Statement of Principles concerning acute stress disorder (Reasonable Hypothesis) (No. 95 of 2022)

The central concept is the ‘reasonable hypothesis’ standard. Under the VEA and MRCA, a claimant does not need to prove causation on the balance of probabilities. Instead, they must raise a reasonable hypothesis connecting the injury or disease to service. This SoP defines the minimum factors that can give rise to that hypothesis. The instrument does not alter the higher standard of proof, but it constrains the hypothesis by listing exclusive pathways. If no factor in section 9 is satisfied, the claim must fail on the causation element, regardless of any other evidence of a connection.

The definition of acute stress disorder is taken directly from DSM-5-TR, which is an American diagnostic manual. The instrument incorporates the full text of the criteria in section 7(2). The disorder is distinguished from post-traumatic stress disorder (PTSD) mainly by the duration: three days to one month, compared to PTSD’s longer timeframe. This creates a tight window for compensation eligibility. The requirement that symptoms begin or worsen after the traumatic event means the clinical onset must be established as occurring after the stressor, and within the 30-day window before the stressor? Actually factor (1) to (6) require the stressor within 30 days before the clinical onset. This means the clinical onset date is decisive; the stressor must occur no more than 30 days before that date. If clinical onset occurs more than 30 days after the stressor, or if the timing cannot be established, the factor is not satisfied. This imposes a significant evidentiary burden on claimants, especially when the disorder is not diagnosed until later or when symptoms have a gradual onset.

Category 1A stressors are life-threatening events: experiencing a life-threatening event, being subject to a serious physical attack or assault (including rape and sexual molestation), or being threatened with a weapon, held captive, kidnapped or tortured. Category 1B stressors are less direct: killing or maiming a person, being an eyewitness to a person being killed or critically injured, being an eyewitness to atrocities, participating in clearance of a corpse or critically injured casualty, or viewing a corpse or critically injured casualty as an eyewitness. The definition of ‘eyewitness’ is strict: the person must experience the incident first hand and give direct evidence. Exposure only through public broadcasting or mass media is excluded. Similarly, ‘corpse’ is defined narrowly as human remains or body parts of one or more persons who have met a violent or horrific death; examples include death from suicide, gunshot, improvised explosive devices, natural and technological disasters, terrorist attacks or motor vehicle accidents. Seeing a closed body bag or viewing a body in an open-casket coffin is explicitly excluded.

‘Being exposed to repeated or extreme aversive details of severe traumatic events’ includes witnessing a person suffering real, severe traumatic events (like first responders collecting human remains, police officers repeatedly exposed to details of child abuse, or drone operators viewing planned strikes) or repeatedly listening to a person’s account of their exposure to severe traumatic events. It includes media exposure only where viewing images is a work requirement. This definition captures occupational exposure for certain military roles.

‘Severe childhood abuse’ means serious physical, emotional, psychological or sexual harm whilst a child aged under 16 years, or neglect involving a serious failure to provide necessities for health, physical and emotional development, perpetrated by a parent, care provider, adult who works with or around that child, or any other adult in contact with that child. Critically, factor 9(6) requires that this abuse be experienced within the 30 days before the clinical onset. This is an odd temporal requirement because childhood abuse typically ends years before service. For the factor to be satisfied, the person must have experienced severe childhood abuse as a child (under 16) and then the clinical onset must occur within 30 days of that abuse. If the abuse ended years ago, the factor is not met. This likely means that only current serving members who are still children (under 18) and experienced abuse within the preceding 30 days could rely on this factor. It may also apply if the abuse occurred shortly before enlistment and clinical onset occurred within 30 days. The definition’s inclusion of ‘serious failure to provide necessities’ may be difficult to prove in a specific time frame.

The concept of ‘significant other’ is defined broadly as a person who has a close family bond or close personal relationship and is important or influential in one’s life. Factor (3) requires that a significant other experiences a category 1A stressor within the 30 days before the clinical onset. Factor (4) requires experiencing the traumatic death of a significant other within the same window. These factors extend coverage to secondary victims, but only for category 1A stressors (not 1B stressors) and only for traumatic death (not natural death).

The temporal requirement of 30 days before clinical onset is a crucial concept. It creates a bright-line rule. This may be advantageous for decision-makers but can be arbitrary. A claimant whose clinical onset occurs 31 days after the stressor is excluded. The instrument does not allow for a gradual onset or delayed presentation, which are recognised clinically for acute stress disorder (symptoms typically begin immediately after trauma, but diagnosis requires at least 3 days and up to 1 month). The 30-day window tracks the diagnostic duration of the disorder, but the requirement that the stressor occur before clinical onset may cause confusion: the disorder by definition begins within days of the stressor, so clinical onset usually coincides with the stressor. The SoP’s language ‘within the 30 days before the clinical onset’ effectively requires that the stressor and the onset be in close proximity, but it does not require that the stressor be the sole cause; it only requires a temporal connection.

The primary affected population is veterans, members of Peacekeeping Forces, and members of the Forces under the VEA, and members under the MRCA, who make a claim for compensation in respect of acute stress disorder or death from acute stress disorder. The instrument applies to claims that fall under the reasonable hypothesis standard, which is the standard for most claims for operational service, peacekeeping service, hazardous service, British nuclear test defence service under the VEA, and warlike or non-warlike service under the MRCA. This covers a broad range of current and former Australian Defence Force personnel.

The instrument directly affects decision-makers at the Department of Veterans’ Affairs (DVA) and the Veterans’ Review Board, who must apply the SoP when determining whether a reasonable hypothesis has been raised. They must assess whether the claimant has suffered a category 1A or 1B stressor, or other defined stressor, within the required timeframe, and whether the stressor was related to service. They also must apply the definitions strictly, for example, determining whether an event is a ‘traumatic death’ or whether a person is an ‘eyewitness’. This can lead to disputes about the characterisation of events.

Medical practitioners who provide reports in support of claims are also affected. They must be familiar with the diagnostic criteria in the SoP (which tracks DSM-5-TR) and with the definitions of stressors. They may need to specify the date of clinical onset and document the nature of the stressor. For veterans with complex trauma histories, the requirement to identify a specific stressor within 30 days of onset may be challenging. The SoP may influence clinical practice by incentivising precise recording of onset dates.

Legal practitioners and advocates who represent claimants must understand the SoP’s factor structure and definitions. They must advise clients on whether their circumstances fit within the defined stressors, and gather evidence to prove the temporal relationship. The narrow definitions may limit the pool of claimants eligible to raise a reasonable hypothesis.

The instrument also affects the Repatriation Medical Authority, which is required to review the SoP periodically and may make amendments. The current SoP replaces the 2014 version; changes in definitions (such as the introduction of DSM-5-TR and refined definitions of stressors) may affect ongoing claims.

Indirectly, the instrument affects the government budget by determining which claims are accepted or rejected. The costs of compensation for acute stress disorder include disability pension, treatment, and possibly death benefits. By imposing strict temporal and definitional constraints, the SoP likely reduces the number of successful claims compared to a more flexible test based solely on clinical judgment. This may be seen as fiscally prudent or as under-compensating veterans with genuine trauma depending on one’s perspective.

Finally, the instrument affects family members or dependants who may be eligible for benefits following a death from acute stress disorder. The definitions of ‘significant other’ and ‘traumatic death’ narrow the circumstances under which a secondary stressor claim can succeed.

The instrument creates no directly enforceable duties or rights, but it structures the application of existing rights under the VEA and MRCA. The primary right of a claimant is to have their claim determined in accordance with the applicable standard of proof, which for relevant service is the reasonable hypothesis standard. The SoP defines the minimum necessary elements of that hypothesis. If a claimant can satisfy at least one factor in section 9 and the factor is related to their relevant service (section 10(1)), they are entitled to have the claim determined in their favour on the causation issue, subject to other requirements of the VEA or MRCA.

The decision-maker has a duty to apply the SoP correctly. This means they must interpret the definitions as set out in Schedule 1 and not substitute a broader meaning. For example, ‘eyewitness’ expressly excludes persons exposed only to public broadcasting or mass media coverage. A decision-maker cannot accept a claimant’s report of seeing a news broadcast as satisfying that definition. Similarly, they must enforce the 30-day temporal requirement and cannot waive it on compassionate grounds. The decision-maker also has a duty to consider whether the factor is ‘related to the relevant service’. This requires a causal or circumstantial connection; simply experiencing a stressor while on service is generally sufficient if the stressor arises out of the service.

Where a factor refers to an injury or disease covered by another SoP, section 11 incorporates the factors of that other SoP. This imposes a duty on the decision-maker to consider that SoP if the claimant’s factor is, for example, ‘experiencing a category 1A stressor’ that itself involves a physical injury. If the stressor is a serious physical attack, that attack may constitute a physical injury for which another SoP applies. The decision-maker must then determine whether the claimant meets the factors of that other SoP to establish that the physical injury is related to service. This layered approach can increase complexity.

The right of the claimant to rely on factor 9(7) (inability to obtain appropriate clinical management) is limited by section 10(2). That subsection states the factor applies only to material contribution to, or aggravation of, acute stress disorder where the person’s acute stress disorder was suffered or contracted before or during (but did not arise out of) the person’s relevant service. This means that if the acute stress disorder is accepted as arising out of service (i.e., caused by service), factor 9(7) cannot be used. It only applies to aggravation of a pre-existing condition. Claimants with a pre-existing acute stress disorder that is aggravated by inability to obtain clinical management during service may use this factor, but the burden is on them to prove the aggravation and the inability to obtain management.

The instrument also confers rights on the Repatriation Medical Authority: it has the authority to determine and amend SoPs under section 196B(2) of the VEA. The Authority’s discretion in setting the factors is broad, subject to the requirement that there be sound medical-scientific evidence. The instrument does not create a right for claimants to challenge the SoP itself; they can only challenge its application to their facts.

This instrument does not contain any penalty provisions. It is a legislative instrument that sets evidentiary standards rather than prohibitions or obligations enforceable by criminal or civil penalties. However, penalties under other laws may apply if a claimant makes a false or misleading statement in connection with a claim. The VEA and MRCA contain provisions that make it an offence to knowingly provide false or misleading information in a claim for compensation. Such penalties exist independently of the SoP.

Enforcement of the SoP occurs through the claims determination process. If the DVA incorrectly applies the SoP, a claimant may seek review by the Veterans’ Review Board, and ultimately the Administrative Appeals Tribunal (AAT) and the Federal Court. These bodies can set aside a decision that does not correctly apply the SoP and substitute a correct decision. Failure to comply with the SoP by a decision-maker does not attract a penalty but can lead to the decision being set aside.

The Repatriation Medical Authority has no enforcement function regarding the SoP; its role is limited to making and reviewing SoPs. The instrument itself is not subject to enforcement; it is the underlying compensation legislation that carries enforcement mechanisms.

There is also the potential for the Commonwealth Director of Public Prosecutions to investigate and prosecute fraud where a claimant or their representative fabricates evidence of a stressor or onset date to fit within the SoP. The strict definitions and temporal requirements may create incentives for misrepresentation of facts, especially where a claimant’s genuine trauma falls just outside the criteria. The enforcement of fraud relies on evidence gathering by DVA investigation branches and the AFP.

The instrument does not provide for any civil penalties, fines, or infringement notices for non-compliance. Its ‘teeth’ come from the structure of the compensation system: if a factor is not made out, the claim fails, and the claimant bears the cost of their own evidence and legal fees. This may be an effective gatekeeping mechanism from the government’s perspective.

The SoP operates within the framework of the Veterans’ Entitlements Act 1986 and the Military Rehabilitation and Compensation Act 2004. Specifically, it is made under subsection 196B(2) of the VEA and applies to claims under sections 120A of the VEA and 338 of the MRCA. These provisions require the decision-maker to determine claims for diseases by reference to the applicable SoP. If a SoP has been determined, the decision-maker must apply it; if the SoP provides that a reasonable hypothesis cannot be raised on the facts, the claim must be rejected.

The SoP interacts with other SoPs through section 11. If a factor (such as experiencing a category 1A stressor) incorporates a physical injury or disease that is itself covered by a separate SoP, then the factors in that other SoP apply. For example, if a claimant experiences a serious physical attack that results in a separate injury like traumatic brain injury, the decision-maker must consider the SoP for that injury to determine if the attack is related to service. This creates a cascade of evidentiary requirements.

The instrument repeals the previous SoP (No. 41 of 2014) and thus replaces the old definitions and factors. Any claims not yet determined as of 21 November 2022 are assessed under the new instrument. Claims already determined may be reopened if the new SoP is more favourable, subject to the rules on review and reconsideration in the VEA and MRCA. The instrument does not specify transitional provisions beyond the repeal; it applies to claims to which section 120A or 338 applies, which is ongoing.

The definition of acute stress disorder is derived from DSM-5-TR, which is an American diagnostic manual. Australian clinical practice may use the ICD-11 or the Australian adaptation of DSM. The SoP’s adoption of DSM-5-TR may lead to misalignment with Australian diagnostic standards, but the SoP is binding regardless. Medical practitioners may need to frame their diagnoses in terms that match the SoP’s criteria.

The interaction with common law concepts of causation is relevant. The reasonable hypothesis standard is lower than the civil standard of proof. The SoP does not displace the need for the hypothesis to be reasonable; it merely sets a floor of factors that must exist. If a claimant meets a factor, a reasonable hypothesis is raised, but the decision-maker must still consider whether any alternative hypothesis based on non-service factors outweighs the service hypothesis - although the ‘raised reasonable hypothesis’ standard means that if the SoP factor is met, the claim must succeed unless the decision-maker can exclude the hypothesis beyond reasonable doubt (per VEA s 120). The SoP therefore interacts with the burden of proof provisions.

The instrument also interacts with state and territory workers’ compensation schemes, but only to the extent that a veteran might be covered by both. Generally, the VEA and MRCA are exclusive for defence-related injuries, but there may be overlapping coverage. The SoP does not address this; it is solely for the purposes of the federal acts.

The instrument is a new determination that repeals and replaces the Statement of Principles concerning acute stress disorder (Reasonable Hypothesis) No. 41 of 2014. The previous SoP was made under subsections 196B(2) and (8) of the VEA. The new instrument is made under subsection 196B(2) only (no subsection (8) for this one). The reason for the change is not stated in the instrument, but the use of DSM-5-TR (2022) instead of DSM-5 (2013) suggests an update to reflect the latest diagnostic criteria. The 2014 SoP used DSM-5; the current one uses the text revision. The definitions of stressors may also have been refined. For example, the new SoP adds explicit notes about drone operators and work-related media exposure in the definition of ‘being exposed to repeated or extreme aversive details of severe traumatic events’. The definition of ‘traumatic death’ is also new - the 2014 SoP may have had a different term. Without access to the old instrument, we can note that the current SoP is more specific in several definitions, which may narrow or broaden eligibility depending on the change. The 2014 SoP was also made under both subsections 196B(2) and (8); the current one is only under (2). Subsection (8) concerns statements of principles for the reasonable satisfaction of the Commission; its omission may reflect a change in the legislative framework.

The instrument commenced on 21 November 2022, one month after it was made (21 October 2022). There is no further amendment history because it is the first version since 2014. The Repatriation Medical Authority may amend or revoke SoPs in the future as evidence evolves.

The instrument itself does not cite any case law. However, the application of SoPs in general has been the subject of significant litigation in the AAT and Federal Court. Cases often deal with the interpretation of definitions, the meaning of ‘reasonable hypothesis’, and whether a factor is satisfied on the facts. Specific to acute stress disorder, there may be cases where claimants disputed the timing of clinical onset or the characterisation of a stressor as a category 1A or 1B event. The instrument does not provide a history, so we cannot name any cases. It is safe to assume that the DVA, VRB and AAT have applied the 2014 SoP in numerous decisions, and the 2022 SoP will generate further disputes, particularly around the new definitions such as ‘work-related media exposure’ and ‘traumatic death’. The strict temporal requirement may be challenged in cases where onset is difficult to pinpoint. However, the instrument’s language is regulatory, not judicial, so no litigation history is recorded within it.

Several traps lie in the interstices of the definitions and temporal requirements.

First, the 30-day limit: the stressor must occur within 30 days before the clinical onset. If the clinical onset is not clearly documented, the claim may fail. Moreover, if the clinical onset occurs before the stressor (which is impossible if the stressor is the cause, but a prior asymptomatic condition may be aggravated), the factor cannot be used for initial onset. Factor 9(7) (inability to obtain appropriate clinical management) is only for aggravation of a pre-existing condition (s 10(2)). So a veteran who had acute stress disorder before service and whose condition is aggravated by inability to get treatment during service can use factor 9(7), but only if the disorder did not arise out of service. If the disorder arose out of service, factor 9(7) cannot be used, and the other factors must be shown on initial onset.

Second, the definition of ‘being exposed to repeated or extreme aversive details of severe traumatic events’ has a work requirement for media exposure. A veteran who sees graphic images of trauma on the news while off duty cannot rely on this factor, but a drone operator who views planned strikes as part of their work can. This may create an arbitrary distinction: two veterans may experience the same psychological impact, but only the one whose exposure is work-related gets the factor.

Third, category 1A stressor includes ‘being threatened with a weapon, being held captive, being kidnapped or being tortured’. It does not include being threatened without a weapon, or being verbally abused, or being subjected to non-physical intimidation. A veteran who is threatened by a colleague with a knife may have a category 1A stressor, but one who is threatened with a lawsuit or career reprisal likely does not.

Category 1B stressor includes viewing a corpse or critically injured casualty. However, viewing a closed body bag is excluded from the definition of ‘corpse’. So a soldier who sees a closed body bag may not satisfy the factor unless they also view the remains inside. Similarly, viewing an open-casket coffin is excluded. This could lead to absurd results: viewing a mangled body in an emergency room may count, but viewing a respectful coffin may not, even if the emotional impact is similar.

Fourth, the definition of ‘traumatic death’ requires death in sudden, violent or traumatic circumstances such as homicide, suicide or accidental death. It excludes death from natural causes, including sudden heart attack. A significant other who dies of a heart attack does not qualify, even if the death is sudden and distressing. This narrows the secondary victim factor (4) considerably.

Fifth, severe childhood abuse factor (6) requires that the abuse occur within 30 days before the clinical onset. For an adult veteran, this is almost impossible because childhood abuse occurred many years earlier. The only scenario is if the veteran is under 16 years of age and serving? That seems unlikely but possible for cadets or junior recruits. Alternatively, if the veteran experiences a flashback that triggers clinical onset, that does not satisfy the factor - it requires the abuse itself to occur within 30 days. This factor appears to be a drafting residue with limited practical application, except perhaps for young serving members.

Sixth, factor (3) requires a significant other to experience a category 1A stressor. If the significant other experiences a category 1B stressor (e.g., witnessing a death), that does not count. This asymmetry may be unintentional.

Seventh, the term ‘clinical onset’ is not defined. Disputes may arise about whether it means the first appearance of sufficient symptoms to meet the diagnostic criteria, or the date of first medical consultation. The SoP does not specify; it may be left to the decision-maker. The DSM-5-TR criteria require symptoms to persist for at least 3 days, so clinical onset likely cannot occur on the same day as the stressor; it must be after the symptoms have been present for at least 3 days. The SoP’s 30-day window runs from 30 days before onset to the date of onset, so theoretically the stressor could occur up to 33 days before the onset? No, the stressor must be within 30 days before onset. So if onset is day 5 after the stressor, the stressor is within 30 days before onset. If onset is day 32 after the stressor, the stressor is more than 30 days before onset, and the factor fails even though the acute stress disorder criteria only require duration of up to one month. This can happen if the person has a delayed presentation; for example, symptoms start at day 2 but the person does not meet the nine-symptom threshold until day 32, and the diagnosis is then made. The SoP may require that the clinical onset be considered the date when the full disorder criteria are first met, but the symptoms began earlier. This is a trap for practitioners: they must identify the onset date precisely.

Compliance with this SoP is not a voluntary act by individuals; rather, it is a standard to be met by claimants and applied by decision-makers. For a claimant seeking to raise a reasonable hypothesis for acute stress disorder, the following steps are necessary.

First, secure a diagnosis that matches the DSM-5-TR criteria in section 7(2). The diagnosis should be made by a qualified mental health practitioner and should explicitly state that the criteria A through E are met. The diagnosis must note the date of clinical onset - that is, the date when the full criteria (including nine symptoms) were first present. It must also confirm that the disturbance is not attributable to substances or another medical condition. The duration must be between 3 days and 1 month at the time of diagnosis, but the claim may be made later if the condition has resolved or become chronic? The SoP relates to the disorder as defined, so if the person continues to have symptoms beyond one month, they may have PTSD instead, not acute stress disorder. Claimants with symptoms beyond one month should consider a separate claim for PTSD under its SoP.

Second, identify a stressor from the defined categories in Schedule 1 that occurred within 30 days before the clinical onset. The stressor must be related to service. For most veterans, the stressor will be a category 1A or 1B stressor. The claimant must provide evidence of the event, such as incident reports, witness statements, or medical notes. If the stressor involves a death, the death must be traumatic. If it involves repeated exposure to aversive details, the exposure must be work-related (for media) and the claimant must provide evidence that they were required to view the images as part of their duties.

Third, establish the temporal relationship. The evidence must show the date of the stressor and the date of clinical onset. This may require a medical report that gives a specific onset date. If the medical report only says ‘approximately’ or ‘around’, the claim may be rejected for lack of precision. It may be necessary for the medical practitioner to estimate the onset date based on a retrospective history.

Fourth, if the claimant cannot satisfy any of the six stressor factors, they may consider factor 9(7) - inability to obtain appropriate clinical management. This only applies if the acute stress disorder existed before or during (but did not arise out of) service. The claimant must show that the condition was aggravated by the inability to obtain clinical management during service. They must provide evidence that clinical management was unavailable, inadequate, or delayed, and that this materially contributed to the aggravation.

Fifth, the claimant must ensure that the factor is related to service. For operational service, a stressor occurring on service will generally be related. For non-operational service, the stressor must arise out of or be attributable to service. If the stressor occurred during a period of leave off base, it may not be related.

For decision-makers, compliance involves checking every element of the SoP. They must verify the diagnosis against the DSM-5-TR criteria. They must ensure that the stressor fits within the defined categories, and not accept a broader interpretation. They must calculate the 30-day window precisely. They must apply section 11 if a factor refers to another SoP. They must also respect section 10(2) - if the claim is for aggravation of a pre-existing disorder, factor 9(7) is the only one that can be used, but other factors may apply for initial onset if the condition arose out of service.

Practitioners advising claimants should gather detailed statements about the stressor and its timing. They should obtain a comprehensive psychiatric report that addresses the DSM-5-TR criteria and the specific factor. They should be aware of the narrow definitions and not assume that a traumatic event will fit. For example, if a veteran’s friend died of a heart attack while on duty, that is not a traumatic death under the definition; the claim should be based on a different factor such as being an eyewitness to the death if it was sudden and unexpected? The definition requires ‘sudden, violent or traumatic circumstances’. A heart attack is not violent and may not be traumatic in the sense of external violence; it might not qualify. The practitioner should consider whether the veteran witnessed the event and whether that witnessing meets category 1B (seeing a person being critically injured - a heart attack could be a critical injury). But the definition of ‘being critically injured’ may require physical injury. This is a grey area; a definitive ruling would depend on the AAT.

Finally, the instrument applies to claims under both VEA and MRCA. Claimants under MRCA should note that the definition of ‘relevant service’ includes warlike and non-warlike service. The SoP applies equally. There is no difference in the factor analysis between the two acts, but the underlying legislation (VEA s 120A and MRCA s 338) have slightly different wording for the reasonable hypothesis test; however, the SoP is designed to work with both.

Compliance is a matter of evidence and careful interpretation. The cost of non-compliance is claim rejection, which in turn may mean loss of access to disability pension, treatment, and other benefits. Given the strictness of the temporal and definitional requirements, claimants are well advised to seek legal or advocacy assistance early. The Repatriation Medical Authority will not provide individual guidance; compliance responsibilities rest entirely on the parties.
