Statement of Principles concerning chronic exertional compartment syndrome of the lower leg (Balance of Probabilities) (No. 99 of 2023)

The SoP rests on a small set of core concepts and definitions that determine how CECS claims are to be adjudicated under the VEA and MRCA framework.

• Definition of the condition. CECS of the lower leg is defined by clinical features: raised muscle compartment pressure manifesting with exercise‑induced pain and tightness originating in the calf or shin, typically resolving or reducing with rest (s7(2)(a)). That definition is the operative medical characterisation for the instrument.
• Exclusions. The SoP explicitly excludes a list of conditions from the CECS definition, which affects differential diagnosis and claim scope: fracture (including stress fracture), lower leg tendinopathies or bursitis, nerve entrapments (sural or superficial peroneal , rendered as "superfoneal" in the text), popliteal artery entrapment syndrome, acute sprain and acute strain, and vascular insufficiency (s7(2)(b)(i)-(vi)). These exclusions identify conditions that will not, on their own, be treated as CECS for the purposes of this SoP.
• Death from CECS. The SoP includes death from CECS where the terminal event or condition was contributed to by the CECS (s7(3)). The Schedule defines "terminal event" in a non‑exhaustive list of proximate or ultimate causes such as pneumonia, respiratory failure, cardiac arrest, circulatory failure and cessation of brain function (Schedule 1).
• Evidentiary factors. Section 9 contains four alternative factors; the presence of at least one is necessary before a finding of service connection on the balance of probabilities. These are exposure metrics tied to physical activity: (1) running/jogging at least 60 kilometres per week averaged over the four weeks before clinical onset or worsening (s9(1)); (2) undertaking weight‑bearing exercise involving repeated lower‑leg activity at a minimum intensity of 5 METs for at least 6 hours per week for at least the four weeks before onset/worsening (s9(2)); (3) a rapid increase in weight‑bearing activity , doubling activity by at least 100 percent to at least 5 METs for at least 4 hours per day within the one week before onset/worsening (s9(3)); and (4) inability to obtain appropriate clinical management before clinical worsening (s9(4)). The instrument gives examples of 5 MET activities (marching, sustained brisk walking, playing football and dancing) in a note to s9(2).
• Quantitation of exertion. MET is defined numerically in the Schedule: 1 MET = 3.5 ml O2/kg/min, or 1.0 kcal/kg/hour, or resting metabolic rate (Schedule 1).
• Relation to service. Section 10 requires that any factor in s9 must be related to the person's relevant service. The Schedule defines relevant service for these purposes as eligible war service (other than operational service) under the VEA, defence service (other than hazardous service and British nuclear test defence service) under the VEA, or peacetime service under the MRCA (Schedule 1 definition of relevant service). Section 10(2) restricts the application of "clinical worsening" aspects of s9 to situations where the CECS was suffered or contracted before or during, but did not arise out of, the person's relevant service.

Those concepts together make the SoP a technical schema: a clinical definition, a list of excluded diagnoses, objective physical‑activity thresholds, an inclusion of death where CECS contributed, and rules tying the required factors to particular categories of service defined in the Schedule.

The instrument applies to claimants under the VEA and MRCA who seek a finding that chronic exertional compartment syndrome of the lower leg, or death from it, is connected with relevant service. Section 5 expressly states the application to claims to which section 120B of the VEA or section 339 of the MRCA applies. The Schedule defines relevant service categories: eligible war service (other than operational service), defence service (other than hazardous service and British nuclear test defence service), and peacetime service (Schedule 1).

Directly affected parties

• Veterans and serving or former members of the Forces making claims under the specified sections. A person who alleges CECS or death from CECS as related to their service must meet the SoP’s factors and the requirement that the factor be related to the person's relevant service (s9, s10).
• Medical practitioners and diagnosticians who prepare clinical evidence for claims. The SoP’s clinical definition (s7(2)(a)), the exclusions (s7(2)(b)), and the MET definition in the Schedule guide the nature of medical evidence that decisionmakers will expect.
• Decisionmakers in agencies administering VEA/MRCA entitlements. These officials must apply the SoP as part of the statutory decision process on entitlement claims under the cited sections (s5, s8).

Indirectly affected parties and stakeholder consequences

• Treatment providers and rehabilitation providers. The fourth factor in s9 references "inability to obtain appropriate clinical management", which makes access to clinical care part of the evidentiary landscape.
• Insurers and compensation administrators who participate in or advise on claims. While the instrument does not itself set benefits, it supplies the medical‑evidentiary threshold used to determine whether CECS is service‑connected for statutory entitlement under VEA/MRCA pathways.

Other notes on affected persons

• The SoP’s exclusions mean that persons whose symptoms are attributable to excluded conditions listed in s7(2)(b) are not covered by this SoP for CECS. Those claimants will need to rely on other medical classifications or other SoPs where applicable.
• Where a factor in s9 refers to an injury or disease covered by another SoP, the other SoP applies in accordance with its terms as in force from time to time (s11). That creates an operational link for claimants whose evidence crosses diagnostic boundaries.

The instrument itself does not create a benefit entitlement but provides the medical link the decisionmaker will use to determine whether CECS is connected with relevant service for the purpose of statutory entitlements under the VEA and MRCA.

This Statement of Principles does not impose duties on individuals in the coercive or penal sense; rather it prescribes the medical and evidentiary criteria that must be met before a finding of service connection for CECS or death from CECS can be made.

Duties implicit in application of the SoP

• Decisionmakers must have regard to the SoP when assessing whether CECS or death from CECS is connected with relevant service, because the instrument is made under subsection 196B(3) of the VEA and by its terms applies to claims under s120B VEA or s339 MRCA (s3, s5, s8).
• A finding that CECS is connected with service requires that at least one of the factors in s9 exists and that the existence of the factor is related to the person's relevant service (s9, s10(1)).

Rights and entitlements implicated

• Claimants have the right to present evidence that one or more of the s9 factors existed in the relevant pre‑onset or pre‑worsening time frames, and to invoke s11 where overlap with another SoP is relevant. The SoP sets the medical criteria that will be applied to the evidence.
• The Authority has articulated its view that, on the available medical‑scientific evidence, it is more probable than not that CECS and death from CECS can be related to relevant service (s8). That statement is the Authority’s evidentiary conclusion and is the basis for the SoP’s adoption; it does not itself create a discrete entitlement but functions as a foundation for claim assessment.

Operational constraints and limits

• Clinical worsening clauses in s9 apply only to cases where CECS was suffered or contracted before or during, but did not arise out of, the person's relevant service. In other words, s10(2) limits the reach of aggravation/worsening arguments to cases where service materially contributed to an existing condition rather than where the condition first arose during service and is said to have arisen out of service.
• Where a factor in s9 refers to an injury or disease covered by another SoP, the SoP for that injury/disease applies as in force from time to time, so the claimant’s rights will depend on the terms of that other SoP as well as the present instrument (s11).

What the SoP does not do

• The instrument does not specify decision timelines, appeal rights, or payment mechanics; those operational rights and duties are governed by the VEA and MRCA and their administrative procedures, not by this SoP. The SoP is confined to medical‑evidentiary guidance.

The Statement of Principles contains no provisions for penalties, sanctions, or enforcement actions. It is a non‑punitive, evidentiary instrument issued by the Repatriation Medical Authority under subsection 196B(3) of the VEA (s3). Its function is to provide medical‑scientific guidance for adjudicating claims under specified provisions of the VEA and MRCA (s5, s8).

Consequences of non‑compliance are therefore administrative rather than criminal or civil penalties imposed by the SoP itself. The SoP establishes criteria that decisionmakers will apply when deciding whether CECS, or death from CECS, is connected with relevant service. If the criteria in s9 and the service relation requirement in s10 are not satisfied, the practical consequence for a claimant is likely denial of a finding of service connection for CECS in the relevant entitlement process. The instrument does not itself prescribe the outcome following such a denial; those consequences flow from the governing statutes and administrative processes under the VEA and MRCA.

Enforcement actors and mechanisms

• The instrument does not create a new enforcement agency. The Repatriation Medical Authority issues the SoP (signature and seal noted on the instrument), and administrative decisions made under the VEA or MRCA will be implemented by the relevant statutory decisionmakers and departments. The SoP is an evidentiary tool for those processes.
• There is no enforcement schedule or penalty table in the instrument. No monetary penalties, criminal offences, licensing consequences, or administrative fines are specified.

Practical enforcement risks and implementation points

• Because the SoP sets objective thresholds and defined terms (for example, MET definition in Schedule 1 and activity thresholds in s9), enforcement in practice is the exercise of administrative discretion in applying these criteria to evidence. The instrument does not prescribe what types of documentary or testimonial evidence will satisfy thresholds such as "running or jogging an average of at least 60 kilometres per week" (s9(1)), leaving decisionmakers to evaluate the sufficiency of supporting evidence.
• The SoP’s exclusion list (s7(2)(b)) limits the instrument’s reach; decisionmakers will need to apply clinical judgement based on medical records to differentiate CECS from excluded conditions. The SoP provides the medical standard but not the procedural enforcement steps.

In short, the instrument sets evidentiary criteria to be applied administratively; it does not generate statutory penalties or independent enforcement mechanisms.

The instrument is made under the VEA and is explicitly designed to operate within the statutory frameworks of the Veterans' Entitlements Act 1986 and the Military Rehabilitation and Compensation Act 2004.

Primary statutory interaction

• Enabling provision. The instrument is made under subsection 196B(3) of the VEA (s3). Its legal effect flows from that statutory power to determine Statements of Principles for linking particular injuries, diseases or deaths to service.
• Application to claims. The instrument applies to claims to which section 120B of the VEA or section 339 of the MRCA applies (s5). Those sections (not reproduced here) are the statutory provisions that govern the relevant claims processes; the SoP is an evidentiary input into those statutory decision processes.

Interaction with other Statements of Principles

• Section 11 explicitly manages interaction with other SoPs: if a factor in s9 applies and refers to an injury or disease for which there is another SoP determined under subsection 196B(3) of the VEA, the factors in that other SoP apply in accordance with its terms as in force from time to time. That creates a hierarchical or coordinate relationship between this SoP and others where factor‑references overlap.
• The instrument also repeals the earlier SoP concerning shin splints No. 10 of 2015 (s4). That repeal changes the SoP landscape and requires decisionmakers and practitioners to apply the new instrument to claims that might previously have been addressed under the repealed instrument.

Limits and boundaries

• The Schedule defines relevant service as certain categories under the VEA and MRCA (Schedule 1). That limits the SoP’s application geographically and temporally to the categories listed; operational service and some hazardous services are explicitly excluded from the relevant‑service definition in the Schedule’s wording for particular categories (see Schedule 1 relevant service categories and their parenthetical exclusions).
• The SoP is narrowly framed to CECS of the lower leg. The exclusion list in s7(2)(b) makes clear that other lower‑leg diagnoses will not be treated as CECS for the purpose of this instrument. Where claimants assert alternative diagnoses, other SoPs or different statutory provisions will govern.

What the SoP does not displace

• It does not amend the VEA or MRCA or change their substantive entitlement rules. The instrument provides medical‑scientific principles to be used in applying those statutes.
• It does not itself create administrative procedures, appeal routes, or evidentiary rules in whole; those rules are set out in the VEA and MRCA and in the administrative practices of responsible agencies.

In sum, the SoP is an instrument that integrates with the statutory decision framework under the VEA and MRCA by supplying medical criteria and by coordinating with other SoPs where overlap exists. It does not itself alter statutory rights or procedural law beyond its evidentiary role.

The instrument records its own making and immediate legislative ancestry but contains no extensive amendment record. The items available in the text establish the following history:

• Instrument designation. The document is the Statement of Principles concerning chronic exertional compartment syndrome of the lower leg (Balance of Probabilities) No. 99 of 2023 (s1).
• Date made. The instrument is dated 25 October 2023 and bears the Common Seal of the Repatriation Medical Authority, signed at the direction of Professor Terence Campbell AM as Chairperson (instrument header and signature block).
• Commencement. It commences on 28 November 2023 (s2).
• Repeal of prior SoP. It expressly repeals the Statement of Principles concerning shin splints No. 10 of 2015 (Federal Register of Legislation No. F2014L01812) made under subsection 196B(3) of the VEA (s4). That is the only repeal recorded in the instrument.
• Authority for instrument. The instrument was made under subsection 196B(3) of the VEA (s3).

The instrument does not record any prior amendments to itself, nor does it list consequential amendments to other instruments or statutes. It does not contain a schedule of historical amendments or an amendment log; the repeal of the 2015 shin splints SoP is the only explicit historical adjustment documented in the text. There is no retroactive provision or savings clause visible in the instrument text, nor is there a transitional rule in respect of claims in progress; the instrument simply states its commencement date (s2) and repeal (s4).

Practically, users should note that the repeal of the shin splints SoP replaces the earlier medical framework for claims previously considered under that instrument. The instrument does not describe whether or how claims already decided under the repealed SoP are to be revisited; such procedures, if any, would be governed by the VEA/MRCA and administrative practice outside the text of this SoP.

The instrument contains no litigation history, case citations, or references to judicial decisions. It does not identify any legal challenges, appeals, or judicial interpretations of its terms in the text provided.

What can be inferred from the document about litigation

• The instrument is an administrative medical‑scientific determination issued by the Repatriation Medical Authority under the statutory power in subsection 196B(3) of the VEA (s3, s8). The instrument itself does not provide a record of litigation challenging its content.
• Because the instrument will be applied in entitlement decisions under the VEA and MRCA (s5), any litigation arising from decisions that rely on this SoP would be external to the instrument and handled through the statutory appeal and review processes applicable to VEA/MRCA determinations. Those processes are not set out in this SoP.

What the absence of litigation history means for practitioners

• There are no cases named in this instrument and no precedent supplied by the Authority within the instrument. Practitioners should therefore treat the SoP as the Authority’s current medical‑scientific position, but should not expect the instrument to contain legal interpretation or examples of its application in contested cases.
• Absent case law recorded in the SoP, points of interpretation , such as the practical measurement of an activity at 5 METs, the form of evidence sufficient to show "running or jogging an average of at least 60 kilometres per week", or the meaning of "inability to obtain appropriate clinical management" , will likely arise in claims decision processes and, potentially, in any disputes that progress to formal review or appeal. The instrument does not resolve those evidentiary or procedural details.

In short, the instrument does not document any litigation history; it provides a medical standard to be applied within statutory claim processes. Any litigation or judicial interpretation that develops will be external to this text and is not summarised here.

This SoP contains several features and drafting choices that create potential practical traps or important points for practitioners, claimants and decisionmakers. These are matters that are visible from the instrument’s text and may affect evidence, claim strategy and administration.

1. Strict, numeric exposure thresholds

• The SoP sets precise activity thresholds. Example: s9(1) demands running or jogging an average of at least 60 kilometres per week for the four weeks before clinical onset or worsening. Meeting that numeric threshold requires quantifiable evidence of distance and timing. The instrument does not specify types of acceptable proof, leaving a potential evidentiary gap (s9(1)).
• The MET‑based thresholds in s9(2) and s9(3) rely on a minimum intensity of 5 METs. MET is defined numerically in the Schedule (Schedule 1). Translating real‑world activities into METs can be contested; while s9 includes examples (marching, sustained brisk walking, playing football, dancing), the SoP does not provide measurement methodology for contested cases.

2. Timing windows are tight

• The required windows are specific. For example, s9(1) looks at the four weeks before clinical onset or worsening. s9(3) requires a doubling of activity and attainment of at least 5 METs for at least 4 hours per day within the one week before onset or worsening. Small errors in documenting dates can be decisive.

3. Clinical worsening limitation

• Section 10(2) limits the application of clinical worsening aspects to cases where the CECS was suffered or contracted before or during, but did not arise out of, relevant service. That is a restrictive caveat; it means that in cases where CECS arose out of service, s9’s "worsening" pathways do not apply as aggravation mechanisms. Practitioners must pay careful attention to the chronology and the statutory categories that trigger this rule (s10(2)).

4. Exclusions are explicit

• The instrument excludes several diagnoses from being treated as CECS under the SoP (s7(2)(b)(i)-(vi)). If a claimant’s symptoms are attributable to any of the listed exclusions , fracture, tendinopathies, certain nerve entrapments, popliteal artery entrapment, acute sprain/strain, vascular insufficiency , the SoP does not cover them. This affects the route to entitlement and may require reliance on other SoPs or medical classification.

5. "Inability to obtain appropriate clinical management" is undefined

• The fourth alternative factor in s9(4) refers to inability to obtain appropriate clinical management before clinical worsening. The instrument provides no definition of "appropriate" or standards for establishing inability to obtain care. This is a potential evidentiary and interpretative gap that may create contested decisionmaking in practice (s9(4)).

6. Interaction with other SoPs can complicate cases

• Section 11 makes cross‑SoP interplay mandatory where a factor refers to an injury or disease covered by another SoP. Practitioners must therefore check other SoPs and be alert to composite evidentiary regimes. The instrument does not catalogue which other SoPs might be engaged, so cross‑checking is required (s11).

7. Repeal of prior SoP

• The repeal of the shin splints SoP (s4) may impact ongoing claims that were previously framed under that instrument. The new diagnostic framing and thresholds may change the evidentiary approach.

8. Death claims require causation contribution

• For death claims, s7(3) includes death from CECS only where the terminal event or condition was contributed to by the CECS. The Schedule’s definition of terminal event is broad but the requirement of contribution introduces a causation standard that may be difficult to establish clinically and temporally.

9. No procedural or evidentiary guidance in the instrument

• The SoP specifies the medical criteria but does not provide a list of acceptable documentary evidence or standards of proof beyond the balance of probabilities. Decisionmakers will need to exercise judgement in assessing evidence such as activity logs, service records, or medical notes.

10. Potential for measurement disputes

• Translating real‑world activities into quantitative terms like kilometres per week or METs, especially for historical periods, invites disputes over retrospective estimation and interpretation of notes, training programmes, and witness evidence.

Practitioners and claimants should therefore plan for documentary proof tailored to the specific s9 pathway relied upon, ensure clear chronology of onset/worsening, and anticipate the need to establish how the relevant activity was related to the statutory categories of relevant service (Schedule 1).

Compliance here means assembling and presenting evidence that satisfies the SoP’s medical‑scientific criteria so a decisionmaker can find, on the balance of probabilities, that CECS or death from CECS is connected with relevant service under the VEA/MRCA.

Step 1 , Establish the clinical diagnosis consistent with s7(2)

• Obtain contemporaneous medical records describing raised compartment pressures or equivalent clinical findings consistent with elevated muscle compartment pressure, exercise‑induced pain and tightness localised to calf or shin, and the characteristic relief or reduction of symptoms with rest (s7(2)(a)).
• Where possible, include objective diagnostic tests or clinician notes that document compartment pressure measurements, exercise provocation tests, or other relevant investigations. The SoP’s clinical definition is the primary medical gateway.

Step 2 , Exclude the SoP’s listed exclusions

• Ensure medical evidence addresses and rules out the exclusions listed in s7(2)(b), including fracture, tendinopathy, bursitis, nerve entrapments, popliteal artery entrapment, acute sprain/strain, and vascular insufficiency. Explicitly document why those excluded diagnoses do not account for the claimant’s presentation.

Step 3 , Demonstrate at least one s9 factor with chronology

• Choose the s9 pathway best supported by evidence and document it precisely:
  • s9(1) running/jogging threshold: provide contemporaneous training logs, GPS data, unit training schedules, service fitness records or other corroborative evidence showing an average of at least 60 km per week for the four weeks prior to onset or worsening; corroborate onset/worsening dates from clinical records.
  • s9(2) MET/weekly hours threshold: provide evidence of the type, intensity and duration of weight‑bearing exercise. Where possible, translate activities into METs using the Schedule definition and provide contemporaneous records showing at least 6 hours per week at 5 METs or higher for the four weeks before onset/worsening. Use the s9(2) examples where appropriate to support plausibility (marching, brisk walking, football, dancing).
  • s9(3) rapid increase pathway: document baseline activity and then provide clear records showing at least a 100 percent increase, reaching a minimum of 5 METs for at least 4 hours per day within the week before onset/worsening.
  • s9(4) access to care pathway: assemble evidence demonstrating attempts to obtain clinical management and explain the nature of the inability to obtain appropriate care, for example correspondence, appointment records, referrals declined, delays, or service constraints.
• Always tie activity evidence to the clinical onset or clinical worsening date recorded in medical notes.

Step 4 , Link the factor to relevant service (s10 and Schedule 1)

• Demonstrate that the activity or the inability to obtain care was related to the person’s relevant service as defined in the Schedule: eligible war service (other than operational service), defence service (other than hazardous service and British nuclear test defence service) under the VEA, or peacetime service under the MRCA (Schedule 1). This requires establishing that the activity occurred during a period covered by those categories or that the inability to obtain management was connected to service circumstances.
• For clinical worsening cases, confirm the chronology matches s10(2): CECS must have been suffered or contracted before or during (but not arising out of) the person’s relevant service for the worsening provisions to apply.

Step 5 , Consider other SoPs and overlapping conditions (s11)

• If any s9 factor refers to an injury or disease covered by another SoP, identify and comply with that other SoP’s factors. The instrument requires that the factors in the other SoP apply as in force from time to time (s11).
• Where medical evidence touches multiple lower‑leg pathologies, prepare a clear differential diagnosis explaining why CECS is the applicable condition for this SoP and how excluded conditions have been excluded.

Step 6 , Address death claims carefully (if applicable)

• If the claim relates to death, document how CECS contributed to the terminal event or condition in accordance with s7(3) and the Schedule’s terminal event definition. Provide clinical evidence linking the CECS to the proximate or ultimate cause of death, with contemporaneous medical opinions addressing contribution.

Step 7 , Anticipate evidentiary gaps and prepare expert opinion

• Where documentary evidence of activity intensity or volume is sparse, obtain contemporaneous or retrospective expert opinion that ties the claimant’s described activities to 5 MET intensity or to the 60 km/week threshold. Be explicit about methodology and limits of retrospective estimation.
• Where "inability to obtain appropriate clinical management" is relied upon, secure records and contemporaneous notes showing care‑seeking behaviour, or obtain a clinician’s statement explaining that appropriate management was not accessible and that lack of management materially contributed to worsening.

Step 8 , Present a clear chronology and mapping to the SoP

• Produce a timeline aligning service periods, the s9 factor period(s), dates of clinical onset and worsening, records of medical attendance, and any treatment or access issues. Make it easy for decisionmakers to map documentary evidence to the specific paragraphs of s9 and to the relevant service definitions in Schedule 1.

Step 9 , Check the repeal implication for prior claims

• If a claim was previously considered under the repealed shin splints SoP (No. 10 of 2015), review how evidence aligns with the new SoP’s criteria (s4). If necessary, update evidence to meet the current instrument’s thresholds and definitions.

Step 10 , Plan for contested assessments

• The SoP does not set procedural rules for disputes. Be prepared to produce expert evidence and clear documentary proof to meet the balance of probabilities. Where thresholds are close or evidence ambiguous, obtain specialist clinical statements addressing why the SoP’s criteria are satisfied.

Following these steps aligns claim preparation with the specific medical and exposure criteria the Repatriation Medical Authority has prescribed, and with the requirement that any factor relied upon be related to relevant service as defined in the Schedule.
