Statement of Principles concerning acute pancreatitis (Balance of Probabilities) (No. 6 of 2020)

This SoP is constructed around a small set of legal‑medical mechanics. The core concepts are: the medical definition of acute pancreatitis; the balance‑of‑probabilities causal standard; a closed list of qualifying factors; temporal and threshold conditions for certain factors; the requirement that any qualifying factor be related to relevant service; and cross‑reference to other Statements of Principles where overlap exists.

Definition of condition: Acute pancreatitis is defined in clinical terms in subsection 7(2) as an acute inflammatory condition due to auto‑digestion of pancreatic tissue by its own enzymes. The instrument notes that acute pancreatitis typically presents with abdominal pain and is usually associated with raised pancreatic enzymes (s7(2) note). Although ICD‑10‑AM code K85 is acknowledged (s7(3)), the statutory meaning for SoP purposes is the instrument’s clinical definition (s7(2)).

Causal standard: The instrument repeatedly frames its determinations around the balance of probabilities. The Repatriation Medical Authority states that, on the sound medical‑scientific evidence available, it is of the view that it is more probable than not that acute pancreatitis can be related to relevant service (s8). This is the standard applied by the Authority in setting the factors in s9, and it is the standard claimants must meet when relying on the SoP in claims processed under VEA s120B or MRCA s339 (s5).

Closed list of factors: Section 9 lists the specific factors any of which, if established and related to relevant service, suffice to connect acute pancreatitis (or death from it) to service. The factors include behavioural exposures (smoking, alcohol), clinical conditions (cholelithiasis, biliary sludge, pancreatic outflow obstruction, diabetes mellitus, hypertriglyceridaemia, hypercalcaemia), procedural and traumatic triggers (defined time windows for trauma, surgery, ERCP and other procedures), iatrogenic or pharmacological exposures (specified list of drugs and an individual‑drug association test), infections and infestations (specified organisms and parasitic infestations), envenomation and toxic ingestions (specified snakes/scorpions, alpha‑amanitin mushroom toxicity, specified agents), dialysis and transplant status, obesity for severe pancreatitis, and inability to obtain appropriate clinical management (s9(1)-(26)).

Temporal and quantitative limits: Many factors have defined temporal windows and numeric thresholds. Examples include smoking of at least 15 pack‑years with onset within ten years of cessation if smoking has ceased (s9(1) and Schedule 1 definition of pack‑years); alcohol consumption averaging at least 420 grams per week for ten years before onset (s9(2)); trauma or spinal cord injury within seven days prior to onset (s9(6)-(7)); procedures within 30 days (s9(8)); ERCP, sphincterotomy, or sphincter manometry within seven days (s9(9)); dialysis “at the time of” clinical onset (s9(10)); triglyceride levels above 11.3 mmol/L at clinical onset (s9(15)); and obesity defined as BMI 30 or greater for severe acute pancreatitis (s9(25) and Schedule 1).

Relation to service and special rule for lack of appropriate management: Section 10 requires that any factor listed in s9 be related to the person’s relevant service. A specific rule limits the application of factor 9(26) (inability to obtain appropriate clinical management) to cases where the person’s acute pancreatitis was suffered or contracted before or during, but did not arise out of, the person’s relevant service; in such cases the inability to obtain appropriate clinical management may materially contribute to or aggravate acute pancreatitis (s10(2)). Thus 9(26) cannot be used to assert that service caused the initial onset when onset occurred out of service.

Cross‑application to other Statements: Where a factor refers to an injury or disease covered by another SoP, the other SoP applies as in force at the relevant time (s11). This creates dependency and potential variability over time because the other SoP might be amended; the instrument makes clear that the terms of the other SoP govern in such cases.

Definitions as operational rules: Schedule 1 supplies the technical definitions used to apply the factors, for example the organisms that qualify as “acute infection with an organism”, the calculation of pack‑years, the composition of the specified lists of drugs, infestations, procedures, agents, snakes and scorpions, and the cutoffs for BMI, triglycerides and other clinical measures. The definitions are part of the operative law (s6, Schedule 1).

This instrument affects three groups directly and several secondary actors involved in veterans’ compensation and medical assessment processes.

Primary affected persons

• Veterans and members of the Forces who lodge or may lodge claims that involve acute pancreatitis or death from acute pancreatitis under the VEA or MRCA. The instrument explicitly applies to claims to which VEA s120B or MRCA s339 applies (s5). Those individuals must demonstrate that at least one factor in s9 existed and that it is related to their relevant service (s9, s10(1)).

• Medical practitioners and forensic clinicians responsible for diagnosing acute pancreatitis, compiling clinical records, and providing evidence or expert opinions for claims. The SoP specifies clinical and laboratory thresholds (for example raised pancreatic enzymes, triglycerides >11.3 mmol/L, BMI ≥30) and timing windows for procedures and exposures. Clinicians will be asked to document onset dates, lab values at the time of clinical onset, procedural dates, medication histories (including dates of initiation and discontinuation), and diagnoses such as cholelithiasis, biliary microlithiasis or sludge, and pancreatic outflow obstruction.

Decision‑makers and administrators

• Decision‑makers under the VEA and MRCA who adjudicate entitlement and compensation claims. The instrument constrains adjudicators by listing which factors, if established and related to relevant service, support a conclusion that acute pancreatitis is connected to service (s9, s10). Adjudicators will need to check the definitions in Schedule 1 to establish whether a claimant’s history meets the specific thresholds.

• The Repatriation Medical Authority, which determined and signed the instrument as the authorising medical body (s3). The Authority has the power under s196B(3) of the VEA to set such SoPs; this instrument records its view and establishes the factors it has determined (s3, s8).

Secondary affected actors

• Legal representatives, advocates and advisers preparing claims for affected persons. They must marshal the evidence specified or implied by the SoP: smoking history with pack‑year calculation, sustained alcohol consumption evidence, lab results, imaging, procedure and surgery records, drug therapy records, transplant or dialysis records, entomological/toxicology evidence where applicable, and records showing inability to obtain appropriate clinical management (for s9(26)).

• Record‑keeping institutions, such as hospitals, pathology laboratories and pharmacies, as their records will be relied upon to establish the presence and timing of factors that the SoP requires.

• Where a factor refers to another SoP for a different injury or disease, the persons affected by that other SoP are indirectly implicated because changes to that other SoP may alter the applicability of factors here (s11).

Who pays and who decides

• The instrument itself does not levy charges or allocate monetary payments. Monetary entitlements, if any, arise under the VEA or MRCA once an adjudicator decides on the claim. The Authority determines what factors satisfy the medical link; decision‑makers under the VEA or MRCA apply the SoP in individual claims (s3, s5, s8).

Behavioural and evidentiary adjustments required

• Claimants and clinicians will need to present evidence in the forms the SoP contemplates: histories quantified by pack‑years, documented weekly alcohol consumption over a ten‑year period, exact dates of procedures and traumas, laboratory test results proximate to clinical onset, obesity measure by BMI calculation, and medication timelines that meet the specific individual‑drug association test for s9(13).

• Where a factor references another disease SoP, claimants and advisers must follow that other SoP’s requirements as that other SoP is in force (s11). This creates a requirement to monitor not only this SoP but potentially other SoPs that are cross‑referenced.

This instrument primarily creates evidentiary rules rather than direct personal duties or statutory rights; it shapes how adjudicators assess causal connection for claims. The key legal duties and rights flow from its role as an SoP under the VEA framework.

Duty to establish a qualifying factor and service connection

• A claimant must establish, on the balance of probabilities, that at least one of the factors in s9 existed and that the factor is related to the claimant’s relevant service (s9, s10(1)). The SoP sets the necessary factual predicates that, if proved, support a finding of material contribution or aggravation by service under the VEA or MRCA claims processes.

Duty to use the instrument’s definitions and thresholds

• Adjudicators and medical assessors must apply the definitions in Schedule 1 when construing the factors. For example, smoking must be demonstrated in pack‑years as defined in Schedule 1, and obesity must be shown as BMI ≥ 30 as defined (s9(1); Schedule 1). The instrument makes these definitions integral to compliance (s6).

Duty to relate factors to relevant service

• Section 10(1) requires that any factor in s9 which is relied upon be related to the relevant service rendered by the person. The SoP therefore imposes a duty on decision‑makers to examine whether the factual cause or exposure arose in connection with the person’s qualifying service (relevant service defined in Schedule 1).

Right to rely on listed factors as determinative evidence

• If a claimant satisfies a listed factor and its relation to service, the SoP functions as determinative medical evidence that, on the balance of probabilities, acute pancreatitis or its death is connected to service. The SoP is the Repatriation Medical Authority’s statement of medical opinion that such links are more probable than not given the specified factors (s8). That statutory posture gives claimants the right to rely on the SoP to support entitlement claims under VEA s120B or MRCA s339 (s5), subject to the adjudicator’s application of the SoP to the facts.

Right to other SoPs where overlap exists

• Where a factor in s9 refers to an injury or disease covered by another SoP, the claimant may need to rely on that other SoP. Section 11 provides that the other SoP’s factors apply as in force from time to time. This means claimants have the right to invoke the terms of that other SoP to satisfy the factor, but must accept the other SoP’s terms as currently in force.

Limitations and special duties

• Factor 9(26) is limited by s10(2): it applies only to material contribution or aggravation of acute pancreatitis where the acute pancreatitis was suffered or contracted before or during (but did not arise out of) relevant service. This limits the situations in which inability to obtain appropriate clinical management can be used to connect acute pancreatitis to service and imposes a duty on decision‑makers to distinguish initial causation from aggravation or contribution.

No penal sanctions in the instrument itself

• The SoP does not create criminal offences, fines, or administrative penalties. It operates as a determinative medical authority for evidentiary purposes in claims under the VEA and MRCA (see s3, s5, s8). Any consequences for entitlement or payments depend on the separate decision‑making processes under the VEA or MRCA.

Administrative duties of the Repatriation Medical Authority

• The Authority is the agency that determined the SoP and affixed its common seal (cover sheet and s3). It has the statutory duty to prepare and promulgate SoPs under the VEA; this instrument is one such exercise of that function.

Information duties implicit in the factors

• Implicitly, the SoP requires claimants and their advisers to provide sufficiently precise and contemporaneous evidence to meet thresholds that are numerical or time‑specific, such as triglyceride levels at clinical onset, dates of procedures, and detailed medication histories (s9, Schedule 1). The burden of assembling this evidence falls on claimants and their advisers as part of the claims process.

This instrument does not itself impose penalties, sanctions, or criminal liability. Its function is to provide the Repatriation Medical Authority’s medical determination of the factors that establish a connection between acute pancreatitis and relevant service for claims processed under the VEA and MRCA. The instrument contains no enforcement provisions, infringement penalties, or administrative fines. The legal effect is evidentiary and determinative rather than punitive.

Mechanism of enforcement in practice

• The instrument’s enforcement effect occurs through its use by claim adjudicators under the VEA s120B and MRCA s339 (s5). When a decision‑maker assesses whether acute pancreatitis is connected with relevant service, they must apply the SoP’s factors and definitions to the claimant’s factual and medical evidence. If a claimant proves a factor listed in s9 and establishes its relation to service, that provides determinative medical evidence of connection on the balance of probabilities, which in turn influences entitlement determinations under the primary legislation. The instrument itself does not prescribe the adjudication procedures, remedies, or payment calculations , those are within the VEA and MRCA frameworks.

Absence of sanctioning provisions

• There are no sections in the instrument that create offences for false statements, fraudulent claims, or failure to comply with reporting duties. Any administrative or criminal sanctions for fraud, false representation, or similar conduct would be governed by the VEA, MRCA, or general criminal law rather than by this SoP. The instrument does not purport to replace those provisions.

Evidence and probative effect

• The SoP’s value in enforcement is that it sets out criteria that, when satisfied, show that a condition is related to service on the balance of probabilities (s8, s9). The Authority’s determination of medical factors has probative weight as the product of the Repatriation Medical Authority’s statutory function. Decision‑makers must nonetheless apply the SoP to the facts of each claim; the SoP is not an automatic entitlement generator without factual proof that the claimant actually had the listed factor and that it related to service (s10(1)).

Potential for review of decisions applying the SoP

• This instrument does not create an internal appeal process or judicial review mechanism; those mechanisms, if any, exist in the VEA and MRCA frameworks and in general administrative law. The SoP itself does not document enforcement avenues or appeal rights. Where an adjudicator applies the SoP and an adverse decision follows, remedies and review would depend on the primary legislation and the administrative law framework, not on any enforcement provision in the SoP.

Monitoring and update mechanism

• Section 11 contemplates that factors may refer to other Statements of Principles “as in force from time to time”. This implies continued monitoring and updating of SoPs by the Authority. The instrument does not specify enforcement mechanisms for ensuring decision‑makers use the most recent SoPs, but s11 creates an ongoing interaction between SoPs that decision‑makers must observe.

The instrument is expressly a SoP made under the VEA and is designed to be applied within the claims frameworks of both the VEA and the MRCA. It cross‑references external classification systems and other SoPs. Its legal interactions are manifest in its application clause, its definitions, and its cross‑reference rules.

Primary statutory relationships

• VEA: The instrument is made under subsection 196B(3) of the VEA (s3). It applies to claims to which VEA s120B applies (s5). Under the VEA framework, SoPs are medical findings that assist in determining whether a condition is service‑related. The instrument therefore binds or guides decision‑makers adjudicating claims under the VEA in assessing whether acute pancreatitis is connected to relevant service.

• MRCA: The instrument also applies to claims to which MRCA s339 applies (s5). The MRCA uses similar SoP mechanisms for determining service connection in the military rehabilitation and compensation context. This SoP therefore affects claim assessment under both statutory regimes.

Interaction with classification and medical standards

• ICD‑10‑AM: The SoP acknowledges that, while acute pancreatitis attracts ICD‑10‑AM code K85, the statutory meaning for this instrument is the clinical definition in s7(2). The instrument references the Tenth Edition of the Australian modification of ICD‑10‑AM with effective date 1 July 2017 for code identification (s7(3)-(4)). This means classification codes may inform or supplement evidence but do not supplant the SoP’s defined clinical meaning.

Cross‑references between SoPs

• Other Statements of Principles: Where a factor in s9 refers to an injury or disease covered by another SoP, s11 provides that the other SoP applies in accordance with its terms “as in force from time to time”. This links the instrument to the broader SoP ecosystem and makes its application contingent at points on the content of other SoPs. Decision‑makers and claimants must therefore consult other SoPs and be aware that amendments to those SoPs can change the applicability of particular factors here.

Dependence on primary legislation for remedies, appeals and decision processes

• The SoP does not itself provide entitlement, payment rules, or appeal mechanisms; those are governed by the VEA and MRCA. The instrument is evidence for determinations under those statutes, so its practical effects arise only within the decision and remedy processes they set out (s5).

No interaction with criminal law or administrative fines specified

• The SoP contains no provisions that interact directly with criminal or administrative sanctions; any such interactions would be governed by other laws. The instrument’s legal role is confined to its evidentiary function in determination of service connection.

Interaction with medical practice and record‑keeping obligations

• By specifying precise clinical criteria and time windows (for example, triglyceride thresholds, procedural and traumatic windows, and drug exposure timing), the SoP creates a de facto requirement for adequate medical documentation where claim evidence is to be compiled. Health providers and record custodians will therefore be indirectly affected because good record‑keeping becomes necessary to satisfy the factual predicates enumerated in the SoP.

Temporal scope and repeal of earlier SoP

• The instrument expressly repeals the earlier 2011 SoP for acute pancreatitis (s4). This means that for claims processed after the commencement date (s2), the 2020 instrument’s factors and definitions are the operative medical standard. The repeal indicates a legislative/administrative update to the medical findings, and interaction with previous decisions may require reference to transitional rules in the applicable claims legislation, although those transitional rules are not contained in the SoP itself.

This instrument is No. 6 of 2020 and is dated 28 February 2020, with commencement on 23 March 2020 (cover page and s2). It expressly repeals the prior Statement of Principles concerning acute pancreatitis No. 86 of 2011 (Federal Register of Legislation No. F2011L01444) made under subsection 196B(3) of the VEA (s4). The instrument is made under subsection 196B(3) of the VEA which authorises the Repatriation Medical Authority to determine SoPs (s3).

Recorded changes within the text

• Repeal: Section 4 is the only explicit repeal provision. It removes the 2011 acute pancreatitis SoP from the legal framework. The instrument itself does not provide transitional provisions or savings clauses; it simply states that the 2011 SoP is repealed.

• Commencement and dating: The instrument records its commencement date clearly in s2 (23 March 2020) and is dated 28 February 2020 on the instrument’s cover page.

No other amendments recorded within the instrument

• The instrument does not record subsequent amendments, revisions, or marginal notes about future changes. It does, however, anticipate interaction with other SoPs by expressly stating that factors referring to injuries or diseases covered by other SoPs will be governed by those other SoPs “as in force from time to time” (s11). This implicitly acknowledges that other SoPs may be amended after this instrument’s commencement and that such amendments could affect application of factors here.

Consequences of the repeal and replacement

• The repeal of the 2011 SoP means that, for claims falling within the instrument’s application (s5) after the commencement date, the 2020 SoP’s factors and definitions are applicable. The instrument itself does not set out transitional rules for claims made prior to commencement; any transitional or retrospective arrangements would be determined by the VEA and MRCA processes, or other administrative practice, none of which are contained in this instrument.

No in‑instrument history of prior amendments

• The instrument does not include a schedule of prior amendments beyond the express repeal of the 2011 instrument. There is no textual record here of amendments between 2011 and 2020, beyond replacement.

Authority and format

• The instrument is signed by the Chairperson of the Repatriation Medical Authority, with a common seal affixed (cover page). It follows the recurring administrative practice of the Authority of issuing numbered SoPs, with the instrument title identifying it as Statement of Principles concerning acute pancreatitis (Balance of Probabilities) (No. 6 of 2020).

Implication for practitioners monitoring SoPs

• Because s11 allows factors to draw on other SoPs “as in force from time to time”, changes to those other SoPs after 23 March 2020 may affect how this SoP is applied. Practitioners should therefore monitor not only this instrument’s text but also the current versions of any other SoPs to which it refers.

The instrument itself contains no record of litigation relating to its provisions, and it does not name any cases. It is a statutory administrative instrument setting out medical findings rather than adjudicating particular disputes. The text does not identify existing or concluded litigation brought against the Repatriation Medical Authority or concerning the 2020 Statement.

What the instrument shows about potential litigation risk

• The SoP establishes deterministic medical criteria to be applied by decision‑makers in the compensation claims context. Litigation that typically engages SoPs in practice arises from decisions under the VEA or MRCA where an adjudicator declines liability or entitlement despite a claimant’s reliance on an SoP. This instrument does not record such cases nor purport to alter procedural remedy routes in the VEA or MRCA. The instrument therefore does not provide a litigation history but it is designed to be used in claims that may later be challenged in administrative review or judicial proceedings under the VEA or MRCA regimes; those proceedings are not described here.

Absence of named cases or judicial interpretation in the text

• No court decisions, tribunal determinations, or judicial interpretations are cited or summarised in the instrument. It is autonomous medical guidance intended to be read and applied by adjudicators and clinicians. The instrument’s approach is statement of medical opinion, not a judicial pronouncement.

Consequences for litigators and advisers

• Advisers preparing claims or contesting decisions must rely on the text of the SoP and on the evidentiary record in each claim. Where factual disputes arise about whether a claimant met a numerical threshold (for example triglycerides >11.3 mmol/L), temporal window (for example trauma within seven days), or medical definition (for example biliary microlithiasis), those disputes are factual and would be addressed in the claim and any subsequent review or litigation under the primary legislation. The instrument itself does not preclude such litigation; it is an evidentiary tool within the statutory framework.

Monitoring case law

• Because this instrument may be applied in a wide range of individual claim contexts, legal practitioners should monitor administrative decisions and court outcomes under the VEA and MRCA that interpret or apply SoPs. The instrument does not list precedents and contains no litigation analysis; any legal interpretations will derive from future adjudicator or judicial decisions outside the instrument.

The instrument contains multiple technical and procedural features that can create traps or pitfalls for claimants, clinicians and decision‑makers if not carefully navigated. The following are concrete items to watch for, grounded in the instrument’s text.

1. “At least one” but must be related to relevant service (s9, s10(1))

• The SoP requires proof of at least one factor in s9. However, s10(1) insists that the factor must be related to the person’s relevant service. Meeting a medical threshold alone (for example triglycerides above 11.3 mmol/L) is insufficient if that exposure or condition cannot be tied to relevant service.

2. Strict temporal windows and thresholds

• Many factors are time‑limited and numeric. Examples: smoking cessation must have clinical onset within ten years of cessation (s9(1)); alcohol requires at least 420 grams per week averaged for ten years before onset (s9(2)); trauma and spinal cord injury must occur within seven days before clinical onset (s9(6)-(7)); certain procedures have 30‑day or seven‑day windows (s9(8)-(9)); drug‑related onset in s9(13) requires symptom development within 30 days and at least three days of therapy prior to onset. Failure to demonstrate the precise timing or threshold can defeat reliance on a factor.

3. Dual drug rules , class list vs individual association (s9(12)-(13))

• There are two approaches to drug causation: being treated with a drug or class from the specified list at the time of clinical onset (s9(12)), or proving an individual‑level association where onset is within 30 days of starting the drug, symptoms cease on stopping, there was absence of prior evidence, and treatment continued for at least three days prior to onset (s9(13)). Claimants must understand which route they can establish and assemble corresponding evidence.

4. Factor 9(26) limitation and the distinction between causation and aggravation (s9(26), s10(2))

• The inability to obtain appropriate clinical management (s9(26)) is available only in a narrow circumstance: the acute pancreatitis must have been suffered or contracted before or during relevant service but did not arise out of service, and the inability must materially contribute to or aggravate the condition (s10(2)). This is not a route to establish initial causation where the index event first occurred out of service. Practitioners must document chronology and causal link precisely.

5. Cross‑dependence on other SoPs (s11)

• Where a factor refers to an injury or disease covered by another SoP, the other SoP “as in force from time to time” applies. This creates dependence on the content and amendments of other SoPs, and potential uncertainty if those SoPs are updated. Claimants and advisers must check the current version of any referenced SoP when preparing evidence.

6. Definitions contain operational detail that changes application

• Examples: “pack‑years of cigarettes” is given a precise calculation in Schedule 1 (one pack‑year equals twenty tailor‑made cigarettes per day for a year or 7,300 cigarettes, one tailor‑made cigarette approximates one gram of tobacco) and translates into 7.3 kg of tobacco per pack‑year. BMI is defined as W/H2 (Schedule 1). These operational definitions can materially change whether a claimant meets a threshold.

7. Clinical measurement at “the time of the clinical onset”

• Several factors require evidence at the time of clinical onset (for example cholelithiasis, biliary sludge, hypertriglyceridaemia, hypercalcaemia, dialysis at time of onset). This requires contemporaneous records and not simply later or earlier results. Absence of labs or imaging at the relevant time may make it difficult to satisfy the SoP.

8. Broad specified lists that create different evidentiary obligations

• The specified lists in Schedule 1 are extensive (for example drugs, organisms, infestations, procedures, agents, snakes/scorpions). Where a claim relies on one of these items, the claimant must show the presence of the specific item on the list. For drug classes, the list is broad and includes many commonly used medicines, which may make it easier to locate a qualifying drug but also requires evidence of timing and association.

9. Death from acute pancreatitis includes contribution to terminal events (s7(5))

• The SoP defines death from acute pancreatitis to include death from a terminal event or condition that was contributed to by the person’s acute pancreatitis (s7(5)). This broadens the concept of death from acute pancreatitis but requires medical evidence that acute pancreatitis contributed to the terminal event identified in Schedule 1’s terminal event definitions.

10. No sanctions or procedural directions in the instrument

• The SoP does not set out claim processing steps, appeal routes, or transitional protections for the repeal of the 2011 instrument. Practitioners must rely on the VEA and MRCA for procedural matters and be mindful that the SoP is an evidentiary instrument only.

11. Measurements and units require conversion and careful documentation

• Alcohol consumption is expressed in grams per week and the instrument notes that calculation uses the Australian Standard of ten grams per standard alcoholic drink (s9(2) note). Claimants must convert reported drinking into gram‑equivalents and document sustained averages over a decade. Similarly, triglyceride thresholds are given in mmol/L and mg/dL; practitioners must ensure laboratory units are accurately converted and documented.

12. Obesity applies only to severe acute pancreatitis (s9(25))

• Being obese (BMI ≥ 30) is listed as a factor only for severe acute pancreatitis (s9(25) and Schedule 1). For non‑severe acute pancreatitis, obesity alone does not satisfy s9.

This section sets out practical, text‑grounded steps for claimants, clinicians, legal advisers and decision‑makers to assemble and present evidence consistent with this SoP’s requirements. All references below are to sections of the instrument and to Schedule 1 definitions.

1. Confirm the instrument’s applicability to the claim

• Check that the claim is one to which VEA s120B or MRCA s339 applies (s5). Confirm the instrument’s commencement date (23 March 2020) and that the claim falls within the operative period for this SoP (s2, s4).

2. Establish the medical diagnosis and date of clinical onset

• Obtain the clinical diagnosis of acute pancreatitis consistent with the instrument’s definition (an acute inflammatory condition due to autodigestion of pancreatic tissue) and document the clinical onset date (s7(2)). Collect hospital records, imaging reports, surgeon notes, and laboratory results showing raised pancreatic enzymes where available (s7(2) note).

3. Identify which s9 factor(s) are relied upon

• Review the list in s9 and Schedule 1 to select the most likely qualifying factor(s). Each factor has distinct evidentiary needs (for example substance exposure, lab thresholds, procedural timing).

4. Gather evidence tailored to the chosen factor(s)

• Smoking (s9(1), Schedule 1): Compile a detailed smoking history enabling calculation of pack‑years as defined in Schedule 1 (one pack‑year = 20 tailor‑made cigarettes/day for a calendar year = 7,300 cigarettes = 7.3 kg tobacco). If smoking ceased, document the cessation date to verify clinical onset occurred within ten years of cessation.

• Alcohol (s9(2)): Gather contemporaneous medical records, primary care notes, workplace medicals or other documentation demonstrating average alcohol consumption. Convert to grams per week using the note that one standard Australian drink equals ten grams of alcohol. Show sustained average of at least 420 grams per week for at least ten years before clinical onset.

• Cholelithiasis, biliary microlithiasis or sludge (s9(3)-(4), Schedule 1): Obtain ultrasound, CT, MRCP or intraoperative findings documenting gallstones, microlithiasis or biliary sludge at the time of clinical onset.

• Pancreatic outflow obstruction (s9(5), Schedule 1): Secure imaging or endoscopic reports demonstrating obstruction due to one of the listed disorders (for example tumours, choledochocele, foreign body, periampullary diverticula).

• Trauma and spinal cord injury (s9(6)-(7)): For trauma, obtain emergency department, surgical or ambulance records showing penetrating or major blunt trauma to the upper abdomen or back within seven days before onset. For spinal cord injury, obtain neurological and hospital records confirming injury and temporal relation.

• Procedures and ERCP/sphincter procedures (s9(8)-(9), Schedule 1): Obtain operation notes, endoscopy reports and procedure dates showing intra‑abdominal, intrathoracic, spinal surgery or upper GI endoscopy within the specified windows (30 days or seven days for ERCP/sphincter procedures).

• Dialysis/transplant (s9(10)-(11)): Collect nephrology records demonstrating peritoneal dialysis or haemodialysis at the time of clinical onset, or transplant records showing a prior solid organ transplant.

• Drugs (s9(12)-(13), Schedule 1): If relying on the class list, show that the person was taking a specified drug or a drug within a specified class at the time of clinical onset (s9(12)). If relying on individual causation (s9(13)), assemble documentation showing symptom onset within 30 days of commencing the drug, cessation of symptoms after stopping the drug, absence of evidence of pancreatitis prior to starting, and that the person had been on the drug for at least three days before onset.

• Diabetes, triglycerides, calcium (s9(14)-(16)): Provide endocrinology records showing diabetes mellitus at clinical onset; lab results with triglycerides above 11.3 mmol/L (or 1,000 mg/dL) at clinical onset; and serum calcium measurements showing hypercalcaemia at onset.

• Diseases, infections, infestations (s9(17), s9(19)-(21), Schedule 1): For listed diseases and organisms, provide serological, microbiology or clinical evidence documenting the condition at time of clinical onset and ensure the organism or disease is one of those specified in Schedule 1.

• Envenomation or toxic ingestion (s9(22)-(24), Schedule 1): Provide toxicology reports, hospital notes, or other definitive evidence of envenomation by a listed species or acute toxicity from a specified agent within seven days prior to onset.

• Severe acute pancreatitis and obesity (s9(25), Schedule 1): Where relying on obesity as a factor for severe acute pancreatitis, document hospitalisation for severe acute pancreatitis or death and provide accurate weight and height to calculate BMI ≥ 30.

• Inability to obtain appropriate clinical management (s9(26), s10(2)): Document the chronology to show acute pancreatitis was suffered or contracted before or during (but did not arise out of) relevant service, and produce evidence of denied, unavailable or inaccessible appropriate clinical management and an explanation of how that lack materially contributed to or aggravated the pancreatitis. This factor is constrained by s10(2) and requires precise chronological and causal evidence.

5. Establish relation to relevant service

• For each relied factor, assemble service records, personnel records, deployment logs, medical records from service time, or corroborative evidence to link the factor to the person’s relevant service as defined in Schedule 1 (eligible war service, defence service, or peacetime service under MRCA). Section 10(1) requires that the factor be related to relevant service.

6. Check cross‑references to other SoPs

• If a factor refers to an injury or disease covered by another SoP (s11), obtain and apply the current version of that other SoP. For example, if a factor depends on a condition that is itself governed by another SoP, follow that SoP’s terms “as in force from time to time”.

7. Document measurement units and conversions

• Ensure all lab results and exposure measurements are in or converted to the units used by the SoP (for example triglycerides in mmol/L and mg/dL; alcohol calculated in grams using the 10 g per standard drink standard noted in the instrument). Record conversion methodology.

8. Prepare medico‑legal statements that map facts to SoP text

• Obtain medico‑legal or treating clinician reports that explicitly map the claimant’s evidence to the specific subsections and definitions of the SoP. Reports should state which s9 factor(s) are being relied on, the evidence that supports each element (including dates and values), and an opinion about the relation to relevant service.

9. For adjudicators: apply definitions literally and check for contemporaneous evidence

• Decision‑makers should apply Schedule 1 definitions literally and give weight to contemporaneous lab, imaging and procedural records at the time of clinical onset. When the SoP requires measurements “at the time of the clinical onset”, adjudicators should prefer proximate records and treat later or retrospective evidence with caution.

10. Retain documentary trail for review

• Because the SoP itself does not set appeal procedures, but claims may be subject to review under the VEA and MRCA, preserve originals and certified copies of primary records: hospital charts, pathology reports, imaging, operation notes, pharmacy dispensing records, service records, and clinician statements.

11. Update reliance if other SoPs change

• If a factor depends on another SoP, monitor that SoP for amendments because s11 makes the application dependent on the other SoP “as in force from time to time”. Where an amendment to a referenced SoP occurs between claim lodgement and decision, advise the claimant and consider supplementary evidence addressing any new criteria.

12. Note the instrument’s evidentiary, not remedial, role

• Remember the SoP is a medical standard. For entitlement, payment and appeal questions, consult the VEA and MRCA and their internal procedures. This instrument supplies the medical linkage criteria necessary to prove connection between acute pancreatitis and relevant service per those statutes.

By following the above procedural checklist derived from the instrument’s text (particularly s5, s7, s8, s9, s10, s11 and Schedule 1), claimants and advisers can present a focused evidentiary case that matches the precise criteria the Repatriation Medical Authority has determined.
