Statement of Principles concerning bruxism (Balance of Probabilities) (No. 8 of 2026)

The SoP advances a narrow catalogue of medical and temporal concepts that determine causation on the balance of probabilities. The central concept is bruxism, defined clinically (section 7(1)-(2)), with an express statement that, although bruxism corresponds to an ICD‑10‑AM code (G47.63 or F45.8), the statutory meaning is the definition in the instrument (section 7(2)-(3)). This resolves potential ambiguity between coding and clinical description by prioritising the instrument’s explanatory paragraph.

Causation is established using a threshold of “more probable than not” in respect of whether bruxism can be related to relevant service; this is the basis statement of the RMA grounded on available medical‑scientific evidence (section 8). Operationally, the SoP requires that at least one specified factor exist before a connection is accepted on the balance of probabilities (section 9). The factors are a mix of proximate events with tight temporal constraints, pre‑existing disease states, psychiatric comorbidity, medication exposures, a gastrointestinal diagnosis, and a health‑service access variable:

• Traumatic brain injury (moderate to severe) within 30 days before clinical onset or worsening (section 9(1)). The temporal window is explicit and narrow.
• A “clinically significant neurological condition as specified” at the time of onset or worsening, which the Schedule lists as craniocervical dystonia, Huntington’s chorea, and Parkinson disease and Secondary Parkinsonism (Schedule 1).
• An anxiety disorder at the time of onset or worsening (section 9(3)).
• Taking specified pharmacological agents at the time of onset or worsening, including amphetamines and derivatives (including methamphetamine and MDMA), antipsychotics, dexamphetamine, methylphenidate, selective serotonin reuptake inhibitors, and serotonin and noradrenaline reuptake inhibitors (section 9(4)).
• Gastro‑oesophageal reflux disease at the relevant time (section 9(5)).
• Inability to obtain appropriate clinical management for bruxism prior to clinical worsening (section 9(6)).

The SoP also distinguishes between “clinical onset” and “clinical worsening” in relation to the application of factors, and constrains the application of the “worsening” language to situations where bruxism was suffered or contracted before or during, but not arising out of, relevant service (section 10(2)). The RMA requires that any factor relied on must be related to the person’s relevant service (section 10(1)). “Relevant service” is defined in Schedule 1 to include types of eligible war service, defence service, and peacetime service under the MRCA (Schedule 1).

Death from bruxism is defined to include deaths where bruxism contributed to a terminal event or terminal condition, and the Schedule lists examples of terminal events (Schedule 1). The Schedule also defines craniocervical dystonia and repeats cross references to MRCA and VEA (Schedule 1).

Finally, the instrument contains an instrument‑level statement that it applies to claims to which s120B of the VEA or s339 of the MRCA apply (section 5), thereby tying the SoP to specific statutory claim processes and decision points.

The SoP governs adjudication of claims by people (or their estates) who assert that bruxism, or death from bruxism, is connected with their relevant service. The instrument explicitly applies to claims to which section 120B of the VEA or section 339 of the MRCA apply (section 5). Those statutory references identify the decision contexts in which the SoP provides the medical causation framework that will be applied by decision‑makers assessing entitlement.

Stakeholders directly affected include:

• Claimants: veterans and former members of the defence forces, and their dependants or estates where death is alleged to have been contributed to by bruxism. For death claims, the instrument’s definition of death from bruxism extends to terminal events contributed to by bruxism (section 7(4); Schedule 1).
• Medical assessors and clinicians who provide evidence in claims: the SoP prescribes diagnostic criteria and lists qualifying comorbid conditions and exposures (sections 7 and 9; Schedule 1). Clinicians are required to supply medical evidence that aligns with the temporal and diagnostic thresholds the SoP sets.
• Decision makers and administrators within the Department and other agencies who apply the VEA and MRCA: they must apply the SoP’s factors and interpretative definitions when determining causal connection under the relevant claim provisions (sections 3 and 5).
• Legal representatives and advocates who prepare claims: they must marshal evidence (medical records, diagnostic codes, medication histories, operational/in‑service records) that shows a listed factor existed and that the factor was related to the claimant’s relevant service (section 10).

Indirectly affected parties include treating providers and hospitals where evidence will be sought to establish the narrow temporal windows (for example a moderate to severe traumatic brain injury within 30 days before onset or worsening, section 9(1)) and to document exposure to specified drugs at the time of onset or worsening (section 9(4)). The Schedule’s definition of “clinically significant neurological condition as specified” limits which neurological diagnoses satisfy that factor to three named conditions (Schedule 1), narrowing the class of neurological comorbidity that can be relied upon.

The instrument does not itself create new benefits or payments; it functions as an evidentiary and causation rule within the statutory framework of the VEA and MRCA. The RMA’s statement that the SoP is based on the sound medical‑scientific evidence available and that it is of the view that it is more probable than not that bruxism and death from bruxism can be related to relevant service (section 8) is a policy position informing adjudication; however, who benefits in monetary or service terms depends on determinations made under the VEA or MRCA using this SoP.

The instrument does not itself impose criminal sanctions or statutory duties on private individuals. Instead, it establishes prescribed evidentiary and causal criteria that administrative decision makers must apply when considering claims under the VEA and MRCA. Key operative legal effects and the attendant rights and duties are as follows, grounded in the instrument text.

Duties on decision makers and medical assessors:

• Apply the SoP when adjudicating claims to which s120B VEA or s339 MRCA apply (section 5). The SoP is made under the authority of subsection 196B(3) of the VEA (section 3), and therefore functions as the RMA’s statutory statement of medical causation to inform administrative decisions.
• Require that at least one of the specified factors in section 9 exist before concluding, on the balance of probabilities, that bruxism or death from bruxism is connected with a person’s relevant service (section 9). Decision makers must therefore examine evidence against each listed factor.
• Ensure that any factor relied upon is related to the person’s relevant service (section 10(1)). The duty here is procedural: to establish a nexus between the factor and service.

Rights and evidentiary positions for claimants:

• The claimant has the right to have their bruxism or death from bruxism claim considered under the SoP framework. If the claimant establishes that a listed factor existed and that the factor is related to relevant service, the SoP supports a finding of causal connection on the balance of probabilities, subject to the statutory entitlement provisions of the VEA or MRCA.
• Where clinical worsening is alleged, claimants can rely on the “clinical worsening” aspect of factors only if their bruxism was suffered or contracted before or during, but did not arise out of, relevant service (section 10(2)). This creates a specific evidentiary route for pre‑existing bruxism that has been aggravated by service.

Implicit procedural consequences:

• Medical evidence must be specific to the definitions and temporal requirements in the SoP. For example, to rely on the traumatic brain injury factor, evidence must establish moderate to severe TBI and a temporal window of within 30 days before clinical onset or worsening (section 9(1)). For medication exposure, records must show use of one or more specified categories at the time of onset or worsening (section 9(4)). For neurological conditions, the diagnosis must be one of the three listed in Schedule 1.
• Where a factor refers to an injury or disease covered by another SoP, the other SoP’s terms apply (section 11). That introduces a duty on decision makers to cross‑reference other SoPs and apply their terms where relevant.

No private‑law rights or statutory remedies are created by the SoP itself beyond its role in administrative entitlement decisions under the VEA and MRCA. The instrument does not provide for review mechanisms inside the instrument text; rights to review or appeal will arise under the substantive provisions of the VEA and MRCA and their procedural regimes, not within the SoP itself. The SoP therefore shapes rights to entitlement by specifying what medical and temporal evidence will establish causal connection for the purpose of those statutes.

The Statement of Principles does not create direct criminal or civil penalties, nor does it set out enforcement mechanisms inside the instrument text. Its operation is administrative and evidentiary: the RMA issues the SoP under statutory power (subsection 196B(3) of the VEA, section 3) to guide decision makers assessing claims under the VEA and MRCA (section 5). Enforcement of the SoP’s standards occurs through administrative application in claims processing, not through sanctions proscribed by this instrument.

Concrete enforcement consequences flow from administrative determinations under the VEA and MRCA. If decision makers apply the SoP and find that none of the specified factors (section 9) are established, then the claimant will not meet the SoP’s test for service connection for bruxism as a causal diagnosis. That outcome has practical consequences: potential denial of entitlement, associated benefits, or health care supports that derive from a successful link being established under the VEA or MRCA. Those entitlement consequences, including any rights of internal review, merits review, or judicial review, are governed by the VEA, the MRCA, and their associated review regimes rather than by the SoP.

The instrument itself contains no penalty provisions for misleading evidence, nor does it require notification, registration, inspection, or auditing by the RMA. The SoP prescribes medical criteria and definitions; compliance and enforcement in practice will rely on the decision‑making machinery of the Department and judicial or merits review channels available under the primary statutes.

Because the SoP incorporates factors that refer to other Statements of Principles (section 11), enforcement of those linked factors will involve application of the other SoPs “as in force from time to time”, which may change the evidentiary landscape for particular factors over time. Where factors refer to other SoPs, decision makers effectively enforce a chain of evidentiary standards: the presence or absence of a factor may be judged by reference to another instrument’s terms, and any dispute about that application will be resolved within the statutory administrative review framework.

In short, the SoP is an adjudicative standard, not an enforcement statute. The “sanction” for non‑satisfaction of the SoP’s factors is administrative denial of causal connection and consequent ineligibility for statutory entitlements under the VEA and MRCA. Any consequences beyond that (for example appeals or judicial review) derive from the primary Acts and not from the SoP itself.

The instrument is explicitly designed to operate within and to inform determinations made under two primary statutes: the Veterans' Entitlements Act 1986 (VEA) and the Military Rehabilitation and Compensation Act 2004 (MRCA). It is made under subsection 196B(3) of the VEA (section 3), applies to claims to which s120B of the VEA or s339 of the MRCA apply (section 5), and defines “relevant service” by reference to types of service under the VEA and MRCA in Schedule 1. That situates the SoP as an evidentiary annex to those Acts rather than an independent legislative regime.

Cross‑instrument references and interactions:

• Other Statements of Principles: Section 11 expressly requires that if a factor in this SoP refers to an injury or disease covered by another SoP, then the factors in that other SoP apply according to their terms as in force from time to time. This creates a legal interplay where determination of a factor may depend on a separate SoP’s definitions and thresholds, obliging decision makers to cross‑apply instruments and to track their current versions.
• ICD‑10‑AM diagnostic coding: Section 7(3) references the International Statistical Classification of Diseases and Related Health Problems, Tenth Revision, Australian Modification (ICD‑10‑AM), Tenth Edition, effective 1 July 2017, and notes the applicable codes for bruxism. The instrument clarifies that the statutory meaning of bruxism is the definition in subsection 7(2) and not merely the ICD code (section 7(2)-(3)); nevertheless, the ICD reference links the SoP to widely used diagnostic coding for interoperability with clinical records, hospital classifications and aggregated health data. The SoP’s reliance on a particular edition of ICD‑10‑AM (noted in section 7(3)) may matter for interpretation of historical records that use different coding editions.
• VEA and MRCA procedural regimes: The SoP does not repeat or displace procedural appeal or review rights contained in the VEA or MRCA. Instead, it supplies medical causation criteria for the decision processes those Acts establish. Any procedural consequences of a SoP‑based determination, such as internal reconsideration, merits review, or judicial review, remain subject to the review mechanisms in the primary legislation and associated regulations and policy instruments.
• Interaction with treatment standards and health law: The SoP includes “inability to obtain appropriate clinical management for bruxism before clinical worsening” as a factor (section 9(6)). That factor embeds a health‑service access element into causation assessment. Determination of that factor will require evidence about availability or adequacy of clinical management, which may intersect with health administrative records, public health policy, or private medical care records. The SoP does not define what constitutes “appropriate clinical management”; this will require fact‑specific clinical evidence and potentially reference to standards of care external to the SoP.
• Other statutory definitions: Schedule 1 defines terminal event and repeats MRCA and VEA acronyms. Those definitions will interact with death certification and coronial records where death claims are made. The SoP’s list of terminal events (for example pneumonia, respiratory failure, cardiac arrest) guides how death from bruxism is linked to an ultimate or proximate cause under the VEA/MRCA claim processes.

Finally, the instrument’s repeal of the earlier 2016 SoP (section 4) creates a temporal interaction: decision makers must apply this current SoP to claims after commencement (section 2), and if previous decisions were made under the 2016 instrument, their evidentiary basis may differ. The instrument does not state transitional arrangements beyond repeal, so application to historic claims will follow the primary statutes’ administrative rules for instrument application and transitional decision practice.

The instrument itself records only a small body of immediate amendment history and provenance. It is the Statement of Principles concerning bruxism (Balance of Probabilities) (No. 8 of 2026), dated 19 December 2025 and commencing 19 January 2026 (sections 1 and 2). It is made under subsection 196B(3) of the Veterans' Entitlements Act 1986 (section 3). The instrument expressly repeals the previous Statement of Principles concerning bruxism (Balance of Probabilities) (No. 92 of 2016) (Federal Register of Legislation No. F2016L01671) which had been made under the same subsection of the VEA (section 4).

The Schedule makes an edition‑specific reference to the ICD‑10‑AM classification: “Tenth Edition, effective date of 1 July 2017” (section 7(3) and note). That cross‑reference embeds an editorial link to a particular health classification edition, which can be relevant where diagnostic coding is used as documentary evidence. The instrument does not itself record prior amendments beyond the single repeal of the 2016 SoP. It does not print a list of superseded modifications or prior versions apart from the 2016 instrument it replaces.

No further amending instruments, legislative history, explanatory memoranda or transitional provisions are included within the text provided. Therefore, the amendment history contained in this instrument is limited to:

• Issuance date: 19 December 2025 (cover page and signature block).
• Commencement date: 19 January 2026 (section 2).
• Repeal of the 2016 SoP: section 4.
• Authoritative link to ICD‑10‑AM Tenth Edition: section 7(3).

Because the instrument is an RMA SoP issued under the VEA, subsequent changes to the RMA’s statements are typically achieved by the RMA publishing a new or replacement SoP under the same statutory power. Any later amendment or repeal will appear in subsequent instruments and in the Federal Register of Legislation. The text provided contains no further amendment timeline or staged changes, and does not indicate transitional arrangements for claims that straddle the repeal and commencement dates; decisions about which instrument applies to specific claims will be governed by the procedural rules and administrative practice in the VEA and MRCA environments, which are not reproduced in this instrument.

The instrument contains no case law or references to judicial decisions. The text does not mention any litigation, appeals, tribunal determinations, or judicial consideration of the previous or current Statement of Principles. As such, there is no litigation history recorded within this SoP itself.

Practically, the absence of litigation references means that this SoP stands as the RMA’s current medical‑scientific statement on bruxism without recorded judicial interpretation in the instrument text. That implies two immediate points relevant to advisers and decision makers:

• No precedent recorded in the instrument: The SoP does not identify how courts or tribunals have interpreted the listed factors or applied the SoP in contested cases. Any legal argument about the scope, interpretation or application of this SoP must therefore proceed from the instrument’s language, the primary statutes, administrative practice, and any external case law not cited here. The instrument text does not supply examples or interpretive guidance based on litigation.
• Potential for future challenge: Because no litigation history is included, the contours of judicial review or merits review about the SoP’s definitions, temporal windows or the meaning of terms such as “appropriate clinical management” are not settled by the instrument. Claimants and respondents may still litigate these issues under the VEA or MRCA frameworks, but the SoP does not report any such outcomes.

For advisers preparing claims or appeals, the SoP should be treated as the operative RMA medical standard while recognising that its terms may be subject to administrative and judicial interpretation in future proceedings. Any past tribunal or court decisions that have considered bruxism under earlier SoPs or other medical‑causation contexts are not cited in this instrument; practitioners must search external databases and the primary statutes’ review records for judicial or tribunal treatment not recorded in the SoP.

The SoP contains a number of technical features and drafting choices that can be material in claims practice. These are not evaluative judgments but concrete points where evidence, timing and interpretation will determine outcomes.

1. Narrow, enumerated factors , at least one required (section 9). The SoP does not allow a holistic causation assessment outside the listed factors. For a claimant to establish service connection on the balance of probabilities, evidence must show one or more of the enumerated factors. If evidence does not support any listed factor, the SoP offers no alternative pathway to causal connection in bruxism claims.

2. Tight temporal windows for traumatic brain injury (section 9(1)). The TBI factor requires a moderate to severe traumatic brain injury within 30 days before clinical onset or worsening. The 30‑day window is explicit. Absence of documentation pinpointing the temporal relation will be consequential.

3. Limited neurological diagnoses qualify (Schedule 1). “Clinically significant neurological condition as specified” is limited to craniocervical dystonia, Huntington’s chorea, and Parkinson disease and Secondary Parkinsonism. Common neurological diagnoses outside this list do not satisfy this factor even if causally plausible in clinical practice.

4. Medication list is specific and broad categories mix unique agents (section 9(4)). The list includes amphetamines and derivatives (including illicit agents like methamphetamine and MDMA), antipsychotics, dexamphetamine, methylphenidate, SSRIs, and serotonin and noradrenaline reuptake inhibitors. Evidence must show use of one or more of these agents at the time of clinical onset or worsening. Practitioners should note that some categories partially overlap (for example amphetamines and dexamphetamine), so documentation should be precise about timing and agent.

5. “Inability to obtain appropriate clinical management” is a non‑technical access factor (section 9(6)). The SoP includes lack of access to appropriate clinical management as a permissible factor. The instrument does not define “appropriate clinical management”, so claimants must provide evidence establishing both the inadequacy or unavailability of management and a causal link to clinical worsening. This raises evidentiary complexity because it draws on health‑service availability and standard‑of‑care questions outside narrow diagnostic facts.

6. Relationship to relevant service required (section 10(1)). Every factor relied upon must be related to the person’s relevant service. It is not sufficient merely to establish a listed factor in the abstract; claimants must tie that factor to eligible war service, defence service, or peacetime service as defined in the Schedule.

7. Limits on “clinical worsening” (section 10(2)). The “clinical worsening” pathway applies only if the bruxism was suffered or contracted before or during, but did not arise out of, relevant service. That limits the ability of claimants to use the worsening pathway where bruxism arose out of service in the first instance. Careful pleading and evidence about onset timing relative to service will be required.

8. Death definition includes contribution to terminal events (section 7(4); Schedule 1). For death claims, bruxism need only have contributed to a terminal event (for example pneumonia, respiratory failure, cardiac arrest). Proof of contribution may require expert evidence linking the bruxism to the terminal event sequence.

9. ICD‑10‑AM is referenced but not controlling (section 7(2)-(3)). The SoP notes associated ICD codes but states that the statutory meaning is the given clinical definition. Reliance on coding in isolation is insufficient; medical evidence must address the clinical definition and the SoP’s factors.

10. Repeal of prior SoP (section 4) and no transitional text. The repeal of the 2016 SoP is recorded but no transitional provisions are included in this instrument. Practitioners handling claims across the repeal/commencement boundary should confirm applicable administrative practice for transitional cases under the VEA/MRCA.

11. Absence of definition for some terms. Terms such as “appropriate clinical management” and “moderate to severe traumatic brain injury” are not further defined in the instrument text. That will necessitate clinical and expert evidence to interpret those thresholds in fact‑specific ways.

12. Dependency on other SoPs (section 11). Where a factor refers to an injury or disease covered by another SoP, that other SoP’s terms apply. This introduces an administrative complexity of cross‑referencing current SoPs and ensuring the version applied is in force at the relevant time.

These are practical evidentiary and interpretive traps that advisers and decision makers must navigate. They are not legal objections to the instrument; they are places where claim success will turn on precise documentary, clinical and temporal evidence that aligns with the SoP’s wording.

Compliance, in this context, means preparing or adjudicating a claim in a way that aligns evidence with the SoP’s requirements so that a decision maker can find, on the balance of probabilities, that bruxism or death from bruxism is related to relevant service. The SoP prescribes what must be shown; compliance requires focused documentation, timing precision, and cross‑referencing other SoPs where relevant.

Evidence to gather and present (mapped to sections):

• Establish diagnosis of bruxism using the SoP’s clinical definition (section 7(1)-(2)). Clinical notes should describe repetitive, involuntary clenching or grinding of the teeth or bracing or thrusting of the mandible, and specify whether manifestations occurred during wakefulness or sleep. While ICD‑10‑AM codes may assist, the claimant must provide clinical descriptions that correspond to subsection 7(2), not merely a diagnostic code (section 7(2)-(3)).

• For traumatic brain injury factor (section 9(1)):

  • Obtain and produce contemporaneous hospital and neurology records documenting the TBI and its severity classification as moderate to severe.
  • Produce incident reports, service records, or operational reports showing timing of injury.
  • Link the TBI event to the clinical onset or worsening of bruxism within the 30‑day window.

• For “clinically significant neurological condition as specified” (Schedule 1):

  • Provide specialist neurological diagnoses and supporting investigations for craniocervical dystonia, Huntington’s chorea, or Parkinson disease/Secondary Parkinsonism.
  • Include expert opinions explaining how the specified neurological diagnosis relates to bruxism onset or worsening at the relevant time.

• For anxiety disorder (section 9(3)):

  • Supply psychiatric or general practice records confirming a diagnosis of an anxiety disorder at the time of clinical onset or worsening, with dates and treatment notes.

• For medication exposures (section 9(4)):

  • Produce prescription records, pharmacy dispensing records, hospital medication charts and treating clinician notes confirming use of listed agents at the time of onset or worsening. Specify exact dates and dosages where possible.
  • Where illicit substances are implicated (for example methamphetamine, MDMA under section 9(4)(a)), supply forensic, police, treatment or clinical records that support exposure timing.

• For gastro‑oesophageal reflux disease (section 9(5)):

  • Provide gastroenterology records, diagnostic testing (for example endoscopy reports) and treating clinician notes showing the presence of GORD at the time of clinical onset or worsening.

• For inability to obtain appropriate clinical management (section 9(6)):

  • Compile contemporaneous correspondence, referral records, waiting lists, refusals, health service denial notes, or treating clinician statements that document attempts to obtain care and reasons why "appropriate clinical management" was unavailable or not provided.
  • Provide expert evidence linking the absence of appropriate management to clinical worsening.

• For death claims (section 7(4) and Schedule 1):

  • Provide death certificate, coronial findings where applicable, and medical records that document the terminal event and link bruxism as contributing to that event.
  • Obtain an expert medico‑legal report that explains causal contribution from bruxism to the terminal event listed in Schedule 1.

Procedural and strategic steps:

• Tie every factor to relevant service (section 10(1)). For each medical fact, supply documentary evidence from service records, deployment logs, incident reports, or medical boards that explain how the factor arose from or was related to the claimed period of relevant service as defined in Schedule 1.

• Address the “clinical worsening” limitation (section 10(2)). If relying on clinical worsening, ensure the claim establishes that bruxism was suffered or contracted before or during relevant service and that the worsening did not arise out of service. Provide pre‑service or in‑service clinical records showing pre‑existing bruxism.

• Cross‑reference other Statements of Principles where a factor points to another injury or disease (section 11). Identify any linked SoPs and ensure evidence meets the terms of those SoPs as they are in force.

• Use expert reports to interpret undefined thresholds. Terms such as “moderate to severe traumatic brain injury” and “appropriate clinical management” require clinical interpretation. Obtain contemporaneous specialist and expert opinions that apply accepted clinical definitions and link them to the SoP thresholds.

• Be precise on timing. The SoP uses specific temporal language (for example “within the 30 days before clinical onset or clinical worsening” for TBI, section 9(1)) so evidence should include dates and show temporal proximity.

• Keep documentation consistent with the SoP’s clinical definition rather than relying solely on diagnostic coding (section 7(2)-(3)). Provide narrative clinical descriptions supported by test results, clinician notes and specialist assessments.

• Prepare to address availability of medical records across time. The ICD‑10‑AM reference (section 7(3)) suggests clinical records may use coding systems. Where records use older or different versions of coding, supply clinical notes to demonstrate equivalence to the SoP definition.

• For adjudicators: where a factor is said to refer to another disease covered by a different SoP, ensure the correct, current version of that SoP is applied and that any temporal or definitional variations are accounted for (section 11).

Administrative considerations:

• Confirm which SoP applies to the claim given the commencement date (section 2) and the repeal of the prior instrument (section 4). Where claims straddle the repeal/commencement, verify departmental guidance about which SoP is applied to the specific filing date or treatment period.

• Anticipate requests for further information. Because the SoP leaves certain thresholds undefined, decision makers should request targeted clinical evidence or expert opinion rather than general statements.

• For legal representatives: structure submissions to map discrete pieces of evidence to the specific numbered factors in section 9 and to the requirement that the factor be related to relevant service (section 10(1)). Use sequential fact tables that show date, evidence, source, and nexus to service.

Following this approach aligns evidentiary preparation with the SoP’s text and helps decision makers apply the precise factors and definitions the instrument sets out.
