Statement of Principles concerning cervical spondylosis (Balance of Probabilities) (No. 12 of 2023)

The instrument organises around a small set of legal‑medical concepts that determine its application. These concepts are defined in the Schedule 1 Dictionary; repeated definitions are incorporated into operative clauses.

• Cervical spondylosis. Defined as a degenerative joint disorder affecting cervical vertebrae or intervertebral discs, including the cervicothoracic junction (s 7(3)). The definition expressly excludes diffuse idiopathic skeletal hyperostosis and isolated disc bulging without other degenerative signs (s 7(4)). The SoP maps the concept to specific ICD‑10‑AM codes and requires both clinical manifestations and imaging evidence of degenerative change for diagnosis (s 7(2), (6), (8)).

• Clinical onset. A medical dating concept defined as the point backwards in time from the first date of imaging confirming cervical spondylosis to the date at which symptoms were persistently present, assessed by a registered medical practitioner (Schedule 1, clinical onset). The definition establishes a backward look from imaging to symptomatic presence, which affects how pre‑service or post‑service exposures are temporally related to disease.

• Imaging evidence of degenerative change. Defined as medical imaging (X‑ray, MRI, etc) showing prior degenerative change, usually obtained after clinical onset (Schedule 1). The instrument therefore contemplates that imaging often occurs after symptoms begin, and uses clinical onset as a dating anchor.

• Relevant service. The instrument applies only where the causal connection between the listed factors and cervical spondylosis is related to relevant service defined to include eligible war service (other than operational service), defence service (other than hazardous and British nuclear test defence service) under the VEA, or peacetime service under the MRCA (Schedule 1, relevant service; s 5 states the instrument applies to claims subject to s 120B VEA or s 339 MRCA).

• Factors vs material contribution/aggravation. Section 9 divides causative considerations into two categories: factors that must exist to establish that spondylosis is connected with service (s 9(1)-(15) cover conditions before clinical onset; s 9(16)-(31) relate to material contribution to, or aggravation of, cervical spondylosis where spondylosis pre‑existed service or was suffered/during service but not arisen out of service). Section 10(2) limits the application of subsections 9(16)-9(31) to cases of material contribution or aggravation, and only where the person’s cervical spondylosis was present before or during (but did not arise out of) the relevant service. That structure separates presumptive causes of initial disease from presumptive causes of aggravation.

• Temporal thresholds and cumulative exposures. Several factors require cumulative exposure thresholds and defined look‑back windows: carrying ≥25 kg on the head upright to a cumulative total ≥5,000 hours in any 10‑year period, with onset occurring within 25 years following that period (s 9(10), (25)); flying in high performance aircraft for ≥1,000 hours within 25 years before clinical onset (s 9(11), (26)); piloting a helicopter for ≥1,000 hours within 25 years before clinical onset (s 9(12), (27)); obesity defined as BMI ≥30 for at least 10 years within 25 years before clinical onset (s 9(13), (28), Schedule 1).

• Trauma definition and injury latency. “Trauma to the cervical spine” has a specific three‑part definition (Schedule 1): discrete event applying significant force, immediate symptom onset within 24 hours and persistence for at least 7 days (with an exception where certain medical interventions occur). Many trauma‑related factors require the trauma at least six months before onset/worsening and within 20 years before onset/worsening (s 9(7), (22)).

• Death from cervical spondylosis. The instrument treats death as included where cervical spondylosis contributed to a terminal event or condition, and it defines terminal event (Schedule 1, terminal event includes pneumonia, respiratory failure, cardiac arrest, circulatory failure, cessation of brain function) (s 7(9), Schedule 1).

These concepts frame how medical evidence , clinical records, imaging, operative notes, flight logs, occupational records, BMI history , must be assembled and temporally anchored to the person’s relevant service. The SoP is both a catalog of presumptive causal pathways and a set of evidentiary thresholds that operationalise causation "on the balance of probabilities" (title; s 8).

Primary legal target. The instrument affects claimants making claims under the VEA (s 120B) or MRCA (s 339) for cervical spondylosis or death from cervical spondylosis. By its terms it applies only where a claim to which those provisions applies is lodged (s 5). The medical findings in the SoP are used by decision makers within those schemes to determine whether a condition is connected with relevant service.

Veterans and members. Individuals who served in the Forces and later develop, or die with, cervical spondylosis may be affected. The definition of relevant service in Schedule 1 narrows the affected population: eligible war service (other than operational service), defence service (other than hazardous service and British nuclear test defence service) under the VEA, and peacetime service under the MRCA (Schedule 1, relevant service). The SoP therefore does not apply to operational service exposures or to claims falling outside those categories.

Families and dependants. The provision covering death from cervical spondylosis potentially affects dependants or estates pursuing claims for death where cervical spondylosis contributed to a terminal event (s 7(9)). The Schedule’s list of terminal events indicates the kinds of proximate causes for which a contribution by cervical spondylosis is recognised.

Decision‑makers and clinicians. Decision‑makers in the Department of Veterans' Affairs (DVA) and adjudicators under the VEA/MRCA will use the SoP as a medico‑legal guide. Registered medical practitioners assessing clinical onset, and producing expert evidence, are central , clinical onset is to be assessed by a registered medical practitioner (Schedule 1, clinical onset). Flight surgeons, occupational physicians, surgeons and radiologists are likely to be asked to provide record evidence mapped to the SoP’s thresholds (for example imaging confirming degenerative change, surgical records for spinal fusion, fracture records).

Employers and record‑holders. Employers, defence units and aviation authorities that retain service and flight records are indirectly affected; the SoP requires documentary proof such as flight hours, helicopter pilot logbooks, unit records for head‑load carriage or trauma reports. Private clinicians and hospitals will be asked to provide imaging and treatment records that establish the required timing and nature of events.

Insurers and rehabilitation providers. While the instrument is internally focused on veteran entitlements, insurers or rehabilitation providers who coordinate care under MRCA processes will engage with its thresholds when preparing treatment plans or assessments of causation for service‑related injury management.

Administrative costs and beneficiaries. The SoP changes the evidentiary landscape. For claimants, assembling records to meet cumulative exposure thresholds (for example 5,000 hours of head carriage or 1,000 hours of flying) may be difficult decades after service. For the DVA and adjudicators, the SoP reduces disputes about medical causation where listed factors are clearly present, but it increases administrative review where factors are borderline or documentation is lacking. The instrument’s mappings to ICD‑10‑AM codes (s 7(6) and Schedule 1 reference to edition) also affect statistical classification and record coding across claim adjudication systems.

Who it does not immediately alter. The SoP does not itself change eligibility criteria in the VEA or MRCA nor does it directly alter rehabilitation, pension rates or compensation sums; it is a medical descriptive instrument to be applied within those statutory frameworks (s 3, s 5). It does not impose duties on private parties outside the claims context except insofar as they are asked to provide clinical records or operational logs.

Rights established by, and dependent on, the instrument. The SoP creates a prescriptive evidentiary framework that claimants can rely on when asserting that cervical spondylosis or death from it is connected with their relevant service. By specifying factors that the Repatriation Medical Authority regards as sufficient for causation on the balance of probabilities (s 9), the instrument provides claimants and decision makers with a rule for determining medical connection under the VEA/MRCA process (s 5, s 8).

Duty to relate factors to relevant service. Section 10(1) expressly states that any factor in s 9 must be related to the relevant service rendered by the person. That imposes a normative duty on claimants and decision makers to establish not only that a listed factor existed, but that it was related to the person’s service. The instrument does not specify the form of proof for that relationship; however the duty is explicit: factors must be related to relevant service (s 10(1)). For the subsections addressing material contribution or aggravation (9(16)-9(31)), s 10(2) restricts application to cases where spondylosis pre‑existed or was suffered/during service but did not arise out of service, and only where the factor materially contributed to or aggravated the condition.

Standard of proof. The instrument operates on the balance of probabilities. The title and s 8 state the Authority’s view that “it is more probable than not” that such connections can be made on available medical‑scientific evidence. The SoP itself is therefore a device for applying the civil standard of proof to medical causation within the statutory claims regime.

Obligations of medical assessors. The definition of clinical onset requires assessment by a registered medical practitioner (Schedule 1). This assigns an evidentiary role to clinicians, who must retrospectively date symptom onset by reference to the first imaging date and persistent symptomology. Clinicians are therefore tasked with producing dated clinical opinions that align with the SoP’s temporal constructs.

Interplay with other Statements of Principles. Section 11 creates a duty to apply other SoPs where a factor refers to a disease or injury already subject to a separate SoP. If a factor in s 9 references another injury or disease for which an SoP exists, the provisions of that SoP apply “in accordance with the terms of that Statement of Principles as in force from time to time” (s 11). That places a procedural duty on decision makers to identify cross‑references and apply the relevant SoP(s).

No criminal penalties or direct enforcement powers in the instrument. The SoP does not prescribe fines, offences or criminal sanctions. Burden and proof. The SoP does not itself state which party bears the evidentiary burden in claim assessments; it sets out what must exist before a medical connection can be said to have occurred (s 9), and that those factors must relate to relevant service (s 10). In practice, claimants will need to marshal clinical, imaging and service records to establish the existence and timing of a listed factor and its relation to relevant service.

Rights of cross‑referenced claimants. Where a factor is for an injury or disease covered by another SoP, the claimant’s rights under that other SoP will apply as to causation. Section 11 makes the cross‑application explicit; the rights under the other SoP apply “as in force from time to time”.

The Statement of Principles is not a punitive or enforcement instrument and does not create criminal offences or civil penalties within its text. The instrument is a medical determination made under subsection 196B(3) of the VEA (s 3), and its role is to guide determinations of whether a disease is connected with relevant service for the purposes of claims under the VEA or MRCA (s 5). It does not itself prescribe administrative sanctions, penalty regimes, compliance audits, or direct enforcement powers.

Enforcement in administrative decision‑making. The practical effect of the instrument is enforced through administrative decision making under the VEA and MRCA processes. Decision makers are required or expected to apply the SoP when considering claims to which the relevant provisions of those Acts apply (s 5). Where the SoP identifies a factor that, on the balance of probabilities and properly related to service, establishes connection, a claimant’s entitlement decision will, within those administrative frameworks, reflect that finding. Any consequences for an incorrect application of the SoP or for a mistaken decision (for example, reversal on review or appeal) are governed by the review and appeal mechanisms contained in the VEA, MRCA and associated administrative law, not by the SoP itself. The SoP does not set those review mechanisms out.

No specified investigatory powers. The instrument does not create explicit investigatory powers for the Repatriation Medical Authority or for administrators to compel production of third‑party records. It relies on existing claim processes and evidence production mechanisms within the VEA/MRCA frameworks. Where documentary proof is lacking, decision makers must assess the probative value of available evidence; the SoP sets the evidentiary thresholds (for example cumulative hours, BMI duration, latency periods) but not the compulsory disclosure mechanics.

Practical enforcement outcomes. The only practical “enforcement” consequence evident within the instrument is that medical causation will be found or not found for claims, which in turn determines access to benefits under the VEA or MRCA subject to those Acts’ provisions. The SoP’s factors and time limits are the deterministic criteria used by adjudicators when deciding whether medical causation is accepted on the balance of probabilities. Any corrective or remedial outcomes for claimants arising from an accepted causation (for example pensions, treatment entitlements, or compensation) are determined under the underlying statutes and administrative practices.

Documentation and evidentiary compliance risk. Because the instrument imposes specific numerical and temporal thresholds (e.g. 5,000 hours carrying 25 kg on the head; 1,000 flight hours; BMI ≥30 for 10 years), there is an implicit compliance risk for claimants whose records do not demonstrate those thresholds. Where documentary evidence is absent, claim outcomes may be unfavourable and administrative reviews or appeals may follow; such outcomes are addressed under the VEA/MRCA processes and administrative law, not within the SoP.

The instrument is expressly made under the VEA (s 3) and applies to claims to which s 120B of the VEA or s 339 of the MRCA applies (s 5). Cross‑application with other Statements of Principles. Section 11 provides that if a factor in s 9 refers to an injury or disease for which another SoP exists, then that other SoP’s factors apply according to its terms “as in force from time to time”. This creates an inter‑SoP hierarchy in which reference factors are resolved by the instrument specifically governing that referenced disease or injury. It therefore requires decision makers to identify and apply the correct SoP(s) when factors cross‑refer. Practically, this means that the SoP for cervical spondylosis may trigger application of other SoPs (for example if a factor is an inflammatory joint disease or a spinal condition that itself has an SoP).

Statutory standard and medical evidence. The SoP’s formulation of what the Repatriation Medical Authority views as establishing causation on the balance of probabilities operates as a medical rule of construction inside the VEA/MRCA statutory schemes. The instrument’s statement that the Authority is of the view “on the sound medical‑scientific evidence available” (s 8) places the medical findings within an evidentiary standard that must be weighed by statutory decision makers. The underlying statutes determine ultimate entitlement. The SoP therefore supplies medical content that the statutes reference when adjudicators decide whether a condition is service connected.

ICD‑10‑AM and health information classification. Section 7(8) and Schedule 1 reference the ICD‑10‑AM Tenth Edition (effective date 1 July 2017) for code mapping. This links the SoP to national medical coding standards, which will interact with broader health information systems, medical records, insurance coding and statistical reporting frameworks. The SoP’s reliance on a specific edition means that coding and classification in administrative records should align with that edition’s codes for cervical spondylosis where the SoP is applied.

Interaction with clinical practice and medico‑legal evidence. The SoP requires clinical assessments and imaging; the definition of clinical onset explicitly requires assessment by a registered medical practitioner (Schedule 1). This brings clinical record‑keeping and medico‑legal reporting into the statutory decision‑making process under the VEA/MRCA. Existing laws and professional regulations governing medical practice, privacy (e.g. health records rules) and expert witness duties will intersect with the SoP when clinicians prepare reports for claims.

Temporal relationships with other statutory provisions. The SoP imposes look‑back windows (eg 25 years for certain exposures; 20 years for trauma) and latency requirements (eg six months between antecedent event and clinical onset or worsening for many factors). These temporal constraints must be interpreted alongside any statutory limitation periods or procedural time limits in the VEA and MRCA. The SoP does not itself alter limitation periods for claims; those remain within the parent Acts.

No direct conflict with criminal or workplace health and safety law. The SoP is a claims instrument and does not purport to regulate occupational safety, workplace compensation schemes, or criminal liability. Where the same medical facts are relevant to other regimes (workers’ compensation, civil personal injury litigation, coronial processes), the SoP may be used as medical reasoning but does not displace or supersede the legal standards or evidentiary rules of those other regimes. The instrument does not speak to those interactions, and it requires decision makers to apply it only within the VEA/MRCA context (s 5).

This Statement of Principles is No. 12 of 2023 and was dated 27 February 2023; it commences 27 March 2023 (s 2). It expressly repeals the earlier Statement of Principles concerning cervical spondylosis No. 67 of 2014 (Federal Register of Legislation No. F2014L00932) made under subsection 196B(3) of the VEA (s 4). The instrument therefore replaces the 2014 SoP for this condition.

The instrument refers to the ICD‑10‑AM Tenth Edition with an effective date of 1 July 2017 (s 7(8); Schedule 1). That reference fixes the coding edition used to map cervical spondylosis to ICD‑10‑AM codes M47.xx or M50.3 (s 7(6)-(8)). Any future amendments that change the ICD‑10‑AM edition referenced, or that alter code mappings, would change how coding aligns with the SoP; currently the text ties the mapping to the 2017 edition.

Section 11 contemplates that other Statements of Principles “as in force from time to time” will be applied where a factor in this SoP refers to an injury or disease that has its own SoP. That language anticipates that other SoPs will be updated independently and those updates will affect the application of this SoP where cross‑references occur.

What the instrument does not record. The instrument contains no schedule of past amendments or a change log beyond the repeal of the 2014 SoP. It does not list the specific medical‑scientific changes from the 2014 version to the 2023 version; the reader must compare the two instruments to identify substantive differences. 1. Clinical onset is clinician‑assessed and can be dated earlier than imaging. The Schedule defines clinical onset as the point backwards from first imaging confirming spondylosis to the date at which symptoms were persistently present, as assessed by a registered medical practitioner (Schedule 1). If imaging occurs long after symptoms began, clinical onset may be placed years earlier. Disputes are likely where medical records are sparse or where practitioners differ about persistence of symptoms.

2. Imaging evidence is required in addition to clinical signs. Section 7(2) requires both clinical manifestations and imaging evidence of degenerative change. The instrument notes imaging evidence is usually obtained after clinical onset (Schedule 1). A claimant with symptoms but without imaging confirmation may fail to meet the SoP’s diagnostic threshold.

3. Stringent cumulative exposure thresholds with long look‑back windows. Several exposure factors require large cumulative totals and long look‑back periods. For example, carrying 25 kg on the head upright for a cumulative total of at least 5,000 hours within any 10‑year period, with clinical onset within 25 years following that period (s 9(10), (25)); flying in high performance aircraft for 1,000 hours within 25 years before onset (s 9(11), (26)); piloting a helicopter for 1,000 hours within 25 years before onset (s 9(12), (27)). Recordkeeping for these thresholds may be inadequate after decades, meaning claimants may struggle to prove the required hours.

4. BMI requirement is time‑defined. “Being obese” is defined as BMI ≥30 (Schedule 1), but the SoP requires obesity for at least 10 years within the 25 years before clinical onset (s 9(13), (28)). Claimants will need longitudinal weight/height records (medical records, service health records) to demonstrate duration. Single‑point BMI measurements will not suffice.

5. Trauma definition has a tight symptom window and persistence requirement. “Trauma to the cervical spine” requires development of symptoms within 24 hours and persistence for at least 7 days, unless specific medical interventions occurred (Schedule 1). If symptoms began later than 24 hours or resolved within 7 days without listed interventions, the event may not qualify, even if the event otherwise involved significant force.

6. Penetrating injury examples are limited. The Schedule defines penetrating injury to an intervertebral disc by examples (bullet, shell fragment, knife, needle). Novel penetrating mechanisms may require argument to fit within this definition.

7. Latency periods apply inconsistently. Many antecedent events must have occurred at least six months before clinical onset or worsening (numerous s 9 items). Practitioners and adjudicators must check whether the relevant item requires six months. Errors in applying latency requirements can be decisive.

8. Cross‑reference traps. Section 11 requires application of other SoPs where a factor refers to an injury or disease covered by another SoP. Failure to identify and apply that external SoP will produce incorrect causation findings. Conversely, misidentifying a factor as covered by another SoP when it is not can misdirect the assessment.

9. Death causation requires contribution to a terminal event. For death claims, cervical spondylosis must have contributed to a terminal event or condition (s 7(9)). The Schedule lists examples of terminal events (pneumonia, respiratory failure, etc). Proving that spondylosis materially contributed to such terminal events can be medically complex and contested.

10. SoP does not itself define appeal or procedural rights. The instrument does not state how and when claim decisions applying the SoP may be reviewed or appealed; those procedural routes are in the VEA/MRCA framework, so claimants unfamiliar with those statutes might misunderstand next steps.

11. ICD‑10‑AM edition fixed. The instrument references the ICD‑10‑AM Tenth Edition effective 1 July 2017 for code mapping (s 7(8)). If clinical coding in records uses different editions or local adaptations, mapping inconsistencies may arise.

12. The instrument creates no statutory duty to obtain records. While the SoP expects medical and service records for proof, it does not impose a statutory obligation on third parties to retain or produce such records. Practical problems arise where records have been destroyed or are incomplete.

13. Aggravation vs initial causation distinction. Subsections 9(16)-(31) apply only to material contribution to or aggravation of cervical spondylosis where the condition pre‑existed service or was suffered during but did not arise out of service (s 10(2)). Misclassifying a claim as an initial causation rather than aggravation (or vice versa) can lead to misapplication of the SoP.

14. “High performance aircraft” definition is physics‑specific. It is defined as an aircraft capable of routinely producing at least 4g. Evidence may need technical aviation data or expert evidence to classify aircraft; unit records alone may be insufficient.

These “gotchas” are concrete operational and evidentiary traps implicit in the instrument’s language. They identify where claimants, clinicians and decision makers need particular care in assembling, preserving and presenting evidence to ensure the SoP is correctly applied.

Compliance, in this context, means preparing and presenting claims and supporting evidence so that decision makers applying the VEA/MRCA and this SoP can properly assess whether cervical spondylosis or death from it is connected with relevant service. The instrument imposes specific evidential and temporal thresholds; meeting them requires structured documentation and medico‑legal preparation.

Evidence and documentation checklist

1. Clinical records establishing symptoms and persistence. Because “clinical onset” is to be assessed by a registered medical practitioner as the point backwards from first imaging confirmation to when symptoms were persistently present (Schedule 1), obtain contemporaneous GP notes, specialist notes, hospital records, and any allied health notes that document symptom onset, duration and persistence. Where possible, secure notes that tie symptom onset to particular events.

2. Imaging reports and images. Obtain the first imaging study that confirms degenerative change (X‑ray, MRI). The SoP requires imaging evidence of degenerative change in addition to clinical manifestations (s 7(2)). Ensure radiology reports and DICOM images are available, dated, and linked to the clinical records.

3. Expert medical opinion. Procure a report from a registered medical practitioner (orthopaedic surgeon, neurosurgeon, rheumatologist, or rehabilitative medicine specialist) that: (a) identifies the date of clinical onset in accordance with the SoP definition; (b) confirms imaging evidence of degenerative change; (c) expressly addresses any listed antecedent factors and the temporal relationship to relevant service as required by s 10(1); and (d) if death, addresses whether spondylosis contributed to the terminal event (s 7(9), Schedule 1 terminal event).

4. Service records and operational logs. For factors linked to service exposures, collect service medical records, unit logs, deployment records, and personnel files. For flight‑related factors, obtain flight logbooks, squadron records, and aircraft type information to establish aircraft capability (for high performance aircraft test for ≥4g). For head load carriage, secure unit training logs, equipment lists, role descriptions, and any retrospective testimony corroborating hours and loads.
