Statement of Principles concerning anxiety disorder (Balance of Probabilities) (No. 101 of 2023)

The instrument rests on a small number of legal-medical concepts that govern how causation will be determined in claims under the VEA or MRCA.

Anxiety disorder and diagnostic scope

• The SoP defines “anxiety disorder” by reference to categories derived from DSM-5-TR: generalised anxiety disorder, anxiety disorder due to another medical condition, substance/medication-induced anxiety disorder, and other specified/unspecified anxiety disorders (s 7(2)-(6); Schedule 1). The DSM-5-TR source is recorded in the Schedule (Schedule 1, DSM-5-TR definition).
• The SoP expressly excludes a set of anxiety‑type diagnoses from its definition: agoraphobia, panic disorder, selective mutism, separation anxiety disorder, social anxiety disorder and specific phobia (s 7(7)). This exclusion matters because those disorders will be dealt with by other SoPs where applicable.

Causation by factors and temporal windows

• Section 9 lists specific factors that must exist for the RMA to conclude, on the balance of probabilities, that anxiety disorder or death from it is connected with relevant service. The SoP adopts a “factors must exist” approach: at least one of the listed factors must be present (s 9 opening line).
• Each factor is tied to specific temporal windows relative to the “clinical onset” or “clinical worsening” of generalised anxiety disorder. Examples: category 1A and 1B stressors must be experienced within 2 years before clinical onset (ss 9(1)-(2)); category 2 stressors must be within 6 months before onset (s 9(7)); clinically significant prior mental health disorder must be within 5 years before onset (s 9(8)); life-threatening medical illness or injury must be within 3 years before onset (ss 9(9)-(10)).

Pre-existing versus new-onset and aggravation

• Section 10(2) restricts the operation of subsections 9(25)-9(48) so that those factors are only relevant to matters of material contribution to, or aggravation of, anxiety disorder where the person’s anxiety disorder was suffered or contracted before or during (but did not arise out of) the person’s relevant service. That is, certain factors are framed to address worsening or material contribution for pre‑existing conditions rather than initial causal linkages for new-onset disorders.

Role of specific exposures and substance causation

• The SoP lists specific substances and exposure patterns that will be treated as factors for substance/medication-induced anxiety disorder or its worsening. Mefloquine within 24 hours before onset/worsening is singled out where symptoms persist after discontinuation (ss 9(16), 9(40)). The Schedule lists the specified psychoactive substances (amphetamine-type substances including methamphetamine and MDMA, cannabis, cocaine, inhalants, opioids, PCP) and defines “intoxicant dose” (Schedule 1).
• Tobacco exposure is quantified (0.5 pack-years threshold) and timing considerations apply if smoking ceased before onset/worsening (ss 9(22), 9(46); Schedule 1 defines pack-year).

Cross-reference governance

• Section 11 requires that, where a factor refers to an injury or disease covered by another SoP, the factors in that other SoP apply according to their terms. The SoP therefore functions within a system of interlocking medical‑causation instruments: a factor does not operate in isolation where another SoP governs the referenced condition.

Death as an outcome

• Death from anxiety disorder is included: anxiety disorder includes death from a terminal event or condition contributed to by the person’s anxiety disorder (s 7(8)). “Terminal event” is defined in the Schedule as proximate or ultimate causes such as pneumonia, respiratory failure, cardiac arrest and similar events (Schedule 1).

Standards and burden

• The RMA adopts the balance of probabilities standard (s 8). The instrument is explicit that its conclusions arise from the RMA’s view of the sound medical‑scientific evidence available (s 8). The SoP does not change the legal standard in the VEA or MRCA; it provides a legislative medical framework to assess causation against that standard.

Terms and measurements

• The Schedule supplies operational thresholds used through the SoP: BMI ≥30 for obesity; METs for physical capacity; 200 mg and 400 mg caffeine thresholds differentiated by “regular caffeine habit” (Schedule 1); clinically significant disorder of mental health enumerated conditions and the note that “ongoing management” may involve regular visits (Schedule 1). These measurable thresholds convert some clinical judgments into discrete evidentiary touchstones.

Primary affected groups

• Veterans and serving members who lodge claims under the VEA sections connected to s 120B, or claims under s 339 of the MRCA, are directly affected because the SoP applies to claims to which those provisions apply (s 5). The Schedule’s definition of “relevant service” identifies the classes of service that trigger application: eligible war service (other than operational service) under the VEA, defence service (other than hazardous service and British nuclear test defence service) under the VEA, and peacetime service under the MRCA (Schedule 1).

Decision-makers and assessing bodies

• Administrative decision-makers, adjudicators and medical officers within the Department of Veterans’ Affairs and related review tribunals will be required to apply the SoP when determining whether a claimant’s anxiety disorder is connected to relevant service. The instrument is made under s 196B(3) of the VEA; that statutory process produces SoPs which decision-makers use as the medical test for causation. Although the SoP does not itself name the decision-makers, its operational role is to guide those bodies in assessing causation on the balance of probabilities (s 8 and s 9).

Medical practitioners and experts

• Treating clinicians, forensic psychiatrists, general practitioners, and other medical experts preparing evidence for claims will be affected by the diagnostic and temporal requirements. The SoP prescribes diagnostic criteria derived from DSM-5-TR for generalised anxiety disorder and other categories (s 7) and requires evidence that specific factors fall within specified timeframes (s 9). Practitioners will need to address those discrete criteria and thresholds in reports.

Family members and witnesses

• Family members and close friends are implicated in several factors: having a family member or close friend who experiences a category 1A stressor within one year before clinical onset is a factor (s 9(4)), and the death of a family member or close friend within two years before clinical onset is a factor (s 9(5)). Those secondary participants therefore may become sources of evidence or subjects of inquiry.

Administrative cost‑bearers

• The Department of Veterans’ Affairs and ultimately taxpayers bear the administrative costs of claim assessment, medical examinations and tribunal reviews triggered by claims using this SoP. The SoP potentially alters claim volume and complexity, which has resource implications for the administering agency.

Legal advisers, advocates and representatives

• Lawyers, advocates, and accredited representatives preparing and presenting claims will need to align claim strategies with the SoP: identify and prove the presence of one or more listed factors within their temporal windows, obtain suitable expert evidence applying DSM-5-TR criteria, and, where relevant, engage other SoPs through s 11.

Service providers in mental health and rehabilitation

• Providers of clinical management for anxiety disorder (psychiatrists, psychologists, counsellors) will be asked to provide records and opinions evidencing diagnosis, onset/worsening dates, management history and capacity measures such as METs. The SoP’s note that “inability to obtain appropriate clinical management for anxiety disorder” is a factor for clinical worsening (s 9(48)) directly draws clinical service access into causation assessments.

Insurers and compensation administrators (indirectly)

• Although the SoP operates within statutory veterans’ compensation schemes rather than private insurance, its diagnostic and factor thresholds may influence medical evidence used in other contexts and could indirectly affect interactions where overlapping claims or evidentiary material are used across systems.

Researchers and policymakers

• The RMA’s adoption of DSM‑5‑TR and its selection of factors (for example, spotlighting mefloquine, caffeine thresholds) will be relevant to researchers studying military mental health and to policymakers considering preventive measures, drug use policies and clinical management pathways in defence settings.

Groups with potential evidentiary difficulty

• Claimants lacking documentary records of stressor events, or whose exposures and symptoms fall outside the SoP’s specified temporal windows, may face difficulty establishing the required factor(s). The Schedule’s narrow definitions (for example witness, corpse) and precise thresholds (BMI, pack-years, METs, caffeine mg) create evidentiary hurdles for some individuals.

Legal nature of the instrument and decision framework

• The SoP itself is not an entitlement statute; it is a medical‑causation instrument made under s 196B(3) of the VEA and intended to be applied by decision-makers considering claims under the VEA and MRCA (s 3, s 5). It determines the factors the RMA considers, on the balance of probabilities, sufficient to connect anxiety disorder to relevant service (s 8 and s 9). The instrument does not create administrative procedures, appeal rights, or payment obligations; those arise under the parent Acts (VEA, MRCA) and the administrative framework that applies to claims.

Duties for evidence and diagnosis

• Practitioners carrying out medico-legal assessments have the duty to apply the DSM-5-TR-derived diagnostic criteria for generalised anxiety disorder and the other categories enumerated in the SoP when preparing evidence (s 7(3)-(6)). Reports should identify clinical onset and, if relevant, clinical worsening dates because the causal factors in s 9 are tied to specific time windows before onset or worsening.

Duty to link factors to relevant service

• Section 10(1) requires that any factor relied on under s 9 must be related to the person’s relevant service. Decision-makers must therefore connect the existence of a factor to the period or circumstances of relevant service as defined in the Schedule (Schedule 1: relevant service). A finding that a factor existed is insufficient unless the factor is shown to be related to relevant service.

Duty to apply cross-referenced SoPs

• Section 11 creates a duty to apply, where applicable, factors in other Statements of Principles if a s 9 factor refers to an injury or disease covered by another SoP. Adjudicators and advisers must therefore be aware of the wider SoP corpus and treat referenced conditions according to their own terms.

Rights of claimants

• Claimants retain their rights under the VEA and MRCA claim processes (the SoP does not extinguish procedural rights). The SoP affects the admissible medical framework for proving causation. In practice, a claimant has the right to present medical and other evidence meeting the SoP’s requirements and to challenge decision-makers’ application of the SoP through the usual review and appeal mechanisms established under the parent Acts and administrative review bodies (those processes are not set out in the SoP itself).

No new criminal or civil penalties in the SoP

• The instrument contains no penal provisions. It does not create offences or administrative sanctions: its legal force is confined to its evidentiary role in deciding service connection under the VEA or MRCA (see s 3 and s 5). Enforcement, in the sense of compliance with the SoP, occurs through its application by the relevant decision-making and review machinery.

Operational obligations for record keeping and proof

• Practical duties follow from the SoP’s measurable thresholds: clinicians should record BMI, smoking history (pack-years calculation), caffeine intake habits, drug exposure timing (mefloquine, psychoactive drugs), capacity to undertake METs and dates of onset/worsening. The Schedule’s definitions make these records material to decision outcomes (Schedule 1: BMI, pack-year, MET, regular caffeine habit).

Temporal duties for linking exposures

• The specified time windows impose temporal duties on claim preparation. For example, to rely on a category 1A stressor a claimant must show such an event occurred within 2 years before clinical onset of generalised anxiety disorder (s 9(1)). For substance-induced disorders, the relevant exposures are tied to the 24 hours before onset (ss 9(16), 9(17), 9(18), 9(19), 9(40), 9(41), 9(42), 9(43)) or narrower windows for cessation/reduction of substance use (10 days, s 9(20)).

Medical interpretation duties

• Reports must address whether anxiety symptoms are “directly related to the pathological process of the medical condition and not solely due to its psychosocial stress effects” where a medical condition is advanced as the cause (s 9(15) and s 9(39)). This requires clinicians to differentiate pathophysiologic causation from psychosocial reaction, and to state that opinion.

No penalties in the instrument

• The SoP contains no penalty or offence provisions. It does not introduce fines, imprisonment, administrative penalties or similar sanctions. Its legal effect is confined to specifying the RMA's view on medical‑scientific causation for decisions under the VEA and MRCA (s 3 and s 8).

Enforcement by administrative application

• Enforcement, in practice, occurs through the application of the SoP in the statutory claims processes under the VEA and MRCA. Decision-makers assessing claims will use the SoP’s factors as the medical criteria for deciding whether an anxiety disorder is connected to relevant service. The instrument’s provisions such as the requirement that at least one factor exist (s 9) are applied by claim assessors in making entitlement decisions.

Review and dispute mechanisms lie outside the SoP

• The SoP does not itself set out review or appeal mechanisms; those are provided under the VEA and MRCA and associated administrative law. The instrument therefore must be read as a component of the statutory decision-making apparatus whose application may be challenged by claimants through the established administrative or judicial review processes, though those procedures and remedies are not recited in the SoP.

Adjudicative discretion and evidentiary weight

• The SoP sets out the RMA’s view of which factors are sufficient for a causal connection on the balance of probabilities but it gives decision-makers interpretive tasks that can affect outcomes. For example, s 10(1) requires the factor be related to relevant service; decision-makers must exercise judgment to determine the strength of that relationship. The SoP does not prescribe the exact evidentiary content required to prove the existence of a factor; the evidentiary weight of particular records, witness statements or expert reports remains an administrative judgment.

Potential for dispute over measurement and definitions

• The Schedule turns some clinical judgments into discrete measurements (BMI ≥30, 0.5 pack-years, caffeine mg thresholds, METs). Disagreements can arise over how those measurements are calculated or evidenced (for example whether historical weight/height data exist to compute BMI at the relevant time). Those disputes are resolved in claims processes and, if contested, via review mechanisms.

Practical enforcement implications for record producers

• Clinicians, Defence medical services, unit records custodians and pharmacies are indirectly affected because their records will be used to evidence the factors listed in s 9. Non-production or absence of reliable records can affect claim outcomes; however the SoP contains no sanction for missing records.

Integration into the VEA/MRCA framework

• The SoP is made under the VEA (s 3) and applies to claims to which s 120B of the VEA or s 339 of the MRCA applies (s 5). It is therefore intended to be read and applied within the statutory compensation framework those Acts create. The SoP provides the RMA’s medical view to be used in applying the causation standard that decision-makers under the VEA and MRCA must apply. The SoP does not rewrite substantive entitlements under those Acts; it provides the medical causation criteria used to determine whether an entitlement arises.

Cross-references to other Statements of Principles

• Section 11 establishes a mechanism for interaction with other SoPs: where a s 9 factor refers to an injury or disease covered by another SoP, that other SoP’s factors apply as in force from time to time. This creates an interlocking system; a factor referring to, for example, an injury defined in another SoP will import that SoP’s terms. The operational effect is that assessors must consult the relevant SoP corpus to determine causation when referenced conditions are present.

Reliance on DSM-5-TR as clinical standard

• The SoP explicitly derives its diagnostic criteria from DSM-5-TR (s 7(3) and Schedule 1). That choice links the SoP’s clinical framework to an international psychiatric taxonomy. Where Australian medical practice or other statutory instruments use different diagnostic manuals (for example ICD codes), decision-makers and clinicians will need to translate between diagnostic frameworks in evidence and assessment.

Overlap with other statutory instruments and clinical standards

• Some disorders the SoP excludes (panic disorder, social anxiety disorder, etc) are covered by other SoPs. A claimant’s presentation may involve multiple anxiety-related diagnoses; assessors must determine which SoP(s) apply. Section 11 makes clear that when a s 9 factor refers to a condition governed by another SoP, that SoP’s factors govern.

Administrative law and rights to review

• While the SoP does not itself provide review rights, decisions made using the SoP will be reviewable under the review regimes in the parent Acts and under general administrative law. The SoP’s definitions and thresholds will therefore be interpreted and applied in that broader legal context, potentially subject to judicial review on conventional grounds such as error of law, failure to consider relevant material, or unreasonableness, though those remedies are not addressed in the SoP text.

Data and privacy regimes (indirect interaction)

• Application of the SoP will involve the use and exchange of sensitive health information. That means healthcare privacy and record-keeping laws and Defence record disclosure rules will be practically engaged in claims. The SoP does not address privacy or disclosure procedures; those remain governed by existing statutory and administrative rules.

Interaction with clinical management obligations

• The SoP recognises “inability to obtain appropriate clinical management for anxiety disorder” as a factor for clinical worsening (s 9(48)). That creates an operational interface between entitlement assessment and health service delivery. Deficiencies in service access may become part of causal assessments, and that will engage health system policy and funding arrangements, albeit indirectly.

International practice and drug regulation

• The SoP’s attention to specific drugs (mefloquine) and specified psychoactive substances reflects medical and pharmacological considerations that intersect with drug regulation, prescribing practices and military pharmaceutical policies. Defence drug policy and prescribing guidelines, while not changed by the SoP, will be relevant to evidentiary questions about exposure and timing.

Instrument creation and repeal of prior SoP

• The instrument is dated 25 October 2023 and commences on 28 November 2023 (s 1 and s 2). It expressly repeals the Statement of Principles concerning anxiety disorder No. 103 of 2014 (Federal Register of Legislation No. F2014L01390) (s 4). The SoP therefore replaces the previous 2014 SoP on anxiety disorder.

Statutory authority for amendment

• The instrument is made under subsection 196B(3) of the Veterans’ Entitlements Act 1986 (s 3). That is the legislative provision empowering the RMA to determine Statements of Principles. The SoP therefore follows the statutorily prescribed instrument-making process under the VEA.

Content updates reflected in this instrument

• The 2023 SoP adopts DSM-5-TR (2022) diagnostic formulations for generalised anxiety disorder and other categories (s 7(3) and Schedule 1 DSM-5-TR definition). The Schedule includes expanded, concrete thresholds for exposures and measures , for example caffeine dose thresholds differentiated by “regular caffeine habit” and a defined 0.5 pack-year tobacco threshold. The instrument explicitly lists psychoactive substances of interest and clarifies definitions (for example corpse, witness, terminal event). Those may represent substantive updates from the 2014 instrument, which is repealed, though the SoP text itself is the direct source for the updated content.

No transitional provisions in the instrument

• The SoP contains no express transitional clauses describing how claims spanning the repeal date are to be treated, nor does it state whether claims lodged before commencement remain governed by the 2014 SoP. Section 5 simply states that the instrument applies to a claim to which s 120B of the VEA or s 339 of the MRCA applies. Practitioners should therefore check the parent Acts and administrative rules for transitional and application provisions or guidance from the administering agency on handling existing claims. The instrument itself is silent on transitional procedures.

Potential for future amendment

• The SoP is made “as in force from time to time” for cross-reference purposes (s 11). That language, and the RMA’s statutory power to issue SoPs, implies the RMA may amend or replace this instrument in the future as medical evidence evolves. The instrument does not specify amendment criteria or timelines; any future changes would be made under the same statutory authority and published accordingly.

Record of sources and scientific basis

• Section 8 states the RMA’s view is based on “sound medical‑scientific evidence available”. The Schedule cites DSM-5-TR as the diagnostic source. The instrument does not include a bibliography of studies or an explanatory memorandum within the provided text; any fuller account of the scientific basis will be found in RMA materials or accompanying documents published separately. The SoP itself is an administrative instrument that records the outcome of the RMA’s scientific assessment rather than the detailed evidence base.

No cases or litigation recorded in the instrument

• The Statement of Principles as provided contains no citation to cases, judicial decisions, or any litigation history. It does not record prior tribunal or court determinations concerning the interpretation or application of its predecessor or the new instrument.

Potential for disputes arising from interpretive points

• Several provisions in the SoP create interpretive issues that are likely to generate litigation or review challenges in the claims context, even though the SoP lists none. For example:
  • The requirement in s 10(1) that a factor “must be related to the relevant service rendered by the person” will require decision-makers to form a factual and legal conclusion about the relationship between events and service; contested decisions on this point are naturally susceptible to review.
  • Section 10(2) limits the operation of subsections 9(25)-9(48) to circumstances of material contribution or aggravation where the anxiety disorder was suffered or contracted before or during but did not arise out of service. That qualification introduces a three-way distinction (pre-existing, arising out of service, and aggravated by service) that may be litigated where facts are finely balanced.
  • The discrete measurement thresholds in the Schedule (BMI ≥30, pack-year computations, caffeine mg thresholds, MET capacity) may prompt disputes about the correct calculation, the relevant date for measurement and what evidence suffices to prove those metrics.
  • Definitions that narrow evidentiary categories, such as “witness” (which expressly excludes persons exposed only to public broadcasting or mass media coverage), or “corpse” (which excludes seeing a closed body bag or viewing a body in an open-casket coffin), create lines that may be contested in particular factual situations.

No recorded judicial treatment of predecessor SoP in the instrument

• The instrument repeals the 2014 SoP (s 4). It does not summarise any judicial interpretation of that predecessor SoP or say whether earlier decisions would be binding or persuasive in construing the new instrument. Consequently, users must consult case law databases and tribunal decisions separately to see how courts and tribunals have treated prior SoPs or similar issues, recognising that the 2023 instrument alters the statutory medical framework.

Expectation of tribunal and judicial review

• Given the SoP’s role in claims determinations and the high stakes of veterans’ compensation, it is reasonable to expect that disputed applications of the SoP will appear before administrative review bodies and occasionally courts. Areas likely to generate challenge include establishing clinical onset/worsening dates; proving the relation of a factor to relevant service (s 10); interpreting the scope and operation of subsections 9(25)-9(48); and calculation or proof of numerical thresholds such as pack-years and BMI. The instrument itself does not catalogue such litigation, but its provisions create identifiable points of legal contest.

Strict temporal windows and onset/worsening definitions

• The SoP ties many factors to precise windows before “clinical onset” or “clinical worsening” of generalised anxiety disorder (s 9). Practitioners must be careful to identify and prove the date of clinical onset or worsening. The SoP does not define “clinical onset” or “clinical worsening” within the body of the instrument; those terms are used as determinative anchors for multiple factors. The absence of an express definitional gloss means assessors and experts must clarify dates in their reports and decision-makers must make factual findings about those dates.

Narrow definitions that exclude plausible evidence

• The Schedule’s definitions can exclude evidence that claimants might expect to rely on. For example:
  • “Witness” is defined to exclude persons exposed only to public broadcasting or mass media coverage of the incident (Schedule 1). A claimant who experienced a distressing event only through media coverage cannot rely on a s 9 factor that requires a witness as defined.
  • “Corpse” excludes seeing a closed body bag or viewing a body in an open-casket coffin (Schedule 1), so some traumatic viewing experiences will not meet the SoP’s “corpse” criterion.
• These fine distinctions matter when assembling documentary proof of stressors.

DSM-conformant diagnostic requirement and duration requirement

• Generalised anxiety disorder in the SoP follows DSM‑5‑TR and requires excessive anxiety and worry occurring more days than not for at least six months (s 7(3)(a)). That six-month duration is a gating requirement: complaints lasting less than this period do not meet the SoP’s criteria for GAD. For claimants with briefer symptom duration, other categories (substance-induced, due to another medical condition, other/unspecified anxiety disorder) may be relevant, but the delineation must be carefully argued.

Exclusions of common anxiety-type disorders

• The SoP excludes agoraphobia, panic disorder, selective mutism, separation anxiety disorder, social anxiety disorder and specific phobia (s 7(7)). Claims framed generically as “anxiety” must therefore be analysed to see whether the claimant’s presentation actually fits the SoP’s included categories. If the clinical presentation better fits one of the excluded diagnoses, a different SoP may govern.

Mefloquine and specific substance timing

• Mefloquine is singled out as a factor if taken within 24 hours before clinical onset or worsening where the disorder persists after discontinuation or tapering (ss 9(16), 9(40)). Similarly, use of specified psychoactive substances at an intoxicant dose within 24 hours before onset/worsening is a factor (ss 9(17), 9(41); Schedule 1 for the specified list). The 24-hour window is narrow; evidence must show precise timing of ingestion relative to symptom onset. The requirement that symptoms persist after discontinuation for mefloquine adds another evidentiary hurdle.

Substance use cessation/reduction timings

• The SoP treats cessation or reduction of therapeutic or illicit drug use within 10 days before clinical onset/worsening as a factor for substance/medication-induced anxiety disorder or its worsening (ss 9(20), 9(44)). Again, proof of the exact timing of cessation or reduction is necessary.

Caffeine and tobacco thresholds

• For persons without a regular caffeine habit (as defined in the Schedule), taking at least 200 mg of caffeine within one hour of onset is a factor; for regular caffeine users the threshold is 400 mg (ss 9(23)-(24); Schedule 1 defines regular caffeine habit). Practitioners must gather evidence of habitual consumption and precise intake within an hour of onset, which can be challenging.
• Tobacco is treated quantitatively: at least 0.5 pack-years before onset/worsening is required, and if smoking ceased, the onset/worsening must occur within three months of cessation (ss 9(22), 9(46); Schedule 1 defines pack-year). This numerical threshold may be missed if smoking histories are not elicited or calculated correctly.

METs and physical capacity measurement

• One factor is inability to undertake physical activity greater than 3 METs for a continuous period of at least the three months before clinical onset/worsening (ss 9(14), 9(38); Schedule 1 defines MET). Obtaining evidence to demonstrate MET capacity historically, over the requisite continuous three-month period, can be difficult unless medical/occupational records exist.

Clinically significant disorder of mental health

• The Schedule provides an extensive list of disorders that count as a “clinically significant disorder of mental health” and includes a note that “ongoing management” may involve regular visits such as at least monthly to a psychiatrist, counsellor or GP (Schedule 1). It also notes that warranting ongoing management does not require that actual management was received (Schedule 1 Note 2). This means that a prior condition can be a factor even if there is no record of treatment, but claimants must show that the condition was of sufficient severity to warrant ongoing management.

Interaction with other SoPs and imported factors

• Section 11 means that factors which reference conditions covered by other SoPs import that other instrument’s factors “as in force from time to time”. Practitioners must therefore be alert to parallel SoPs and be cautious about changes to those instruments that can affect causation in an anxiety claim.

Application limits for worsening vs onset

• Subsections 9(25)-9(48) are expressly framed for clinical worsening and, per s 10(2), apply only to material contribution to or aggravation of anxiety disorder where the disorder was suffered or contracted before or during , but not arising out of , relevant service. This is an important procedural distinction: where the disorder arose out of service the s 9(25)-(48) regime will not apply in the same way, which can complicate claims involving pre-existing conditions.

Death linkage requires terminal event contribution

• For death from anxiety disorder the SoP includes deaths from terminal events or conditions that were “contributed to by the person’s anxiety disorder” (s 7(8); Schedule 1 terminal event). Practically, medical evidence must link anxiety disorder to the proximate/ultimate cause of death (for example through physiological deterioration or complication) rather than rely on mere contemporaneity.

Evidence planning and medical reporting

• Start with a structured clinical assessment that maps the claimant’s presentation against the DSM‑5‑TR‑derived criteria in s 7. A medical expert report should explicitly state whether the diagnostic criteria for the relevant category (generalised anxiety disorder, substance/medication-induced anxiety disorder, anxiety disorder due to another medical condition, or other specified/unspecified anxiety disorder) are met and provide objective support for the date of clinical onset and, if applicable, the date of clinical worsening (s 7(2)-(6); s 9).

Demonstrate at least one s 9 factor and its temporal relation

• The SoP requires at least one factor in s 9 to be present. Practitioners should choose the strongest available factor and document it thoroughly, ensuring the event or exposure falls within the specified timeframe before clinical onset or worsening (for example category 1A stressor within two years for onset, s 9(1)). Where relying on exposures such as mefloquine or psychoactive substances, document timing of ingestion relative to symptom onset (24-hour windows in ss 9(16)-(19) and corresponding worsening factors).

Tie the factor to relevant service

• Section 10(1) requires the factor to be related to relevant service as defined in the Schedule. Evidence that connects the identified factor to the claimant’s service record is therefore essential. Obtain service records, deployment logs, incident reports, unit diaries, and witness statements that link the stressor or exposure to the person’s period or circumstances of relevant service.

Check whether the matter is one of onset or worsening

• If the claimant had anxiety before service or developed it during service but not out of service, s 10(2) limits the application of s 9(25)-(48). Determine whether the claim concerns new-onset (use ss 9(1)-(24)) or aggravation/worsening of a pre-existing condition (ss 9(25)-(48)). Tailor the evidence accordingly.

Collect documentary and contemporaneous proof

• For traumatic stressors, obtain contemporaneous military notifications, incident reports, police reports, medical entries, and witness statements. For exposures (drugs, substances), supply pharmacy dispensing records, prescribing records, Defence medical records, or contemporaneous notes confirming use and timing. For death of family/close friend or miscarriage, obtain death certificates, medical records, or coroner reports where applicable. For persistent pain, obtain pain management clinic records, analgesic prescriptions, and occupational health notes (Schedule 1 persistent pain definition).

Quantify lifestyle measures precisely

• BMI: record contemporaneous weight and height measurements to calculate BMI (Schedule 1 defines BMI as W/H2 and obesity as BMI ≥30). If only historical self-reports are available, collect corroborating notes from GPs or military medical records.
• Smoking: calculate pack-years using Schedule 1 methodology and document dates of cessation if applicable (ss 9(22), 9(46); Schedule 1 pack-year).
• Caffeine: document habitual use and acute intake around symptom onset. Establish whether the claimant meets the “regular caffeine habit” definition (more than 200 mg daily for at least two weeks) to determine applicable thresholds (ss 9(23)-(24); Schedule 1).
• METs: obtain occupational or exercise testing results where possible; otherwise obtain corroborative assessments from treating clinicians about functional capacity and the claimant’s inability to undertake >3 METs for the continuous three-month period required (ss 9(14), 9(38); Schedule 1).

Address medical causation where another medical condition is relied on

• If advancing anxiety disorder due to another medical condition, the clinician must provide evidence from history, examination or laboratory findings that the disturbance is the direct pathophysiological consequence of that medical condition and not merely its psychosocial stress effects (s 7(4); s 9(15), s 9(39)). Opinion evidence should explain pathophysiological mechanisms and cite relevant investigations.

Document prior mental health conditions and management

• If relying on prior clinically significant disorder of mental health as a factor, document diagnosis, severity and whether the condition warranted ongoing management as per the Schedule (evidence of regular visits, referrals, prescriptions). The Schedule lists conditions that qualify and notes that ongoing management need not have actually occurred (Schedule 1).

Use cross-referenced SoPs where relevant

• If a s 9 factor refers to a condition covered by another SoP, obtain and apply the factors in that other SoP as required by s 11. Practitioners should identify any implicated SoPs early in claim preparation and obtain the relevant medical evidence mapped to those SoP factors.

Be explicit about the relationship to service

• Reports should make an express opinion about whether and how the factor is connected to the claimant’s relevant service as defined in the Schedule. This is necessary under s 10(1). For secondary factors (having a family member experience a stressor etc), establish the relational facts and timing.

Prepare for potential evidentiary gaps

• Recognise common evidentiary weak points and plan to mitigate them. If contemporaneous records are lacking, obtain comprehensive medico‑legal reports that explain why retrospective diagnosis is reliable, corroborative testimony, unit-level records, employer statements about functional capacity, or sworn statutory declarations from family and witnesses. Address the credibility and reliability of such evidence in expert reports.

Anticipate and document inability to obtain treatment

• If relying on s 9(48) (inability to obtain appropriate clinical management for anxiety disorder before clinical worsening), document attempts to obtain treatment, wait lists, referrals declined, or geographical/service barriers, with dates and supporting correspondence.

Address the death linkage carefully

• For claims involving death from anxiety disorder, ensure medical evidence links the anxiety disorder to the terminal event in a causal manner (s 7(8); Schedule 1 terminal event list). Expert evidence should address proximate causes, contributory mechanisms and medical plausibility.

Check exclusions and ensure correct diagnostic fit

• Ensure the claimant’s clinical picture aligns with disorders covered by this SoP and not with excluded diagnoses (s 7(7)). If excluded disorders better explain the presentation, identify the correct SoP and evidence package.

Practical checklist for claim file

• Completed DSM-5-TR conformant clinical assessment and dates of onset/worsening (s 7).
• Service records linking event/exposure to relevant service and timestamps (s 10; Schedule 1 relevant service).
• Documentary support for the selected s 9 factor within its temporal window (incident reports, medical records, prescriptions, pharmacy/dispensing records, death certificates, etc).
• Quantitative measures: BMI calculations, pack-year computation, caffeine habit documentation, METs evidence (Schedule 1).
• Substance exposure evidence: mefloquine prescriptions, dates, persistence of symptoms after discontinuation; evidence of intoxicant dosing where applicable (s 9(16)-(19), s 9(40)-(43); Schedule 1 specified list and intoxicant dose).
• Evidence of prior mental health conditions and management, or lack of access to treatment if alleging s 9(48).
• Expert medico-legal report mapping facts to SoP factors and addressing alternative explanations (psychosocial vs pathophysiological causation, differential diagnoses).
• Identification of any other SoPs implicated by s 11 and corresponding evidence.

Administrative practice note

• Because the SoP replaces the 2014 instrument without transitional clauses, practitioners should verify with the administering agency whether legacy claims are subject to the new SoP or transitional arrangements. In preparing reports and evidence, state explicitly which version of the SoP is being addressed.

Record retention and privacy

• Maintain complete medical and evidentiary records that support the facts at the relevant dates. Given the sensitivity of health data, ensure compliance with applicable privacy and disclosure protocols when assembling and submitting claim materials.

By structuring medical and factual evidence to align with the SoP’s diagnostic criteria, temporal windows and definitional thresholds, claimants and their advisers materially increase the likelihood a decision‑maker can apply the SoP’s factors without the assessor having to infer or interpolate missing information.
