Statement of Principles concerning benign prostatic hyperplasia (Balance of Probabilities) (No. 14 of 2025)

The statement relies on a small set of tightly defined concepts. First, the medical object is “benign prostatic hyperplasia” defined narrowly as benign hyperplasia of prostate glandular and stromal tissue causing potential obstruction of urine outflow; it excludes prostate cancer, overactive bladder, and prostatitis (subsection 7(2)). The instrument notes the ICD‑10‑AM code N40 corresponds to BPH but makes the statutory meaning the subsection’s text, not the coding alone (subsections 7(3)-(4)). That removes any ambiguity that might arise if a health record used ICD coding inconsistent with the textual exclusion list.

Second, causation is expressed on the civil standard: more probable than not. The RMA records that, based on the medical‑scientific evidence it considered, it is of the view that BPH and death from BPH “can be related” to relevant service on the balance of probabilities (section 8). The SoP therefore functions as a medical guideline for decision‑makers applying that standard to claims.

Third, the instrument identifies a single determinative factor: inability to obtain appropriate clinical management for BPH before clinical worsening (section 9). The phrase combines two elements: a lack of access to or provision of appropriate clinical management, and a temporal element “before clinical worsening.” The instrument does not define “appropriate clinical management” in the Schedule, so the term remains a practical threshold that will require evidentiary work in individual claims. The temporal phrase means the inability must precede a stage of clinical worsening; the SoP does not further define “clinical worsening,” leaving that assessment to clinical evidence in each claim.

Fourth, the relation to service is constrained. The factor must be causally linked to the person's “relevant service” as defined in Schedule 1: eligible war service (other than operational service) or defence service (other than hazardous service and British nuclear test defence service) under the VEA, or peacetime service under the MRCA (Schedule 1 definition of “relevant service”). The SoP also limits application to cases where the BPH was “suffered or contracted before or during (but did not arise out of) the person's relevant service” and then materially contributed to, or aggravated, the condition (section 10(2)). In other words, this SoP addresses material contribution or aggravation arising from lack of access to management in service for pre‑existing or pre‑service conditions, rather than conditions that arose out of service.

Fifth, death is tied to the concept of a terminal event contributed to by BPH. The SoP treats death from a terminal event or condition that was contributed to by BPH as included (subsection 7(5)). The Schedule defines terminal events concretely (pneumonia, respiratory failure, cardiac arrest, circulatory failure, cessation of brain function), which anchors the death linkage in identifiable proximate causes.

Finally, the instrument permits cross‑reference to other Statements of Principles. If a factor in this SoP refers to an injury or disease covered by another SoP determined under subsection 196B(3) of the VEA, the other SoP’s factors apply “in accordance with the terms of that Statement of Principles as in force from time to time” (section 11). That creates a mechanism for layered factual and medical causation issues where comorbidities or related conditions are the subject of separate SoPs.

These are the core legal and medical constructs the instrument creates. Several of them (notably “appropriate clinical management” and “clinical worsening”) are open to evidentiary elaboration in claims because the instrument does not provide technical definitions, thereby delegating assessment of those concepts to medical evidence and decision‑makers applying the SoP.

The SoP is expressly framed to affect persons making claims under particular statutory provisions: those claims to which section 120B of the VEA or section 339 of the MRCA applies (section 5). The instrument itself does not enumerate the universe of claimants; it confines its application to the statutory claim processes these provisions govern. The Schedule defines “relevant service” and thus limits the population for whom the SoP can be applied: eligible war service (excluding operational service), defence service (excluding hazardous service and British nuclear test defence service) under the VEA, and peacetime service under the MRCA (Schedule 1 definition of “relevant service”).

Practically, the primary affected group is people who have benign prostatic hyperplasia (as defined in subsection 7(2)) and who assert a nexus between that condition or death from it and their relevant service. The instrument also affects decision‑makers who adjudicate these claims because it sets the medical framework and the single determinative factor that must be established for service connection. The RMA as the instrument maker is affected in its statutory function , it replaces the 2016 SoP (section 4) and thereby changes the medical guideline it supplies to claim adjudicators (section 3).

Other actors are indirectly affected. Where claimants rely on the factor of “inability to obtain appropriate clinical management before clinical worsening” (section 9), evidence about service arrangements, access to medical care during relevant service, record‑keeping by military medical services, and medical practitioners’ notes will become relevant. The SoP’s exclusions (malignant neoplasm of the prostate, overactive bladder, prostatitis) mean that persons whose primary diagnoses are those conditions will not be captured by this SoP; their claims will need to rely on other medical definitions or SoPs.

Because the SoP treats death from BPH as death from a terminal event or condition that was contributed to by BPH (subsection 7(5)), families or estates seeking entitlements in respect of death where one of the specified terminal events is noted (for example, pneumonia) may have claims that engage this SoP if there is evidence that BPH contributed to the terminal event.

Finally, the cross‑reference mechanism (section 11) means claimants with co‑existing injuries or diseases that are the subject of other SoPs will be affected insofar as those other SoPs’ factors become relevant to the decision. The SoP therefore has a bounded but significant operational impact on claimants with BPH, decision‑makers assessing service connection, and medical evidence providers who must speak to “appropriate clinical management” and “clinical worsening” in a service context.

The instrument itself is not a statute conferring payable entitlements; rather it is a medical guidance instrument used under VEA/MRCA claim provisions. It sets requirements that must be established for a finding of service connection on the balance of probabilities. The key legal duties and rights that flow from the instrument are therefore functional and evidentiary rather than regulatory obligations in the administrative law sense.

Duty to establish the specified factor: The core requirement is that the claimant must establish the presence of the factor set out in section 9 , an “inability to obtain appropriate clinical management for benign prostatic hyperplasia before clinical worsening.” The instrument states this as a prerequisite: “The following factor must exist before it can be said that, on the balance of probabilities, benign prostatic hyperplasia or death from benign prostatic hyperplasia is connected with the circumstances of a person's relevant service” (section 9). This imposes an evidentiary duty on the claimant to produce medical and service evidence that demonstrates both inability to obtain appropriate management and that this inability preceded clinical worsening.

Duty to connect the factor to relevant service: Section 10(1) requires that the existence of the factor be “related to the relevant service rendered by the person.” That imposes a second linkage duty , not only must the factor exist factually, the causal origin or nexus of the factor must be traceable to the claimant’s relevant service. The Schedule’s definition of “relevant service” (Schedule 1) sets the legal categories of service that can ground this connection.

Limitation on the kinds of contribution covered: Section 10(2) further narrows application: the factor “applies only to material contribution to, or aggravation of, benign prostatic hyperplasia where the person's benign prostatic hyperplasia was suffered or contracted before or during (but did not arise out of) the person's relevant service.” Thus there is a rights/duties split: for persons whose BPH arose out of service, this SoP’s factor does not apply for material contribution/aggravation claims; the claimant’s right to rely on this factor is therefore limited to specified temporal and causal scenarios. The instrument does not create a duty on providers or the Crown to provide care; rather it records a factual scenario that, if proven, supports a causal link for entitlements under the statutes identified in section 5.

Rights to have other SoPs applied where relevant: Section 11 establishes a procedural or evidentiary right: where a factor in this SoP refers to an injury or disease covered by another SoP, the factors in that other SoP will apply “in accordance with the terms of that Statement of Principles as in force from time to time.” In practice, that means a claimant has the right to rely on other SoPs’ factors where relevant comorbidities or contributing conditions are covered elsewhere, and decision‑makers must apply those other SoPs to the extent they are engaged.

RMA’s declaratory role and evidentiary caution: Section 8 records the RMA’s view that, on the available medical‑scientific evidence, it is “more probable than not” that BPH and death from BPH can be related to relevant service. That does not itself grant an entitlement; it is a guidance statement that shapes how decision‑makers apply the balance of probabilities. The RMA’s declaration functions as a starting point for claim assessment, but the claimant retains the burden to establish the specific factor(s) and the link to relevant service in their case.

No operational duty to pay, no procedural prescriptions: The instrument does not itself specify entitlements, payment mechanisms, or administrative procedures for lodging or determining claims. Those rights and duties are governed by the VEA and MRCA sections identified in section 5. This SoP supplies the medical criteria that must be considered within those statutory frameworks.

In sum, the SoP creates evidentiary duties for claimants to demonstrate the single enumerated factor and its relation to defined categories of relevant service, while providing a right to have cross‑referenced SoPs applied where appropriate. The instrument does not itself impose operational duties to provide care or pay benefits; it is a rule about how medical causation is to be assessed in the statutory claim processes.

The instrument is a Statement of Principles and does not itself create criminal offences, civil penalties, or an enforcement regime. It is a statutory medical guideline used under subsection 196B(3) of the VEA (section 3) to inform determinations about whether a condition is connected with relevant service for claims under the VEA and MRCA (section 5). The instrument contains no penal provisions, no regulatory sanctioning powers, and no administrative penalties.

Enforcement in practical terms occurs through the decision‑making processes of the agencies and tribunals that adjudicate VEA and MRCA claims. The SoP provides the medical criteria and the factual factor(s) that must be considered; compliance with those criteria is assessed by decision‑makers applying the VEA and MRCA statutory frameworks. Section 11 provides for application of other SoPs where a factor refers to an injury or disease covered by another SoP, which effectively enforces consistency across medical guidance instruments insofar as decision‑makers are to apply the relevant SoPs “as in force from time to time.”

There is no provision in the instrument for administrative review or appeal specific to the SoP itself. Any challenge to decisions that rely on this SoP would be brought under the review mechanisms established by the VEA, MRCA or associated administrative law and merits review processes. The SoP does not specify evidentiary standards beyond the balance of probabilities statement in section 8; it does not prescribe the types of documentary proof required, nor does it set out time limits, disclosure obligations, or enforcement mechanisms against practitioners or the Department.

Because the instrument repeals the 2016 SoP (section 4), its enforcement effect is that decision‑makers must apply this SoP from its commencement date (section 2) in lieu of the 2016 text. That replacement is an administrative change with legal effect; decisions made after commencement should be informed by this instrument. There is no transitional or savings clause in the text supplied that preserves prior determinations or addresses how decisions in progress are to be handled. The absence of explicit transitional provisions means adjudicators will need to determine how to apply the new SoP in ongoing matters in accordance with the VEA/MRCA procedures (the instrument does not itself dictate the approach).

In short, there are no direct penalties or enforcement tools embedded in the instrument; its operational enforcement is through its use by adjudicators and the statutory review channels available under the VEA and MRCA to contest decisions that rely on it.

The SoP is expressly made under and for use in the context of the Veterans' Entitlements Act 1986 (VEA) and the Military Rehabilitation and Compensation Act 2004 (MRCA). Section 3 records that the instrument is made under subsection 196B(3) of the VEA, and section 5 states it applies to claims “to which section 120B of the VEA or section 339 of the MRCA applies.” It therefore interacts with the substantive and procedural rules in those Acts that govern the assessment, acceptance or rejection of claims and consequent entitlements. The SoP itself does not restate those statutory procedural rules; instead it supplies an evidentiary and medical template to be applied within the statutory decision‑making frameworks.

The Schedule defines “relevant service” in terms that cross‑reference the VEA and MRCA categories (Schedule 1). Because the SoP limits its application to specific categories of service , eligible war service (other than operational service), defence service (other than hazardous service and British nuclear test defence service) under the VEA, and peacetime service under the MRCA , it interacts materially with how those Acts define service categories and eligibility. Adjudicators must therefore apply the service definitions in the parent statutes in tandem with the SoP’s requirements.

Section 11 establishes an explicit interaction mechanism with other Statements of Principles made under subsection 196B(3) of the VEA: if a factor in this SoP refers to an injury or disease for which another SoP exists, “the factors in that Statement of Principles apply in accordance with the terms of that Statement of Principles as in force from time to time.” That provision creates a layered legal architecture: where medical causation involves multiple conditions, decision‑makers must consult and apply the relevant SoPs together according to their own terms. This can lead to cumulative or overlapping evidentiary obligations depending on how the various SoPs define factors and exclusions.

The instrument’s definition of death from BPH depends on the concept of a terminal event (Schedule 1). Terminal events are enumerated (pneumonia, respiratory failure, cardiac arrest, circulatory failure, cessation of brain function). Where a terminal event is otherwise the subject of medical or legal consideration (for example, where coronial determinations or other statutes apply), this SoP supplies a medical linkage rule to the VEA/MRCA claims process; it does not displace coronial findings or other legal processes but will be used by decision‑makers in the context of entitlement claims.

There is no provision in the instrument that amends or modifies other Acts directly; it operates as a subordinate medical guideline within the statutory architecture. It repeals the earlier 2016 SoP (section 4), which means that interactions previously governed by that SoP are now governed by this instrument. How tribunals or courts weigh the RMA’s views recorded in section 8, or apply the narrowly framed factor in section 9, will depend on the interplay between the SoP and the evidentiary and legal standards in the VEA and MRCA; those broader interactions are governed by the parent statutes and internal agency practice rather than by any provision within the SoP itself.

In summary, the SoP is a medical guideline instrument that must be read and applied alongside the VEA and MRCA, the statutory definitions of relevant service, any other SoPs that are engaged, and the administrative procedures and review channels those Acts provide.

This instrument is dated 17 December 2024 (cover page) and commences on 28 January 2025 (section 2). It expressly repeals the Statement of Principles concerning benign prostatic hyperplasia (Balance of Probabilities) (No. 18 of 2016) (Federal Register of Legislation No. F2016L00242) made under subsection 196B(3) of the VEA (section 4). The instrument therefore supersedes the 2016 SoP from the commencement date.

Beyond that, the text provided contains no other amendment history entries, no transitional provisions, and no savings clauses. There are no provisions that amend the VEA or MRCA themselves; the instrument is made pursuant to subsection 196B(3) of the VEA and is an exercise of the RMA’s power to determine Statements of Principles. The Schedule contains the current definitions used in the instrument; any future amendments to this SoP would be effected by the RMA in a subsequent instrument and would themselves replace this text by being registered and commencing under the relevant statutory process.

Because the instrument contains an explicit repeal of the 2016 instrument, the amendment history is clear at least in this instance: 2016 SoP revoked, 2025 SoP in force from 28 January 2025. The document does not record earlier antecedent SoPs or a sequence of prior amendments beyond the single repeal. No procedural detail is provided about how or when the RMA reviewed the evidence or what aspects of the 2016 instrument were changed. The instrument’s section 8 records the RMA’s view "on the sound medical‑scientific evidence available" but does not set out that evidence or any consulting timetable.

There is no clause preserving decisions made under the 2016 SoP, nor is there any explicit transition mechanism in the text supplied. In practical administration, decision‑makers applying the VEA and MRCA will need to determine whether decisions made before commencement remain valid or whether new decisions should apply this SoP; the instrument itself does not direct how to treat such matters. Any future amendment to this instrument would similarly need to be made under subsection 196B(3) and would replace the current text when it commences; the instrument gives no limit on amendment frequency or content.

In short, the amendment history recorded in the instrument is limited: (1) the 2016 SoP is repealed by this instrument, and (2) this instrument takes effect from 28 January 2025. No further amendment text or history is supplied in the document provided.

The instrument text supplied contains no litigation history. It does not cite, refer to, or summarise any judicial or tribunal decisions, nor does it identify any cases that have considered the earlier 2016 SoP or the content of this SoP. The document is a standalone instrument made by the Repatriation Medical Authority under subsection 196B(3) of the Veterans' Entitlements Act 1986; it sets out the RMA’s view based on “sound medical‑scientific evidence available” (section 8) but does not record any litigation or appeals that influenced its content.

Because the SoP is a medical guidance instrument used in statutory decision‑making under the VEA and MRCA, litigation relevant to its application would arise in the administrative and merits review context under those Acts, or potentially in judicial review proceedings, but no such materials are included in or referenced by this text. The instrument also does not record whether the 2016 SoP was the subject of litigation or administrative challenge.

Practitioners needing to understand how this SoP has been interpreted in decisions will therefore have to consult tribunal determinations and court judgments separately, because there is nothing in the instrument that provides precedential or interpretive guidance beyond the RMA’s expressed views and the textual definitions and factors contained herein. The SoP itself is an authoritative medical statement for use under the VEA and MRCA, but any case law on its application is external to the document and not supplied in the text here.

In short, the instrument contains no litigation history, no references to judicial or tribunal decisions, and no annotated summaries of jurisprudence. Any assessment of how tribunals or courts have applied the factors set out in this instrument must be undertaken by reviewing the case law corpus under the VEA and MRCA, which is outside the scope of the instrument text provided.

The instrument is short and focused, but it embeds several practical traps or points of friction for claimants and decision‑makers because of what it leaves undefined and the narrowness of the required factor.

Single required factor, narrowly phrased: The SoP requires one specific factor , “inability to obtain appropriate clinical management for benign prostatic hyperplasia before clinical worsening” (section 9). The wording combines a qualitative standard (“appropriate clinical management”) with a temporal element (“before clinical worsening”). The instrument does not define either term. That leaves the claimant to provide evidence that medical care was both unavailable or inaccessible and that this unavailability preceded an objectively identifiable stage of clinical worsening. Without statutory definitions, disputes will arise about the meaning of “appropriate,” what constitutes “inability to obtain” (e.g. was care offered but declined; was care available but unaffordable; were there location or administrative barriers?), and what counts as “clinical worsening.”

Temporal and causal constraint on service link: Section 10(2) restricts the SoP’s operation to material contribution or aggravation where the BPH was “suffered or contracted before or during (but did not arise out of) the person's relevant service.” That raises two issues. First, if BPH “arose out of” service (i.e. it is alleged to have originated in service), this SoP’s factor does not apply for material contribution or aggravation. Parties will need to be careful in pleadings and evidence to frame whether the claim is one of arising out of service or of aggravation of a pre‑existing condition. Second, the instrument requires that the inability to obtain management be “related to the relevant service” (section 10(1)), so evidence tying any lack of care to service conditions will be necessary.

Exclusions may divert cases: The instrument expressly excludes malignant neoplasm of the prostate, overactive bladder, and prostatitis from the definition of BPH (subsection 7(2)(2)). A claimant whose primary diagnosis is prostatitis or overactive bladder may not be able to use this SoP and will need to rely on other medical definitions or SoPs; failure to note the exclusion could result in misdirected claims or evidence.

Death linkage depends on “contribution”: For death claims the SoP includes death from a terminal event or condition that was “contributed to by” the person’s BPH (subsection 7(5)). The Schedule identifies terminal events concretely. The evidentiary bar is contribution, not sole causation, but practitioners must assemble evidence that BPH materially contributed to the terminal event , for example, demonstrating how urinary obstruction worsened respiratory status or predisposed to pneumonia. That causal chain may be challenging where multiple comorbidities exist.

Cross‑SoP complexity: Section 11 requires that, if a factor in this SoP refers to an injury or disease covered by another SoP, the other SoP’s factors apply. That can complicate proof where multiple SoPs are implicated, creating layered evidence obligations and potential inconsistencies between instruments. Decision‑makers must apply the other SoPs “as in force from time to time,” which introduces the possibility that changes to other SoPs after a claimant’s relevant events could affect how the factors operate.

No transitional provisions after repeal: The instrument repeals the 2016 SoP (section 4) but contains no transitional or savings provisions. If a claim was pending under the 2016 SoP as at commencement, the instrument does not state whether the earlier SoP or the new one governs determination. That procedural lacuna could lead to disputes about retroactivity and fairness, and will require adjudicators to resolve the practical application.

ICD‑10‑AM code note does not control meaning: The instrument notes that while BPH attracts ICD‑10‑AM code N40, the meaning of BPH for this SoP is the textual definition in subsection 7(2) (subsection 7(3)-(4)). Practitioners cannot rely on ICD codes alone; clinical records coded N40 must be examined for diagnostic content to confirm they meet the statutory textual definition and do not fall within the listed exclusions.

No definition of “appropriate clinical management” or evidentiary standard for “inability to obtain”: These are the two most consequential undefined terms and will be the battleground in many claims. Practitioners should be prepared to adduce service medical records, contemporaneous notes about referrals and access, evidence of availability of services at the time (including geographical and administrative barriers), and expert medical opinion linking lack of management to subsequent clinical worsening.

These are the principal practical pitfalls embedded in the SoP’s compact text. Each creates evidentiary and procedural issues that claimants and decision‑makers will need to address in individual cases.

Compliance in this context is evidentiary compliance aimed at meeting the SoP’s requirement so that a decision‑maker applying the VEA or MRCA can find, on the balance of probabilities, that BPH or death from BPH is connected with relevant service. The SoP sets out a single required factual factor (section 9) and constrains the service linkage (section 10). To comply with the SoP for a claim, collect and present evidence targeted to each element of the factor and to the service nexus.

1. Establish the medical diagnosis that fits the statutory definition. Use clinical records, diagnostic imaging, surgical/pathology reports, and specialists’ notes to demonstrate that the condition is the “benign hyperplasia of the prostate glandular and stromal tissue which can cause obstruction of urine outflow” and to exclude malignant neoplasm, overactive bladder and prostatitis (subsection 7(2)). Because the SoP specifies that the textual definition controls notwithstanding the ICD‑10‑AM coding, do not rely on a coded diagnosis alone (subsections 7(3)-(4)).

2. Demonstrate “inability to obtain appropriate clinical management.” The claimant must show both inability and that the management sought or clinically indicated was appropriate. Evidence types that will be relevant include:

   • Service medical records documenting requests for treatment, referrals, triage decisions, or denials while on relevant service.
   • Correspondence or administrative records showing unavailability of specialists, clinics, or procedures during relevant service periods.
   • Statements or affidavits from treating clinicians (military and civilian) that identify the standard of care appropriate at the time and whether that care was accessible to the claimant.
   • Evidence addressing barriers such as location (remote postings), administrative refusal, lack of facilities, waiting lists, or policies in force during the service period that prevented timely treatment. Note that the SoP does not define “appropriate clinical management,” so expert medical opinion that maps contemporaneous standards of care onto the claimant’s clinical needs will be critical.

3. Establish the temporal sequence: inability to obtain management “before clinical worsening.” Provide clinical timelines that show when symptoms first appeared, when management was sought or clinically indicated, when management was unavailable, and when clinical deterioration occurred. Use objective measures where possible (flow rates, post‑void residuals, PSA levels if relevant, urodynamic studies, progress notes, surgical interventions) to evidence “clinical worsening.”

4. Link the factor to “relevant service.” The SoP requires that the factor be “related to the relevant service rendered by the person” (section 10(1)). Use service records to show that the inability to obtain care occurred contemporaneously with the relevant service period defined in Schedule 1. Where necessary, produce evidence that the systemic or local service conditions that produced inability to obtain care were caused by service posting, role, or organisational factors. Be mindful of section 10(2): this SoP applies to material contribution or aggravation where BPH was “suffered or contracted before or during (but did not arise out of) the person's relevant service.” If the BPH is alleged to have arisen out of service, a different causation pathway may be in play.

5. For death claims, establish that death was from a terminal event or condition contributed to by BPH. The Schedule lists terminal events (pneumonia, respiratory failure, cardiac arrest, circulatory failure, cessation of brain function). Evidence should link BPH to the terminal event , for example, showing urinary obstruction complicated overall health, predisposed to infection, or exacerbated comorbid conditions. Medical expert opinion tying the chain of causation is likely necessary.

6. Where other conditions are implicated, consult relevant SoPs. If a factor in this SoP refers to an injury or disease covered by another SoP, section 11 requires that the other SoP’s factors apply. Identify any comorbid conditions that have separate SoPs and ensure evidence meets their requirements as well.

7. Prepare to address exclusions. If diagnoses include prostatitis, overactive bladder or prostate malignancy, explain the relationship between those diagnoses and the BPH claim, or rely on an alternative SoP if appropriate.

8. Anticipate procedural issues from repeal. Given that this SoP replaces the 2016 SoP (section 4) and contains no transitional clause, for claims spanning the repeal date be prepared to argue whether the prior or current SoP should apply, and to update evidence or expert opinion to fit the new textual definitions.

9. Use expert medical statements to interpret undefined terms. Because “appropriate clinical management” and “clinical worsening” are not defined, obtain contemporaneous or retrospective expert opinions that:

   • Identify what management was appropriate for the claimant at relevant times.
   • Explain why the absence of such management constituted inability to obtain care (rather than refusal or other issues).
   • Establish how the absence of that management caused or materially contributed to worsening.

10. Assemble administrative and service evidence. Service records, posting histories, administrative orders, and contemporaneous correspondence can be decisive in showing the connection between inability to obtain care and relevant service conditions.

Following these steps aligns the evidentiary materials with the textual requirements of the SoP. Because the instrument supplies a narrow and specific factor, tailoring evidence to that factor and the service nexus is the most efficient strategy for compliance.
