Statement of Principles concerning carpal tunnel syndrome (Balance of Probabilities) (No. 94 of 2021)

The SoP organises its medical causation framework around several core concepts: a clinical definition of the condition; a closed list of causal and contributory factors; quantitative exposure thresholds; temporal proximity rules; differentiating primary causation from material contribution/aggravation; and reliance on other Statements of Principles where overlap exists.

Clinical definition and scope. The instrument sets the clinical meaning of CTS (s 7(2)) and expressly extends the concept to include deaths where a terminal event or condition was contributed to by the person’s CTS (s 7(5)). Although an ICD‑10‑AM code is cited (G56.0) (s 7(3)-(4)), the operative meaning for the SoP is the clinical description in s 7(2).

Closed-factor approach. Section 9 lists the factors that “must exist” for an applicant to establish, on the balance of probabilities, that CTS or death from CTS is connected with relevant service. At least one of the enumerated factors in s 9 must be present. The factors include occupational mechanical exposures (s 9(1) and 9(17)), traumatic or surgical insults to the wrist (s 9(2) and 9(18)), local oedema (s 9(3) and 9(19)), being overweight or obese (s 9(4) and 9(20)), systemic diseases (amyloidosis, chronic renal failure, acromegaly, diabetes mellitus , ss 9(5)-(7), 9(12), 9(13) and their equivalents for worsening), pharmacologic agents (aromatase inhibitors, immune checkpoint inhibitors , ss 9(14)-(15) and 9(30)-(31)), pregnancy (s 9(16) and 9(32)), space-occupying lesions, haemorrhage, infection, inflammatory arthritides, and finally inability to obtain appropriate clinical management (s 9(33) for clinical worsening).

Quantitative thresholds and timing. For occupational exposures described as “specified activities with the affected hand or forearm”, the Schedule sets quantitative thresholds (for example, bending/twisting or similar movements at least 50 times per hour; forceful activities involving lifting >3 kilograms or >1 kilogram >10 times per hour; or at least 8 hours per week on average over a cumulative 6 months before clinical onset) (s 9(1), Schedule 1). If such activities have ceased before clinical onset, the SoP requires onset within 30 days of cessation (s 9(1)). Similar thresholds apply for clinical worsening (s 9(17)).

Temporal and relationship rules. Section 10 requires that any factor found under s 9 be “related to the relevant service” rendered by the person. Section 10(2) narrows the application of s 9(17)-(33) to cases of material contribution or aggravation of CTS where the person’s CTS pre-dated or began during but did not arise out of relevant service. Thus the SoP specifies both a temporal proximity test and a relational test to relevant service.

Interplay with other SoPs and medical classifications. Section 11 instructs that where a factor in s 9 refers to an injury or disease that itself is covered by another SoP made under s 196B(3) of the VEA, then the factors specified in that other SoP apply as in force from time to time. The SoP also situates the clinical code reference to the ICD‑10‑AM (s 7(3)-(4)) but disclaims that code as the operative definition.

Technical definitions. The Schedule supplies definitional precision on several contested or material concepts: “being overweight or obese” uses BMI ≥ 25 or waist measures (Schedule 1); “chronic renal failure” is defined by GFR <15 mL/min/1.73 m2 for at least three months, need for renal replacement therapy, or undergoing chronic dialysis; “trauma” has an elaborate test requiring a discrete event of significant physical force plus onset within 24 hours and persistence for at least seven days unless specific medical interventions occur (Schedule 1). These definitions convert clinical or workplace histories into thresholded legal facts.

Evidentiary presumption and burden. The RMA states that, on the sound medical‑scientific evidence available, it is more probable than not that CTS and death from CTS can be related to relevant service (s 8). Mechanically, the SoP therefore establishes the factors that, when proved and related to relevant service, satisfy the balance of probabilities standard for causal connection in claims covered by s 120B of the VEA or s 339 MRCA (s 5).

The instrument concerns persons pursuing claims under the VEA or the MRCA where carpal tunnel syndrome or death from carpal tunnel syndrome is alleged. It applies specifically to claims that fall within the scope of section 120B of the VEA or section 339 of the MRCA (s 5). The Schedule defines “relevant service” to include eligible war service (other than operational service), defence service (other than hazardous service and British nuclear test defence service) under the VEA, and peacetime service under the MRCA (Schedule 1). Therefore the population affected comprises:

• veterans whose service meets the Schedule’s categories under the VEA; and
• members of the Australian Defence Force whose peacetime service makes them claimants under the MRCA.

Decision-makers and administrative actors. The Repatriation Medical Authority (RMA) is the instrument-maker and provider of the medical-scientific framework (s 3, s 8). The instrument will be used by decision-makers who determine claims under the VEA and MRCA,those are the statutory decision processes invoked by s 120B of the VEA and s 339 of the MRCA (s 5). The SoP thus binds the medical-assessment layer of those claims: medical officers and claims assessors will apply the factors and definitions set out here when deciding whether CTS or death from CTS is connected to a person’s relevant service.

Medical practitioners and treating clinicians. Treating clinicians who provide diagnostic statements, surgical records, medication histories, BMI and waist circumference measurements, pathology results (for chronic renal failure GFRs), pregnancy records and documentation of infections, trauma events or space-occupying lesions will be directly implicated. The Schedule imposes objective thresholds and timing requirements that clinicians and occupational health professionals will need to document for decision-makers to accept the relevant factor.

Employers and occupational health units. Where claims turn on “specified activities” in the workplace (Schedule 1; s 9(1) and s 9(17)), employers, supervisors and occupational health providers may need to supply or verify exposure histories, shift records, task descriptions and frequency/force metrics. The thresholds in the Schedule (for example, number of repetitions per hour; weight lifted per event; average hours per week; cumulative duration) mean employment records, task analyses and ergonomics reports will be probative.

Legal practitioners, advocates and advisers. Lawyers and advocates representing claimants or responding for government agencies must work within the evidentiary parameters set by the SoP: establish at least one qualifying factor under s 9, show that the factor is related to relevant service (s 10(1)), and where aiming to show material contribution/aggravation for pre-existing CTS, ensure the matters in s 10(2) and ss 9(17)-(33) are engaged. The SoP’s explicit cross-reference rule (s 11) also requires advisers to check other SoPs where comorbid conditions are involved.

Families and beneficiaries. Where the instrument applies to death from CTS (s 7(5)), surviving family members or dependants pursuing death-related claims under the VEA/MRCA are affected. The instrument’s extension to death requires showing that the terminal event or condition was contributed to by CTS; the Schedule defines “terminal event” with examples (Schedule 1).

In short, the SoP reshapes evidentiary expectations across the administrative decision-chain: claimants, medical providers, employers and decision-makers must align histories, clinical findings and records with the defined factors, thresholds and temporal rules to establish service connection for CTS or death from it under the VEA/MRCA framework.

This SoP primarily prescribes evidentiary conditions rather than imposing traditional regulatory duties or civil rights; however, it creates practical obligations on parties involved in claims by setting what must be established to succeed. The key operative duties and rights derived from the instrument are:

Duty to establish a qualifying factor. A claimant bears the practical burden of proving, on the balance of probabilities, that at least one of the factors listed in s 9 exists and is related to the person’s relevant service (s 9, s 10(1)). The SoP does not itself allocate statutory burden of proof under the VEA or MRCA, but its language makes clear that the existence of a listed factor is a prerequisite to finding a service connection on the balance of probabilities (s 9).

Duty to show relationship to relevant service. Even where a listed factor is present, s 10(1) requires that the factor be related to the person’s relevant service. The SoP does not set a specific test for “related to” inside the instrument, but it makes relation to relevant service an explicit element of the causal chain (s 10(1)). Practically, this imposes a duty on claimants to provide evidence linking an exposure, trauma, or other factor to their period of service as defined in the Schedule.

Duty to attend to temporal and quantitative thresholds. Where the relevant factor is occupational exposure, the Schedule prescribes quantitative thresholds (for example, repetitions per hour, weight thresholds, 8 hours per week average over a cumulative 6 months) and timing rules (onset within 30 days of cessation if activities have ceased) that must be met (s 9(1), Schedule 1). For trauma, the Schedule requires discrete events with symptom onset within 24 hours and persistence for at least seven days unless certain interventions occur (Schedule 1). These are concrete evidential thresholds that shape the duty to gather contemporaneous records, shift histories, and medical notes.

Right to have cross-referenced factors considered from other SoPs. Section 11 gives claimants (and decision-makers) a right to rely on another SoP when a listed factor in s 9 refers to an injury or disease covered by that other SoP. The application is “in accordance with the terms of that Statement of Principles as in force from time to time” (s 11). Practically, a claimant with, say, chronic renal failure as a factor (s 9(6)) will have to engage the SoP that covers chronic renal failure for the precise criteria and factual application.

Right to medical consideration where death is alleged to be contributed to by CTS. Section 7(5) states that CTS includes death from a terminal event or condition that was contributed to by the person’s CTS. This creates a pathway for dependants or estate representatives to assert that, if CTS materially contributed to the terminal event, the death falls within the SoP’s scope.

Duty to link pre-existing conditions and aggravation. Section 10(2) confines subsections 9(17)-9(33) to cases of material contribution or aggravation where CTS was suffered or contracted before or during but did not arise out of relevant service. This imposes a duty on claimants and their advisers to frame arguments about aggravation distinctly from primary causation and to align the evidence with the narrower applicability of these subsections.

No penal regime in the instrument. The SoP itself does not prescribe criminal or civil penalties for non-compliance by applicants or clinicians. Its effect is evidentiary: it sets standards that a decision-maker will apply when determining service connection under the VEA or MRCA (s 5). Any consequences for failing to establish a factor are administrative, primarily denial of the claim, rather than punitive inside the instrument.

Procedural implications. Because many factors depend on objective measures (BMI, GFR, surgical records, drug prescription history, documented trauma events), claimants and clinicians have an implicit duty to preserve and supply relevant contemporaneous medical and occupational records. The Schedule’s detailed definitions make certain documentary elements materially important to the right to a favourable finding.

In sum, the SoP allocates rights and duties around evidentiary thresholds: claimants have the right to have CTS and death from CTS judged on the listed factors; they bear the practical duty to demonstrate a qualifying factor and link it to relevant service; and decision-makers must apply the SoP and cross-refer to other SoPs where applicable.

The Statement of Principles is an administrative instrument that sets evidentiary criteria for decision-making under the VEA and MRCA; it does not itself create criminal offences, civil penalties or an independent enforcement mechanism within its text. The instrument is made under subsection 196B(3) of the VEA (s 3), and its operative effect is to prescribe medical-scientific factors for assessing causal connection in claims that fall under the statutory decision frameworks of the VEA and MRCA (s 5). Consequently, enforcement and any consequences flow indirectly through those Acts and their decision processes rather than via the SoP itself.

Administrative enforcement and consequences. The immediate enforcement mechanism is administrative: decision-makers determining claims under s 120B of the VEA or s 339 of the MRCA will apply the SoP. If a claimant cannot demonstrate a qualifying factor related to relevant service as the SoP requires, their claim for service connection on the grounds of CTS or death from CTS will, as a practical matter, be unsuccessful. The instrument does not specify appeal processes; appeals and merits review processes are governed by the procedural and review provisions of the VEA and MRCA and the administrative law framework that applies to decisions under those Acts (the SoP does not itself create new appeal rights).

No penal sanctions in the SoP. The instrument does not impose fines, imprisonment, or civil remedies for non-compliance by clinicians, employers, or claimants. It does not set compliance reporting obligations with sanctions. The SoP operates by establishing rules that have consequences only through the decision-making architecture of the VEA/MRCA claims process.

Potential indirect enforcement levers. Although the SoP contains no enforcement provisions, some of the facts that it requires will depend on records and clinical decisions (for example, surgical notes, medication histories, GFR measurements, BMI values, documented trauma events). In practice, deficiency or absence of such records can lead to denial of claims. That practical consequence is the primary enforcement lever: the SoP shapes the evidentiary bar that claimants must meet.

Decision-maker obligation to apply the SoP. The RMA’s formal determination (s 3) and the SoP’s operation (s 5) mean that decision-makers under the VEA and MRCA will be obliged to have regard to, and to give effect to, the SoP in the relevant claims processes. Failure by an administrative decision-maker to apply the SoP where it governs a claim can be subject to internal review or external merits and judicial review avenues, but the instrument itself does not set those pathways; they are established by the VEA/MRCA and general administrative law. The SoP does not detail the standard of application beyond the RMA’s view that the medical‑scientific evidence supports the probability of a connection (s 8).

Record-keeping and evidentiary duties. For practical enforcement of the SoP’s standards, clinicians and employers will find that adequate records and contemporaneous documentation are the decisive factors in outcomes. While the SoP imposes no penalty for poor record-keeping, inadequate documentation is likely to result in inability to prove the requisite factors and thus in claim denial.

In short, the instrument enforces its standards administratively through the claims process under the VEA/MRCA; it contains no independent penal regime or sanctions language, and its enforcement consequences are the administrative outcomes of claim determinations and any further reviews available under the governing Acts.

The SoP interacts with other legal instruments and decision frameworks in several discrete ways, as provided by its text. These interactions are primarily procedural and evidentiary rather than legislative amendments to other Acts, and they are mediated by references within the instrument to other Statements of Principles, the VEA, the MRCA and the ICD‑10‑AM medical classification.

Embedded operation within VEA and MRCA claims regime. Section 5 expressly states that the instrument applies to a claim to which section 120B of the VEA or section 339 of the MRCA applies. The SoP therefore functions as an evidentiary annex to decisions made under those statutory provisions. It does not amend the VEA or MRCA; rather, it prescribes the medical factors that decision-makers are to use when applying the causation and connection rules within the VEA and MRCA frameworks. Any procedural requirements, appeals or review processes remain those provided for in the VEA/MRCA and administrative law; the SoP’s role is to supply medical causation criteria.

Cross‑SoP interaction. Section 11 provides a rule for interaction among SoPs: where a factor in this SoP (s 9) refers to an injury or disease that itself has an SoP determined under subsection 196B(3) of the VEA, then “the factors in that Statement of Principles apply in accordance with the terms of that Statement of Principles as in force from time to time” (s 11). Mechanically, this gives primacy to other SoPs for the detailed application of factors that reference other diseases or conditions. For example, chronic renal failure is a factor here (s 9(6)), and if chronic renal failure has its own SoP, the criteria there will govern how chronic renal failure should be established for the purposes of s 9(6).

Relationship to medical classification systems. Section 7(3)-(4) references the ICD‑10‑AM code G56.0 for CTS, and identifies the specific edition and copyright details for that classification. However, the instrument makes clear that the meaning of CTS in this SoP is the clinical definition in s 7(2), not merely the code (s 7(3)). Thus while the SoP aligns with international/national disease classification nomenclature for cross-reference, it reserves its own operative clinical definition.

Interaction with clinical and common law standards. The SoP establishes statutory definitions and thresholds that will be applied administratively. It does not purport to displace clinical standards of care, nor does it modify common law tort or workers’ compensation rules. However, where evidence of workplace exposures, traumas, or clinical conditions is used in other legal settings (for example, veterans’ compensation versus civilian workers’ compensation or private litigation), the SoP’s definitions may be persuasive but are not binding outside the VEA/MRCA context. The instrument itself does not address interactions with state or territory workers’ compensation schemes or private tort claims.

Effect on medical record and clinical reporting obligations. Although the SoP does not create direct statutory obligations for clinicians under other statutes, its requirements (for example, BMI thresholds, documented GFR values, records of surgery, onset-timing for trauma and post‑event persistence) will influence the content and significance of clinical records used in VEA/MRCA decision-making. In practice, clinicians may need to align their documentation with the SoP’s thresholds to ensure that evidence is adequate for claims, but the instrument itself does not amend medical registration or privacy regimes.

No express modification of other Acts. The SoP does not purport to amend the VEA or MRCA. It was made under the rule-making power in subsection 196B(3) of the VEA (s 3). Any interplay with other legislation, appeals, judicial review, privacy, health records retention, workers’ compensation,is governed by those other laws and not altered by the SoP.

In summary, the SoP integrates into the pre-existing statutory architecture for veterans’ and members’ claims by prescribing medical factors that decision-makers under the VEA and MRCA must apply, cross-references other SoPs for related conditions, and uses medical classification systems for alignment while maintaining its own operative definitions.

The instrument itself contains the core amendment event recorded within its text: it repeals the earlier Statement of Principles concerning carpal tunnel syndrome No. 8 of 2013 (Federal Register of Legislation No. F2013L00023) made under subsection 196B(3) of the VEA (s 4). The replacement instrument is titled Statement of Principles concerning carpal tunnel syndrome (Balance of Probabilities) (No. 94 of 2021) and is dated 20 August 2021, with commencement on 20 September 2021 (s 1 and s 2). That sequence indicates a contemporaneous update of the RMA’s SoP for CTS.

Documented enactment steps in the instrument. The front matter records that the RMA determined the SoP under subsection 196B(3) of the VEA, signed and sealed it, and dated it 20 August 2021. The commencement clause sets 20 September 2021 as the operative date (s 2). Section 4 then repeals the 2013 SoP , that is the explicit textual amendment history contained within this instrument.

Implications of the repeal. The repeal clause (s 4) means that from 20 September 2021 the 2013 SoP is of no further operative effect and is replaced by the current SoP. For decision-makers and claimants, this is important because the criteria to be applied to claims (including retrospective and continuing claims) will be those in the 2021 SoP from its commencement date, subject to the governing statutes’ rules on how SoPs are applied to claims with onset or events before commencement. The instrument does not itself state transitional provisions for claims straddling the commencement date, nor does it expressly state whether the new SoP applies to events predating commencement; application of the SoP to specific claims will be governed by the terms of the VEA/MRCA and administrative practice.

No further amendment record in the instrument. The body of the instrument does not list prior amendments, subsequent amendments, or a history beyond the immediate repeal of the 2013 instrument. The header gives the instrument’s serial identification (No. 94 of 2021) and the determination date. Any subsequent amendments after commencement would appear in the Federal Register of Legislation as further instruments; none are recorded in the text supplied.

Cross-references to other SoPs as a source of amendment risk. Section 11 allows factors in other SoPs to be applied “in accordance with the terms of that Statement of Principles as in force from time to time” (s 11). That phrase imports a change‑over time risk: if the SoP for a referenced disease is amended later, the criteria for establishing that disease-as-factor here will change with it. Practitioners should therefore track not only this SoP’s amendment history but also the amendment histories of other SoPs referenced by s 9 factors (for example, SoPs covering chronic renal failure, amyloidosis, or inflammatory arthritis).

Administrative amendment mechanics. The SoP was made under the RMA’s statutory power in the VEA. Under that statutory framework, future revision of the SoP would follow the RMA’s processes and publication on the Federal Register of Legislation. The instrument itself does not delineate the internal RMA process for amendments; it simply records this iteration and the repeal of the prior version.

In sum, the only textual amendment recorded in the instrument is the repeal of the 2013 SoP and replacement with the 2021 SoP, effective 20 September 2021. Practitioners must monitor both this SoP and any other SoPs that are cross-referenced, because s 11 imports their terms “as in force from time to time.”

The text of this Statement of Principles does not record any litigation history. There are no case citations, no references to judicial decisions, and no mention of prior tribunal or court determinations within the instrument itself. The SoP is a statute‑based administrative instrument; it does not include a schedule of judicial consideration or precedent.

Practical consequences of that absence. The absence of recorded litigation in the instrument means that any interpretation issues, evidentiary disputes or challenges to its application must be sought from outside sources, tribunal decisions, court judgments or agency practice notes. The SoP itself does not supply clarifying case law, nor does it attempt to catalogue contested interpretative points that have been litigated. Practitioners therefore must rely on post‑enactment decisions under the VEA and MRCA, and any relevant administrative reviews or judicial review proceedings, to build an interpretive jurisprudence.

Potential sources of dispute likely to generate litigation. Although the SoP contains no litigation history, its content identifies areas where disputes could arise and therefore where litigation or merits review might be expected. These areas include, but are not limited to:

• Application of the quantitative thresholds for “specified activities” (for example, measurement of repetitions per hour, weighting of forceful activities, determination of “average of at least 8 hours per week” and cumulative 6-month periods) (s 9(1), Schedule 1).
• Timing and causation rules, such as onset within 30 days of cessation of activities (s 9(1)) and the 24‑hour symptom onset/persistence requirements for trauma (Schedule 1).
• Interpretation of “related to relevant service” (s 10(1)), which is a statutory relational element that could be litigated in cases where exposures overlap service and non-service periods.
• The meaning and proof required for “inability to obtain appropriate clinical management” (s 9(33)), because the term is operationally vague and may depend heavily on administrative record evidence.
• How other SoPs operate when cross-referenced under s 11 and changes in those SoPs over time.

No recorded RMA or tribunal commentary in the instrument. The SoP does not include explanatory memoranda, legislative history or RMA deliberative notes other than the single declarative sentence in s 8 that the RMA is of the view, on the sound medical-scientific evidence available, that a probable relation to relevant service exists. Any further interpretive materials (RMA guidance, decision-maker practice notes, or tribunal determinations) are not included in the text provided.

Implication for advisers. Because the instrument contains no litigation history, lawyers and advocates must proactively search tribunal and court databases, and monitor decisions under the VEA/MRCA, to identify how administrative decision-makers and courts apply the SoP in practice. The SoP provides bright-line thresholds and definitions; litigation will likely test borderline applications and evidentiary sufficiency rather than the statutory validity of the SoP itself, though challenges on procedural or application grounds remain possible under the governing legislation and general administrative law.

The SoP contains multiple technical features and drafting traps that materially affect claim outcomes. These “gotchas” are concrete evidentiary and timing points; practitioners and claimants should not treat the SoP as a general medical summary but as a rules-based test with specific thresholds.

1. Quantitative exposure thresholds are strict and cumulative. For occupational exposures to qualify as “specified activities” (s 9(1), 9(17) and Schedule 1), the SoP requires, for the onset test, an average of at least 8 hours per week and a cumulative period of at least 6 months before clinical onset. The Schedule additionally demands either at least 50 bending/twisting movements per hour or 50 similar movements per hour, or force thresholds (lifting >3 kg or lifting >1 kg in excess of 10 times per hour). These numerical thresholds are precise; administrative decision-makers are likely to treat them as binary tests. Vague or unquantified task descriptions in employment records may be insufficient.

2. Cessation/recency rule. If specified activities have ceased before clinical onset or clinical worsening, the onset or worsening must have occurred within 30 days of cessation (s 9(1) and 9(17)). For exposures that ended longer ago, the occupational factor will not assist unless the temporal rule is met.

3. Trauma definition imposes narrow timing and persistence tests. “Trauma to the affected wrist or hand” is defined in the Schedule as a discrete event with symptom onset within 24 hours and persistence for at least seven days, unless intervening medical actions (immobilisation, injection, or surgery) have occurred (Schedule 1). This is narrower than casual references to “injury” and requires contemporaneous documentation of onset and persistence. If pain was masked by analgesia or the person was unconscious, symptoms must appear on return to consciousness or withdrawal of analgesia to qualify. Claims that rely on later-declared or anecdotal trauma without immediate symptom documentation risk failure.

4. Material contribution/aggravation subset applies only to pre-existing CTS. Subsections 9(17)-9(33) apply only where the person’s CTS was suffered or contracted before or during, but did not arise out of, the person’s relevant service (s 10(2)). This is a narrower remit than primary causation and must be pleaded and evidenced accordingly.

5. “Inability to obtain appropriate clinical management” as a factor for worsening. Section 9(33) lists inability to obtain appropriate clinical management for CTS as a factor for clinical worsening. The SoP offers no definition or objective threshold for what counts as “appropriate” or documentation required. This will create evidentiary debates; claimants must document attempts to access care, refusals, geographic or system barriers and the timing of such inability relative to worsening.

6. Disease definitions carry objective lab thresholds. Chronic renal failure is defined by objective GFR thresholds (<15 mL/min/1.73 m2 for at least three months) or need for renal replacement therapy, or undergoing chronic dialysis (Schedule 1). Amyloidosis, acromegaly, diabetes mellitus, gout, inflammatory arthritis and others are listed without the same numeric thresholds, but some (chronic renal failure) require specific laboratory documentation. Failure to provide GFR history or dialysis records will undermine these factor claims.

7. BMI and waist measures specified at time of onset/worsening. “Being overweight or obese” is defined as BMI ≥ 25 or waist circumference thresholds (males >94 cm, females >80 cm). The SoP requires that this factor be present “at the time of the clinical onset” (s 9(4)) or “at the time of the clinical worsening” (s 9(20)). Practically, claimants must provide contemporaneous height/weight or waist circumference records from the time of onset/worsening rather than later measurements.

8. Drug exposure windows are time-limited. Taking an aromatase inhibitor or an immune checkpoint inhibitor qualifies only if taken within the two years before clinical onset or worsening (ss 9(14)-(15), 9(30)-(31)). Pharmacy and prescribing records must therefore be tightly aligned to these windows. Post-hoc or remote drug exposures outside the two-year window will not qualify.

9. Pregnancy window narrow. The SoP lists pregnancy within the three months before clinical onset or worsening as a factor (ss 9(16), 9(32)). This requires accurate obstetric records and dates.

10. Cross‑SoP dependency. Section 11 requires that if a factor references an injury or disease covered by another SoP, then that other SoP’s factors apply “as in force from time to time” (s 11). This means a claimant relying on, say, inflammatory arthritis or chronic renal failure must ensure compliance not only with this SoP’s wording but also the current terms of the cross-referenced SoP. That creates a moving-target risk if those other SoPs are amended.

11. Death inclusion is conditional and proximate. The SoP extends to death from CTS only where a terminal event or condition was contributed to by CTS (s 7(5)). The Schedule defines “terminal event” with examples (for example, pneumonia, cardiac arrest). Practitioners must show contribution to the terminal event rather than mere incidental coexistence.

12. Lack of explicit transitional rules. The instrument repeals the 2013 SoP (s 4) and commences on a date (s 2) but does not state detailed transitional rules for events or claims that straddle the repeal and commencement dates. Practitioners must be alert to administrative guidance or the governing statutes on which SoP applies to a given claim.

13. Absence of penalty language may create inconsistent behaviour by third parties. The SoP imposes no sanctions on clinicians who do not record the specific metrics the SoP requires; that absence can create evidentiary risk for claimants. Practitioners should not assume clinicians automatically record waist circumference or GFR trends unless specifically requested.

These are not hypothetical interpretive questions; they arise directly from the SoP’s precise thresholds and definitions. The practical effect is that claim success often turns on precise contemporaneous measurement, clear timing evidence, and documentary proof that aligns with the Schedule’s objective criteria.

Compliance in the context of this SoP means assembling, preserving and presenting the documentary and medical evidence necessary to establish that at least one of the factors in s 9 exists and is related to relevant service as required by s 10(1), and where applicable ensuring the limited material-contribution/aggravation provisions of s 10(2) and ss 9(17)-(33) are properly engaged. The following practical steps derive directly from the instrument’s operative requirements and the Schedule’s definitions.

1. Identify which s 9 factor(s) are applicable early. Review the claimant’s history to see which of ss 9(1)-(33) could apply: specified activities; trauma/surgery; oedema; overweight/obesity; amyloidosis; chronic renal failure; acromegaly; gout; space-occupying lesion; haemorrhage; infection; osteoarthritis/inflammatory arthritis; diabetes mellitus; aromatase inhibitor or immune checkpoint inhibitor exposure within two years; pregnancy within three months; or inability to obtain appropriate clinical management (s 9). Pinpoint the specific factor(s) so evidence collection is targeted.

2. For occupational exposure factors, document frequency and force metrics. The Schedule requires specific numbers (for example, at least 50 bending/twisting movements per hour, or lifting >3 kg or >1 kg more than 10 times per hour, average of 8 hours/week and cumulative 6 months) (s 9(1), Schedule 1). Obtain rosters, task analyses, witness statements from supervisors/colleagues, ergonomic assessments, tool usage logs, and any workplace health and safety reports that quantify repetitions, durations and lifting weights. If activities have ceased, establish the cessation date and check the 30‑day onset proximity requirement (s 9(1)).

3. For trauma factors, secure contemporaneous medical records. The trauma definition requires a discrete event with symptom onset within 24 hours and symptom persistence for at least seven days unless specified medical interventions occurred (Schedule 1). Obtain emergency department notes, ambulance records, initial GP or hospital notes describing onset timing, analgesia records, immobilisation/splinting or surgery notes where applicable, and documentation of analgesic use or periods of unconsciousness to satisfy alternative showing rules.

4. For systemic disease factors, collect objective diagnostic and laboratory data. Chronic renal failure requires GFR values (<15 mL/min/1.73 m2 for at least three months), dialysis records, or transplant/renal replacement documentation (Schedule 1). For diabetes mellitus, amyloidosis, acromegaly and inflammatory arthritis, obtain endocrinology/haematology/rheumatology diagnostic letters, pathology reports, imaging, and treatment histories. For BMI/waist circumference, produce measurements taken at or close to the time of onset/worsening (s 9(4), Schedule 1).

5. For drug-related factors, compile prescription and pharmacy dispensing records. The SoP limits qualifying drug exposures to aromatase inhibitors and immune checkpoint inhibitors within two years before onset/worsening (ss 9(14)-(15), 9(30)-(31)). Provide prescribing dates, dispensing records, treatment cycles, and clinical notes indicating start and stop dates to meet the two-year window.

6. For pregnancy-related factors, supply obstetric records. The SoP requires pregnancy within three months before onset/worsening (ss 9(16), 9(32)). Obtain antenatal records, delivery dates, and GP or obstetrician notes indicating pregnancy status and dates.

7. Demonstrate space-occupying lesions, infection or haemorrhage with imaging/pathology. Space-occupying lesions and infections require imaging, surgical pathology, microbiology or histology evidence and specialist letters. Haemorrhage claims should be supported by coagulation profiles, haematology reports and medication histories if anticoagulants are implicated (s 9(10)).

8. For “inability to obtain appropriate clinical management”, document attempts to obtain care. Since s 9(33) contains no detailed test, preserve referrals, appointment logs, correspondence with providers, waitlist evidence, reasons for treatment denial, or proof of geographic/administrative barriers. Show timing of the inability relative to clinical worsening.

9. Establish relation to relevant service. Section 10(1) requires relation between the factor and relevant service as defined in Schedule 1. Collect service records, deployment/task listings, and links between duty tasks and exposures or events to show the factor was encountered during the relevant service categories (eligible war service, defence service, peacetime service under MRCA).

10. For pre-existing CTS cases where material contribution or aggravation is alleged, frame evidence to s 10(2). If CTS was suffered or contracted before or during but did not arise out of service, show how service materially contributed to or aggravated the condition using the factors in ss 9(17)-(33), with documentation aligned to those subsections.

11. Cross‑reference other SoPs where necessary. If any factor refers to another injury or disease covered by an SoP (s 11), identify and follow that SoP’s current terms. Obtain the relevant SoP and ensure documentary compliance with its definitions and thresholds, since s 11 imports them “as in force from time to time”.

12. Preserve contemporaneous clinical records for death claims. When death from CTS is asserted, collect terminal event documentation (for example, cause of death certificates, hospital records), and expert medical opinions linking CTS to the terminal event in a contributory manner (s 7(5) and Schedule 1’s terminal event examples).

13. Use expert medico-legal reports that map facts to the SoP. Expert clinical opinions should explicitly address whether the SoP factors are met and explain how the clinical findings, timelines, and records satisfy the precise criteria in the SoP and Schedule. Experts should reference specific subsections (for example, s 9(1) or Schedule definitions) to make their findings administratively utilitarian.

14. Maintain a chain of documentary proof. Because many definitions are numeric or time-limited (BMI, GFR, two-year drug windows, three-month pregnancy window, seven-day persistence after trauma, 30-day cessation proximity), the single best compliance measure is robust contemporaneous documentation rather than retrospective accounts.

15. Monitor changes to other SoPs and RMA guidance. Given s 11’s cross-reference to other SoPs “as in force from time to time”, compliance requires checking the current versions of any SoP implicated by s 9 factors.

Following these steps aligns practical record-gathering and medical reporting with the SoP’s strict thresholds and reduces the risk a claim will fail for evidentiary insufficiency. The SoP’s structure means that successful claims rest on meeting a prescribed list of factors and proving their relation to relevant service, so targeted evidence collection is essential.
