Statement of Principles concerning cluster headache (Balance of Probabilities) (No. 58 of 2018)

The primary substantive concept is a tailored, operational definition of cluster headache used for adjudication of service connection. Subsection 7(2) gives a diagnostic-style definition: multiple attacks of severe unilateral headache in orbital, supraorbital or temporal regions, each lasting typically 15 to 180 minutes, accompanied by restlessness or specified ipsilateral autonomic signs (conjunctival injection or lacrimation; eyelid oedema; forehead and facial sweating; miosis or ptosis; nasal congestion or rhinorrhoea). The definition expressly includes episodic and chronic forms and expressly excludes a defined list of alternate headache diagnoses and causes, including inflammatory disorders of head and neck, structural abnormalities, systemic disease, hemicrania continua, migraine, paroxysmal hemicrania, SUNCT, SUNA, tension-type headache, and trigeminal neuralgia (s 7(2)(a)-(c)). The instrument notes that cluster headache typically maps to ICD‑10‑AM code G44.0 but instructs that the operative meaning is the statutory definition in s 7(2) rather than the ICD code alone (s 7(3)-(4)).

Another core concept is causal and temporal filtering. Section 9 lists the factors that “must exist” for connection on the balance of probabilities. Each factor is expressed in narrow terms and with explicit timing: nitrates (glyceryl trinitrate, isosorbide mononitrate, isosorbide dinitrate) taken within 24 hours before clinical worsening (s 9(1)), alcohol consumed within 24 hours before clinical worsening (s 9(2)), and an inability to obtain appropriate clinical management for cluster headache (s 9(3)). Section 10(2) limits the application of those factors to cases where the cluster headache was suffered or contracted before or during the relevant service, but did not arise out of the service, meaning the factors are available only for material contribution to, or aggravation of, a pre-existing or contemporaneous condition, not for primary causation arising out of service.

The instrument also recognises death from cluster headache as a compensable endpoint where the cluster headache contributed to a terminal event such as pneumonia, respiratory failure, cardiac arrest, circulatory failure or cessation of brain function, as defined in Schedule 1 (s 7(5); Schedule 1). Section 11 sets an interaction rule with other Statements of Principles: if a factor in s 9 refers to an injury or disease already covered by another Statement, then the factors in that other Statement apply according to their own terms.

Finally, the legal status concept: this is a Repatriation Medical Authority Statement of Principles made under the VEA. The instrument’s stated medical-scientific basis is the RMA’s view “on the sound medical‑scientific evidence available” that a service connection is more probable than not (s 8). The instrument applies to claims where s 120B of the VEA or s 339 of the MRCA are relevant (s 5). The Statement therefore functions as a determinative medical framework used by decision processes governed by those statutes.

The instrument applies to claimants whose claims fall within the scope of section 120B of the VEA or section 339 of the MRCA, as stated in section 5. Those statutory references identify the class of claims for which the Statement supplies the medical factors for establishing service connection, but the instrument itself does not reproduce or expand those statutory eligibility criteria. The Schedule defines “relevant service” as eligible war service (other than operational service), defence service (other than hazardous service and British nuclear test defence service) under the VEA, or peacetime service under the MRCA, thereby indicating which forms of service can generate claims where this Statement will be applied (Schedule 1).

Practically, the instrument affects three groups. First, veterans, members of the Forces, or former members who assert that their cluster headache or death from cluster headache is connected with their relevant service will be directly affected because the Statement identifies the factors they must demonstrate on the balance of probabilities for a finding of connection (s 9 and s 10). Second, clinical practitioners preparing evidence for such claims will be affected because the statutory definition of cluster headache and the listed aggravating factors narrow the clinical findings and temporal relationships that decision-makers will expect to see in evidence (s 7(2); s 9). Third, administrative decision-makers and adjudicators applying the VEA and MRCA provisions will be affected because the Statement provides the medical-factual yardstick for assessing connection where the statute requires application of a Statement of Principles (s 3; s 5).

The instrument also affects estates and dependants where death from cluster headache is alleged to have contributed to a terminal event, because the Statement treats death from cluster headache as including death from a terminal event to which the cluster headache contributed, and defines terminal events (s 7(5); Schedule 1). The RMA’s repeal of the prior 2010 Statement (s 4) means claimants and decision-makers must use this 2018 Statement for relevant claims from its commencement date.

Finally, the instrument has indirect effects on providers of pharmaceuticals and operational medical services only to the extent that it identifies specific agents (glyceryl trinitrate and the isosorbides) and a management-access factor. The Statement does not impose regulatory obligations on clinicians or suppliers, but it does make particular exposures and service-era access to management legally salient for adjudication (s 9(1), s 9(3)).

This Statement does not itself create statutory monetary entitlements or duties to pay. Instead, it establishes the medical-factual conditions that must be met for a finding that cluster headache or death from cluster headache is connected with relevant service in claims to which section 120B of the VEA or section 339 of the MRCA apply (s 5). The instrument’s operative legal effect is to instruct decision-makers that at least one of the factors in section 9 must exist, and must be related to the person’s relevant service, before connection can be found on the balance of probabilities (ss 9 and 10(1)). That allocates the burden of establishing those factual linkages to claimants by identifying the precise types of facts that qualify.

Key rights implied by the Statement are limited and indirect. A claimant asserting connection has the right to have their case assessed against the medical criteria set out in this Statement when their claim falls within the referenced statutory provisions (s 5). If a claimant can establish one or more of the section 9 factors and show the factors relate to relevant service, decision-makers are to treat those factors as satisfying the medical test for connection on the balance of probabilities, subject to the statutory framework in the VEA or MRCA that governs ultimate entitlement. The Statement declares the RMA’s medical-scientific view that connection is more probable than not on the evidence available, which frames the evidentiary lens decision-makers will apply (s 8).

Duties arise for decision-makers only inasmuch as they must apply the Statement to relevant claims under the statutory provisions it references. The Statement requires that if a factor in section 9 refers to an injury or disease covered by another Statement of Principles, then the factors in that other Statement apply in accordance with its terms (s 11). This creates a procedural duty to cross-reference other Statements where applicable.

The instrument does not impose clinical duties on treating doctors, nor does it create new criminal or civil liabilities. It does not specify evidentiary rules, procedural timeframes for claims, or appeal routes; those matters remain governed by the VEA, MRCA, and administrative law. The Statement does, however, affect the substantive burden on claimants, because it narrows the types of medical or exposure evidence that can satisfy the causation question for cluster headache claims: a claimant must show, on the balance of probabilities, the existence of at least one of the s 9 factors and that it is related to relevant service (ss 9 and 10).

The Statement does not specify penalties, fines, or criminal sanctions. It is a medical-factual instrument created under subsection 196B(3) of the VEA for the purpose of assessing service connection in specified veterans’ claims, and operates as an adjudicative criterion rather than an enforcement code (s 3; s 5). There is no provision in the instrument that imposes obligations enforceable by regulatory penalties on individuals or medical practitioners for non-compliance. Nor does the instrument create new statutory enforcement powers or administrative sanctions against service providers or claimants.

Enforcement, in the practical sense, occurs through the application of the Statement by the administrative decision-makers who determine entitlements under the VEA or the MRCA. When assessing whether cluster headache or death from cluster headache is connected with relevant service for the statutory purposes cited in section 5, decision-makers will apply the factors in section 9 and the relationship rules in section 10. If an applicant cannot establish the requisite factor(s) on the balance of probabilities, then there will be no medical finding of connection under this Statement and the claim will be resolved accordingly under the governing statute. Any consequences for entitlement flow from the decision under the VEA or MRCA, not from the Statement itself.

The instrument also repeals the earlier 2010 Statement (s 4), so the decisive Statement for claims from commencement is the 2018 instrument. There is no internal enforcement mechanism or penalty clause in the text requiring notification, remediation, or corrective action where a Statement has been misapplied; remedies or challenge routes would be those available under the VEA, MRCA, or general administrative law.

This Statement is expressly made under subsection 196B(3) of the Veterans’ Entitlements Act 1986, and it applies to claims to which section 120B of the VEA or section 339 of the Military Rehabilitation and Compensation Act 2004 apply (ss 3 and 5). The instrument therefore interacts with the VEA and MRCA by supplying the medical-factual criteria used when those statutory provisions require application of a Statement of Principles. The Statement does not reproduce the operative provisions of the VEA or MRCA, nor does it alter the substantive grant or denial of entitlements under those Acts; instead, it sets the medical yardstick that decision-makers must apply when the statute calls for reference to a Statement of Principles.

Section 11 creates a direct cross-Statement interaction rule. If a factor in section 9 applies and that factor refers to an injury or disease covered by another Statement of Principles made under subsection 196B(3) of the VEA, then the factors in that other Statement apply according to its own terms. That mechanism ensures that where a single factual exposure or disease sits at the intersection of multiple Statements, the adjudicator uses the relevant Statement’s terms to determine its legal effect.

The instrument also makes a link to international clinical classification through the ICD‑10‑AM. Subsection 7(3) and (4) note that while cluster headache attracts ICD‑10‑AM code G44.0, the operative meaning for the Statement is the statutory definition in subsection 7(2), and that the ICD reference is to the ICD‑10‑AM Tenth Edition effective 1 July 2017. This interaction with classification systems can affect how clinical records labelled with ICD codes are interpreted against the statutory definition.

Beyond those direct references, the Statement does not expressly interact with other statutory regimes, regulatory instruments, or administrative procedures. It does not, for example, modify liability, workers compensation, or other non-VEA/MRCA regimes. Any interplay with other legal frameworks will therefore be indirect, mediated by whether those regimes reference, rely on, or require similar clinical definitions or causation standards. The Statement’s narrow temporal and causation rules, and its exclusions list, will be consequential to decision-makers within the VEA/MRCA context, and may influence how clinical evidence is marshalled in adjacent contexts, but the instrument itself limits its legal reach to the statutory claims it names.

The instrument contains its own amendment history within the text. It is identified as Statement of Principles concerning cluster headache (Balance of Probabilities) (No. 58 of 2018) and is dated 22 June 2018, with a commencement date of 23 July 2018 (s 1; s 2). Section 4 expressly repeals the earlier Statement of Principles concerning cluster headache No. 21 of 2010 (Federal Register of Legislation No. F2010L01037). No other amendments, modifications, or transitional provisions are set out in the instrument itself.

There are no schedules or subsections that record subsequent variations, and the Schedule 1 appended to the instrument is limited to definitions relevant to this Statement, including the definitions of “relevant service”, “terminal event”, “MRCA” and “VEA”. The instrument does not include any amendment power clauses or sunset provisions. The RMA’s stated basis for the instrument is its view of the sound medical‑scientific evidence available that cluster headache and death from cluster headache can be related to relevant service on a balance of probabilities (s 8), which is the medical justification attached to the instrument as made.

Because this text is self-contained and no later amending instruments appear within it, the only recorded change to earlier law within the document is the repeal of the 2010 Statement. Any subsequent amendments, replacements, or judicial developments after 22 June 2018 are not recorded in the instrument’s text and therefore are outside the scope of this document.

The instrument does not record any litigation history. It is a Statement of Principles issued by the Repatriation Medical Authority under subsection 196B(3) of the VEA and contains no references to judicial decisions, appeals, or contested administrative rulings within its text. No cases are named in the instrument, and no judicial findings are cited as part of the instrument’s reasoning.

Because the Statement is an administrative medical instrument intended to be applied to claims under the VEA and MRCA, litigation or administrative appeals about its application would arise, if at all, in the adjudication of individual claims or in judicial review proceedings under administrative law. However, the instrument itself provides no record of such proceedings. If users require the post-commencement litigation history concerning the Statement’s application, they will need to consult external case law databases, tribunal decisions, or administrative records, because no such history is embedded in the text of this instrument.

Mindful of the instruction to rely solely on the source material supplied, this section records only that the instrument does not include or cite any litigation history, and that the Statement stands as enacted and commenced on the dates given without internal commentary on disputes, appeals, or court treatment.

The instrument contains several details and limitations that can materially affect whether a claim succeeds, and which frequently produce unexpected outcomes if not carefully observed.

1. Narrow temporal windows for exposure-based factors. The factors in s 9 that involve exposures are strictly timed. Nitrate exposure (glyceryl trinitrate, isosorbide mononitrate, isosorbide dinitrate) must have occurred within the 24 hours before the clinical worsening of cluster headache (s 9(1)). Alcohol consumption must similarly be within 24 hours before the clinical worsening (s 9(2)). The 24 hour limitation is textual and absolute; the Statement will not treat exposures outside that period as satisfying those factors.

2. Limit on causation role of factors. Section 10(2) is a critical limiter. The s 9 factors are available only in relation to material contribution to, or aggravation of, cluster headache where the person’s cluster headache was suffered or contracted before or during relevant service, but did not arise out of the relevant service. That means the factors cannot be used to establish primary causation where the cluster headache first arose out of service. Practically, for a claimant whose cluster headache first began as a consequence of service, the s 9 factors will not be the legal route to connection under this Statement.

3. Definition and exclusions are narrow. The statutory definition in s 7(2) both prescribes specific clinical features and excludes a list of alternative headache or neurological diagnoses. A diagnosis recorded in clinical notes that reflects one of the excluded entities will not fall within the meaning of cluster headache for the purposes of this Statement, even if the ICD code is G44.0. The instrument makes that point explicit: the operative meaning is the statutory definition, not the ICD code alone (s 7(3)). Claimants whose records show mixed or uncertain headache diagnoses may therefore face evidential complications.

4. “Inability to obtain appropriate clinical management” is open-textured. Section 9(3) makes inability to obtain appropriate clinical management for cluster headache a qualifying factor. The phrase is not further defined in the instrument. That lack of definition creates implementation uncertainty about what degree of unavailability, or what specific clinical resources, must have been lacking, and about the temporal relation required for that inability to be “related to the relevant service” (s 10(1)). It is therefore a fact-sensitive and potentially litigable issue in adjudication.

5. Death inclusion mechanics. The Statement treats death from cluster headache as including death from a terminal event or condition that was contributed to by the person’s cluster headache (s 7(5)). The Schedule defines “terminal event” by example, listing pneumonia, respiratory failure, cardiac arrest, circulatory failure and cessation of brain function. Parties should not assume that any death of a person with cluster headache is captured; the death must be from a terminal event to which cluster headache contributed.

6. Cross-reference to other Statements. Where a s 9 factor refers to an injury or disease that is the subject of another Statement of Principles, the other Statement’s factors apply according to its terms (s 11). This may complicate cases involving comorbid conditions where multiple Statements intersect and could require applying multiple Statements’ criteria in tandem.

7. Repeal timing. Because the 2010 Statement is expressly repealed (s 4) and the 2018 Statement commenced on 23 July 2018 (s 2), claims decided after commencement will be assessed under the 2018 Statement. Evidence or submissions prepared under the older Statement may therefore require revision to align with the 2018 definitions and factor lists.

8. No procedural detail on evidence standards. The instrument is silent on admissible evidence types, necessary documentary proof, or the burden of proof mechanics beyond the balance of probabilities articulation in s 8 and the need for factors to be related to relevant service in s 10(1). That silence places practical weight on claimants and clinicians to map clinical and service records to the Statement’s text.

Being attentive to these textual limits is necessary for accurate assessment and for assembling evidence that matches the instrument’s precise formulations.

This Statement is applied in the context of statutory claims under the VEA and MRCA; compliance means presenting medical and service evidence that aligns with the textual requirements of the Statement so that a decision-maker can properly find that at least one of the section 9 factors exists and is related to relevant service (ss 5, 9, 10).

1. Establish the diagnosis according to the statutory definition. Ensure clinical records and expert reports clearly map the claimant’s condition to the definition in subsection 7(2): multiple unilateral attacks in orbital/supraorbital/temporal regions, typical durations 15 to 180 minutes, concurrent restlessness or the specified ipsilateral autonomic signs, and exclusion of the listed alternate diagnoses. The Statement emphasises that the statutory definition is the operative meaning, not merely the ICD code (s 7(2)-(4)).

2. Align evidence to the precise factors. For exposure-based factors, documentation should specify timing in relation to clinical worsening. The instrument requires nitrates to have been taken within 24 hours before clinical worsening, naming glyceryl trinitrate, isosorbide mononitrate and isosorbide dinitrate (s 9(1)), and requires alcohol consumption within 24 hours before clinical worsening (s 9(2)). Medical notes, deployment or medication logs, duty rosters, pharmacy records, or contemporaneous clinical assessments that show those temporal proximities will be the materials that directly correspond to the factors in the Statement.

3. For the access-to-care factor, state the nature and timing of the inability to obtain appropriate clinical management. Section 9(3) invokes inability to obtain appropriate clinical management as a factor. The Statement does not define “appropriate clinical management”, so compliance-focused evidence should describe what treatments were indicated, what services or specialists were unavailable, and how that unavailability related to the period of relevant service. Where possible, contemporaneous requests for assistance, referral denials, clinic logs, and internal service health records that show attempts to obtain care are the kinds of items that will correspond to the textual criterion that a claimant must demonstrate.

4. Demonstrate relationship to relevant service. Section 10(1) requires that any s 9 factor be related to the relevant service rendered by the person. The Schedule defines relevant service categories (Schedule 1). Claimants should therefore present service records, postings, locations, periods of service, and contemporaneous notes that tie exposures or management deficits to the relevant service period. Section 10(2) further limits the Statement’s application to cases where the cluster headache was suffered or contracted before or during relevant service, but did not arise out of that service, for material contribution or aggravation. Claims that assert new onset arising out of service will not be met by the s 9 factors under this Statement.

5. If death is claimed, show contribution to a terminal event. For death claims, the Statement requires that the cluster headache contributed to a terminal event or condition (s 7(5)). The Schedule defines terminal event with examples such as pneumonia and respiratory failure. Death certificates, hospital records, and clinical opinions that link cluster headache to the terminal event will be the direct evidence categories that address the Statement’s terms.

6. Where s 9 factors intersect other Statements, provide supporting references. Section 11 requires application of other Statements where a s 9 factor refers to an injury or disease covered by such a Statement. Practically, ensure that any linked conditions are documented and that relevant Statements of Principles are identified in submissions, so adjudicators can apply the cross‑Statement rules.

7. Be time-aware about which Statement applies. The 2010 Statement is repealed (s 4). For claims with events straddling the repeal and commencement, prepare submissions that justify use of the 2018 Statement in light of the claim timing and the statutory rules that govern which Statement applies.

8. Prepare for evidentiary questions about “clinical worsening” and causation. The s 9 factors reference “clinical worsening of cluster headache”. Evidence should therefore articulate when a clinical worsening occurred and the proximate exposures or management shortfalls related to that worsening. Expert opinion that maps pathophysiology to the 24 hour windows and to service exposures, while not required by the Statement, will be the way to translate clinical facts into the statutory‑language framework that decision-makers are told to apply.

9. Keep administrative remedies in view. The Statement itself does not set appeal or review provisions. If a claim is decided under the VEA or MRCA contrary to the claimant’s view of the Statement’s application, standard statutory or administrative review and appeal mechanisms under those Acts are the routes to challenge the decision. The Statement does not alter those remedial paths.

In sum, compliance requires producing evidence that mirrors the Statement’s precise language: an authorised diagnosis per s 7(2), a s 9 factor with the required timing or service-relatedness, and demonstration that the factor is related to the person’s relevant service as defined in the Schedule. The Statement’s silence on particular documentary formats means that claimants and their advisers should prioritise contemporaneous clinical and service records that speak directly to the statutory elements.
