that a decision‑maker can determine whether a reasonable hypothesis has been raised. For decision‑makers and medical experts, compliance means applying the instrument’s definitions and constraints when assessing claims. The instrument does not specify forms or procedural steps; the following actions are grounded in the text and reflect how to operationalise its requirements.

For claimants and their advisors

• Identify whether the claim falls within the instrument’s application: confirm that the claim is one to which section 120A of the VEA or section 338 of the MRCA applies (s4). If not, this Statement will not be the correct medical benchmark.

• Establish which factor in section 8 is being relied upon: either exposure to SARS‑CoV‑2 within the 14 days before clinical onset (s8(1)), or inability to obtain appropriate clinical management for COVID‑19 (s8(2)). At least one of these must exist to raise a reasonable hypothesis.

• If relying on exposure (s8(1)), collect evidence that maps to the Schedule’s five exposure pathways: presence in a country or area with current transmission; being in the same household or immediate work or travel environment as an infected person; direct contact with contaminated objects or substances; direct contact with, or being within two metres of, an infected person; or inhalation of contaminated droplet nuclei or aerosols (Schedule 1). Evidence can include travel records, deployment orders, accommodation logs, workplace rosters, contact tracing records, contemporaneous notes about known contacts, test results for household/work contacts, and any contemporaneous clinical notes that record symptom onset.

• Pay particular attention to timing: exposure must be within 14 days before "clinical onset" of COVID‑19 (s8(1)). Since "clinical onset" is not defined in the instrument, claimants should obtain precise medical records that document the first symptom date, test dates, and clinician assessments that denote onset. Where symptom onset is unclear, contemporaneous medical or nursing notes, diagnostic testing dates, or statements from treating practitioners will be material.

• If relying on inability to obtain appropriate clinical management (s8(2)), gather medical records, hospital triage notes, correspondence showing attempts to obtain care, and contemporaneous records indicating lack of access. Remember that s9(2) limits the operation of this factor to situations where the COVID‑19 was suffered or contracted before or during, but did not arise out of, the person’s relevant service. Include materials that establish when the illness was suffered or contracted relative to service periods.

• For claims involving death, ensure medical and coronial records address whether death was from a terminal event to which COVID‑19 contributed. The Schedule lists terminal events (pneumonia, respiratory failure, cardiac arrest, circulatory failure, cessation of brain function) that qualify under s6(3). Obtain cause‑of‑death findings, medical attendant reports and any relevant hospital notes.

• Consider cross‑reference to other Statements: if the claim’s facts involve injuries or diseases covered by other Statements of Principles, identify and obtain the relevant Statements, because s10 mandates that those Statements’ factors apply as in force. Collect any evidence those other Statements require.

For medical assessors and decision‑makers

• Apply the instrument’s definitions literally: use the Schedule’s definition of "being exposed to SARS‑CoV‑2 as specified" when assessing claims under s8(1). Where an exposure pathway is alleged, the assessment should check whether the evidence fits one of the enumerated pathways.

• Precisely determine the clinical onset date: because the 14‑day window is central, ascertain the date that qualifies as clinical onset using documented symptom onset, test dates and treating practitioner records. Where onset is disputed, weigh contemporaneous clinical notes and diagnostic evidence.

• Apply s9(1) nexus requirement: ensure any factor relied upon is related to the person’s relevant service, as defined in the Schedule. This may require mapping exposure events to deployment locations, service periods, or service‑related environments.

• Observe the s9(2) constraint on s8(2): the inability‑to‑obtain‑care factor is limited to material contribution or aggravation when COVID‑19 was suffered or contracted before or during, but did not arise out of, relevant service. Confirm the temporal relationship between illness and service. Where COVID‑19 allegedly arose out of the service, s8(2) does not provide a basis for material contribution or aggravation under this Statement.

• Cross‑reference other Statements when invoked: if a factor refers to an injury/disease covered by another Statement, apply that Statement’s factors as in force, per s10. Ensure any updates to other Statements are considered.

Practical evidence management and adjudication tips grounded in the instrument

• Use documentary evidence that best maps to the instrument’s enumerated concepts: deployment records, travel itineraries, accommodation and billet records, contact tracing information, workplace rosters and contemporaneous clinical notes for exposure; hospital logs, referral letters, triage notes and communications showing inability to obtain care for the clinical management factor.

• For death claims, ensure cause‑of‑death documentation addresses whether COVID‑19 contributed to a terminal event listed in the Schedule; where coronial material exists, obtain the coronial findings.

• Where terms are undefined (e.g., "appropriate clinical management"), provide contemporaneous clinical guidance or expert medical opinion that explains why particular care should have been available or why its absence materially contributed to disease progression, linking that opinion to the s9(2) temporal constraint where relevant.

• Prepare to reconcile overlaps with other Statements: assemble any other relevant Statements of Principles and determine whether those Statements supply additional or alternative factors that must be satisfied under s10.

Limitations of compliance guidance

• The instrument supplies the medical factors but does not prescribe procedural forms, timeframes, or the standard of proof for decisions. Those matters are governed by the VEA and MRCA and by the administrative procedures of the competent decision‑making bodies. Claimants and advisers should therefore use this Statement to frame the medical evidence and to ensure that the facts align with the instrument’s enumerated factors and temporal constraints.

In sum, compliance requires matching documentary and medical evidence to the instrument’s enumerated exposure pathways or to the clinical management factor, establishing temporal alignment with clinical onset and service, and applying any relevant cross‑references to other Statements of Principles.
