Statement of Principles concerning aortic aneurysm and aortic wall disorders (Balance of Probabilities) (No. 22 of 2021)

The instrument revolves around a cluster of legal and medical concepts that determine whether aortic aneurysm or an aortic wall disorder can be linked to relevant service. Core concepts and their mechanical operation in the SOP are:

• Covered conditions and textual definitions. Section 7(2) defines aortic aneurysm as permanent dilatation of the thoracic or abdominal aortic wall and lists aortic wall disorders (aortic dissection, intramural haematoma, false aneurysm/pseudoaneurysm, periaortic haematoma, rupture, symptomatic penetrating aortic ulcer). The Schedule gives definitions for some terms used in s 7(2), for example aortic dissection (Schedule 1).

• Diagnostic coding versus textual meaning. Although these conditions attract ICD‑10‑AM code I71, the SOP explicitly makes the textual meanings in s 7(2) the operative definition for the SOP (s 7(3)‑(4)). The SOP therefore prioritises the instrument’s textual descriptions over mere ICD codes when applying causation.

• Evidence threshold and role of the Repatriation Medical Authority. Section 8 records the RMA’s view, grounded in “sound medical‑scientific evidence available”, that the conditions can be related to relevant service on the balance of probabilities. That language expresses the evidentiary basis for the SOP rather than a rule of statutory interpretation; it indicates the RMA’s policy judgment about causation thresholds to be applied in claims.

• Mandatory existence of at least one factor. Section 9 enumerates discrete factors, any one of which must exist (and must be related to relevant service per s 10) before service connection can be found on the balance of probabilities. The factors are split between those tied to clinical onset and those tied to clinical worsening (compare ss 9(1)‑(15) with ss 9(16)‑(30)). Several factors repeat in both lists for onset and for worsening.

• Temporal and quantitative thresholds. Several factors require precise quantification or temporal limits: e.g., smoking thresholds in pack‑years and post‑cessation timeframes (ss 9(3)‑(4) and 9(18)‑(19)); second‑hand smoke exposure hours and timeframes (ss 9(5)‑(6) and 9(20)‑(21)); fluoroquinolone exposure within three months before onset/worsening (ss 9(14), 9(28)); specified drugs within 72 hours for aortic wall disorders (ss 9(15)(e), 9(29)(e)); and the diet threshold (ss 9(8), 9(23)). The Schedule defines “one pack‑year” and the meaning of being exposed to second‑hand smoke, as well as dyslipidaemia thresholds and METs for physical exertion.

• Relationship to relevant service. Section 10(1) requires that any factor in s 9 must be related to the person’s relevant service. Section 10(2) limits the operation of factors in ss 9(16)‑(30) to material contribution or aggravation where the person’s condition was suffered or contracted before or during, but did not arise out of, relevant service.

• Cross‑reference to other SOPs. Section 11 makes clear that if a factor in s 9 refers to an injury or disease covered by another SOP made under s 196B(3) of the VEA, then the factors in that other SOP apply according to its terms. This is an incorporated‑by‑reference approach which imports the causal rules of related SOPs where a factor depends on another disease or injury.

The combined effect of these concepts is that causation is assessed by: (a) checking whether the diagnosed condition matches the textual definitions in s 7; (b) identifying whether at least one of the enumerated factors in s 9 exists; and (c) establishing a service nexus for that factor under s 10. The Schedule refines measurement and thresholds for several factors (for example, biochemical thresholds for dyslipidaemia, the metric for MET, and the numerical definition of one pack‑year). Decision‑makers therefore operate with both qualitative and quantitative thresholds when applying this SOP.

The SOP primarily affects three categories of actors within the veterans’ and defence compensation system, and secondarily affects their advisers and treating clinicians.

• Claimants (veterans, members of the Forces). The instrument applies to any claim where section 120B of the VEA or section 339 of the MRCA applies (s 5). Those provisions govern decisions about service connection for injury or disease; the SOP therefore directly shapes the evidentiary route by which a veteran or ex‑member seeks recognition that aortic aneurysm or an aortic wall disorder is connected to relevant service. Claimants must establish that at least one of the factors in s 9 both existed and related to their relevant service (s 10(1)).

• Decision‑makers and administrators. The Repatriation Medical Authority is the author of the SOP (s 3) and supplies the medical‑scientific basis (s 8). The Department of Veterans’ Affairs, claims assessors, reviewers and tribunals that apply the VEA and MRCA will use this SOP as a determinative instrument when deciding causation under the specified sections. The SOP constrains the medical criteria those decision‑makers must apply.

• Treating clinicians and medical experts. The SOP’s thresholds require clinicians to provide evidence in specific formats: dates of diagnosis, laboratory values for dyslipidaemia (Schedule 1), documentation of smoking history sufficient to calculate pack‑years (Schedule 1), records of second‑hand smoke exposure hours, prescribing and dispensing records for fluoroquinolones and the specified list of drugs (Schedule 1), imaging and operative notes confirming aortic pathology, and records of pregnancy, trauma or infections. Where a factor depends on another disease that is covered by a separate SOP, clinicians’ evidence must align with the diagnostics and factors in that other SOP (s 11).

• Advisers and legal representatives. Lawyers, advocates and other representatives advising claimants are affected because the SOP prescribes which facts are material and the thresholds for each factor. Advice must therefore be targeted: whether the claimant has the required pack‑year history, laboratory documentation of dyslipidaemia, quantifiable second‑hand smoke exposure, or evidence of inability to obtain appropriate clinical management (s 9(30)).

• Secondary stakeholders. Entities that supplied or control records that prove or disprove factors , for example, defence employer records about enclosed smoking areas, unit logs, hospital discharge summaries, prescription dispensary records, or pathology labs , are indirectly affected because their records form the evidentiary basis for applying the SOP.

Who pays and who decides. The SOP itself does not specify payment mechanisms; it is a determinative instrument for use under the VEA and MRCA. In practical terms, if a decision‑maker finds causation pursuant to the SOP, the veteran or member becomes eligible for the relevant entitlements under the VEA or MRCA, with payments administered by the Department of Veterans’ Affairs and related agencies. The Repatriation Medical Authority decides the SOP content (s 3); adjudicators and administrators apply it to claims (s 5).

Limitations on affected persons. The Schedule defines “relevant service” narrowly (note the exclusions mentioned in the Schedule’s definition), so the SOP does not directly apply to service that falls outside that statutory definition (Schedule 1, relevant service definition). The SOP’s temporal rules (for example, limits on post‑cessation periods for smoking and second‑hand smoke) also mean some past behaviours are excluded if they fall outside the specified windows.

This instrument prescribes factual prerequisites and binding definitions rather than imposing duties in the criminal or regulatory sense. The relevant duties and rights for actors in the administrative process are those that flow from the VEA and MRCA together with the SOP’s operative requirements.

Duties of decision‑makers and administrators

• Apply the SOP when deciding claims to which the SOP applies. Section 5 makes the SOP applicable to claims under s 120B of the VEA or s 339 of the MRCA; decision‑makers must use the SOP’s factors and definitions when considering causation. The RMA’s statement that causation is “more probable than not” (s 8) is the medical basis that underpins their application.

• Require proof of at least one factor and a service nexus. Section 9 requires that at least one enumerated factor exist before a finding of service connection can be made on the balance of probabilities; s 10(1) requires that that factor be related to the person’s relevant service. Decision‑makers must therefore find both the factor and the connection to service.

• For conditions arising before or during service (but not arising out of service), limit their assessment to the material contribution or aggravation factors in ss 9(16)‑(30) (s 10(2)).

Rights and procedural implications for claimants

• Right to have causation assessed against the SOP. If a person lodges a claim to which s 120B or s 339 applies, they have the right to have causation assessed with reference to this SOP. This structures the evidentiary pathway they will need to follow.

• Burden of producing evidence. Although the SOP does not itself fix which party bears the legal burden in a merits review or tribunal, its mechanical effect is to identify specific factual elements the claimant must satisfy to obtain a favourable finding: existence of a factor listed in s 9 and its relationship to relevant service (s 10). Practically, claimants will need to marshal medical records, service records and other documentary evidence that correspond to the SOP’s metrics.

Specified evidentiary standards embedded in the SOP

• Quantitative and temporal thresholds are mandatory factual criteria. Examples include dyslipidaemia thresholds in the Schedule (serum HDL <1.0 mmol/L; LDL >4.0 mmol/L; triglycerides ≥2.0 mmol/L; total cholesterol >5.5 mmol/L; or regular drug therapy), smoking measured in pack‑years with the Schedule’s conversion formula, second‑hand smoke measured in hours with cutoffs at 1,000 and 5,000 hours, and defined time windows for smoking cessation and second‑hand smoke cessation (ss 9(3)‑(6), 9(18)‑(21), Schedule 1). These metrics are mandatory for the factual finding.

• Cross‑application of other SOPs. If a factor in s 9 refers to another disease for which another SOP exists, the adjudicator must apply that other SOP’s factors according to its terms (s 11).

No statutory penalties or criminal duties in the instrument

• The SOP does not create offences or fines, and it does not itself grant or deny benefits. Its legal role is evidentiary and determinative for service connection. Any rights to benefits and duties to pay are governed by the VEA or MRCA once causation is determined using this SOP.

In summary, the instrument imposes procedural and evidentiary duties on decision‑makers to apply these specific factors and temporal/quantitative thresholds when assessing causation, and imposes a practical burden on claimants to supply the relevant evidence to satisfy those thresholds and to show the factor’s relation to relevant service.

This Statement of Principles does not itself create criminal offences, civil penalties, or an independent enforcement regime. The SOP is an administrative instrument that sets the causal criteria used by decision‑makers under the VEA and the MRCA. Its enforcement occurs through administrative decision‑making and internal review processes under those Acts, rather than by any sanction contained in the SOP.

Key points about enforcement and consequences:

• Administrative effect, not punitive effect. The SOP’s operative effect is to determine whether a condition can be connected to relevant service on the balance of probabilities (s 8 and s 9). A finding of service connection, established using the SOP, will lead to the ordinary entitlements and administrative consequences under the VEA or MRCA (for example, pension or treatment entitlements). The SOP itself does not specify the entitlements or the payments; those follow from the enabling statutes when service connection is found.

• No penalties included. There are no provisions imposing fines, criminal liability, or administrative sanctions for non‑compliance in the SOP text. The instrument does not require regulated entities to perform acts that, if not performed, would constitute an offence. Instead, it prescribes evidentiary thresholds.

• Review and dispute mechanisms remain governed by VEA and MRCA. Where a claimant disputes a decision that applies this SOP, the available remedies, review rights and appeal pathways are those provided in the governing Acts and regulations. The SOP does not displace statutory review rights; it is the medical standard applied in the merits decision-making and review chain.

• Enforcement in practice is evidentiary scrutiny. Administrative enforcement of the SOP is effected by decision‑makers assessing whether the claimant has provided sufficient evidence that at least one factor in s 9 existed and was related to relevant service (s 10). If a claimant cannot prove a factor or the service nexus, the claim will be refused administratively.

• Interplay with other SOPs can produce evidentiary complexity. Under s 11, factors in this SOP that refer to illnesses covered by other SOPs import the causal rules of those instruments. In disputes, parties may litigate whether the other SOP has been correctly applied; any consequences arise from the governing statutory review and appeal framework rather than from the SOP itself.

Practical enforcement implications for stakeholders

• For claimants and advisers: the “penalty” for failing to meet a factor is a negative administrative decision. The SOP’s prescribed quantitative thresholds (e.g., pack‑years, lipid values, exposure hours) may serve as points of contention in reviews and appeals. Timely and properly documented evidence is therefore essential to avoid an adverse determination.

• For decision‑makers: the SOP is binding as the medical standard to be applied to relevant claims. Failure to apply the SOP or to consider its enumerated factors when required could be a ground in administrative review or appeal that the decision‑maker failed to apply the relevant instrument.

• No express enforcement timelines or compliance reporting. The SOP does not stipulate administrative timeframes for decision‑making, reporting obligations, or particular forms of evidence; these are governed by the procedural rules of the VEA and MRCA and departmental practice.

In short, the instrument enforces causation criteria through the merits of administrative decision‑making rather than by creating offences or financial penalties. The practical consequence of non‑compliance with the SOP’s thresholds is an adverse entitlement decision under the governing Acts.

This SOP is made under the Veterans’ Entitlements Act 1986 and explicitly applies to claims under provisions of the VEA and the Military Rehabilitation and Compensation Act 2004 (s 3 and s 5). Its interaction with other legal instruments is both direct and incorporated by reference.

Direct statutory interplay

• Source of authority. The SOP is made “under subsection 196B(3) of the Veterans’ Entitlements Act 1986” (s 3). That statutory provision empowers the Repatriation Medical Authority to determine Statements of Principles for use in determining service connection. The SOP therefore operates as an exercise of statutory power delegated by the VEA.

• Applicability to claims. Section 5 states that the SOP “applies to a claim to which section 120B of the VEA or section 339 of the MRCA applies.” Those referenced sections (not reproduced in this SOP) are the statutory decision points for determining service connection under the two Acts; the SOP thus functions as the medical standard used by decision‑makers under those provisions.

Incorporation and cross‑reference to other SOPs

• Embedded references. Section 11 provides that if a factor in section 9 refers to an injury or disease covered by another SOP made under the same VEA power, then the factors in that other SOP “apply in accordance with the terms of that Statement of Principles as in force from time to time.” This is an express cross‑instrument incorporation mechanism. It means where, for example, a factor depends on an infection (such as tuberculosis or syphilis) or on HIV, decision‑makers must consult and apply the relevant SOP for that infection in addition to the factors listed in this SOP.

• Practical implication. The cross‑application can create compounded evidentiary rules: a claimant may need to satisfy the standards of multiple SOPs (for the aortic condition and for the referenced disease). The SOP therefore does not operate in isolation; it is part of a network of SOPs that collectively determine causation across a range of medical conditions.

Relationship to classification and diagnostic codes

• ICD‑10‑AM code acknowledgement. Section 7(3) states that while the conditions attract ICD‑10‑AM code I71, the meaning for this SOP is the textual meaning in s 7(2). Section 7(4) describes the referenced ICD edition and notes the copyright owner. This preserves clinical coding compatibility with international disease classification but makes clear that the SOP’s textual definitions govern.

Interplay with administrative law and evidentiary rules

• Evidence and review. The SOP is an administrative instrument forming part of the statutory decision framework. Administrative law principles and procedural safeguards within the VEA and MRCA govern how evidence guided by this SOP is collected, disclosed and reviewed. The SOP does not replace those procedural rights; it specifies the medical factors that must be considered in exercising statutory discretion.

Interaction with employment, tort and criminal law

• No direct displacement. The SOP does not create civil causes of action nor does it alter criminal liability. It merely provides the medical criteria for determining service connection under the VEA and MRCA. It does not modify private law duties, tort claims, or employment law entitlements outside the veterans’ compensation system.

Amendments and legislative hierarchy

• Amendment mechanism recorded. The compilation notes amendments to the SOP, including the Veterans’ Entitlements (Statements of Principles, definition of “one pack‑year”) Amendment Determination 2022 (No. 94 of 2022) (Endnote 3 and Endnote 4). Changes to the SOP are effected by further determinations under the same statutory power.

• Relationship to subordinate instruments. The SOP is a legislative instrument made under authority of the VEA; it sits within the hierarchy as an instrument that must be applied by decision‑makers under that Act. Its terms are controlling for the medical causation question but subordinate to primary legislation.

In summary, the SOP interacts with other laws mainly as an administratively binding medical standard within the VEA/MRCA scheme, is cross‑referential to other SOPs for co‑morbid or causative diseases (s 11), references ICD coding for clarity (s 7(3)‑(4)), and is subject to amendment in accordance with the enabling statutory powers.

The compilation includes an amendment history and endnotes that record the instrument’s legislative lifecycle up to the compilation date of 19 September 2022. The instrument was originally registered as the Statement of Principles concerning aortic aneurysm and aortic wall disorders (Balance of Probabilities) (No. 22 of 2021) on 4 January 2021 (Endnote 3), and it commenced on 25 January 2021 (Endnote 3 table). The compilation expressly incorporates the Veterans’ Entitlements (Statements of Principles, definition of “one pack‑year”) Amendment Determination 2022 (No. 94 of 2022) (registration 26 August 2022), whose commencement date is recorded as 19 September 2022 (Endnote 3).

Endnote 4 provides a provision‑level account of amendments and shows which parts of the instrument were affected by the 2022 determination (rs No. 94 of 2022). The amendment history table in Endnote 4 records specific entries: the notes to subsections 9(3), 9(4), 9(18) and 9(19) were revised by the 2022 instrument, and the Schedule 1 definition for one pack‑year was amended by the same instrument (Endnote 4). The endnotes also show that certain sections (labelled “Section 2” and “Section 4”) were repealed under the Legislation Act 2003 (Endnote 4), although those repeals are part of the compilation metadata rather than changes to the medical criteria.

Mechanically relevant amendments

• One pack‑year definition change. The Schedule’s definition of “one pack‑year” was amended by the 2022 determination. The current Schedule defines one pack‑year as the amount of tobacco consumed in smoking 20 cigarettes per day for a period of 1 year, or an equivalent amount of tobacco products, and provides detailed notes giving equivalences by weight and the formula for computing pack‑years (Schedule 1). The amendment history records that this definition was revised in 2022 (Endnote 4).

• Notes to smoking thresholds. The notes appearing in subsections 9(3), 9(4), 9(18) and 9(19) were also revised by the 2022 amendment (Endnote 4). These notes relate to the definition and calculation of one pack‑year and the pack‑year thresholds embedded in the factors for onset and worsening.

Compilation and commencement details

• The compilation metadata at the front of the instrument states that the compilation date is 19 September 2022 and that it “Includes amendments up to: Veterans’ Entitlements (Statements of Principles, definition of ‘one pack‑year’) Amendment Determination 2022 (No. 94 of 2022) (F2022L01128)” with commencement 19 September 2022. The endnotes advise that uncommenced amendments, if any, are not shown (see the “About this compilation” preamble).

• The endnotes include standard material on the abbreviation key, legislation history and amendment history, and whether amendments were misdescribed. The compilation table in Endnote 3 lists the original registration and commencement of the SOP and the subsequent 2022 amending determination.

Implications for practitioners

• Watch for definition changes. The change to the pack‑year definition is substantive for claims where smoking history is the operative factor. Practitioners must ensure that historical claims are assessed against the version of the SOP in force at the time of decision‑making (the compilation notes the “as in force from time to time” principle for applied SOPs in s 11).

• Administrative record. The instrument’s endnotes serve as the authoritative legislative history for this SOP as at the compilation date; any further amendments after that date are not included and must be checked on the Legislation Register.

The amendment history as compiled shows relatively targeted changes, principally to the numerical and definitional treatment of pack‑years and related explanatory notes. The SOP otherwise retains the same structure and the enumerated factors for onset and worsening as originally promulgated in 2021.

The compilation of the SOP does not record or include any litigation history. The instrument itself contains no references to judicial decisions, and the endnotes (Endnotes 1-4) list only compilation, registration, commencement and amendment information. There are no cases cited within this SOP text, and no litigation annotations or summaries are provided in the endnotes.

Practical consequences of the absence of litigation references in the compilation

• No judicial gloss included. Because the compilation does not include any reported judicial or tribunal decisions, users cannot rely on this document alone for how courts and tribunals have interpreted or applied the SOP. Any interpretative disputes or procedural questions arising from the SOP would be resolved through the administrative review, tribunal processes and, if necessary, litigation; those outcomes are not reflected in this compilation.

• Need to check external records. Practitioners and claimants seeking precedent or interpretive authority should search authoritative databases, tribunal determinations and court judgments outside this compilation to see whether and how the SOP has been applied in contested decisions. The SOP itself (s 11) contemplates interplay with other SOPs, and litigation may have addressed such interactions; that material is not present here.

• Administrative review and tribunal channels remain available. Where a decision applying this SOP is disputed, the statutory review mechanisms under the VEA and MRCA, and appeals to the Administrative Appeals Tribunal or courts where available, are the likely avenues. Any jurisprudence from those processes would be relevant but is not recorded in the instrument.

Limitations on reporting. The compilation’s endnotes are confined to legislative history and amendment entries (Endnote 3-4) and do not purport to catalog tribunal or court decisions. The absence of litigation entries in the legislative compilation does not mean there has been no litigation; it means the legislative instrument does not record it. Users should therefore treat this section as indicating only that this compilation does not supply litigation history and that independent legal research is necessary to locate any authoritative decisions interpreting the SOP.

This SOP contains a number of technical features and drafting choices that can produce traps for claimants, advisers and decision‑makers. These features affect evidentiary strategy, the scope of applicable factors, and the timing of claims.

1. Requirement that at least one enumerated factor exist and be related to relevant service (ss 9, 10(1)). The SOP does not allow an inference of service connection without a specific factor from s 9 being established and tied to service. General assertions that service stress or service exposure caused an aortic condition are insufficient unless they correspond to a listed factor and a service nexus is proved.

2. Distinction between onset and worsening (ss 9(1)‑(15) v 9(16)‑(30) and s 10(2)). If the condition was suffered or contracted before or during service but did not arise out of service, then only the worsening/material contribution factors in ss 9(16)‑(30) are available. Practically, that means the adviser must identify whether the claim is for causation (onset) or for aggravation/worsening, because different factors and temporal rules apply.

3. Quantitative thresholds are binding and precise (Schedule 1; ss 9(3)‑(6), 9(8), 9(14), 9(15)(e), 9(28), 9(29)(e)). Examples:

   • Smoking measured in pack‑years with the Schedule’s conversion and formula (Schedule 1). The 2022 amendment altered the one pack‑year definition , check that the correct version applies to the decision date (Endnote 4). A marginal error in pack‑year computation can be outcome‑determinative.

   • Second‑hand smoke exposure measured in hours (1,000 hours and 5,000 hours thresholds) with a five‑year post‑cessation window for the lower threshold (ss 9(5)‑(6), 9(20)‑(21)). Accurately quantifying hours of exposure in service environments may be difficult.

   • Dietary threshold: inability to consume an average of at least 100 grams per day of fruit/vegetables for five consecutive years within the 20 years before onset/worsening (ss 9(8), 9(23)). This is a high evidentiary bar; documentary proof is rarely straightforward.

   • Dyslipidaemia defined in biochemical terms and evidence of drug therapy (Schedule 1). Decision‑makers will expect laboratory values or prescribing history.

   • Fluoroquinolone exposure limited to three months prior to onset/worsening (ss 9(14), 9(28)). Exact prescription and dispensing dates are therefore critical.

   • Specified illicit stimulant drugs on a 72‑hour window for aortic wall disorders (ss 9(15)(e), 9(29)(e)). Proof of use or toxicology within this narrow window can be challenging and highly contested.

4. Undefined but operative concepts: “clinical onset” and “clinical worsening”, and “permanently ceased”. These critical temporal markers are used throughout but are not explicitly defined in the SOP. The absence of definitions means adjudicators and medical experts will need to interpret these terms in context, which can generate disputes over when onset or worsening occurred and whether cessation of smoking or exposure was “permanent”.

5. Cross‑referencing to other SOPs (s 11). Where a factor refers to an injury/disease covered by another SOP, the practitioner must identify and apply the other SOP’s factors. Overlooking this cross‑reference can lead to incomplete evidentiary presentation.

6. ICD‑10‑AM code note (s 7(3)‑(4)). The SOP explicitly uses its own textual definitions rather than relying solely on diagnostic coding. A claimant cannot rely purely on an ICD code; the clinical narrative and imaging must meet the textual definitions in s 7(2).

7. Narrow “relevant service” definition (Schedule 1). The Schedule’s definition excludes certain types of service (for example, hazardous service and British nuclear test defence service as noted in the Schedule’s wording). Ensuring the claimed service falls within the Schedule’s “relevant service” definition is essential.

8. “Inability to obtain appropriate clinical management” (s 9(30)). This factor is open‑textured. Proving inability to obtain care requires documentary evidence of attempts to access services, referrals, refusals, geographical barriers or systemic constraints. The lack of specification in the SOP as to what constitutes “appropriate clinical management” means cases will hinge on factual context.

9. Temporal windows create evidentiary hurdles. Many factors impose lookback periods (e.g., diet within 20 years, smoking cessation within 20 years, second‑hand smoke cessation within five years). Historical records are commonly incomplete; practitioners should anticipate evidentiary gaps.

10. Specified drugs list and illicit use. The “specified list of drugs” in the Schedule contains illicit stimulants and MDMA (ecstasy). For claims involving drug use, issues of admissibility, confidentiality and criminal law intersect with evidentiary requirements, particularly where documentation of use may be sparse.

For advisers and decision‑makers, the practical “gotcha” is that small deficiencies in documentation (a missing lab date, an imprecise smoking history, an unquantified exposure) can be decisive because the SOP sets precise, enumerated factual gates. Parties should therefore map each desired causal pathway to a discrete evidentiary item that aligns with the SOP’s thresholds and timeframes.

Compliance here means producing and presenting the evidence necessary to satisfy the SOP’s factors and the requirement that any such factor be related to relevant service (s 9 and s 10). The following is a practical checklist and evidence strategy for claimants, advisers and clinicians.

1. Establish the diagnosis per the SOP’s textual definitions

   • Secure imaging and surgical reports that match the textual definitions in s 7(2): for aortic aneurysm, documentation of permanent dilatation of thoracic or abdominal aorta; for aortic dissection, imaging or operative notes confirming separation of aortic wall layers (Schedule 1). Do not rely solely on ICD coding (s 7(3)‑(4)).

2. Identify which factor in section 9 you rely upon

   • Map the claim to at least one factor in s 9(1)‑(30). If asserting onset, use the onset factors (ss 9(1)‑(15)); if asserting material contribution or aggravation for a pre‑existing condition that did not arise out of service, use the worsening factors (ss 9(16)‑(30)) and ensure s 10(2) conditions are met.

3. Collect direct medical evidence matching the factor

   • Hypertension (ss 9(1), 9(16)): Medical records showing diagnosis date and measurements, antihypertensive prescriptions and clinical management notes dated before onset/worsening.

   • Dyslipidaemia (ss 9(2), 9(17)): Laboratory lipid panels with date‑stamped values meeting the Schedule thresholds (HDL <1.0 mmol/L; LDL >4.0 mmol/L; triglycerides ≥2.0 mmol/L; total cholesterol >5.5 mmol/L), or prescribing records showing ongoing lipid‑normalising therapy (Schedule 1).

   • Smoking history (ss 9(3)‑(4), 9(18)‑(19)): Recorded smoking history that enables precise pack‑year calculation per Schedule 1 formula and one pack‑year definition. For post‑cessation scenarios, evidence of cessation date and proof it was “permanent” (clinical notes, cessation programme records, contemporaneous attestations).

   • Second‑hand smoke exposure (ss 9(5)‑(6), 9(20)‑(21)): Records or contemporaneous documentation identifying enclosed spaces and durations sufficient to estimate total exposure hours. Unit rosters, duty records, accommodation logs and witness statements can be used to quantify hours. For post‑cessation scenarios, document last exposure date.

   • Diet (ss 9(8), 9(23)): For the diet factor, secure dietitian assessments, clinical notes expressing inability to consume 100 g/day of fruit/vegetables, welfare or supply records (food insecurity statements), or other corroborating documentation covering a five‑year consecutive period within the 20 years before onset.

   • Infection (ss 9(9), 9(10), 9(24), 9(25)): Microbiology, serology, histopathology, imaging, and treatment records that document HIV or bacterial/fungal infection of the aorta, with dates.

   • Autoimmune disease/vasculitis (ss 9(11), 9(26)): Specialist records, immunologic testing, biopsy, or rheumatologist notes establishing diagnosis and dates.

   • Trauma (ss 9(12), 9(27)): Accident reports, hospital records, imaging and operative notes detailing trauma to the aorta.

   • Non‑aneurysmal aortic atherosclerotic disease (s 9(13)): Imaging and vascular surgical reports confirming atherosclerotic disease at the relevant time.

   • Fluoroquinolone exposure (ss 9(14), 9(28)): Prescription, dispensing and pharmacy records showing fluoroquinolone use within three months prior to onset/worsening.

   • Specified drugs and acute triggers for aortic wall disorders (ss 9(15)(e), 9(29)(e), and Schedule 1 list): For alleged drug exposure within 72 hours, toxicology, hospital/emergency room notes and witness statements are important.

   • Physical exertion (ss 9(15)(a), 9(29)(a)): Document the event where 5 METs or more activity occurred within 24 hours before onset/worsening. Sporting logs, unit exercise records, incident reports, or emergency department history may suffice. Use the MET definition in Schedule 1 to translate activities into METs.

   • Pregnancy (ss 9(15)(b), 9(29)(b)): Obstetric records confirming pregnancy within six weeks prior to onset/worsening.

   • Malignancy invasion/erosion (ss 9(15)(c)‑(d), 9(29)(c)‑(d)): Oncologic imaging, histopathology or surgical notes showing invasion or contiguous inflammatory erosion.

   • Inability to obtain appropriate management (s 9(30)): Document attempts to access care, referrals, refusal letters, travel distance constraints, service limitations, or denial of treatment. Keep contemporaneous communications and appointment records.

4. Prove the relationship to relevant service (s 10(1))

   • Link the identified factor to the person’s relevant service. Evidence may include service records demonstrating the exposure or medical condition occurring during service, workplace records indicating confined smoking spaces, unit operational histories, or contemporaneous medical entries showing diagnosis during service. For exposures occurring outside service, show the causal link to service activities or events.

5. Address timing rules and material contribution limits (s 10(2))

   • If the condition was contracted before or during service but did not arise out of service, ensure the claim is framed as material contribution or aggravation and rely on ss 9(16)‑(30). Prepare evidence showing the condition pre‑dated service and how service materially aggravated it.

6. Cross‑reference other SOPs (s 11)

   • If any factor depends on another disease (for example, tuberculosis or HIV), identify the relevant SOP covering that disease and gather evidence that satisfies that SOP’s factors as well. Section 11 requires application of the other SOP in accordance with its terms.

7. Practical presentation and chain of proof

   • Present a chronological case narrative linking documents to each applicable s 9 factor and to relevant service. Use chronology tables, pack‑year calculations, exposure hour estimates, and laboratory result extracts.

   • Anticipate challenges on vague concepts such as “clinical onset” and “permanently ceased”. Provide expert medical opinion that anchors these concepts to objective dates and clinical milestones.

8. Responding to lack of objective records

   • Where records are unavailable, use corroborating witness statements, unit logs, contemporaneous notes, and expert opinion that explains likely exposures or causation based on available facts. For diet and second‑hand smoke quantification, aim for multiple converging sources rather than single assertions.

9. For decision‑makers: documentation and reasoned decisions

   • Record findings on each required element: diagnosis per s 7, existence of an s 9 factor, and relation to relevant service per s 10(1) or material contribution under s 10(2). Where a factor invokes another SOP, state that and show how the other SOP’s factors were applied per s 11.

10. Keep statutory timeline and amendment awareness in mind

• Verify which version of the SOP applies to the decision date (see the compilation and Endnote 3-4). In particular, the 2022 amendment changed the one pack‑year definition; ensure calculations follow the version in force at the decision date.

Checklist , minimum documents to gather

• Imaging and surgical/operative reports for aortic pathology.
• Laboratory lipid panels and hypertension records.
• Smoking history enabling pack‑year calculation (with Schedule 1 conversion).
• Service records, accommodation logs or witness statements showing exposure to second‑hand smoke and its duration.
• Prescription and dispensing records for fluoroquinolones and any specified drugs near the onset/worsening date.
• Obstetric, trauma, oncologic, and infectious disease documentation if those factors are relied upon.
• Dietitian notes or other documentary evidence for the dietary factor.
• Records evidencing inability to obtain appropriate management if s 9(30) is claimed.
• Expert medical reports linking the clinical timeline to the claimed factor and to relevant service.

Following these staged steps aligns claim preparation with the SOP’s specific factual gates and helps avoid the common evidentiary shortcomings that lead to adverse administrative decisions.
