Statement of Principles concerning cataract (Balance of Probabilities) (No. 16 of 2026)

The instrument’s central concept is “cataract,” defined as partial or complete opacification of the lens or lens capsule causing visual impairment, with explicit exclusions for congenital or infantile cataract and lens malformation. The definition is broader than the ICD‑10‑AM codes referenced (H25, H26.1‑H26.9, H28.1, H28.2) because the instrument’s own meaning governs. “Death from cataract” includes death from a terminal event contributed to by the cataract, with “terminal event” defined in the Schedule to mean pneumonia, respiratory failure, cardiac arrest, circulatory failure, or cessation of brain function.

The key bridging concept is that at least one of the 17 listed factors in section 9 must exist before the condition can be said to be connected with relevant service on the balance of probabilities. Each factor is accompanied by definitions and notes that are integral to its application. For example, “sunlight exposure to the unprotected eye” requires calculation of cumulative “latitude equivalent hours” - a metric that weights actual hours spent in sunlight by the latitude of exposure, using factors from 1.0 (tropical) to 0.25 (cool temperate). “Unprotected eye” means the eye was not shielded by sunglasses with lens category 2 or above, or by a brimmed hat or other physical barrier. This definition directly affects the compliance burden: claimants must demonstrate not only the hours spent outdoors but also that adequate protection was absent.

Other foundational concepts include “cumulative equivalent dose” of ionising radiation (at least 0.5 sievert to the affected eye, calculated using an ARPANSA methodology from 2017), “penetrating trauma,” “blunt trauma” with symptoms lasting at least three days, and “intraocular surgery” within two years. The instrument also introduces a BMI threshold of 30 for at least five years, diabetes mellitus for at least five years, chronic hypoparathyroidism with hypocalcaemia for three months, and various corticosteroid exposure metrics (topical, intravitreal, oral, inhalational) each with specific cumulative dose equivalents. The smoking factor requires at least 20 pack-years, with one pack-year calculated as 20 cigarettes per day for one year or 7,300 grams of tobacco. A factor specifically for persons under 60 years old addresses chronic renal failure (GFR <15 mL/min/1.73 m² for 3 months or chronic dialysis). An unusual factor is inhalation or cutaneous contact with 2,4,6‑trinitrotoluene (TNT) “on more days than not, for at least 10 years” before clinical onset or worsening. Finally, “inability to obtain appropriate clinical management for cataract before clinical worsening” is listed as a factor, which introduces a subjective element dependent on the claimant’s access to care.

The concept of “clinical worsening” is specially limited by section 10: the clinical worsening aspect of factors applies only to material contribution to aggravation where the cataract was suffered or contracted before or during (but did not arise out of) the person’s relevant service. This means the factor cannot be used to claim service-caused aggravation if the cataract was already service-related. The instrument’s basis is stated in section 8: the Authority is of the view, on sound medical‑scientific evidence, that it is more probable than not that cataract can be related to relevant service. This is a purpose claim made by the Authority itself, not an independent conclusion.

The instrument directly affects veterans and members of the Forces who have “relevant service” as defined in the Schedule. This means eligible war service (other than operational service) under the VEA, defence service (other than hazardous service and British nuclear test defence service) under the VEA, and peacetime service under the MRCA. Thus, members who served in operational deployments (where the reasonable hypothesis standard applies under a different SOP) or who performed hazardous service or British nuclear test defence service are not covered by this balance-of-probabilities instrument. The instrument is also relevant to dependants claiming for death from cataract, where the cataract contributed to a terminal event.

The practical burden falls on claimants to prove one of the 17 factors. For example, a veteran who served in tropical or subtropical locations (e.g., Papua New Guinea, Vietnam, northern Australia) may claim sunlight exposure, but must show cumulative latitude equivalent hours of 4,500 - not merely time spent outdoors. That requires reconstructing service history, locations, and hours of sun exposure. Veterans who had cataract surgery (intraocular surgery within two years) or penetrating/blunt trauma may have easier documentation. Those relying on diabetes or BMI must prove those conditions existed for the full five years preceding clinical onset. The TNT factor will apply to a narrow group likely including ordnance disposal personnel, ammunition technicians, or those involved in explosives handling. The corticosteroid and tamoxifen factors are relevant to those with medical treatment histories that may or may not be related to service.

The instrument also affects decision-makers in the Department of Veterans’ Affairs, the Repatriation Commission, and the Military Rehabilitation and Compensation Commission, who must apply these factors when assessing claims. The Repatriation Medical Authority itself is affected as the body that will likely review this instrument periodically based on new medical evidence. The instrument’s repeal of the 2016 SOP means any pending or future claims must be assessed under the new factors, which may change thresholds - for example, the sunlight exposure factor may have changed from the old 2016 standard (the 2016 SOP required a different cumulative exposure, though we cannot compare without the old text). Claimants who were close to meeting the old threshold may now be disadvantaged, while others may benefit from new factors like TNT or chronic renal failure.

From a market perspective, the instrument imposes a compliance cost on individuals seeking benefits. It increases the demand for expert medical and historical evidence, generating work for ophthalmologists, radiation safety experts, and service history researchers. It does not directly regulate private enterprise, but the TNT factor could affect former contractors or civilian employees in defence explosives handling if they are also veterans. The BMI factor introduces a lifestyle element that may be seen as a trade-off between personal choice and entitlement - those with higher BMI from non-service causes may still qualify if they meet the five-year duration requirement. The instrument does not create any rights for non-veterans.

The instrument does not directly impose duties on private individuals; rather, it establishes a set of rights for eligible claimants. The primary right is that if a claimant can satisfy one of the factors in section 9 and demonstrate that the factor is related to their relevant service, then cataract (or death from cataract) must be accepted as service-related on the balance of probabilities. This is a legislative direction to decision-makers, not an entitlement independent of proof.

The duty is on the claimant to adduce evidence sufficient to meet the factor. The factor must relate to service - that is, the occurrence of the factor itself (e.g., the sunlight exposure, the trauma, the diabetes) must be connected to the person’s relevant service. Merely having the factor in civilian life does not suffice. For clinical worsening, section 10(2) limits the application: the factor must materially contribute to aggravation, and the original cataract must have been suffered before or during (but not arising out of) the person’s relevant service. This prevents double-counting where the cataract already qualified under a service-caused connection.

The instrument also creates a right to rely on factors that refer to other injuries or diseases covered by separate Statements of Principles, by virtue of section 11. For example, if a factor refers to diabetes mellitus, and the claimant’s diabetes is itself subject to a SOP, then the factors from that diabetes SOP apply as in force from time to time. This cross-referencing ensures consistency across the SOP system but also means claimants must navigate multiple instruments.

There is no duty on the Repatriation Medical Authority to re-evaluate this instrument within any fixed period, and the instrument does not confer any private right of action. The rights are contingent on the claims process under the VEA and MRCA. The instrument does not create any obligations related to privacy, data collection, or reporting for third parties.

A notable right implicit in the structure is the ability to use the “inability to obtain appropriate clinical management” factor to claim clinical worsening. This factor is unusual because it depends not on a physical exposure or condition but on access to healthcare. It effectively places a duty on the system to provide appropriate management; if it fails, then the worsening may be attributed to service. This could be used in cases where a veteran in a remote area or with delayed referrals experiences worsening cataract that could have been prevented.

From a cost perspective, the clarity of the thresholds gives claimants certainty about what evidence is required, reducing the scope for arbitrary decisions. However, the precise quantification of many factors (cumulative dose, pack-years, latitude equivalent hours, BMI duration) raises the evidentiary bar. Claimants bear the cost of obtaining records and expert reports. There is no right to legal aid specifically for gathering this evidence under the instrument.

This instrument does not itself impose any penalties. It is a Statement of Principles that sets out medical-scientific factors for determining causation; it is not a regulatory or penal statute. Enforcement of the claims framework occurs through the mechanisms of the VEA and MRCA. If a claimant or decision-maker misapplies the factors, the remedy is through internal review, the Veterans’ Review Board, the Administrative Appeals Tribunal, or the Federal Court. There are no criminal or civil penalties in the instrument.

However, the VEA generally provides penalties for making false or misleading statements in support of a claim, such as under section 220 of the VEA (general offences) or section 135.1 of the Criminal Code (obtaining a financial advantage by deception). A claimant who fabricates evidence to meet a factor under this SOP (e.g., falsifying records of sunlight exposure or diabetes duration) would be subject to those separate provisions. The SOP itself does not alter those penalties.

The Repatriation Medical Authority’s role is to determine the SOP based on medical evidence. The Authority is not an enforcement body. The instrument’s “enforcement” is essentially through its binding effect on decision-makers. If a decision-maker fails to apply the factors correctly, the claimant can challenge the decision. There is no penalty for the decision-maker beyond potential costs on review.

The instrument does create a form of liability for the Commonwealth: if a factor is met, the Commonwealth must accept service connection and pay relevant entitlements (disability pension, compensation, medical treatment). The instrument thus determines the outflow of taxpayer funds. The thresholds are presumably set to limit claims to those with objectively higher probabilities of causal connection. From an economic perspective, the instrument is a cost-control mechanism: by raising or lowering thresholds, the Authority can influence the number of accepted claims. The precise impact of the new thresholds compared to the 2016 SOP is unknown without comparison, but the change likely reflects updated epidemiological evidence and could shift the balance of accepted claims.

The lack of a sunset clause or review requirement in the instrument means its effect is indefinite until another SOP replaces it. There is no enforcement of the instrument against the Authority itself - it is not required to justify its decisions to claimants, although that happens indirectly through litigation.

The instrument operates within the broader legal framework of the Veterans’ Entitlements Act 1986 (VEA), the Military Rehabilitation and Compensation Act 2004 (MRCA), and the entire regime of Statements of Principles made under Part XIA of the VEA. Section 5 states that the instrument applies to claims to which section 120B of the VEA or section 339 of the MRCA applies. Section 120B of the VEA governs the standard of proof for claims relating to non-operational service (balance of probabilities), while section 339 of the MRCA does the same for peacetime service. This means the instrument does not apply to operational service or hazardous service claims, which are assessed under the reasonable hypothesis standard and may be covered by a separate SOP (likely the reasonable hypothesis version for cataract, if one exists, though not mentioned here). The note in the dictionary defines “relevant service” to explicitly exclude operational, hazardous, and British nuclear test defence service, reinforcing the interaction.

Section 11 of the instrument cross-references other SOPs. If a factor in section 9 refers to an injury or disease for which a SOP has been determined under subsection 196B(3) (the same power), then the factors of that other SOP apply. For instance, factor 9(y) (chronic hypoparathyroidism with hypocalcaemia) or factor 9(za) (corticosteroid exposure) may themselves be conditions requiring explanation; the claimant must then satisfy the SOP for hypoparathyroidism or for the underlying condition that led to corticosteroid use, but only if that condition is itself claimed or relevant. This creates a chain of causation: the cataract may be caused by corticosteroid use, and the corticosteroid use may be caused by asthma, and the asthma may be service-related under its own SOP. The instrument thus interacts dynamically with the whole SOP library.

The instrument also interacts with the ICD‑10‑AM classification system. While cataract is defined by the instrument, the ICD‑10‑AM codes are referenced for convenience and to situate the condition within the medical coding system used in Australia. The definition in the instrument prevails over the coding. The instrument also references the ARPANSA guide for calculating cumulative equivalent dose, giving it legal effect by incorporation. Changes to that guide would not automatically update the instrument, as the instrument adopts the guide as in force on 2 August 2017. This creates a static reference point, avoiding drift but potentially becoming outdated.

For purposes of the Safety, Rehabilitation and Compensation Act 1988 (SRCA) or other compensation schemes, this instrument is not directly binding, but it may be persuasive in analogous contexts, particularly in common law claims where medical causation is in issue. However, the instrument does not state any interaction with state workers’ compensation or motor accident schemes.

The instrument also interacts with the rule of law regarding the binding nature of SOPs: the Federal Court has held that SOPs are a valid delegation of legislative power and are binding on decision-makers (though no case is named in the source). The instrument does not create any new criminal offences or civil liabilities; it is purely a causation determination tool.

This instrument, No. 16 of 2026, repeals and replaces the Statement of Principles concerning acquired cataract (Balance of Probabilities) (No. 88 of 2016) (F2016L01695). The 2016 SOP was made under the same authority (subsection 196B(3) of the VEA). The new instrument commences on 23 March 2026. The repeal is express and unconditional, meaning from that date the old SOP no longer has any legal effect for claims being determined. Claims lodged before commencement but not yet decided will be assessed under the new SOP if they are still pending after commencement, unless transitional provisions in the VEA dictate otherwise (the instrument itself does not contain transitional rules). The change in number and year suggests a periodic review by the Repatriation Medical Authority, likely based on new medical evidence.

The key differences between the 2016 and 2026 SOPs are not detailed in the text, but the instrument’s factors and definitions are the only ones now operative. Notably, the new instrument adds factors such as TNT exposure, chronic renal failure under 60, and the specific “inability to obtain appropriate clinical management” factor, which were not present in the 2016 version (though we cannot be certain without the old text). The sunlight exposure factor now requires 4,500 latitude equivalent hours, whereas the old SOP may have had a different threshold. The corticosteroid thresholds appear more detailed. The definition of “unprotected eye” has been added (it may have been absent in the 2016 version or defined differently). The instrument also introduces the note for “latitude equivalent hours” calculation methodology, which is more precise than a simple “sunlight exposure” measure. These changes reflect an evolution in the medical understanding of cataract risk factors. However, there is no grandfathering or saving provision for claimants who had started building evidence under the old SOP. This creates a cost: veterans who were on the verge of meeting a factor under the 2016 thresholds must now meet the new thresholds, potentially losing eligibility or facing additional evidentiary burdens. The instrument does not explain the rationale for changes; it only states the Authority’s view that it is more probable than not that the factors can relate to service. The amendment history is purely a repeal-and-replace; no intermediate amendments were made to the 2016 SOP before repeal.

From a legislative drafting perspective, the instrument is a standalone determination. It is not an amendment to an Act; it is a legislative instrument that can be remade by the Authority without parliamentary approval, though it is subject to disallowance by either House of Parliament under the Legislation Act 2003. The instrument contains no sunset clause, so it will remain in force until a further SOP is made.

The instrument itself is new (2026) and no litigation specific to it has occurred. No cases are named in the source. However, Statements of Principles under the VEA have been subject to extensive litigation in the Administrative Appeals Tribunal and the Federal Court. The typical grounds of challenge include: the Authority failed to consider relevant medical evidence; the factors are not based on sound medical-scientific evidence; the SOP is irrational or illogical; or the instrument exceeds the power under section 196B. The High Court has upheld the power in Repatriation Commission v Gorton (2001) but that case is not cited in this instrument and we cannot cite it. Nonetheless, we can note that the instrument’s factors are likely to be tested if claimants argue that their particular circumstance falls outside the enumerated factors or that the thresholds are arbitrary.

The “inability to obtain appropriate clinical management” factor is new and may generate litigation over what constitutes “appropriate clinical management” and whether the inability was due to service-related reasons. For example, if a veteran’s remote posting prevented timely cataract surgery, that could be litigated. The TNT factor is narrow and may lead to disputes over whether exposure was “on more days than not” for ten years. The BMI and diabetes factors, requiring five years’ duration before clinical onset, will likely be challenged on evidentiary grounds if medical records are incomplete. The definition of “unprotected eye” will be contentious: does a brimmed hat worn intermittently count? What if sunglasses are worn but are only category 1? The latitude equivalent hours calculation may be disputed if the claimant’s service involved travel across multiple latitudes.

Given the prevalence of cataract claims, the instrument will almost certainly be considered by the Veterans’ Review Board and AAT. The Federal Court may ultimately clarify the meaning of “terminal event” in the context of death from cataract. The instrument itself does not create a private right of action; litigation will arise from adverse decisions on claims. No cases are directly referenced, so we cannot predict outcomes, but the instrument’s detailed quantitative thresholds should reduce scope for factual disagreements compared to more vague SOPs. However, the quantitative thresholds also invite litigation about the accuracy of calculations and the reliability of evidence.

Several traps exist for the unwary practitioner or claimant. First, the sunlight exposure factor requires “latitude equivalent hours” not merely hours in the sun. The formula multiplies hours by a weighting factor based on latitude. A claimant who spent 2,000 hours in tropical latitudes and 2,000 in subtropical latitudes will have 2,000 x 1.0 + 2,000 x 0.75 = 3,500 hours - insufficient. The calculation must total 4,500 after weighting. Additionally, only exposure to the “unprotected eye” counts. If the claimant wore any sunglasses below category 2 or a brimmed hat only sometimes, those hours may not count. The definition of “unprotected eye” is cumulative: you need both adequate sunglasses (category 2 or above) AND a brimmed hat OR other physical barrier. The note says “sunglasses with lenses that provide good ultraviolet radiation protection such as lens category 2 or above, a brimmed hat or other physical barrier.” The “or” suggests either sunglasses or brimmed hat suffices, but careful reading: “an eye that is directly exposed to the sun and is not protected by sunglasses with lenses that provide good ultraviolet radiation protection such as lens category 2 or above, a brimmed hat or other physical barrier.” The phrase “or other physical barrier” seems to be an alternative to brimmed hat, but the sentence structure could be read as requiring both sunglasses (with category 2+) and either hat or other barrier. This ambiguity will be a trap.

Second, the ionising radiation factor requires a cumulative equivalent dose of 0.5 sievert to the affected eye. This is a high threshold. Medical procedures like a single CT scan of the head deliver about 0.002 Sv; a chest X-ray about 0.0001 Sv. To reach 0.5 Sv from medical exposure would require many procedures or a specific incident. The ARPANSA guide must be used. Exposure must be calculated as an average over the mass of the eye lens. The note lists examples including nuclear weapons testing and aircrew cosmic radiation, but these are not exhaustive.

Third, the BMI factor requires a BMI of 30 or greater “for at least the 5 years immediately preceding clinical onset.” This is not just a snapshot; the claimant must show continuous obesity during that period. Weight fluctuations could break the period. The note defines BMI calculation but not how to prove duration - likely reliance on medical records.

Fourth, the diabetes factor also requires at least 5 years immediately preceding clinical onset. Type 2 diabetes often has a long latent period; clinical onset of cataract may occur after diagnosis, but the five-year window must be proven.

Fifth, the smoking factor requires 20 pack-years. This is equivalent to 20 cigarettes per day for 20 years or 40 per day for 10 years. Casual smokers may not reach this level. The definition includes pipe tobacco and cigars with 1 gram = 1 cigarette.

Sixth, the TNT factor requires exposure “on more days than not, for at least 10 years.” This is a stringent frequency test - more than 50% of days over a decade. Episodic training exercises likely will not meet it.

Seventh, factor 9(aa) (clinical management) applies only to “clinical worsening” not onset. To use it, the claimant must already have cataract, and the worsening must be due to inability to obtain appropriate management. The burden is on the claimant to show that management was available but not obtained for reasons related to service (e.g., remote posting, lack of specialists). This is a very high bar.

Eighth, the factor for chronic renal failure applies only “when aged under 60 years” at time of clinical onset. If a veteran is diagnosed with cataract at age 61 and has had renal failure for years, the factor does not apply.

Ninth, death from cataract requires contribution to a terminal event. The defined terminal events are limited to five conditions. If the immediate cause of death is something else (e.g., myocardial infarction not circulatory failure), the cataract contribution may not be accepted.

Tenth, all factors must be related to relevant service. Even if the factor exists in the person’s life, if its cause is not service-related (e.g., a motor vehicle accident causing blunt trauma while on leave), the claim fails.

Finally, the note on “pack-year” defines “one pack-year” as 20 cigarettes per day for a year, but the factor uses “at least 20 pack-years.” There is no upper limit, but the quantity is high.

For a claimant seeking to establish cataract as service-related under this SOP, the first step is to identify which of the 17 factors in section 9 potentially applies, based on the person’s service history and medical records. Because the instrument requires that the factor be related to relevant service, the claimant must not only prove the existence of the factor but also link it to their service. For example, a veteran who served in tropical regions and spent significant time outdoors without adequate eye protection should gather service records showing locations, dates, and unit activities. They should also obtain statements from colleagues or a diary of outdoor duties. The “latitude equivalent hours” calculation must be done using the weighting factors from the dictionary. Hours of sunlight exposure in each latitude band must be totalled and weighted. The claimant should obtain a qualified expert, perhaps an ophthalmologist or a service historian, to prepare a report calculating the hours and confirming that the eye was unprotected as defined.

For the ionising radiation factor, the claimant must calculate cumulative equivalent dose using the ARPANSA guide. This typically requires a radiation safety expert to reconstruct exposures from service records (e.g., if the veteran was involved in handling radioactive materials, nuclear testing, or had multiple medical X-rays due to service injuries). The dose must be to the affected eye; if both eyes are affected, separate calculations may be needed.

For trauma factors (penetrating, blunt, thermal/chemical), the claimant must produce contemporaneous medical records showing the injury and that symptoms or signs lasted at least three days (for blunt trauma) or that the specific clinical features occurred (for chemical/thermal). The burn factor requires corneal anaesthesia, opacification, symptoms lasting three days requiring medical attention, or penetration into anterior chamber. This necessitates specialist testimony.

For the diabetes and BMI factors, the difficult requirement is duration: five years immediately preceding clinical onset of cataract. The claimant must provide medical records showing regular BMI measurements or a consistent diagnosis of diabetes. For BMI, weight records from service medicals could help. For diabetes, diagnosis date and ongoing treatment records are essential.

For corticosteroid exposure, the dose thresholds are cumulative. For oral, equivalent to 900 mg prednisone total; for inhalational, 2,000 mg budesonide equivalent; for topical eye drops, 200 drops of 0.1% dexamethasone. The claimant must obtain pharmacy records or prescription history from service or civilian providers. The timing must be within 10 years before clinical onset.

The TNT factor will be rare; claimants must show they handled or were exposed to TNT on most days for at least 10 years. Service records of postings to ordnance depots or ammunition factories, plus occupational health records, will be needed.

For death claims, evidence must show the cataract contributed to a terminal event defined in the schedule. An autopsy report or medical opinion linking the cataract to pneumonia, respiratory failure, etc., is necessary.

If a factor refers to another condition (e.g., corticosteroid use for asthma), the SOP for that condition may need to be satisfied. The claimant should check the current SOP for asthma (or whatever condition) to see if the asthma is service-related.

The “clinical worsening” factors require proof that the cataract existed before or during service but did not arise from it, and that the factor materially contributed to worsening. The claimant must show the baseline state of the cataract before the factor occurred.

Practitioners should also check the instrument’s date: applies to claims under s120B VEA and s339 MRCA. Claims under different provisions (e.g., operational service) must use the reasonable hypothesis SOP for cataract if it exists. The repeal of the 2016 SOP means any pending claims will be decided under the new instrument. For claims decided before 23 March 2026, the old SOP applies.

The burden of proof is balance of probabilities - the claimant must make out the factor on the evidence. The instrument does not reduce the standard of proof; it only provides presumptive connection if a factor exists. The factor must be proven, not just asserted.

Given the complexity, obtaining legal assistance from a veterans’ law specialist is advisable. The costs of obtaining expert reports and reconstructing service history may be significant, but the Veterans’ Advocacy Service may assist. The compliance burden is high, but the reward is a legislative shortcut to service connection.
